		  long-term contracts for the procurement of certain liquid transportation fuels

		<section id="idB66DC308E3C14B64BFF639679CC8073A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Freedom Fuels Act of
			 2011</short-title></quote>.</text>
		</section><section id="idA5FA66D91B8C41EA8E597ECDFB4AC8EA" section-type="subsequent-section"><enum>2.</enum><header>Authority for
			 long-term contracts for procurement of certain liquid transportation fuels for
			 the Department of Defense</header>
			<subsection id="id6C71B130C5FE47B89E000B6EF0F20E31"><enum>(a)</enum><header>Authority</header><text>Subchapter
			 II of chapter 173 of title 10, United States Code, is amended by adding at the
			 end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="idFB618E4F2B3B482AB5839997E9F17E10" style="USC">
					<section id="id23E8C04BCBF740679EA90DEA9F3B53DD"><enum>2922h.</enum><header>Liquid
				fuels: contracts for procurement of certain transportation fuels</header>
						<subsection id="idD1B35F8422B443A5A1E2245899ACB6FB"><enum>(a)</enum><header>Authority To
				contract</header><text>The Secretary of Defense may enter into one or more
				contracts for the procurement of fuels described in subsection (b) for the
				Department of Defense.</text>
						</subsection><subsection id="idA9DD4A6C60994AECA681F97B3ECA8A9E"><enum>(b)</enum><header>Covered
				fuels</header><text>A fuel described in this subsection is a liquid
				transportation fuel, including jet fuel, that—</text>
							<paragraph id="id553EF00E53AA41ADB33658C727956E78"><enum>(1)</enum><text>meets the
				requirements of section 526 of the Energy Independence and Security Act of 2007
				(42 U.S.C. 17142);</text>
							</paragraph><paragraph id="idA2A0847A0BB648139FE2CC23E8E7F901"><enum>(2)</enum><text>uses a feedstock
				that is produced within a State; and</text>
							</paragraph><paragraph id="idAC551BE319494287AD2375CB3007B07B"><enum>(3)</enum><text>is refined,
				manufactured, or produced in a State.</text>
							</paragraph></subsection><subsection id="id8B3F310E8D0C43D6985F1BE027840651"><enum>(c)</enum><header>Period of
				contract</header><text>The period of a contract entered into under subsection
				(a) may not exceed 10 years.</text>
						</subsection><subsection id="id3D97930F2FE247F78832DE2B4EFF5E8F"><enum>(d)</enum><header>Prohibition on
				options</header><text>A contract under subsection (a) may not include any
				options that would extend the overall period of the contract beyond 10
				years.</text>
						</subsection><subsection id="id978B281184CA49C08DD0ED82878AF3BC"><enum>(e)</enum><header>Reports on
				contracts</header><text>Not later than three years after entering into a
				contract under subsection (a), the Secretary of Defense shall submit to
				Congress a report on the contract. The report shall include the
				following:</text>
							<paragraph id="id9833278211184C039EF40131E5F4373D"><enum>(1)</enum><text>A description of
				the performance of the contract, including an assessment whether the contract
				is yielding savings to the Department when compared with the procurement of
				fuels that meet the requirements referred to in subsection (b) but are not
				procured under the authority in subsection (a).</text>
							</paragraph><paragraph id="id55774C22685B477E890196246109CCAE"><enum>(2)</enum><text>In consultation
				with the Secretary of Energy, an assessment whether the contract has stimulated
				the development of domestic energy infrastructure, and an assessment whether
				lengthening the maximum authorized period of contract in subsection (c) would
				further stimulate the development of domestic energy infrastructure.</text>
							</paragraph><paragraph id="idDEDB56DBC00D44BDA9836A8B5681661B"><enum>(3)</enum><text>An assessment
				whether the expanded use of contracts as authorized by subsection (a) have
				reduced, or can reduce, the vulnerability of the Department to disruptions in
				the global oil supply, and an assessment whether lengthening the maximum
				authorized period of contract in subsection (c), could further reduce the
				vulnerability of the Department to such disruptions.</text>
							</paragraph></subsection><subsection id="idCF40CF2D6D4C4DDCA7373342A7A07BB9"><enum>(f)</enum><header>State
				defined</header><text>In this section, the term <term>State</term>—</text>
							<paragraph id="idFE75D3B0EA7749B8B7A9674CF9C4DD16"><enum>(1)</enum><text>means each of the
				several States; and</text>
							</paragraph><paragraph id="id8B84EA3CB4C94942A9C95EDB19B7F9EE"><enum>(2)</enum><text>includes any land
				under the jurisdiction of an Indian tribe located in any of the several
				States.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id7FD49870398B4B0EAC5CB76FF58CAE0D"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of subchapter II
			 of chapter 173 of such title is amended by adding at the end the following new
			 item:</text>
