		<official-title>To provide for reforming and consolidating agencies of
		  the Federal Government to improve efficiency and
		  effectiveness.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Reforming and Consolidating
			 Government Act of 2012</short-title></quote>.</text>
		</section><section id="id7e5596289acc4fffa096ff23018fc228"><enum>2.</enum><header>Providing
			 consolidation authority</header>
			<subsection id="id56df21bee29f4f83bb489b1cb7d72955"><enum>(a)</enum><header>Defining an
			 efficiency-Enhancing plan</header><text display-inline="yes-display-inline">Section 902 of title 5, United States Code,
			 is amended—</text>
				<paragraph id="idf45f1e7261284c4aa5c5077dbb146436"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="id639c82df38f34651b90b8897f56ee24b"><enum>(2)</enum><text>in paragraph (3),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="id665babf131c3484fb9f098f2de2bc870"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id20E2B40C79164E368AF3D8F4AFE9CB88" style="OLC">
						<paragraph id="id170032f7044545cc9ac17d7d0147e9c6"><enum>(4)</enum><text><term>efficiency-enhancing
				plan</term> means a reorganization plan that the Director of the Office of
				Management and Budget determines will result in, or is likely to result
				in—</text>
							<subparagraph id="ide76909003ceb4f549f459b52f6dc5612"><enum>(A)</enum><text>a decrease in the
				number of agencies; or</text>
							</subparagraph><subparagraph id="id26365562d3324b90a40fb29a603db5a4"><enum>(B)</enum><text>cost savings in
				performing the functions that are the subject of that
				plan.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idae665c938ba34d869bd9e3b9e75cc342"><enum>(b)</enum><header>Modernizing
			 reorganization authority</header><text>Section 905(a) of title 5, United States
			 Code, is amended—</text>
				<paragraph id="idd65d763809b7401e813087a62ad3b286"><enum>(1)</enum><text>by amending
			 paragraph (1) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id658D08C6C6F34242A50DF24517CD026A" style="OLC">
						<paragraph id="id6c262597a2eb48758c11436a90ba1859"><enum>(1)</enum><text>abolishing or
				transferring an independent regulatory agency, or all the functions thereof, or
				consolidating 2 or more independent regulatory agencies, or all the functions
				thereof;</text>
						</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id610492fb190044719ab1e6a82897eaa8"><enum>(2)</enum><text>by striking
			 paragraph (5); and</text>
				</paragraph><paragraph id="idBA1E86F888E2492BAB725FCF67368AA4"><enum>(3)</enum><text>by redesignating
			 paragraphs (6) and (7) as paragraphs (5) and (6), respectively.</text>
				</paragraph></subsection></section><section id="id5b86d242649241248ff71a5ce7d223b9"><enum>3.</enum><header>Duration and
			 scope of authority</header>
			<subsection id="idbf0d9b3d42bd47708d764337dfa04a27"><enum>(a)</enum><header>In
			 general</header><text>Section 905(b) of title 5, United States Code, is amended
			 by striking <quote>if the plan</quote> and all that follows and inserting the
			 following: “if the plan is—</text>
				<quoted-block display-inline="no-display-inline" id="idBEF7F4BCB64C48A2B8EC9B96F4B639C8" style="OLC">
					<paragraph id="id5BAC6F6AE0754F71BD5B3E1514C1BCDD"><enum>(1)</enum><text>transmitted to
				Congress (in accordance with section 903(b)) on or before the date that is 2
				years after the date of enactment of the <short-title>Reforming and Consolidating Government Act of
				2012</short-title>; and</text>
					</paragraph><paragraph id="idB1CC1E54068C4984A936C3327ABCC8FE"><enum>(2)</enum><text>an
				efficiency-enhancing
				plan.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE3FAD17FE41E4969B0D6AB7EF69CE033"><enum>(b)</enum><header>Exercise of
			 rulemaking power</header><text>Section 908(1) of title 5, United States Code,
			 is amended by striking <quote>December 31, 1984</quote> and inserting
			 <quote>the date that is 2 years after the date of enactment of the
			 <short-title>Reforming and Consolidating Government Act of
			 2012</short-title></quote>.</text>
			</subsection><subsection id="idF132402DAB244868B0430412D8639748"><enum>(c)</enum><header>Terms of
			 resolution</header><text>Section 909 of title 5, United States Code, is amended
			 by striking <quote>the matter after the resolving clause</quote> and all that
			 follows through <quote>such modifications</quote> and inserting <quote>the
			 matter after the resolving clause of which is as follows: <quote>That Congress
			 approves the reorganization plan numbered _____ transmitted to Congress by the
			 President on ___________.</quote>, and includes such
			 modifications</quote>.</text>
			</subsection></section><section id="idb0dcb953c9bd43aabec2905b16d5f09b"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment
			 made by this Act, or the application of such provision or amendment to any
			 person or circumstance is held to be unconstitutional, the remainder of this
			 Act, the amendments made by this Act, and the application of the provisions of
			 such to any person or circumstance shall not be affected thereby.</text>
