		<official-title>To require the lender or servicer of a home mortgage,
		  upon a request by the homeowner for a short sale, to make a prompt decision
		  whether to allow the sale.</official-title>

		<section id="H40D489E5F7104E5FB367EB67CA54C89E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Prompt Notification of Short Sales
			 Act</short-title></quote>.</text>
		</section><section id="HE851EF8ABF5645B581934D652D684B37"><enum>2.</enum><header>Prompt decision
			 regarding short sale</header>
			<subsection id="H8F52935D40684C4EB266467CB902B926"><enum>(a)</enum><header>Requirement for
			 prompt decision</header>
				<paragraph id="idC7B4B0814E204644BD588B3D05629FE0"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="id33B8493228224B819A39FDCBBC528CCA"><enum>(A)</enum><header>Written
			 response to mortgagor requests required</header>
						<clause id="id51F426D264F04431B1FAA79FD017EF40"><enum>(i)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each servicer shall
			 respond in writing to a mortgagor of a residential mortgage loan who has
			 submitted a written request that meets the requirements of paragraph (2), not
			 later than the end of the 75-calendar day period beginning on the date of
			 receipt of such request, subject to subparagraphs (B) and (C).</text>
						</clause><clause id="id6E98B6EB8D4A498C8830CBB21388B393"><enum>(ii)</enum><header>Applicability</header><text>Clause
			 (i) shall apply, except as provided in subsection (b), and notwithstanding any
			 other provision of law or of any contract, including a contract between a
			 servicer of a residential mortgage loan and a securitization vehicle or other
			 investment vehicle.</text>
						</clause></subparagraph><subparagraph id="id9182E76A92E145B8B8EEB5EF7EDF88C5"><enum>(B)</enum><header>Content</header><text display-inline="yes-display-inline">A written response by a servicer under
			 subparagraph (A) shall specify—</text>
						<clause id="id67B4325CAFB04C9FAE2A936D75416079"><enum>(i)</enum><text display-inline="yes-display-inline">a decision on whether such request has been
			 denied, approved, or that such request has been approved subject to specified
			 changes; or</text>
						</clause><clause id="id1C0805578A4E4053A479FB85852690A4"><enum>(ii)</enum><text display-inline="yes-display-inline">that additional time is required, in which
			 case the servicer shall provide a new decision date.</text>
						</clause></subparagraph><subparagraph commented="no" id="id6C55ADEBE15945A3A050CC9E5552143A"><enum>(C)</enum><header>Single
			 extension of new decision date authorized</header><text display-inline="yes-display-inline">A servicer may, upon written notice to the
			 mortgagor, extend a new decision date provided under subparagraph (B)(ii) one
			 single time, for a period of not longer than 21 additional calendar
			 days.</text>
					</subparagraph></paragraph><paragraph id="idB514247D3649436F8A03372F63A0C204"><enum>(2)</enum><header>Mortgagor
			 submission</header><text display-inline="yes-display-inline">Paragraph (1)
			 shall apply in any case in which the mortgagor under a residential mortgage
			 loan submits to the servicer thereof—</text>
					<subparagraph id="id12C50E2C8BE6421EBCD65028B8780DF9"><enum>(A)</enum><text display-inline="yes-display-inline">a written offer for a short sale of the
			 dwelling or residential real property that is subject to the mortgage, deed of
			 trust, or other security interest that secures the mortgage loan; and</text>
					</subparagraph><subparagraph id="idFBEAA0AE3691401D80F405DDA18FAFF4"><enum>(B)</enum><text display-inline="yes-display-inline">all information required by the servicer in
			 connection with such a request (including a copy of an executed contract
			 between the owner of the dwelling or property and the prospective buyer that is
			 subject to approval by the servicer).</text>
					</subparagraph></paragraph><paragraph id="id821BE87F85144657947D7F4AA4622E7F"><enum>(3)</enum><header>Civil actions
			 authorized</header><text display-inline="yes-display-inline">An aggrieved
			 individual may bring an action in a court of competent jurisdiction, asserting
			 a violation of this Act. Aggrieved individuals may be awarded all appropriate
			 relief, including equitable relief, and a monetary award of $1,000 per
			 violation, plus reasonable attorneys’ fees, or such higher amount as may be
			 appropriate in the case of an established pattern or practice of such
			 failures.</text>
				</paragraph></subsection><subsection id="H2E11D1B3B08842959BBDB2C4C70FDC6D"><enum>(b)</enum><header>Inapplicability
			 to certain existing mortgages</header><text>Subsection (a) shall not apply with
			 respect to any residential mortgage with respect to which the mortgagor and the
			 mortgagee or servicer have entered into a written agreement before the date of
			 enactment of this Act explicitly providing a procedure or terms for approval of
			 a short sale.</text>
			</subsection><subsection display-inline="no-display-inline" id="H65526057842743EF8114650BF61BB95E"><enum>(c)</enum><header>Treatment of
			 other time limits</header><text display-inline="yes-display-inline">This
			 section may not be construed to preempt, annul, or otherwise affect any other
			 provision of law or of any contract or program that provides a shorter period
			 than is provided under subsection (a) for a decision by the servicer of a
			 residential mortgage loan regarding a short sale of the dwelling or residential
			 real property that is subject to the mortgage, deed or trust, or other security
			 interest that secures the mortgage loan.</text>
			</subsection><subsection id="H2E804B5AD5CE4138A3675BB4DF7C202B"><enum>(d)</enum><header>Definitions</header><text>For
			 purposes of this Act, the following definitions shall apply:</text>
				<paragraph id="HB43C51A80A0A40BF98BD29BE24D709FF"><enum>(1)</enum><header>Residential
			 mortgage loan</header><text display-inline="yes-display-inline">The term
			 <term>residential mortgage loan</term> means any consumer credit transaction
			 that is secured by a mortgage, deed of trust, or other equivalent consensual
			 security interest on a dwelling or on residential real property that includes a
			 dwelling, other than a consumer credit transaction under an open end credit
			 plan or an extension of credit relating to a plan described in section 101(53D)
			 of title 11, United States Code.</text>
				</paragraph><paragraph id="H3558205A31094EFB93CD3A1B3EB8613B"><enum>(2)</enum><header>Securitization
			 vehicle</header><text>The term <term>securitization vehicle</term> means a
			 trust, special purpose entity, or other legal structure that is used to
			 facilitate the issuing of securities, participation certificates, or similar
			 instruments backed by or referring to a pool of assets that includes
			 residential mortgage loans (or instruments that are related to residential
			 mortgage loans, such as credit-linked notes).</text>
				</paragraph><paragraph id="H5A2EF868AFED41E5BA1ABFF3EFFC8BD6"><enum>(3)</enum><header>Servicer</header><text>The
			 term <term>servicer</term> has the same meaning as in section 129A, except that
			 such term includes a person who makes or holds a residential mortgage loan
			 (including a pool of residential mortgage loans), if such person also services
			 the loan.</text>
				</paragraph><paragraph id="H4F6807B7101648E58E18603623DDE737"><enum>(4)</enum><header>Short
			 sale</header><text display-inline="yes-display-inline">The term <term>short
			 sale</term> means the sale of the dwelling or residential real property that is
			 subject to the mortgage, deed or trust, or other security interest that secures
			 a residential mortgage loan that—</text>
					<subparagraph id="HF21AD384F51D455AACC7F0C0F9C457DD"><enum>(A)</enum><text>will result in
			 proceeds in an amount that is less than the remaining amount due under the
			 mortgage loan; and</text>
					</subparagraph><subparagraph id="H136EE736FD6F4A78A9C21AFA260B95E0"><enum>(B)</enum><text>requires
			 authorization by the se­cu­ri­ti­za­tion vehicle or other investment vehicle or
			 holder of the mortgage loan, or the servicer acting on behalf of such a vehicle
			 or holder.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
