		  detained by the United States at Naval Station, Guantanamo Bay, Cuba, and

		<section id="H73F74730CA764A1191B2BE64E09A25BE" section-type="section-one"><enum>1.</enum><header>Prohibition on use of funds
			 to transfer individuals detained at Guantanamo Bay, Cuba, and certain other
			 enemy belligerents to the United States</header>
			<subsection id="H5D175119F3C34D84B0976F73ADE5485E"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">None of the funds appropriated or otherwise
			 made available to any Federal department or agency may be used to transfer any
			 individual described in subsection (b) to the United States.</text>
			</subsection><subsection id="HBBB091099E00474CA3B5E9315754D19C"><enum>(b)</enum><header>Individual
			 described</header><text display-inline="yes-display-inline">An individual
			 described in this subsection is any individual who is—</text>
				<paragraph id="H05089DA590CF4E22A4A1DE8B224EED01"><enum>(1)</enum><text display-inline="yes-display-inline">detained by the United States at Naval
			 Station, Guantanamo Bay, Cuba; or</text>
				</paragraph><paragraph id="HA9C2D5F794374E1F8D302B33C5C75CDC"><enum>(2)</enum><text display-inline="yes-display-inline">a foreign national who is—</text>
					<subparagraph id="H09BCA9387C2B45CFA1E8E89B825EE398"><enum>(A)</enum><text display-inline="yes-display-inline">captured or detained outside the United
			 States as an enemy belligerent; and</text>
					</subparagraph><subparagraph id="H8154CF5FA8454121BA43D8EA6B07791A"><enum>(B)</enum><text>in the custody or
			 under the effective control of the Department of Defense.</text>
					</subparagraph></paragraph></subsection><subsection id="HA3CD2FC18CE14D1D8C408957E1E4930C"><enum>(c)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
				<paragraph id="H474A3CC9F7A6475495BD2F7DF386B6B4"><enum>(1)</enum><text>The term
			 <quote>foreign national</quote> means an individual who is not a citizen or
			 national of the United States.</text>
				</paragraph><paragraph id="H77C7CE8406554E148442AF007C085954"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>enemy belligerent</quote>
			 includes a privileged belligerent and an unprivileged enemy belligerent, as
			 such terms are defined by section 948a of title 10, United States Code.</text>
