		<official-title>To amend the Balanced Budget and Emergency Deficit
		  Control Act of 1985 to modify the discretionary spending limits to take into
		  account savings resulting from the reduction in the number of Federal employees
		  and extending the pay freeze for Federal employees.</official-title>

		<section id="H1B166A388F144D1AB759A492569CF21C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Down Payment to Protect National
			 Security Act of 2012</short-title></quote>.</text>
		</section><section id="HD759B43BE8B946A1BB8C7DDC9F79F2B9" section-type="subsequent-section"><enum>2.</enum><header>Reduction in the
			 number of Federal employees</header>
			<subsection id="HCB9F730AB06E4FC1BA6D85F153CACFA6"><enum>(a)</enum><header>Definition</header><text>In
			 this section, the term <term>agency</term> has the meaning given the term
			 <term>Executive agency</term> under section 105 of title 5, United States
			 Code.</text>
			</subsection><subsection id="H45DBF370234C4720985D85ED72AB82A3"><enum>(b)</enum><header>Determination of
			 number of employees</header><text display-inline="yes-display-inline">Not later
			 than 60 days after the date of enactment of this Act, the Director of the
			 Office of Management and Budget shall determine the number of full-time
			 employees employed in each agency. The head of each agency shall cooperate with
			 the Director of the Office of Management and Budget in making the
			 determinations.</text>
			</subsection><subsection id="HAED4193051F248FFBD7624757AB651E9"><enum>(c)</enum><header>Replacement hire
			 rate</header>
				<paragraph id="H669C21B6912F41BF9B53AB0E489B2D85"><enum>(1)</enum><header>In
			 general</header><text>During the period described under paragraph (2), the head
			 of each agency may hire no more than 2 employees in that agency for every 3
			 employees who leave employment in that agency.</text>
				</paragraph><paragraph id="H765E4E8BBA5344F9886412F4FB65C08F"><enum>(2)</enum><header>Period of
			 replacement hire rate</header><text>Paragraph (1) shall apply to each agency
			 during the period beginning 60 days after the date of enactment of this Act
			 through the date on which the Director of the Office of Management and Budget
			 makes a determination that the number of full-time employees employed in that
			 agency is 5 percent less than the number of full-time employees employed in
			 that agency determined under subsection (a).</text>
				</paragraph></subsection><subsection id="HB85A72DCA5E5486889BE61A4F52CC0AB"><enum>(d)</enum><header>Waivers</header><text>This
			 section may be waived upon a determination by the President that—</text>
				<paragraph id="H0A3FBC42DAE942B49F1F60890B20CB13"><enum>(1)</enum><text>the existence of a
			 state of war or other national security concern so requires; or</text>
				</paragraph><paragraph id="H22857A8676BD4AAA9C13D3E4ABAC65EC"><enum>(2)</enum><text>the existence of
			 an extraordinary emergency threatening life, health, public safety, property,
			 or the environment so requires.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB01010996EAC4443A5ACF8E79893BB44"><enum>3.</enum><header>Extension of pay
			 freeze for Federal employees</header>
			<subsection commented="no" display-inline="no-display-inline" id="id8E70B7212CA9449B962718831E9463B7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 147 of the
			 Continuing Appropriations Act, 2011 (Public Law 111–242; 5 U.S.C. 5303 note) is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H7315E838B0194A7CB1963580A7AB99E5"><enum>(1)</enum><text>in subsection
			 (b)(1), by striking <quote>December 31, 2012</quote> and inserting <quote>June
			 30, 2014</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE47CE0DC07FE48758195AC41DCB2D5F9"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c), by striking
			 <quote>December 31, 2012</quote> and inserting <quote>June 30,
			 2014</quote>.</text>
				</paragraph></subsection><subsection id="H8988595F78114DC68EEAED009D8EFCBE"><enum>(b)</enum><header>Clarification
			 that freeze applies to Members of Congress</header><text>Notwithstanding any
			 other provision of law, no adjustment shall be made under section 601(a) of the
			 Legislative Reorganization Act of 1946 (2 U.S.C. 31) (relating to cost of
			 living adjustments for Members of Congress) during the period beginning on the
			 first day of the first pay period beginning on or after February 1, 2013 and
			 ending on June 30, 2014.</text>
			</subsection></section><section id="H96873DBB7E964FC482D3C336BC7C52E8"><enum>4.</enum><header>Reduction of
			 revised discretionary spending limits to achieve savings from Federal employee
			 provisions</header><text display-inline="no-display-inline">Paragraph (2) of
			 section 251A of the Balanced Budget and Emergency Deficit Control Act of 1985
			 (2 U.S.C. 901a) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H408641CF25734DF8B0CCECE9BF2F4D88" style="OLC">
				<paragraph id="H2C03204E065E4796A98FF49AB50CF7DC"><enum>(2)</enum><header>Revised
				discretionary spending limits</header><text display-inline="yes-display-inline">The discretionary spending limits for
				fiscal years 2013 through 2021 under section 251(c) shall be replaced with the
				following:</text>
					<subparagraph id="HDE36C621438E40AB89F62679267DD630"><enum>(A)</enum><text display-inline="yes-display-inline">For fiscal year 2013—</text>
						<clause id="HE8C6DB98DDAD49DB82CEBAB8D71118AD"><enum>(i)</enum><text display-inline="yes-display-inline">for the revised security category,
				$546,000,000,000 in budget authority; and</text>
						</clause><clause id="HE7EAF553F7E44969A6F20D72A526DF87"><enum>(ii)</enum><text display-inline="yes-display-inline">for the revised nonsecurity category,
				$501,000,000,000 in budget authority.</text>
						</clause></subparagraph><subparagraph id="H4B7B20579E7B46CCB3B570B0F1A38107"><enum>(B)</enum><text>For fiscal year
				2014—</text>
						<clause id="HB5CBB1DFD7B64327BA3A373FAC96D7B4"><enum>(i)</enum><text display-inline="yes-display-inline">for the revised security category,
				$551,000,000,000 in budget authority; and</text>
						</clause><clause id="H0D1AAB30B0EC4DF49CE397559F11744A"><enum>(ii)</enum><text display-inline="yes-display-inline">for the revised nonsecurity category,
				$500,000,000,000 in budget authority.</text>
						</clause></subparagraph><subparagraph id="H49D3B2F508A64BDF8DD590332D536676"><enum>(C)</enum><text>For fiscal year
				2015—</text>
						<clause id="H2C4659DD132F41E69770E437B165EE46"><enum>(i)</enum><text display-inline="yes-display-inline">for the revised security category,
				$560,000,000,000 in budget authority; and</text>

						</clause></subparagraph><subparagraph id="H585232BA35AF481FB8CFE508618EED96"><enum>(D)</enum><text>For fiscal year
				2016—</text>

						</clause></subparagraph><subparagraph id="H50A27A2CE3784060884CCDC3B70E37BC"><enum>(E)</enum><text>For fiscal year
				2017—</text>
						<clause id="H32D103A2CDB240549F2A96C9DA915303"><enum>(i)</enum><text>for the revised
				security category, $584,000,000,000 in budget authority; and</text>

						</clause></subparagraph><subparagraph id="H150DF51F21304A9A846B7C6F0D97BD38"><enum>(F)</enum><text>For fiscal year
				2018—</text>

			 901a) is amended—</text>
