		<official-title display="yes">To allow a State or local government to
		  construct levees on certain properties otherwise designated as open space
		  lands.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="id959B12FB93C64D8587F01821841A8105" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Levees</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDad88ad4448c740e7b4b09c44a1aab0a3"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idD3F3EF9416C14806A4ABAB0299666E9D"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Administrator</term> means
			 the Administrator of the Federal Emergency Management Agency; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4F8BB20AB568456586E134FB02B422CF"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered hazard mitigation
			 land</term> means land—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idCB7C54701C2944B785AA22CCD71FA8FD"><enum>(A)</enum><text display-inline="yes-display-inline">acquired and deed restricted under section
			 404(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act
			 (42 U.S.C. 5170c(b)) before, on, or after the date of enactment of this Act;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5156127B9D2E4E1DB8FACD3D777EED5D"><enum>(B)</enum><text display-inline="yes-display-inline">that is located—</text>
						<clause commented="no" display-inline="no-display-inline" id="id5533D648C28743D091CF760C4704440F"><enum>(i)</enum><text display-inline="yes-display-inline">in North Dakota; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id2DB74D4DB7D94D57B152CD9A492C2480"><enum>(ii)</enum><text display-inline="yes-display-inline">in a community that—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id5B85BA894D794725839CDC310B3B4316"><enum>(I)</enum><text display-inline="yes-display-inline">is participating in the National Flood
			 Insurance Program on the date on which a State, local, or tribal government
			 submits an application requesting to construct a permanent flood risk reduction
			 levee under subsection (b); and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id869D2920B18F4A7CB23485D453377F02"><enum>(II)</enum><text display-inline="yes-display-inline">certifies to the Administrator and the
			 Chief of Engineers that the community will continue to participate in the
			 National Flood Insurance Program.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBE9BB022CD71424BB9AC636C6EE18C87"><enum>(b)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Notwithstanding clause (i) or (ii) of
			 section 404(b)(2)(B) of the Robert T. Stafford Disaster Relief and Emergency
			 Assistance Act (42 U.S.C. 5170c(b)(2)(B)), the Administrator shall approve the
			 construction of a permanent flood risk reduction levee by a State, local, or
			 tribal government on covered hazard mitigation land if the Administrator and
			 the Chief of Engineers determine, through a process established by the
			 Administrator and Chief of Engineers and funded entirely by the State, local,
			 or tribal government seeking to construct the proposed levee, that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idDFE33EB733994B669D6D1F4AE7CCD3F6"><enum>(1)</enum><text display-inline="yes-display-inline">construction of the proposed permanent
			 flood risk reduction levee would more effectively mitigate against flooding
			 risk than an open floodplain or other flood risk reduction measures;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc10a206f82fe4d0eace317fdc700221c"><enum>(2)</enum><text display-inline="yes-display-inline">the proposed permanent flood risk reduction
			 levee complies with Federal, State, and local requirements, including
			 mitigation of adverse impacts and implementation of floodplain management
			 requirements, which shall include an evaluation of whether the construction,
			 operation, and maintenance of the proposed levee would continue to meet best
			 available industry standards and practices, would be the most cost-effective
			 measure to protect against the assessed flood risk and minimizes future costs
			 to the federal government;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa3ce571dc6a749aa898b305193eb6cac"><enum>(3)</enum><text display-inline="yes-display-inline">the State, local, or tribal government
			 seeking to construct the proposed levee has provided an adequate maintenance
			 plan that documents the procedures the State, local, or tribal government will
			 use to ensure that the stability, height, and overall integrity of the proposed
			 levee and the structure and systems of the proposed levee are maintained,
			 including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDf1e8b77a8e4c4b289304400b79429cf2"><enum>(A)</enum><text display-inline="yes-display-inline">specifying the maintenance activities to be
			 performed;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb38723cfc5f44131ad0d20590bce603a"><enum>(B)</enum><text display-inline="yes-display-inline">specifying the frequency with which
			 maintenance activities will be performed;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaea24ebc1c04453bacc022373d238ad2"><enum>(C)</enum><text display-inline="yes-display-inline">specifying the person responsible for
			 performing each maintenance activity (by name or title);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb61326a8ae13486ab9f78aab42f70bf8"><enum>(D)</enum><text display-inline="yes-display-inline">detailing the plan for financing the
			 maintenance of the levee; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6388D4F8C7CD4084B1EBB423C30D9D13"><enum>(E)</enum><text display-inline="yes-display-inline">documenting the ability of the State,
			 local, or tribal government to finance the maintenance of the levee.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id261DB8F70BE94C9AAFCE27E3FF5A1253"><enum>(c)</enum><header display-inline="yes-display-inline">Maintenance certification</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2C40636039E04BBBB0857A20A00DAF40"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State, local, or tribal government that
			 constructs a permanent flood risk reduction levee under subsection (b) shall
			 submit to the Administrator and the Chief of Engineers an annual certification
			 indicating whether the State, local, or tribal government is in compliance with
			 the maintenance plan provided under subsection (b)(3).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa93c041c816144ad9ac2c647f492ffcc"><enum>(2)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">The Chief of Engineers shall review a
			 certification submitted under paragraph (1) and determine whether the State,
			 local, or tribal government has complied with the maintenance plan.</text>
				</paragraph></subsection></section></legis-body>
