		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Older Americans Act Amendments of
			 2012</short-title></quote>.</text>
		</section><section id="idB23716DD7D7F40E8BBAE4FFD63330A34"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="idb970c169baf848afa06e07d00323d460"><enum>(1)</enum><text>Older adults are
			 the fastest growing segment of the Nation’s population, in the Nation’s
			 history.</text>
			</paragraph><paragraph id="idfa1956151eeb41c28ecc31a719f529db"><enum>(2)</enum><text>Every day, 10,000
			 Baby Boomers turn 65.</text>
			</paragraph><paragraph id="id4d735966321b478eb762a86211c85187"><enum>(3)</enum><text>One in every 5 of
			 those individuals age 65 and older survives on an average of $7,500 a
			 year.</text>
			</paragraph><paragraph id="id0c141ee3f9af43e68b83691629be0277"><enum>(4)</enum><text>Older adults
			 haven’t seen a cost of living adjustment in Federal benefits, including
			 assistance under the Social Security Act, in more than 2 years and will only
			 see a very slight cost of living adjustment in those benefits for this fiscal
			 year.</text>
			</paragraph><paragraph id="id47fbe5ca33b24fb4b5400645492e9059"><enum>(5)</enum><text>Federal funding
			 to support older adults and their caregivers has not kept pace with
			 inflation.</text>
			</paragraph><paragraph id="ide6d18b756bf045078a8f3febebfc9bb0"><enum>(6)</enum><text>Only 7 percent of
			 individuals who are food insecure are getting a home-delivered meal.</text>
			</paragraph><paragraph id="id333897d7d61e41fba77506a53f14f7d7"><enum>(7)</enum><text>The cost of
			 staying in a nursing home is averaging over $77,000 per year.</text>
			</paragraph><paragraph id="id97521b48c3df45cfb4e7c9482a917190"><enum>(8)</enum><text>The Medicaid
			 program is paying for the majority of nursing home care.</text>
			</paragraph><paragraph id="idcf2eb981b32f479d8b7945c364bdb2fb"><enum>(9)</enum><text>The number of
			 elder abuse and neglect cases is soaring.</text>
			</paragraph><paragraph id="id11c2583d476440548d0c9212a1b9dbab"><enum>(10)</enum><text>States are
			 cutting budgets for Medicaid programs, and the cuts sometimes result in nursing
			 homes dropping older adults off at homeless shelters.</text>
			</paragraph><paragraph id="idf2e37f7e44e74dbc83a37bbce9741903"><enum>(11)</enum><text>By making
			 significant improvements through the Older Americans Act Amendments of 2012, it
			 is possible to improve the lives of millions of older adults, and ensure that
			 they receive all of the supports and services that they need to stay healthy
			 and active in their homes and communities.</text>
			</paragraph></section><title id="id0CD1251771F2416C88CD2BC22B500875"><enum>I</enum><header>Declaration of
			 objectives; definitions</header>
			<section id="id3E672AA6BB1D4039B35B334CF7D6C267"><enum>101.</enum><header>Declaration of
			 objectives</header><text display-inline="no-display-inline">Section 101 of the
			 Older Americans Act of 1965 (42 U.S.C. 3001) is amended by striking paragraph
			 (1) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA75BE44A9F5B4156AB1A99C17CEA02C9" style="OLC">
					<paragraph id="idEBCC734AC99A4A22B5BCD62FC195E825"><enum>(1)</enum><text>Economic security
				in later life in accordance with the American standard of
				living.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id978501E4A06344F8BEC261825935B1C8"><enum>102.</enum><header>Definitions</header>
				<subsection id="idA8EA9C4A52BE4E6C9BCFF9A31916DC1A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 102 of the
			 Older Americans Act of 1965 (42 U.S.C. 3002) is amended—</text>
					<paragraph id="id2BEDAEB27E02447A8CDD41BFCF0B796D"><enum>(1)</enum><text>in paragraph
			 (14), by striking the last sentence;</text>
					</paragraph><paragraph id="id713B9B7355874B2CB0989D40ABFEC317"><enum>(2)</enum><text>by redesignating
			 paragraphs (15) through (54) as paragraphs (16) through (55),
			 respectively;</text>
					</paragraph><paragraph id="idD2ED723339A849668BA447E89BE25B39"><enum>(3)</enum><text>by inserting
			 after paragraph (14) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idFBC90B20724D41ECB0D5FE122BC0813D" style="OLC">
							<paragraph id="id4A8C11953F4E4442BD7FF0968AA82992"><enum>(15)</enum><text>The term
				<term>economic security</term> means the situation of having the income
				necessary to pay for housing, health care, transportation, food, long-term
				care, and goods and services to meet other basic
				needs.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id736117BE194C4D909E72673D41FD1285"><enum>(4)</enum><text>in paragraph
			 (24), as redesignated by paragraph (2) of this subsection, by striking
			 <quote>at or below the poverty line.</quote> and inserting <quote>that is not
			 more than 200 percent of the poverty line.</quote>;</text>
					</paragraph><paragraph id="idF5496CB08C7E4E85979C202488691EBA"><enum>(5)</enum><text>by striking
			 paragraph (25), as redesignated by paragraph (2) of this subsection, and
			 inserting the following:</text>

				social need</header><text>The term <term>greatest social need</term> means
				need—</text>
								<subparagraph id="idB3267A7D686A4E4D9AB2B46D0CBDEBD2"><enum>(A)</enum><text>caused by
				noneconomic factors, which include—</text>
									<clause id="ID76854d2544c442bfad2695d4f8aba439"><enum>(i)</enum><text>physical and
				mental disabilities;</text>
									</clause><clause id="ID32cbda66532b4cc9b291f824c478d55c"><enum>(ii)</enum><text>language
				barriers including limited English proficiency;</text>
									</clause><clause id="IDf4edbb5ee388402c88e888c0c0c5d35d"><enum>(iii)</enum><text>cultural,
				social, or geographic isolation (such as residence in a rural area), including
				isolation caused by racial, minority, or ethnic status, or status as a lesbian,
				gay, bisexual, or transgendered older adult; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id000FD7BAA5034AFCB9236AFC5696674D"><enum>(iv)</enum><text display-inline="yes-display-inline">HIV-positive health status or Alzheimer's
				disease or a related disorder with neurological and organic brain dysfunction;
				and</text>
									</clause></subparagraph><subparagraph id="id573082B360614A0CAA63C0C212AAD79C"><enum>(B)</enum><text>that—</text>
									<clause id="ID5c00c55559e74127a5099117dc771d46"><enum>(i)</enum><text>restricts the
				ability of an individual to perform normal daily tasks; or</text>
									</clause><clause id="ID8c4b73503d4d4b0a94ac2026315897ca"><enum>(ii)</enum><text>threatens the
				capacity of the individual to live
				independently.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id715951CDC0F149CEAFC59DAC449EDDAF"><enum>(6)</enum><text>in paragraph
			 (29)(E)(i), as redesignated by paragraph (2) of this subsection, by inserting
			 after <term>social need</term> the following: <quote>(with particular attention
			 to individuals with factors listed in paragraph (25))</quote>;</text>

				legal assistance delivery system</header><text>The term <term>integrated legal
				assistance delivery system</term> means a collaboratively run, statewide
				network that is established to provide direct legal assistance, in the most
				efficient and impactful manner possible, targeted at older individuals with
				greatest economic need and older individuals with greatest social need, in
				coordination with the legal assistance developer for the State and all State,
				regional, and local service providers engaged in promoting or supporting elder
				rights.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="idEEDF3F36751F40378BF1347B0D716719"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 102 of the Older Americans Act of 1965 (42
			 U.S.C. 3002), as redesignated by subsection (a)(2), is amended—</text>
					<paragraph commented="no" id="id67C8E618110E4A898EBD59156071B275"><enum>(1)</enum><text>in paragraph
			 (38)(A), by striking <quote>as defined in paragraph (5)</quote> and inserting
			 <quote>as defined in paragraph (27)</quote>;</text>
					</paragraph><paragraph commented="no" id="id41E1160B01DD48138B618B9CAE58137E"><enum>(2)</enum><text>in paragraph
			 (39), by striking <quote>(as defined in paragraph (18)(B))</quote> and

			 of Administration on Aging</header><text display-inline="no-display-inline">Section 201(d)(3) of the Older Americans Act
			 of 1965 (42 U.S.C. 3011(d)(3)) is amended—</text>
				<paragraph id="id5E254BCB51054FCCA6970A42C5447F34"><enum>(1)</enum><text>in subsection
			 (C)—</text>
					<subparagraph id="idE19212E1C8F349F79AE5A79182F638BC"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>; and</quote> and inserting a semicolon;</text>
					</subparagraph><subparagraph id="id055C12D516E747A491E820E486CC7811"><enum>(B)</enum><text>by redesignating
			 clause (ii) as clause (iii); and</text>

								</clause><clause commented="no" id="id24E784A1D7F942DE93C44679FCB3135C" indent="up1"><enum>(ii)</enum><text>on the capacity, as of the date of
				the study, of the aging network to manage such a database; and</text>
								</clause></subparagraph><subparagraph commented="no" id="id6152301F91EE43C89B5365EAC8482F66" indent="up1"><enum>(B)</enum><text>not later than 2 years after the date
				of enactment of the Older Americans Act Amendments of 2012, submit to Congress
				the results of the study conducted under subparagraph
				(A);</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" id="id17ED4C49EA91418B91933B51CEF97B44"><enum>203.</enum><header>Federal agency
			 consultation</header><text display-inline="no-display-inline">Section 203 of
			 the Older Americans Act of 1965 (42 U.S.C. 3013) is amended—</text>
				<paragraph commented="no" id="id3EC4CC8BACDB4E2CB85DF4483B46C929"><enum>(1)</enum><text>in subsection
			 (a)(3)(A), by striking <quote>older individuals (with particular attention to
			 low-income older individuals, including low-income minority older individuals,
			 older individuals with limited English proficiency, and older individuals
			 residing in rural areas)</quote> and inserting <quote>older individuals, older
			 individuals with greatest economic need, and older individuals with greatest
			 social need (with particular attention to individuals with factors listed in
			 section 102(25))</quote>; and</text>

			 1965 (42 U.S.C. 3017) is amended—</text>
				<paragraph commented="no" id="id18017093E43E41CA963B62B62ECB1843"><enum>(1)</enum><text>in subsection
			 (a), by striking <quote>greatest economic need</quote> and all that follows
			 through <quote>areas),</quote> and inserting <quote>greatest economic need and
			 unserved older individuals with greatest social need (with particular attention
			 to individuals with factors listed in section 102(25)),</quote>; and</text>
				</paragraph><paragraph commented="no" id="idFB9473DBCD994C1E883EF9DCE5302AAD"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g), by striking

				<subsection commented="no" id="id7FC95E13AA74485989C5034E4B308C67"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Labor, through the Bureau of Labor Statistics and in consultation with the
			 Assistant Secretary for Aging, shall revise and improve the Experimental Price
			 Index for the Elderly published by the Bureau of Labor Statistics (commonly
			 referred to as the <quote>CPI–E</quote>) in order for the CPI–E to be
			 considered a reliable measure in determining future cost of living adjustments
			 that impact Americans who are 62 years of age or older.</text>
				</subsection><subsection commented="no" id="id624EFD375900447CA24576F10238CE2F"><enum>(b)</enum><header>Revision
			 requirements</header><text display-inline="yes-display-inline">In carrying out
			 subsection (a), the Secretary of Labor shall—</text>
					<paragraph commented="no" id="idB1AF3A5D28D643939401CC739A093E2E"><enum>(1)</enum><text display-inline="yes-display-inline">increase the number of Americans 62 years
			 of age and older sampled in the consumer expenditure survey used to establish
			 the CPI–E;</text>
					</paragraph><paragraph commented="no" id="idC58323DBBCB04F2A89C859DE03A58063"><enum>(2)</enum><text display-inline="yes-display-inline">establish samples of market-based items,
			 stores, and prices to represent the purchasing patterns of Americans 62 years
			 of age and older; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAA90BEB04E58451D98801CE0FA022B7E"><enum>(3)</enum><text display-inline="yes-display-inline">examine the medical care component,
			 including the cost and usage of prescription drugs, of the CPI–E taking into
			 account that Americans 62 years of age and older have different illnesses and
			 medical expenses than Americans under 62 years of age.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id839DC824766043B885ACC54CF6AB7813"><enum>(c)</enum><header>Report to
			 Congress</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Secretary of Labor shall submit to Congress a report that
			 describes the revised CPI–E and the activities carried out by the Secretary
			 under this section.</text>

			 State and community programs on aging</header>
			<section id="id7D5DA0490E0D4E1C9C0105836274D4CA"><enum>301.</enum><header>Purpose;

			 1965 (42 U.S.C. 3028) is amended—</text>

				the funds to provide either type of nutrition services, including paying for
				transportation costs that can be demonstrated to be directly related to the
				provision of either type of nutrition
				services.</text>

				</after-quoted-block></quoted-block>

			 percent</quote> and inserting <quote>200 percent</quote>; and</text>

			 an evaluation of the methods used, by the area agencies on aging and service
			 providers under this Act, to ensure that the consumer contributions are used to
			 supplement the services for which the contributions were
			 collected.</quote>.</text>

			 services and senior centers program</header><text display-inline="no-display-inline">Section 321(b)(1) of the Older Americans Act

			 preventive services</header><text>Part D of title III of the Older Americans
			 Act of 1965 (42 U.S.C. 3030m et seq.) is amended by adding at the end the

				preventive services</header>

				services described in subsection (c) are covered under the Medicare program
				carried out under title XVIII of the Social Security Act (42 U.S.C. 1395 et
				seq.).</text>

							<subsection id="id1412AFABCE03472CB00DEE121973F8CA"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="idD49D59975D69426C899514D336DC9C06"><enum>(1)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means—</text>
									<subparagraph id="idA8233C7A9DEC431B880CA9503221A197"><enum>(A)</enum><text>a State;</text>
									</subparagraph><subparagraph id="idE63F4D279F7742E799EE69A04DE135E3"><enum>(B)</enum><text>an area agency on
				aging; or</text>
									</subparagraph><subparagraph id="id332140E45ACA415BB434191E8A0E3A55"><enum>(C)</enum><text>a tribal or
				Native Hawaiian organization.</text>
									</subparagraph></paragraph><paragraph commented="no" id="idEF91E467EF4D48A0ABC1F7AE20DB777A"><enum>(2)</enum><header>Livable
				community</header><text>The term <term>livable community</term> means a
				metropolitan, urban, suburban, or rural community in which—</text>
									<subparagraph commented="no" id="id2862EE16479E4457BAD4F68BA6E7B7C9"><enum>(A)</enum><text>safe, reliable,
				and accessible transportation choices exist;</text>
									</subparagraph><subparagraph commented="no" id="id4F928D03FF4842958B41736B3EA420CB"><enum>(B)</enum><text>long-term,
				affordable, accessible, energy-efficient, and conveniently located housing
				choices exist for people of all ages, incomes, races, and ethnicities;</text>
									</subparagraph><subparagraph commented="no" id="id97EC29839C1E4B42B2019FA4BFCDFD1C"><enum>(C)</enum><text>the growth of
				neighborhoods is supported, revitalized, and encouraged, and the
				cost-effectiveness of infrastructure is maximized;</text>
									</subparagraph><subparagraph commented="no" id="idC5108A853E1E43D9879B7EC836612984"><enum>(D)</enum><text>economic
				development and economic competitiveness are promoted;</text>
									</subparagraph><subparagraph commented="no" id="id714BD57BB90442769E4D8518ADDE5701"><enum>(E)</enum><text>the environment
				and natural resources are preserved;</text>
									</subparagraph><subparagraph commented="no" id="id685D91CE55CF43309D9D0997C79E31DA"><enum>(F)</enum><text>agricultural
				land, rural land, and green space are protected; and</text>
									</subparagraph><subparagraph commented="no" id="id234AAFD940DA4FBE93BF6E8F12FEE7A2"><enum>(G)</enum><text>public health is
				supported, improving the quality of life for residents of, and workers in, the
				community.</text>
									</subparagraph></paragraph><paragraph commented="no" id="idF883468E694F401384690C4E0AA81B3F"><enum>(3)</enum><header>Tribal or
				native hawaiian organization</header><text>The term <term>tribal or Native
				Hawaiian organization</term> means an organization that is eligible to receive
				a grant under title VI.</text>
								</paragraph></subsection><subsection id="idC78E15DC45444D29A303D1FB49FF32BF"><enum>(b)</enum><header>In
				general</header><text>The Assistant Secretary shall award grants, from
				allotments made under subsection (c)(1) and as described in subsection (c)(2),
				to eligible entities to pay for the Federal share of the cost of assisting
				communities in preparing for the aging of the population, through activities
				described in subsection (e).</text>
							</subsection><subsection id="id2BBB7965112C45EEADB761938CC68544"><enum>(c)</enum><header>Availability of
				funds</header>
								<paragraph id="ID6f9c0efa72534d84b70340c5ff973c03"><enum>(1)</enum><header>States and area
				agencies on aging</header><text>Subject to paragraph (4), from the sums
				appropriated under subsection (i) for each of fiscal years 2013, 2014, 2015,
				2016, and 2017, the Assistant Secretary shall allot funds under this section in
				the amount of—</text>
									<subparagraph id="IDdebe335ade5744d79a79f9f46ee010cd"><enum>(A)</enum><text>$30,000 to each
				State; and</text>
									</subparagraph><subparagraph id="ID5258b7ec9629459ea837487afc7283bc"><enum>(B)</enum><text>$30,000 to each
				area agency on aging.</text>
									</subparagraph></paragraph><paragraph id="IDc889def59f674729bbc1c378ca6a1023"><enum>(2)</enum><header>Tribal or
				native hawaiian organizations</header><text>Subject to paragraph (4), from the
				sums appropriated under subsection (i) for each of fiscal years 2013, 2014,
				2015, 2016, and 2017, the Assistant Secretary shall reserve $1,500,000, and use
				the reserved funds for grants to tribal or Native Hawaiian
				organizations.</text>
								</paragraph><paragraph id="idF53C967EBCB547EBB886B8F29C76BB01"><enum>(3)</enum><header>National
				Resource Center</header><text>Subject to paragraph (4), from the sums
				appropriated under subsection (i) for each of fiscal years 2013, 2014, 2015,
				2016, and 2017, the Assistant Secretary shall reserve $3,000,000, and use the
				reserved funds for a grant to the national organization selected under
				subsection (f)(1).</text>
								</paragraph><paragraph id="id931CD9A70B1E4CE8BDED4B2B97814254"><enum>(4)</enum><header>Insufficient
				appropriations</header><text>Notwithstanding paragraphs (1), (2), and (3), if
				the amount appropriated under subsection (i) for a fiscal year is insufficient
				for the Assistant Secretary to provide all the allotments described in
				paragraph (1), and to reserve the amounts described in paragraphs (2) and (3),
				for that fiscal year, the Secretary shall proportionately reduce the number of
				allotments made under paragraph (1), and the amount of each reservation
				described in paragraph (2) or (3) for that fiscal year.</text>
								</paragraph></subsection><subsection id="id50D4EC45F25947F4ABAFE6DFCE803C1B"><enum>(d)</enum><header>Application</header><text>An
				eligible entity desiring a grant under this section shall submit an application
				to the Assistant Secretary at such time, in such manner, and accompanied by
				such information as the Assistant Secretary may require.</text>
							</subsection><subsection id="idB33FB2354C6942DB9E0EE2D47672D3DB"><enum>(e)</enum><header>Use of grant
				funds</header><text>An eligible entity may use the funds made available through
				a grant—</text>
								<paragraph id="ID9f009f32f49c4a868b8d1ec0d02a958d"><enum>(1)</enum><text>to hire a
				professional planner to help State agencies, local elected officials, local
				government agencies, tribal or Native Hawaiian organizations, and private and
				nonprofit organizations to develop policies, programs, and services to foster
				livable communities for people of all ages;</text>
								</paragraph><paragraph id="IDdb2939afa1004026826d1ae723f02f7c"><enum>(2)</enum><text>to assess the
				aging population; and</text>
								</paragraph><paragraph id="ID5b99c0f9774446ad9121f8f48949ffa1"><enum>(3)</enum><text>to coordinate the
				activities of State and local agencies in order to meet the needs of older
				individuals.</text>
								</paragraph></subsection><subsection id="idA6C64EFFA2064D8DBED1897734DAB3F7"><enum>(f)</enum><header>National
				Resource Center</header>
								<paragraph id="idEBF69424457145EDB72DC6D1D6D68871"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary shall make a grant to a national
				organization, as described in subsection (c)(3), to establish a National
				Resource Center on Livable Communities for All Ages to provide technical
				assistance to eligible entities awarded grants under subsection (b).</text>
								</paragraph><paragraph id="id0A2D925030C14EF8B14BE802DB2EC508"><enum>(2)</enum><header>Criteria for
				selection</header><text>The national organization selected under paragraph (1)
				shall have a proven capacity to provide training and technical assistance to
				support States, area agencies on aging, and tribal or Native Hawaiian
				organizations, in engaging in community planning activities.</text>
								</paragraph><paragraph id="id39A1653FE6724C8DBD12D8D24B2C4712"><enum>(3)</enum><header>Application</header><text>A
				national organization desiring the grant under this subsection shall submit an
				application to the Assistant Secretary at such time, in such manner, and
				accompanied by such information as the Assistant Secretary may require.</text>
								</paragraph></subsection><subsection id="IDaf296b6fd8844cbcb136aaebc5ad4b99"><enum>(g)</enum><header>Federal
				share</header>
								<paragraph id="ID479947d00eee4c659ec5bf81b8cb0c30"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), the Federal share of
				the cost described in subsection (b) shall be 75 percent.</text>
								</paragraph><paragraph id="ID2cd0a9c1264e4634ae457de979c5c70e"><enum>(2)</enum><header>Exceptions</header>
									<subparagraph id="ID5386a25fa2034efd853cd2e6ade36801"><enum>(A)</enum><header>Small and rural
				communities</header><text>In the case of an eligible entity that is an area
				agency on aging that serves an area with less than 200,000 in population, the
				Federal share of the cost described in subsection (b) may be 80 percent.</text>
									</subparagraph><subparagraph id="ID11417959c13c4312a80202d4d0d5812d"><enum>(B)</enum><header>Tribal or
				native hawaiian organizations</header><text>In the case of an eligible entity
				that is a tribal or Native Hawaiian organization, the Federal share of the cost
				described in subsection (b) shall be 100 percent.</text>
									</subparagraph></paragraph><paragraph id="IDdbb7a3d105634522b7c8b154bb207757"><enum>(3)</enum><header>Non-Federal
				share</header>
									<subparagraph id="IDda28b4ab00894158b96fcf9095181607"><enum>(A)</enum><header>In-kind
				contributions</header><text>For the purpose of this section, the non-Federal
				share of the cost may be provided in cash or in-kind, fairly evaluated.</text>
									</subparagraph><subparagraph id="IDb3a56a1743a74fc6a07e8a375dc8eda5"><enum>(B)</enum><header>Other Federal
				funding</header><text>An eligible entity may use Federal funds appropriated
				under this Act and available to carry out section 306, 307, 614, or 624, as the
				case may be, towards providing the non-Federal share of the cost.</text>
									</subparagraph></paragraph></subsection><subsection id="idD63658918B4C45EEBBEAA1BFC6C32BE2"><enum>(h)</enum><header>Application of
				general provisions</header><text>Sections 301 through 316 shall not be
				considered to apply to this part.</text>
							</subsection><subsection id="id37650AD344224A50B5200021850754E1"><enum>(i)</enum><header>Authorization
				of appropriations</header>
								<paragraph id="idD7610469AC2D412A8ACF81D7F6E7A6DD"><enum>(1)</enum><header>In
				general</header><text>There are authorized to be appropriated to carry out this
				part such sums as may be necessary for fiscal years 2013, 2014, 2015, 2016, and
				2017.</text>
								</paragraph><paragraph id="id016AFE104D864352990EEE15A3B69B89"><enum>(2)</enum><header>Sense of the
				Senate</header><text>It is the sense of the Senate that the amount appropriated
				under paragraph (1) should be not less than $25,000,000 for fiscal year
				2013.</text>
								</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="id13CE9F090F8E47AB8FBF150928E0D02B"><enum>IV</enum><header>Activities for
			 health, independence, and longevity</header>
			<section id="id3B32ABEF69804715BC5EC62274955B54"><enum>401.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">Section 417(c)(2) of
			 the Older Americans Act of 1965 (42 U.S.C. 3032f(c)(2)) is amended by striking
			 <quote>older individuals and communities</quote> and all that follows and
			 inserting <quote>communities with greatest need, older individuals with
			 greatest economic need, and older individuals with greatest social need (with
			 particular attention to individuals with factors listed in section
			 102(25));</quote>.</text>
			</section><section id="ID585c1bd7455e47efb7cf7f9d064133b3"><enum>402.</enum><header>Multipurpose
			 senior center modernization, training, and support</header><text display-inline="no-display-inline">Part
			 A of title IV of the Older Americans Act of 1965 (42 U.S.C. 3032 et seq.) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB08E7C75E0CF4890B7072191293BF975" style="OLC">
					<section id="idE36C90C841AC4DEEB728D68C5CE681C2"><enum>423.</enum><header>Multipurpose
				senior center modernization, training, and support</header>
						<subsection id="ID96f5b1f4333942769b471383fd313300"><enum>(a)</enum><header>Program
				authorized</header><text>The Assistant Secretary shall award grants and enter
				into contracts with eligible entities to carry out projects to—</text>
							<paragraph id="ID7108bb93e35946608011048f6c302de2"><enum>(1)</enum><text>support and
				promote modern multipurpose senior center models which yield vibrant,
				multiservice, multigenerational centers for older individuals, families of
				older individuals, and others in the community to gain skills, resources, and
				connections needed to meet the challenges that occur with continuum of care and
				quality of life;</text>
							</paragraph><paragraph id="IDbac515b039904a388d7c292ffae86cb2"><enum>(2)</enum><text>build an evidence
				base of modern, replicable practices that allow senior centers to serve a
				diverse array of older individuals, as well as their families and other
				caregivers, leveraging innovative partnerships and public and private resources
				to develop and expand programs; and</text>
							</paragraph><paragraph id="ID5274617d35614e62a56d89efd0feda0d"><enum>(3)</enum><text>mobilize services
				and leverage resources to support the role of multipurpose senior centers as
				community focal points, as provided in section 306(a)(3), and for the
				establishment, construction, maintenance, and operation of centers, as
				described in sections 303(c)(2) and 306(a)(1), including development of
				intergenerational shared site models, consistent with the purposes of this
				Act.</text>
							</paragraph></subsection><subsection id="ID3a71e67b1005468a9c2ae4ab1ea4f2c4"><enum>(b)</enum><header>Use of
				funds</header><text>An eligible entity shall use funds made available under a
				grant awarded, or a contract entered into, under subsection (a) to—</text>
							<paragraph id="ID032bcb723c744f5ebb80d6ed81c56ff0"><enum>(1)</enum><text>carry out a
				project described in subsection (a); and</text>
							</paragraph><paragraph id="ID4895ad9e257e43aeb47a9b005af091d1"><enum>(2)</enum><text>evaluate the
				project in accordance with subsection (f).</text>
							</paragraph></subsection><subsection id="ID5b83c339ea2846dcb46cf4d380717413"><enum>(c)</enum><header>Application</header><text>To
				be eligible to receive a grant or enter into a contract under subsection (a),
				an eligible entity shall submit an application to the Assistant Secretary at
				such time, in such manner, and accompanied by such information as the Assistant
				Secretary may reasonably require.</text>
						</subsection><subsection id="ID469df9d3e42f47f992ff2f83f6286420"><enum>(d)</enum><header>Eligible
				entity</header><text>For purposes of this section, the term <term>eligible
				entity</term> means—</text>
							<paragraph id="ID7a30bea4f3a8429d971bbfd05515227a"><enum>(1)</enum><text>a multipurpose
				senior center that has met national accreditation and fiduciary standards;
				and</text>
							</paragraph><paragraph id="ID2de8789dde674c419ce74d0aa9d775e8"><enum>(2)</enum><text>a regional
				partnership or collaboration of multipurpose senior centers or State
				association of senior centers in which not less than 2 centers are
				accredited.</text>
							</paragraph></subsection><subsection id="ID8e9b12e5a812431cae5fe6d04b7e6753"><enum>(e)</enum><header>Competitive
				grants for technical assistance</header>
							<paragraph id="ID6b43e1a7b9ba41edad19fbdfdcdfc983"><enum>(1)</enum><header>Grants</header><text>The
				Assistant Secretary shall make a grant, on a competitive basis, to an eligible
				nonprofit organization described in paragraph (2), to enable the organization
				to—</text>
								<subparagraph id="IDd0c9203bc0214200b02d18af17c15d76"><enum>(A)</enum><text>provide training
				and technical assistance to recipients of grants under this section and other
				multipurpose senior centers to adopt and tailor evidence-based modernization
				strategies and practices to respond to the economic and health needs of the
				diverse and growing aging populations in their own communities; and</text>
								</subparagraph><subparagraph id="ID7d16dfe292ce424592dd732fffbb3a16"><enum>(B)</enum><text>carry out other
				duties, as determined by the Assistant Secretary.</text>
								</subparagraph></paragraph><paragraph id="ID81bdc147919a45ac854508e1149de26e"><enum>(2)</enum><header>Eligible
				nonprofit organization</header><text>To be eligible to receive a grant under
				this subsection, an organization shall be a nonprofit organization (including a
				partnership of nonprofit organizations), that—</text>
								<subparagraph id="ID54cfa99c5ea047feb90409bfa3108988"><enum>(A)</enum><text>has experience
				and expertise in providing technical assistance to a range of multipurpose
				senior centers and experience evaluating and reporting on programs; and</text>
								</subparagraph><subparagraph id="ID6616a2243aa14d46983b749d6643d43c"><enum>(B)</enum><text>has demonstrated
				knowledge of and expertise in multipurpose senior center accreditation or other
				standards of excellence.</text>
								</subparagraph></paragraph><paragraph id="ID3ecd28c727bd43e7a204be0182d59b22"><enum>(3)</enum><header>Application</header><text>To
				be eligible to receive a grant under this subsection, an organization
				(including a partnership of nonprofit organizations) shall submit an
				application to the Assistant Secretary at such time, in such manner, and
				containing such information as the Assistant Secretary may require, including
				an assurance that the organization will submit to the Assistant Secretary such
				evaluations and reports as the Assistant Secretary may require.</text>
							</paragraph></subsection><subsection id="ID682c1feecc0e4c628382af3cb649544a"><enum>(f)</enum><header>Local
				evaluation and report</header>
							<paragraph id="IDba94e4520abb432fbf89ec760c76dd82"><enum>(1)</enum><header>Evaluation</header><text>Each
				entity receiving a grant or a contract under subsection (a) to carry out a
				project described in subsection (a) shall evaluate the project, leadership, and
				resources for the modernization of multipurpose senior centers to
				determine—</text>
								<subparagraph id="IDf34a33935c3f4bcf8bc01a2c82d20db1"><enum>(A)</enum><text>the effectiveness
				of the project in producing innovations and mobilizing resources;</text>
								</subparagraph><subparagraph id="ID1d34ecacfcbd49ea939acf29253abf67"><enum>(B)</enum><text>the impact on
				older individuals, families of older individuals, and the community being
				served; and</text>
								</subparagraph><subparagraph id="ID061b2efdcd34446f9b4001049872ef47"><enum>(C)</enum><text>the potential for
				the project to be replicated by other multipurpose senior centers, noting the
				necessary resources and partnerships and the types of populations and
				communities best suited for the model.</text>
								</subparagraph></paragraph><paragraph id="IDd3b96fc71e78492ea053bd8a88a20915"><enum>(2)</enum><header>Report</header><text>The
				entity described in paragraph (1) shall submit a report to the Assistant
				Secretary containing the evaluation not later than 6 months after the
				expiration of the period for which the grant or contract is in effect.</text>
							</paragraph></subsection><subsection id="ID7f797fc3fedb43a29f4302ee2d5431da"><enum>(g)</enum><header>Report to
				Congress</header><text>Not later than 6 months after the Assistant Secretary
				receives the reports described in subsection (f)(2), the Assistant Secretary
				shall prepare and submit to Congress a report that assesses the evaluations and
				includes, at a minimum—</text>
							<paragraph id="ID7fa0e0cf99a341c0b4407b7e44444642"><enum>(1)</enum><text>a description of
				the nature and operation of the projects funded under this section and other
				activities conducted in support of such projects;</text>
							</paragraph><paragraph id="ID57796f7d041d4d28ad015a20e8c52056"><enum>(2)</enum><text>the findings
				resulting from the evaluations of the model projects conducted under this
				section;</text>
							</paragraph><paragraph id="IDdd004c6aa6414c7f90a5763aff4838ac"><enum>(3)</enum><text>a description of
				recommended best practices of modern multipurpose senior centers;</text>
							</paragraph><paragraph id="IDdd64902a243942388d59613fa1286a50"><enum>(4)</enum><text>a strategy for
				disseminating the findings resulting from the projects described in paragraph
				(1); and</text>
							</paragraph><paragraph id="IDd5a1fe76d92c454ebc4dac72dbbe8f26"><enum>(5)</enum><text>recommendations
				for legislative or administrative action, as the Assistant Secretary determines
				appropriate.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="idD617225147CB41BBB47EE32E5E77D5E9"><enum>V</enum><header>Community service
			 senior opportunities</header>
			<section commented="no" id="idEE4E89AE3FF942DBA1BC84A7E7648CFC"><enum>501.</enum><header>Older american
			 community service employment program</header><text display-inline="no-display-inline">Section 502 of the Older Americans Act of
			 1965 (42 U.S.C. 3056) is amended—</text>
				<paragraph commented="no" id="id45DF8938C94F445FBC7E409C9A161AA2"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph commented="no" id="id4D047253D9184D03A8CD64C5E32AAD09"><enum>(A)</enum><text>in paragraph

				order to maximize the number of older individuals being served, each grantee
				under this title shall, to the maximum extent practicable, achieve a goal,
				referred to paragraph (1)(S), of placing not less than 50 percent of the
				participants in the grantee's project in positions with organizations that
				assist older adults or in positions with duties that positively impact the
				lives of older adults.</text>
								</subparagraph><subparagraph id="idB6DA187BCC234E938ECBD0DEF3095F24"><enum>(B)</enum><header>Contracts with
				service providers</header><text>In order to achieve the goal described in
				subparagraph (A), each such grantee shall enter into a contract or memorandum
				of understanding with—</text>
									<clause id="id48B7CC144B2D4F9BA74172865E04E3AB"><enum>(i)</enum><text>entities from 2
				or more categories of entities, which categories shall consist of—</text>
										<subclause id="idD632D78DC1B343EC95615CFDBE003102"><enum>(I)</enum><text>the State
				Long-Term Care Ombudsman selected in accordance in section 712;</text>
										</subclause><subclause id="IDcac05c97208c4d16be9a477fa25e2bc2"><enum>(II)</enum><text>an area agency
				on aging;</text>
										</subclause><subclause id="ID22d4c22e638c4605802089f3e5e0898e"><enum>(III)</enum><text>a multipurpose
				senior center;</text>
										</subclause><subclause id="ID2eadfa2f8f574013a840383b722b5160"><enum>(IV)</enum><text>a contractor
				providing a system of support services under part E of title III; and</text>
										</subclause><subclause commented="no" id="IDbf0fdab453f146e499a8b691d934f00c"><enum>(V)</enum><text>a transportation
				service provider; or</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id69228DFBE5EF4AF79C39EB8F0D97D7F1"><enum>(ii)</enum><text>an entity
				approved by the Assistant Secretary, and the Secretary of
				Labor.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="idB06959E9B61240188BD6D5E6BBD284AC"><enum>(2)</enum><text>in subsection

				skills;</text>
								</clause><clause commented="no" id="id896AC40A564E470E986F1865EF1BC701"><enum>(iv)</enum><text>word processing
				and spreadsheet skills;</text>
								</clause><clause commented="no" id="id31DFD4CDF2C94BD686199FB5A0B45E0E"><enum>(v)</enum><text>presentation
				software skills; and</text>
								</clause><clause commented="no" id="idAB7EE9E2EA894321B983D86B51A6CAB0"><enum>(vi)</enum><text>any other key
				skills appropriate for assisting eligible individuals in entering or
				re-entering the
				workforce.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></section><section id="id25667CE0E83041929F133CCCABF035AC"><enum>502.</enum><header>State
			 plan</header><text display-inline="no-display-inline">Section 503(a)(4)(C) of

			</section><section id="idFC65FB8A39E74BDE98EA11F07181769D"><enum>507.</enum><header>Study on
			 feasibility of transfer of program</header>
				<subsection id="idFD3DB2669974409FA6903EC17FE83B96"><enum>(a)</enum><header>Study</header><text>The
			 Assistant Secretary for Aging of the Department of Health and Human Services,
			 and the Secretary of Labor, shall study the feasibility of transferring the
			 program carried out under title V of the Older Americans Act of 1965 (42 U.S.C.
			 3056 et seq.) to the Administration on Aging.</text>

			 rights protection activities</header>

			 of Appropriations for Ombudsman Program</header><text display-inline="no-display-inline">Section 702 of the Older Americans Act of
			 1965 (42 U.S.C. 3058a) is amended—</text>

				State agency to the Assistant Secretary in writing; and</text>
										</subclause><subclause id="ID142e20114de840f78512e05be23c183d"><enum>(III)</enum><text>remedied in
				accordance with this subparagraph.</text>
										</subclause></clause><clause id="idF6C0FD8B4CC14731AB3437F38668AC9E"><enum>(ii)</enum><header>Reporting by
				any person or entity</header><text>Any person or entity may identify any
				potential or actual organizational conflict of interest involving the Office
				and report the conflict to the Assistant Secretary for review and action under
				clause (iii).</text>
									</clause><clause id="IDfab177d76c364c09bd56e6277f746d1f"><enum>(iii)</enum><header>Action by
				administration</header><text>In a case in which a potential or actual
				organizational conflict of interest involving the Office is disclosed or
				reported to the Assistant Secretary, the Assistant Secretary shall require that
				the State agency—</text>
										<subclause id="id75B4E5BB59C4429FB73B8E8B65D575F0"><enum>(I)</enum><text>remove the
				conflict; or</text>
										</subclause><subclause id="id718437346F554645A921469D8AF7EA10"><enum>(II)</enum><text>submit, and
				obtain the approval of the Assistant Secretary for, an adequate remedial plan
				that indicates how the Ombudsman will be unencumbered in fulfilling all of the
				functions specified in paragraph (3).</text>
										</subclause></clause></subparagraph><subparagraph id="IDd3d2d40f2dc94ac0801f322d3690d122"><enum>(C)</enum><header>Organizational
				conflict of interest</header><text>In this paragraph, the term
				<term>organizational conflict of interest</term> includes placement of the
				Office in an organization that—</text>
									<clause id="ID237042c785c34026a0069e73aebe8fe8"><enum>(i)</enum><text>is responsible
				for licensing or certifying long-term care services in the State;</text>
									</clause><clause id="ID131b52727265422bbd6729180d4e5bef"><enum>(ii)</enum><text>is an
				association (or an affiliate of such an association) of long-term care
				facilities, or of any other residential facilities for older
				individuals;</text>
									</clause><clause id="ID3d64ea76729c430fba4b68c9647faedd"><enum>(iii)</enum><text>provides
				long-term care services, including programs carried out under a Medicaid waiver
				approved under section 1115 of the Social Security Act (42 U.S.C. 1315) or
				under subsection (c) or (b) of 1915 of the Social Security Act (42 U.S.C.
				1396n), or under a Medicaid State plan amendment under subsection (i) of
				section 1915 of the Social Security Act (42 U.S.C. 1396n(i));</text>
									</clause><clause id="ID095de2e482c14fe7bac982a1a42ca614"><enum>(iv)</enum><text>provides
				long-term care case management;</text>
									</clause><clause id="ID1f7c19669f4e480fbe96212b8e907d49"><enum>(v)</enum><text>sets rates for
				long-term care services;</text>
									</clause><clause id="ID73a5950dc6154f59b383f24078fb19d1"><enum>(vi)</enum><text>provides adult
				protective services;</text>
									</clause><clause id="IDf9dd602df03a43e59538ff3f653ed48b"><enum>(vii)</enum><text>is responsible
				for eligibility determinations for the Medicare program carried out under title
				XVIII, or the Medicaid program carried out under title XIX, of the Social
				Security Act (42 U.S.C. 1395 et seq., 1396 et seq.);</text>
									</clause><clause id="ID8aa9d1e12d414b0c860dc97821d4ac86"><enum>(viii)</enum><text>conducts
				preadmission screening for placements in facilities described in clause (ii);
				or</text>
									</clause><clause id="ID2c43955ba96d407483f499893df4f780"><enum>(ix)</enum><text>makes decisions
				regarding admission of individuals to such
				facilities.</text>
									</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="idCAB721C2EF3D44108AE0DE82C0D46A74"><enum>(D)</enum><text>in paragraph
			 (5)—</text>

				development and operation of an integrated legal assistance delivery system for
				the State. To the maximum extent practicable, the individual selected to serve
				as the developer shall—</text>
						<paragraph id="idD06561422A8344C6B6D958E934504731"><enum>(1)</enum><text>agree to serve as
				the developer on a full-time basis;</text>
						</paragraph><paragraph commented="no" id="idF167F0423D5947728F85DD6264CABA12"><enum>(2)</enum><text>have a law degree
				from an accredited law school or have been admitted to practice law in any
				jurisdiction in the United States; and</text>
						</paragraph><paragraph commented="no" id="id4F7AC141B929414E85CDE60E334339AF"><enum>(3)</enum><text>possess other
				knowledge, skills, training, and education that reflect a comprehensive
				understanding of legal services for older individuals.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id90F0EA34FD084E8CA1823C395BF07868"><enum>(b)</enum><header>Other
				personnel</header><text>In addition to the State legal services developer, the
				State agency shall provide the services of other personnel, sufficient to
				ensure—</text>
