		<section id="idC72668150BC140718896EC5D1C0EA9C9" section-type="section-one"><enum>1.</enum><header>Disclosure of safety
			 performance ratings of motorcoach services and operations</header>
			<subsection id="ID43b9adde82b14ad1922009a8db51bf89"><enum>(a)</enum><header>In
			 general</header><text>Subchapter I of chapter 141 of title 49, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idDBB7AF4DBD5D479ABC6570291255AE29" style="USC">
					<section id="IDaa869c69a62a41eca33e5d6ffe12f094"><enum>14105.</enum><header>Safety
				performance ratings of motorcoach services and operations</header>
						<subsection id="idBB5BE799B3CA4EA5AE573042E0883F45"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="idD1311610F6FB4331B14D5B77A8901D3C"><enum>(1)</enum><header>Motorcoach</header>
								<subparagraph id="id2ABDA9235CC14F94A852AA740D854DB1"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), the term
				<term>motorcoach</term> has the meaning given to the term <term>over-the-road
				bus</term> in section 3038(a)(3) of the Transportation Equity Act for the 21st
				Century (49 U.S.C. 5310 note).</text>
								</subparagraph><subparagraph id="id3234E445E7A043D4A859D9B73DEC3520"><enum>(B)</enum><header>Inclusions and
				exclusions</header><text>The term <term>motorcoach</term>—</text>
									<clause id="id60854064E98947A68748BA2E78AF29DD"><enum>(i)</enum><text>includes a motor
				vehicle used to transport passengers that has a gross vehicle weight of at
				least 10,001 pounds; and</text>
									</clause><clause id="idFEE930D1ADCF4AC5B8802BEA2EF150EC"><enum>(ii)</enum><text>does not
				include—</text>
										<subclause id="id043CE905163C472D90DA671EBD169617"><enum>(I)</enum><text>a bus used in
				public transportation that is provided by a State or local government;
				or</text>
										</subclause><subclause id="id890C370E29374BD285F69526F4D16554"><enum>(II)</enum><text>a school bus (as
				defined in section 30125(a)(1)), including a multifunction school activity
				bus.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62B6A892EBDA47C08E954A785E7C54A6"><enum>(2)</enum><header>Motorcoach
				services and operations</header><text>The term <term>motorcoach services and
				operations</term> means passenger transportation by a motorcoach for
				compensation.</text>
							</paragraph></subsection><subsection id="ID5741d434be4f4e50b67716af88ff86fa"><enum>(b)</enum><header>Rulemaking</header>
							<paragraph id="id320AB83D510F482C98A61DD59DB71DD8"><enum>(1)</enum><header>In
				general</header><text>Not later than 1 year after the date of the enactment of
				this section, the Secretary shall require, by regulation—</text>
								<subparagraph id="idDE24E018F83143A1ADB26C6D7853DD63"><enum>(A)</enum><text>each motor
				carrier that owns or leases 1 or more motorcoaches that transport passengers
				subject to the Secretary’s jurisdiction under section 13501 to display
				prominently in each motorcoach it operates, and in all announcements,
				advertisements, and points of sale for such motorcoach services and operations,
				a simple and understandable letter grade rating system that allows motorcoach
				passengers to compare the safety performance of motorcoach operators;
				and</text>
								</subparagraph><subparagraph id="id174D5A36C8A94351B3316369660D56A7"><enum>(B)</enum><text>any person who
				sells tickets for motorcoach services and operations to display the letter
				grade rating system described in subparagraph (A) in all announcements,
				advertisements, and points of sale for such motorcoach services and
				operations.</text>
								</subparagraph></paragraph><paragraph id="ID70b1cc8f03dd48dd9c441436e3357260"><enum>(2)</enum><header>Items included
				in the rulemaking</header><text>In promulgating safety performance ratings for
				motorcoaches pursuant to the rulemaking required under paragraph (1), the
				Secretary shall consider—</text>
								<subparagraph id="ID6d1459d1d75c499aacac8a24810df2b2"><enum>(A)</enum><text>the frequency
				with which safety performance ratings will be assigned and updated, which
				updates shall take place at least once per year;</text>
								</subparagraph><subparagraph id="ID17cbf7d3e95b4d92a5150f4e4e8f4ba8"><enum>(B)</enum><text>the specific data
				elements and sources of information to be utilized in establishing and updating
				safety performance ratings for motorcoaches;</text>
								</subparagraph><subparagraph id="IDab976ddc45a340678db8eadc67c83041"><enum>(C)</enum><text>the need and
				extent to which safety performance ratings should be made available in
				languages other than English; and</text>
								</subparagraph><subparagraph id="IDcc6047b5a98a4eeb98946c7fc89ebce0"><enum>(D)</enum><text>penalties
				authorized under section 521.</text>
								</subparagraph></paragraph><paragraph id="id493197A93A4B45F7B95B024F9B932C34"><enum>(3)</enum><header>Insufficient
				inspections</header><text>Any motor carrier that has not received sufficient
				inspections or been subject to a compliance review during the most recent
				12-month period shall display a <term>No Safety Data</term> rating in lieu of a
				letter grade rating in accordance with paragraph (1)(A).</text>
							</paragraph></subsection><subsection id="IDd23bc5841e9c4696a92ec4297f90d936"><enum>(c)</enum><header>Effect on State
				and local law</header><text>Nothing in this section may be construed to preempt
				a State, or a political subdivision of a State, from enforcing any requirements
				concerning the manner and content of consumer information provided by motor
				carriers that are not subject to the Secretary’s jurisdiction under section
				13501.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDccd22436701b47279d779da754e1133a"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis of chapter 141 of title 49, United States
			 Code, is amended by inserting after the item relating to section 14104 the
			 following:</text>
