			 the <quote><short-title>Next Generation Television
			 Marketplace Act of 2011</short-title></quote>.</text>

			 regulatory intervention in the television marketplace under the Communications
			 Act of 1934</header>
			<subsection id="idBB22BF0910ED475BB3F547465DDACAA8"><enum>(a)</enum><header>In
			 general</header><text>The following sections of the Communications Act of 1934
			 (47 U.S.C. 151 et seq.) are repealed:</text>
				<paragraph id="idA658E50EEA6C43168ADED914009B53B3"><enum>(1)</enum><text>Section 339 (47
			 U.S.C. 339).</text>
				</paragraph><paragraph id="id355A10ED99BC40B0873BC4A46F2584FF"><enum>(2)</enum><text>Section 340 (47
			 U.S.C. 340).</text>

			 general</header><text>Section 325 of the Communications Act of 1934 is
			 amended—</text>
					<subparagraph id="id49B73ABD8EAD474F8546018562B9036E"><enum>(A)</enum><text>by striking
			 subsections (b) and (e); and</text>
					</subparagraph><subparagraph id="id9BBA7164DB40439C9387A38FE0C82E3B"><enum>(B)</enum><text>by redesignating
			 subsections (c) and (d) as subsections (b) and (c), respectively.</text>
					</subparagraph></paragraph><paragraph id="idCA14142F962D4C69ADF2F81A4D22F78B"><enum>(2)</enum><header>Technical and
			 conforming amendment</header><text>Section 309(c)(2)(F) of the Communications
			 Act of 1934 (47 U.S.C. 309(c)(2)(F)) is amended by striking <quote>section
			 325(c)</quote> and inserting <quote>section 325(b)</quote>.</text>
				</paragraph></subsection><subsection id="idF1F3F77647D44D82A4BAD543150A3A0C"><enum>(c)</enum><header>Amendments</header><text>Section
			 338 of the Communications Act of 1934 (47 U.S.C. 338) is amended—</text>
				<paragraph id="idE277E37DAA0C49D08FEBA7286C897F6A"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="id39D46AEB70AC4D0796136F732B8DCCAB"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="id5866F21DF4324308B2A337CB509E6B71"><enum>(i)</enum><text>by
			 striking <quote>, under section 122 of title 17, United States Code, secondary
			 transmissions</quote> and inserting <quote>signals of a qualified noncommercial
			 educational television station</quote>; and</text>
						</clause><clause id="id7256DDCEA3734DF8940E14E8413E7A82"><enum>(ii)</enum><text>by
			 striking <quote>a television broadcast station</quote> and all that follows
			 through <quote>section 325(b).</quote> and inserting <quote>such station shall
			 carry upon request the signals of all qualified noncommercial educational
			 television stations located within that local market.</quote>;</text>

				general</header><text>The term <term>local market</term>, in the case of
				noncommercial television broadcast stations, means the designated market area
				in which a station is located, and, in the case of a noncommercial educational
				television broadcast station, the market includes any station that is licensed
				to a community within the same designated market area as the noncommercial
				educational television broadcast station.</text>
								</subparagraph><subparagraph id="ID12c155e74edc42a384eb3a8f6f3366f7"><enum>(B)</enum><header>County of
				license</header><text>In addition to the area described in subparagraph (A), a
				station’s local market includes the county in which the station’s community of
				license is located.</text>
								</subparagraph><subparagraph id="IDeeb35f2d85e3457cbd973f218b505d0e"><enum>(C)</enum><header>Designated
				market area</header><text>For purposes of subparagraph (A), the term
				<term>designated market area</term> means a designated market area, as
				determined by Nielsen Media Research and published in the 1999–2000 Nielsen
				Station Index Directory and Nielsen Station Index United States Television
				Household Estimates or any successor publication.</text>
								</subparagraph><subparagraph id="ID89d7ddd0558c4315a556a7936ba03d31"><enum>(D)</enum><header>Certain areas
				outside of any designated market area</header><text>Any census area, borough,
				or other area in the State of Alaska that is outside of a designated market
				area, as determined by Nielsen Media Research, shall be deemed to be part of
				one of the local markets in the State of Alaska. A satellite carrier may
				determine which local market in the State of Alaska will be deemed to be the
				relevant local market in connection with each subscriber in such census area,
				borough, or other
				area.</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id15142A33F56540789B74F8F2F9495791"><enum>(F)</enum><text>in paragraph (6),
			 as redesignated by subparagraph (D), by striking <quote>has the meaning</quote>
			 and all that follows and inserting <quote>means an entity that uses the
			 facilities of a satellite or satellite service licensed by the Commission and
			 operates in the Fixed-Satellite Service under part 25 of title 47, Code of
			 Federal Regulations, or the Direct Broadcast Satellite Service under part 100
			 of title 47, Code of Federal Regulations, to establish and operate a channel of
			 communications for point-to-multipoint distribution of television station
			 signals, and that owns or leases a capacity or service on a satellite in order
			 to provide such point-to-multipoint distribution, except to the extent that
			 such entity provides such distribution pursuant to tariff under this Act, other
			 than for private home viewing pursuant to this section.</quote>;</text>
					</subparagraph><subparagraph id="idA3452E56A03E4FC18140FE28A485CA95"><enum>(G)</enum><text>in paragraph (7),
			 as redesignated by subparagraph (D), by striking <quote>has the meaning</quote>
			 and all that follows and inserting <quote>means a person or entity that
			 receives a secondary transmission service from a satellite carrier and pays a
			 fee for the service, directly or indirectly, to the satellite carrier or to a
			 distributor.</quote>; and</text>
					</subparagraph><subparagraph id="id438EB24632ED4B0AAD93A06BAE6274A4"><enum>(H)</enum><text>in paragraph (8),
			 as redesignated by subparagraph (D), by striking <quote>has the meaning</quote>
			 and all that follows and inserting <quote>means an over-the-air commercial or
			 noncommercial television broadcast station licensed by the Commission under
			 subpart E of part 73 of title 47, Code of Federal Regulations, except that such
			 term does not include a low-power or translator television
			 station.</quote>.</text>
					</subparagraph></paragraph><paragraph id="idF75B883CD37D40278FA1AC0B41E7CB6A"><enum>(12)</enum><header>Section
			 623</header><text>Section 623 of the Communications Act of 1934 (47 U.S.C. 543)
			 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id294E86B9EC5343D1BA3CF1064C183982" style="OLC">
						<section id="idC77E6AD2DE574814B0B7BF6BAF2C5F54"><enum>623.</enum><header>Regulation of
				rates and broadcast signal carriage</header><text display-inline="no-display-inline">No Federal agency, State, or franchising
				authority may regulate—</text>
							<paragraph id="id0F8920D2BCA84075B0AE6DEDF4906891"><enum>(1)</enum><text display-inline="yes-display-inline">the rates for the provision of the service
				of a multichannel video programming distributor; or</text>
							</paragraph><paragraph id="idB2664AE366FA4ABC816E871687C91266"><enum>(2)</enum><text>the
				retransmission of television broadcast signals by a multichannel video
				programming distributor, except in accordance with the requirements of sections
				338 and 615 relating to qualified noncommercial educational television
				stations.</text>
							</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id65A95C32634F4193A0AD1481E9A4A7F3"><enum>(d)</enum><header>Conforming
			 amendments</header>
				<paragraph id="idAA4986419D724092B8AF61CA4500998B"><enum>(1)</enum><header>Section
			 336</header><text>Section 336(b)(3) of the Communications Act of 1934 (47
			 U.S.C. 336(b)(3)) is amended by striking <quote>614 or</quote>.</text>
				</paragraph><paragraph id="idC24530F55B3B402D89B2F15EF298D64C"><enum>(2)</enum><header>Section
			 613</header>
					<subparagraph id="id699DAE596ACA4550A470E1BE59235F94"><enum>(A)</enum><header>In

			 615</header><text>Section 615 of the Communications Act of 1934 (47 U.S.C. 535)
			 is amended—</text>

			</paragraph><paragraph id="ID5a33fdbe2efc45718a0f5bee9210e567"><enum>(3)</enum><text>repeal subpart F
			 of part 76 of title 47 of the Code of Federal Regulations; and</text>
			</paragraph><paragraph id="IDf1ae605204a346f5adaf13de1fa9defb"><enum>(4)</enum><text>modify the
			 broadcast ownership limitations set forth in section 73.3555 of title 47 of the
			 Code of Federal Regulations by eliminating—</text>
				<subparagraph id="IDbd5fd0c09e564741ad529e4b09eda16d"><enum>(A)</enum><text>the restrictions
			 on the number of broadcast television stations that a person or entity may
			 directly or indirectly own, operate, or control in the same designated market
			 area (as such term is defined under section 501(f)(2) of title 17, United
			 States Code, as described in subsection (b) of such section 73.3555;</text>
				</subparagraph><subparagraph id="ID74088af23e004ce28e71b9ab3fafdb0e"><enum>(B)</enum><text>the
			 radio-television cross-ownership rule, as described in subsection (c) of such
			 section 73.3555; and</text>
				</subparagraph><subparagraph id="IDb71fb6e549d64699b7a356d68e59e620"><enum>(C)</enum><text>the limitations
			 on the direct or indirect ownership, operation, or control of a broadcast
			 television station by a person or entity that directly or indirectly owns,
			 operates, or controls a daily newspaper, as that term was defined in note 6 to
			 such section 73.3555 in effect on October 1, 2011, as described in subsection
			 (d) of such section 73.3555.</text>
				</subparagraph></paragraph></section><section id="idAC833A17CC524089B37EE78E4B2844F6"><enum>5.</enum><header>Transitional
			 Provisions</header>
			<subsection id="id3393B77305224E10BDA8B21332BC590C"><enum>(a)</enum><header>Congressional
			 finding</header><text>Congress finds and declares that the enactment of this
			 Act will change laws that have provided the basis for certain contracts,
			 understandings, and arrangements related to retransmission consent and the
			 distribution of video programming entered into prior to the enactment of this
			 Act and that, accordingly, certain transitional measures are necessary to
			 preserve an orderly marketplace for the provision of video programming to
			 consumers.</text>
			</subsection><subsection id="idAD2A55C5AD32445195AA90BDED9D393B"><enum>(b)</enum><header>Retransmission
			 consent</header>
				<paragraph id="id3C39DEEAD3C14DE78A20DF7263AD92A2"><enum>(1)</enum><header>No new
			 contracts</header><text>No contract, understanding, or arrangement for the
			 retransmission consent shall be entered into pursuant to section 325(b) of the
			 Communications Act of 1934 (47 U.S.C. 325(b)) after the date of enactment of
			 this Act.</text>
				</paragraph><paragraph id="idA44758C373774753AC51D610D91D1E36"><enum>(2)</enum><header>Extension of
			 prior contracts</header><text>Any contract, understanding, or arrangement for
			 retransmission consent entered into pursuant to section 325(b) of the
			 Communications Act of 1934 (47 U.S.C. 325(b)) prior to the date of enactment of
			 this Act, which by the terms of the contract, understanding, or arrangement
			 expires before July 1, 2014, shall be deemed to be extended through July 1,
			 2014 based on the terms of the contract, understanding, or arrangement in
			 effect on the date before the expiration date of the contract, understanding,
			 or arrangement.</text>
				</paragraph><paragraph id="id915A06450AB44072B636267006C5CD99"><enum>(3)</enum><header>Expiration of
			 prior contracts</header><text>No contract, understanding, or arrangement for
			 retransmission consent entered into pursuant to section 325(b) of the
			 Communications Act of 1934 (47 U.S.C. 325(b)) before the date of enactment of
			 this Act shall be enforceable by any person or entity after July 1,
			 2014.</text>
				</paragraph></subsection><subsection id="id24C785551D404923A67E8FA9C7336029"><enum>(c)</enum><header>Continued
			 collection and distribution of previously due
			 royalties</header><text>Notwithstanding section 5, the collection and
			 distribution of royalties due for secondary transmissions made pursuant to
			 sections 111 and 119 of title 17, United States Code, prior to July 1, 2014,
			 shall continue to be governed by such title and the rules of the Register of
			 Copyrights and Copyright Royalty Judges as in effect prior to the date of
			 enactment of this Act until such time as the Register certifies that all
			 royalties collected pursuant to such provisions have been distributed.</text>
			</subsection></section><section id="idA197134952FF4D59A1DB9B0ABA455C11"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Except as provided in
			 section 5, this Act and the amendments made by this Act, shall take effect on
			 July 1, 2014.</text>
