		<official-title display="yes">To amend the Surface Transportation and
		  Uniform Relocation Assistance Act of 1987 to authorize the Secretary of
		  Transportation to permit Federal regulation and review of tolls and toll
		  increases on certain surface transportation facilities, and for other
		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Commuter Protection
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idC96738FFE04343CEB26C674EF5C1C6EF" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Review and regulation of tolls</header>
			<subsection commented="no" display-inline="no-display-inline" id="idE6C92C06796A4537A29084F34E90894F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 135 of the Surface Transportation
			 and Uniform Relocation Assistance Act of 1987 (33 U.S.C. 508; Public Law
			 100–17; 101 Stat. 174) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idDCA14F3462AA4FFC8D8A29E367D325BF" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="id0B8C16F2BD0948BF92DB8A8367D53979" section-type="subsequent-section"><enum>135.</enum><header display-inline="yes-display-inline">Review and regulation of tolls</header>
						<subsection commented="no" display-inline="no-display-inline" id="idA76F423ABDD846EFAC1BB118F54DDF54"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Tolls for passage or transit over any
				bridge constructed under the Act of March 23, 1906 (33 U.S.C. 491 et seq.)
				(commonly known as the <quote>Bridge Act of 1906</quote>), the General Bridge
				Act of 1946 (33 U.S.C. 525 et seq.), or the International Bridge Act of 1972
				(33 U.S.C. 535 et seq.), and over or through any bridge or tunnel constructed
				on a Federal-aid highway (as defined in section 101(a) of title 23, United
				States Code) under any other provision of law, shall be—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id9F1CF914FD0F4CA5BF6FE8E48236FF09"><enum>(1)</enum><text display-inline="yes-display-inline">just and reasonable; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82C6ED8175BB4E4CB789A91906BDD279"><enum>(2)</enum><text display-inline="yes-display-inline">subject to review and regulation by the
				Secretary, upon complaint or the initiative of the Secretary, including with
				respect to increases in the amount of tolls.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id945D9C302EFF4F56971D89C0EE612E3F"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary shall promulgate such
				regulations as are necessary to carry out this section, including regulations
				that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id339C29B5924E4E5DA287F77A767CB777"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9CA0D9131BFB46E58A20E9C0F4BEA8E3"><enum>(A)</enum><text display-inline="yes-display-inline">define the term <term>just and
				reasonable</term> for purposes of this section;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4E438BDD3F024042AE720EB7C0CCE5DF" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">establish a process to determine whether
				tolls are just and reasonable for purposes of this section; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD3CBB482D31C4B1D9557A0819663DA09" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">prescribe, when appropriate, the just and
				reasonable rates of tolls to be charged under this section;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE893F86B3C4F408BA207E36A3C40A6A3"><enum>(2)</enum><text display-inline="yes-display-inline">establish a process for the filing of an
				administrative complaint to challenge a determination described in paragraph
				(1)(B);</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCF59C02A1274CBA89670D4BE7BD8FCD"><enum>(3)</enum><text display-inline="yes-display-inline">authorize the Secretary, or a designated
				administrative law judge—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idB0F51DDD3B66429AA824DECF5B8F3154"><enum>(A)</enum><text display-inline="yes-display-inline">to consider a complaint from any person
				aggrieved by a toll increase on any bridge or tunnel described in subsection
				(a); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB54E38687ACB4328AB823C66DB0934D7"><enum>(B)</enum><text display-inline="yes-display-inline">to conduct an investigation and, if
				appropriate, hold a formal hearing on such a complaint; and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7BA00F9CABFC4697BC76ADD66A803DD9"><enum>(4)</enum><text display-inline="yes-display-inline">authorize a person who submitted a
				complaint described in paragraph (3)(A) to challenge the final administrative
				determination of the Secretary or administrative law judge on the complaint,
				after issuance of that determination, in the appropriate United States district
				court in accordance with subchapter II of chapter 5, and chapter 7, of title 5,
				United States Code (commonly known as the <quote>Administrative Procedure
				Act</quote>).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id242E00FC7C134B008A8297D6FD52436B"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of contents for the Surface
			 Transportation and Uniform Relocation Assistance Act of 1987 (23 U.S.C. 101
			 note; Public Law 100–17) is amended by striking the item relating to section
			 135 and inserting the following:</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id1AE45EC8BE394D5590FA35322C6C0BFE" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Study on use of tolls by interstate
			 authorities</header><text display-inline="no-display-inline">As soon as
			 practicable after the date of enactment of this Act, the Comptroller General
			 shall conduct, and submit to the appropriate committees of Congress a report on
			 the results of, a study—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id4CEAB286B5164417B43D832D62AE9E1A"><enum>(1)</enum><text display-inline="yes-display-inline">to evaluate the use of tolls by interstate
			 authorities to maintain and improve surface transportation facilities;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC7825C398B8D45FE94CFD3B47789E9A6"><enum>(2)</enum><text display-inline="yes-display-inline">to make recommendations to increase
			 transparency and accountability of the funding decisions by those
			 authorities.</text>
