		  transportation departments of certain unexpended highway
		  funding.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Redistribution of Unspent Earmarks
			 Act of 2011</short-title></quote>.</text>
		</section><section id="id39EF1E1F2216482A822532B9581D354C"><enum>2.</enum><header>Return and
			 redistribution of certain unobligated highway funding</header>
			<subsection id="idED369353879D479E855D0747D35A91F6"><enum>(a)</enum><header>Definition of
			 earmark</header><text>In this section, the term <term>earmark</term>
			 means—</text>
				<paragraph id="id46D577FBA2C448868A8199199BBB407D"><enum>(1)</enum><text>a congressionally
			 directed spending item, as defined in clause 5(a) of rule XLIV of the rules of
			 the Senate for the 112th Congress; or</text>
				</paragraph><paragraph id="id7D0869AAEBC94D59B8612CC24FFA4126"><enum>(2)</enum><text>a congressional
			 earmark, as defined in clause 9(d) of rule XXI of the rules of the House of
			 Representatives for the 112th Congress.</text>
				</paragraph></subsection><subsection id="id31C68DE8193549D8B2A05838D24A392B"><enum>(b)</enum><header>Return and
			 redistribution</header><text>Notwithstanding any other provision of law, funds
			 made available from the Highway Trust Fund through an earmark for fiscal year
			 2008 or a preceding fiscal year that remain unobligated as of the date of
			 enactment of this Act shall be—</text>
				<paragraph id="id9D2209E2BBCF4D6C9BE440C0A9FC1356"><enum>(1)</enum><text>returned to the
			 State transportation department of the State in which the earmarked funds were
			 directed to be used; and</text>
				</paragraph><paragraph id="id1DCD26218DB645EC8779531800F2BDD2"><enum>(2)</enum><text>redistributed by
			 the State for expeditious use for other federally approved transportation
			 projects in the State.</text>
				</paragraph></subsection></section></legis-body>
