			 findings:</text>
			<paragraph id="ID9b522da1fa5f45528877882eff9387c3"><enum>(1)</enum><text>Achieving
			 economic recovery will require the formation and growth of new
			 companies.</text>
			</paragraph><paragraph id="ID8c6db3878936490c8d9f88deb7e4b726"><enum>(2)</enum><text>Between 1980 and
			 2005, companies less than 5 years old accounted for nearly all net job creation
			 in the United States.</text>
			</paragraph><paragraph id="IDe5c7c7c62f584817b2f34790615407ae"><enum>(3)</enum><text>New firms in the
			 United States create an average of 3,000,000 jobs per year.</text>
			</paragraph><paragraph id="idE9ADBF5DB3F9493BB08FBB2FE7AB0E00"><enum>(4)</enum><text>To get Americans
			 back to work, entrepreneurs must be free to pursue their ideas, form companies,
			 and hire employees.</text>
			</paragraph><paragraph id="IDeb2ad3a0d28346da8b65c86a2e7c79fb"><enum>(5)</enum><text>State and local
			 policies affect entrepreneurs’ ability to start new businesses and grow
			 existing businesses.</text>
			</paragraph></section><section id="id994E0FFCF45F4B118235CD6661C209EA"><enum>3.</enum><header>Economic impact
			 of major rules</header><text display-inline="no-display-inline">Section 553 of
			 title 5, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idDE894F56240A46C3B5DEDFC3B6011C88" style="OLC">
				<subsection id="ID60dfadb12cde4ad1b2b16c088b3a6732"><enum>(f)</enum><header>Required review
				before issuance of major rules</header>
					<paragraph id="ID8db480f65e8c49b7bcda619051c1c23d"><enum>(1)</enum><header>In
				general</header><text>Before issuing a notice of proposed rulemaking in the
				Federal Register regarding the issuance of a proposed major rule, the head of
				the Federal agency or independent regulatory agency seeking to issue the rule
				shall complete a review that—</text>
						<subparagraph id="ID167f48308ace4c358bad61d8300ab643"><enum>(A)</enum><text>analyzes the
				problem that the proposed rule intends to address, including—</text>
							<clause id="ID36f0949e6b0843269554838a99a17957"><enum>(i)</enum><text>the specific
				market failure, such as externalities, market power, or lack of information,
				that justifies such rule; or</text>
							</clause><clause id="ID1387a5c0d6c4419e9a7f3c482a290d9e"><enum>(ii)</enum><text>any other
				specific problem, such as the failures of public institutions, that justifies
				such rule;</text>
							</clause></subparagraph><subparagraph id="ID7c8a8f6a222c4714adf4468c973f87fe"><enum>(B)</enum><text>analyzes the
				expected impact of the proposed rule on the ability of new businesses to form
				and expand;</text>
						</subparagraph><subparagraph id="ID5bee6d15d2674e27801ade02f2461b40"><enum>(C)</enum><text>identifies the
				expected impact of the proposed rule on State, local, and tribal governments,
				including the availability of resources—</text>
							<clause id="ID61de81e083a244deb6e07f7a81fb6f62"><enum>(i)</enum><text>to carry out the
				mandates imposed by the rule on such government entities; and</text>
							</clause><clause id="ID7dea9228ac5e4ecf850eccf9b8105242"><enum>(ii)</enum><text>to minimize the
				burdens that uniquely or significantly affect such governmental entities,
				consistent with achieving regulatory objectives;</text>
							</clause></subparagraph><subparagraph id="ID0337b4fd0a4640e199280490607965cd"><enum>(D)</enum><text>identifies any
				conflicting or duplicative regulations;</text>
						</subparagraph><subparagraph id="ID2da94892f15a4bb1951fa3f9e93f6de4"><enum>(E)</enum><text>determines—</text>
							<clause id="IDb8311b4e4ec34d6e90d309aca325c33a"><enum>(i)</enum><text>if existing laws
				or regulations created, or contributed to, the problem that the new rule is
				intended to correct; and</text>
							</clause><clause id="ID356753e0422b4490a4cb603fcb0a3610"><enum>(ii)</enum><text>if the laws or
				regulations referred to in clause (i) should be modified to more effectively
				achieve the intended goal of the rule; and</text>
							</clause></subparagraph><subparagraph id="ID3cdd7d8755a84ce784fc21661865bb90"><enum>(F)</enum><text>includes the
				cost-benefit analysis described in paragraph (2).</text>
						</subparagraph></paragraph><paragraph id="ID47704f5ee2db40019cfd540bdeb31dcb"><enum>(2)</enum><header>Cost-benefit
				analysis</header><text>A cost-benefit analysis described in this paragraph
				shall include—</text>
						<subparagraph id="IDea8d600884884c6c8113b6cde53f059e"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id32DBB03EC5474B6EB742D31AC2C24B46"><enum>(i)</enum><text>an assessment,
				including the underlying analysis, of benefits anticipated from the proposed
				rule, such as—</text>
								<subclause id="idB713107FD33140F9ADCB992E75A2C0E2" indent="up1"><enum>(I)</enum><text>promoting the efficient functioning of
				the economy and private markets;</text>
								</subclause><subclause id="idADCB33D96C5E46ECBFFB255004CE32F9" indent="up1"><enum>(II)</enum><text>enhancing health and safety;</text>
								</subclause><subclause id="id41294049C08047BC9AFCE90F8D1C275A" indent="up1"><enum>(III)</enum><text>protecting the natural environment;
				and</text>
								</subclause><subclause id="id2E18D23632464BCAA7E45B3BBD2B8ED5" indent="up1"><enum>(IV)</enum><text>eliminating or reducing discrimination
				or bias; and</text>
								</subclause></clause><clause id="id87FEA7195EA94F2182486FD44E323EE2" indent="up1"><enum>(ii)</enum><text>the quantification of the benefits
				described in clause (i), to the extent feasible;</text>
							</clause></subparagraph><subparagraph id="ID9a94471e6d0e4fdbb1b63e618727a709"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id8780583BB757462BA28DC1A947E63948"><enum>(i)</enum><text>an assessment,
				including the underlying analysis, of costs anticipated from the proposed rule,
				such as—</text>
								<subclause id="idF0C1C1F50B494B42933E8D0BE14AD8B7" indent="up1"><enum>(I)</enum><text>the direct costs to the Federal
				Government to administer the rule;</text>
								</subclause><subclause id="idF14928CB0BAF40C7A40070018C6CF7F9" indent="up1"><enum>(II)</enum><text>the direct costs to businesses and
				others to comply with the rule; and</text>
								</subclause><subclause id="id7879DDAA7A8C4DE487224C4FAEEFB758" indent="up1"><enum>(III)</enum><text>any adverse effects on the efficient
				functioning of the economy, private markets (including productivity,
				employment, and competitiveness), health, safety, and the natural environment;
				and</text>
								</subclause></clause><clause id="idB899E745A49E4EA0AC858A528CB4A226" indent="up1"><enum>(ii)</enum><text>the quantification of the costs
				described in clause (i), to the extent feasible;</text>
							</clause></subparagraph><subparagraph id="ID566976c67e1b40268955a7b73a0f8c21"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idE01E9E6415E64C3D9B1BB975C5FE5C4C"><enum>(i)</enum><text>an assessment,
				including the underlying analysis, of costs and benefits of potentially
				effective and reasonably feasible alternatives to the proposed rule, which have
				been identified by the agency or by the public, including taking reasonably
				viable nonregulatory actions; and</text>
							</clause><clause id="idCB2AF52EA396484AB420D71C72D8AA3E" indent="up1"><enum>(ii)</enum><text>an explanation of why the proposed
				rule is preferable to the alternatives identified under clause (i).</text>
							</clause></subparagraph></paragraph><paragraph id="ID23fa84a2f0db40e18bfa571c5e20ff18"><enum>(3)</enum><header>Report</header><text>Before
				issuing a notice of proposed rulemaking in the Federal Register regarding the
				issuance of a proposed major rule, the head of the Federal agency seeking to
				issue the rule shall—</text>
						<subparagraph id="ID9368a6bdbb6847e895aaeb326de93c4f"><enum>(A)</enum><text>submit the
				results of the review conducted under paragraph (1) to—</text>
							<clause id="idC7C30AE36E76407FA25094764B5F8025"><enum>(i)</enum><text>Congress;
				and</text>
							</clause><clause id="id232A02AE1DD042CCBD3FF265B7DC80F9"><enum>(ii)</enum><text>the Office of
				Information and Regulatory Affairs in the Office of Management and Budget;
				and</text>
							</clause></subparagraph><subparagraph id="ID40d92e6a28d645189340b13c2da82778"><enum>(B)</enum><text>post the results
				of the review conducted under paragraph (1) on a publicly available
				website.</text>
						</subparagraph></paragraph><paragraph id="IDc15a1a987dae4ca1aa9fb8a2dca4ad93"><enum>(4)</enum><header>Judicial
				review</header><text>Any determinations made, or other actions taken, by an
				agency or independent regulatory agency under this subsection shall not be
				subject to judicial review.</text>
					</paragraph><paragraph id="IDc8a01fc476064e4289fa14f0b5850d54"><enum>(5)</enum><header>Defined
				term</header><text>In this subsection the term <term>major rule</term> has the
				meaning given the term in section
				804.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idE3E8A482F1C14329844D71B0D22959E0" section-type="subsequent-section"><enum>4.</enum><header>Permanent full
			 exclusion applicable to qualified small business stock</header>
			<subsection id="ID4CC5E4C46F8245A88726105EF544E040"><enum>(a)</enum><header>Permanent full
			 exclusion</header>
				<paragraph id="id98D72BCE744A4634BA1C43D5F261D56A"><enum>(1)</enum><header>In
			 general</header><text>Subsection (a) of section 1202 of the Internal Revenue
			 Code of 1986 is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idF289326DB43341ADBF2D2B1587A058C0" style="OLC">
						<subsection id="id8B6CEDC8BE1D4DCAA7B8FE3C1C1B5E9E"><enum>(a)</enum><header>Exclusion</header><text>In
				the case of a taxpayer other than a corporation, gross income shall not include
				100 percent of any gain from the sale or exchange of qualified small business
				stock held for more than 5
				years.</text>

			</subsection></section><section id="idD88EAC3FC04147FA8400DFB1681471DB"><enum>5.</enum><header>Income tax
			 credit for certain startup small businesses</header>
			<subsection id="id21684B5C333942529EA931868F91E1D0"><enum>(a)</enum><header>In
			 general</header><text>Section 6401 of the Internal Revenue Code of 1986 is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="idEA917AD0F6114D20831EE4A9981C8470" style="OLC">
					<subsection id="id75CBF17810DA4548970AE9C6F218A79B"><enum>(c)</enum><header>Income tax
				credit for startup small businesses</header>
						<paragraph id="idFE183707371043B38104D724E711CF2F"><enum>(1)</enum><header>In
				general</header><text>In the case of a qualified small business (within the
				meaning of section 1202(d)), if the tax imposed by subtitle A for any taxable
				year exceeds the credits allowable under chapter 1 for such taxable year, an
				amount equal to the lesser of—</text>
							<subparagraph id="idC69D9B1EE2C54AF59EE6D9D289AC7D11"><enum>(A)</enum><text>the applicable
				percentage of the amount of such excess, or</text>
							</subparagraph><subparagraph id="idF536DB3CA28548BCAFAD382C681463B3"><enum>(B)</enum><text>$5,000,000,</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">shall be
				considered an overpayment with respect to such taxable year.</continuation-text></paragraph><paragraph id="idE2FC5D17F1D54962BD71E3922E413D88"><enum>(2)</enum><header>Applicable
				percentage</header><text>For purposes of this section, the applicable
				percentage is 100 percent for the first taxable year described in paragraph (1)
				of the qualified small business, 50 percent for each of the 2 succeeding
				taxable years, and zero percent thereafter.</text>
						</paragraph><paragraph id="id10A37A6DC399439CBC25F13B3C8A7959"><enum>(3)</enum><header>Election not to
				claim credit</header><text>This subsection shall not apply to a taxpayer for
				any taxable year if such taxpayer elects to have this subsection not apply for
				the first taxable year described in paragraph (1).</text>
						</paragraph><paragraph id="idA3EC644102BC461BB053FFBC753AB5FA"><enum>(4)</enum><header>Regulations</header><text>The
				Secretary shall prescribe such regulations as may be appropriate to carry out
				the purposes of this subsection, including—</text>
							<subparagraph id="idBC234BABD9824328B4856A4B81DB2496"><enum>(A)</enum><text>regulations to
				prevent the avoidance of the purposes of this subsection through split-ups,
				shell corporations, partnerships, or otherwise, and</text>
							</subparagraph><subparagraph id="idEE3AEAABC9A74F648965D4152D1EDA12"><enum>(B)</enum><text>regulations to
				provide for the proper determination of the first taxable year of a qualified
				small
				business.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id10AC40E5B42747C58F7558DF1764F0FF"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 6501(m) of the Internal Revenue Code of 1986 is
			 amended by striking <quote>or 51(j)</quote> and inserting <quote>51(j), or
			 6401(c)</quote>.</text>
			</subsection><subsection id="idCAFA423168024B66BDA84B3B8F0C5CFE"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to the first
			 taxable year described in section 6401(c)(1) of the Internal Revenue Code of
			 1986 (as added by this section) of any qualified small business, but only if
			 such first taxable year begins after the date of the enactment of this
			 Act.</text>
			</subsection></section><section id="id1469CD466AE849F0AC25A03E0CFDF4F4"><enum>6.</enum><header>Study of
			 regulatory impact of possible Sarbanes-Oxley reform</header><text display-inline="no-display-inline">In carrying out the study and report
			 required by section 989I of the Investor Protection and Securities Reform Act
			 of 2010 (Public Law 111–203, 124 Stat. 1948), the Comptroller General of the
			 United States shall—</text>
			<paragraph id="ID4f7f16482c0841bb883124acab2c9ac5"><enum>(1)</enum><text>assess the costs
			 and benefits to prospective investors, shareholders, and securities markets of
			 allowing smaller issuers to opt out of the requirements of section 404(b) of
			 the Sarbanes-Oxley Act of 2002 (15 U.S.C. 7262(b)); and</text>
			</paragraph><paragraph id="id34BA32B5F373417DA49D21A056E29787"><enum>(2)</enum><text>in assessing such
			 costs and benefits, consider the feasibility, costs, and benefits to
			 prospective investors, shareholders, and securities markets of placing an
			 asterisk or some other designation on the ticker symbol and other relevant
			 company disclosures of such issuers, indicating that the issuer has elected not
			 to comply with section 404(b) of the Sarbanes-Oxley Act of 2002 (15 U.S.C.

			</paragraph></section><section id="idB8A5554CF0A04460A8384A21D710F190"><enum>7.</enum><header>Accelerated
			 commercialization of university-based research</header>
			<subsection id="idBFA8C0A9D4814A2CAD12BE568C676E71"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id8E0C0FF3DDF242988C123AAD37D9C0E2"><enum>(1)</enum><header>Committee</header><text>The
			 term <term>Committee</term> means the Committee on Research Commercialization
			 Improvement established under subsection (c).</text>
				</paragraph><paragraph id="id6E6DBA4CA78244CBB60001EE31C75738"><enum>(2)</enum><header>Extramural
			 budget</header><text>The term <term>extramural budget</term> means the sum of
			 the total obligations minus amounts obligated for such activities by employees
			 of the agency in or through Government-owned, Government-operated facilities,
			 except that for the Department of Energy it shall not include amounts obligated
			 for atomic energy defense programs solely for weapons activities or for naval
			 reactor programs, and except that for the Agency for International Development
			 it shall not include amounts obligated solely for general institutional support
			 of international research centers or for grants to foreign countries.</text>
				</paragraph><paragraph id="id2DEF129250BB4625B2137B9CC1F2D76C"><enum>(3)</enum><header>Institution of
			 higher education</header><text>The term <term>institution of higher
			 education</term> has the meaning given the term in section 101(a) of the Higher
			 Education Act of 1965 (20 U.S.C. 1001(a)).</text>
				</paragraph><paragraph id="id37FB8362D93F4A4D874833C4D7501450"><enum>(4)</enum><header>Research or
			 research and development</header><text>The term <term>research</term> or
			 <term>research and development</term> means any activity that is—</text>
					<subparagraph id="id2E917613C4EA4C248B91901DF2387C8C"><enum>(A)</enum><text>a systematic,
			 intensive study directed toward greater knowledge or understanding of the
			 subject studied;</text>
					</subparagraph><subparagraph id="idE5E7466CAC7149EFABB47ED3CA00A649"><enum>(B)</enum><text>a systematic
			 study directed specifically toward applying new knowledge to meet a recognized
			 need; or</text>
					</subparagraph><subparagraph id="id0AE1A655F7224D4DB3C6045ECDE106C0"><enum>(C)</enum><text>a systematic
			 application of knowledge toward the production of useful materials, devices,
			 and systems or methods, including design, development, and improvement of
			 prototypes and new processes to meet specific requirements.</text>
					</subparagraph></paragraph><paragraph id="id004718B9F1CF4FEA9A311903F02D5861"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Commerce.</text>
				</paragraph></subsection><subsection id="idF1446059F412471C88C4B373E5445E1B"><enum>(b)</enum><header>Grant program
			 authorized</header>
				<paragraph id="id19B54DA7841144F4BFCB3CF623C4084D"><enum>(1)</enum><header>In
			 general</header><text>Each Federal agency that has an extramural budget for
			 research or research and development that is in excess of $100,000,000 for each
			 of fiscal years 2012 through 2017, shall transfer 0.15 percent of such
			 extramural budget for each of such fiscal years to the Secretary to enable the
			 Secretary to carry out a grant program in accordance with this
			 subsection.</text>
				</paragraph><paragraph id="id4C93D2682F494AFCB8F645E1AD418B5A"><enum>(2)</enum><header>Grants</header>
					<subparagraph id="id40E7394B61E84C1EB0A5F0259D45134C"><enum>(A)</enum><header>Awarding of
			 grants</header>
						<clause id="id010A2F434E634758BFDE0CAB437FFB8E"><enum>(i)</enum><header>In
			 general</header><text>From funds transferred under paragraph (1), the Secretary
			 shall use the criteria developed by the Committee to award grants to
			 institutions of higher education, including consortia of institutions of higher
			 education, for initiatives to improve commercialization and transfer of
			 technology.</text>
						</clause><clause id="id11962615C1984C23BD1C8AFC55E2A5D2"><enum>(ii)</enum><header>Request for
			 proposals</header><text>Not later than 30 days after the Committee submits the
			 recommendations for criteria to the Secretary under subsection (c)(4)(B), and
			 annually thereafter for each fiscal year for which the grant program is
			 authorized, the Secretary shall release a request for proposals.</text>
						</clause><clause id="id6AA02D9A4C304C79BF3EED0F97D3AD0A"><enum>(iii)</enum><header>Applications</header><text>Each
			 institution of higher education that desires to receive a grant under this
			 subsection shall submit an application to the Secretary not later than 90 days
			 after the Secretary releases the request for proposals under clause
			 (ii).</text>
						</clause><clause id="idD309814B37524040BDA1290B0C30AB5E"><enum>(iv)</enum><header>Committee
			 review</header>
							<subclause id="id96C20898A16B4BE1B8984F21D93C14C0"><enum>(I)</enum><header>In
			 general</header><text>The Secretary shall submit each application received
			 under clause (iii) to the Committee for Committee review.</text>
							</subclause><subclause id="id71F5DBFA83C44C4FA90BA00223827969"><enum>(II)</enum><header>Recommendations</header><text>The
			 Committee shall review each application received under subclause (I) and submit
			 recommendations for grant awards to the Secretary, including funding
			 recommendations for each proposal.</text>
							</subclause><subclause id="id6F3F6E5C6F1F4CA291DF03F9290CC805"><enum>(III)</enum><header>Public
			 release</header><text>The Committee shall publicly release any recommendations
			 made under subclause (II).</text>
							</subclause><subclause id="id9241804832384A9887EF57D567FF78EC"><enum>(IV)</enum><header>Consideration
			 of recommendations</header><text>In awarding grants under this subsection, the
			 Secretary shall take into consideration the recommendations of the Committee
			 under subclause (II).</text>
							</subclause></clause></subparagraph><subparagraph id="id5AB5D43AB31E400BBF550446E294CD16"><enum>(B)</enum><header>Commercialization
			 accelerator grants</header>
						<clause id="idE8567490DCBB4DF3A8BFFB659A6F24A6"><enum>(i)</enum><header>In
			 general</header><text>The Secretary shall award grants to support institutions
			 of higher education pursuing specific innovative initiatives to improve an
			 institution’s capacity to commercialize faculty research that can be widely
			 adopted if the research yields measurable results.</text>
						</clause><clause id="id94D65F60ABB54253880CE8982AE603E9"><enum>(ii)</enum><header>Content of
			 proposals</header><text>Grants shall be awarded under this subparagraph to
			 proposals demonstrating the capacity for accelerated commercialization,
			 proof-of-concept proficiency, and translating scientific discoveries and
			 cutting-edge inventions into technological innovations and new companies. In
			 particular, grant funds shall seek to support innovative approaches to
			 achieving these goals that can be replicated by other institutions of higher
			 education if the innovative approaches are successful.</text>
						</clause><clause id="id8FF3EBA62D334859B015F0265975682D"><enum>(iii)</enum><header>Assessment of
			 success</header><text>Grants awarded under this subparagraph shall use criteria
			 for assessing the success of programs through the establishment of technical
			 milestones.</text>
						</clause></subparagraph><subparagraph id="id548F79EFA5294AA5ADD3C71860926989"><enum>(C)</enum><header>Collaborative
			 commercialization grants</header>
						<clause id="idCE042286F8094E0298065EF080769199"><enum>(i)</enum><header>In
			 general</header><text>The Secretary shall award grants to support institutions
			 of higher education pursuing initiatives that allow faculty to directly
			 approach technology transfer programs outside of their institution of
			 employment in an effort to commercialize research breakthroughs.</text>
						</clause><clause id="id4E1B6C55B35049BA8574A921DE3829C1"><enum>(ii)</enum><header>Content of
			 initiatives</header><text>Initiatives eligible to be supported with grant funds
			 awarded under this subparagraph shall only include those—</text>
							<subclause id="id3A74F3BAE6324BC5B4C93E8DE33F09AE"><enum>(I)</enum><text>that have a
			 licensing revenue sharing agreement between the institution of higher education
			 where the research originates and the institution that commercializes the
			 research; and</text>
							</subclause><subclause id="id64F2A7E8110F4E1E862BBC6344156CFC"><enum>(II)</enum><text>for which the
			 first right of refusal in commercializing research belongs to the institution
			 of higher education where the research originates.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="id1F9255FBB5F5437AB6B23BD300D0499B"><enum>(3)</enum><header>Termination</header><text>The
			 Secretary shall have the authority to terminate grant funding to an institution
			 of higher education in accordance with the process and performance metrics
			 recommended by the Committee.</text>
				</paragraph><paragraph id="id5C9A2BD48D9047979B1434B154650F87"><enum>(4)</enum><header>Limitations</header>
					<subparagraph id="id11A5420112C6488E9FFF722D65E659E7"><enum>(A)</enum><header>Project
			 management costs</header><text>A grant recipient may use not more than 10
			 percent of grant funds awarded under this subsection for the purpose of funding
			 project management costs of the grant program.</text>
					</subparagraph><subparagraph id="id5C17E5A14F73400794C422EDC48D7A82"><enum>(B)</enum><header>Supplement, not
			 supplant</header><text>An institution of higher education that receives a grant
			 under this subsection shall use the grant funds to supplement, and not
			 supplant, non-Federal funds that would, in the absence of such grant funds, be
			 made available for activities described in this section.</text>
					</subparagraph></paragraph><paragraph id="idAD5F99F8D11A4FE6B0365F6210EED25B"><enum>(5)</enum><header>Unspent
			 funds</header><text>Any funds transferred to the Secretary under paragraph (1)
			 for a fiscal year that are not expended by the end of such fiscal year may be
			 expended in any subsequent fiscal year through fiscal year 2017. Any funds
			 transferred under paragraph (1) that are remaining at the end of the grant
			 program's authorization under this subsection shall be transferred to the
			 Treasury for deficit reduction.</text>
				</paragraph></subsection><subsection id="idC7742B26584E44E29A80415A40B5AFCD"><enum>(c)</enum><header>Committee on
			 research commercialization improvement</header>
				<paragraph id="idB78834FECF074C6F963F94EBCBA6CD87"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this section, the Director of the National Science Foundation shall—</text>
					<subparagraph id="id24BEAD0C30074A1FA7CACC7AB45687F4"><enum>(A)</enum><text>establish the
			 Committee on Research Commercialization Improvement; and</text>
					</subparagraph><subparagraph id="idD576CF11342F4201B2F7300DE4534EC5"><enum>(B)</enum><text>appoint the
			 members of the Committee described in subparagraphs (A) through (J) of
			 paragraph (2).</text>
					</subparagraph></paragraph><paragraph id="idFCFE9ED714524DFCA036413CC1C61C5F"><enum>(2)</enum><header>Composition</header><text>The
			 Committee shall be composed of 15 members, of whom—</text>
					<subparagraph id="idA4ACD8F637F54827A186D6F32DE79445"><enum>(A)</enum><text>1 member shall be
			 an administrator at a private institution of higher education;</text>
					</subparagraph><subparagraph id="idD9DF3928CB084B4188F47F3C351C2C6D"><enum>(B)</enum><text>1 member shall be
			 an administrator at a land-grant college or university (as defined in section
			 1404 of the Agricultural Research, Extension, and Teaching Policy Act of 1977
			 (7 U.S.C. 3103));</text>
					</subparagraph><subparagraph id="id5DFFE6258BFE48378C1307E2ED7EF84F"><enum>(C)</enum><text>1 member shall be
			 an administrator at a public institution of higher education;</text>
					</subparagraph><subparagraph id="id5543CFAF3FEB4B1EBE66C182D0B831B2"><enum>(D)</enum><text>1 member shall be
			 a tenured faculty member at an institution of higher education, whose research
			 has been commercialized;</text>
					</subparagraph><subparagraph id="id78801617F42748D3BBD768F36C789767"><enum>(E)</enum><text>1 member shall be
			 a qualified venture capitalist, defined as an individual who is employed by a
			 company that—</text>
						<clause id="id98E839DD80984885845B8EFE889D9558"><enum>(i)</enum><text>is
			 classified as a <quote>venture capital operating company</quote> under section
			 2510.3–101(d) of title 29, Code of Federal Regulations;</text>
						</clause><clause id="idE1F033C80B8945278FD56729533FD765"><enum>(ii)</enum><text>is
			 based in the United States;</text>
						</clause><clause id="idBC40A9C3F1754E89A062A370549474DF"><enum>(iii)</enum><text>is comprised of
			 partners, the majority of whom are United States citizens;</text>
						</clause><clause id="idCD1AA844E41042C188F1B80EED86F1ED"><enum>(iv)</enum><text>has capital
			 commitments of not less than $10,000,000;</text>
						</clause><clause id="idDB0409A72EB04B9E83ECFDE1D45EB29A"><enum>(v)</enum><text>has
			 been operating for not less than 2 years; and</text>
						</clause><clause id="id757ABCCC68244D9EA5180195000138E3"><enum>(vi)</enum><text>has made not
			 less than 2 investments of not less than $500,000 during each of the most
			 recent 2 years;</text>
						</clause></subparagraph><subparagraph id="id399299BF78354173828DC7C43224A0C5"><enum>(F)</enum><text>1 member shall be
			 a qualified Angel Investor, defined as an individual who—</text>
						<clause id="idA07E9913195149C78C891E4CDB3860BC"><enum>(i)</enum><text>is
			 an accredited investor (as defined in section 230.501(a) of title 17, Code of
			 Federal Regulations);</text>
						</clause><clause id="idF7AFEB01987142C697742A1C082AC345"><enum>(ii)</enum><text>is
			 a United States citizen; and</text>
						</clause><clause id="idA285AA0B39F5426CAB4A86D720BA3EAB"><enum>(iii)</enum><text>has made not
			 less than 2 equity investments of not less than $50,000 in each of the previous
			 3 years;</text>
						</clause></subparagraph><subparagraph id="idE7B81386D37F42238DC70126B5830C4E"><enum>(G)</enum><text>1 member shall be
			 a small business owner or executive at a company that—</text>
						<clause id="id6408C751501B41719BD08694B5BAF32F"><enum>(i)</enum><text>is
			 based in the United States; and</text>
						</clause><clause id="id50893AD26EA746F0BEDFAACDB21E9C7D"><enum>(ii)</enum><text>has worked with
			 an institution of higher education in commercializing research;</text>
						</clause></subparagraph><subparagraph id="idABD018BF098F408D871F1780B52179DB"><enum>(H)</enum><text>1 member shall be
			 a chief executive officer at an innovative and growing company that is based in
			 the United States;</text>
					</subparagraph><subparagraph id="id46E9D6C2C6BF43C8BC48B2425B75DB9B"><enum>(I)</enum><text>2 members shall
			 be individuals who work in a technology transfer office at an institution of
			 higher education;</text>
					</subparagraph><subparagraph id="idC73951CC19C24003BE15E3C3BC3E15CD"><enum>(J)</enum><text>1 member shall be
			 an individual who works in a technology transfer office at a company in the
			 technology sector that generates at least $50,000,000 in revenue
			 annually;</text>
					</subparagraph><subparagraph id="idFBECBEB797C74F2FA4CFAEB2D8B44EAC"><enum>(K)</enum><text>1 member shall be
			 a technology transfer expert to be nominated by the National Governors
			 Association;</text>
					</subparagraph><subparagraph id="id4711EE26077E4D8C81451A04BF3D55A8"><enum>(L)</enum><text>1 member shall be
			 a nationally recognized technology transfer expert who is not employed at the
			 time of their service on the Committee by a public or private institution of
			 higher education;</text>
					</subparagraph><subparagraph id="id72922E8D14D0455CB7C7572FB40AFB0C"><enum>(M)</enum><text>1 member shall be
			 nominated by the National Advisory Council on Innovation and Entrepreneurship;
			 and</text>
					</subparagraph><subparagraph id="idD46149C5980E4099AEB32182D88D054B"><enum>(N)</enum><text>1 member shall be
			 the Director of the National Science Foundation.</text>
					</subparagraph></paragraph><paragraph id="id1869D2E8C3774BE0B99F63C1426A23C2"><enum>(3)</enum><header>Chair</header>
					<subparagraph id="id112BE9B1126247C291C0468F894645E6"><enum>(A)</enum><header>In
			 general</header><text>The Director of the National Science Foundation shall
			 serve as the Chair of the Committee.</text>
					</subparagraph><subparagraph id="idA44E25D442B7465DB31B436C967DE26A"><enum>(B)</enum><header>Replacement of
			 members</header><text>The Director of the National Science Foundation, in the
			 Director's capacity as Chair of the Committee, shall appoint a replacement for
			 any member described in subparagraphs (A) through (M) of paragraph (2) who
			 leaves membership on the Committee.</text>
					</subparagraph></paragraph><paragraph commented="no" id="id872EBF8D055442E4938227A86D516BA3"><enum>(4)</enum><header>Duties</header>
					<subparagraph commented="no" id="idFE0947958F504D80B70D2126F215CC47"><enum>(A)</enum><header>Development of
			 criteria</header><text>Not later than 120 days after the Committee is
			 established and all of the members of the Committee are appointed, the
			 Committee shall convene and develop recommendations for criteria in awarding
			 grants to institutions of higher education under subsection (b).</text>
					</subparagraph><subparagraph commented="no" id="idEBDCC437F6884D3987EB2BF79B578429"><enum>(B)</enum><header>Submission to
			 Commerce and publicly released</header><text>The Committee shall—</text>
						<clause commented="no" id="id264CB22CA7924E82A4A8C5578E180434"><enum>(i)</enum><text>submit the
			 recommendations described in subparagraph (A) to the Secretary; and</text>
						</clause><clause commented="no" id="idAECFBC09AD0F40FE98F1E279E0CE4A97"><enum>(ii)</enum><text>release the
			 recommendations to the public.</text>
						</clause></subparagraph><subparagraph commented="no" id="id03619947A8654D3EB690BB93B9B1131B"><enum>(C)</enum><header>Majority
			 vote</header><text>The recommendations submitted by the Committee, as described
			 in this paragraph, shall be determined by a majority vote of Committee
			 members.</text>
					</subparagraph><subparagraph commented="no" id="id3A068B16D59D4CCC94E8B402AF6860A5"><enum>(D)</enum><header>Performance
			 metrics</header><text>The Committee shall develop and provide to the Secretary
			 recommendations on performance metrics to be used to evaluate grants awarded
			 under subsection (b).</text>
					</subparagraph></paragraph><paragraph id="idB601BE2E9F3648ABB1400DE99851F90D"><enum>(5)</enum><header>Powers</header>
					<subparagraph id="idED63B020901A4A999F9C4AD5D3215C8F"><enum>(A)</enum><header>Hearings</header><text>The
			 Committee may hold such hearings, meet and act at such times and places, take
			 such testimony, and receive such evidence as the Committee considers advisable
			 to carry out this section.</text>
					</subparagraph><subparagraph id="id351E5BE18A9E4F60A89B375B59D127B4"><enum>(B)</enum><header>Information
			 from Federal agencies</header>
						<clause id="id3847C071EF6D457AB7A6DD0CADD3997F"><enum>(i)</enum><header>In
			 general</header><text>The Committee may secure directly from a Federal agency
			 such information as the Committee considers necessary to carry out this
			 section.</text>
						</clause><clause id="id499191DBE82749499BD649C185B7148D"><enum>(ii)</enum><header>Provision of
			 information</header><text>On request of the Chair of the Committee, the head of
			 the agency shall provide the information to the Committee.</text>
						</clause></subparagraph><subparagraph id="idF1DACD3ACDE246958CD1ED07704377B3"><enum>(C)</enum><header>Postal
			 services</header><text>The Committee may use the United States mails in the
			 same manner and under the same conditions as other agencies of the Federal
			 Government.</text>
					</subparagraph></paragraph><paragraph id="idED70D2BEEE3A40BA9121DAB62FA791F2"><enum>(6)</enum><header>Committee
			 personnel matters</header>
					<subparagraph id="id9B2E770190F14DA58020F329808D4F6F"><enum>(A)</enum><header>Compensation of
			 members</header><text>Members of the Committee shall not receive any
			 compensation for service on the Committee.</text>
					</subparagraph><subparagraph id="id15557A755EFA4A209F84569E64491D06"><enum>(B)</enum><header>Travel
			 expenses</header><text>A member of the Committee shall be allowed travel
			 expenses, including per diem in lieu of subsistence, at rates authorized for an
			 employee of an agency under subchapter I of chapter 57 of title 5, United
			 States Code, while away from the home or regular place of business of the
			 member in the performance of the duties of the Committee.</text>
					</subparagraph><subparagraph id="id1C4E21EB491347DE83B0132D68190CAE"><enum>(C)</enum><header>Staff</header>
						<clause id="id0CCECB8463274A1488418020AA039094"><enum>(i)</enum><header>In
			 general</header><text>The Chair of the Committee may, without regard to the
			 civil service laws (including regulations), appoint and terminate an executive
			 director and such other additional personnel as are necessary to enable the
			 Committee to perform the duties of the Committee.</text>
						</clause><clause id="id0A23AED3E51747218309436E34FDD901"><enum>(ii)</enum><header>Confirmation
			 of executive director</header><text>The employment of an executive director
			 shall be subject to confirmation by the Committee.</text>
						</clause><clause id="id339A0F0851EC4E98ACD6B1467ABE55B1"><enum>(iii)</enum><header>Compensation</header>
							<subclause id="id2FDBCB5B3A5C4DB39AB5EFE2C3E40DC7"><enum>(I)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the Chair of the
			 Committee may fix the compensation of the executive director and other
			 personnel without regard to the provisions of chapter 51 and subchapter III of
			 chapter 53 of title 5, United States Code, relating to classification of
			 positions and General Schedule pay rates.</text>
							</subclause></clause><clause id="idAA6BC894DB53480FAC03B5908EB48A4B"><enum>(iv)</enum><header>Maximum rate
			 of pay</header><text>The rate of pay for the executive director and other
			 personnel shall not exceed the rate payable for level V of the Executive
			 Schedule under section 5316 of title 5, United States Code.</text>
						</clause></subparagraph></paragraph><paragraph id="idBE6DB299A38642149F2B0219C66D331F"><enum>(7)</enum><header>
			 Evaluation</header>
					<subparagraph id="id91EB2F37B00C44E8892C1B456C53A38D"><enum>(A)</enum><header>In
			 general</header><text>Not later than 180 days before the date that the grant
			 program authorized under subsection (b) expires, the Committee shall conduct an
			 evaluation of the effect that the grant program is having on accelerating the
			 commercialization of faculty research.</text>
					</subparagraph><subparagraph id="idD4F452A5CE7C403EA9FA4E0901828B5C"><enum>(B)</enum><header>Inclusions</header><text>The
			 evaluation shall include—</text>
						<clause id="id41F701A8B29344FDBC1F764DEC63F156"><enum>(i)</enum><text>the
			 recommendation of the Committee as to whether the grant program should be
			 continued or terminated;</text>
						</clause><clause id="idAED63FCC8F204ABEA7E48C42945270F9"><enum>(ii)</enum><text>quantitative
			 data related to the effect, if any, that the grant program has had on faculty
			 research commercialization; and</text>
						</clause><clause id="id0C399D313D434A7E94760FC892557F0E"><enum>(iii)</enum><text>a
			 description of lessons learned in administering the grant program, and how
			 those lessons could be applied to future efforts to accelerate
			 commercialization of faculty research.</text>
						</clause></subparagraph><subparagraph id="id3BC84C05447D48D498F7F5801A398D29"><enum>(C)</enum><header>Availability</header><text>Upon
			 completion of the evaluation, the evaluation shall be made available on a
			 public website and submitted to Congress. The Secretary shall notify all
			 institutions of higher education when the evaluation is published and how it
			 can be accessed.</text>
					</subparagraph></paragraph></subsection></section><section id="idB9C29054A5CA4413992230027D547A3B" section-type="subsequent-section"><enum>8.</enum><header>Conditional permanent
			 resident status for aliens with an advanced degree in a STEM field</header>
			<subsection id="H12F29ACD84D9452393D33F87B245440A"><enum>(a)</enum><header>In
			 general</header><text>Title II of the Immigration and Nationality Act (8 U.S.C.
			 1151 et seq.) is amended by inserting after section 216A the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB488C03020134D0DA49429F4FC94B271" style="OLC">
					<section id="id48987926877F4574A3645D43B854D508"><enum>216B.</enum><header>Conditional
				permanent resident status for aliens with an advanced degree in a STEM
				field</header>
						<subsection id="id1B7A4202B1B24871B535B209D48542D2"><enum>(a)</enum><header>In
				general</header><text>Notwithstanding any other provision of this Act, the
				Secretary of Homeland Security may adjust the status of not more than 50,000
				aliens who have earned a master’s degree or a doctorate degree at an
				institution of higher education in a STEM field to that of an alien
				conditionally admitted for permanent residence and authorize each alien granted
				such adjustment of status to remain in the United States—</text>
							<paragraph id="idA677880FF4E14FD5B2F11D7D58929DD0"><enum>(1)</enum><text>for up to 1 year
				after the expiration of the alien’s student visa under section 101(a)(15)(F)(i)
				if the alien is diligently searching for an opportunity to become actively
				engaged in a STEM field; and</text>
							</paragraph><paragraph id="idC024709E09DC4526BB021432DD045085"><enum>(2)</enum><text>indefinitely if
				the alien remains actively engaged in a STEM field.</text>
							</paragraph></subsection><subsection id="idA445B6DA75D74D30A2DB6B6927FB72B8"><enum>(b)</enum><header>Application for
				conditional permanent resident status</header><text>Every alien applying for a
				conditional permanent resident status under this section shall submit an
				application to the Secretary of Homeland Security before the expiration of the
				alien's student visa in such form and manner as the Secretary shall prescribe
				by regulation.</text>
						</subsection><subsection id="id3B5210F180084798AC71A5B3B0B8D6C6"><enum>(c)</enum><header>Ineligibility
				for Federal Government assistance</header><text>An alien granted conditional
				permanent resident status under this section shall not be eligible, while in
				such status, for—</text>
							<paragraph id="id54506021669C464EB999218E67081714"><enum>(1)</enum><text>any unemployment
				compensation (as defined in section 85(b) of the Internal Revenue Code of
				1986); or</text>
							</paragraph><paragraph id="id83554C60A8B945359DFDFC509E76C3E2"><enum>(2)</enum><text>any form of
				assistance or benefit described in section 403(a) of the Personal
				Responsibility and Work Opportunity Reconciliation Act of 1996 (8 U.S.C.
				1613(a)).</text>
							</paragraph></subsection><subsection id="id510FFD3D9DAF41218F06B902019F2419"><enum>(d)</enum><header>Effect on
				naturalization residency requirement</header><text>An alien granted conditional
				permanent resident status under this section shall be deemed to have been
				lawfully admitted for permanent residence for purposes of meeting the 5-year
				residency requirement set forth in section 316(a)(1).</text>
						</subsection><subsection id="id6501D635D7DC48FE834A546A1D48F580"><enum>(e)</enum><header>Removal of
				condition</header><text>The Secretary of Homeland Security shall remove the
				conditional basis of an alien’s conditional permanent resident status under
				this section on the date that is 5 years after the date such status was granted
				if the alien maintained his or her eligibility for such status during the
				entire 5-year period.</text>
						</subsection><subsection id="id0C50F9C82E0B48CE86B4C8A3569F9E0D"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="idC297EC2098C5410FB762FAF47C716B4F"><enum>(1)</enum><text>The term
				<term>actively engaged in a STEM field</term>—</text>
								<subparagraph id="id45DA32A2D8954C198068E88136B26A2B"><enum>(A)</enum><text>means—</text>
									<clause id="id9A783757064D41F081BE6A1D121CE672"><enum>(i)</enum><text>gainfully
				employed in a for-profit business or nonprofit organization in the United
				States in a STEM field;</text>
									</clause><clause id="id6554E8990DDE42C4B29AE307C17BDCE0"><enum>(ii)</enum><text>teaching 1 or
				more STEM field courses at an institution of higher education; or</text>
									</clause><clause id="id12A6D17B00264677B5D8B131B21FB07F"><enum>(iii)</enum><text>employed by a
				Federal, State, or local government entity; and</text>
									</clause></subparagraph><subparagraph id="id3022B3DA2D6A4D168B345C0BB4F2B4A7"><enum>(B)</enum><text>includes any
				period of up to 6 months during which the alien does not meet the requirement
				under subparagraph (A) if such period was immediately preceded by a 1-year
				period during which the alien met the requirement under subparagraph
				(A).</text>
								</subparagraph></paragraph><paragraph id="id2C67C781398D42A1B9D37AAA663E1A2C"><enum>(2)</enum><text>The term
				<term>institution of higher education</term> has the meaning given the term in
				section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)).</text>
							</paragraph><paragraph id="idE2CB197C3F774A9B8E7F3DC629378CFB"><enum>(3)</enum><text>The term
				<term>STEM field</term> means any field of study or occupation included on the
				most recent STEM-Designated Degree Program List published in the Federal
				Register by the Department of Homeland Security (as described in section
				214.2(f)(11)(C)(2) of title 8, Code of Federal
				Regulations).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="id3691D559B0014E1EA83CF1C93992F60A"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of contents for the Immigration and
			 Nationality Act (8 U.S.C. 1101 et seq.) is amended by inserting after the item
			 relating to section 216A the following:</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id7C7D9151D46242D39BB38A82925F134B"><enum>(c)</enum><header>Government
			 Accountability Office study</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id20CC957471474FD3AE144EF802DB4EAB"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of the enactment of
			 this Act, the Comptroller General of the United States shall submit a report to
			 Congress on the alien college graduates granted immigrant status under section
			 216B of the Immigration and Nationality Act, as added by subsection (a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id118533F7937D4C1990D95F381200C3B2"><enum>(2)</enum><header>Contents</header><text>The
			 report described in paragraph (1) shall include—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB97D684658A34B2E89BD60A38162B9C9"><enum>(A)</enum><text>the number of
			 aliens described in paragraph (1) who have earned a master’s degree, broken
			 down by the number of such degrees in science, technology, engineering, and
			 mathematics;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id68B5D1F00D1A48579D601F9015B08B34"><enum>(B)</enum><text>the number of
			 aliens described in paragraph (1) who have earned a doctorate degree, broken
			 down by the number of such degrees in science, technology, engineering, and
			 mathematics;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC88C63D3A5674E3DB3C84FAF703AA206"><enum>(C)</enum><text>the number of
			 aliens described in paragraph (1) who have founded a business in the United
			 States in a STEM field;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0953EE76D890478892B84A13829AEB6C"><enum>(D)</enum><text>the number of
			 aliens described in paragraph (1) who are employed in the United States in a
			 STEM field, broken down by employment sector (for profit, nonprofit, or
			 government); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76EC8E75DA2C4E0AB3D33D4F7E13E7A2"><enum>(E)</enum><text>the number of
			 aliens described in paragraph (1) who are employed by an institution of higher
			 education.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81EE1EF5EC7141F0A5FD97D69AB0544B"><enum>(3)</enum><header>Definitions</header><text>The
			 terms <term>institution of higher education</term> and <term>STEM field</term>
			 have the meaning given such terms in section 216B(f) of the Immigration and
			 Nationality Act, as added by subsection (a).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id1151AB38E4FF4C20A8B9A05961574AC7" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Alien entrepreneurs</header>
			<subsection commented="no" display-inline="no-display-inline" id="id86EBA4F114674F2F818B1548247F0E0A"><enum>(a)</enum><header>Qualified alien
			 entrepreneurs</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id4046A0F2D122469EB5F397D1D9331F57"><enum>(1)</enum><header>Admission as
			 immigrants</header><text display-inline="yes-display-inline">Chapter 1 of title
			 II of the Immigration and Nationality Act (8 U.S.C. 1151 et seq.) is amended by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id98CA76B784BE4625ACEAF159EFB83A44" style="OLC">
						<section commented="no" display-inline="no-display-inline" id="id8168483E42334BCFA1D27ECDBD2C733A"><enum>210A.</enum><header>Qualified
				alien entrepreneurs</header>
							<subsection commented="no" display-inline="no-display-inline" id="idDB7CEF6CEC9B431385BEF40A7A14EB98"><enum>(a)</enum><header>Admission as
				immigrants</header><text>The Secretary of Homeland Security, in accordance with
				the provisions of this section and section 216A, may issue a conditional
				immigrant visa to not more than 75,000 qualified alien entrepreneurs.</text>
							</subsection><subsection id="idD1484E45F03A4B9D9743DD5AC98B617B"><enum>(b)</enum><header>Application for
				conditional permanent resident status</header><text>Every alien applying for a
				conditional immigrant visa under this section shall submit an application to
				the Secretary of Homeland Security in such form and manner as the Secretary
				shall prescribe by regulation.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id18F5EB37198E445396D89ABE3267391D"><enum>(c)</enum><header display-inline="yes-display-inline">Revocation</header><text>If, during the
				4-year period beginning on the date that an alien is granted a visa under this
				section, the Secretary of Homeland Security determines that such alien is no
				longer a qualified alien entrepreneur, the Secretary shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idC7E7DA222F884908BDCE6DB47ADF3A97"><enum>(1)</enum><text>revoke such visa;
				and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC2A661F74F2546ADB1F801A03416EB20"><enum>(2)</enum><text>notify the alien
				that the alien—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id800BF4F2730B415985D6FE72BC0C0A78"><enum>(A)</enum><text>may voluntarily
				depart from the United States in accordance to section 240B; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAE7340E60B3241319273D87A6EEC0274"><enum>(B)</enum><text>will be subject
				to removal proceedings under section 240 if the alien does not depart from the
				United States not later than 6 months after receiving such notification.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id90ED8A09C27C436B94BF3DDD82A344DA"><enum>(d)</enum><header>Removal of
				conditional basis</header><text>The Secretary shall remove the conditional
				basis of the status of an alien issued an immigrant visa under this section on
				that date that is 4 years after the date on which such visa was issued if such
				visa was not revoked pursuant to subsection (c).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idFF1F9DD27F7C40DDA8CC0AAB2EFA9340"><enum>(e)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idDB10AFDC4E6A4DC593456C0F3259659A"><enum>(1)</enum><text>The term
				<term>full-time employee</term> means a United States citizen or legal
				permanent resident who is paid by the new business entity registered by a
				qualified alien entrepreneur at a rate that is comparable to the median income
				of employees in the region.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1DC6B78252F04130B246C8FD5C575F3F"><enum>(2)</enum><text>The term
				<term>institution of higher education</term> has the meaning given the term in
				section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDB29180C5BC24041A50069E942316CC1"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>qualified alien
				entrepreneur</term> means an alien who—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id147BCABE7FB14CD3B637FCF9E73A6CC9"><enum>(A)</enum><text display-inline="yes-display-inline">at the time the alien applies for an
				immigrant visa under this section—</text>
										<clause commented="no" display-inline="no-display-inline" id="id324FF25BDD1C4C55B9C2E917AE234FDE"><enum>(i)</enum><text display-inline="yes-display-inline">is lawfully present in the United
				States;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id951AF64D6F0E41FC998C05DADDF27203"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id8F6821250DD0402C85C91ECEF2D70804"><enum>(I)</enum><text display-inline="yes-display-inline">holds a nonimmigrant visa pursuant to
				section 101(a)(15)(H)(i)(b); or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="id436309AC1D1745B8844936CB8583E156" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">has completed or will complete a graduate
				level degree in a STEM field from an institution of higher education;</text>
											</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id59C7873ABE5349E5950CC8681156D922"><enum>(B)</enum><text display-inline="yes-display-inline">during the 1-year period beginning on the
				date the alien is granted a visa under this section—</text>
										<clause commented="no" display-inline="no-display-inline" id="id724FC3070B994DCA88776D55DF1C5287"><enum>(i)</enum><text display-inline="yes-display-inline">registers at least 1 new business entity in
				a State;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id293EB2801B8643AE8D183B19AEE83267"><enum>(ii)</enum><text display-inline="yes-display-inline">employs, at such business entity in the
				United States, at least 2 full-time employees who are not relatives of the
				alien; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id33EAFF93A3244A93999EF8C3EEB91E08"><enum>(iii)</enum><text>invests, or
				raises capital investment of, not less than $100,000 in such business entity;
				and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCFB0198119AA4EAFA7E4D43AD721ECE1"><enum>(C)</enum><text display-inline="yes-display-inline">during the 3-year period beginning on the
				last day of the 1-year period described in paragraph (2), employs, at such
				business entity in the United States, an average of at least 5 full-time
				employees who are not relatives of the alien.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC4FF22C0F0FD44A2A6981ECF8AE2AA78"><enum>(4)</enum><text>The term
				<term>STEM field</term> means any field of study or occupation included on the
				most recent STEM-Designated Degree Program List published in the Federal
				Register by the Department of Homeland Security (as described in section
				214.2(f)(11)(C)(2) of title 8, Code of Federal
				Regulations).</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idEE64F3045B964DCFB068C2540D01C30F"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of the enactment of
			 this Act, the Comptroller General of the United States shall submit a report to
			 Congress on the qualified alien entrepreneurs granted immigrant status under
			 section 210A of the Immigration and Nationality Act, as added by subsection
			 (a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id808A0C3EADD24C8C999FDA228CD84CFC"><enum>(2)</enum><header>Contents</header><text>The
			 report described in paragraph (1) shall include information regarding—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id885F329EF4C84390A0F9515E4F38CA88"><enum>(A)</enum><text>the number of
			 qualified alien entrepreneurs who have received immigrant status under section
			 210A of the Immigration and Nationality Act, as added by subsection (a), listed
			 by country of origin;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA83A94634987474380A20DBADA6047DF"><enum>(B)</enum><text>the localities in
			 which such qualified alien entrepreneurs have initially settled;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id219BD224D5104794A1F2A84607E243CA"><enum>(C)</enum><text>whether such
			 qualified alien entrepreneurs generally remain in the localities in which they
			 initially settle;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0764D8F044B04E309D7E0336A5D89F42"><enum>(D)</enum><text>the types of
			 commercial enterprises that such qualified alien entrepreneurs have
			 established; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB038C34BE4BE4BA8B4FA0DABDFAF68EF"><enum>(E)</enum><text>the types and
			 number of jobs created by such qualified alien entrepreneurs.</text>
					</subparagraph></paragraph></subsection></section><section id="id0B7D01C8F40E4D05A69CD0D0C67299C9" section-type="subsequent-section"><enum>10.</enum><header>Biennial State
			 startup business report</header>
			<subsection id="id8B0EA50E01144AD5BE44051796C6EA37"><enum>(a)</enum><header>Data
			 collection</header><text display-inline="yes-display-inline">The Secretary of
			 Commerce shall regularly compile information from each of the 50 States and the
			 District of Columbia on State laws that affect the formation and growth of new
			 businesses within the State or District.</text>
			</subsection><subsection id="id216E3608153940709C287101DE8883DB"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 the enactment of this Act, and every 2 years thereafter, the Secretary, using
			 data compiled under subsection (a), shall prepare a report that—</text>
				<paragraph id="idFC3C29048FF342EBA8CB87A497E684F6"><enum>(1)</enum><text display-inline="yes-display-inline">analyzes the economic effect of State and
			 District laws that either encourage or inhibit business formation and growth;
			 and</text>
				</paragraph><paragraph id="id5F5C8B6353C24CD299C404CC3F55D610"><enum>(2)</enum><text>ranks the States
			 and the District based on the effectiveness with which their laws foster new
			 business creation and economic growth.</text>
				</paragraph></subsection><subsection id="id4A8F4B1341484FF68624FBDF5C2A3D4C"><enum>(c)</enum><header>Distribution</header><text>The
			 Secretary shall—</text>
				<paragraph id="idD47C5AC691DA4CFFAE095F272F3E0CCE"><enum>(1)</enum><text>submit each
			 report prepared under subsection (b) to Congress; and</text>
				</paragraph><paragraph id="id5A8DCC1B3F864C5BAE079AEA8BD0B1A1"><enum>(2)</enum><text>make each report
			 available to the public on the Department of Commerce’s website.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id776011B17F854358B672DB0A79789B9B"><enum>(d)</enum><header>Inclusion of
			 large metropolitan areas</header><text>Not later than 90 days after the
			 submission of the first report under this section, the Secretary of Commerce
			 shall submit to Congress a study on the feasibility and advisability of
			 including, in future reports, information about the effect of local laws and
			 ordinances on the formation and growth of new businesses in large metropolitan
			 areas within the United States.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idE7D342E853AA411BBCA956A112872737"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 section.</text>
			</subsection></section><section id="id5A8025E36EE5489EA2F244FEAB0C30DB"><enum>11.</enum><header>New business
			 formation report</header>
			<subsection id="id3B327B72649C4926A35410C92E9BD36C"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Commerce shall regularly compile
			 quantitative and qualitative information on businesses in the United States
			 that are not more than 1 year old.</text>
			</subsection><subsection id="ID2d7c99f5704445b7a9e6996a04ca6024"><enum>(b)</enum><header>Data
			 collection</header><text>The Secretary shall—</text>
				<paragraph id="IDd968c8ca080141ed8b378a3f1d0b9f46"><enum>(1)</enum><text>regularly compile
			 information from the Bureau of the Census’ business register on new business
			 formation in the United States; and</text>
				</paragraph><paragraph id="id867F9FD41B824171908FE7ED41C54D49"><enum>(2)</enum><text>conduct quarterly
			 surveys of business owners who start a business during the 1-year period ending
			 on the date on which such survey is conducted to gather qualitative information
			 about the factors that influenced their decision to start the business.</text>
				</paragraph></subsection><subsection id="id9BBFFB500BE24D5EAF443A80571027AF"><enum>(c)</enum><header>Random
			 sampling</header><text>In conducting surveys under subsection (b)(2), the
			 Secretary may use random sampling to identify a group of business owners who
			 are representative of all the business owners described in subsection
			 (b)(2).</text>
			</subsection><subsection id="id554AFE3A9A7449E5B66E765C97805FE5"><enum>(d)</enum><header>Benefits</header><text>The
			 Secretary shall inform business owners selected to participate in a survey
			 conducted under this section of the benefits they would receive from
			 participating in the survey.</text>
			</subsection><subsection id="id0A02C7FEA1A945E3B245AA3A0E476895"><enum>(e)</enum><header>Voluntary
			 participation</header><text>Business owners selected to participate in a survey
			 conducted under this section may decline to participate without penalty.</text>
			</subsection><subsection id="id320C2BB4C9F2454584803E369369C82A"><enum>(f)</enum><header>Report</header><text>Not
			 later than 18 months after the date of the enactment of this Act, and every 3
			 months thereafter, the Secretary shall use the data compiled under subsection
			 (b) to prepare a report that—</text>
				<paragraph id="idB20E3446B83B46E48CCBB598858371BC"><enum>(1)</enum><text>lists the
			 aggregate number of new businesses formed in the United States;</text>
				</paragraph><paragraph id="ID5fbe87377a714dab8b2ee60edeb154b1"><enum>(2)</enum><text>lists the
			 aggregate number of persons employed by new businesses formed in the United
			 States;</text>
				</paragraph><paragraph id="ID9190694aaeba4aad81322c598c98093f"><enum>(3)</enum><text>analyzes the
			 payroll of new businesses formed in the United States;</text>
				</paragraph><paragraph id="idE5CB23297E14494AA9D95CB407F066C6"><enum>(4)</enum><text>summarizes the
			 data collected under subsection (b); and</text>
				</paragraph><paragraph id="id1CBAAA9570054B89AE7CB0A3EF65D3E1"><enum>(5)</enum><text>identifies the
			 most effective means by which government officials can encourage the formation
			 and growth of new businesses in the United States.</text>
				</paragraph></subsection><subsection id="idF6A57F6903F9411EA3ABEC5317FCDA6C"><enum>(g)</enum><header>Distribution</header><text>The
			 Secretary shall—</text>
				<paragraph id="id2A58CBF242CA4E46B007FB26303F4611"><enum>(1)</enum><text>submit each
			 report prepared under subsection (f) to Congress; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF05573FEBB3444928D998873C9BECEFC"><enum>(2)</enum><text>make each report
			 available to the public on the Department of Commerce’s website.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCA5FCBDFDDFB4EF390A5A79981F71A70"><enum>(h)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 section.</text>
