			 Cooperative Freight Research Program</header><text display-inline="no-display-inline">Section 509(d) of title 23, United States
			 Code, is amended by adding at the end the following:</text>

				cooperative research</header><text>The National Academy of Sciences shall
				coordinate research agendas, research project selections, and competitions
				across all transportation-related cooperative research programs conducted by
				the National Academy of Sciences to ensure program efficiency, effectiveness,
				and sharing of research
				findings.</text>

		</section><section id="IDf5d4dee167d545b9978c482d4ec5498d"><enum>3.</enum><header>Multimodal
			 Innovative Research Program</header>
			<subsection id="ID2bc4ec7729c147099e63c8c82baef4e7"><enum>(a)</enum><header>In
			 general</header><text>Subchapter I of chapter 55 of title 49, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idDF658D91EA9947DDB26DAFD97F99C2AF" style="USC">
					<section id="id75637D5E1701496487C0B09140E8E615"><enum>5507.</enum><header>Multimodal
				Innovative Research Program</header>
						<subsection id="idCCECEF85B7DF4D38B8720BFF6ED95511"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary of Transportation shall establish a Multimodal Innovative Research
				Program (referred to in this section as the <quote>Program</quote>) in the
				Research and Innovative Technology Administration.</text>
						</subsection><subsection id="ID119b966b9c6c4b69a8f54e20f6ba683f"><enum>(b)</enum><header>Purpose</header><text>The
				Program shall support—</text>
							<paragraph id="IDe0c40fbf122045e6a80d22c8f9afea8c"><enum>(1)</enum><text>national
				transportation policy, objectives, and goals by applying state-of-the-art
				advanced technology solutions to multimodal transportation issues; and</text>
							</paragraph><paragraph id="IDc746c3a3bf194c65a0a8945276a6298e"><enum>(2)</enum><text>key partnerships
				throughout the Department of Transportation and with other Federal agencies to
				fully leverage their investments in transportation research and technology
				developments to address transportation problems at modal interfaces or
				affecting more than 1 transportation mode.</text>
							</paragraph></subsection><subsection id="ID8939d69dfa884ea3b47a345a4bb23b6d"><enum>(c)</enum><header>Content</header><text>The
				Program shall—</text>
							<paragraph id="IDd3ce01f4f7b04e25b8ff2c340ba45310"><enum>(1)</enum><text>address issues
				affecting—</text>
								<subparagraph id="id2652D7DDC20A4A0AA3F94A081E293692"><enum>(A)</enum><text>policy;</text>
								</subparagraph><subparagraph id="id95469E08B8E945CB82961C7E85AC84B7"><enum>(B)</enum><text>cross-modal
				concerns, such as efficient and intermodal goods and passenger
				movements;</text>
								</subparagraph><subparagraph id="idBBEAA080FFD44E70A52AA3A37615CDD0"><enum>(C)</enum><text>the development
				of advanced vehicle technologies;</text>
								</subparagraph><subparagraph id="idC4C0FAD4DE96497FA76841206D6D58CC"><enum>(D)</enum><text>the application
				of existing technologies; and</text>
								</subparagraph><subparagraph id="id9F96A9EB620C44E9BC47BD0863867DAD"><enum>(E)</enum><text>the integration
				of multimodal real-time transportation information systems;</text>
								</subparagraph></paragraph><paragraph id="IDa4b4c2c0fec645f583e1d33c4cde2bdb"><enum>(2)</enum><text>competitively
				award contracts or cooperative agreements for advanced multimodal
				transportation research to facilitate practical innovative approaches to solve
				transportation problems related to attaining—</text>
								<subparagraph id="idB4362986E95D48CD964C582D8B5E5258"><enum>(A)</enum><text>the strategic
				goals of the Department of Transportation; and</text>
								</subparagraph><subparagraph id="idDDBC33D2F8FE41A3BC4C8C93C0BBB678"><enum>(B)</enum><text>multimodal
				elements of the Transportation Research and Development Strategic Plan required
				under section 508 of title 23;</text>
								</subparagraph></paragraph><paragraph id="IDb2d5f9c15d7b4f84ab55e829ee42096e"><enum>(3)</enum><text>demonstrate
				transportation system applications of advanced transportation technologies,
				methodologies, policies, and decisions;</text>
							</paragraph><paragraph id="ID5ed8ff3641554ee680686bdf63a02c0a"><enum>(4)</enum><text>disseminate best
				practices in planning, operations, design, and maintenance of transportation
				and related systems; and</text>
							</paragraph><paragraph id="ID48bee42fbb9948548b1f25f23aa5851f"><enum>(5)</enum><text>provide
				technology identification, modification, and dissemination through outreach to
				other Federal agencies, State and local transportation agencies, and other
				public, private, and academic stakeholders in the industry.</text>
							</paragraph></subsection><subsection id="ID8f688b088ece4b8989d1e51ea46be591"><enum>(d)</enum><header>Coordination</header><text>The
				Secretary of Transportation shall coordinate activities under this section with
				other Federal agencies, as appropriate.</text>
						</subsection><subsection id="ID148c17f6355944b3aab500c4bd30fbd6"><enum>(e)</enum><header>Funding</header>
							<paragraph id="id79197AB0352A44C5963ED8CEC9F74B7F"><enum>(1)</enum><header>In
				general</header><text>Of the amounts appropriated pursuant to section 11 of the
				<short-title>Research and Innovative Technology
				Administration Reauthorization Act of 2011</short-title>, $20,000,000 shall be
				made available for each of the fiscal year 2012 and 2013 to establish and
				maintain the Multimodal Innovative Research Program.</text>
							</paragraph><paragraph id="ID2fefefbbd60e4341989d7d76e95c005e"><enum>(2)</enum><header>Management and
				oversight</header><text>During each of the fiscal years 2012 and 2013, the
				Secretary of Transportation may not expend more than 1.5 percent of the amounts
				made available under paragraph (1) to carry out management and oversight of the
				Multimodal Innovative Research
				Program.</text>

						<subchapter id="idE993A9362D524EC8A4FE7E024AFAC0A8"><enum>I</enum><header>Bureau of
				Transportation Statistics</header>
							<section id="ID1a55b08472c24642b8b578314ccbc9fb"><enum>6301.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established, in the Research and
				Innovative Technology Administration, a Bureau of Transportation Statistics
				(referred to in this subchapter as the <quote>Bureau</quote>).</text>
							</section><section id="ID28791cf40258403580539e614f711c6e"><enum>6302.</enum><header>Director</header>
								<subsection id="ID94910b8949a6437ca4a578c5bb2afca3"><enum>(a)</enum><header>Appointment</header><text>The
				Bureau shall be headed by a Director, who shall be appointed in the competitive
				service by the Secretary of Transportation.</text>
								</subsection><subsection id="ID991b4bb1bff046b1ba6c5dc6adffd2dc"><enum>(b)</enum><header>Qualifications</header><text>The
				Director shall be appointed from among individuals who are qualified to serve
				as the Director by virtue of their training and experience in the collection,
				analysis, and use of transportation statistics.</text>
								</subsection></section><section id="ID602d800fa64a48d68da0c8e0419af4af"><enum>6303.</enum><header>Responsibilities</header>
								<subsection id="ID8d0c85985aa44f4bba221c83d1eafb55"><enum>(a)</enum><header>Duties of the
				Director</header><text>The Director, who shall serve as the Secretary of
				Transportation’s senior advisor on data and statistics, shall be responsible
				for carrying out the following duties:</text>
									<paragraph id="ID5362377b64f643fda8124a9c908212eb"><enum>(1)</enum><text>Ensuring that the
				statistics compiled under paragraph (6) are designed to support transportation
				decisionmaking by the Federal Government, State and local governments,
				metropolitan planning organizations, transportation-related associations, the
				private sector (including the freight community), and the public.</text>
									</paragraph><paragraph id="ID6fcc57d1ed334f40b7c020283c37943e"><enum>(2)</enum><text>Establishing a
				program, on behalf of the Secretary—</text>
										<subparagraph id="id3E183C1D977345BAB7F692353065CEAD"><enum>(A)</enum><text>to effectively
				integrate safety data across modes; and</text>
										</subparagraph><subparagraph id="id0F92AA7F41CC49769579AA6558DFFCE7"><enum>(B)</enum><text>to address gaps
				in existing safety data programs of the Department of Transportation.</text>
										</subparagraph></paragraph><paragraph id="ID50cff151f2a1421aaca0054d8e343c92"><enum>(3)</enum><text>Working with the
				operating administrations of the Department of Transportation—</text>
										<subparagraph id="idD5A4D59D6AE44CF9A9EAA68E61FDCD1B"><enum>(A)</enum><text>to establish and
				implement the Bureau’s data programs; and</text>
										</subparagraph><subparagraph id="id4B49CC637ADC45F9B2946197119E9351"><enum>(B)</enum><text>to improve the
				coordination of information collection efforts with other Federal
				agencies.</text>
										</subparagraph></paragraph><paragraph id="ID9d618050269b4e0aaf0952d700cbf426"><enum>(4)</enum><text>Continually
				improving surveys and data collection methods to improve the accuracy and
				utility of transportation statistics.</text>
									</paragraph><paragraph id="ID213564058bd54cda84e52128807d6aef"><enum>(5)</enum><text>Encouraging the
				standardization of data, data collection methods, and data management and
				storage technologies for data collected by the Bureau, the operating
				administrations of the Department of Transportation, States, local governments,
				metropolitan planning organizations, and private sector entities.</text>
									</paragraph><paragraph id="IDaf33aeda49564d3a8c39b57b079b4eaf"><enum>(6)</enum><text>Collecting,
				compiling, analyzing, and publishing a comprehensive set of transportation
				statistics on the performance and impacts of the national transportation
				system, including statistics on—</text>
										<subparagraph id="ID9d3c9fc8e86f4e1483c2b8d24753da1f"><enum>(A)</enum><text>transportation
				safety across all modes and intermodally;</text>
										</subparagraph><subparagraph id="ID6cb1e81c14a74e19bed19bb70755a471"><enum>(B)</enum><text>the state of good
				repair of United States transportation infrastructure.</text>
										</subparagraph><subparagraph id="ID9bb90450cc07428f8b5c114f4f399170"><enum>(C)</enum><text>the extent,
				connectivity, and condition of the transportation system, building on the
				national transportation atlas database developed under section 6312;</text>
										</subparagraph><subparagraph id="ID1e808004484d48779bfd4c44f48a3f8c"><enum>(D)</enum><text>economic
				efficiency throughout the entire transportation sector;</text>
										</subparagraph><subparagraph id="ID425e907be3a3484cbce311e495ab1ef4"><enum>(E)</enum><text>the effects of
				the transportation system on global and domestic economic
				competitiveness;</text>
										</subparagraph><subparagraph id="ID8f9acd660ff548dd85f6938d4cae1b00"><enum>(F)</enum><text>demographic,
				economic, and other variables influencing travel behavior, including choice of
				transportation mode and goods movement;</text>
										</subparagraph><subparagraph id="ID42339771dcc44079a1fefa5f5ee41580"><enum>(G)</enum><text>transportation-related
				variables that influence the domestic economy and global
				competitiveness;</text>
										</subparagraph><subparagraph id="IDa181ec6980304411b7cbc7f14c1b8a95"><enum>(H)</enum><text>the economic
				costs and impacts for passenger travel and freight movement;</text>
										</subparagraph><subparagraph id="ID7b397c673b0c4d4b8e13f890423a7ad2"><enum>(I)</enum><text>intermodal and
				multimodal passenger movement;</text>
										</subparagraph><subparagraph id="IDfee7e017a7ca4901ab08555c16a04fc0"><enum>(J)</enum><text>intermodal and
				multimodal freight movement; and</text>
										</subparagraph><subparagraph id="ID2f0de363749c49ef9d8c006b64136065"><enum>(K)</enum><text>the consequences
				of transportation for the human and natural environment, sustainable
				transportation, and livable communities.</text>
										</subparagraph></paragraph><paragraph id="ID419cb57d2873425d997945146b9afd2b"><enum>(7)</enum><text>Building and
				disseminating the transportation layer of the National Spatial Data
				Infrastructure developed under Executive Order 12906, including—</text>
										<subparagraph id="idDB987FF13E0E4DF8BBB4BF31343D901F"><enum>(A)</enum><text>coordinating the
				development of transportation geospatial data standards;</text>
										</subparagraph><subparagraph id="id36827155FE3345F286914EFAAFB3A874"><enum>(B)</enum><text>compiling
				intermodal geospatial data; and</text>
										</subparagraph><subparagraph id="idF75C085F9D224696A39F5C815C1FC4C8"><enum>(C)</enum><text>collecting
				geospatial data that is not being collected by others.</text>
										</subparagraph></paragraph><paragraph id="IDaa39f48996fc4e02b6196a34abb69a6d"><enum>(8)</enum><text>Issuing
				guidelines for the collection of information by the Department of
				Transportation that is required for transportation statistics, modeling,
				economic assessment, and program assessment in order to ensure that such
				information is accurate, reliable, relevant, uniform and in a form that permits
				systematic analysis by the Department.</text>
									</paragraph><paragraph id="ID3e6d39fd41894ac7b195221762bfca41"><enum>(9)</enum><text>Reviewing and
				reporting to the Secretary of Transportation on the sources and reliability
				of—</text>
										<subparagraph id="idC79FD891EA72431D800C261E90625C7E"><enum>(A)</enum><text>the statistics
				proposed by the heads of the operating administrations of the Department of
				Transportation to measure outputs and outcomes, as required by the Government
				Performance and Results Act of 1993 (Public Law 103–62; 107 Stat. 285);
				and</text>
										</subparagraph><subparagraph id="idBF4D7F2FD24F4BC3A774E45AB776C09A"><enum>(B)</enum><text>other data
				collected or statistical information published by the heads of the operating
				administrations of the Department.</text>
										</subparagraph></paragraph><paragraph id="ID8ad4470072e3401c89b810dd722025e6"><enum>(10)</enum><text>Making the
				statistics published under this subsection readily accessible to the public,
				consistent with applicable security constraints and confidentiality
				interests.</text>
									</paragraph></subsection><subsection id="IDeb3a229b36aa420881adcc7a4c7a5cb2"><enum>(b)</enum><header>Access to
				Federal data</header><text>In carrying out subsection (a)(2), the Director
				shall be provided access to—</text>
									<paragraph id="id2C6B052E373946DF94E3698416BB95D8"><enum>(1)</enum><text>all safety data
				held by any agency of the Department; and</text>
									</paragraph><paragraph id="id92025B6223B448B08ED58BD9A6F8F140"><enum>(2)</enum><text>all safety data
				held by any other Federal Government agency that is germane to carrying out
				subsection (a), upon written request and subject to any statutory or regulatory
				restrictions.</text>
									</paragraph></subsection><subsection id="IDc35a92f0a1a84f3b957cf80e82869fca"><enum>(c)</enum><header>Intermodal
				transportation database</header>
									<paragraph id="id0C2D6DD2CD524A1F8109FDBBB62147A9"><enum>(1)</enum><header>In
				general</header><text>In consultation with the Under Secretary for Policy, the
				Assistant Secretaries, and the heads of the operating administrations of the
				Department of Transportation, the Director shall establish and maintain a
				transportation database for all modes of transportation.</text>
									</paragraph><paragraph id="ID00193093ce1749eaa963a1958859cd2b"><enum>(2)</enum><header>Use of
				database</header><text>The database established under this subsection shall be
				suitable for analyses carried out by the Federal Government, the States, and
				metropolitan planning organizations.</text>
									</paragraph><paragraph id="ID67055a5de83142368994519744796ca6"><enum>(3)</enum><header>Contents</header><text>The
				database established under this section shall include—</text>
										<subparagraph id="ID992ae164522f48618f60389b66d7eeb4"><enum>(A)</enum><text>information on
				the volumes and patterns of movement, including local, interregional, and
				international movement—</text>
											<clause id="id559EAA9783D54C43A4D404524AC4609B"><enum>(i)</enum><text>of goods by all
				modes of transportation and intermodal combinations, and by relevant
				classification; and</text>
											</clause><clause id="ID5cd396e1e69d4c1bb6fa60a2a7d71d00"><enum>(ii)</enum><text>of people by all
				modes of transportation (including bicycle and pedestrian modes) and intermodal
				combinations, and by relevant classification;</text>
											</clause></subparagraph><subparagraph id="IDa5f504f796a840a88aacc9b2d6fee8ca"><enum>(B)</enum><text>information on
				the location and connectivity of transportation facilities and services;
				and</text>
										</subparagraph><subparagraph id="IDff45e84f32ca4ef680b5f37134edc987"><enum>(C)</enum><text>a national
				accounting of expenditures and capital stocks on each mode of transportation
				and intermodal combination.</text>
										</subparagraph></paragraph></subsection></section><section id="ID26c18529db8c4b03891c5715650b7971"><enum>6304.</enum><header>National
				Transportation Library</header>
								<subsection id="IDffea13331e4b428d968d80516ca1d899"><enum>(a)</enum><header>Purpose and
				establishment</header><text>There is established, in the Bureau, a National
				Transportation Library (referred to in this section as the
				<quote>Library</quote>), which shall—</text>
									<paragraph id="ID7a1a5e72e606440bae9a450a7b781405"><enum>(1)</enum><text>support the
				information management and decisionmaking needs of transportation at Federal,
				State, and local levels;</text>
									</paragraph><paragraph id="id30698E6D14E14BF79FD2470A0C2C99B2"><enum>(2)</enum><text>be headed by an
				individual who is highly qualified in library and information science;</text>
									</paragraph><paragraph id="ID9ab05b5ac996479f98e8a57a6b13332c"><enum>(3)</enum><text>acquire,
				preserve, and manage transportation information and information products and
				services for use of the Department of Transportation, other Federal agencies,
				and the general public;</text>
									</paragraph><paragraph id="ID8295587be63242efb9aabb241a09d6a4"><enum>(4)</enum><text>provide reference
				and research assistance;</text>
									</paragraph><paragraph id="ID0bbb69d461904e7ba29e5541382f9272"><enum>(5)</enum><text>serve as a
				central depository for research results and technical publications of the
				Department of Transportation;</text>
									</paragraph><paragraph id="IDb107452b9cd440fd900a58f43aab601a"><enum>(6)</enum><text>provide a central
				clearinghouse for transportation data and information in the Federal
				Government;</text>
									</paragraph><paragraph id="IDaf4105d5015e4751b6e6a7c4b57c614d"><enum>(7)</enum><text>serve as
				coordinator and policy lead for transportation information access;</text>
									</paragraph><paragraph id="ID5ca250855e2441bdae348bc4102c08eb"><enum>(8)</enum><text>provide
				transportation information and information products and services to the
				Department of Transportation, other agencies of the Federal Government, public
				and private organizations, and individuals, within the United States and
				internationally;</text>
									</paragraph><paragraph id="IDb44d1f366b3843cf92d144a746b52f6c"><enum>(9)</enum><text>coordinate
				efforts among, and cooperate with, transportation libraries, information
				providers, and technical assistance centers, in conjunction with private
				industry and other transportation library and information centers, toward the
				development of a comprehensive transportation information and knowledge network
				supporting activities described in subparagraphs (A) through (K) of section
				6303(a)(6); and</text>
									</paragraph><paragraph id="ID58709eeec310420cbada24ec1927f886"><enum>(10)</enum><text>engage in such
				other activities as the Director determines appropriate and as the Library’s
				resources permit.</text>
									</paragraph></subsection><subsection id="ID703cebc46ec74a6998faddf19304330b"><enum>(b)</enum><header>Access</header><text>The
				Director shall publicize, facilitate, and promote access to the information
				products and services described in subsection (a) to improve—</text>
									<paragraph id="id15DE34E8A4B5463897B3796C1F5AFB01"><enum>(1)</enum><text>the ability of
				the transportation community to share information; and</text>
									</paragraph><paragraph id="id2683E11F34D14049A90E65565C2D7088"><enum>(2)</enum><text>the ability of
				the Director to make statistics and other information readily accessible under
				section 6303(a)(10).</text>
									</paragraph></subsection><subsection id="IDffe66c9fe8e548b28746347ade73dd97"><enum>(c)</enum><header>Agreements</header>
									<paragraph id="ID094ca27b69ee40a6953c750a277a50d1"><enum>(1)</enum><header>In
				general</header><text>The Director may enter into agreements with, award grants
				to, and receive funds from any State and other political subdivision,
				organization, business, or individual for the purpose of conducting activities
				under this section.</text>
									</paragraph><paragraph id="IDb2fafd55c2d445a883c0361c0613f4d0"><enum>(2)</enum><header>Contracts,
				grants, and agreements</header><text>The Library may initiate and support
				specific information and data management, access, and exchange activities in
				connection with matters relating to Department of Transportation's strategic
				goals, knowledge networking, and national and international cooperation by
				entering into contracts or awarding grants for the conduct of such
				activities.</text>
									</paragraph><paragraph id="ID41219fbdb06f47448cbba165d6d97e6c"><enum>(3)</enum><header>Funds</header><text>Amounts
				received under this subsection for payments for library products and services
				or other activities shall—</text>
										<subparagraph id="id7447B615FD9749398A0214D76D1E8508"><enum>(A)</enum><text>be deposited in
				the Research and Innovative Technology Administration's general fund account;
				and</text>
										</subparagraph><subparagraph id="id573B6CC1BC654FFDAA41BDB8D488D574"><enum>(B)</enum><text>remain available
				to the Library until expended.</text>
										</subparagraph></paragraph></subsection></section><section id="ID83a151ce36d64212ba780dac6c8a9810"><enum>6305.</enum><header>Advisory
				Council on Transportation Statistics</header>
								<subsection id="ID45f8f7e91ca34d2dae9ac30f35e4e45e"><enum>(a)</enum><header>In
				general</header><text>The Director shall maintain an Advisory Council on
				Transportation Statistics (referred to in this section as the <quote>Advisory
				Council</quote>).</text>
								</subsection><subsection id="ID4c957e4319354a1a92d68978754bf6ed"><enum>(b)</enum><header>Function</header><text>The
				Advisory Council shall advise the Director on—</text>
									<paragraph id="ID3197b9f55b184fba8e64281a6bcce271"><enum>(1)</enum><text>the quality,
				reliability, consistency, objectivity, and relevance of transportation
				statistics and analyses collected, supported, or disseminated by the Bureau and
				the Department of Transportation; and</text>
									</paragraph><paragraph id="ID8f125f6d627042d9869fd3f05f7ca9c9"><enum>(2)</enum><text>methods to
				encourage cooperation and interoperability of transportation data collected by
				the Bureau, the operating administrations of the Department, States, local
				governments, metropolitan planning organizations, and private sector
				entities.</text>
									</paragraph></subsection><subsection id="IDe3430f17a4a04cb887671325dab16680"><enum>(c)</enum><header>Membership</header>
									<paragraph id="idD935E55B79F749B09A2BD16CF30FA67B"><enum>(1)</enum><header>In
				general</header><text>The Advisory Council shall be composed of not fewer than
				9 members and not more than 11 members, who shall be appointed by the
				Director.</text>
									</paragraph><paragraph id="idDAC797B2C15D49339DDA6CDD07186A96"><enum>(2)</enum><header>Selection</header><text>In
				selecting members for the Advisory Council, the Director shall appoint
				individuals who—</text>
										<subparagraph id="id367F704BA1554DB58C056117765B095B"><enum>(A)</enum><text>are not officers
				or employees of the United States;</text>
										</subparagraph><subparagraph id="id5010BFBC705F47339ADCFD41B27DB528"><enum>(B)</enum><text>possess expertise
				in—</text>
											<clause id="id7AC409654F2748D5824CBBA437B8958E"><enum>(i)</enum><text>transportation
				data collection, analysis, or application;</text>
											</clause><clause id="idD59B91AC433A4FF394E51F2662D0279A"><enum>(ii)</enum><text>economics;
				or</text>
											</clause><clause id="id00690331BADA4D269CAE0A1F43B92F05"><enum>(iii)</enum><text>transportation
				safety; and</text>
											</clause></subparagraph><subparagraph id="id0525022979714CC5A8E57F839DA95C0D"><enum>(C)</enum><text>represent a cross
				section of transportation stakeholders, to the greatest extent possible.</text>
										</subparagraph></paragraph><paragraph id="ID7231e9615b9a487490df2134e65a95bc"><enum>(3)</enum><header>Terms of
				appointment</header>
										<subparagraph id="ID8798b27b9df942cbbec99deac7cb9116"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), members of the
				Advisory Council—</text>
											<clause id="idEBA11A56C1DB4641B25A43D81796C2F4"><enum>(i)</enum><text>shall be
				appointed to staggered terms not to exceed 3 years; and</text>
											</clause><clause id="idC89601F07C9B435D9066713F7C1EFF61"><enum>(ii)</enum><text>may be
				renominated for 1 additional 3-year term.</text>
											</clause></subparagraph><subparagraph id="ID0760c584fcab45bbbe986d2990c7baf8"><enum>(B)</enum><header>Current
				members</header><text>Members serving on the Advisory Council as of the date of
				the enactment of the <short-title>Research and Innovative
				Technology Administration Reauthorization Act of 2011</short-title> shall serve
				until the end of their appointed terms.</text>
										</subparagraph></paragraph></subsection><subsection id="ID48387ee947a5479e914527213ff4212f"><enum>(d)</enum><header>Applicability
				of Federal Advisory Committee Act</header><text>The Federal Advisory Committee
				Act (except for section 14 of such Act) shall apply to the Advisory
				Council.</text>
								</subsection></section><section id="IDb889c2d420a84c4093da6f545f7c99fd"><enum>6306.</enum><header>Transportation
				statistical collection, analysis, and dissemination</header><text display-inline="no-display-inline">To ensure that all transportation
				statistical collection, analysis, and dissemination is carried out in a
				coordinated manner, the Director may—</text>
								<paragraph id="IDcf697ee9e2c747be842a5e3c3d8596a3"><enum>(1)</enum><text>utilize, with
				their consent, the services, equipment, records, personnel, information, and
				facilities of other Federal, State, local, and private agencies and
				instrumentalities with or without reimbursement for such utilization;</text>
								</paragraph><paragraph id="idA43CE27CBB984DBCAB8ABBF49E87F409"><enum>(2)</enum><text>enter into
				agreements with agencies and instrumentalities referred to in paragraph (1) for
				purposes of data collection and analysis;</text>
								</paragraph><paragraph id="ID3b552ea9148c45a1bf78d1f94cd26d7b"><enum>(3)</enum><text>confer and
				cooperate with foreign governments, international organizations, States,
				municipalities, and other local agencies;</text>
								</paragraph><paragraph id="ID609896f64406444c82daf3b1b8d9d579"><enum>(4)</enum><text>request such
				information, data, and reports from any Federal agency as may be required to
				carry out the purposes of this section;</text>
								</paragraph><paragraph id="IDdb20e6718b0546ac9e27bdbbd4f606e0"><enum>(5)</enum><text>encourage
				replication, coordination, and sharing among transportation agencies regarding
				information systems, information policy, and data; and</text>
								</paragraph><paragraph id="ID55d5b617c4e345ea89e43bbbf7d9839c"><enum>(6)</enum><text>confer and
				cooperate with Federal statistical agencies as needed to carry out the purposes
				of this section, including by entering into cooperative data sharing agreements
				in conformity with all laws and regulations applicable to the disclosure and
				use of data.</text>
								</paragraph></section><section id="IDcc4ad6d03ced463795cf25a37ce59862"><enum>6307.</enum><header>Furnishing
				information, data, or reports by Federal agencies</header><text display-inline="no-display-inline">Federal agencies requested to furnish
				information, data, or reports under section 6303(b) shall provide such
				information to the Bureau as is required to carry out the purposes of this
				section.</text>
							</section><section id="ID49c39d3d9fec4e82889ba099eec35a33"><enum>6308.</enum><header>Prohibition
				on certain disclosures</header>
								<subsection id="ID85ffe096d4da46bd9391f0c6d8e400f9"><enum>(a)</enum><header>In
				general</header><text>An officer, employee, or contractor of the Bureau may
				not—</text>
									<paragraph id="IDed5bacc4634541ab876177c38171fc1d"><enum>(1)</enum><text>make any
				disclosure in which the data provided by an individual or organization under
				section 6303 can be identified;</text>
									</paragraph><paragraph id="ID931daf933bf44a2eae450ab8b1e2bc06"><enum>(2)</enum><text>use the
				information provided under section 6303 for a nonstatistical purpose; or</text>
									</paragraph><paragraph id="IDff315d6508714add9d73f63b93c904e0"><enum>(3)</enum><text>permit anyone
				other than an individual authorized by the Director to examine any individual
				report provided under section 6303.</text>
									</paragraph></subsection><subsection id="IDc09b4763f5094432960c9414c8b2450f"><enum>(b)</enum><header>Copies of
				reports</header>
									<paragraph id="ID26542b387ec44591be7d31844b1a9fd3"><enum>(1)</enum><header>In
				general</header><text>A department, bureau, agency, officer, or employee of the
				United States (except the Director in carrying out this section) may not
				require, for any reason, a copy of any report that has been filed under section
				6303 with the Bureau or retained by an individual respondent.</text>
									</paragraph><paragraph id="ID0e31799d2fa8470cafeb31ed9e12b7f7"><enum>(2)</enum><header>Limitation on
				judicial proceedings</header><text>A copy of a report described in paragraph
				(1) that has been retained by an individual respondent or filed with the Bureau
				or any of its employees, contractors, or agents—</text>
										<subparagraph id="IDd5309dba418f4277b0cd5d749156fecb"><enum>(A)</enum><text>shall be immune
				from legal process; and</text>
										</subparagraph><subparagraph id="IDd16ca2b17b754ebc8bd800f34c31cb2d"><enum>(B)</enum><text>may not, without
				the consent of the individual concerned, be admitted as evidence or used for
				any purpose in any action, suit, or other judicial or administrative
				proceedings.</text>
										</subparagraph></paragraph><paragraph id="IDf3718a04d2714f819c5eacfbad9736ce"><enum>(3)</enum><header>Applicability</header><text>This
				subsection shall only apply to reports that permit information concerning an
				individual or organization to be reasonably determined by direct or indirect
				means.</text>
									</paragraph></subsection><subsection id="IDec85fe749fb84dd5986f4547516e21a1"><enum>(c)</enum><header>Informing
				respondent of use of data</header><text>If the Bureau is authorized by statute
				to collect data or information for a nonstatistical purpose, the Director shall
				clearly distinguish the collection of such data or information, by rule and on
				the collection instrument, to inform a respondent who is requested or required
				to supply the data or information of the nonstatistical purpose.</text>
								</subsection></section><section id="IDb211b857f69a475b843151d19074dfd3"><enum>6309.</enum><header>Data
				access</header><text display-inline="no-display-inline">The Director shall be
				provided access to transportation and transportation-related information in the
				possession of any Federal agency, except—</text>
								<paragraph id="ID2be31dc707f8413fa9ae2b583ab20f4e"><enum>(1)</enum><text>information that
				is expressly prohibited by law from being disclosed to another Federal agency;
				or</text>
								</paragraph><paragraph id="ID33620c5932e94b6aadfc41252325bde0"><enum>(2)</enum><text>information that
				the agency possessing the information determines could not be disclosed without
				significantly impairing the discharge of authorities and responsibilities which
				have been delegated to, or vested by law, in such agency.</text>
								</paragraph></section><section id="ID0c118e1ea66a4edeb12d6a84f7a3fa63"><enum>6310.</enum><header>Proceeds of
				data product sales</header><text display-inline="no-display-inline">Notwithstanding section 3302 of title 31,
				amounts received by the Bureau from the sale of data products, for necessary
				expenses incurred, may be credited to the Highway Trust Fund (other than the
				Mass Transit Account) for the purpose of reimbursing the Bureau for such
				expenses.</text>
							</section><section id="IDa9674e5f74e744c68e7fd8e39eb35302"><enum>6311.</enum><header>Information
				collection</header><text display-inline="no-display-inline">As the head of an
				independent Federal statistical agency, the Director may consult directly with
				the Office of Management and Budget concerning any survey, questionnaire, or
				interview that the Director considers necessary to carry out the statistical
				responsibilities under this subchapter.</text>
							</section><section id="ID3cd7704ca33c472fb0b44e91b977b300"><enum>6312.</enum><header>National
				transportation atlas database</header>
								<subsection id="IDf019217af8c742078ba0c278b6e1869a"><enum>(a)</enum><header>In
				general</header><text>The Director shall develop and maintain a national
				transportation atlas database that is comprised of geospatial databases that
				depict—</text>
									<paragraph id="IDe3933a01ff854000be4f227e344d18c4"><enum>(1)</enum><text>transportation
				networks;</text>
									</paragraph><paragraph id="ID427b086018954886aa491b8a408c53e8"><enum>(2)</enum><text>flows of people,
				goods, vehicles, and craft over the networks; and</text>
									</paragraph><paragraph id="IDbc41407ee96a4413891e394d962c3d3c"><enum>(3)</enum><text>social, economic,
				and environmental conditions that affect, or are affected by, the
				networks.</text>
									</paragraph></subsection><subsection id="ID81b4c8cf700b4a3db2523eab382b8ce6"><enum>(b)</enum><header>Intermodal
				network analysis</header><text>The databases developed under subsection (a)
				shall be capable of supporting intermodal network analysis.</text>
								</subsection></section><section id="ID1ea266e8bef04d97880fc4b9a4d57457"><enum>6313.</enum><header>Limitations
				on statutory construction</header><text display-inline="no-display-inline">Nothing in this subchapter may be
				construed—</text>
								<paragraph id="ID37f8e769e1ff4cafb5f2ae3f52969b19"><enum>(1)</enum><text>to authorize the
				Bureau to require any other department or agency to collect data; or</text>
								</paragraph><paragraph id="ID100e6b9c2a8849b5a8d645995244b7cd"><enum>(2)</enum><text>to reduce the
				authority of any other officer of the Department to independently collect and
				disseminate data.</text>
								</paragraph></section><section id="ID7e233a00c42247f585f1c105f15538b4"><enum>6314.</enum><header>Research and
				development grants</header><text display-inline="no-display-inline">The
				Secretary may award grants to, or enter into cooperative agreements or
				contracts with, public and nonprofit private entities (including State
				transportation departments, metropolitan planning organizations, and
				institutions of higher education) for—</text>
								<paragraph id="ID0cf96cb4bb3c4b46b430fd986cb98ace"><enum>(1)</enum><text>investigation of
				the subjects specified in section 6303 and research and development of new
				methods of data collection, standardization, management, integration,
				dissemination, interpretation, and analysis;</text>
								</paragraph><paragraph id="IDecab9c2ad7e74d46a20d5f9b4c8c5ddc"><enum>(2)</enum><text>demonstration
				programs by States, local governments, and metropolitan planning organizations
				to coordinate data collection, reporting, management, storage, and archiving to
				simplify data comparisons across jurisdictions;</text>
								</paragraph><paragraph id="IDafdb6487d4184d748156edf43604c55e"><enum>(3)</enum><text>development of
				electronic clearinghouses of transportation data and related information, as
				part of the National Transportation Library under section 6304; and</text>
								</paragraph><paragraph id="ID8dd1a700a3094e7c80466dc2a08cf615"><enum>(4)</enum><text>development and
				improvement of methods for sharing geographic data, in support of the database
				under section 6303 and the National Spatial Data Infrastructure.</text>
								</paragraph></section><section id="ID5416ed5e8ac0449eb7aa66ecdc703bd9"><enum>6315.</enum><header>Transportation
				statistics annual report</header><text display-inline="no-display-inline">The
				Director shall submit to the President and Congress a transportation statistics
				annual report, which shall include—</text>
								<paragraph id="id1BCD51DA1C7F467783074A4F8672F2B1"><enum>(1)</enum><text display-inline="yes-display-inline">information on items referred to in section
				6303(a)(6);</text>
								</paragraph><paragraph id="id0A2F501267B142DD8BC30AAF60F65DE1"><enum>(2)</enum><text display-inline="yes-display-inline">documentation of methods used to obtain and
				ensure the quality of the statistics presented in the report; and</text>
								</paragraph><paragraph id="id90786737E71D4D61B333D4B7B56BA8C5"><enum>(3)</enum><text display-inline="yes-display-inline">recommendations for improving
				transportation statistical information.</text>
								</paragraph></section><section id="ID3309846ebebf4034af72fe8615a48b87"><enum>6316.</enum><header>Mandatory
				response authority for data collections</header><text display-inline="no-display-inline">Any individual who, as the owner, official,
				agent, person in charge, or assistant to the person in charge of any
				corporation, company, business, institution, establishment, organization of any
				nature or the member of a household, neglects or refuses, after requested by
				the Director or other authorized officer, employee, or contractor of the
				Bureau, to answer completely and correctly to the best of the individual’s
				knowledge all questions relating to the corporation, company, business,
				institution, establishment, or other organization or household, or to make
				available records or statistics in the individual’s official custody, contained
				in a data collection request prepared and submitted under section
				6303(a)—</text>
								<paragraph id="id608E61F77CCA4F9C8258CA75CF650860"><enum>(1)</enum><text display-inline="yes-display-inline">shall be fined not more than $500, except
				as provided under paragraph (2); and</text>
								</paragraph><paragraph id="idAD3F11BF181D4DD481D19AF51083B31C"><enum>(2)</enum><text display-inline="yes-display-inline">if the individual willfully gives a false
				answer to such a question, shall be fined not more than
				$10,000.</text>
								</paragraph></section></subchapter></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID36390088a5134a79be75016548e8c195"><enum>(b)</enum><header>Rules of
			 construction</header><text>In transferring the provisions under section 111 of
			 title 49, United States Code, to chapter 63 of title 49, as added by subsection
			 (a), the following rules of construction shall apply:</text>
				<paragraph id="ID0791af62836a444da7d7e7b01fc961f3"><enum>(1)</enum><text>For purposes of
			 determining whether 1 provision of law supersedes another based on enactment
			 later in time, a provision under chapter 63 of title 49, United States Code, is
			 deemed to have been enacted on the date of the enactment of the corresponding
			 provision under section 111 of such title.</text>
				</paragraph><paragraph id="ID3a63f054f9014974880bb4c6ea4c897d"><enum>(2)</enum><text>A reference to a
			 provision under such chapter 65 is deemed to refer to the corresponding
			 provision under such section 111.</text>
				</paragraph><paragraph id="ID9941a2807a1c413abf09e28fe0f8b787"><enum>(3)</enum><text>A reference to a
			 provision under such section 111, including a reference in a regulation, order,
			 or other law, is deemed to refer to the corresponding provision under such
			 chapter 65.</text>
				</paragraph><paragraph id="ID759db0933f41494d87b23bfc17908b4e"><enum>(4)</enum><text>A regulation,
			 order, or other administrative action authorized by a provision under such
			 section 111 continues to be authorized by the corresponding provision under
			 such chapter 65.</text>
				</paragraph><paragraph id="ID3b63479699c74c42937308007a692251"><enum>(5)</enum><text>An action taken
			 or an offense committed under a provision of section 111 is deemed to have been
			 taken or committed under the corresponding provision of chapter 65.</text>
				</paragraph></subsection><subsection id="IDf04911cdf58744d2be0579d38683c088"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="ID28634fe52ba747678c392bd30cc6e5c9"><enum>(1)</enum><header>Repeal</header><text>Chapter
			 1 of title 49, United States Code, is amended—</text>
					<subparagraph id="id7BF0106B82BB46D8AC0FD16C5736324F"><enum>(A)</enum><text>by repealing
			 section 111; and</text>
					</subparagraph><subparagraph id="id32B4925D7F344055B898E635D158E31E"><enum>(B)</enum><text>by striking the

			<subsection id="idED02541AA0A74938B29C7C4BC7B78F1A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter I of
			 chapter 55 of title 49, United States Code, as amended by section 3, is further
			 amended by adding at the end the following:</text>

				general</header><text>Not later than 3 years after the date of the enactment of
				this section, the Secretary shall submit a report to the
				<committee-name committee-id="SSCM00">Committee on Commerce, Science, and
				Transportation of the Senate</committee-name>, the
				<committee-name committee-id="">Committee on Transportation and Infrastructure
				of the House of Representatives</committee-name>, and the
				<committee-name committee-id="">Committee on Energy and Commerce of the House
				of Representatives</committee-name> that—</text>
							<paragraph id="id3692803016124508A41786F4386122DA"><enum>(1)</enum><text>defines a
				recommended implementation path for Dedicated Short Range Communications (DSRC)
				technology and applications; and</text>
							</paragraph><paragraph id="idF23549EC8F4A4E3581B8E774B6331319"><enum>(2)</enum><text>includes guidance
				concerning the relationship of the proposed DSRC deployment to Intelligent
				Transportation System National Architecture and Standards.</text>
							</paragraph></subsection><subsection id="ID97febde7c3504fd9a494e526766cbc4a"><enum>(b)</enum><header>Report
				review</header><text>The Secretary shall enter into an agreement for the review
				of the report submitted under subsection (a) by an independent third party with
				subject matter
				expertise.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID14a8ac2715864f3aac3a77ce93237ab0"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis of chapter 55 of title 49, United States
			 Code, is amended by inserting after the item relating to section 5507, as added
			 by section 3, the following:</text>

			 authority</header><text display-inline="no-display-inline">Section 112 of title
			 49, United States Code, is amended by inserting after subsection (e) the
			 following:</text>

				<subsection id="ID87f09503e369491bb2f639345f6727b8"><enum>(f)</enum><header>Program
				evaluation and oversight</header><text>The Administrator is authorized to
				expend not more than 1.5 percent of the amounts authorized to be appropriated
				for each of the fiscal years 2012 and 2013, for necessary expenses for
				administration and operations of the Research and Innovative Technology
				Administration for the coordination, evaluation, and oversight of the programs
				administered by the Administration.</text>
				</subsection><subsection id="ID4249769c123f44a49243f557010818d0"><enum>(g)</enum><header>Collaborative
				research and development</header>
					<paragraph id="IDee1864618ab641ef85a2c07ef3e499d6"><enum>(1)</enum><header>In
				general</header><text>To encourage innovative solutions to multimodal
				transportation problems and stimulate the deployment of new technology, the
				Administrator may carry out, on a cost-shared basis, collaborative research and
				development with—</text>
						<subparagraph id="ID432a56084cf9433ea4fe798f99532d72"><enum>(A)</enum><text>non-Federal
				entities, including State and local governments, foreign governments, colleges
				and universities, corporations, institutions, partnerships, sole
				proprietorships, and trade associations that are incorporated or established
				under the laws of any State;</text>
						</subparagraph><subparagraph id="ID5f5386be3f8f4b4ba6abd386962b9b8f"><enum>(B)</enum><text>Federal
				laboratories; and</text>
						</subparagraph><subparagraph id="IDc39cfe7474524f36ae5126771e8a35bf"><enum>(C)</enum><text>other Federal
				agencies.</text>
						</subparagraph></paragraph><paragraph id="ID9ffeaaa4e45b48118576dcd27d4e8058"><enum>(2)</enum><header>Cooperation,
				grants, contracts, and agreements</header><text>Notwithstanding any other
				provision of law, the Administrator may directly initiate contracts, grants,
				other transactions, and cooperative research and development agreements (as
				defined in section 12 of the Stevenson-Wydler Technology Innovation Act of 1980
				(15 U.S.C. 3710a)) to fund, and accept funds from, the Transportation Research
				Board of the National Research Council of the National Academy of Sciences,
				State departments of transportation, cities, counties, universities,
				associations, and the agents of such entities to conduct joint transportation
				research and technology efforts.</text>
					</paragraph><paragraph id="ID678e2e4683b3465887bfc4dd79683036"><enum>(3)</enum><header>Federal
				share</header>
						<subparagraph id="ID7a46f28398174e53946bf8fd56f33274"><enum>(A)</enum><header>In
				general</header><text>The Federal share of the cost of activities carried out
				under a cooperative research and development agreement entered into under this
				subsection may not exceed 50 percent unless the Secretary approves a greater
				Federal share due to substantial public interest or benefit.</text>
						</subparagraph><subparagraph id="ID520ada380f1d4a569ead8f274a2280a3"><enum>(B)</enum><header>Non-federal
				share</header><text>All costs directly incurred by the non-Federal partners,
				including personnel, travel, facility, and hardware development costs, shall be
				credited toward the non-Federal share of the cost of the activities described
				in subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="IDbab5da3230a84171b80d4f1d3ccef055"><enum>(4)</enum><header>Use of
				technology</header><text>The research, development, or use of a technology
				under a cooperative research and development agreement entered into under this
				subsection, including the terms under which the technology may be licensed and
				the resulting royalties may be distributed, shall be subject to the
				Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C. 3701 et
				seq.).</text>
					</paragraph><paragraph id="ID552f2b7516b04f86b909c45f29004ff0"><enum>(5)</enum><header>Waiver of
				advertising requirements</header><text>Section 3709 of the Revised Statutes (41
				U.S.C. 5) shall not apply to a contract, grant, or other agreement entered into
				under this
				chapter.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDb487326b0e8a4795a99b1582eddb5a65"><enum>7.</enum><header>Prize
			 authority</header>
			<subsection id="IDb2a143bf378245688cc9894a87439e5c"><enum>(a)</enum><header>In
			 general</header><text>Chapter 3 of title 49, United States Code, is amended by
			 inserting before section 336 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id83B2D68049074B2A91818F0BAB212237" style="OLC">
					<section id="ID2ba2bc12627f4e6fa2e9b696345c43fd"><enum>335.</enum><header>Prize
				authority</header>
						<subsection id="ID426b589903c94b7d943ee3e010c16b63"><enum>(a)</enum><header>In
				general</header><text>The Secretary of Transportation may carry out a program,
				in accordance with this section, to competitively award cash prizes to
				stimulate innovation in basic and applied research, technology development, and
				prototype demonstration that have the potential for application to the national
				transportation system.</text>
						</subsection><subsection id="ID9548d50ab4764d1ebadc0fcc77712e5b"><enum>(b)</enum><header>Topics</header><text>In
				selecting topics for prize competitions under this section, the Secretary
				shall—</text>
							<paragraph id="id73478E754ECF479AABB8D628E573E0B5"><enum>(1)</enum><text>consult with a
				wide variety of Government and nongovernment representatives; and</text>
							</paragraph><paragraph id="id173A616BF53E4EA1A5571198DB0EBB6A"><enum>(2)</enum><text>give
				consideration to prize goals that demonstrate innovative approaches and
				strategies to improve the safety, efficiency, and sustainability of the
				national transportation system.</text>
							</paragraph></subsection><subsection id="ID7ddc15c532894fdf8e47f33eb9baf296"><enum>(c)</enum><header>Advertising</header><text>The
				Secretary shall encourage participation in the prize competitions through
				extensive advertising.</text>
						</subsection><subsection id="IDf0005fa3493948389547efc2f4799fe5"><enum>(d)</enum><header>Requirements
				and registration</header><text>For each prize competition, the Secretary shall
				publish a notice on a public website that describes—</text>
							<paragraph id="id6B46633107CB4960BE43E86AA48B65A9"><enum>(1)</enum><text>the subject of
				the competition;</text>
							</paragraph><paragraph id="idE3321CD1C17B4060A3D0EE6CF9133577"><enum>(2)</enum><text>the eligibility
				rules for participation in the competition;</text>
							</paragraph><paragraph id="id8C70D173A4A245FE86CE5C0B7D0002B4"><enum>(3)</enum><text>the amount of the
				prize; and</text>
							</paragraph><paragraph id="id265DAD5ED77842DCBF312AACCD020711"><enum>(4)</enum><text>the basis on
				which a winner will be selected.</text>
							</paragraph></subsection><subsection id="IDbccad15fbdde41c3ae4f5bc33c5c6964"><enum>(e)</enum><header>Eligibility</header><text>An
				individual or entity may not receive a prize under this section unless the
				individual or entity—</text>
							<paragraph id="ID1a265a25f61043fdb3a7e4a653f5f514"><enum>(1)</enum><text>has registered to
				participate in the competition pursuant to any rules promulgated by the
				Secretary under this section;</text>
							</paragraph><paragraph id="ID0051fdc0e0234ae89df730f4e172ce6b"><enum>(2)</enum><text>has complied with
				all the requirements under this section;</text>
							</paragraph><paragraph id="ID496166974e9949f6bea307c44c1252e5"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id74D5A4B3005848F68A2869516EDFC356"><enum>(A)</enum><text>in the case of a
				private entity, is incorporated in, and maintains a primary place of business
				in, the United States; or</text>
								</subparagraph><subparagraph id="idE62A048EB28B41B2BAA307F78CE61D49" indent="up1"><enum>(B)</enum><text>in the case of an individual, whether
				participating singly or in a group, is a citizen or permanent resident of the
				United States; and</text>
								</subparagraph></paragraph><paragraph id="IDb3d86b09758e4946b8f39a7c8e9b694e"><enum>(4)</enum><text>is not a Federal
				entity or Federal employee acting within the scope of his or her
				employment.</text>
							</paragraph></subsection><subsection id="ID3a064fe1f2034e398b696b0aa30f96a8"><enum>(f)</enum><header>Liability</header>
							<paragraph id="IDe598bf67bc404cabad0607b263204e8d"><enum>(1)</enum><header>Assumption of
				risk</header>
								<subparagraph id="idB02370B9CA6B46ACA90461DC694564EB"><enum>(A)</enum><header>In
				general</header><text>A registered participant shall agree to assume any and
				all risks and waive claims against the Federal Government and its related
				entities, except in the case of willful misconduct, for any injury, death,
				damage, or loss of property, revenue, or profits, whether direct, indirect, or
				consequential, arising from participation in a competition, whether such
				injury, death, damage, or loss arises through negligence or otherwise.</text>
								</subparagraph><subparagraph id="idAD077A508A1B451FB567F18762302210"><enum>(B)</enum><header>Related
				entity</header><text>In this paragraph, the term <term>related entity</term>
				means a contractor, subcontractor (at any tier), supplier, user, customer,
				cooperating party, grantee, investigator, or detailee.</text>
								</subparagraph></paragraph><paragraph id="ID501fc3cb90334488991ad496bf43969e"><enum>(2)</enum><header>Financial
				responsibility</header><text>A participant shall obtain liability insurance or
				demonstrate financial responsibility, in amounts determined by the Secretary,
				for claims by—</text>
								<subparagraph id="IDe3f41e8e4dde4040ac4c99b952df2e4a"><enum>(A)</enum><text>a third party for
				death, bodily injury, or property damage, or loss resulting from an activity
				carried out in connection with participation in a competition, with the Federal
				Government named as an additional insured under the registered participant’s
				insurance policy and registered participants agreeing to indemnify the Federal
				Government against third party claims for damages arising from or related to
				competition activities; and</text>
								</subparagraph><subparagraph id="ID8849a9c17f444a3188bf7e719152fbbb"><enum>(B)</enum><text>the Federal
				Government for damage or loss to Government property resulting from such an
				activity.</text>
								</subparagraph></paragraph></subsection><subsection id="ID2819b20544f744ba98e9a257d8c65970"><enum>(g)</enum><header>Judges</header>
							<paragraph id="id04B2F291E53240439A401539B626922C"><enum>(1)</enum><header>Selection</header><text>For
				each prize competition, the Secretary, either directly or through an agreement
				under subsection (h), shall assemble a panel of qualified judges to select the
				winner or winners of the prize competition on the basis described in subsection
				(d). Judges for each competition shall include individuals from outside the
				Administration, including the private sector.</text>
							</paragraph><paragraph id="id77B34F70D57A42EBBA09614F00F1A0AC"><enum>(2)</enum><header>Limitations</header><text>A
				judge selected under this subsection may not—</text>
								<subparagraph id="IDff81ec4a08b1400196e14adbf4a2352b"><enum>(A)</enum><text>have personal or
				financial interests in, or be an employee, officer, director, or agent of, any
				entity that is a registered participant in a prize competition under this
				section; or</text>
								</subparagraph><subparagraph id="IDace301792d494816ae3ecab35107d7bb"><enum>(B)</enum><text>have a familial
				or financial relationship with an individual who is a registered
				participant.</text>
								</subparagraph></paragraph></subsection><subsection id="ID5d76d143e2e546d1bfaa82ba11bec32c"><enum>(h)</enum><header>Administering
				the competition</header><text>The Secretary may enter into an agreement with a
				private, nonprofit entity to administer the prize competition, subject to the
				provisions of this section.</text>
						</subsection><subsection id="ID71235202a8f14c9ab1b58bc5230546ec"><enum>(i)</enum><header>Funding</header>
							<paragraph id="ID3e2ec48e3b774ef2af74b9ab9d4da231"><enum>(1)</enum><header>Private sector
				funding</header><text>A cash prize under this section may consist of funds
				appropriated by the Federal Government and funds provided by the private
				sector. The Secretary may accept funds from other Federal agencies, State and
				local governments, and metropolitan planning organizations for the cash prizes.
				The Secretary may not give any special consideration to any private sector
				entity in return for a donation under this paragraph.</text>
							</paragraph><paragraph id="ID6f02b7bfbbe54104a2fe676079dc2c14"><enum>(2)</enum><header>Availability of
				funds</header><text>Notwithstanding any other provision of law, amounts
				appropriated for prize awards under this section—</text>
								<subparagraph id="idA864D82CFB30458CB26728FBC1B063CF"><enum>(A)</enum><text>shall remain
				available until expended; and</text>
								</subparagraph><subparagraph id="idC69D0424B09D46BF8526A8ED3E4AC070"><enum>(B)</enum><text>may not be
				transferred, reprogrammed, or expended for other purposes until after the
				expiration of the 10-year period beginning on the last day of the fiscal year
				for which the funds were originally appropriated.</text>
								</subparagraph></paragraph><paragraph id="id53CBAF3CDF194A1CA5357E45A4B17AB0"><enum>(3)</enum><header>Savings
				provision</header><text>Nothing in this subsection may be construed to permit
				the obligation or payment of funds in violation of the Anti-Deficiency Act (31
				U.S.C. 1341).</text>
							</paragraph><paragraph id="ID41b695187a154a32ad216ae8727f516b"><enum>(4)</enum><header>Prize
				announcement</header><text>A prize may not be announced under this section
				until all the funds needed to pay out the announced amount of the prize have
				been appropriated or committed in writing by a private source.</text>
							</paragraph><paragraph id="idBF65D680A9F1444BB7F56C80A4933D27"><enum>(5)</enum><header>Prize
				increases</header><text>The Secretary may increase the amount of a prize after
				the initial announcement of the prize under this section if—</text>
								<subparagraph id="ID93d9d56395af4997bfeca8ac0aa1ce19"><enum>(A)</enum><text>notice of the
				increase is provided in the same manner as the initial notice of the prize;
				and</text>
								</subparagraph><subparagraph id="IDb2e6a95113324da78a19e816ed6361b6"><enum>(B)</enum><text>the funds needed
				to pay out the announced amount of the increase have been appropriated or
				committed in writing by a private source.</text>
								</subparagraph></paragraph><paragraph id="ID8e643963e3d1477d9671fe83c33e2143"><enum>(6)</enum><header>Congressional
				notification</header><text>A prize competition under this section may offer a
				prize in an amount greater than $1,000,000 only after 30 days have elapsed
				after written notice has been transmitted to the
				<committee-name committee-id="SSCM00">Committee on Commerce, Science, and
				Transportation of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Science, Space, and Technology of
				the House of Representatives</committee-name>.</text>
							</paragraph><paragraph id="IDf700ae6abd6d490a974ba3e25afbd052"><enum>(7)</enum><header>Award
				limit</header><text>A prize competition under this section may not result in
				the award of more than $25,000 in cash prizes without the approval of the
				Secretary.</text>
							</paragraph></subsection><subsection id="ID763c3001fdd44bd284d84bc08022c179"><enum>(j)</enum><header>Use of
				department name and insignia</header><text>A registered participant in a prize
				competition under this section may use the Department’s name, initials, or
				insignia only after prior review and written approval by the Secretary.</text>
						</subsection><subsection id="ID8819a5144ca9407095dbea431fbacf98"><enum>(k)</enum><header>Compliance with
				existing law</header><text>The Federal Government shall not, by virtue of
				offering or providing a prize under this section, be responsible for compliance
				by registered participants in a prize competition with Federal law, including
				licensing, export control, and non-proliferation laws, and related
				regulations.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID42fb1885dbef4107893be6e24d758e04"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis of chapter 3 of title 49, United States

			</paragraph><paragraph id="id8CD0A1C869234DF49B34D220CE3386C6"><enum>(2)</enum><text display-inline="yes-display-inline">by amending paragraph (2)(A) to read as
			 follows:</text>

			</paragraph></section><section id="ID72fa27cd4d1546fca4f4aee4a9919844"><enum>9.</enum><header>Use of funds for
			 intelligent transportation systems activities</header><text display-inline="no-display-inline">Section 513 of title 23, United States Code,
			 is amended to read as follows:</text>

				<section id="ID3a193361577a45f08b4950ce79f08996"><enum>513.</enum><header>Use of funds
				for ITS activities</header>
					<subsection id="ID7acee8f0aac1461881ca1c69ab6242b6"><enum>(a)</enum><header>In
				general</header><text>The Secretary may use not more than $500,000 of the
				amounts made available to the Department for each fiscal year to carry out the
				Intelligent Transportation Systems Program (referred to in this section as
				<quote>ITS</quote>) on intelligent transportation system outreach, websites,
				public relations, displays, tours, and brochures.</text>
					</subsection><subsection id="ID9ac003fb4ba94819b054f00beba91860"><enum>(b)</enum><header>Purpose</header><text>Amounts
				authorized for use under subsection (a) are intended to develop, administer,
				communicate, and promote the use of products of research, technology, and
				technology transfer programs under this section.</text>
					</subsection><subsection id="ID73d50392cc624bbeb0c22e1cd8a1e15f"><enum>(c)</enum><header>ITS deployment
				incentives</header>
						<paragraph id="ID1bacd268dfd9455d9acdf57f80cc8357"><enum>(1)</enum><header>In
				general</header><text>The Secretary may develop and implement incentives to
				accelerate the deployment of ITS technologies and services within all programs
				receiving amounts appropriated pursuant to section 11 of the
				<short-title>Research and Innovative Technology
				Administration Reauthorization Act of 2011</short-title>.</text>
						</paragraph><paragraph id="IDb80296d429a740758463ad04dcb28f4c"><enum>(2)</enum><header>Comprehensive
				plan</header><text>The Secretary shall develop a detailed and comprehensive
				plan to carry out this subsection that addresses how incentives may be adopted,
				as appropriate, through the existing deployment activities carried out by
				surface transportation modal
				administrations.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idBFF8380A0D61438F9281164C2412B12A"><enum>10.</enum><header>National Travel
			 Data Program</header>
			<subsection id="idFFB8082A4C6A4749AC9E36524E7BE333"><enum>(a)</enum><header>In
			 general</header><text>Subchapter I of chapter 55 of title 49, United States
			 Code, as amended by sections 3 and 5, is further amended by adding at the end

				this section as the <quote>‘Program</quote>’) to collect essential national
				passenger and freight travel data to help guide transportation operations,
				policy, and investment decisions for Federal, State, and local governments and
				the private sector.</text>
						</subsection><subsection id="ID426a0bdc198a48d7aca33da8240444ad"><enum>(b)</enum><header>Program
				elements</header><text>In carrying out the Program, the Secretary shall—</text>
							<paragraph id="IDf8d16034d04e4b329193605b3557adfd"><enum>(1)</enum><text>collect data and
				make such data available to support transportation operations, policy, and
				investment decisions, including data on system performance, safety,
				international competitiveness, energy efficiency, and changes in
				demographics;</text>
							</paragraph><paragraph id="ID87917056300648dabb5eab4854cd367a"><enum>(2)</enum><text>improve the
				quality of the data collected under the Program, including identifying and
				addressing current gaps in passenger and freight travel data collection, such
				as the sample sizes and frequency of transportation surveys including the
				Commodity Flow Survey, the National Household Travel Survey, and the
				Transportation Services Index; and</text>
							</paragraph><paragraph id="IDfe42302617024455b5b435ac61e3ce83"><enum>(3)</enum><text>consult with
				State and local governments, private sector data providers, and professional
				and nonprofit associations to improve the integration, management, and
				implementation of data collected under the Program.</text>
							</paragraph></subsection><subsection id="ID347637cf13c24d52a1ee52225a821dc8"><enum>(c)</enum><header>Advisory
				Council on Transportation Statistics</header>
							<paragraph id="idA76AA9F39E114F039C53718623C9AB9C"><enum>(1)</enum><header>Establishment</header><text>In
				carrying out the Program, the Secretary shall seek recommendations from the
				Advisory Council on Transportation Statistics, established under section 6305
				on—</text>
								<subparagraph id="ID99bca71339394d05a9c2cd56414ffa75"><enum>(A)</enum><text>the design and
				implementation of the Program;</text>
								</subparagraph><subparagraph id="ID9fb0a1778f3a46f0b6e61c94e1e09ee8"><enum>(B)</enum><text>emerging
				transportation-related data needs relevant to the Program; and</text>
								</subparagraph><subparagraph id="ID5aef6804ffcf4277a66800de20541368"><enum>(C)</enum><text>other matters the
				Secretary determines to be appropriate.</text>
								</subparagraph></paragraph></subsection><subsection id="ID67a40242813842ec91c6de2a86a7012b"><enum>(d)</enum><header>Reports to
				Congress</header>
							<paragraph id="idAB8574F8746441CBAB4178CA4D053ABF"><enum>(1)</enum><header>5-year
				plan</header><text>Not later than 1 year after the date of the enactment of the
				<short-title>Research and Innovative Technology
				Administration Reauthorization Act of 2011</short-title>, the Secretary shall
				submit, to the <committee-name committee-id="SSCM00">Committee on Commerce,
				Science, and Transportation of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Transportation and Infrastructure
				of the House of Representatives</committee-name>, a 5-year plan for
				implementing the National Travel Data Program that includes benchmarks and
				goals.</text>
							</paragraph><paragraph id="ID32de5060cdda48b9ab87903cc342e068"><enum>(2)</enum><header>Biennial
				report</header><text>Upon the establishment of the National Travel Data
				Program, and every 2 years thereafter, the Secretary shall submit a report on
				the activities of the Program to the congressional committees set forth in
				paragraph (1).</text>
							</paragraph></subsection><subsection id="ID0e9bae52ed014e37b97c2fa03f32bc9d"><enum>(e)</enum><header>Funding</header><text>Of
				the amounts made available under section 11 of the
				<short-title>Research and Innovative Technology
				Administration Reauthorization Act of 2011</short-title>, $8,000,000 shall be
				available for each of the fiscal years 2012 and 2013 to establish and maintain
				the
				Program.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idBB689BC7329143DA847DEB2CE612E6AE"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The chapter
			 analysis for chapter 55 of title 49, United States Code, as amended by sections
			 3 and 5, is further amended by inserting after the item relating to section
			 5508 the following:</text>

			 of appropriations</header>
			<subsection id="IDf9a670795c9b4c0599fb8428eb9b4ed2"><enum>(a)</enum><header>In
			 general</header><text>There are authorized to be appropriated out of the
			 Highway Trust Fund (other than the Mass Transit Account), under the conditions
			 set forth in subsection (b)—</text>
				<paragraph id="ID3834009a3c294ab49c085d235b58a090"><enum>(1)</enum><text>$55,297,000 for
			 fiscal year 2012; and</text>
				</paragraph><paragraph id="IDa011426d0f78497f8eab1a4ac35da0e3"><enum>(2)</enum><text>$55,597,000 for
			 fiscal year 2013.</text>
				</paragraph></subsection><subsection id="ID32bbd044f8184ac4b60ce9de868ec65b"><enum>(b)</enum><header>Applicability
			 of title 23, United States Code</header>
				<paragraph id="idF1E5A74DF4CA44AE87786ED872434B1A"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), amounts appropriated
			 pursuant to subsection (a) shall be available for obligation in the same manner
			 as if such funds were apportioned under chapter 1 of title 23, United States
			 Code.</text>
				</paragraph><paragraph id="id1B6105BF7E5B489D835B97E3CBA15874"><enum>(2)</enum><header>Federal
			 share</header><text>The Federal share of the cost of a project or activity
			 carried out with amounts appropriated pursuant to subsection (a) shall be 50
			 percent unless another percentage is—</text>
					<subparagraph id="id5F4A8076E7914D928AD2446918A8C16E"><enum>(A)</enum><text>expressly
			 provided under this Act or the amendments made by this Act; or</text>
					</subparagraph><subparagraph id="idC1A0922D459743CE966A5C23E824DBA6"><enum>(B)</enum><text>determined by the
			 Secretary.</text>
					</subparagraph></paragraph><paragraph id="idE2A3D78533364A7DBE6FEC5489C96DB8"><enum>(3)</enum><header>Availability;
			 transferability</header><text>Amounts appropriated pursuant to subsection (a)
			 shall remain available until expended and shall not be transferable.</text>
