			 means the Secretary of Transportation.</text>
		</section><section id="idDC338A0E9E924D1B8B1B8C64DEB8D08F"><enum>4.</enum><header>References to
			 title 49, United States Code</header><text display-inline="no-display-inline">Except as otherwise expressly provided,
			 whenever in this Act an amendment or repeal is expressed in terms of an
			 amendment to, or repeal of, a section or other provision, the reference shall
			 be considered to be made to a section or other provision of title 49, United
			 States Code.</text>
		</section><section id="ID4d26f9bd76cc4a65aa96ab722908ae65"><enum>5.</enum><header>Training for
			 emergency responders</header>
			<subsection id="IDf3264aed0b3b4bb18311d5f2ce05450c"><enum>(a)</enum><header>Training
			 curriculum</header><text>Section 5115 is amended—</text>
				<paragraph id="id24D8585C7A5F4B74A3BC20D9C0C0DD78"><enum>(1)</enum><text>in subsection
			 (b)(1)(B), by striking <quote>basic</quote>;</text>
				</paragraph><paragraph id="idBD67E0B2D59D422BB3A3F6D745D35609"><enum>(2)</enum><text>in subsection
			 (b)(2), by striking <quote>basic</quote>; and</text>
				</paragraph><paragraph id="id12EA678C1E024F59828B0E37CA61681F"><enum>(3)</enum><text>in subsection
			 (c), by striking <quote>basic</quote>.</text>
				</paragraph></subsection><subsection id="ID4ec8a06d27da4a198ed65e3852ab0810"><enum>(b)</enum><header>Operations
			 level training</header><text>Section 5116 is amended—</text>
				<paragraph id="IDf5279984262d473095fe5bebf858a076"><enum>(1)</enum><text>in subsection
			 (b)(1), by adding at the end the following: <quote>To the extent that a grant
			 is used to train emergency responders, the State or Indian tribe shall provide
			 written certification to the Secretary that the emergency responders who
			 receive training under the grant will have the ability to protect nearby
			 persons, property, and the environment from the effects of accidents or
			 incidents involving the transportation of hazardous material in accordance with
			 existing regulations or National Fire Protection Association standards for
			 competence of responders to hazardous materials.</quote>;</text>
				</paragraph><paragraph id="ID5e2150d2427240b7b1550388af6bb878"><enum>(2)</enum><text>in subsection
			 (j)—</text>
					<subparagraph id="IDd23db61289204a51a9c520f28d0ca572"><enum>(A)</enum><text>by redesignating
			 paragraph (5) as paragraph (7); and</text>
					</subparagraph><subparagraph id="IDd2b8e46bdbd44ad0ad0fbd49716321b6"><enum>(B)</enum><text>by inserting
			 after paragraph (4) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id06DF4D3B69D347F8821AE7212EDBBAF9" style="OLC">
							<paragraph id="ID31b50450d7e84b2e90377dfab88fc780"><enum>(5)</enum><text>The Secretary may
				not award a grant to an organization under this subsection unless the
				organization ensures that emergency responders who receive training under the
				grant will have the ability to protect nearby persons, property, and the
				environment from the effects of accidents or incidents involving the
				transportation of hazardous material in accordance with existing regulations or
				National Fire Protection Association standards for competence of responders to
				hazardous materials.</text>
							</paragraph><paragraph id="IDaf1ee32f9be84693af0f83d4fb730b55"><enum>(6)</enum><text>Notwithstanding
				paragraphs (1) and (3), to the extent determined appropriate by the Secretary,
				a grant awarded by the Secretary to an organization under this subsection to
				conduct hazardous material response training programs may be used to train
				individuals with responsibility to respond to accidents and incidents involving
				hazardous material.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="IDf1da1db3e00f463f8b71a4f9ec2f839b"><enum>(3)</enum><text>in subsection
			 (k)—</text>
					<subparagraph commented="no" id="idCD8A8A7F850D410FAFEA2A48BF9ACB84"><enum>(A)</enum><text>by striking
			 <quote>annually</quote> and inserting <quote>an annual report</quote>;</text>
					</subparagraph><subparagraph commented="no" id="idD7C69D27D3D54F129902436D92E970E9"><enum>(B)</enum><text>by inserting
			 <quote>the report</quote> after <quote>make available</quote>;</text>
					</subparagraph><subparagraph commented="no" id="id34EC1BBBA07E46079E06247C1A15837B"><enum>(C)</enum><text>by striking
			 <quote>information</quote> and inserting <quote>. The report submitted under
			 this subsection shall include information</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="idC3B61DB591CB45F1A3FC533C87006F66"><enum>(D)</enum><text>by striking
			 <quote>The report shall identify</quote> and all that follows and inserting the
			 following: “The report submitted under this subsection shall identify the
			 ultimate recipients of such grants and include—</text>
						<quoted-block display-inline="no-display-inline" id="id6034C2AAD4D5445F91A5507D0DE67B5F" style="OLC">
							<subparagraph commented="no" id="ID1d9e979d48b84317b73fbf7a656b2e26"><enum>(A)</enum><text>a detailed
				accounting and description of each grant expenditure by each grant recipient,
				including the amount of, and purpose for, each expenditure;</text>
							</subparagraph><subparagraph commented="no" id="ID530274b1005341039c5e83bcedbca935"><enum>(B)</enum><text>the number of
				persons trained under the grant program, by training level;</text>
							</subparagraph><subparagraph commented="no" id="ID1683d1ca40f1414e86478ddab9a44b74"><enum>(C)</enum><text>an evaluation of
				the efficacy of such planning and training programs; and</text>
							</subparagraph><subparagraph commented="no" id="IDe3addcfa4f8d467bb2108d6df3c8b7d9"><enum>(D)</enum><text>any
				recommendations the Secretary may have for improving such grant
				programs.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="IDc3ce199543ad4ae5aa1702d30090ac46"><enum>6.</enum><header>Paperless Hazard
			 Communications Pilot Program</header>
			<subsection id="ID6bdfe3c906e94b4eacc6b36d6ab6bf1e"><enum>(a)</enum><header>In
			 general</header><text>The Secretary may conduct pilot projects to evaluate the
			 feasibility and effectiveness of using paperless hazard communications systems.
			 At least 1 of the pilot projects under this section shall take place in a rural
			 area.</text>
			</subsection><subsection id="IDc138247e84514bfc8a9c721cf29ef06b"><enum>(b)</enum><header>Requirements</header><text>In
			 conducting pilot projects under this section, the Secretary—</text>
				<paragraph id="ID0b91747c922b4befbd9c76131912289b"><enum>(1)</enum><text>may not waive the
			 requirements under section 5110 of title 49, United States Code; and</text>
				</paragraph><paragraph id="ID7b6b6134f40b46e49a68c8175d36db40"><enum>(2)</enum><text>shall consult
			 with organizations representing—</text>
					<subparagraph id="IDbdc8afb1a0cb4f5c8672e017bbab9780"><enum>(A)</enum><text>fire services
			 personnel;</text>
					</subparagraph><subparagraph id="IDc83e401f1aef48d4a4cbeb637d36c8dd"><enum>(B)</enum><text>law enforcement
			 and other appropriate enforcement personnel;</text>
					</subparagraph><subparagraph id="IDab869827a716450e862293519070b0d5"><enum>(C)</enum><text>other emergency
			 response providers;</text>
					</subparagraph><subparagraph id="ID4f683934868f4595a3daaa2055a22550"><enum>(D)</enum><text>persons who offer
			 hazardous material for transportation;</text>
					</subparagraph><subparagraph id="IDafe5fc36b7bb4ad89bdae5f570aa531f"><enum>(E)</enum><text>persons who
			 transport hazardous material by air, highway, rail, and water; and</text>
					</subparagraph><subparagraph id="IDf0358a956360440680c7b3f2f264f132"><enum>(F)</enum><text>employees of
			 persons who transport or offer for transportation hazardous material by air,
			 highway, rail, and water.</text>
					</subparagraph></paragraph></subsection><subsection id="ID5857daaa6d07404cb6948c44749600fc"><enum>(c)</enum><header>Report</header><text>Not
			 later than 2 years after the date of the enactment of this Act, the Secretary
			 shall—</text>
				<paragraph id="IDabd756bcc49846708028ec7f1aa270f2"><enum>(1)</enum><text>prepare a report
			 on the results of the pilot projects carried out under this section,
			 including—</text>
					<subparagraph id="ID8759de1a23134519bd544aed587685bb"><enum>(A)</enum><text>a detailed
			 description of the pilot projects;</text>
					</subparagraph><subparagraph id="ID06090cc31dbf49e5a2b7948ef117c3b1"><enum>(B)</enum><text>an evaluation of
			 each pilot project, including an evaluation of the performance of each
			 paperless hazard communications system in such project;</text>
					</subparagraph><subparagraph id="IDc63b4ed703ed4ab0afbb4f3d778ccfa4"><enum>(C)</enum><text>an assessment of
			 the safety and security impact of using paperless hazard communications
			 systems, including any impact on the public, emergency response, law
			 enforcement, and the conduct of inspections and investigations; and</text>
					</subparagraph><subparagraph id="IDf2f251e19d7947e1bb160f0d121acfbc"><enum>(D)</enum><text>a recommendation
			 on whether paperless hazard communications systems should be permanently
			 incorporated into the Federal hazardous material transportation safety program
			 under chapter 51 of title 49, United States Code; and</text>
					</subparagraph></paragraph><paragraph id="IDeb41200e021e4b73809b30fed582d7e6"><enum>(2)</enum><text>submit a final
			 report to the <committee-name committee-id="SSCM00">Committee on Commerce,
			 Science, and Transportation of the Senate</committee-name> and the
			 <committee-name committee-id="">Committee on Transportation and Infrastructure
			 of the House of Representatives</committee-name> that contains the results of
			 the pilot projects carried out under this section, including the matters
			 described in paragraph (1).</text>
				</paragraph></subsection><subsection id="ID285cfa6c0050439c867041ec4b169fa6"><enum>(d)</enum><header>Paperless
			 hazard communications system defined</header><text>In this section, the term
			 <term>paperless hazard communications system</term> means the use of advanced
			 communications methods, such as wireless communications devices, to convey
			 hazard information between all parties in the transportation chain, including
			 emergency responders and law enforcement personnel. The format of communication
			 may be equivalent to that used by the carrier.</text>
			</subsection></section><section id="idD4711D087A3842B78E06B3BD742DF191"><enum>7.</enum><header>Improving data
			 collection, analysis, and reporting</header>
			<subsection id="IDe3b6841ee5fc4693a9ee3f32ef4307c6"><enum>(a)</enum><header>Assessment</header>
				<paragraph id="id1CA4B21390C744EA9BDC6A37DA5DA08C"><enum>(1)</enum><header>In
			 general</header><text>Not later than 6 months after the date of the enactment
			 of this Act, the Secretary, in coordination with the Secretary of Homeland
			 Security, as appropriate, shall conduct an assessment to improve the
			 collection, analysis, reporting, and use of data related to accidents and
			 incidents involving the transportation of hazardous material.</text>
				</paragraph><paragraph id="ID756218b995ae4f908aa8efd4e2661561"><enum>(2)</enum><header>Review</header><text>The
			 assessment conducted under this subsection shall review the methods used by the
			 Pipeline and Hazardous Materials Safety Administration (referred to in this
			 section as the <term>Administration</term>) for collecting, analyzing, and
			 reporting accidents and incidents involving the transportation of hazardous
			 material, including the adequacy of—</text>
					<subparagraph id="IDf7bbd681b10b41048318a005e306dee2"><enum>(A)</enum><text>information
			 requested on the accident and incident reporting forms required to be submitted
			 to the Administration;</text>
					</subparagraph><subparagraph id="IDa1c94f7cacfe4fbc830f4c4c11080560"><enum>(B)</enum><text>methods used by
			 the Administration to verify that the information provided on such forms is
			 accurate and complete;</text>
					</subparagraph><subparagraph id="ID2e5d44a0bd2a4034a1549af5e1a3ba91"><enum>(C)</enum><text>accident and
			 incident reporting requirements, including whether such requirements should be
			 expanded to include shippers and consignees of hazardous materials;</text>
					</subparagraph><subparagraph id="id999A01A215404BBABBEEF87020782420"><enum>(D)</enum><text>resources of the
			 Administration related to data collection, analysis, and reporting, including
			 staff and information technology; and</text>
					</subparagraph><subparagraph id="ID3c211fcd29ec49d2ad5acd39a2ac9d60"><enum>(E)</enum><text>the database used
			 by the Administration for recording and reporting such accidents and incidents,
			 including the ability of users to adequately search the database and find
			 information.</text>
					</subparagraph></paragraph></subsection><subsection id="ID2d094a5e1c5b4cad8f9af76e726cb834"><enum>(b)</enum><header>Development of
			 action plan</header><text>Not later than 9 months after the date of the
			 enactment of this Act, the Secretary shall develop an action plan and timeline
			 for improving the collection, analysis, reporting, and use of data by the
			 Administration, including revising the database of the Administration, as
			 appropriate.</text>
			</subsection><subsection id="ID8246dd5971de4b9ebbfa0edee7d74952"><enum>(c)</enum><header>Submission to
			 Congress</header><text>Not later than 15 days after the completion of the
			 action plan and timeline under subsection (c), the Secretary shall submit the
			 action plan and timeline to the <committee-name committee-id="SSCM00">Committee
			 on Commerce, Science, and Transportation of the Senate</committee-name> and the
			 <committee-name committee-id="">Committee on Transportation and Infrastructure
			 of the House of Representatives</committee-name>.</text>
			</subsection><subsection id="id31FBF958A75B456CB387B8AAFB8E93D4"><enum>(d)</enum><header>Reporting
			 requirements</header><text>Section 5125(b)(1)(D) is amended by inserting
			 <quote>and other hazardous materials transportation incident reporting to the
			 9–1–1 emergency system or involving State or local emergency responders in the
			 initial response to the incident</quote> before the period at the end.</text>
			</subsection></section><section id="IDdfbe0693fdfb47d6b1196ed9b1fbe132"><enum>8.</enum><header>Loading and
			 unloading of hazardous materials</header>
			<subsection id="id007B864250914887A5E5E8BE4C86E293"><enum>(a)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 2 years after date of the
			 enactment of this Act, the Secretary, after consultation with the Department of
			 Labor and the Environmental Protection Agency, as appropriate, and after
			 providing notice and an opportunity for public comment shall prescribe
			 regulations establishing uniform procedures among facilities for the safe
			 loading and unloading of hazardous materials on and off tank cars and cargo
			 tank trucks.</text>
			</subsection><subsection id="id355CC46F466B44A3AC878054EC7886D9"><enum>(b)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The regulations prescribed under subsection
			 (a) may include procedures for equipment inspection, personnel protection, and
			 necessary safeguards.</text>
			</subsection><subsection id="idAEF99EA3F1A74E7A89FC2D9D3CA7A78B"><enum>(c)</enum><header>Consideration</header><text display-inline="yes-display-inline">In prescribing regulations under subsection
			 (a), the Secretary shall give due consideration to carrier rules and procedures
			 that produce an equivalent level of safety.</text>
			</subsection></section><section id="IDb58cbb008882450a817964779225a340"><enum>9.</enum><header>Hazardous
			 material technical assessment, research and development, and analysis
			 program</header>
			<subsection id="ID81090e52cb944014b4d70b2fe9d7af72"><enum>(a)</enum><header>In
			 general</header><text>Chapter 51 is amended by inserting after section 5117 the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id74EA762EAA0141AA8D1E427DD7C70E07" style="USC">
					<section id="IDd553cc6dbf0242ae99e1f5a8bcb41cfd"><enum>5118.</enum><header>Hazardous
				material technical assessment, research and development, and analysis
				program</header>
						<subsection id="IDe0f1d4e7a75b4fcbb033d978812a33ba"><enum>(a)</enum><header>Risk
				reduction</header>
							<paragraph id="id3A34EBE209354147A9A8371031E26907"><enum>(1)</enum><header>Program
				authorized</header><text>The Secretary of Transportation may develop and
				implement a hazardous material technical assessment, research and development,
				and analysis program for the purpose of—</text>
								<subparagraph id="idC99CA4F8DC9945628695F895B250094C"><enum>(A)</enum><text>reducing the
				risks associated with the transportation of hazardous material; and</text>
								</subparagraph><subparagraph id="idB9AC0570EC3A4109B8FEDE975B2F1305"><enum>(B)</enum><text>identifying and
				evaluating new technologies to facilitate the safe, secure, and efficient
				transportation of hazardous material.</text>
								</subparagraph></paragraph><paragraph id="idD89FFD084E7B4B52A8124A1D5F6A96AB"><enum>(2)</enum><header>Coordination</header><text>In
				developing the program under paragraph (1), the Secretary shall—</text>
								<subparagraph id="id2D5395C4EE3045FB8AF2956393FF1AEA"><enum>(A)</enum><text>utilize
				information gathered from other modal administrations with similar programs;
				and</text>
								</subparagraph><subparagraph id="id33A675AB48A44FA6A886408F3FA54AD4"><enum>(B)</enum><text>coordinate with
				other modal administrations, as appropriate.</text>
								</subparagraph></paragraph></subsection><subsection id="ID6f3864ff681b44968e622fae3441dff9"><enum>(b)</enum><header>Cooperation</header><text>In
				carrying out subsection (a), the Secretary may work cooperatively with
				regulated and other entities, including shippers, carriers, emergency
				responders, State and local officials, and academic
				institutions.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDb81fdab4fbf144478d372246246c380f"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The chapter analysis for chapter 51 is amended by
			 inserting after the item relating to section 5117 the following:</text>

			</subsection></section><section id="idC544456B4DBF4F2F9F899288A206D817"><enum>10.</enum><header>Hazardous
			 Material Enforcement Training Program</header>
			<subsection id="ID05e683f30fee4850beeeb7a5e40ecb46"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall establish a multimodal hazardous
			 material enforcement training program for government hazardous materials
			 inspectors and investigators—</text>
				<paragraph id="ID321005c067bf4ae297ec18518bde5c80"><enum>(1)</enum><text>to develop
			 uniform performance standards for training hazardous material inspectors and
			 investigators; and</text>
				</paragraph><paragraph id="ID807ba19ebca6457690160d95ca77b43d"><enum>(2)</enum><text>to train
			 hazardous material inspectors and investigators on—</text>
					<subparagraph id="id356D9491D793460181F22DFF147F888D"><enum>(A)</enum><text>how to collect,
			 analyze, and publish findings from inspections and investigations of accidents
			 or incidents involving the transportation of hazardous material; and</text>
					</subparagraph><subparagraph id="ID9e0c5d63e7414bdfbe3c4dd66db75411"><enum>(B)</enum><text>how to identify
			 noncompliance with regulations issued under chapter 51 of title 49, United
			 States Code, and take appropriate enforcement action.</text>
					</subparagraph></paragraph></subsection><subsection id="ID3f978ac16e0c4e6c9a0c91145aa96d66"><enum>(b)</enum><header>Standards and
			 guidelines</header><text>Under the program established under this section, the
			 Secretary may develop—</text>
				<paragraph id="IDdca61002b71e4125a56e3bfc3a8b3385"><enum>(1)</enum><text>guidelines for
			 hazardous material inspector and investigator qualifications;</text>
				</paragraph><paragraph id="ID9f97a37f6a3c4b33ad8b98e0bf2d29cf"><enum>(2)</enum><text>best practices
			 and standards for hazardous material inspector and investigator training
			 programs; and</text>
				</paragraph><paragraph id="ID9afa49bfdf2b411e86c37176f9bdb3dd"><enum>(3)</enum><text>standard
			 protocols to coordinate investigation efforts among Federal, State, and local
			 jurisdictions on accidents or incidents involving the transportation of
			 hazardous material.</text>
				</paragraph></subsection><subsection id="IDa512e9e135fb4a61911863b1b9916726"><enum>(c)</enum><header>Availability</header><text>The
			 standards, protocols, and findings of the program established under this
			 section—</text>
				<paragraph id="IDf67b9eb1395948abaecc379fce8f679c"><enum>(1)</enum><text>shall be
			 mandatory for—</text>
					<subparagraph id="idF5216692EF314A4A8CC59622CB07D3CF"><enum>(A)</enum><text>the Department of
			 Transportation’s multimodal personnel conducting hazardous material enforcement
			 inspections or investigations; and</text>
					</subparagraph><subparagraph id="IDb13ea805516548eb97b399b799e59f8d"><enum>(B)</enum><text>State employees
			 who conduct federally funded compliance reviews, inspections, or
			 investigations; and</text>
					</subparagraph></paragraph><paragraph id="ID03b8ac8b6a234aba803a2c97326966ed"><enum>(2)</enum><text>shall be made
			 available to Federal, State, and local hazardous materials safety enforcement
			 personnel.</text>
				</paragraph></subsection></section><section id="idE644515CCE3141928C4E5CA11808E5F3"><enum>11.</enum><header>Inspections</header>
			<subsection id="IDafd1a01dca2147b784da151b66f83dee"><enum>(a)</enum><header>Notice of
			 enforcement measures</header><text>Section 5121(c)(1) is amended—</text>
				<paragraph id="IDec20761491804d2bbecedc6356726f40"><enum>(1)</enum><text>in subparagraph
			 (E), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="IDb4eb0531e0124240ab1ecef0d5529da1"><enum>(2)</enum><text>in subparagraph
			 (F), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="IDbab7b3367633452bb5af816cea0db376"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idCF69CF73CFF24D8B8CD836C075BC1024" style="OLC">
						<subparagraph id="ID31ac45453f6344949b2e81c84186b704"><enum>(G)</enum><text>shall provide to
				the affected offeror, carrier, packaging manufacturer or tester, or other
				person responsible for the package reasonable notice of—</text>
							<clause id="id518DCBB0789A4046B56D291D00FE6E02"><enum>(i)</enum><text>his or her
				decision to exercise his or her authority under paragraph (1);</text>
							</clause><clause id="id29E6CAA519404E76A96B9692B088B8C9"><enum>(ii)</enum><text>any findings
				made; and</text>
							</clause><clause id="idAD79C72483754E97BF1E2ABF1E29F95D"><enum>(iii)</enum><text>any actions
				being taken as a result of a finding of
				noncompliance.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDdb8fa539fae247ec9a08c529ca888d7a"><enum>(b)</enum><header>Regulations</header><text>Section
			 5121(e) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA2A1581917484CCC9A68FBA07D1C30C4" style="OLC">
					<paragraph id="ID94dd859acf6341ba9fef1170b7956709"><enum>(3)</enum><header>Matters to be
				addressed</header><text>The regulations issued under this subsection shall
				address—</text>
						<subparagraph id="IDfd581039f7184a918224f340d7f26243"><enum>(A)</enum><text>the safe and
				expeditious resumption of transportation of perishable hazardous material,
				including radiopharmaceuticals and other medical products, that may require
				timely delivery due to life-threatening situations;</text>
						</subparagraph><subparagraph id="IDfbccaef0daf84858806f41a5235358c1"><enum>(B)</enum><text>the means by
				which—</text>
							<clause id="id8CC1D1B0DE0B4506B85A0A3BAB557B57"><enum>(i)</enum><text>noncompliant
				packages that present an imminent hazard are placed out-of-service until the
				condition is corrected; and</text>
							</clause><clause id="id4F521E430FE647DBA98D5E0AD4D40E5B"><enum>(ii)</enum><text>noncompliant
				packages that do not present a hazard are moved to their final
				destination;</text>
							</clause></subparagraph><subparagraph id="ID28785703827b4800b58923d0c38b1eff"><enum>(C)</enum><text>appropriate
				training and equipment for inspectors; and</text>
						</subparagraph><subparagraph id="ID5b1c9916596346b3afebed8769dc3380"><enum>(D)</enum><text>the proper
				closure of packaging in accordance with the hazardous material
				regulations.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDe3f9395ddf17463a928c027aa53344c9"><enum>(c)</enum><header>Grants and
			 cooperative agreements</header><text>Section 5121(g)(1) is amended by inserting
			 <quote>safety and</quote> before <quote>security</quote>.</text>
			</subsection></section><section id="IDe1066b0ab62642f0b01ccc7aaf45309c"><enum>12.</enum><header>Civil
			 penalties</header><text display-inline="no-display-inline">Section 5123 is
			 amended—</text>
			<paragraph id="ID8b782eac6e21403a9c1c89c28880720b"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="idF0F65F0861DB47C78EA4E053ED048C89"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>$50,000</quote> and inserting <quote>$75,000</quote>;
			 and</text>
				</subparagraph><subparagraph id="idF03242AEC79840F4B77FFF19CA40A442"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>$100,000</quote> and inserting <quote>$175,000</quote>;
			 and</text>
				</subparagraph></paragraph><paragraph id="id41B285A626AF4F1FB4D45C97D5C7A76F"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4782EF11559741228C9DC9A21DE4E309" style="OLC">
					<subsection id="IDfac9cbce7aef4243baa21f4aa74d14a2"><enum>(h)</enum><header>Penalty for
				obstruction of inspections and investigations</header><text>The Secretary may
				impose a penalty on a person who obstructs or prevents the Secretary from
				carrying out inspections or investigations under subsection (c) or (i) of
				section 5121.</text>
					</subsection><subsection id="ID8a4875043540430c894b2c279c03355b"><enum>(i)</enum><header>Prohibition on
				hazardous material operations after nonpayment of penalties</header>
						<paragraph id="IDa0caec8b37f84b0f8c6acd05c07b0d73"><enum>(1)</enum><header>In
				general</header><text>Except as provided under paragraph (2), a person subject
				to the jurisdiction of the Secretary under this chapter who fails to pay a
				civil penalty assessed under this chapter, or fails to arrange and abide by an
				acceptable payment plan for such civil penalty, may not conduct any activity
				regulated under this chapter beginning on the 91st day after the date specified
				by order of the Secretary for payment of such penalty unless the person has
				filed a formal administrative or judicial appeal of the penalty.</text>
						</paragraph><paragraph id="IDd75b5844f8554880abcc8d827346e591"><enum>(2)</enum><header>Exception</header><text>Paragraph
				(1) shall not apply to any person who is unable to pay a civil penalty because
				such person is a debtor in a case under chapter 11 of title 11.</text>
						</paragraph><paragraph id="ID9743763687e448f88ddc4ae607197291"><enum>(3)</enum><header>Rulemaking</header><text>Not
				later than 2 years after the date of the enactment of this subsection, the
				Secretary, after providing notice and an opportunity for public comment, shall
				issue regulations that—</text>
							<subparagraph id="idB5F0F3530286462CA92FC4F5BF8953E4"><enum>(A)</enum><text>set forth
				procedures to require a person who is delinquent in paying civil penalties to
				cease any activity regulated under this chapter until payment has been made or
				an acceptable payment plan has been arranged; and</text>
							</subparagraph><subparagraph id="id75F64475088A41DDBAD063B7F52358F2"><enum>(B)</enum><text>ensures that the
				person described in subparagraph (A)—</text>
								<clause id="idD675BEE2B2DC4C96B1C7239AB2BFBB70"><enum>(i)</enum><text>is notified in
				writing; and</text>
								</clause><clause id="idBC8D8FFE8B9C4AD89FC0295726DB9157"><enum>(ii)</enum><text>is given an
				opportunity to respond before the person is required to cease the
				activity.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID9a88f2e21a23415f919ca1d1e9cbcc44"><enum>13.</enum><header>Reporting of
			 fees</header><text display-inline="no-display-inline">Section 5125(f)(2) is
			 amended by striking <quote>, upon the Secretary’s request,</quote> and
			 inserting <quote>biennially</quote>.</text>
		</section><section id="id57D57934940C4C07A47F9A7D40C6268C"><enum>14.</enum><header>Special
			 permits, approvals, and exclusions</header>
			<subsection id="ID7cd48ae33234494082fd435c59e60569"><enum>(a)</enum><header>In
			 general</header><text>Section 5117 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idAB47F3C1AC4C4A89A6D7F4317912F76B" style="USC">
					<section id="IDdd5947e772094c528aa59f541a676d32"><enum>5117.</enum><header>Special
				permits, approvals, and exclusions</header>
						<subsection id="ID1fa1de3d317b447c8c8c1161cdbe30b5"><enum>(a)</enum><header>Authority To
				issue special permits</header>
							<paragraph id="IDe5657bc45c1343888f9fc795cc7d8466"><enum>(1)</enum><header>Conditions</header><text>The
				Secretary of Transportation may issue, modify, or terminate a special permit
				implementing new technologies or authorizing a variance from a provision under
				this chapter or a regulation prescribed under section 5103(b), 5104, 5110, or
				5112 to a person performing a function regulated by the Secretary under section
				5103(b)(1) to achieve—</text>
								<subparagraph id="IDbf343110e97946188f51fa64fb8de9fc"><enum>(A)</enum><text>a safety level at
				least equal to the safety level required under this chapter; or</text>
								</subparagraph><subparagraph id="ID0bf8fff12dec46538202b75301653608"><enum>(B)</enum><text>a safety level
				consistent with the public interest and this chapter, if a required safety
				level does not exist.</text>
								</subparagraph></paragraph><paragraph id="ID09f7ca42741e4d6a9d2e75ab736bd18f"><enum>(2)</enum><header>Findings
				required</header>
								<subparagraph id="ID2cb9b66a9dc84ce2a30e15cb9d15e557"><enum>(A)</enum><header>In
				general</header><text>Before issuing, renewing, or modifying a special permit
				or granting party status to a special permit, the Secretary shall determine
				that the person is fit to conduct the activity authorized by such permit in a
				manner that achieves the level of safety required under paragraph (1).</text>
								</subparagraph><subparagraph id="ID346f72a3b96745b8be304ae6ac6ed6c1"><enum>(B)</enum><header>Considerations</header><text>In
				making the determination under subparagraph (A), the Secretary shall
				consider—</text>
									<clause id="idE0D01F004FC44694BC4E54548AFDAC4C"><enum>(i)</enum><text>the person’s
				safety history (including prior compliance history);</text>
									</clause><clause id="idB15E26B928214D2AA5E3A1D4B858207E"><enum>(ii)</enum><text>the person’s
				accident and incident history; and</text>
									</clause><clause id="id988D45A2F08E476498089B6006A0805C"><enum>(iii)</enum><text>any other
				information the Secretary considers appropriate to make such a
				determination.</text>
									</clause></subparagraph></paragraph><paragraph id="IDb33ffb20f9f0438ab178b5ec42337fd6"><enum>(3)</enum><header>Effective
				period</header><text>A special permit issued under this section—</text>
								<subparagraph id="id9AF71638C2B14F5488F0D5F3410C5E0B"><enum>(A)</enum><text>shall be for an
				initial period of not more than 2 years;</text>
								</subparagraph><subparagraph id="idBAA94C1AD78842FCB6DA791AC87967C0"><enum>(B)</enum><text>may be renewed by
				the Secretary upon application—</text>
									<clause id="id4240E9E2ED404AEDA2D97977681AE75B"><enum>(i)</enum><text>for successive
				periods of not more than 4 years each; or</text>
									</clause><clause id="idE51C940E50EF43BEBACC73233223DB6C"><enum>(ii)</enum><text>in the case of a
				special permit relating to section 5112, for an additional period of not more
				than 2 years.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="ID3048cc5601cd4df6bd79bd0f7045cccc"><enum>(b)</enum><header>Applications</header>
							<paragraph id="IDd33d88f1211242fdb35453394c0ec7f6"><enum>(1)</enum><header>Required
				documentation</header><text>When applying for a special permit or the renewal
				or modification of a special permit or requesting party status to a special
				permit under this section, the Secretary shall require the person to submit an
				application that contains—</text>
								<subparagraph id="idB49DC890DC0C40A5A9A1A99325D961DD"><enum>(A)</enum><text>a detailed
				description of the person’s request;</text>
								</subparagraph><subparagraph id="id42049CC07106444DB1BA75FE8F98AB72"><enum>(B)</enum><text>a listing of the
				person’s current facilities and addresses where the special permit will be
				utilized;</text>
								</subparagraph><subparagraph id="idE2A35C9EB5274CC2A86A9DDA3D6444B0"><enum>(C)</enum><text>a safety analysis
				prescribed by the Secretary that justifies the special permit;</text>
								</subparagraph><subparagraph id="id64ED96525881499A8263D2F969D59CCA"><enum>(D)</enum><text>documentation to
				support the safety analysis;</text>
								</subparagraph><subparagraph id="id3AAA318DC1E042ED90388D892E8F24DD"><enum>(E)</enum><text>a certification
				of safety fitness; and</text>
								</subparagraph><subparagraph id="id2C8AEFDDAD764C4A94D024C54C4BCF59"><enum>(F)</enum><text>proof of
				registration, as required under section 5108.</text>
								</subparagraph></paragraph><paragraph id="ID507055d2c5d242ee86bfc9716f284744"><enum>(2)</enum><header>Public
				notice</header><text>The Secretary shall—</text>
								<subparagraph id="id677F5223D2D241ABA54FDA008C4A7121"><enum>(A)</enum><text>publish notice in
				the Federal Register that an application for a special permit has been filed;
				and</text>
								</subparagraph><subparagraph id="idBF25F69432214A4BB032FC8444815FA4"><enum>(B)</enum><text>provide the
				public an opportunity to inspect and comment on the application.</text>
								</subparagraph></paragraph><paragraph id="ID3c91a0d1888a4fc9b48ba5f013264a0d"><enum>(3)</enum><header>Savings
				clause</header><text>This subsection does not require the release of
				information protected by law from public disclosure.</text>
							</paragraph></subsection><subsection id="IDcb9ea89f90f5407d8ddfd4a2bb9f43ff"><enum>(c)</enum><header>Coordinate and
				communicate with modal contact officials</header>
							<paragraph id="ID8a0995d6f2f94a7bab58851d3e8064a0"><enum>(1)</enum><header>In
				general</header><text>In evaluating applications under subsection (b), and
				making the findings and determinations under subsections (a), (e), and (h), the
				Administrator of the Pipeline and Hazardous Materials Safety Administration
				shall consult, coordinate, or notify the modal contact official responsible for
				the specified mode of transportation that will be utilized under a special
				permit or approval before—</text>
								<subparagraph id="idBCF342DD1B7A44448368A76ABCA99D17"><enum>(A)</enum><text>issuing,
				modifying, or renewing the special permit;</text>
								</subparagraph><subparagraph id="id1F56BE029F734DB38F66F7DB745FD215"><enum>(B)</enum><text>granting party
				status to the special permit; or</text>
								</subparagraph><subparagraph id="id59CC0C68B3A4442DB8FDCB668A5FC2C9"><enum>(C)</enum><text>issuing or
				renewing the special permit or approval.</text>
								</subparagraph></paragraph><paragraph id="ID5de02a5fd8ea4483af81c71520369f8e"><enum>(2)</enum><header>Modal contact
				official defined</header><text>In this section, the term <term>modal contact
				official</term> means—</text>
								<subparagraph id="IDd2cf81c41edb4b988e03000fe46ea6be"><enum>(A)</enum><text>the Administrator
				of the Federal Aviation Administration;</text>
								</subparagraph><subparagraph id="ID79b535269a4740e392ae8a632befbc43"><enum>(B)</enum><text>the Administrator
				of the Federal Motor Carrier Safety;</text>
								</subparagraph><subparagraph id="ID2f72c4b8a61b4b56b89e8e032420d4f3"><enum>(C)</enum><text>the Administrator
				of the Federal Railroad Administration; and</text>
								</subparagraph><subparagraph id="ID4e02c41d4de04a789ffe0979eb39ac80"><enum>(D)</enum><text>the Commandant of
				the Coast Guard.</text>
								</subparagraph></paragraph></subsection><subsection id="ID0d0503f72edc42fab20aa739a58a809f"><enum>(d)</enum><header>Applications To
				be dealt with promptly</header><text>The Secretary shall—</text>
							<paragraph id="id3D1F739933AC4E99BB2E14F312B61061"><enum>(1)</enum><text>issue, modify,
				renew, or grant party status to a special permit or approval for which a
				request was filed under this section, or deny the issuance, modification,
				renewal, or grant, on or before the last day of the 180-day period beginning on
				the first day of the month following the date of the filing of the request;
				or</text>
							</paragraph><paragraph id="id03FD333A0D504865AD4F5258922C5354"><enum>(2)</enum><text>publish a
				statement in the Federal Register that—</text>
								<subparagraph id="idC06C4F0F448849AF8E63A4F05C61B3A1"><enum>(A)</enum><text>describes the
				reason for the delay of the Secretary's decision on the special permit or
				approval; and</text>
								</subparagraph><subparagraph id="idE6C31469034A4368A7A1D94D56F8A1F8"><enum>(B)</enum><text>includes an
				estimate of the additional time necessary before the decision is made.</text>
								</subparagraph></paragraph></subsection><subsection id="IDc5c0b08c4b694aeaaae9c6e209b640fe"><enum>(e)</enum><header>Emergency
				processing of special permits</header>
							<paragraph id="IDa48f093887b34e5b995a700ec2b76183"><enum>(1)</enum><header>Findings
				required</header><text>The Secretary may not grant a request for emergency
				processing of a special permit unless the Secretary determines that—</text>
								<subparagraph id="ID4a4e451971924aff95bfbe94571849b0"><enum>(A)</enum><text>a special permit
				is necessary for national security purposes;</text>
								</subparagraph><subparagraph id="ID06d5915adfa34295a8926e5b51f6b3cd"><enum>(B)</enum><text>processing on a
				routine basis under this section would result in significant injury to persons
				or property; or</text>
								</subparagraph><subparagraph id="ID922054e2d06c4db48b20db989867b868"><enum>(C)</enum><text>a special permit
				is necessary to prevent significant economic loss or damage to the environment
				that could not be prevented if the application were processed on a routine
				basis.</text>
								</subparagraph></paragraph><paragraph id="ID83f54302192a44b4a159a4b86fe74387"><enum>(2)</enum><header>Waiver of
				fitness test</header><text>The Secretary may waive the requirement under
				subsection (a)(2) for a request for which the Secretary makes a determination
				under subparagraph (A) or (B) of paragraph (1).</text>
							</paragraph><paragraph id="ID4d130741fdc64de39454148fa4c172cb"><enum>(3)</enum><header>Notification</header><text>Not
				later than 90 days after the date of issuance of a special permit under this
				subsection, the Secretary shall publish a notice in the Federal Register of the
				issuance that includes—</text>
								<subparagraph id="idEDFA46D3324D4A159690F05770133AB7"><enum>(A)</enum><text>a statement of
				the basis for the finding of emergency; and</text>
								</subparagraph><subparagraph id="id34F4C2EF4E794DC9880FCAD6188484F7"><enum>(B)</enum><text>the scope and
				duration of the special permit.</text>
								</subparagraph></paragraph><paragraph id="ID5277e14aab8948e69ebc7e46c9c847e7"><enum>(4)</enum><header>Effective
				period</header><text>A special permit issued under this subsection shall be
				effective for a period not to exceed 180 days.</text>
							</paragraph></subsection><subsection id="ID27e32b21baeb47d0908c9cc4406a7331"><enum>(f)</enum><header>Exclusions</header>
							<paragraph id="IDed5820cee23844c98b372458f3cc2b93"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall exclude, in any part, from this
				chapter and regulations prescribed under this chapter—</text>
								<subparagraph id="ID04c53200c56b44f4b48d839f20823dd1"><enum>(A)</enum><text>a public vessel
				(as defined in section 2101 of title 46);</text>
								</subparagraph><subparagraph id="ID0b996a5af1e9448e9ebb0ac8a3a1e5e2"><enum>(B)</enum><text>a vessel exempted
				under section 3702 of title 46 or from chapter 37 of title 46; and</text>
								</subparagraph><subparagraph id="ID4bd61c0285e34db7abea90528a1c024e"><enum>(C)</enum><text>a vessel to the
				extent it is regulated under the Ports and Waterways Safety Act of 1972 (33
				U.S.C. 1221, et seq.).</text>
								</subparagraph></paragraph><paragraph id="IDcee01d2ead58464fbf905237f38c4ae0"><enum>(2)</enum><header>Firearms</header><text>This
				chapter and regulations prescribed under this chapter do not prohibit—</text>
								<subparagraph id="ID2ea13e503382429c9df51865beefd9cf"><enum>(A)</enum><text>or regulate
				transportation of a firearm (as defined in section 232 of title 18), or
				ammunition for a firearm, by an individual for personal use; or</text>
								</subparagraph><subparagraph id="IDccabc2b76eae48fb99872baa5400aef6"><enum>(B)</enum><text>transportation of
				a firearm or ammunition in commerce.</text>
								</subparagraph></paragraph></subsection><subsection id="ID2cd6f3f51601409c83dc4f70fbba1fb9"><enum>(g)</enum><header>Limitation on
				authority</header><text>Unless the Secretary decides that an emergency exists,
				a person subject to this chapter may only be granted a variance from this
				chapter through a special permit or renewal granted under this section.</text>
						</subsection><subsection id="ID735224d709d54f5988bc9e56185c7cf7"><enum>(h)</enum><header>Approvals</header>
							<paragraph id="IDeb2065b240754890a424ef62a7278ec2"><enum>(1)</enum><header>Findings
				required</header>
								<subparagraph id="ID412cb299832743c4b81cae1699c0e4e8"><enum>(A)</enum><header>In
				general</header><text>The Secretary may not issue an approval or grant the
				renewal of an approval pursuant to part 107 of title 49, Code of Federal
				Regulations until the Secretary has determined that the person is fit, willing,
				and able to conduct the activity authorized by the approval in a manner that
				achieves the level of safety required under subsection (a)(1).</text>
								</subparagraph><subparagraph id="IDd3bb369980bd4608b7e49772219b3090"><enum>(B)</enum><header>Considerations</header><text>In
				making a determination under subparagraph (A), the Secretary shall
				consider—</text>
									<clause id="idFFB1BE0AA13C42319A2AD57D3FDD33F3"><enum>(i)</enum><text>the person’s
				safety history (including prior compliance history);</text>
									</clause><clause id="id677ED21637F545A785142CA86F96D02F"><enum>(ii)</enum><text>the person’s
				accident and incident history; and</text>
									</clause><clause id="id80E17BD3513F4018813E53E4686CC8E1"><enum>(iii)</enum><text>any other
				information the Secretary considers appropriate to make such a
				determination.</text>
									</clause></subparagraph></paragraph><paragraph id="IDf43c8c67a09143e0b6a96ab4004ec6db"><enum>(2)</enum><header>Required
				documentation</header><text>When applying for an approval or renewal or
				modification of an approval under this section, the Secretary shall require the
				person to submit an application that contains—</text>
								<subparagraph id="idDD95C883D01249E78B165A09751BD249"><enum>(A)</enum><text>a detailed
				description of the person’s request;</text>
								</subparagraph><subparagraph id="idF0A0FC44CFD148F297633880430C0410"><enum>(B)</enum><text>a listing of the
				persons current facilities and addresses where the approval will be
				utilized;</text>
								</subparagraph><subparagraph id="idD7EACE4E788147CB82850B64575CF11E"><enum>(C)</enum><text>a safety analysis
				prescribed by the Secretary that justifies the approval;</text>
								</subparagraph><subparagraph id="id1309BC8DC762497997E9AEE1F62972F8"><enum>(D)</enum><text>documentation to
				support the safety analysis;</text>
								</subparagraph><subparagraph id="idE7E492BDEAAA4DE588B001DD5692175F"><enum>(E)</enum><text>a certification
				of safety fitness; and</text>
								</subparagraph><subparagraph id="id8751708E30B549BEBE32F5F05C64A117"><enum>(F)</enum><text>the verification
				of registration required under section 5108.</text>
								</subparagraph></paragraph><paragraph id="ID66fda5152bc84843b735fedb45d35996"><enum>(3)</enum><header>Savings
				provision</header><text>Nothing in this subsection may be construed to require
				the release of information protected by law from public disclosure.</text>
							</paragraph></subsection><subsection id="ID55c91a7c26f4487695fd08de5212bd36"><enum>(i)</enum><header>Noncompliance</header><text>The
				Secretary may modify, suspend, or terminate a special permit or approval if the
				Secretary determines that—</text>
							<paragraph id="idD924ADE952654936BBB2F13D79F597F9"><enum>(1)</enum><text>the person who
				was granted the special permit or approval has violated the special permit or
				approval or the regulations issued under this chapter in a manner that
				demonstrates that the person is not fit to conduct the activity authorized by
				the special permit or approval; or</text>
							</paragraph><paragraph id="idFA3827E2CA43440581A2E21BF2A22E95"><enum>(2)</enum><text>the special
				permit or approval is unsafe.</text>
							</paragraph></subsection><subsection id="ID83cd0919e79b467abeaecaa3f88fe84f"><enum>(j)</enum><header>Rulemaking</header><text>Not
				later than 2 years after the date of the enactment of this Act, the Secretary,
				after providing notice and an opportunity for public comment, shall issue
				regulations that establish—</text>
							<paragraph id="id3C377CE9E60B476A9A04880A0A5031FA"><enum>(1)</enum><text>standard
				operating procedures to support administration of the special permit and
				approval programs; and</text>
							</paragraph><paragraph id="idCC0C705B6B3B47EF97879FD0198A0BFC"><enum>(2)</enum><text>objective
				criteria to support the evaluation of special permit and approval
				applications.</text>
							</paragraph></subsection><subsection id="ID8a44bed840fb437caa63b9a8bcf9a76a"><enum>(k)</enum><header>Annual review
				of certain special permits</header>
							<paragraph id="IDf207d39c9ccd46b2879d27ccbc750b15"><enum>(1)</enum><header>Review</header><text>The
				Secretary shall conduct an annual review and analysis of special
				permits—</text>
								<subparagraph id="idD5B85E43518C4EFB9270920CBCD4D0EA"><enum>(A)</enum><text>to identify
				consistently used and longstanding special permits with an established safety
				record; and</text>
								</subparagraph><subparagraph id="id63728FC6307047739F4EDBCB1F73BB2C"><enum>(B)</enum><text>to determine
				whether such permits may be converted into the hazardous materials
				regulations.</text>
								</subparagraph></paragraph><paragraph id="IDf188188332d24103b8ace9a2386b4f47"><enum>(2)</enum><header>Factors</header><text>In
				conducting the review and analysis under paragraph (1), the Secretary may
				consider—</text>
								<subparagraph id="IDb3f3ce1a8cd7403a9e51e90891a83a34"><enum>(A)</enum><text>the safety record
				for hazardous materials transported under the special permit;</text>
								</subparagraph><subparagraph id="IDca2ea3be0cbd4e328612938cd3880313"><enum>(B)</enum><text>the application
				of a special permit;</text>
								</subparagraph><subparagraph id="IDbd00b72a4b5d44a5b89f59b00bd327b2"><enum>(C)</enum><text>the suitability
				of provisions in the special permit for incorporation into the hazardous
				materials regulations; and</text>
								</subparagraph><subparagraph id="ID5d2542fbffb14082acc9d60783e314bf"><enum>(D)</enum><text>rulemaking
				activity in related areas.</text>
								</subparagraph></paragraph><paragraph id="IDd4da077884bd422c84421c2b6694737e"><enum>(3)</enum><header>Rulemaking</header><text>After
				completing the review and analysis under paragraph (1) and providing notice and
				opportunity for public comment, the Secretary shall issue regulations, as
				needed.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDcde9750861714f78bab68ab2f84ca1a8"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis for chapter 51 is amended by striking the
			 item relating to section 5117 and inserting the following:</text>

				State shall submit the information described in subparagraph (A)(ii)—</text>

				every 2 years; and</text>
								</clause><clause id="IDba0b14416bae4cc9aa069540de2f5453"><enum>(ii)</enum><text>not later than
				60 days after a hazardous material highway route designation is established,
				amended, or
				discontinued.</text>

				</paragraph></subsection><subsection id="ID5861667cc27849cfac5f6c9b05cb93e2"><enum>(b)</enum><header>Compliance with
			 section 5112</header><text>Section 5125(c)(1) is amended by inserting <quote>,
			 and is published in the Department’s hazardous materials route registry under
			 section 5112(c)</quote> before the period at the end.</text>
			</subsection></section><section id="idA5B44CA325114902B9FF34A0EE01A0D6"><enum>16.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">Section 5128
			 is amended to read as follows:</text>

						<paragraph id="ID977b8abec5654e219585f952ea46218e"><enum>(1)</enum><text>$42,338,000 for
				fiscal year 2012; and</text>
						</paragraph><paragraph id="ID1f94092308634713a01b9b92079eae4d"><enum>(2)</enum><text>$42,762,000 for
				fiscal year 2013.</text>
						</paragraph></subsection><subsection id="ID8d1ec69749f441cfb3f4f908c1f723b6"><enum>(b)</enum><header>Hazardous
				materials emergency preparedness fund</header><text>From the Hazardous
				Materials Emergency Preparedness Fund established under section 5116(i), the
				Secretary may expend, during each of fiscal years 2012 and 2013—</text>
						<paragraph id="ID1f0293bd7c494d0bbe96e336e0848e31"><enum>(1)</enum><text>$188,000 to carry
				out section 5115;</text>
						</paragraph><paragraph id="ID18c50eeed3374fe2b9803d586f2a6cb1"><enum>(2)</enum><text>$21,800,000 to
				carry out subsections (a) and (b) of section 5116, of which not less than
				$13,650,000 shall be available to carry out section 5116(b);</text>
						</paragraph><paragraph id="IDcc75a2ee27874a1b9e264fa4b14f1d97"><enum>(3)</enum><text>$150,000 to carry
				out section 5116(f);</text>
						</paragraph><paragraph id="ID8fdfdee11ac247a9b7cbaf500768b406"><enum>(4)</enum><text>$625,000 to
				publish and distribute the Emergency Response Guidebook under section
				5116(i)(3); and</text>
						</paragraph><paragraph id="ID68605af2e9a44bb6a433b0d5f522353b"><enum>(5)</enum><text>$1,000,000 to
				carry out section 5116(j).</text>
						</paragraph></subsection><subsection id="IDb217cdfa62134726af7489ccab1903b4"><enum>(c)</enum><header>Hazardous
				materials training grants</header><text>From the Hazardous Materials Emergency
				Preparedness Fund established pursuant to section 5116(i), the Secretary may
				expend $4,000,000 for each of the fiscal years 2012 and 2013 to carry out
				section 5107(e).</text>
					</subsection><subsection id="IDdb4545ad120c4444b0a5c77bf3b63252"><enum>(d)</enum><header>Credits to
				appropriations</header>
						<paragraph id="IDd972637a7fd5450c83328e8f9ff34d3d"><enum>(1)</enum><header>Expenses</header><text>In
				addition to amounts otherwise made available to carry out this chapter, the
				Secretary may credit amounts received from a State, Indian tribe, or other
				public authority or private entity for expenses the Secretary incurs in
				providing training to the State, authority, or entity.</text>
						</paragraph><paragraph id="ID057fcb09dbc144f6b55bf011173f6382"><enum>(2)</enum><header>Availability of
				amounts</header><text>Amounts made available under this section shall remain
				available until
				expended.</text>
