		  procedures pertaining to the arrest, detention, and processing of aliens in
		  immigration enforcement operations.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idBD8E3E1A607340CBB6D0A4BA3F45E2CA" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Families First Immigration Enforcement
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id1F2212F6EAB44B1BA541ACBB2AEE84D0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id3A2D9E3DB2374CF9BBAD209E034DBCD4"><enum>(1)</enum><header display-inline="yes-display-inline">Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the
			 Department of Homeland Security.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0AB6B55385114198BF4FBDD5EE0CF14C"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Homeland Security.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC7385E2FF148470682BC51691F470D7D"><enum>(3)</enum><header display-inline="yes-display-inline">SSA</header><text display-inline="yes-display-inline">The term <term>SSA</term> means appropriate
			 State social service agencies.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idE5AC7F6E634842579EE7CEA0C441B619" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Arrest procedures</header>
			<subsection commented="no" display-inline="no-display-inline" id="id349EF35FB06842339A89A165FC24F23C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any immigration workplace enforcement
			 operation by the Department for alleged violations of the Immigration and
			 Nationality Act (8 U.S.C. 1101 et seq.), which is reasonably calculated to
			 apprehend, or results in the apprehension of, at least 50 aliens, shall be
			 carried out in accordance with the procedures described in this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDe19bee086a694190b9f201d460be3644"><enum>(b)</enum><header display-inline="yes-display-inline">State notification</header><text display-inline="yes-display-inline">The Department shall provide State
			 officials with sufficient advance notice of all immigration workplace
			 enforcement operations to allow State law enforcement officials to notify SSA
			 of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id554D3B9F470847CA8E69688D4D4186D8"><enum>(1)</enum><text display-inline="yes-display-inline">the specific area of the State that will be
			 affected;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22BCAE30388B4127843844C2FF35510F"><enum>(2)</enum><text display-inline="yes-display-inline">the languages spoken by employees at the
			 target worksite; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id849C651B310E4A0B8D542E9BF4F80555"><enum>(3)</enum><text display-inline="yes-display-inline">any special needs of the employees.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id45F46B3EECF3462E80BE5AA8F3BD3C26"><enum>(c)</enum><header display-inline="yes-display-inline">Nongovernmental organization
			 notification</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idE8BE6E4B099E437B8858A236457A0E86"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Department and SSA shall determine how
			 appropriate nongovernmental organizations will be notified on the day of the
			 enforcement action.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id205406C3CC744E86A812B0E17AA7FB0B"><enum>(2)</enum><header display-inline="yes-display-inline">Participation</header><text display-inline="yes-display-inline">At the discretion of SSA, representatives
			 of a nongovernmental organization who speak the native language of the aliens
			 detained in the enforcement action may be permitted to participate with SSA
			 officials in interviewing such aliens.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id643F84B9E151487081C6C74324C25898"><enum>(d)</enum><header display-inline="yes-display-inline">Determination of risk to
			 relatives</header><text display-inline="yes-display-inline">The Department
			 shall provide SSA with unfettered and confidential access to aliens detained in
			 the enforcement action to assist in the screening and interviews of aliens to
			 determine whether the detainee, the detainee’s children, or other vulnerable
			 people, including elderly and disabled individuals, have been placed at risk as
			 a result of the detainee’s arrest.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id08A36A617C3E42938A8DCE0C18AD839B"><enum>(e)</enum><header display-inline="yes-display-inline">Medical screening</header><text display-inline="yes-display-inline">After SSA officials have met with the alien
			 detainees, qualified medical personnel from the Division of Immigration Health
			 Services of the Department of Health and Human Services shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id059488B71EB346358BD2D2AD7DEB6150"><enum>(1)</enum><text display-inline="yes-display-inline">conduct medical screenings of the alien
			 detainees; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7033BD434147486EB8ABB743D4C20367"><enum>(2)</enum><text display-inline="yes-display-inline">identify and report any medical issues that
			 might necessitate humanitarian release or additional care.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC03A19AFDC6145EABBF792EAEF3EAE39"><enum>(f)</enum><header display-inline="yes-display-inline">Consideration of
			 recommendations</header><text display-inline="yes-display-inline">The
			 Department shall immediately consider recommendations made by SSA and the
			 Division of Immigration Health Services about alien detainees who should be
			 released on humanitarian grounds, including alien detainees who—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDabb8399a3ffd4e20a21418e9a738cf70"><enum>(1)</enum><text display-inline="yes-display-inline">have a medical condition that requires
			 special attention;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3d9236d9e8204bc5b3626c5243aa86a3"><enum>(2)</enum><text display-inline="yes-display-inline">are pregnant women;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5fb5ae1a6b2b484cad38847b52cd1c31"><enum>(3)</enum><text display-inline="yes-display-inline">are nursing mothers;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4ae4603a56af45bab2ce747749b2ea9e"><enum>(4)</enum><text display-inline="yes-display-inline">are the sole caretakers of their minor
			 children or elderly relatives;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf09fd1e1901b4d9db77a54d8a2c7cb4b"><enum>(5)</enum><text display-inline="yes-display-inline">function as the primary contact between the
			 family and those outside the home due to language barriers;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc5039721765142fba31e8e9cba4c8d48"><enum>(6)</enum><text display-inline="yes-display-inline">are needed to support their spouses in
			 caring for sick or special needs children;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8ab2e673c96b40dba82c6a244c27b710"><enum>(7)</enum><text display-inline="yes-display-inline">have spouses who are ill or otherwise
			 unable to be sole caretaker; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85968cd314d4468e81510140e23510d8"><enum>(8)</enum><text display-inline="yes-display-inline">are younger than 18 years of age.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCC77754A2EC04B139591C926375D9607"><enum>(g)</enum><header display-inline="yes-display-inline">Publicity</header><text display-inline="yes-display-inline">The Department shall provide, and advertise
			 in the mainstream and foreign language media, a toll-free number through which
			 family members of alien detainees may report such relationships to operators
			 who—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idEF3A3B13BC9941DAB5726795578496BE"><enum>(1)</enum><text display-inline="yes-display-inline">speak English and the majority language of
			 the target population of the enforcement operation; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBE18706FD3AB4317B21554AD2394E58A"><enum>(2)</enum><text display-inline="yes-display-inline">will convey such information to the
			 Department and SSA.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idD48A9AC4DF0144108682CE3CC8A64D16" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Detention procedures</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID6436f808d9c243d79e7728b67865cdc7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In order to maximize full and fair
			 visitation by children, immediate family members, and counsel, an alien should
			 be detained, to the extent space is available, in facilities within the
			 physical jurisdiction or catchment area of the local field office of United
			 States Immigration and Customs Enforcement.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5ded2a0b2c694f4db74391d576d2ae16"><enum>(b)</enum><header display-inline="yes-display-inline">Release</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idCA708C6E676340DCB8E0FB2ECB5AF39F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 72 hours after an alien’s
			 apprehension in an immigration workplace enforcement operation, the alien shall
			 be released from Department custody, in accordance with paragraph (2), if the
			 alien—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idAEEAAE5CC809481D9D9BA39299D38D7A"><enum>(A)</enum><text display-inline="yes-display-inline">is not subject to mandatory detention under
			 section 235(1)(B)(iii)(IV), 236(c), or 236A of the Immigration and Nationality
			 Act (8 U.S.C. 1225(1)(B)(iii)(IV), 1226(c), and 1226a);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4DCC3A1ACC8141F7B50D7FCE625F0120"><enum>(B)</enum><text display-inline="yes-display-inline">does not pose an immediate flight risk;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38894B8530364C4CBD6E1BC374529064"><enum>(C)</enum><text display-inline="yes-display-inline">meets any of the criteria set forth in
			 section 3(f).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD93C4763D9AB4DF7AB121F1FBE122D17"><enum>(2)</enum><header display-inline="yes-display-inline">Type of release</header><text display-inline="yes-display-inline">An alien shall be released under this
			 subsection—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id1795D40AB8E34788AC7C893A136DF2EC"><enum>(A)</enum><text display-inline="yes-display-inline">on the alien’s own recognizance;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id19276F34ECD1466FA2BA8173F712F826"><enum>(B)</enum><text display-inline="yes-display-inline">by posting a minimum bond under section
			 236(a) of the Immigration and Nationality Act (8 U.S.C. 1226(a));</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7C3C68928E314583A77E84DEA0DEC0C9"><enum>(C)</enum><text display-inline="yes-display-inline">on parole in accordance with section
			 212(d)(5)(A) of such Act (8 U.S.C. 1182(d)(5)(A)); or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3CEBFEE060324DC2B3803FBBDCADB1F4"><enum>(D)</enum><text display-inline="yes-display-inline">through the Intensive Supervision
			 Appearance Program or another comparable alternative to detention
			 program.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id2062E46EEFBA439AB5ACBFCDBB1F611E" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Legal orientation
			 presentations</header><text display-inline="no-display-inline">Any alien
			 arrested in an immigration enforcement operation that is reasonably calculated
			 to apprehend, or results in the apprehension of, at least 50 aliens shall have
			 access to legal orientation presentations provided by independent,
			 nongovernmental agencies through the Legal Orientation Program administered by
			 the Executive Office for Immigration Review.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id0AA768DD8812496A8D955FA6528E6B91" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Regulations concerning the treatment of
			 aliens in a vulnerable population in the United States</header><text display-inline="no-display-inline">Not later than 6 months after the date of
			 the enactment of this Act, the Secretary shall promulgate regulations to
			 implement this Act, in accordance with the notice and comment requirements
			 under subchapter II of chapter 5 of title 5, United States Code (commonly
			 referred to as the Administrative Procedure Act).</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDa12faf9074aa4b3baec773e04c699f54" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="no-display-inline">The Secretary shall submit an annual report
			 that describes all the actions taken by the Department to implement this Act
			 to—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id07F62F48BEA34F43910E1C9B6C9F10D6"><enum>(1)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSJU00">Committee on the Judiciary of the
			 Senate</committee-name>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB8F78183620432BAA42E87D5C48BFE4"><enum>(2)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on the Judiciary of the House of
			 Representatives</committee-name>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76A63CB48D714334B4195DCCDAB4407E"><enum>(3)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs
			 of the Senate</committee-name>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3774E08F942A4B058C4D5A9402D717FD"><enum>(4)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Homeland Security of the House of
			 Representatives</committee-name>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID4155208caa8c4406afc9686408f2664b" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act.</text>
