		<official-title>To exclude ecosystem component stocks of fish from
		  certain annual catch limits and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Fishery Science Improvement Act of
			 2011</short-title></quote>.</text>
		</section><section id="IDdc3bbdc2e35c458e8d90c667674cf59e"><enum>2.</enum><header>Improvement of
			 scientific data for annual catch limits</header>
			<subsection id="IDca82a14c5fba46adaa5a35c0361ac0f8"><enum>(a)</enum><header>Scientific data
			 required for annual catch limits</header><text>Section 104(b) of the
			 Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of
			 2006 (Public Law 109–479; 16 U.S.C. 1853 note) is amended—</text>
				<paragraph id="IDc26c2a3b2ee7482e85ffbe5b7accbcec"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="ID4388bc3e4d13413683bf537f36963634"><enum>(2)</enum><text>by redesignating
			 paragraph (3) as paragraph (5); and</text>
				</paragraph><paragraph id="ID9865ae8cea90496cbaf4d6d3fea17ba5"><enum>(3)</enum><text>by inserting
			 after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8066DE1AA2B840D2A68C76D28C28343B" style="OLC">
						<paragraph id="ID5516962c062148e3ae04281b07c0826f"><enum>(3)</enum><text>shall not apply
				to a stock for which a stock assessment has not been performed during the
				previous 6-year period, if the Secretary has determined pursuant to section
				304(e) of the Magnuson-Stevens Fishery Conservation and Management Act (16
				U.S.C. 1854(e)) that—</text>
							<subparagraph id="idFEABCA200BF54CA69A20D7E8F7B0FBF4"><enum>(A)</enum><text>the fishery is
				not subject to overfishing of that stock; and</text>
							</subparagraph><subparagraph id="idC8B3D072244B42CAA6EAD1D64C6DB67F"><enum>(B)</enum><text>the stock is not
				overfished;</text>
							</subparagraph></paragraph><paragraph id="ID2e5691f47e7e4c3da3e4c014a9e6793c"><enum>(4)</enum><text>shall not apply
				to an ecosystem component stock;
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDd1fb97f6adef419fb56a21fef5a6fd98"><enum>(b)</enum><header>Ecosystem
			 component stocks</header><text>Section 104 of the Magnuson-Stevens Fishery
			 Conservation and Management Reauthorization Act of 2006 (Public Law 109–479;
			 120 Stat. 3584) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9F947EDC58694A85ADD558DE53E7B91B" style="OLC">
					<subsection id="ID3ea4d4be032b440d9ed36f340e5aa57e"><enum>(e)</enum><header>Ecosystem
				component stock</header>
						<paragraph id="idFB97D71503B341E38DA0DB2F81B7A7EB"><enum>(1)</enum><header>Definition</header><text>In
				this section, the term <term>ecosystem component stock</term> means a stock of
				fish that the Secretary determines—</text>
							<subparagraph id="IDe6880d4d3b8f4fbd9065244206ff3716"><enum>(A)</enum><text>is a nontarget
				stock; and</text>
							</subparagraph><subparagraph id="IDf88dfe7a37d54233a8cffe76f7691725"><enum>(B)</enum><text>is not subject to
				overfishing or overfished.</text>
							</subparagraph></paragraph><paragraph id="id1142746F1B9E4BCBBAA1EE04B8253636"><enum>(2)</enum><header>Prior
				determinations</header><text>Ecosystem component species as determined by the
				Secretary of Commerce prior to the date of the enactment of the
				<short-title>Fishery Science Improvement Act of
				2011</short-title>, shall be determined to be ecosystem component stocks as
				defined by paragraph (1) after such date of
				enactment.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
