		<section id="HB867C7C3D3084B52B2401A45C3D27EB7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Guard Technician Equity
			 Act</short-title></quote>.</text>
		</section><section id="HC73B5F664411446F8C9FD2C6C779F07F"><enum>2.</enum><header>Titles 10 and 32,
			 United States Code, amendments regarding National Guard technicians and related
			 provisions</header>
			<subsection id="H7DB8B07FF4C84F308DB19D4E829EEE6C"><enum>(a)</enum><header>Authority To
			 employ technician as non-Dual status technician after 20 years of creditable
			 service</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 709 of title 32, United States Code, is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H7D83E13167E14022BBA550A231CE78D9" style="OLC">
					<subsection id="HC923C8E0442C43BCBCB49FD8D994378F"><enum>(c)</enum><text display-inline="yes-display-inline">A person shall have the right to be
				employed under subsection (a) as a non-dual status technician (as defined by
				section 10217 of title 10) if—</text>
						<paragraph id="H0418F58CD24B4FCBB1C16EE04C0A7E8F"><enum>(1)</enum><text>the technician
				position occupied by the person has been designated by the Secretary concerned
				to be filled only by a non-dual status technician; or</text>
						</paragraph><paragraph id="H418810CC1462410F981D31772D8794D3"><enum>(2)</enum><text display-inline="yes-display-inline">the person occupying the technician
				position has at least 20 years of creditable service as a military technician
				(dual
				status).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HCFEE8D5220044B3F82779276A33C93C7"><enum>(b)</enum><header>Exception to
			 dual-Status employment condition of membership in Selected
			 Reserve</header><text>Section 10216 of title 10, United States Code, is
			 amended—</text>
				<paragraph id="HB2E09C4D3C244DAB9122E4E4E72255A0"><enum>(1)</enum><text>in subsection
			 (a)(1)(B), by inserting <quote>subject to subsection (d),</quote> before
			 <quote>is required</quote>; and</text>
				</paragraph><paragraph id="HAC8074D794BE4137803C74A4E4221511"><enum>(2)</enum><text>in subsection
			 (d)(1), by striking <quote>Unless specifically exempted by law</quote> and
			 inserting <quote>Except as provided in section 709(c)(2) of title 32 or as
			 otherwise specifically exempted by law</quote>.</text>
				</paragraph></subsection><subsection id="H1EE5E94F431845A9867E1C1C6A47DC48"><enum>(c)</enum><header>Continued
			 compensation after loss of membership in Selected Reserve</header><text display-inline="yes-display-inline">Subsection (e) of section 10216 of title
			 10, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H0431135C071B49F39B73DE9A2C9F46EC" style="OLC">
					<subsection id="H6959A81DE55440619132D851C48BD4F2"><enum>(e)</enum><header>Continued
				compensation after loss of membership in Selected Reserve</header><text display-inline="yes-display-inline">Funds appropriated for the Department of
				Defense may continue to be used to provide compensation to a military
				technician who was hired as a military technician (dual status), but who is no
				longer a member of the Selected
				Reserve.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HEB72A27C89534764BCEDB50908ACFFC8"><enum>(d)</enum><header>Repeal of
			 permanent limitations on number of non-Dual status technicians</header><text display-inline="yes-display-inline">Section 10217 of title 10, United States
			 Code, is amended by striking subsection (c).</text>
			</subsection><subsection id="HAFAD33E6FD114C2F877B760DB1C1D366"><enum>(e)</enum><header>Technician
			 restricted right of appeal and adverse actions covered</header>
				<paragraph id="H43ED989EE2534DBCAD1D5E62F5340C19"><enum>(1)</enum><header>Rights of
			 grievance, arbitration, appeal, and review beyond AG</header><text display-inline="yes-display-inline">Section 709 of title 32, United States
			 Code, is amended—</text>
					<subparagraph id="H04186303589C40EEA1EC6DE9B0306E37"><enum>(A)</enum><text>in subsection
			 (f)—</text>
						<clause id="H0F510D114E5D49DD901D0BB520FDE4CE"><enum>(i)</enum><text>in
			 the matter preceding paragraph (1), by striking <quote>Notwithstanding any
			 other provision of law and under</quote> and inserting <quote>Under</quote>;
			 and</text>
						</clause><clause id="H48179B050D8449F09EA999AA4B96760E"><enum>(ii)</enum><text>in
			 paragraph (4), by striking <quote>a right of appeal</quote> and inserting
			 <quote>subject to subsection (j), a right of appeal</quote>; and</text>
						</clause></subparagraph><subparagraph id="HC44A0954AA724CD58733F806BEC0DAE6"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H6DE9A09D7EA94C2594D6BB50F092F301" style="OLC">
							<subsection id="H851C9ADA330245C89D438418F2E9B550"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H3A95E90ECC8C45E5A4D6345041FB5EF6"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (f)(4) or any
				other provision of law, a technician and a labor organization that is the
				exclusive representative of a bargaining unit including the technician shall
				have the rights of grievance, arbitration, appeal, and review extending beyond
				the adjutant general of the jurisdiction concerned and to the Merit Systems
				Protection Board and thereafter to the United States Court of Appeals for the
				Federal Circuit, in the same manner as provided in sections 4303, 7121, and
				7701–7703 of title 5, with respect to a performance-based or adverse action
				imposing removal, suspension for more than 14 days, furlough for 30 days or
				less, or reduction in pay or pay band (or comparable reduction).</text>
								</paragraph><paragraph id="HD8B7406B9E114CA1825072DBC6485B70" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">This subsection does not apply to a
				technician who is serving under a temporary appointment or in a trial or
				probationary
				period.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H03A10A7A928C4F6388AD5F4E26F24B8C"><enum>(2)</enum><header>Adverse actions
			 covered</header><text display-inline="yes-display-inline">Section 709(g) of
			 title 32, United States Code, is amended by striking <quote>7511, and
			 7512</quote>.</text>
				</paragraph><paragraph id="H866A27F2EECA4902A3AB40BF85319F4C"><enum>(3)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 7511(b) of
			 title 5, United States Code, is amended—</text>
					<subparagraph id="HE42008C0D9BF47F48CE7A06E82B8B34D"><enum>(A)</enum><text>by striking
			 paragraph (5); and</text>
					</subparagraph><subparagraph id="H8A4F02EC0C4644DE8887F93F9D830D47"><enum>(B)</enum><text>by redesignating
			 paragraphs (6) through (10) as paragraphs (5) through (9), respectively.</text>
					</subparagraph></paragraph></subsection><subsection id="H7B5129168E2C4CFD809C82B9C9C03CAA"><enum>(f)</enum><header>Technician
			 Seniority Rights during RIF</header><text display-inline="yes-display-inline">Subsection (g) of section 709 of title 32,
			 United States Code, as amended by subsection (e)(2), is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="H92A3EA1558174A358921731F3F1F2273" style="OLC">
					<subsection id="HAC861478EA184B039E62089901D82088"><enum>(g)</enum><text display-inline="yes-display-inline">Section 2108 of title 5 does not apply to a
				person employed under this
				section.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H35300B616C8D462F8D895375E09CBDAD"><enum>(g)</enum><header>Availability of
			 certain enlistment, reenlistment, and student loan benefits for military
			 technicians</header><text>Section 10216 of title 10, United States Code, is
			 amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H8C448330A5C74CECB1FCF8187077D236" style="OLC">
					<subsection id="HEE9A0BDC5E794F02875604FD2BB063A0"><enum>(h)</enum><header>Eligibility for
				bonuses and other benefits</header><paragraph commented="no" display-inline="yes-display-inline" id="H93C6BB8215914BB8991E23D8B047FF99"><enum>(1)</enum><text display-inline="yes-display-inline">If an individual becomes employed as a
				military technician (dual status) while the individual is already a member of a
				reserve component, the Secretary concerned may not require the individual to
				repay any enlistment, reenlistment, or affiliation bonus provided to the
				individual in connection with the individual’s enlistment or reenlistment
				before such employment.</text>
						</paragraph><paragraph id="HB1530AF0497049E59E1342DE52A29B44" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Even though an individual employed as a
				military technician (dual status) is required as a condition of that employment
				to maintain membership in the Selected Reserve, the individual shall not be
				precluded from receiving an enlistment, reenlistment, or affiliation bonus nor
				be denied the opportunity to participate in an educational loan repayment
				program under chapter 1609 of this title as an additional incentive for the
				individual to accept and maintain such
				membership</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE9CAA511F0F54E879F039D7C5C262285"><enum>(h)</enum><header>Repeal of
			 prohibition against overtime pay for National Guard technicians</header><text display-inline="yes-display-inline">Section 709(h) of title 32, United States
			 Code, is amended by striking the second sentence and inserting the following
			 new sentence: <quote>The Secretary concerned shall pay a technician for
			 irregular or overtime work at a rate equal to one and one-half times the rate
			 of basic pay applicable to the technician, except that, at the request of the
			 technician, the Secretary may grant the technician, instead of such pay, an
			 amount of compensatory time off from the technician’s scheduled tour of duty
			 equal to the amount of time spent in such irregular or overtime
			 work.</quote>.</text>
			</subsection></section><section id="HF82A6481A14A4F80968B24A41A984B35"><enum>3.</enum><header>Title 5, United
			 States Code, amendments regarding National Guard technicians and related
			 provisions</header>
			<subsection id="HCEA5D07A891C458DA75026A20A0E882D"><enum>(a)</enum><header>Lowering
			 Retirement Age</header>
				<paragraph id="HD4E4780924304D4EAF0EC61B6877F1CD"><enum>(1)</enum><header>Amendment to
			 FERS</header><text display-inline="yes-display-inline">Subsection (c) of
			 section 8414 of title 5, United States Code, is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H7B24EC1F4756442D838C5CE6ABDCE8A7" style="USC">
						<subsection id="HBF9693010FD740D0B565BD8FDD4D0B5F"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H71DDAEA3446B401FA8C6D907B58DB355"><enum>(1)</enum><text display-inline="yes-display-inline">Under the circumstances described in
				paragraph (2), an employee who is separated from service as a military
				technician (dual status) is entitled to an annuity if the separation is by
				reason of either—</text>
								<subparagraph id="H94FCE007E88B4B969628666E663E04A4" indent="up1"><enum>(A)</enum><text>separating from the Selected Reserve;
				or</text>
								</subparagraph><subparagraph id="HE8D4D755861A4EAEBD5F29AC53451950" indent="up1"><enum>(B)</enum><text>ceasing to hold the military grade
				specified by the Secretary concerned for the position involved.</text>
								</subparagraph></paragraph><paragraph id="H87CE352C9748449A81C71D128272D8E7" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (3),
				paragraph (1) applies to a military technician (dual status) who is
				separated—</text>
								<subparagraph id="H0D991D0DCCDC43019A8444915D041DD3"><enum>(A)</enum><text>after completing 25 years of service
				as such a technician, or</text>
								</subparagraph><subparagraph id="HA815B07CBC384E3F88C81464692839CC"><enum>(B)</enum><text display-inline="yes-display-inline">after becoming 50 years of age and
				completing 20 years of service as such a technician.</text>
								</subparagraph></paragraph><paragraph id="H541077AF3BDD4AF296A63A4C4947F709" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Paragraph (1) does not apply if separation
				or removal is for cause on charges of misconduct or
				delinquency.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF9F4AD31C2E94D9B9D324E952A57BEE5"><enum>(2)</enum><header>Amendment to
			 CSRS</header><text>Section 8336 of title 5, United States Code, is amended by
			 adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H690C1874097D498F86B7961569AB0047" style="USC">
						<subsection display-inline="no-display-inline" id="H8921FDD24AAA4024911FB9F162567ABA"><enum>(q)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H8D108F60355940F89496D1D5BED1AFB8"><enum>(1)</enum><text display-inline="yes-display-inline">Under the circumstances described in
				paragraph (2), an employee who is separated from service as a military
				technician (dual status) is entitled to an annuity if the separation is by
				reason of either—</text>
								<subparagraph id="HBBB93497754F40AFB5AEDCC10D9488DE" indent="up1"><enum>(A)</enum><text>separating from the Selected Reserve;
				or</text>
								</subparagraph><subparagraph id="H54DD7FF4692A44D0824C3BC0BD138405" indent="up1"><enum>(B)</enum><text>ceasing to hold the military grade
				specified by the Secretary concerned for the position involved.</text>
								</subparagraph></paragraph><paragraph id="H4628787768FC4ABCB3119E11AB246DCD" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (3),
				paragraph (1) applies to a military technician (dual status) who is
				separated—</text>
								<subparagraph id="HF0AE7385870A4FD2965424E06C33D035"><enum>(A)</enum><text>after completing 25 years of service
				as such a technician, or</text>
								</subparagraph><subparagraph id="HD0842564B1C94616895D1F81CB8702FE"><enum>(B)</enum><text display-inline="yes-display-inline">after becoming 50 years of age and
				completing 20 years of service as such a technician.</text>
								</subparagraph></paragraph><paragraph id="H2AA8C51C8C2349B0ABCB81CF3C913F07" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Paragraph (1) does not apply if separation
				or removal is for cause on charges of misconduct or
				delinquency.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HB100190D3C9349C8809F6E1F0C9D15BC"><enum>(b)</enum><header>Adequate Leave
			 Time for Military Activations</header><text>Section 6323(a)(1) of title 5,
			 United States Code, is amended by striking the last sentence and inserting the
			 following new sentence: <quote>Leave under this subsection accrues for an
			 employee or individual at the rate of 30 days per fiscal year and, to the
			 extent that such leave is not used by the employee or individual during the
			 fiscal year accrued, accumulates without limitation for use in succeeding
			 fiscal years.</quote>.</text>
			</subsection><subsection id="HE1BDB52CAC7C4E60834C916290DE1835"><enum>(c)</enum><header>Improved Health
			 Care Benefits</header>
				<paragraph id="H5B8F2E34BCA94B56B37895D2522D22FD"><enum>(1)</enum><header>FEHBP
			 changes</header><text display-inline="yes-display-inline">Subparagraph (B) of
			 section 8906(e)(3) of title 5, United States Code, is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H1C4FF3AD76ED496C858232B8E6F90A67" style="OLC">
						<subparagraph id="H01D3B7C72EC9428BA97C31AD1A49465A" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">An employee referred to in subparagraph (A)
				is an employee who—</text>
							<clause id="H9914C1528F6A43F397AB7C1F23C8A26B"><enum>(i)</enum><text>is enrolled in a health benefits plan
				under this chapter;</text>
							</clause><clause id="H5E7D00BDD5BD4E979DE17856CDEB91F5"><enum>(ii)</enum><text>is a member of a reserve component of
				the Armed Forces;</text>
							</clause><clause id="H285122DF3930417FBFC6C4F6AC6CBC64"><enum>(iii)</enum><text>is placed on leave without pay or
				separated from service to perform the active duty or other duties described in
				clause (iv); and</text>
							</clause><clause id="HCC0D87C7707344B4B10DCA886AF07A56"><enum>(iv)</enum><text>is called or ordered to—</text>
								<subclause id="HB4B6FAFB0FE74A268CC07CC70BCCE05F"><enum>(I)</enum><text>active duty in support of a
				contingency operation (as defined in section 101(a)(13) of title 10);</text>
								</subclause><subclause id="HF3A22B6230FC4B6A94BACB6A57DCFA1B"><enum>(II)</enum><text>active duty for a period of more
				than 30 consecutive days;</text>
								</subclause><subclause id="H368E98902DD04EDEBA63A98D9923B289"><enum>(III)</enum><text display-inline="yes-display-inline">active duty under section 12406 of title
				10;</text>
								</subclause><subclause id="H80606AD85FD04F7E87E95BA3728AE06F"><enum>(IV)</enum><text display-inline="yes-display-inline">perform training or other duties described
				under paragraph (1) or (2) of section 502(f) of title 32; or</text>
								</subclause><subclause id="HCF6AB730CB4046718951E6389402BCF5"><enum>(V)</enum><text display-inline="yes-display-inline">while not in Federal service, perform
				duties related to an emergency declared by the chief executive of a State, the
				District of Columbia, the Commonwealth of Puerto Rico, or a territory or
				possession of the United
				States.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" id="H6EA23E13CD0A4ED29AF7EEE7FD11DED1"><enum>(2)</enum><header>Study and
			 report</header>
					<subparagraph commented="no" id="HCAA9212338A74A06B84770027AF0B67D"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Within 6 months after
			 the date of the enactment of this Act, the Secretary of Defense and the
			 Director of the Office of Personnel Management shall jointly conduct a study
			 and submit to Congress a report—</text>
						<clause id="HFA95825DEEE442C7A0D0E8B9ABAFA203"><enum>(i)</enum><text>evaluating the
			 feasibility of converting military technicians from FEHBP coverage to coverage
			 provided under the TRICARE or TRICARE Reserve Select program (or both);
			 and</text>
						</clause><clause id="H0BE6A5A526DE4FF8BE230375AA1820A5"><enum>(ii)</enum><text display-inline="yes-display-inline">identifying any problems associated with
			 the conversion of military technicians from FEHBP coverage to coverage provided
			 under chapter 55 of title 10, United States Code, during contingency
			 operations.</text>
						</clause></subparagraph><subparagraph commented="no" id="HFE9EE4C208ED4ACDA1C3ADEF09982614"><enum>(B)</enum><header>Definitions</header><text>For
			 purposes of this subsection—</text>
						<clause commented="no" id="H39A74F616DE24E0A8617B040E1F49518"><enum>(i)</enum><text>the term
			 <term>FEHBP coverage</term> means coverage provided under chapter 89 of title
			 5, United States Code; and</text>
						</clause><clause commented="no" id="H77B42207BBFE486089EF9389419E2542"><enum>(ii)</enum><text>the term
			 <term>contingency operation</term> has the meaning given that term in section
			 101(a)(13) of title 10, United States Code.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="HA3555ACDA8E94DD890DC9EFD639055EE"><enum>4.</enum><header>Reduction in
			 eligibility age for retirement for non-Regular service</header><text display-inline="no-display-inline">Section 12731(f) of title 10, United States
			 Code, is amended by striking <quote>60 years of age</quote> both places it
			 appears and inserting <quote>55 years of age</quote>.</text>
