		  to establish a program to provide loans for local farms, ranches, and market
		  gardens to improve public health and nutrition, reduce energy consumption, and

		<section id="id7767B85099F6485A93E966B1248DCB66" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Growing Opportunities for Agriculture
			 and Responding to Markets Act of 2011</short-title></quote>.</text>
		</section><section id="idD676AD6414454B8499B9B7379F3F3C8A"><enum>2.</enum><header>Local farm
			 business and market garden competitive loan program</header><text display-inline="no-display-inline">Subtitle D of title X of the Food,
			 Conservation, and Energy Act of 2008 is amended by adding after section 10404
			 (Public Law 110–246; 122 Stat. 2111) the following:</text>
			<quoted-block display-inline="no-display-inline" id="id66F45AA1DB114B8E99C12E2E81F4C4F3" style="OLC">
				<section id="id279ABD73382D4649AD6D060F687AD879"><enum>10405.</enum><header>Local farm
				business and market garden competitive loan program</header>
					<subsection id="ID34a67d6907e14a72a4c301fc8d7750f2"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="ID5ac5c8ba65b2473b8c910926da2e46ce"><enum>(1)</enum><header>Agricultural
				commodity</header><text>The term <term>agricultural commodity</term> has the
				meaning given the term in section 102 of the Agricultural Trade Act of 1978 (7
				U.S.C. 5602).</text>
						</paragraph><paragraph id="ID6ca4ee4a7f57464cad1cda193c2cb861"><enum>(2)</enum><header>Eligible
				lending entity</header><text>The term <term>eligible lending entity</term>
				means a government agency, nonprofit organization, or any other entity that the
				Secretary designates to finance and facilitate the development of a local farm
				business project or market garden project.</text>
						</paragraph><paragraph id="ID93b749aebe064724a0cafa3c1aebc3b9"><enum>(3)</enum><header>Eligible
				producer</header><text>The term <term>eligible producer</term> means an
				individual or group of individuals who carry out a local farm business project
				or market garden project.</text>
						</paragraph><paragraph id="id8E857E9EE8F7476C86A21F186C5531B9"><enum>(4)</enum><header>Food
				desert</header><text>The term <term>food desert</term> has the meaning given
				the term in section 7527(a).</text>
						</paragraph><paragraph id="IDe5bf1581ebe749e58808753e7610255f"><enum>(5)</enum><header>Local farm
				business project</header><text>The term <term>local farm business
				project</term> means a project on a farm or ranch that—</text>
							<subparagraph id="id830E1636386C45F9A9F71137E85C06B0"><enum>(A)</enum><text>is for the
				production of an agricultural commodity for local markets in the local service
				area; and</text>
							</subparagraph><subparagraph id="id1A112325C6334E11B216B3C89FE9646A"><enum>(B)</enum><text>is located on 1
				or more property lots, the cumulative acreage of which shall be more than 1
				acre.</text>
							</subparagraph></paragraph><paragraph id="IDfa3afa4df6b748a280b6095b4aa9463f"><enum>(6)</enum><header>Local service
				area</header><text>The term <term>local service area</term> means an area
				consisting of a certain mile radius (as determined by the Secretary) from the
				physical location of production by an eligible local farm business or market
				garden project.</text>
						</paragraph><paragraph id="ID2b8dff724f044d469070b70d3566635c"><enum>(7)</enum><header>Market garden
				project</header><text>The term <term>market garden project</term> means a
				project that—</text>
							<subparagraph id="id6AE28DA418D945F6ABA70B2B226F3A98"><enum>(A)</enum><text>is for the
				production of an agricultural commodity for local markets in the local service
				area; and</text>
							</subparagraph><subparagraph id="id9351E86660A94098BEAE164D5C17F5E2"><enum>(B)</enum><text>is located on 1
				or more property lots (regardless of the population density of the area in
				which the property lots are located), the cumulative acreage of which shall be
				more than ¼ acre.</text>
							</subparagraph></paragraph><paragraph id="idA21A56FA875D473BA94FA80A97234B73"><enum>(8)</enum><header>Revolving loan
				fund</header><text>The term <term>revolving loan fund</term> means a revolving
				loan fund established by an eligible lending entity as described in subsection
				(c).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id278042D54688471C9795C8427D05629D"><enum>(9)</enum><header>Socially
				disadvantaged farmer or rancher</header><text>The term <term>socially
				disadvantaged farmer or rancher</term> has the meaning given the term in
				section 355(e) of the Consolidated Farm and Rural Development Act (7 U.S.C.
				2003(e)).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEBD370CAD7FF4905B1D462CD0DCFEE3F"><enum>(10)</enum><header>Specialty
				crop</header><text>The term <term>specialty crop</term> has the meaning given
				the term in section 3 of the Specialty Crops Competitiveness Act of 2004 (7
				U.S.C. 1621 note; Public Law 108–465).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2824315C5CCE46669ECEFDCAF23DB195"><enum>(11)</enum><header>Sustainable
				agriculture</header><text>The term <term>sustainable agriculture</term> has the
				meaning given the term in section 1404 of the National Agricultural Research,
				Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3103).</text>
						</paragraph></subsection><subsection id="ID485e52d053154c1bae9b14c8f0095b53"><enum>(b)</enum><header>Competitive
				loan program for eligible lending entities</header>
						<paragraph id="IDf8759cb6faf74f83bb8dcc7f281e0ddb"><enum>(1)</enum><header>In
				general</header><text>To support new entrepreneurship and job creation, the
				Secretary shall establish a local farm business and market garden competitive
				loan program under which the Secretary shall make available to eligible lending
				entities loans to develop revolving loan funds to assist—</text>
							<subparagraph id="id291B5BC30E1044C29D97A1EA87CB5D2E"><enum>(A)</enum><text>eligible
				producers in establishing local farm business projects or market garden
				projects that will locally produce fresh foods; and</text>
							</subparagraph><subparagraph id="id1F8F6713A2F041DB9A9C31D6B34CCD2A"><enum>(B)</enum><text>local farm
				business projects and market garden projects to create local employment
				opportunities by—</text>
								<clause id="ID5f5cdcfb85594c5795d8db57161557a1"><enum>(i)</enum><text>increasing farm
				and garden income by connecting producers and consumers;</text>
								</clause><clause id="ID3aef05035bf348c48960c67b316606d3"><enum>(ii)</enum><text>creating more
				reliable local food systems;</text>
								</clause><clause id="ID6beaea085a52476b8ea4b5b400307210"><enum>(iii)</enum><text>diversifying
				food production;</text>
								</clause><clause id="IDa8e0f2e3280b4a0b98fccc00cce8e4c0"><enum>(iv)</enum><text>increasing
				consumer access to fresh, local healthful foods produced by local farms,
				ranches, and market gardens in urban, suburban, or rural areas;</text>
								</clause><clause id="ID7cfeb155c5514fa5ab4f1f77bfd118f3"><enum>(v)</enum><text>supporting
				nutrition education that incorporates participation of school children in farm-
				and garden-based agricultural education activities; and</text>
								</clause><clause id="ID5eef6740247742608f8a1e2bf899e335"><enum>(vi)</enum><text>preserving
				farmland.</text>
								</clause></subparagraph></paragraph><paragraph id="ID9f3305cbc591439eb1421da1f7479870"><enum>(2)</enum><header>Eligibility</header><text>To
				be eligible to receive a loan under the program established under paragraph
				(1), an eligible lending entity shall submit to the Secretary an application at
				such time, in such form, and containing such information as the Secretary may
				require.</text>
						</paragraph><paragraph id="ID752b442cd5c049f1b2f8c81179e32e1d"><enum>(3)</enum><header>Selection
				criteria</header>
							<subparagraph id="ID5628ec5f040e452dbfc1034d4672fc06"><enum>(A)</enum><header>Approval</header><text>Not
				later than 1 year after the date of enactment of this section and in accordance
				with this paragraph, the Secretary shall, on a competitive basis, begin
				assessing and approving such applications received under paragraph (2) as the
				Secretary considers appropriate.</text>
							</subparagraph><subparagraph id="idEDB4A52346DE49939457DA7C9AEA4C12"><enum>(B)</enum><header>Criteria</header><text>In
				considering a loan application received under paragraph (2), the Secretary
				shall—</text>
								<clause id="IDdaf1d1aea32f4043b46436b576d50475"><enum>(i)</enum><text>evaluate the
				extent to which the application demonstrates the ability of the eligible
				lending entity—</text>
									<subclause id="IDda856159002e4d0d8f86f08aef61331d"><enum>(I)</enum><text>to manage,
				market, and administer a revolving loan fund;</text>
									</subclause><subclause id="IDbcc9536ff0514fe6b7dd79c1bd9bab87"><enum>(II)</enum><text>to assist local
				eligible producers to successfully meet local service area
				opportunities;</text>
									</subclause><subclause id="ID5b7247a23d544f50865bbb1d47b9f171"><enum>(III)</enum><text>to work with
				partners to provide technical support to eligible local farm business projects
				and market garden projects;</text>
									</subclause><subclause id="IDe105b43093b74b1fbc6138c738968cae"><enum>(IV)</enum><text>to recruit,
				educate, and assist local producers to advance local farming and ranching
				opportunities that meet local service area needs; and</text>
									</subclause><subclause id="ID28d00b387fa24a57b4bb9abe51778d7b"><enum>(V)</enum><text>subject to
				paragraph (5), to provide matching funds in the form of cash or in-kind
				services to properly implement and manage the revolving loan fund;</text>
									</subclause></clause><clause id="ID6561daea90c6439da89b728a7236f8b7"><enum>(ii)</enum><text>assess—</text>
									<subclause id="ID8b83072c32f44074a8e9dfd873563bb2"><enum>(I)</enum><text>the number and
				type of local farm business projects and market garden projects to be affected
				by local farm business project loan funding;</text>
									</subclause><subclause id="IDefdda131b52f4442b012b6453485efaa"><enum>(II)</enum><text>the number of
				new jobs and eligible local farm business projects and market garden projects
				to be created by the revolving loan fund;</text>
									</subclause><subclause id="ID82571562887f433f93f6361359940377"><enum>(III)</enum><text>the ability of
				an eligible local farm business project or market garden project—</text>
										<item id="id640B8DAF857F4868BEF926A5F0699427"><enum>(aa)</enum><text>to
				preserve farmland through economically and environmentally sustainable
				agriculture practices (as determined by the Secretary); and</text>
										</item><item id="ID16c542ce02b74754976ba02f269568e6"><enum>(bb)</enum><text>to
				serve schools and institutions with a high proportion of students who are
				eligible for free or reduced price lunches under the Richard B. Russell
				National School Lunch Act (42 U.S.C. 1751 et seq.);</text>
										</item></subclause><subclause id="IDf4d7efb604844d74a5d28477a8fc59d5"><enum>(IV)</enum><text>the degree to
				which an eligible local farm business project or market garden project—</text>
										<item id="id150D8C9189424A1C85FC77A78AD3D0FE"><enum>(aa)</enum><text>incorporates
				experiential nutrition education;</text>
										</item><item id="ID256a0e84677d4dd3a88637214c834afd"><enum>(bb)</enum><text>demonstrates the
				potential positive economic impact for the local economy;</text>
										</item><item id="IDdd7e5ec6867b474784f24da5b9912c0d"><enum>(cc)</enum><text>demonstrates
				environmentally sustainable agriculture practices; and</text>
										</item><item id="ID5f4ee7acc2224619947a944a25a5481f"><enum>(dd)</enum><text>demonstrates a
				collaboration between schools or educational institutions, nongovernmental
				organizations, producer groups, and other community and business partners;
				and</text>
										</item></subclause><subclause id="ID6e1fbe66168d480db1ca24c8b7d897ea"><enum>(V)</enum><text>the market
				opportunity for eligible local farm business projects or market garden projects
				to sell products in the local community; and</text>
									</subclause></clause><clause id="ID3fdfc3a7468a4c01ab6db552c1a1dbc0"><enum>(iii)</enum><text>consider any
				other factors that the Secretary determines to be appropriate.</text>
								</clause></subparagraph><subparagraph id="IDa83357e91f9e47beb991622fbe7cec7c"><enum>(C)</enum><header>Regional
				balance</header><text>To the maximum extent practicable, in awarding loans
				under this section, the Secretary shall ensure that loan recipients—</text>
								<clause id="ID506fcbc818c7403b9f64e57140d977ae"><enum>(i)</enum><text>are
				geographically diverse;</text>
								</clause><clause id="IDcbe3af2aa7a8435f96c052a3b90b476f"><enum>(ii)</enum><text>serve clients
				targeted by the loan program, including socially disadvantaged farmers or
				ranchers;</text>
								</clause><clause id="ID2e03d8d89f714624a1c447216b419304"><enum>(iii)</enum><text>serve clients
				located in areas with a variety of population densities, including rural,
				suburban, urban, and tribal areas; and</text>
								</clause><clause id="ID9964142320aa4361aa828aa97180195d"><enum>(iv)</enum><text>identify and
				serve food deserts within the local service area.</text>
								</clause></subparagraph><subparagraph id="IDb4aaf22ebd1143ffa91db9afcc96fc8c"><enum>(D)</enum><header>Priority</header>
								<clause id="id7ECA14A816A54898860C8730E0951822"><enum>(i)</enum><header>In
				general</header><text>In considering loan applications received under paragraph
				(2), the Secretary shall give priority to applications that demonstrate the
				ability and willingness of the eligible lending entity—</text>
									<subclause id="ID5f744a9975d2483881fde3ca460a619d"><enum>(I)</enum><text>to serve clients
				targeted by the program, including, as appropriate, socially disadvantaged
				farmers or ranchers;</text>
									</subclause><subclause id="ID45f63649a8f34f2e94e7b120865d31e9"><enum>(II)</enum><text>to assist with
				the financial management aspects of specialty crop farming and other types of
				local agricultural projects; and</text>
									</subclause><subclause id="ID0875220c73314dc29b8b47dd5b6594a5"><enum>(III)</enum><text>to address the
				nutritional needs of an underserved area, as determined in accordance with
				clause (ii).</text>
									</subclause></clause><clause id="ID4d4bc762b5994898922a6a4effbd93f9"><enum>(ii)</enum><header>Underserved
				areas</header><text>In determining whether an area is an underserved area, the
				Secretary shall consider—</text>
									<subclause id="IDebf40e6da1164942877873d7fbe7db56"><enum>(I)</enum><text>population
				density;</text>
									</subclause><subclause id="IDb5dc11fe12c240d9a2d7d01ff0f968f0"><enum>(II)</enum><text>below-average
				supermarket density or sales;</text>
									</subclause><subclause id="IDff67e19862dc412a9d31ad86a2adbb0f"><enum>(III)</enum><text>the rate of
				ownership of motor vehicles; and</text>
									</subclause><subclause id="IDc607ff6a767b430e89ab5cdddcee852a"><enum>(IV)</enum><text>geographical or
				physical barriers, such as highways, mountains, major parks, or bodies of
				water.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="ID541b86bb82e441e08632ddc03b9edd06"><enum>(4)</enum><header>Loan terms for
				eligible lending entities</header>
							<subparagraph id="IDba5597fcd4e5487e80bc14ad32e7ef73"><enum>(A)</enum><header>In
				general</header><text>For each fiscal year for which the Secretary makes a loan
				to an eligible lending entity under this subsection, the loan shall—</text>
								<clause id="idF9B01A6972FB420F97C1AFE8DF299693"><enum>(i)</enum><text>be in an amount
				that is not less than $200,000 and not more than $1,000,000; and</text>
								</clause><clause id="id815921776E804C4999CA055C4FF57682"><enum>(ii)</enum><text>be used by the
				eligible lending entity to establish a revolving loan fund to provide loans for
				local farm business projects or market garden projects.</text>
								</clause></subparagraph><subparagraph id="ID925d075ee2854656bf55a491bbaa9b69"><enum>(B)</enum><header>Term</header><text>The
				term of a loan under this subsection shall not exceed 20 years from the date on
				which the loan is finalized.</text>
							</subparagraph><subparagraph id="IDa50802480bf348f3a6d01968f33fe062"><enum>(C)</enum><header>Loan financing
				terms</header><text>In making loans to eligible lending entities under this
				subsection, the Secretary shall—</text>
								<clause id="IDfe2273d14c844cfab3714c2e855e29a6"><enum>(i)</enum><text>set the rate of
				interest at not more than 2 percent per year; and</text>
								</clause><clause id="ID4d0617dbd0ca418db45cff9c0f13c904"><enum>(ii)</enum><text>ensure that no
				payments are due on the loan during the first 2 years of the loan.</text>
								</clause></subparagraph></paragraph><paragraph id="ID2f5fb8b9dd7e45dd996524d13309d985"><enum>(5)</enum><header>Matching
				funds</header><text>The Secretary may not require an eligible lending entity
				that receives a loan under this subsection to provide, from non-Federal
				sources, in cash or in-kind, the cost of carrying out activities under the
				loan.</text>
						</paragraph><paragraph id="IDce0974fa981f428eac52e9f8ee2082be"><enum>(6)</enum><header>Administrative
				expenses</header>
							<subparagraph id="id029F2D58F1C443228C3DBAC1335A3A40"><enum>(A)</enum><header>In
				general</header><text>Each eligible lending entity that receives a loan under
				this subsection shall be eligible additionally to receive a 1-time grant for
				purposes described in subparagraph (B) in an amount that is not more than the
				lesser of—</text>
								<clause id="idBF6A6172BC3B4987AF614573B8C12852"><enum>(i)</enum><text>10 percent of the
				total amount of the loan received by the eligible lending entity; or</text>
								</clause><clause id="id9D0B0036D9DA48908CA988AB7E3A44C7"><enum>(ii)</enum><text>$50,000.</text>
								</clause></subparagraph><subparagraph id="id9C9341D89EFE4AEC83BBFBCDFCBDB7C6"><enum>(B)</enum><header>Use of grant
				funds</header><text>Grant funds received under subparagraph (A) may be used by
				the eligible lending entity only to pay management and technical support costs
				associated with the loan.</text>
							</subparagraph><subparagraph id="id978EBDACC13D4C6CAE8DC842A36DE9C0"><enum>(C)</enum><header>Interest
				rate</header><text>If an eligible lending entity receives a grant under
				subparagraph (A), the eligible lending entity may not set the interest rate of
				loans made by the eligible lending entity to local farm business projects or
				market garden projects at more than 3 percent per year.</text>
							</subparagraph></paragraph><paragraph id="ID53453646f0f24880bd3ba3174c3a6f58"><enum>(7)</enum><header>Progress
				reports</header>
							<subparagraph id="ID07e93b320e6c4da09a14076797087d9e"><enum>(A)</enum><header>In
				general</header><text>Not later than 90 days after the last day of each fiscal
				year, each eligible lending entity that has a loan under this subsection shall
				submit to the Secretary a report that includes—</text>
								<clause id="IDc304e65278864ab0809817079a17ec20"><enum>(i)</enum><text>an evaluation of
				the progress of the revolving loan fund carried out by the eligible lending
				entity;</text>
								</clause><clause id="ID6984385f8b264b0eb70eac23a1111545"><enum>(ii)</enum><text>a description of
				the revolving loan fund, including information on all loans made to local farm
				business projects or market garden projects;</text>
								</clause><clause id="IDdd3fab472d0142f0a20832f539c4878b"><enum>(iii)</enum><text>a status update
				for the local farm business projects and market garden projects funded by the
				revolving loan fund that describes—</text>
									<subclause id="ID1f7d854b0d0e4a789eba0ca767bf6cb2"><enum>(I)</enum><text>the amount of
				food produced;</text>
									</subclause><subclause id="IDa2542f86d8d844a8aeac576b1d235b70"><enum>(II)</enum><text>the amount of
				revenue generated; and</text>
									</subclause><subclause id="ID2875d94953f440c1a6b22534ec42fa48"><enum>(III)</enum><text>the number of
				new and retained jobs; and</text>
									</subclause></clause><clause id="ID4db0d0e9e5a74578b76be8513524aaf4"><enum>(iv)</enum><text>such other
				information as the Secretary may require.</text>
								</clause></subparagraph><subparagraph id="ID6d046614110c4cd98ea394a01f5b6ce0"><enum>(B)</enum><header>Reports by the
				Secretary</header><text>Not later than 3 years after the date of enactment of
				this section, the Secretary shall submit to the Committee on Agriculture of the
				House of Representatives and the Committee on Agriculture, Nutrition, and
				Forestry of the Senate a report that describes the results and findings of the
				loan program carried out under this subsection.</text>
							</subparagraph></paragraph><paragraph id="ID4b80119de83042b4bc86098cf547a633"><enum>(8)</enum><header>Annual
				review</header><text>The Secretary shall conduct an annual review of the
				financial records of each eligible lending entity that receives funding under
				this subsection—</text>
							<subparagraph id="ID3cb14783f7f84d00a5125a91d5149c03"><enum>(A)</enum><text>to assess the
				financial soundness of the eligible lending entity; and</text>
							</subparagraph><subparagraph id="ID2458e9b78ce84d2681dc2486f6a455a9"><enum>(B)</enum><text>to determine the
				effective use of loan and grant funds made available to the eligible lending
				entity under this subsection.</text>
							</subparagraph></paragraph></subsection><subsection id="ID01dc4871e3e14ae0995dfdd9b8f6500d"><enum>(c)</enum><header>Revolving loan
				fund</header>
						<paragraph id="ID74fee1d7528449deb86a67844551292a"><enum>(1)</enum><header>Establishment
				and purpose</header><text>Each eligible lending entity that receives a loan
				under subsection (b) shall use the funds to establish a revolving loan fund to
				provide loans to eligible producers in the local service area.</text>
						</paragraph><paragraph id="ID193ae188a81c469384270bc7858f5df1"><enum>(2)</enum><header>Eligible
				activities</header><text>Loans made by an eligible lending entity under this
				subsection shall be used by the eligible producer to carry out eligible
				activities in the local service area, including—</text>
							<subparagraph id="ID6323aba7b6d746be972a25bdc4440d37"><enum>(A)</enum><text>to carry out
				production projects for value-added food products;</text>
							</subparagraph><subparagraph id="IDe04a43ba45b449d69c11faf0a384e181"><enum>(B)</enum><text>to provide
				working capital for general operational costs of the local farm business
				project or market garden project;</text>
							</subparagraph><subparagraph id="IDd6412a086ddc4733bbbda3110d78a9d8"><enum>(C)</enum><text>to purchase
				project-related equipment;</text>
							</subparagraph><subparagraph id="IDc2b4e7803085499b809f1bb2d765e1c2"><enum>(D)</enum><text>to purchase
				seeds, plants, and fruit or nut trees;</text>
							</subparagraph><subparagraph id="ID1d2e81ca43e9432e93d7c9d0f4d22703"><enum>(E)</enum><text>to purchase
				livestock, poultry, and breeding stock;</text>
							</subparagraph><subparagraph id="IDdf278ca09c974c099f2a67d3c72a73be"><enum>(F)</enum><text>to construct and
				maintain irrigation systems;</text>
							</subparagraph><subparagraph id="ID750ebb12c09d4bf9ab9b213f87e2291a"><enum>(G)</enum><text>to construct
				buildings (including barns, sheds, greenhouses, and dry and cold storage sheds)
				necessary to support production;</text>
							</subparagraph><subparagraph id="IDe225a175727f44fcbff23fc35a397dc7"><enum>(H)</enum><text>to lease, lease
				to purchase, or directly purchase farmland or make a down payment on an
				accepted purchase offer for farmland; or</text>
							</subparagraph><subparagraph id="ID3005a63193cd43bea65046f33be08aa0"><enum>(I)</enum><text>to carry out any
				other activity that the Secretary determines to be in accordance with this
				section.</text>
							</subparagraph></paragraph><paragraph id="ID8d1fc15d50ac45bfa7965b856579125d"><enum>(3)</enum><header>Loan
				conditions</header>
							<subparagraph id="id4CA60E9FCBB04E3AAFF6EE754FA11368"><enum>(A)</enum><header>In
				general</header><text>To be eligible to receive a loan under this section from
				an eligible lending entity, an eligible producer shall—</text>
								<clause id="ID1fd05da12d1842d59b3243584096cc9b"><enum>(i)</enum><text>supply a minimum
				level of support of the cost of the local farm business project, market garden
				project, or institution costs, as determined by the Secretary; and</text>
								</clause><clause id="IDc3d77055b92e4615b49d1ca0792ab39d"><enum>(ii)</enum><text>submit to the
				eligible lending entity—</text>
									<subclause id="id5679C3295DE04497AE0AC57DC94C874F"><enum>(I)</enum><text>documentation of,
				as appropriate—</text>
										<item id="idFEC580847FF8402BBFF923E16C3F8772"><enum>(aa)</enum><text>a
				long-term land lease contract granting the right to perform local production
				agriculture;</text>
										</item><item id="idC49C26C0D0C04CFE9C62F32F366D46C4"><enum>(bb)</enum><text>a
				building lease; or</text>
										</item><item id="IDe8ff7fd331384e33a88aefe0739b685e"><enum>(cc)</enum><text>a
				deed of property ownership; and</text>
										</item></subclause><subclause id="ID6eaff0f1adb1491bb44a5fb1173ee8d4"><enum>(II)</enum><text>a conservation
				plan and a sound business plan that is likely to result in a profitable
				business with sustainable employment for the eligible producer and any
				employees.</text>
									</subclause></clause></subparagraph><subparagraph id="id9A527ED3F539457C97F6424F30BE5967"><enum>(B)</enum><header>Secretarial
				approval; guarantee</header>
								<clause id="idE958D9E136324310B2F332FFA598DF1D"><enum>(i)</enum><header>Approval</header><text>Before
				an eligible lending entity may make a loan or package of loans to an eligible
				producer under this section, the Secretary shall approve the loan or package of
				loans in accordance with the requirements of this section.</text>
								</clause><clause id="idFE5831BCAB0349B9BD121A66667BF735"><enum>(ii)</enum><header>Loan
				guarantee</header><text>The Secretary shall guarantee not more than 85 percent
				of the principal and interest on each loan approved under clause (i).</text>
								</clause></subparagraph></paragraph><paragraph id="IDfaa7d65502ed40079eab32010f5bf2b1"><enum>(4)</enum><header>Priority</header><text>In
				making loans under this subsection, the eligible lending entity shall give
				priority to eligible producers that are operated by, or that support—</text>
							<subparagraph id="ID72a103943008447098f243a32f7117e3"><enum>(A)</enum><text>qualified
				beginning farmers or ranchers (as defined in section 343(a) of the Consolidated
				Farm and Rural Development Act (7 U.S.C. 1991(a))) and socially disadvantaged
				farmers or ranchers;</text>
							</subparagraph><subparagraph id="IDf10c755f52f04417b9a11d76386e9db5"><enum>(B)</enum><text>existing eligible
				producers, whether owners or tenants, who use loan funds to convert to
				agricultural production systems approved by the Secretary;</text>
							</subparagraph><subparagraph id="ID5c3fc7d71ab848558645be4aa08138b1"><enum>(C)</enum><text>eligible
				producers who use loan funds to build conservation structures or carry out
				conservation practices;</text>
							</subparagraph><subparagraph id="ID2f8c10dc5b004313a43fb5fa4f2afffa"><enum>(D)</enum><text>eligible
				producers who will supply fresh and locally produced food to underserved
				communities; and</text>
							</subparagraph><subparagraph id="IDfdde8dd223504914be461230d84f965d"><enum>(E)</enum><text>existing eligible
				producers of agriculture commodities who want to diversify farm, ranch, or
				market garden production and income.</text>
							</subparagraph></paragraph><paragraph id="ID374a61fdcd6240088d4b9755da9f5dbc"><enum>(5)</enum><header>Loan terms for
				eligible producers</header>
							<subparagraph id="IDc9df196b06e249e6b4d70c8a25f17a27"><enum>(A)</enum><header>In
				general</header><text>A loan made by an eligible lending entity to an eligible
				producer under this subsection shall be in an amount that is—</text>
								<clause id="IDe62af30f8f9548388f5d73ba646310e6"><enum>(i)</enum><text>in the case of a
				local farm business project, not less than $5,000 and not more than $100,000;
				and</text>
								</clause><clause id="IDe8dad1fa80a84fb294ba8c7904141d98"><enum>(ii)</enum><text>in the case of a
				market garden project, not less than $3,000 and not more than $50,000.</text>
								</clause></subparagraph><subparagraph id="id5F1A6E3185FD4BE88680CC0A009531E3"><enum>(B)</enum><header>Term</header><text>The
				term of a loan under this subsection shall not exceed—</text>
								<clause id="idA4894C4B22044E02A50BF99502615CC6"><enum>(i)</enum><text>in the case of a
				loan in an amount that is not more than $35,000, 12 years from the date on
				which the loan is finalized; and</text>
								</clause><clause id="id9028504A00434B2FA967A6FFB5E83256"><enum>(ii)</enum><text>in the case of
				all other loans, 20 years from the date on which the loan is finalized.</text>
								</clause></subparagraph><subparagraph id="idB6D780EABA084EA7A02BA3A4A19B2F55"><enum>(C)</enum><header>Loan financing
				terms</header><text>In making loans under this subsection, an eligible lending
				entity shall—</text>
								<clause id="idF6D4783BE42F4E1E9FD6CA371299CFD2"><enum>(i)</enum><text>set the rate of
				interest at not more than 3 percent per year;</text>
								</clause><clause id="id9EB6FCE617B6478A9C59F1A3EAD429DA"><enum>(ii)</enum><text>ensure that no
				payments are due on the loan during the first 9 months of the loan; and</text>
								</clause><clause id="idF442272BDB5D448FB79E3E667EC69CE7"><enum>(iii)</enum><text>ensure that
				only interest is due on the loan during the period beginning on the last day of
				the period described in clause (ii) and ending 24 months after the issuance of
				the loan.</text>
								</clause></subparagraph><subparagraph id="ID52cabd2ec1e744cc880cb6cff5362eae"><enum>(D)</enum><header>Loan
				forgiveness</header><text>If an eligible producer has received a loan under
				this section to carry out a local farm business project or market garden
				project, and after 3 years the Secretary determines that the project is
				successful, the Secretary may offer to forgive—</text>
								<clause id="ID5345575fbef9476ab476054cded9e388"><enum>(i)</enum><text>up to 10 percent
				of the outstanding amount of the loan; and</text>
								</clause><clause id="IDec78b28406914e07ae262f6aaadd7bcd"><enum>(ii)</enum><text>in the case of
				an eligible producer supporting sustainable agriculture practices, up to 20
				percent of the outstanding amount of the loan.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="ID58e3cb6220754cd59bc15520b28d8a8c"><enum>(d)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to the
				Secretary for each of fiscal years 2012 through 2022—</text>
						<paragraph id="ID2693db60bf73427991c51482422ec640"><enum>(1)</enum><text>$20,000,000 to
				provide loans and grants under subsection (b); and</text>
						</paragraph><paragraph id="ID391421ba9f7f40d4a4d46162e1ec4c45"><enum>(2)</enum><text>$100,000 for the
				administrative costs of carrying out this
				section.</text>
