		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Counterfeit Drug Penalty Enhancement
			 Act of 2011</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idA901E4862CCC4DF981DC18BB4E7C906F" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Counterfeit drug prevention</header><text display-inline="no-display-inline">Section 2320(b) of title 18, United States
			 Code, is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idE5C2776ECB3144F4BE1A3702636BB412"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) and (3) as
			 paragraphs (3) and (4), respectively; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id743E633907CC4A418C645561A60DED1C"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idE038BA47C1534297B71A03AA60621CCC" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="idAFFCF960E86F4E8D9CA095EAEF26E0FA"><enum>(2)</enum><header display-inline="yes-display-inline">Counterfeit drugs</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id96AFC8134A7C40398C7EB5544ADBB10B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Whoever commits an offense under subsection
				(a) with respect to a drug (as defined in section 201 of the Federal Food,
				Drug, and Cosmetic Act (21 U.S.C. 321)) shall—</text>
							<clause commented="no" display-inline="no-display-inline" id="idEBD35E3B0E314D4C8C2DA1097B15A875"><enum>(i)</enum><text display-inline="yes-display-inline">if an individual, be fined not more than
				$4,000,000, imprisoned not more than 20 years, or both; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idD5416B9148884A7290C8EBC9308342FF"><enum>(ii)</enum><text display-inline="yes-display-inline">if a person other than an individual, be
				fined not more than $10,000,000.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDE818A1CDBEB49EBAF5355C802D589C7"><enum>(B)</enum><header display-inline="yes-display-inline">Multiple offenses</header><text display-inline="yes-display-inline">In the case of an offense by a person under
				this paragraph that occurs after that person is convicted of another offense
				under this paragraph, the person convicted—</text>
							<clause commented="no" display-inline="no-display-inline" id="id29D602D876D54AC5A57B2553E220A18C"><enum>(i)</enum><text display-inline="yes-display-inline">if an individual, shall be fined not more
				than $8,000,000, imprisoned not more than 20 years, or both; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id1A1C36530E874DE9A79266F0ADFFEFAB"><enum>(ii)</enum><text display-inline="yes-display-inline">if other than an individual, shall be fined
				not more than
				$20,000,000.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id2A77DEB07C3248A9902DA5570362B50E" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Sentencing Commission Directive</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID750a1b64682a4110a3bd167a19a88e0e"><enum>(a)</enum><header display-inline="yes-display-inline">Directive to sentencing
			 commission</header><text display-inline="yes-display-inline">Pursuant to its
			 authority under section 994(p) of title 28, United States Code, and in
			 accordance with this section, the United States Sentencing Commission shall
			 review and amend, if appropriate, its guidelines and its policy statements
			 applicable to persons convicted of an offense described in section 2320(b)(2)
			 of title 18, United States Code, as amended by section 2, in order to reflect
			 the intent of Congress that such penalties be increased in comparison to those
			 currently provided by the guidelines and policy statements.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd4e434f546f64e67b4991f9233f74219"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In carrying out this section, the
			 Commission shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDe7adc515130b4e9cb807241da530213c"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that the sentencing guidelines and
			 policy statements reflect the intent of Congress that the guidelines and policy
			 statements reflect the serious nature of the offenses described in subsection
			 (a) and the need for an effective deterrent and appropriate punishment to
			 prevent such offenses;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd045b0b0769147e48c0718afcf2863ca"><enum>(2)</enum><text display-inline="yes-display-inline">consider the extent to which the guidelines
			 may or may not appropriately account for the potential and actual harm to the
			 public resulting from the offense;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID121585d970f04e1fa8cabdfcb9708012"><enum>(3)</enum><text display-inline="yes-display-inline">assure reasonable consistency with other
			 relevant directives and with other sentencing guidelines;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5391e51ecd24468490a917f046018ad8"><enum>(4)</enum><text display-inline="yes-display-inline">account for any additional aggravating or
			 mitigating circumstances that might justify exceptions to the generally
			 applicable sentencing ranges;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb1ce68cae4a44ba28a4bd118a2929d60"><enum>(5)</enum><text display-inline="yes-display-inline">make any necessary conforming changes to
			 the sentencing guidelines; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0403fea699364924ae89aa772de31c10"><enum>(6)</enum><text display-inline="yes-display-inline">assure that the guidelines adequately meet
			 the purposes of sentencing as set forth in section 3553(a)(2) of title 18,
			 United States Code.</text>
				</paragraph></subsection></section></legis-body>
