		<section id="idC54EBA4D1E4A427FB3677835398171DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Biofuels Market Expansion Act of
			 2011</short-title></quote>.</text>
		</section><section id="id1F355B9387D8469EB24E2DCDF253945D" section-type="subsequent-section"><enum>2.</enum><header>Ensuring the
			 availability of dual fueled automobiles and light duty trucks</header>
			<subsection id="IDE82BB767B0904CB183F115EF3604AE56"><enum>(a)</enum><header>In
			 general</header><text>Chapter 329 of title 49, United States Code, is amended
			 by inserting after section 32902 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBE6AED12DA5C43A2B3903916CC69084C" style="USC">
					<section id="ID9EEC7B1167BB45D2BD6C53E8E4EA80BF"><enum>32902A.</enum><header>Requirement
				to manufacture dual fueled automobiles and light duty trucks</header>
						<subsection id="idEB72F13A664B41338A03E3D579787917"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">For each model year
				listed in the following table, each manufacturer shall ensure that the
				percentage of automobiles and light duty trucks manufactured by the
				manufacturer for sale in the United States that are dual fueled automobiles and
				light duty trucks is not less than the percentage set forth for that model year
				in the following table:</text>

				(a) shall not apply to automobiles or light duty trucks that operate only on
				electricity.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDAECD9EA9DE5442FFA820AD91780865CF"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter 329 of title 49,
			 United States Code, is amended by inserting after the item relating to section
			 32902 the following:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1EAAE99C8AC5493C86E10CAA7BE191AF"><enum>(c)</enum><header>Rulemaking</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the Secretary of
			 Transportation shall prescribe regulations to carry out the amendments made by
			 this Act.</text>
			</subsection></section><section id="S1" section-type="subsequent-section"><enum>3.</enum><header>Blender pump
			 promotion</header>
			<subsection id="id0781DE7BD8C14EE5B486E2B7BB669F8E"><enum>(a)</enum><header>Blender Pump
			 grant program</header>
				<paragraph id="ID00401548515446aeb02452def7e2d1df"><enum>(1)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph id="idB3B36A46AAB4440FBFAF1D6239335D2F"><enum>(A)</enum><header>Blender
			 pump</header><text>The term <term>blender pump</term> means an automotive fuel
			 dispensing pump capable of dispensing at least 3 different blends of gasoline
			 and ethanol, as selected by the pump operator, including blends ranging from 0
			 percent ethanol to 85 percent denatured ethanol, as determined by the
			 Secretary.</text>
					</subparagraph><subparagraph id="idBED784B4C3A4482195D8D082A2712181"><enum>(B)</enum><header>E–85
			 fuel</header><text>The term <term>E–85 fuel</term> means a blend of gasoline
			 approximately 85 percent of the content of which is ethanol.</text>
					</subparagraph><subparagraph id="ID000f744107564c96968382d8b7fa96fa"><enum>(C)</enum><header>Ethanol fuel
			 blend</header><text>The term <term>ethanol fuel blend</term> means a blend of
			 gasoline and ethanol, with a minimum of 0 percent and maximum of 85 percent of
			 the content of which is denatured ethanol.</text>
					</subparagraph><subparagraph id="id114CB0412AB341C6AB995990A3417534"><enum>(D)</enum><header>Major fuel
			 distributor</header>
						<clause id="idAAF5178A6B0B4D3C911366670EEFC4BE"><enum>(i)</enum><header>In
			 general</header><text>The term <term>major fuel distributor</term> means any
			 person that owns a refinery or directly markets the output of a
			 refinery.</text>
						</clause><clause id="id3B8275E9629D43AC99C9FAA401F5D846"><enum>(ii)</enum><header>Exclusion</header><text>The
			 term <term>major fuel distributor</term> does not include any person that
			 directly markets through less than 50 retail fueling stations.</text>
						</clause></subparagraph><subparagraph id="id8B5569C6E7574556ABFF07558624B8F6"><enum>(E)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
					</subparagraph></paragraph><paragraph id="ID49c1aa0c4640420aab7dff380f5445f4"><enum>(2)</enum><header>Grants</header><text>The
			 Secretary shall make grants under this subsection to eligible facilities (as
			 determined by the Secretary) to pay the Federal share of—</text>
					<subparagraph id="IDc577b19834f94906aa663c1184147993"><enum>(A)</enum><text>installing
			 blender pump fuel infrastructure, including infrastructure necessary for the
			 direct retail sale of ethanol fuel blends (including E–85 fuel), including
			 blender pumps and storage tanks; and</text>
					</subparagraph><subparagraph id="ID5e06b533b9484db5accb1363142d9375"><enum>(B)</enum><text>providing
			 subgrants to direct retailers of ethanol fuel blends (including E–85 fuel) for
			 the purpose of installing fuel infrastructure for the direct retail sale of
			 ethanol fuel blends (including E–85 fuel), including blender pumps and storage
			 tanks.</text>
					</subparagraph></paragraph><paragraph id="idACEAAC69173344B8884FE81298196D1B"><enum>(3)</enum><header>Limitation</header><text>A
			 major fuel distributor shall not be eligible for a grant or subgrant under this
			 subsection.</text>
				</paragraph><paragraph id="idA6A4247C9D0A4A958C6019E77323CF4B"><enum>(4)</enum><header>Federal
			 share</header><text>The Federal share of the cost of a project carried out
			 under this subsection shall be up to 50 percent of the total cost of the
			 project.</text>
				</paragraph><paragraph id="id274DBD0D82CB4670877B0221C4B2C9DA"><enum>(5)</enum><header>Reversion</header><text>If
			 an eligible facility or retailer that receives a grant or subgrant under this
			 subsection does not offer ethanol fuel blends for sale for at least 2 years
			 during the 4-year period beginning on the date of installation of the blender
			 pump, the eligible facility or retailer shall be required to repay to the
			 Secretary an amount determined to be appropriate by the Secretary, but not more
			 than the amount of the grant provided to the eligible facility or retailer
			 under this subsection.</text>
				</paragraph><paragraph id="IDB1C5861CCF924A248D84A16F952B681B"><enum>(6)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to the
			 Secretary to carry out this subsection, to remain available until
			 expended—</text>
					<subparagraph id="ID1EC7809C49AB4FAFA36F0C6754C4CC32"><enum>(A)</enum><text>$50,000,000 for
			 fiscal year 2012;</text>
					</subparagraph><subparagraph id="id25EEC1DE15C040819FFC6239EEA33CDC"><enum>(B)</enum><text>$100,000,000 for
			 fiscal year 2013;</text>
					</subparagraph><subparagraph id="id89D2EC52BCC34718BF91E2FC97430392"><enum>(C)</enum><text>$200,000,000 for
			 fiscal year 2014;</text>
					</subparagraph><subparagraph id="id4088855868A44CE3A233F553A2406CC2"><enum>(D)</enum><text>$300,000,000 for
			 fiscal year 2015; and</text>
					</subparagraph><subparagraph id="id3427994D5E1F4833AD110703EED0A7B8"><enum>(E)</enum><text>$350,000,000 for
			 fiscal year 2016.</text>
					</subparagraph></paragraph></subsection><subsection id="ID3b615f05238c434eb56482d759786c89"><enum>(b)</enum><header>Installation of
			 blender pumps by major fuel distributors at owned stations and branded
			 stations</header><text display-inline="yes-display-inline">Section 211(o) of
			 the Clean Air Act (42 U.S.C. 7545(o)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id358905D29777472CB8D4B7401364DC87" style="OLC">
					<paragraph id="ID3ee5c8575c084f92ba2734e820c43e92"><enum>(13)</enum><header>Installation
				of blender pumps by major fuel distributors at owned stations and branded
				stations</header>
						<subparagraph id="ID50eaf855811d40c2bd697220a48bcfef"><enum>(A)</enum><header>Definitions</header><text>In
				this paragraph:</text>
							<clause id="idE1172872D29644178E82ABCA594AEBCC"><enum>(i)</enum><header>E–85
				fuel</header><text>The term <term>E–85 fuel</term> means a blend of gasoline
				approximately 85 percent of the content of which is ethanol.</text>
							</clause><clause id="idEF243C1FB665491A8A0FB8AC1D7FAE35"><enum>(ii)</enum><header>Ethanol fuel
				blend</header><text>The term <term>ethanol fuel blend</term> means a blend of
				gasoline and ethanol, with a minimum of 0 percent and maximum of 85 percent of
				the content of which is denatured ethanol.</text>
							</clause><clause id="ID28f4542b2fc44fc0a45a83c34e74a403"><enum>(iii)</enum><header>Major fuel
				distributor</header>
								<subclause id="id05B68158124E4CFE91C81559FC76A85F"><enum>(I)</enum><header>In
				general</header><text>The term <term>major fuel distributor</term> means any
				person that owns a refinery or directly markets the output of a
				refinery.</text>
								</subclause><subclause id="idAC3006C45901497F95F2BC89AA08262A"><enum>(II)</enum><header>Exclusion</header><text>The
				term <term>major fuel distributor</term> does not include any person that
				directly markets through less than 50 retail fueling stations.</text>
								</subclause></clause><clause id="ID890b4769b63d4448a96c4de10b30a02b"><enum>(iv)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Energy, acting in
				consultation with the Administrator of the Environmental Protection Agency and
				the Secretary of Agriculture.</text>
							</clause></subparagraph><subparagraph id="ID82a6f19baf034781bd50ae2c80583a81"><enum>(B)</enum><header>Regulations</header><text>The
				Secretary shall promulgate regulations to ensure that each major fuel
				distributor that sells or introduces gasoline into commerce in the United
				States through majority-owned stations or branded stations installs or
				otherwise makes available 1 or more blender pumps that dispense E–85 fuel and
				ethanol fuel blends (including any other equipment necessary, such as tanks, to
				ensure that the pumps function properly) for a period of not less than 5 years
				at not less than the applicable percentage of the majority-owned stations and
				the branded stations of the major fuel distributor specified in subparagraph
				(C).</text>
						</subparagraph><subparagraph id="ID739acae26f2f46b1b63c286ee65b1956"><enum>(C)</enum><header>Applicable
				percentage</header><text>For the purpose of subparagraph (B), the applicable
				percentage of the majority-owned stations and the branded stations shall be
				determined in accordance with the following table:<pagebreak></pagebreak></text>

						</subparagraph><subparagraph id="IDe0bca9532c1e42008fcb62cde65c4c51"><enum>(D)</enum><header>Geographic
				distribution</header>
							<clause id="ID76a7d04643f04be69f440e00bb942275"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (ii), in promulgating regulations under
				subparagraph (B), the Secretary shall ensure that each major fuel distributor
				described in that subparagraph installs or otherwise makes available 1 or more
				blender pumps that dispense E–85 fuel and ethanol fuel blends at not less than
				a minimum percentage (specified in the regulations) of the majority-owned
				stations and the branded stations of the major fuel distributors in each
				State.</text>
							</clause><clause id="ID4899f79b87de46928f0936078a575d46"><enum>(ii)</enum><header>Requirement</header><text>In
				specifying the minimum percentage under clause (i), the Secretary shall ensure
				that each major fuel distributor installs or otherwise makes available 1 or
				more blender pumps described in that clause in each State in which the major
				fuel distributor operates.</text>
							</clause></subparagraph><subparagraph id="IDe3a7c8da51494434a78d784f386610b6"><enum>(E)</enum><header>Financial
				responsibility</header><text>In promulgating regulations under subparagraph
				(B), the Secretary shall ensure that each major fuel distributor described in
				that subparagraph assumes full financial responsibility for the costs of
				installing or otherwise making available the blender pumps described in that
				subparagraph and any other equipment necessary (including tanks) to ensure that
				the pumps function properly.</text>
						</subparagraph><subparagraph id="IDaa3ee623ede24dcb916cad1990c21f3a"><enum>(F)</enum><header>Production
				credits for exceeding blender pumps installation requirement</header>
							<clause id="IDaa0fd2473df54c07bd53a015e36d59a9"><enum>(i)</enum><header>Earning and
				period for applying credits</header><text>If the percentage of the
				majority-owned stations and the branded stations of a major fuel distributor at
				which the major fuel distributor installs blender pumps in a particular
				calendar year exceeds the percentage required under subparagraph (C), the major
				fuel distributor shall earn credits under this paragraph, which may be applied
				to any of the 3 consecutive calendar years immediately after the calendar year
				for which the credits are earned.</text>
							</clause><clause id="ID10533f8fa0ed4f18a56d7a2e2a59e4ab"><enum>(ii)</enum><header>Trading
				credits</header><text>Subject to clause (iii), a major fuel distributor that
				has earned credits under clause (i) may sell the credits to another major fuel
				distributor to enable the purchaser to meet the requirement under subparagraph
				(C).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDf2a33054102a4b3880bb43bcc7c67044"><enum>(iii)</enum><header>Exception</header><text>A
				major fuel distributor may not use credits purchased under clause (ii) to
				fulfill the geographic distribution requirement in subparagraph
				(D).</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id7A80021CA8E04EE7ADCABF5DCFD1F0BB"><enum>4.</enum><header>Loan guarantees
			 for projects to construct renewable fuel pipelines</header>
			<subsection id="ID78552ffbed514eabbf40ad74184e0ccc"><enum>(a)</enum><header>Definitions</header><text>Section
			 1701 of the Energy Policy Act of 2005 (42 U.S.C. 16511) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idAB5D60466597472BB8BE3CF017365E7A" style="OLC">
					<paragraph id="ID5b486fef735b40fc93e631bd5f6d88cd"><enum>(6)</enum><header>Renewable
				fuel</header><text>The term <term>renewable fuel</term> has the meaning given
				the term in section 211(o)(1) of the Clean Air Act (42 U.S.C. 7545(o)(1)),
				except that the term includes all types of ethanol and biodiesel.</text>
					</paragraph><paragraph id="ID250f0a2c75ab45b2aab6ee1ae9463a44"><enum>(7)</enum><header>Renewable fuel
				pipeline</header><text>The term <term>renewable fuel pipeline</term> means a
				pipeline for transporting renewable
				fuel.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID2f21e2283b134643ae6cf26b62d4c2c7"><enum>(b)</enum><header>Amount</header><text>Section
			 1702(c) of the Energy Policy Act of 2005 (42 U.S.C. 16512(c)) is
			 amended—</text>
				<paragraph id="IDbfb8b6478fae466389bf301cc2f8d1fd"><enum>(1)</enum><text>by striking
			 <quote>(c) <header-in-text level="subsection" style="OLC">Amount</header-in-text>.—Unless</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id26801183CCE942B7A15830896B5C0493" style="OLC">

				</paragraph><paragraph id="ID38b52eb947ee4138b4c067af9d449e53"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id68CCB9E65EB24A1A80C52D743B649997" style="OLC">
						<paragraph id="IDc0c090dcddce4362aa3796e88ea159a1"><enum>(2)</enum><header>Renewable fuel
				pipelines</header><text>A guarantee for a project described in section
				1703(b)(11) shall be in an amount equal to 80 percent of the project cost of
				the facility that is the subject of the guarantee, as estimated at the time at
				which the guarantee is
				issued.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID26c79008c15f40ca816619d647376ee7"><enum>(c)</enum><header>Renewable fuel
			 pipeline eligibility</header><text>Section 1703(b) of the Energy Policy Act of
			 2005 (42 U.S.C. 16513(b)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id95CA1961446F47648DF163518F2108F8" style="OLC">
					<paragraph id="id879784F7EFD74551B65157F6D05F4271"><enum>(11)</enum><text>Renewable fuel
				pipelines.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID2b271332b649486b818bbfe2e2d93c2c"><enum>(d)</enum><header>Rapid
			 deployment of renewable fuel pipelines</header><text>Section 1705 of the Energy
			 Policy Act of 2005 (42 U.S.C. 16516) is amended—</text>
				<paragraph id="idD1A0CBE05AFC4E208DF0B5BB877CD2DC"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="ID37da6f3fdf7144be804e28653b5cea19"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by inserting “, or, in the case of projects described
			 in paragraph (4), September 30, 2012” before the colon at the end; and</text>
					</subparagraph><subparagraph id="id3D9C3010B8F841BA949DD73764EBC4DC"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id08EB98EBE99743C581B98CA09FFB16F1" style="OLC">
							<paragraph id="id78F6FE28DE1C4074ABB0BD48AC8BB74A"><enum>(4)</enum><text>Installation of
				sufficient infrastructure to allow for the cost-effective deployment of clean
				energy technologies appropriate to each region of the United States, including
				the deployment of renewable fuel pipelines through loan guarantees in an amount
				equal to 80 percent of the cost.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id30D5A84FAE5B474BA53472745A7738D3"><enum>(2)</enum><text>in subsection
			 (e), by inserting “, or, in the case of projects described in subsection
			 (a)(4), September 30, 2012” before the period at the end.</text>
