		<official-title>To amend the Child Abuse Prevention and Treatment Act to
		  require mandatory reporting of incidents of child abuse or neglect, and for
		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Speak Up to Protect Every Abused
			 Kid Act</short-title></quote>.</text>
		</section><section id="idB35D19D10FEE480F8ACD374DD9FBA69E"><enum>2.</enum><header>Child abuse and
			 neglect</header><text display-inline="no-display-inline">Section 3(2) of the
			 Child Abuse Prevention and Treatment Act (42 U.S.C. 5101 note) is amended to
			 read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id7547CDB0A340448DA84B36B1347A9AEC" style="OLC">
				<paragraph id="idBC6883D045D341979DCD43E76942E6D7"><enum>(2)</enum><text>the term
				<term>child abuse or neglect</term> means, at a minimum—</text>
					<subparagraph id="ID98167b3b1e10450f806824d0b27d08b1"><enum>(A)</enum><text>any recent act or
				failure to act, on the part of a parent or caretaker, that results in death,
				serious physical or emotional harm, or sexual abuse or exploitation, or an act
				or failure to act that presents an imminent risk of serious harm; or</text>
					</subparagraph><subparagraph id="idC6D96E202B6648CBA5EC7E3D13294FC6"><enum>(B)</enum><text>any deliberate
				act, on the part of an individual other than a parent or caretaker, that
				results in death, serious physical or emotional harm, or sexual abuse or
				exploitation, or that presents an imminent risk of serious harm to a
				child.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id7FC91756F9C94AFC9D887229E9AD435F"><enum>3.</enum><header>Educational
			 campaigns and training</header><text display-inline="no-display-inline">The
			 Child Abuse Prevention and Treatment Act is amended by inserting after section
			 103 (42 U.S.C. 5104) the following:</text>
			<quoted-block display-inline="no-display-inline" id="id95755A5BD25D463A9491657C6BDAEF9A" style="OLC">
				<section id="id3451D24D1223443A804AAFCEE3C06B28"><enum>103A.</enum><header>Educational
				campaigns and training</header>
					<subsection id="idDB3859BF7C4E4815854BFFB82A1A2EF3"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				make grants to eligible entities to carry out educational campaigns and provide
				training regarding State laws for mandatory reporting of incidents of child
				abuse or neglect.</text>
					</subsection><subsection id="id9E9D6EE169954A5EBAE3957DD8D71AC7"><enum>(b)</enum><header>Guidance and
				information on best practices</header><text display-inline="yes-display-inline">The Secretary shall develop and disseminate
				guidance and information on best practices for—</text>
						<paragraph id="id3BCDF504ACA04784939E22B1E650A6CA"><enum>(1)</enum><text display-inline="yes-display-inline">educational campaigns to educate members of
				the public about—</text>
							<subparagraph id="id3C93A4324F5243AC99CE69DDCC728669"><enum>(A)</enum><text display-inline="yes-display-inline">the acts and omissions that constitute
				child abuse or neglect under State law;</text>
							</subparagraph><subparagraph id="id7A9DAADDA26E4B6F8AA4018651892D63"><enum>(B)</enum><text>the
				responsibilities of adults to report suspected and known incidents of child
				abuse or neglect under State law; and</text>
							</subparagraph><subparagraph id="idCBE82F34DFD34BEBAF4C84196E608D26"><enum>(C)</enum><text>the ways in which
				adults can respond to help children and families without such reporting in a
				case in which the circumstances do not constitute child abuse or neglect under
				State law but the child or family needs assistance to prevent such
				circumstances from deteriorating so as to constitute child abuse or neglect;
				and</text>
							</subparagraph></paragraph><paragraph id="id3EE0149FC258460DA60AA91A7CD6429B"><enum>(2)</enum><text>training programs
				to improve such reporting by adults, with a focus on adults who work with
				children in a professional or volunteer capacity.</text>
						</paragraph></subsection><subsection id="idA8D6E81EE5654FEA945DC15E50AEB665"><enum>(c)</enum><header>Applications</header><text>To
				be eligible to receive a grant under this section, an entity shall submit an
				application to the Secretary at such time, in such manner, and containing such
				information as the Secretary may require. In determining whether to make a
				grant under this section, the Secretary shall determine whether the educational
				campaign or training proposed by the entity uses practices described in the
				guidance and information developed under subsection (b).</text>
					</subsection><subsection id="id34FCBB3A160549BD840E70686A86C077"><enum>(d)</enum><header>Use of
				funds</header><text>An entity that receives a grant under this section shall
				use the funds made available through the grant to carry out an educational
				campaign, or provide training, described in subsection (b).</text>
					</subsection><subsection id="ID404bd7435b874756899a4c5d4ec3301a"><enum>(e)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section $5,000,000 for fiscal year 2012 and $10,000,000 for each of
				fiscal years 2013 through
				2016.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idDC9638AF237740F28B177BF8F176CB85"><enum>4.</enum><header>Grants to States
			 for child abuse or neglect prevention and treatment programs</header><text display-inline="no-display-inline">Section 106(b)(2)(B) of the Child Abuse
			 Prevention and Treatment Act (42 U.S.C. 5106a(b)(2)(B)) is amended by striking
			 <quote>(B) an assurance</quote> and all that follows through clause (i), and
			 inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="id52F1C9B4974B42C3811DA3D6CD7335C2" style="OLC">
				<subparagraph commented="no" id="id1CB44C05D3124ADEBF655E78965EB4CF"><enum>(B)</enum><text>an assurance in
				the form of a certification by the Governor of the State that the State has in
				effect and is enforcing a State law, or has in effect and is operating a
				statewide program, relating to child abuse and neglect that includes—</text>
					<clause commented="no" id="id912AB1702983478DB65C4EC35BAD95F6"><enum>(i)</enum><text>provisions or
				procedures for an individual to report suspected or known incidents of child
				abuse or neglect to a State child protective service agencies or to law
				enforcement agencies, which shall include a State law for mandatory reporting
				of such incidents, to either type of agency, by any
				adult;</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idDEBF581076854411A452380D9FC5E849"><enum>5.</enum><header>Approaches and
			 techniques to improve reporting</header>
			<subsection id="idC090A46993A241B798A38302C54DFF7D"><enum>(a)</enum><header>Eligibility</header><text>Section
			 107(b) of the Child Abuse Prevention and Treatment Act (42 U.S.C. 5107c(b)) is
			 amended—</text>
				<paragraph id="id26D64C4CBBDF44B2A8A27AB11FE8F991"><enum>(1)</enum><text>in paragraph
			 (4)—</text>
					<subparagraph id="id88E38E05D133405797D218F4CAD421D3"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>and</quote> at the end; and</text>
					</subparagraph><subparagraph id="idB7E4A3DFDCEB4081B09F87F0AC5B4F4C"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id8BD2FE4C381B4994A30A5F2A484DB214" style="OLC">
							<subparagraph id="id35B35502E9034180AF56E40F70E29E62"><enum>(C)</enum><text>train adults who
				work with children in a professional or volunteer capacity, to report suspected
				and known incidents of child abuse or neglect under State law;
				and</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id5641C0DFF7E646EE8AFEC11D9423FE42"><enum>(2)</enum><text>in paragraph (5),
			 by inserting before the period <quote>and the training described in paragraph
			 (4)(C)</quote>.</text>
				</paragraph></subsection><subsection id="id36E81D11678C4A98B8BFDA5381ADB9A3"><enum>(b)</enum><header>State task
			 force study</header><text>Section 107(d) of such Act (42 U.S.C. 5107c(e)(2)) is
			 amended—</text>
				<paragraph id="id673D73DD41094C23A01E3216856C5405"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id2B952C510F5449FA8731827DB182E581"><enum>(2)</enum><text>in paragraph (2),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="id5070BCF3C1ED448EBFC27A142A45BEF4"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDC86E9CA1A4C42A2ADAA134506AC3D2A" style="OLC">
						<paragraph id="id9E7D49B2E7B4454096CF753AC0ADDF60"><enum>(3)</enum><text>evaluate the
				State's efforts to train adults who work with children in a professional or
				volunteer capacity, to report suspected and known incidents of child abuse or
				neglect under State
				law.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id45037B0651184B79B7F8B084436361F2"><enum>(c)</enum><header>Adoption of
			 recommendations</header><text display-inline="yes-display-inline">Section
			 107(e)(1) of such Act (42 U.S.C. 5107c(e)(1)) is amended—</text>
				<paragraph id="idAF11B87A58134A9BA649C1A3E040BE84"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id5EEF8F05C545463B96FE49AB32A839C6"><enum>(2)</enum><text>in subparagraph
			 (C), by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="id18BDAA0BF03C425C879CF1C9D34454FE"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id26B3AC8AB1194D11A168F54EB26D3F65" style="OLC">
						<subparagraph id="ID24880d6ca05b414e86d240603ac77373"><enum>(D)</enum><text>experimental,
				model, and demonstration programs for testing innovative approaches and
				techniques that may improve reporting of and response to suspected and known
				incidents of child abuse or neglect by adults to the State child protective
				service agencies or to law enforcement
				agencies.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id49417013BB0343ADBD56EF75287FE0C3"><enum>6.</enum><header>General program
			 grants</header><text display-inline="no-display-inline">Section 108 of the
			 Child Abuse Prevention and Treatment Act (42 U.S.C. 5106d) is amended by adding
			 at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id08B03B65FC454FC6B3960406D8B12E5C" style="OLC">
				<subsection id="id99D80DD2CCC14C29A25C6080084056A8"><enum>(f)</enum><header>Mandatory
				reporting</header><text>To be eligible to receive any form of financial
				assistance under this title, a State shall include in the corresponding plan or
				application an assurance that the State has in effect a State law for mandatory
				reporting described in section
				106(b)(2)(B)(i).</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idD0F147F3BD6A46DA864EE723996F6090"><enum>7.</enum><header>Reports</header><text display-inline="no-display-inline">Section 110 of the Child Abuse Prevention
			 and Treatment Act (42 U.S.C. 5106f) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id9BF00CC2A8734E76AEE0F653B5AAB391" style="OLC">
				<subsection id="id73CFABFA0BCA49CCAB6C372941D79FDE"><enum>(e)</enum><header>Report on State
				mandatory reporting laws</header>
					<paragraph id="ID1771a55d15dc44a8ab320614bc9948ad"><enum>(1)</enum><header>Study</header><text>Not
				later than 4 years after the date of enactment of the Speak Up to Protect Every
				Abused Kid Act, the Secretary shall collect information on and otherwise study
				the efforts of States relating to State laws for mandatory reporting of
				incidents of child abuse or neglect, in order to—</text>
						<subparagraph id="ID65e6b2a0baee41aa84156363a57cab1d"><enum>(A)</enum><text>assess the
				implementation of the amendments made by that Act; and</text>
						</subparagraph><subparagraph id="IDc95c6b4a0118441abc4becaac791f90e"><enum>(B)</enum><text>provide an update
				on—</text>
							<clause id="ID3f832f4478a74a91914815c3de6df7cd"><enum>(i)</enum><text>implementation of
				State laws for mandatory reporting described in section 106(b)(2)(B)(i);
				and</text>
							</clause><clause id="ID0d71202d6bc949988d9106d12f109eed"><enum>(ii)</enum><text>State efforts to
				improve reporting on, and responding to reports of, child abuse or
				neglect.</text>
							</clause></subparagraph></paragraph><paragraph id="id090A32B79ACC478A8FBC276D48299FF0"><enum>(2)</enum><header>Report</header><text>Not
				later than 4 years after that date of enactment, the Secretary shall submit to
				the appropriate committees of Congress a report containing the findings of the
				study.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id093C0226CB384A2DA95482780032620A"><enum>8.</enum><header>Community-based
			 grants</header><text display-inline="no-display-inline">Section 204 of the
			 Child Abuse Prevention and Treatment Act (42 U.S.C. 5116d) is amended—</text>
			<paragraph id="idCECCE47A68614F8EB174FF013CBE039F"><enum>(1)</enum><text>in paragraph
			 (11), by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="id0235783005E64ED28E362F9529C1E913"><enum>(2)</enum><text>in paragraph
			 (12), by striking the period and inserting <quote>; and</quote>; and</text>
			</paragraph><paragraph id="id236DA5DF559449D891AF09EA235D1555"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id892DC8B71D2549918CC9056C29208EC6" style="OLC">
					<paragraph id="id86A98552841745D392B3D25513BEE0AC"><enum>(13)</enum><text>an assurance
				that the State has in effect a State law for mandatory reporting described in
				section
				106(b)(2)(B)(i).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id322904F659124809B0567548AC6740A9"><enum>9.</enum><header>Effective
			 date</header>
			<subsection id="idD3B94CBF73694A90A9C8CBC232D7003A"><enum>(a)</enum><header>In
			 general</header><text>Except as provided in subsection (b), this Act takes
			 effect on the date of enactment of this Act.</text>
			</subsection><subsection id="idDA75E526258D40AFA591A0FA01363658"><enum>(b)</enum><header>Mandatory
			 reporting requirements</header><text display-inline="yes-display-inline">The
			 amendments made by sections 4, 5(a), 6, and 8 shall apply to the corresponding
			 plans and applications submitted after the date that is 2 years after the date
			 of enactment of this Act.</text>
