		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Medical Surge Capacity
			 Act</short-title></quote>.</text>
		</section><section id="id0DA5FB063E2146F2A517F309ECA304B7"><enum>2.</enum><header>Enhancing
			 medical surge capacity</header>
			<subsection id="idDB1A08FC46074FD3AC5F4B3C72F363D1"><enum>(a)</enum><header>Modification of
			 criteria for emergency area; emergency period</header><text display-inline="yes-display-inline">Section 1135(g)(1)(A) of the Social
			 Security Act (42 U.S.C. 1320b–5(a)(1)(A)) is amended by striking
			 <quote>and</quote> after the semicolon and inserting <quote>or</quote>.</text>
			</subsection><subsection id="id34E6E93CF2334374A0DE7EE739B90298"><enum>(b)</enum><header>Waiver
			 authority for host areas</header><text display-inline="yes-display-inline">Section 1135(g)(1) of such Act (42 U.S.C.
			 1320b–5(g)(1)), as amended by subsection (a), is amended by adding after and
			 below subparagraph (B), the following flush sentence:</text>
				<quoted-block display-inline="no-display-inline" id="id42B563CDE67A46C7A80EC89027388087" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Notwithstanding the preceding
				sentence, the Secretary may deem an emergency area to include a geographical
				area into which individuals from the emergency area are evacuated and receiving
				care.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE91DDE461A984EA6A714E93AB723AC41"><enum>(c)</enum><header>Duration of
			 EMTALA and HIPAA waivers</header><text display-inline="yes-display-inline">The
			 third sentence of section 1135(b) of such Act (42 U.S.C. 1320b–5(b)) is amended
			 by striking <quote>72-hour</quote> and inserting <quote>96-hour</quote>.</text>
