		<official-title>To amend title 38, United States Code, to reinstate
		  criminal penalties for persons charging veterans unauthorized fees, and for
		  other purposes.</official-title>

		<section id="idA75AF4408E614DE1B93F8303E54FEEE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Protect Our Disabled Heroes Act of
			 2011</short-title></quote>.</text>
		</section><section id="H7AF4385108EB4F60A27FD3BFF9133C33" section-type="subsequent-section"><enum>2.</enum><header>Reinstatement of
			 penalties for charging veterans unauthorized fees</header>
			<subsection id="H09FE86BE6BC4411AA30067A42B83A921"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 5905 of title
			 38, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H6FAE30AA1B7B45FDA31F0909FA98D470" style="USC">
					<section id="HCFA759C6717A4BF292CCB5AAA3868B76"><enum>5905.</enum><header>Penalty for
				certain acts</header><text display-inline="no-display-inline">Except as
				provided in section 5904 or 1984 of this title, whoever—</text>
						<paragraph id="HF56B49A21EC54EA782C41AA1D7B14580"><enum>(1)</enum><text display-inline="yes-display-inline">in connection with a proceeding before the
				Department, knowingly solicits, contracts for, charges, or receives any fee or
				compensation in connection for—</text>
							<subparagraph id="H7A33964752CA4353AA9C4E52A43440EF"><enum>(A)</enum><text display-inline="yes-display-inline">the provision of advice on how to file a
				claim for benefits under the laws administered by the Secretary; or</text>
							</subparagraph><subparagraph id="HE80AA674BB1B4B74AEAEF9EA95E9D567"><enum>(B)</enum><text display-inline="yes-display-inline">the preparation, presentation, or
				prosecution of such a claim before the date on which a notice of disagreement
				is filed in a proceeding on the claim;</text>
							</subparagraph></paragraph><paragraph id="id2B06652434B84924BA6B160C806BB11C"><enum>(2)</enum><text display-inline="yes-display-inline">attempts to solicit, contract, charge, or
				receive as described in paragraph (1);</text>
						</paragraph><paragraph id="HF06BE250E0B4440D8E15C3991EB67B1B"><enum>(3)</enum><text display-inline="yes-display-inline">unlawfully withholds from any claimant or
				beneficiary any part of a benefit or claim under the laws administered by the
				Secretary that is allowed and due to the claimant or beneficiary, or attempts
				to do so;</text>
						</paragraph><paragraph id="H37AA4FB3C88C4830958224C14FAA3269"><enum>(4)</enum><text display-inline="yes-display-inline">commits an offense punishable by this
				chapter, or aids, abets, counsels, commands, or procures the commission of such
				an act; or</text>
						</paragraph><paragraph id="HB599F5F034BF4D8EB5EBC2A8F7C10CE2"><enum>(5)</enum><text display-inline="yes-display-inline">causes an act to be done, which if directly
				performed would be punishable by this chapter,</text>
						</paragraph></section><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">shall be
				fined as provided in title 18, or imprisoned for not more than one year, or
				both.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H03C1B174B67040729614820FEE2FE09E"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply with respect to acts committed after the date of the
			 enactment of this Act.</text>
