			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Strengthening Services for
			 America’s Seniors Act</short-title></quote>.</text>
		</section><section id="idDB015867AA314999A723A0E2160737B5"><enum>2.</enum><header>Standardized
			 assessment of needs of family caregivers</header>
			<subsection id="idD1E7D72A77944CFFB76EC5D9C2AA3C3F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 373 (42
			 U.S.C. 3030s–1) is amended—</text>
				<paragraph id="idE5E98706F72C43C0BDFC6CABB0A0EC29"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) through
			 (g) as subsections (c) through (h), respectively;</text>
				</paragraph><paragraph id="id4FB6E5C6BAAF4F6EA2FEEAA194DFACFF"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), as so redesignated, by
			 striking <quote>subsection (b)</quote> and inserting <quote>subsection
			 (c)</quote>;</text>
				</paragraph><paragraph id="idF5BECE32F0684A3C8B8999007A93CD7B"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e), as so redesignated, by
			 striking <quote>subsection (b)</quote> and inserting <quote>subsection
			 (c)</quote>; and</text>
				</paragraph><paragraph id="idCADCFE7D9E144735ADC6227750AE46DB"><enum>(4)</enum><text>by inserting
			 after subsection (a) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id105281CB87194F308611BB6C6CC6B62A" style="OLC">
						<subsection id="idED0C088431904B1AAE6F631578319D34"><enum>(b)</enum><header>Assessment
				program of needs of family caregivers</header>
							<paragraph id="idB9AE549E98204AFBB0DB5991BBDAAA97"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary may make grants to States to
				establish a program, in accordance with the program requirements described in
				paragraph (5), to assess the needs of family caregivers for targeted support
				services described in paragraph (5)(C).</text>
							</paragraph><paragraph id="id90C22F9545C84A5AB2F35C2F4615EFBC"><enum>(2)</enum><header>Application by
				States</header><text>Each State seeking a grant under this subsection shall
				submit an application to the Assistant Secretary at such time, in such manner,
				and containing such information and assurances as the Assistant Secretary
				determines appropriate.</text>
							</paragraph><paragraph id="id2B16FA40D78E43A3AB59DFBA87D71C84"><enum>(3)</enum><header>Grant
				amount</header><text>The amount of a grant to a State under this subsection
				shall be determined according to such methodology as the Assistant Secretary
				determines appropriate.</text>
							</paragraph><paragraph id="id913EDBF54E8D41B1B1983EAD9900206A"><enum>(4)</enum><header>Program
				administration</header><text>A State receiving a grant under this subsection
				may enter into an agreement with area agencies on aging in the State, or an
				Aging and Disability Resource Center in the State, to administer the program,
				using such grant funds.</text>
							</paragraph><paragraph id="id78D2D5231E014B2B86B1D7176BD8666C"><enum>(5)</enum><header>Program
				Requirements</header>
								<subparagraph id="id8AD860957E934E61A10627E80797970F"><enum>(A)</enum><header>Standardized
				assessment</header><text>Assessments under a program established under
				paragraph (1)—</text>
									<clause id="idF575620358DE46B38E05B9EE69A5228B"><enum>(i)</enum><text>shall be
				conducted by social workers, care managers, nurses, or other appropriate
				professionals; and</text>
									</clause><clause id="id7BC179287B4740CE96F54C88FEA4D93A"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id0B58C7C349824B76B31C322EF5366247"><enum>(I)</enum><text>shall be conducted with
				a standardized instrument to identify family caregiver needs; and</text>
										</subclause><subclause id="idA53B22B638474A7E8CCB5512F1C08233" indent="up1"><enum>(II)</enum><text>in a State in which an area agency on
				aging or an Aging and Disability Resource Center is using such an instrument on
				the date of enactment of the <short-title>Strengthening
				Services for America’s Seniors Act</short-title>, may continue to be conducted
				with that instrument.</text>
										</subclause></clause></subparagraph><subparagraph commented="no" id="id566F4AE8F2B14FDE9EA8A606991AC1C3"><enum>(B)</enum><header>Questionnaire</header>
									<clause commented="no" id="idCDC3DE86DBE54AFEB40B3F05BE8D1579"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (ii), assessments under a program
				established as described in paragraph (1) shall include asking the family
				caregiver relevant questions in order to determine whether the family caregiver
				would benefit from any targeted support services described in subparagraph
				(C).</text>
									</clause><clause commented="no" id="idD3221BFB898E462A916EA90C46088E9D"><enum>(ii)</enum><header>Completion on
				a voluntary basis</header><text>The answering of questions under clause (i) by
				a family caregiver shall be on a voluntary basis.</text>
									</clause><clause commented="no" id="idAA6EDCF07E314679BA32619755A5FA14"><enum>(iii)</enum><header>Addressing
				diverse caregiver needs and preferences</header><text>The questionnaire under
				this subparagraph shall be designed in a manner that accounts for, and aims to
				ascertain, the varying needs and preferences of family caregivers, based on the
				range of their capabilities, caregiving experience, and other relevant personal
				characteristics and circumstances.</text>
									</clause></subparagraph><subparagraph commented="no" id="idF7B20245E58E464E9C820B284A26DEB7"><enum>(C)</enum><header>Targeted
				support services described</header><text>The following targeted support
				services are described in this subparagraph:</text>
									<clause commented="no" id="ID6b1fb1b621e746218f034dff99a82227"><enum>(i)</enum><text>Information and
				assistance (including brochures and online resources for researching a disease
				or disability or for learning and managing a regular caregiving role, new
				technologies that can assist family caregivers, and practical assistance for
				locating services).</text>
									</clause><clause commented="no" id="ID1319bf75d5e4484d8b9f8dc50e55717a"><enum>(ii)</enum><text>Individual
				counseling (including advice and consultation sessions to bolster emotional
				support for the family caregiver to make well-informed decisions about how to
				cope with caregiver strain).</text>
									</clause><clause commented="no" id="IDc4607c6bef6945dbb4f8c6b034f7aee1"><enum>(iii)</enum><text>Support groups,
				including groups which provide help for family caregivers to—</text>
										<subclause commented="no" id="idC3CB1C580B3F45E09736ECA467200493"><enum>(I)</enum><text>locate a support
				group either locally or online to share experiences and reduce
				isolation;</text>
										</subclause><subclause commented="no" id="idAA7C4340153A40838A0A4E7F3B8C2673"><enum>(II)</enum><text>make
				well-informed caregiving decisions; and</text>
										</subclause><subclause commented="no" id="idA81DCBA757A44E7690A40F3736A948A1"><enum>(III)</enum><text>reduce
				isolation.</text>
										</subclause></clause><clause commented="no" id="ID695a5702a7734eddaff0f0c7de6379d7"><enum>(iv)</enum><text>Education and
				training (including workshops and other resources available with information
				about stress management, self-care to maintain good physical and mental health,
				understanding and communicating with individuals with dementia, medication
				management, normal aging processes, change in disease and disability, the role
				of assistive technologies, and other relevant topics).</text>
									</clause><clause commented="no" id="id9B0BF06926EE48B381201DD8741A4887"><enum>(v)</enum><text>Respite care and
				emergency back-up services (including short-term in-home care services that
				gives the family caregiver a break from providing such care).</text>
									</clause><clause commented="no" id="ID21c6d3a2b4cb4ebf8db6904f8fda0016"><enum>(vi)</enum><text>Chore services
				(such as house cleaning) to assist the individual receiving care.</text>
									</clause><clause commented="no" id="ID31d68e518c62487e96d392e12b0df72c"><enum>(vii)</enum><text>Personal care
				(including outside help) to assist the individual receiving care.</text>
									</clause><clause commented="no" id="id3E22865931654232872C43DF45AA6659"><enum>(viii)</enum><text>Legal and
				financial planning and consultation (including advice and counseling regarding
				long-term care planning, estate planning, powers of attorney, community
				property laws, tax advice, employment leave advice, advance directives, and
				end-of-life care).</text>
									</clause><clause commented="no" id="IDeb5b143021fc40b08491d288941ee0c7"><enum>(ix)</enum><text>Transportation
				(including transportation to medical appointments) to assist the individual
				receiving care.</text>
									</clause><clause commented="no" id="ID2b9ef107019d45f8bf0783a00dd1cb9e"><enum>(x)</enum><text>Other targeted
				support services, as determined appropriate by the State agency and approved by
				the Assistant Secretary.</text>
									</clause></subparagraph><subparagraph commented="no" id="idF705276F4D784AB7BED7F4109B88B6CB"><enum>(D)</enum><header>Referrals</header><text>In
				the case where a questionnaire completed by a family caregiver under
				subparagraph (B) indicates that the family caregiver would benefit from 1 or
				more of the targeted support services described in subparagraph (C), the agency
				administering the program shall provide referrals to the family caregiver for
				State, local, and private-sector caregiver programs and other resources that
				provide such targeted support services to such caregivers.</text>
								</subparagraph><subparagraph id="idCC4A0EF1DEDF49F088CC358F7DBC0182"><enum>(E)</enum><header>Targeting and
				timing of assessments</header><text>Assessments under the program established
				under paragraph (1) may be conducted—</text>
									<clause id="id8EC7566176F8468099646E053EBFC119"><enum>(i)</enum><text>when an
				individual who is being assisted by a family caregiver transitions from one
				care setting to another;</text>
									</clause><clause id="id5900103D1E4844B0AF2A49059F5A3B32"><enum>(ii)</enum><text>upon referral
				from a social worker, care manager, nurse, physician, or other appropriate
				professional; or</text>
									</clause><clause id="IDee71493eb472466ea24b4e7e585968a0"><enum>(iii)</enum><text>according to
				circumstances determined by the State and approved by the Assistant
				Secretary.</text>
									</clause></subparagraph><subparagraph id="idC8D7A94CCD09411D81B73B592FDEF34F"><enum>(F)</enum><header>Coordination
				with other assessment</header><text>Assessments under the program established
				under paragraph (1) may be conducted separately or as part of, or in
				conjunction with, eligibility or other routine assessments of an individual who
				is being (or is going to be) assisted by a family caregiver.</text>
								</subparagraph><subparagraph id="id59B4769697114DB4B200A01600BC66E7"><enum>(G)</enum><header>Followup
				services</header><text>As the Assistant Secretary determines appropriate, a
				State with a program described in paragraph (1) shall conduct followup
				activities with caregivers who have participated in an assessment to determine
				the status of the caregiver and whether services were provided.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9d5667acfd394d41abbb336d3c87c000"><enum>(H)</enum><header>Reporting
				requirement</header><text>Each State with a program described in paragraph (1)
				shall periodically submit to the Assistant Secretary a report containing
				information on the number of caregivers assessed under the program, information
				on the number of referrals made for targeted support services under the program
				(disaggregated by type of service), demographic information on caregivers
				assessed under the program, and other information required by the Assistant
				Secretary.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id6CE3D91B307C4F7394B2757C85467D80"><enum>(b)</enum><header>Standardized
			 assessment of needs of informal caregivers</header><text>Section 202 (42 U.S.C.
			 3012) is amended—</text>
				<paragraph id="id9501D20B71D84E05924BA0FFBC4F07D0"><enum>(1)</enum><text>in subsection
			 (b)(8)—</text>
					<subparagraph id="idE3835FE427EF47B5BA58CC0EA2EE831F"><enum>(A)</enum><text>in subparagraph
			 (D), by striking <quote>and</quote>;</text>
					</subparagraph><subparagraph id="id1BDB83652BCD4340A0AFE547FF022148"><enum>(B)</enum><text>in subparagraph
			 (E), inserting <quote>and</quote> after the semicolon at the end; and</text>
					</subparagraph><subparagraph id="id00333CCD4AD049439505F72D70FD8909"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id24922D77BE29478E9AFD3C76EBEFB585" style="OLC">
							<subparagraph id="idCBA501B29DF94CFF8C0E2B6F77104FF0"><enum>(F)</enum><text>which may carry
				out the informal caregiver assessment program described in subsection
				(g);</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id13BE0B6541474CEEB1FD9CBD78730145"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1B9A05D867F84EA3B7AFA916FCED9A06" style="OLC">
						<subsection id="id70A3AE2896534890A6903F0CAADC829F"><enum>(g)</enum><header>Standardized
				assessment of needs of informal caregivers</header>
							<paragraph id="id6A507A46E0104D12A5982845150D97EB"><enum>(1)</enum><header>In
				general</header><text>Aging and Disability Resource Centers implemented under
				subsection (b)(8) may carry out an assessment program with respect to informal
				caregivers and care recipients. Such assessment program shall be modeled on the
				family caregiver assessment program established under section 373(b).</text>
							</paragraph><paragraph id="id277B5DA21A6B446499E7EB5EB5D589BD"><enum>(2)</enum><header>Definitions</header><text>For
				purposes of an informal caregiver assessment carried out in accordance with
				paragraph (1), the following definitions shall apply:</text>
								<subparagraph id="idB29D14D7017C4337B7B12A880AC53EB4"><enum>(A)</enum><header>Care
				recipient</header><text>The term <term>care recipient</term> means—</text>
									<clause id="id05BE1557A203493DB53C1A02F31E2DC2"><enum>(i)</enum><text>an older
				individual;</text>
									</clause><clause id="id164F2D5779074ACC882B01467BA467E2"><enum>(ii)</enum><text>an individual
				with a disability; or</text>
									</clause><clause id="id5D73D26B57F745E9832119226BF2697A"><enum>(iii)</enum><text>an individual
				with a special need.</text>
									</clause></subparagraph><subparagraph id="id56B0935214C54A16B3472CEAD26D2990"><enum>(B)</enum><header>Individual with
				a special need</header><text>The term <term>individual with a special
				need</term> means an individual who requires care or supervision to—</text>
									<clause id="ID5F45D0C008064F61B7D0AB72B1D52937"><enum>(i)</enum><text>meet the
				individual's basic needs;</text>
									</clause><clause id="ID75044BBE94844926806440C79438BC24"><enum>(ii)</enum><text>prevent physical
				self-injury or injury to others; or</text>
									</clause><clause id="ID38FC161E0D994ED2AF97AC79B74A73C4"><enum>(iii)</enum><text>avoid placement
				in an institutional facility.</text>
									</clause></subparagraph><subparagraph id="id4A6ADB3122054D6C8C1B255F0F9036AA"><enum>(C)</enum><header>Informal
				caregiver</header>
									<clause id="id57034F0094014F678D9B46BCCBAD0095"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (ii), the term <term>informal
				caregiver</term> means an adult family member, or another individual, who is an
				informal provider of in-home and community care to a care recipient.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idF3F9570302484477A829138070E88F6F"><enum>(ii)</enum><header>Alternate
				definition</header><text>A State that has a State law with an alternate
				definition of the term <term>informal caregiver</term> for purposes of a
				program described in paragraph (1) may use that definition (with respect to
				caregivers for care recipients) for purposes of provisions of this Act that
				relate to that program, if such alternative definition is broader than the
				definition in clause (i), and subject to approval by the Assistant
				Secretary.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idACB54716BE0A4698BB181FAD829506F1"><enum>(c)</enum><header>Conforming
			 amendment</header><text>Section 631(b) (42 U.S.C. 3057k–11(b)) is amended by
			 striking <quote>subsections (c), (d), and (e)</quote> and inserting
			 <quote>subsections (d), (e), and (f)</quote>.</text>
			</subsection></section><section id="ID6326EA886AF4448E8300EEFCA18427A0"><enum>3.</enum><header>Advisory
			 Committee to Assess, Coordinate, and Improve Legal Assistance
			 Activities</header>
			<subsection id="idA82FC3B5213447F6980B83DB44C64500"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title II of the Older
			 Americans Act of 1965 is amended—</text>
				<paragraph id="idE8D92CC2DEC2420DAA858C7567D40122"><enum>(1)</enum><text display-inline="yes-display-inline">in section 215(j) (42 U.S.C. 3020e–1(j)),
			 by striking <quote>section 216</quote> and inserting <quote>section
			 217</quote>;</text>
				</paragraph><paragraph id="idDC9A7A1CEBB54666B0DCD5F9E8A925C8"><enum>(2)</enum><text>by redesignating
			 section 216 (42 U.S.C. 3020f) as section 217; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99EBC30026F6401BA9F600DE023BBE54"><enum>(3)</enum><text>by inserting
			 after section 215 (42 U.S.C. 3020e–1) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idEE3F70929AA2466E9B3FEF999F534498" style="OLC">
						<section id="id5D169FACA72B4A04A51808E6DD120304"><enum>216.</enum><header>Advisory
				Committee to Assess, Coordinate, and Improve Legal Assistance
				Activities</header>
							<subsection id="IDFD467BCEA3AA4D48B600D749AD178040"><enum>(a)</enum><header>Establishment</header><text>There
				is established an Advisory Committee to Assess, Coordinate, and Improve Legal
				Assistance Activities (referred to in this section as the
				<quote>Committee</quote>).</text>
							</subsection><subsection id="ID72664CA8B4684A54AD73C527866BF3AF"><enum>(b)</enum><header>Membership</header>
								<paragraph id="ID33D32B163B914F78AF90CAE0814B6274"><enum>(1)</enum><header>Composition</header><text>The
				Committee shall be composed of 9 members—</text>
									<subparagraph id="idDB358D1FFDD941BE882F419DC79CE58C"><enum>(A)</enum><text>with expertise
				with existing State legal assistance development programs carried out under
				section 731 and providers of State legal assistance under subtitle B of title
				III and title IV; and</text>
									</subparagraph><subparagraph id="id4E9087E3B02F414397223D74EED4A2DD"><enum>(B)</enum><text>of whom—</text>
										<clause id="ID8285909008F64CC492A1EC93925E7E70"><enum>(i)</enum><text>6
				individuals shall be appointed by the Assistant Secretary—</text>
											<subclause id="idFE318BE0E0534FABA228F1347070EA64"><enum>(I)</enum><text>1 of whom shall
				be a consumer advocate;</text>
											</subclause><subclause id="id7DAFB9AA920A4E05B7082CBDDDC54FC2"><enum>(II)</enum><text>1 of whom shall
				be a professional advocate from a State agency or State Legal Services
				Developer; and</text>
											</subclause><subclause id="ID8c05a05c00dc42e482e31170cecd7c36"><enum>(III)</enum><text>4 of whom shall
				be representatives from collaborating organizations under the National Legal
				Resource Center of the Administration; and</text>
											</subclause></clause><clause id="IDDACC41CD52704BD4808EA796598754C1"><enum>(ii)</enum><text>3 individuals
				shall be appointed by the Comptroller General of the United States.</text>
										</clause></subparagraph></paragraph><paragraph id="IDE9F3972A53F3431BAFE43A6D84F81B9E"><enum>(2)</enum><header>Date</header><text>The
				appointments of the members of the Committee shall be made not later than 9
				months after the date of enactment of the <short-title>Strengthening Services for America’s Seniors
				Act</short-title>.</text>
								</paragraph><paragraph id="IDB08894DF76264C169C4978B10289F058"><enum>(3)</enum><header>Period of
				appointment; vacancies</header><text>Members shall be appointed for the life of
				the Committee. Any vacancy in the Committee shall not affect its powers, but
				shall be filled in the same manner as the original appointment.</text>
								</paragraph><paragraph id="ID94D5D8A124314622AF523E73B59AF9BD"><enum>(4)</enum><header>Chairperson and
				vice chairperson</header><text>The Committee shall select a Chairperson and
				Vice Chairperson from among its members.</text>
								</paragraph></subsection><subsection id="IDDE5797531FB04E4B802FE4DBC6F02B3C"><enum>(c)</enum><header>Initial
				meeting</header><text>The Committee shall hold its first meeting not later than
				9 months after the date of enactment of the <short-title>Strengthening Services for America’s Seniors
				Act</short-title>.</text>
							</subsection><subsection id="ID96F080F70E204EA5A3E9A7FEF1C0B881"><enum>(d)</enum><header>Duties of the
				Committee</header>
								<paragraph id="ID2A0D088041664985B878621ED725F0D3"><enum>(1)</enum><header>Definition</header><text>In
				this subsection, the term <term>assistance activities</term> includes—</text>
									<subparagraph id="idEAE17EF4295D4552903C093A7C9B7F9A"><enum>(A)</enum><text>legal assistance
				made available to older individuals in social or economic need under this
				Act;</text>
									</subparagraph><subparagraph id="id252C885659F44904A892268A183F4DC4"><enum>(B)</enum><text>activities of the
				National Legal Resource Center carried out under section 420(a);</text>
									</subparagraph><subparagraph id="IDc4b8c6ca01dc4058a74ed83d158ff3a2"><enum>(C)</enum><text>State legal
				assistance developer activities carried out under section 731; and</text>
									</subparagraph><subparagraph id="idD437FB69BC9147A58EC018688FBB8D20"><enum>(D)</enum><text>any other
				directly related activity or program as determined appropriate by the Assistant
				Secretary.</text>
									</subparagraph></paragraph><paragraph id="id924EDE0513AC4CD08A84D3DC1DC9F3B8"><enum>(2)</enum><header>Study</header>
									<subparagraph id="idFF64AED8AEE74E97BD73061F0683AF1B"><enum>(A)</enum><header>In
				general</header><text>The Committee shall design, implement, and analyze
				results of a study of—</text>
										<clause id="ID15be50c804a04fc7a1af8f7db305246a"><enum>(i)</enum><text>the extent to
				which State leadership is provided through the State legal assistance developer
				in States to enhance the coordination and effectiveness of legal assistance
				activities across the State;</text>
										</clause><clause id="IDc61638d60c99466293a7ab16a9973544"><enum>(ii)</enum><text>the extent to
				which—</text>
											<subclause id="id6558D648440F403A97FCF1EA7010121C"><enum>(I)</enum><text>there is data
				collection and reporting of information by legal assistance providers in
				States;</text>
											</subclause><subclause id="idE0D089E452C64B93B43AB1095DC03915"><enum>(II)</enum><text>there is uniform
				statewide reporting among States; and</text>
											</subclause><subclause id="id33F39DA74DB64ABEAF0BD7D1799FF025"><enum>(III)</enum><text>the value and
				impact of services provided is being captured at the State or local level;
				and</text>
											</subclause></clause><clause id="IDb41cad219cb14ad48d0d7922b27ee121"><enum>(iii)</enum><text>the mechanisms
				to organize and promote legal assistance development and services to best meet
				the needs of older individuals with greatest social and economic need.</text>
										</clause></subparagraph><subparagraph id="id4D60343048334B7E94283C2077B68715"><enum>(B)</enum><header>Considerations</header><text>In
				carrying out subparagraph (A)(i), particular attention shall be given
				to—</text>
										<clause id="IDbc47fdec85d14c8ba4a09c6158df7ed6"><enum>(i)</enum><text>State leadership
				on targeting limited legal resources to older individuals in greatest social
				and economic need; and</text>
										</clause><clause id="IDb05cff1a3430427bb72d9d44385aa61f"><enum>(ii)</enum><text>State leadership
				on establishing priority legal issue areas in accordance with section
				307(a)(11)(E).</text>
										</clause></subparagraph></paragraph><paragraph id="ID878439448DC84F64ACEA3FFFAC58C7D7"><enum>(3)</enum><header>Recommendations</header><text>After
				completion and analysis of study results under paragraph (2), the Committee
				shall develop recommendations for the establishment of guidelines for—</text>
									<subparagraph id="IDfa8dfe1cbfcb4b40b5817efefeaa11db"><enum>(A)</enum><text>enhancing the
				leadership capacity of the State legal assistance developers to carry out
				statewide coordinated legal assistance service delivery, with particular focus
				on enhancing leadership capacity to—</text>
										<clause id="ID75e826668fb841b4a1f8fca7b3d98525"><enum>(i)</enum><text>target limited
				legal resources to older individuals in greatest social and economic need;
				and</text>
										</clause><clause id="ID786ae4c8e92342bfa8efc7151a154235"><enum>(ii)</enum><text>establish
				priority legal issue areas in accord with priorities set forth in section
				307(a)(11)(E);</text>
										</clause></subparagraph><subparagraph id="ID70a64c5d3a6c4549b32bfed64e88d424"><enum>(B)</enum><text>developing a
				uniform national data collection system to be implemented in all States on
				legal assistance development and services; and</text>
									</subparagraph><subparagraph id="ID4eae2276a2dd4406a688d206edfb9fea"><enum>(C)</enum><text>identifying
				mechanisms for organizing and promoting legal assistance activities to provide
				the highest quality, impact, and effectiveness to older individuals with the
				greatest social and economic need.</text>
									</subparagraph></paragraph><paragraph id="IDB54BF4F8ADFC412A994FA62FB988BC8C"><enum>(4)</enum><header>Report</header><text>Not
				later than 1 years after the date of the establishment of the Committee, the
				Committee shall submit to the President, Congress, and the Assistant Secretary
				a report that contains a detailed statement of the findings and conclusions of
				the Committee, together with the recommendations described in paragraph
				(3).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD35C8219B6A545CA90426764A613D362"><enum>(e)</enum><header display-inline="yes-display-inline">Duties of the Assistant
				Secretary</header><text display-inline="yes-display-inline">Not later than 180
				days after receiving the report described in subsection (d)(4), the Assistant
				Secretary shall issue regulations or guidance, taking into consideration the
				recommendations described in subsection (d)(3).</text>
							</subsection><subsection commented="no" id="IDBFC32966825247A6B3152C1E31AB711C"><enum>(f)</enum><header>Powers</header>
								<paragraph commented="no" id="IDEEA07BE3799D4088B1C3D80D2B872D72"><enum>(1)</enum><header>Information
				from Federal agencies</header><text>The Committee may secure directly from any
				Federal department or agency such information as the Committee considers
				necessary to carry out the provisions of this section. Upon request of the
				Committee, the head of such department or agency shall furnish such information
				to the Committee.</text>
								</paragraph><paragraph commented="no" id="ID2CBFA1BD6B774392B7B74B562599E13B"><enum>(2)</enum><header>Postal
				services</header><text>The Committee may use the United States mails in the
				same manner and under the same conditions as other departments and agencies of
				the Federal Government.</text>
								</paragraph></subsection><subsection id="IDA098BFCAA835459B87870CB7B7D67EAA"><enum>(g)</enum><header>Personnel and
				administration</header>
								<paragraph id="ID727E11A29415415D888DBF1631255C36"><enum>(1)</enum><header>Travel
				expenses</header><text>The members of the Committee shall not receive
				compensation for the performance of services for the Committee, but shall be
				allowed travel expenses, including per diem in lieu of subsistence, at rates
				authorized for employees of agencies under subchapter I of chapter 57 of title
				5, United States Code, while away from their homes or regular places of
				business in the performance of services for the Committee. Notwithstanding
				section 1342 of title 31, United States Code, the Secretary may accept the
				voluntary and uncompensated services of members of the Committee.</text>
								</paragraph><paragraph id="IDBAC2C5C0AAD2408E94A784B2175CDBC5"><enum>(2)</enum><header>Detail of
				government employees</header><text>Any Federal Government employee may be
				detailed to the Committee without reimbursement, and such detail shall be
				without interruption or loss of civil service status or privilege.</text>
								</paragraph><paragraph id="idD3780A795DD548CEB01A4AC6429814AF"><enum>(3)</enum><header>Administrative
				and support services</header><text>The Assistant Secretary shall provide
				administrative and support services to the Committee.</text>
								</paragraph><paragraph id="ID224BF59C89074FDFA9356D4C2171EA56"><enum>(4)</enum><header>Procurement of
				temporary and intermittent services</header><text>The Chairman of the Committee
				may procure temporary and intermittent services under section 3109(b) of title
				5, United States Code, at rates for individuals that do not exceed the daily
				equivalent of the annual rate of basic pay prescribed for level V of the
				Executive Schedule under section 5316 of such title.</text>
								</paragraph></subsection><subsection id="idAB28E6EC754A46A48B1750F827464A27"><enum>(h)</enum><header>Exemption from
				termination requirements</header><text>Section 14 of the Federal Advisory
				Committee Act shall not apply to the
				Committee.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idF6ECA2A25514480E9A33AAAE52C0836C"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text>Section 217 of the Older Americans Act of 1965,
			 as redesignated by subsection (a), is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id762527E95BAE4E48AA321A591D82C850" style="OLC">
					<subsection id="id049BBC4C5E6D4F3C922994F952877DD1"><enum>(d)</enum><header>Advisory
				Committee To Assess, Coordinate, and Improve Legal Assistance
				Activities</header><text>There is authorized to be appropriated to carry out
				section 216, $300,000 for fiscal year
				2012.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idE32657C4B662466E858B6702A4F66576"><enum>4.</enum><header>Improving the
			 State Long-Term Care Ombudsman programs</header>
			<subsection id="id9CAFDCD307954C699653A2871A07D5C3"><enum>(a)</enum><header>National
			 Ombudsman Resource Center</header><text display-inline="yes-display-inline">Section 202(a)(18)(B) of the Older
			 Americans Act of 1965 (42 U.S.C. 3012(a)(18)(B)) is amended by striking
			 <quote>make available</quote> and all that follows and inserting “reserve and
			 provide, for the funding of the National Ombudsman Resource Center (which may
			 include enabling the center to collaborate and participate with the Centers for
			 Medicare &amp; Medicaid Services in providing training for State survey
			 agencies with an agreement in effect under section 1864 of the Social Security
			 Act (42 U.S.C. 1395aa) or, in the case of States without such an agency, work
			 with the Administrator for the Centers for Medicare &amp; Medicaid Services to
			 improve the investigative processes used by the center to address complaints by
			 residents of long-term care facilities)—</text>

				oversight agency,</quote> so that release of residents' individually
				identifiable health information to the Ombudsman or representative is not
				precluded in cases in which the requirements of clause (i) or (ii) of paragraph
