		<official-title display="yes">To amend the Immigration and Nationality
		  Act to toll, during active-duty service abroad in the Armed Forces, the periods
		  of time to file a petition and appear for an interview to remove the
		  conditional basis for permanent resident status, and for other
		  purposes.</official-title>

		<section id="HFBD1A60697724DB78333A1691D91258A" section-type="section-one"><enum>1.</enum><header>Tolling periods of time to
			 file petition and have interview for removal of condition</header>
			<subsection id="H9231B439F4CD4CE3AB46987B77E7DC24"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 216 of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a</external-xref>) is amended—</text>
				<paragraph id="id7F408452D4434741837E7D5F94F22888"><enum>(1)</enum><text>by redesignating
			 subsection (g) as subsection (h); and</text>
				</paragraph><paragraph id="H5BFFDD7B890D439DA0FB45C8C17A10BF"><enum>(2)</enum><text>by inserting after
			 subsection (f) the following:</text>
					<quoted-block display-inline="no-display-inline" id="HE8B7D89F1D684917A097EC4441FE4998" style="OLC">
						<subsection id="H8D8C6445F9AC4D22BABCA023D987BA21"><enum>(g)</enum><header>Service in Armed
				Forces</header>
							<paragraph id="HBA1B4215076246569E2C64DEBD5D7120"><enum>(1)</enum><header>Filing
				petition</header><text>The 90-day period described in subsection (d)(2)(A)
				shall be tolled during any period in which the alien spouse or petitioning
				spouse is a member of the Armed Forces of the United States and serving abroad
				in an active-duty status in the Armed Forces. The petition under subsection
				(c)(1)(A) may be filed during such active-duty service at any time after the
				commencement of such 90-day period.</text>
							</paragraph><paragraph id="H56E7B4C2D71A47999AF1C38E26C60299"><enum>(2)</enum><header>Personal
				interview</header>
								<subparagraph id="id88D8EC40FA97417FAFA41D50DEA9E867"><enum>(A)</enum><header>In
				general</header><text>The 90-day period described in subsection (d)(3) shall be
				tolled during any period of time in which the alien spouse or petitioning
				spouse is a member of the Armed Forces of the United States and serving abroad
				in an active-duty status in the Armed Forces.</text>
								</subparagraph><subparagraph id="id22F4E589F49F4BD2ABE13D09646F5DE4"><enum>(B)</enum><header>Savings
				provision</header><text>Nothing in this paragraph may be construed to prohibit
				the Secretary of Homeland Security from waiving the requirement for an
				interview under subsection (c)(1)(B) pursuant to the Secretary’s authority
				under subsection
				(d)(3).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7F4FC57C6ED940F2BB22EF5615F29256"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 216 of the Immigration and Nationality Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C.
			 1186a</external-xref>) is amended—</text>
				<paragraph id="id3D015257F8D2463F95D409B4AAF8D65A"><enum>(1)</enum><text>by striking
			 <quote>Attorney General</quote> each place such term appears and inserting
			 <quote>Secretary of Homeland Security</quote>;</text>
				</paragraph><paragraph id="id27E970CE34F840638E15E7B65A2B1654"><enum>(2)</enum><text>in subsection
			 (a)(1)—</text>
					<subparagraph id="H2FDCA629F9274E8FB808ACB506EE04CF"><enum>(A)</enum><text>by striking
			 <quote>(as defined in subsection (g)(1))</quote>; and</text>
					</subparagraph><subparagraph id="H29382B6E5C7E4B2093C68C47442FFDBA"><enum>(B)</enum><text>by striking
			 <quote>(as defined in subsection (g)(2))</quote>;</text>
					</subparagraph></paragraph><paragraph id="HFDD21DD7DE094E46897D7BBA0CB69BCD"><enum>(3)</enum><text>in subsection
			 (c)(1)(B), by striking <quote>Service</quote> and inserting <quote>Department
			 of Homeland Security</quote>; and</text>
				</paragraph><paragraph id="id9B4030991FC849A6B6490C52A924469F"><enum>(4)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="id5EBDD916CE9E4D1D9670298B5E737B71"><enum>(A)</enum><text>in paragraph
			 (2)(A), by inserting <quote>and subsection (g)(1)</quote> after
			 <quote>subparagraph (B)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60A9D13B010D4C1BB31B07DDDB739429"><enum>(B)</enum><text>in paragraph
			 (3)—</text>
						<clause commented="no" display-inline="no-display-inline" id="idD727842B73E44A6E9AE695BBD21E34AF"><enum>(i)</enum><text>by striking
			 <quote>The interview</quote> and inserting <quote>Except as provided in
			 subsection (g)(2), the interview</quote>; and</text>
						</clause><clause id="H04CCCC1D671A4B3B988E4FA18D22500C"><enum>(ii)</enum><text>by
			 striking <quote>Service</quote> and inserting <quote>Department of Homeland
			 Security</quote>.</text>
						</clause></subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="H5D4D75C644D94370A43E3541487EFF03" section-type="subsequent-section"><enum>2.</enum><header>Compliance with
			 PAYGO</header><text display-inline="no-display-inline">The budgetary effects of
			 this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of
			 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the
			 <committee-name committee-id="SSBU00">Committee on the Budget of the
			 Senate</committee-name>, provided that such statement has been submitted prior
			 to the vote on passage.</text>
