			 Stat. 343), for the period beginning on October 1, 2011, and ending on March 4,
			 2012.</text>

			 general</header><text>Section 111 of the Surface Transportation Extension Act
			 of 2011, Part II (125 Stat. 343) is amended—</text>
						<paragraph id="ID5d05f097a8454d9fa887c17b85362e03"><enum>(1)</enum><text>by striking
			 <quote>for the period beginning on October 1, 2011, and ending on March 31,
			 2012,</quote> each place it appears and inserting <quote>for each of fiscal
			 years 2012 and 2013</quote>; and</text>

			 Project Delivery</header>
				<section commented="no" id="id162A24EB8294434C89E45D305E295B49"><enum>131.</enum><header>Project
			 delivery acceleration initiative</header>
					<subsection commented="no" id="id6CCAC932E08E486697A79CBB6EDFF241"><enum>(a)</enum><header>Declaration of
			 policy</header><text>Congress finds that—</text>
						<paragraph commented="no" id="idA1640550DCD945399F5F821FB83DADEA"><enum>(1)</enum><text>it is in the
			 national interest to enable the Secretary of Transportation (referred to in
			 this subtitle as <term>the Secretary</term>), State departments of
			 transportation, transit agencies, and all other recipients of Federal
			 transportation funds—</text>
							<subparagraph commented="no" id="id558DA38A07CF4735B8C9742527EA1CD4"><enum>(A)</enum><text>to accelerate
			 project delivery acceleration and reduce costs; and</text>
							</subparagraph><subparagraph commented="no" id="idA4B24074607C4C55B04D75D11F4F4547"><enum>(B)</enum><text>to ensure that
			 the planning, design, engineering, construction, and financing of
			 transportation projects is done in an efficient and effective manner
			 that—</text>
								<clause commented="no" id="idC3E75AD7FBEC461FB8B14F98D975197F"><enum>(i)</enum><text>promotes
			 accountability for public investments; and</text>
								</clause><clause commented="no" id="id4FC3D977E1F0460CB8A9BB52BFC5894B"><enum>(ii)</enum><text>encourages
			 greater private sector involvement in project financing and delivery;</text>
								</clause></subparagraph></paragraph><paragraph commented="no" id="id8AAB89EA589F4C7EAC941DE6F49CE271"><enum>(2)</enum><text>delay in the
			 delivery of transportation projects—</text>
							<subparagraph commented="no" id="id3689E7C5CBDB4ED48B3B417C152CC33B"><enum>(A)</enum><text>increases project
			 costs;</text>
							</subparagraph><subparagraph commented="no" id="idD415BB63FA4D4ED7A9FF623F4D5F594C"><enum>(B)</enum><text>harms the economy
			 of the United States; and</text>
							</subparagraph><subparagraph commented="no" id="idC508106AE0D546BCBFA4438B4C18F5FC"><enum>(C)</enum><text>impedes the
			 travel of the people of the United States; and</text>
							</subparagraph></paragraph><paragraph commented="no" id="idA43A73BDB2A8447F8B4A117C3AD26A49"><enum>(3)</enum><text>the Secretary
			 shall identify and promote the deployment of innovation aimed at reducing the
			 time and money it takes to deliver transportation projects while enhancing
			 safety and protecting the environment.</text>
						</paragraph></subsection><subsection commented="no" id="id1EF399525BAD4F4EB2B2A4130C68EDEE"><enum>(b)</enum><header>Establishment
			 of initiative</header>
						<paragraph commented="no" id="id0D2270537FA64541A770A6BF8BC0BB19"><enum>(1)</enum><header>In
			 general</header><text>To advance the policy identified in subsection (a), the
			 Secretary shall carry out a project delivery acceleration initiative in
			 accordance with this section.</text>
						</paragraph><paragraph commented="no" id="id512128A69D8A4FCD847F607DD356AD2A"><enum>(2)</enum><header>Purposes</header><text>The
			 purposes of the project delivery acceleration initiative shall be—</text>
							<subparagraph commented="no" id="idBC1CCE30F9A140D393B15C1D36E59E65"><enum>(A)</enum><text>to develop and
			 advance the use of best practices to accelerate project delivery and reduce
			 costs across all modes of transportation and expedite the deployment of
			 technology and innovation;</text>
							</subparagraph><subparagraph commented="no" id="id321ABC651A82479C9A87EC286BBBFFFD"><enum>(B)</enum><text>to implement
			 statutory provisions designed to accelerate project delivery; and</text>
							</subparagraph><subparagraph commented="no" id="id48AC2AB2625F4A71889895B26699B7FC"><enum>(C)</enum><text>to select
			 eligible projects for applying experimental features to test innovative project
			 delivery acceleration techniques.</text>
							</subparagraph></paragraph><paragraph commented="no" id="idB62EA33F4EC74C0186FCDC9FFF160F3C"><enum>(3)</enum><header>Advancing the
			 use of best practices</header>
							<subparagraph commented="no" id="idD986C9637134424B856B000AE54B6FA2"><enum>(A)</enum><header>In
			 general</header><text>In carrying out the initiative under this section, the
			 Secretary shall identify and advance best practices to reduce delivery time and
			 project costs, from planning to construction, for transportation projects and
			 programs of projects regardless of mode and project size.</text>
							</subparagraph><subparagraph commented="no" id="id5B365D0836F54753B618021696F11682"><enum>(B)</enum><header>Requirement</header><text>To
			 advance the use of best practices, the Secretary shall—</text>
								<clause commented="no" id="idBFF0768698FB4FD6896A514E027C2244"><enum>(i)</enum><text>engage
			 transportation stakeholders to gather information regarding opportunities for
			 accelerating project delivery and reducing costs;</text>
								</clause><clause commented="no" id="id80D845F4275C4B3AA20CC2386F112C7A"><enum>(ii)</enum><text>establish a
			 clearinghouse for the collection, documentation, and advancement of existing
			 and new innovative approaches and best practices;</text>
								</clause><clause commented="no" id="id560C43C0F0264C5AA5C7C76EB7CB6833"><enum>(iii)</enum><text>disseminate
			 information through a variety of means to transportation stakeholders on new
			 innovative approaches and best practices; and</text>
								</clause><clause commented="no" id="id51BFC6175E7B470EABD09DE340E6A2A8"><enum>(iv)</enum><text>provide
			 technical assistance to assist transportation stakeholders in the use of
			 existing flexibilities to resolve project delays and accelerate project
			 delivery, to the maximum extent practicable.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" id="id6CE1D72441504391A976646004C8BAA4"><enum>(4)</enum><header>Implementing
			 statutory provisions for accelerating project delivery</header><text>The
			 Secretary shall ensure that the provisions of this subtitle and the amendments
			 made by this subtitle intended to accelerate project delivery are fully
			 implemented, including by—</text>
							<subparagraph commented="no" id="idD4546BA4AD0840DDBC710DE5F953F548"><enum>(A)</enum><text>compressing the
			 process for drafting environmental impact statements under the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.);</text>
							</subparagraph><subparagraph commented="no" id="id8F83DB4B1A81487EA820E848A2D1BDEC"><enum>(B)</enum><text>establishing
			 mandatory timeframes for permitting and approval decisions of other Federal
			 agencies;</text>
							</subparagraph><subparagraph commented="no" id="id5FB7FAA2CD0640008B91CBD53AAD9BE9"><enum>(C)</enum><text>integrating
			 transportation planning and environmental review of transportation
			 projects;</text>
							</subparagraph><subparagraph commented="no" id="idD5E61E04E63D4DC487F0B55F328EEE36"><enum>(D)</enum><text>expanding
			 eligibility of early acquisition of property prior to completion of
			 environmental review under the <act-name parsable-cite="NEPA69">National
			 Environmental Policy Act of 1969</act-name> (42 U.S.C. 4321 et seq.);</text>
							</subparagraph><subparagraph commented="no" id="id24F1074868794FAE90462C2F4369A42B"><enum>(E)</enum><text>allowing the use
			 of the construction manager or general contractor method of contracting in the
			 Federal-aid highway program;</text>
							</subparagraph><subparagraph commented="no" id="id2B8E55DED36C46AC834B116B8F5A0CFB"><enum>(F)</enum><text>establishing a
			 demonstration program to streamline the relocation process by permitting a
			 lump-sum payment for acquisition and relocation if elected by the displaced
			 occupant; and</text>
							</subparagraph><subparagraph commented="no" id="id69CD555384784FF68BA23B116EDFD08E"><enum>(G)</enum><text>establishing a
			 pilot program to provide direct Federal-aid highway funding to local
			 governments.</text>
							</subparagraph></paragraph><paragraph commented="no" id="id21414402DF3A499889F01AB234ED7EB3"><enum>(5)</enum><header>Advancing
			 innovative project delivery</header><text>In order to accelerate project
			 delivery and reduce costs for transportation projects across all modes and
			 regardless of project size, to the maximum extent practicable, the Secretary
			 shall use the authority under section 304 of title 49, United States Code (as
			 amended by section 133(a)).</text>
						</paragraph></subsection></section><section commented="no" id="id58EE7113629D4C57AE504D1E8E9AD911"><enum>132.</enum><header>Efficiencies
			 in contracting</header>
					<subsection commented="no" id="id4056EF468836483D9F0F10164EBC3F8A"><enum>(a)</enum><header>Authority</header><text>Section
			 112(b) of title 23, United States Code, is amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="idC6E8780538894CB2989510CE96053FFF" style="OLC">
							<paragraph commented="no" id="idA8D0CC21E4F24155ABA6F44CCFA38DBF"><enum>(4)</enum><header>Construction
				manager; general contractor</header>
								<subparagraph commented="no" id="id9CE4AC32388F49A8910F5323577568F2"><enum>(A)</enum><header>2-phases
				contract</header>
									<clause commented="no" id="idA90E4854D74046658EAC7553DCAE178E"><enum>(i)</enum><header>In
				general</header><text>A contracting agency may award a 2-phase contract to a
				construction manager or general contractor for pre-construction and
				construction services.</text>
									</clause><clause commented="no" id="idAADF585105C149B8AB618C6F1772BDBB"><enum>(ii)</enum><header>Pre-construction
				phase</header><text>In the pre-construction phase, the construction manager
				shall provide the contracting agency with advice for scheduling, work
				sequencing, cost engineering, constructability, cost estimating, and risk
				identification.</text>
									</clause><clause commented="no" id="id455BEFB65B644AE4A40B54674080C221"><enum>(iii)</enum><header>Price</header><text>Prior
				to the start of the second phase, the owner and the construction manager may
				agree to a price for the construction of the project or a portion of the
				project.</text>
									</clause><clause commented="no" id="idA941F805B90D43C891E5B0BF0374D9F3"><enum>(iv)</enum><header>General
				contractor</header><text>If an agreement is reached under clause (iii), the
				construction manager shall be considered the general contractor for the
				construction of the project at the negotiated schedule and price.</text>
									</clause></subparagraph><subparagraph commented="no" id="idE9EEE1D7484643E0945C486EA3F6E1F2"><enum>(B)</enum><header>Selection</header><text>A
				contract shall be awarded to a construction manager or general contractor using
				a competitive selection process under which the contract is awarded on the
				basis of qualifications, experience, best value, or any other combination of
				factors considered appropriate by the contracting agency.</text>
								</subparagraph><subparagraph commented="no" id="id886C4BAFADBF44F89AA89B0185B203F5"><enum>(C)</enum><header>Timing</header>
									<clause commented="no" id="id323136115D6F48898052AD0A1285DA0B"><enum>(i)</enum><header>In
				general</header><text>Prior to the completion of the process required under
				section 102 of the National Environmental Policy Act of 1969 (42 U.S.C. 4332),
				a contracting agency may—</text>
										<subclause commented="no" id="idAB92712F43334E8AA7B7801A21180D26"><enum>(I)</enum><text>issue requests
				for proposals;</text>
										</subclause><subclause commented="no" id="idB9EFA74DDE0E42F0A377A352214650C9"><enum>(II)</enum><text>proceed with the
				award of the first phase of construction manager or general contractor
				contract; and</text>
										</subclause><subclause commented="no" id="idC37D17449E2C44509F78A061DE9DB5AB"><enum>(III)</enum><text>issue notices
				to proceed with preliminary design.</text>
										</subclause></clause><clause commented="no" id="idE66ED4FCE1114563953D387301FBFD68"><enum>(ii)</enum><header>Compliance
				with other law</header><text>If the first phase of a construction manager or
				general contractor contract focuses primarily on 1 alternative, the Secretary
				shall require that the contract include appropriate provisions to
				ensure—</text>
										<subclause commented="no" id="idF0BC3C3B4F9F4D36A2DD04388C61283E"><enum>(I)</enum><text>that the
				objectives of section 102 of the National Environmental Policy Act of 1969 (42
				U.S.C. 4332) are achieved; and</text>
										</subclause><subclause commented="no" id="id4F7D9BFD093248DDB867EC74275BED33"><enum>(II)</enum><text>compliance with
				other applicable Federal laws and regulations occurs.</text>
										</subclause></clause><clause commented="no" id="idA11C428774EB4D82A34E17E948AE5A02"><enum>(iii)</enum><header>Requirement</header><text>A
				contracting agency shall not proceed with the award of the second phase, and
				shall not proceed, or permit any consultant or contractor to proceed, with
				final design or construction until completion of the process required under
				section 102 of the National Environmental Policy Act of 1969 (42 U.S.C.
				4332).</text>
									</clause></subparagraph><subparagraph commented="no" id="id4FE31B677B704965B241008E640DC3E2"><enum>(D)</enum><header>Applicability</header><text>This
				paragraph shall not apply to any project funded under chapter 53 of title
				49.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" id="idA63B52D464F44A62844F71B284EE2347"><enum>(b)</enum><header>Regulations</header><text>The
			 Secretary shall promulgate such regulations as are necessary to carry out the
			 amendments made by this section.</text>
					</subsection><subsection commented="no" id="id6E1076B192F4485A87141525E8179033"><enum>(c)</enum><header>Effect on
			 experimental program</header><text>Nothing in this section or the amendments
			 made by this section affects the authority to carry out, or any project carried
			 out under, any experimental program concerning construction manager risk that
			 is being carried out by the Secretary as of the date of enactment of this
			 Act.</text>
					</subsection></section><section commented="no" id="idCD55FF90EC1F4AA49E7462C819B56777"><enum>133.</enum><header>Application of
			 categorical exclusions for multimodal projects</header>
					<subsection commented="no" id="idB69E36E8D4F7420893BD51FBBBF65C0F"><enum>(a)</enum><header>In

				term <term>project</term> has the meaning given the term in section 139 of

				transportation department</header><text>The term <term>State transportation
				department</term> has the meaning given the term in section 139 of title

				authority provided in this section may be exercised for any multimodal project,
				class of projects, or program of projects that is carried out under this
				title.</text>
								</subsection><subsection commented="no" id="id403DF5C129AC4B10AEA70FA30C7EC4CD"><enum>(c)</enum><header>Application of
				categorical exclusions for multimodal projects</header>
									<paragraph commented="no" id="idEE3715EBCD5D4E89A634CD9FADF1514A"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), in considering the
				environmental impacts of a proposed multimodal project, a lead agency may apply
				1 or more categorical exclusions under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (42
				U.S.C. 4321 et seq.) to other components of the project carried out by a
				participating agency or State transportation department if the lead agency
				determines that—</text>
										<subparagraph commented="no" id="idEF28BB0E0BBD47D6ACF2BA307C604AE7"><enum>(A)</enum><text>based on
				regulations or procedures of the lead agency for determining categorical
				exclusions, the components of the project that fall under the modal expertise
				of the lead agency satisfy the conditions for 1 or more categorical exclusions
				under <act-name parsable-cite="NEPA69">the National Environmental Policy Act of
				1969</act-name> (42 U.S.C. 4321 et seq.); and</text>
										</subparagraph><subparagraph commented="no" id="id988F7597525B40399CB98D06F8BBB1A4"><enum>(B)</enum><text>the project does
				not require the preparation of an environmental impact statement.</text>
										</subparagraph></paragraph><paragraph commented="no" id="id8209D3474F7049B49951074A955D8B26"><enum>(2)</enum><header>Exclusions</header><text>Paragraph
				(1) shall only apply if—</text>
										<subparagraph commented="no" id="idC545EC61EED447328B97A07919B4F7D7"><enum>(A)</enum><text>the multimodal
				project is funded under a grant agreement administered by the lead
				agency;</text>
										</subparagraph><subparagraph commented="no" id="idEF274EE2317E4D6AB327650163DAA587"><enum>(B)</enum><text>the multimodal
				project has components that require the expertise of a participating agency to
				assess the environmental impacts of the components of the project;</text>
										</subparagraph><subparagraph commented="no" id="id4D4CED9FC3694E039F11CD6CF0397657"><enum>(C)</enum><text>each component of
				the project has independent utility;</text>
										</subparagraph><subparagraph commented="no" id="id7CA216CDA3DF4692B886A7C8F302CD14"><enum>(D)</enum><text>the participating
				agency, in consultation with the lead agency, determines that, based on
				regulations or procedures of the participating agency for determining
				categorical exclusions, 1 or more categorical exclusions under the
				<act-name parsable-cite="NEPA69">National Environmental Policy Act of
				1969</act-name> (42 U.S.C. 4321 et seq.) applies to the components of the
				project under the modal expertise of the participating agency; and</text>
										</subparagraph><subparagraph commented="no" id="id997473B9BBF4443EAF94E10ED2542B5D"><enum>(E)</enum><text>the lead agency
				determines that—</text>
											<clause commented="no" id="id538163D1953F414E95E1048CEEE5FBDC"><enum>(i)</enum><text>the project does
				not individually or cumulatively have a significant impact on the environment;
				and</text>
											</clause><clause commented="no" id="id3A3D0F973BDB41BF9721ED7C2141A9CE"><enum>(ii)</enum><text>extraordinary
				circumstances do not exist.</text>
											</clause></subparagraph></paragraph></subsection><subsection commented="no" id="id15480E5D3CD043749E702CD2FF7E5219"><enum>(d)</enum><header>Modal
				cooperation</header>
									<paragraph commented="no" id="idD894313CF7E749BE813F7E7CB3F1124A"><enum>(1)</enum><header>In
				general</header><text>At the request of the lead agency, a participating agency
				shall provide modal expertise to a lead agency on any aspect of the project in
				which the participating agency has expertise.</text>
									</paragraph><paragraph commented="no" id="id01C20040BC8E41B9B4CA91E8CA48ADA0"><enum>(2)</enum><header>Applicability</header><text>A
				determination of a participating agency that 1 or more categorical exclusions
				under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.)
				applies to an aspect of a multimodal project shall only apply to the larger
				multimodal project if, based on regulations or procedures of the participating
				agency for determining categorical exclusions, the participating agency
				determines that 1 or more categorical exclusions apply to the applicable aspect
				of a multimodal

				product</header><text>The term <term>planning product</term> means any
				decision, analysis, study, or other documented result of an evaluation or
				decisionmaking process that is carried out during transportation
				planning.</text>
									</paragraph><paragraph commented="no" id="idD5DB851AD82D4BD78549033FAE6580AB"><enum>(4)</enum><header>Project</header><text>The
				term <term>project</term> has the meaning given the term in section 139.</text>
									</paragraph><paragraph commented="no" id="idA1090A6ADEAB418FBC368F05FB0C2763"><enum>(5)</enum><header>Project
				sponsor</header><text>The term <term>project sponsor</term> has the meaning
				given the term in section 139.</text>
									</paragraph></subsection><subsection commented="no" id="idF36EA0BB18264DABAE337972E33ADDA2"><enum>(b)</enum><header>Purpose and
				intent</header><text>The purpose of this section is to establish the authority,
				and provide procedures, for achieving integrated planning and environmental
				review processes—</text>
									<paragraph commented="no" id="id92E5B4B1B3B74DE0B08D75D8EB0EDFEE"><enum>(1)</enum><text>to enable
				statewide and metropolitan planning processes to more effectively serve as the
				foundation for highway and transit project decisions;</text>
									</paragraph><paragraph commented="no" id="id71E86DF205F84AFEA7DA680411ABC547"><enum>(2)</enum><text>to foster better
				decisionmaking;</text>
									</paragraph><paragraph commented="no" id="idB71ECB6B277249C0B96E0CA37CF7B328"><enum>(3)</enum><text>to reduce
				duplicative work;</text>
									</paragraph><paragraph commented="no" id="id93AA0436F8A744EB894D455208A91261"><enum>(4)</enum><text>to avoid delays
				in carrying out transportation improvements; and</text>
									</paragraph><paragraph commented="no" id="id6C7466198FED4E4F9C1C1A8A102D456E"><enum>(5)</enum><text>to improve
				transportation and maintain environmental protections for communities and the
				United States.</text>
									</paragraph></subsection><subsection commented="no" id="id2A3451470C144B46B37A178DBACFF748"><enum>(c)</enum><header>Adoption of
				planning products for use in the environmental review process</header>
									<paragraph commented="no" id="id0AA7D1FD1F71453AAD66F16CAEFA977F"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (3) and notwithstanding any other
				provision of law, the Secretary of Transportation, in consultation with 1 or
				more lead agencies or project sponsors, may adopt and use any planning product,
				in whole or in part, in the environmental review process of a transportation
				project or program.</text>
									</paragraph><paragraph commented="no" id="id1D4EB982B99F4BBCB21CF1C1607EE050"><enum>(2)</enum><header>Applicability</header>
										<subparagraph commented="no" id="idF3DF7D79A63346F1A16F0E47AA0EE78D"><enum>(A)</enum><header>In
				general</header><text>Planning decisions that may be adopted pursuant to this
				section include—</text>
											<clause commented="no" id="idB5AC39A430AD4FDE9DECF077A8946221"><enum>(i)</enum><text>a purpose and
				goal for the proposed action, including whether tolling, private financial
				assistance, or other special financial measures are necessary to implement the
				proposed action;</text>
											</clause><clause commented="no" id="id8EDF53A3FE2F42178E1753C119FEC0AF"><enum>(ii)</enum><text>the location of
				the travel corridor;</text>
											</clause><clause commented="no" id="idD755BDE45ADB4C9FB818A1DF8C73F894"><enum>(iii)</enum><text>the modal
				choice, including whether to implement corridor or subarea study
				recommendations to advance different modal solutions as separate projects with
				independent utility;</text>
											</clause><clause commented="no" id="id68415C6BA7EA430B8D720A2F46845737"><enum>(iv)</enum><text>the elimination
				of unreasonable alternatives and the selection of a range of reasonable
				alternatives for detailed study during the environmental review process;</text>
											</clause><clause commented="no" id="id8F3F9B0D1F1C49D097204E47B6181823"><enum>(v)</enum><text>a basic
				description of the environmental setting;</text>
											</clause><clause commented="no" id="id9809B40937A849CB9704022E1D43A630"><enum>(vi)</enum><text>the methodology
				to be used in the analysis; and</text>
											</clause><clause commented="no" id="id1EBE40B19BA24107A8A672731D55C337"><enum>(vii)</enum><text>the
				identification of programmatic level mitigation for potential impacts that the
				Secretary of Transportation, in conjunction with other applicable agencies,
				determines are most effectively addressed at a regional or national program
				level, including—</text>
												<subclause commented="no" id="id944CCA6578BA4A95AAE6C67178B3A36E"><enum>(I)</enum><text>system-level
				measures to avoid, minimize, or mitigate impacts of proposed transportation
				investments on environmental resources;</text>
												</subclause><subclause commented="no" id="id87932945277945E9804AEC8306F8BE9F"><enum>(II)</enum><text>regional
				ecosystem needs and opportunities; and</text>
												</subclause><subclause commented="no" id="idF4DFB65B216D4FFCA38DCA85D6DE754A"><enum>(III)</enum><text>potential
				mitigation activities, locations, and investments.</text>
												</subclause></clause></subparagraph><subparagraph commented="no" id="idF534B6A47C254D87B8B45037384BC4C6"><enum>(B)</enum><header>Planning
				analyses</header><text>Examples of planning analyses that may be adopted under
				this section include studies of past, current, or predicted future—</text>
											<clause commented="no" id="id577FC801D3C941B1B64E38680ED193CB"><enum>(i)</enum><text>travel
				demands;</text>
											</clause><clause commented="no" id="idCAB73CF3D42942B59E35E4572BE3615D"><enum>(ii)</enum><text>regional
				development and growth levels;</text>
											</clause><clause commented="no" id="idD1F34128CDFC48BE872954116AF2FC93"><enum>(iii)</enum><text>local land use,
				growth management, and development patterns;</text>
											</clause><clause commented="no" id="idF035FEA8A126460E826773A09C79D380"><enum>(iv)</enum><text>population and
				employment levels;</text>
											</clause><clause commented="no" id="id3E9C4D979DD64BAA91687FA13C53DA49"><enum>(v)</enum><text>natural and human
				environmental conditions;</text>
											</clause><clause commented="no" id="id935B54C1BB354724B9B95EAE075ACC60"><enum>(vi)</enum><text>environmental
				resources and environmentally sensitive areas;</text>
											</clause><clause commented="no" id="idF8D087A636404597BC273950C8B1C06F"><enum>(vii)</enum><text>potential
				environmental effects, including the identification of resources of concern and
				potential cumulative effects on those resources, as a result of a statewide or
				regional cumulative effects assessment;</text>
											</clause><clause commented="no" id="id2F8D74A13F8E43ED9A167948D0A48261"><enum>(viii)</enum><text>mitigation
				needs for a proposed action or for programmatic level mitigation for potential
				effects that the Secretary of Transportation determines are most effectively
				addressed at a regional or national program level; and</text>
											</clause><clause commented="no" id="idAAE0B0484FC24D8784FC234F249670E8"><enum>(ix)</enum><text>safety
				measures.</text>
											</clause></subparagraph></paragraph><paragraph commented="no" id="id3B7D5A815DCD450E967548CA09722586"><enum>(3)</enum><header>Conditions</header><text>The
				adoption and use of a planning product under this section shall be subject to a
				determination by the Secretary of Transportation, in consultation with
				appropriate lead agencies and project sponsors, that—</text>
										<subparagraph commented="no" id="id33CAD3A77AC84954B069190C0C469583"><enum>(A)</enum><text>the planning
				product has been developed through a planning process carried out pursuant to
				applicable Federal law (including regulations);</text>
										</subparagraph><subparagraph commented="no" id="id0F35F56301CB4CC6918A2C05B70ABF2A"><enum>(B)</enum><text>the planning
				process includes broad multidisciplinary consideration of systems-level or
				corridor-wide transportation needs and an analysis of potential effects;</text>
										</subparagraph><subparagraph commented="no" id="id7B2B103E6C8442AE8639BD39C73B429F"><enum>(C)</enum><text>during the
				planning process—</text>
											<clause commented="no" id="idA6071AEA60834049BE0D85DF0E33CCA9"><enum>(i)</enum><text>notice of the
				proposed planning product and planning process has been provided through
				publication or other means to—</text>
												<subclause commented="no" id="id491F5CE977AB4240BA53D5DA38511D99"><enum>(I)</enum><text>each Federal,
				State, local, and tribal government that may have an interest in the proposed
				project or program; and</text>
												</subclause><subclause commented="no" id="id86D409B93DC54C2B9A04BEF1E4D413AE"><enum>(II)</enum><text>members of the
				general public; and</text>
												</subclause></clause><clause commented="no" id="idCAD9EC196CBD4680AC9C60A5D47B045F"><enum>(ii)</enum><text>the entities
				described in clause (i)(I) have been provided an opportunity to participate in
				the planning process;</text>
											</clause></subparagraph><subparagraph commented="no" id="idE654EFC5A21347AFA9EC727E66C910D9"><enum>(D)</enum><text>prior to
				determining the scope of the environmental review process, each lead agency has
				made documentation relating to the planning product available to the entities
				described in subparagraph (C)(i)(I);</text>
										</subparagraph><subparagraph commented="no" id="id7B18DC3C6A3D4FEBA46605E239D41D29"><enum>(E)</enum><text>no significant
				new information or new circumstance exists that has a reasonable likelihood of
				affecting the continued validity of the planning product;</text>
										</subparagraph><subparagraph commented="no" id="id5B521892CB554BA784C42FA11F7C1368"><enum>(F)</enum><text>the planning
				product—</text>
											<clause commented="no" id="idD1AB155EF21543A791B28886739B7045"><enum>(i)</enum><text>has a rational
				basis;</text>
											</clause><clause commented="no" id="id1C0646362A7E4284A5E9A43D65DBE11D"><enum>(ii)</enum><text>is based on
				reliable and reasonably current data; and</text>
											</clause><clause commented="no" id="idA917D9D3553447C19562C71FE0137FE1"><enum>(iii)</enum><text>in the case of
				an analysis, is based on reasonable and scientifically acceptable
				methodologies;</text>
											</clause></subparagraph><subparagraph commented="no" id="id7DEBE37B826B464CB8F2D386024E2897"><enum>(G)</enum><text>the planning
				product is documented in sufficient detail to support the decision or results
				of the analysis and to meet any requirements for use of the information in the
				environmental review process; and</text>
										</subparagraph><subparagraph commented="no" id="id124FB47189684AE99F7536319CADEBE5"><enum>(H)</enum><text>the planning
				product is appropriate for adoption and use in the environmental review process
				for the project or program.</text>
										</subparagraph></paragraph><paragraph commented="no" id="id081B9B6BFC4C45D28809FC8F77220F71"><enum>(4)</enum><header>Effect of
				adoption</header>
										<subparagraph commented="no" id="id026649C0DF6445B5A86ABC255A996B04"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other law, any planning product
				adopted by the Secretary of Transportation under this section shall not be
				reconsidered or subject to additional interagency consultation while the
				environmental review process for a project or program is being carried out
				unless the Secretary of Transportation, in consultation with applicable lead
				agencies and project sponsors, determines that there is significant new
				information or new circumstances that affect the continued validity or
				appropriateness of the adopted planning product.</text>
										</subparagraph><subparagraph commented="no" id="id2DC0272A636140408E78E59B71814B11"><enum>(B)</enum><header>Transferability</header><text>A
				planning product adopted by the Secretary of Transportation under this section
				may be relied on and used by other Federal agencies in carrying out an
				environmental review of a project or program.</text>
										</subparagraph></paragraph></subsection><subsection commented="no" id="idF9A57EA350904247A244E9CBB9D08048"><enum>(d)</enum><header>Administration</header>
									<paragraph commented="no" id="id267F140A722E477FB1E47CBB10ABBF1B"><enum>(1)</enum><header>In
				general</header><text>The authority granted under this section shall be broadly
				construed and may be applied to any project, class of projects, or program
				carried out under this title.</text>
									</paragraph><paragraph commented="no" id="idBF161883F27D4BF4AE9609A50D63ECDA"><enum>(2)</enum><header>Applicability</header>
										<subparagraph commented="no" id="idFEA723AE121A4434B7D7A0F5FAEB7836"><enum>(A)</enum><header>In
				general</header><text>The <act-name parsable-cite="NEPA69">environmental review
				process under the National Environmental Policy Act of 1969</act-name> (42
				U.S.C. 4321 et seq.) shall not apply to any transportation planning process
				carried out under this title.</text>
										</subparagraph><subparagraph commented="no" id="id837ECED7FCF64EC388ADCE0A9E80B3EF"><enum>(B)</enum><header>Scope</header><text>If
				an environmental review process is commenced as a part of, or concurrently
				with, a transportation planning activity under this title, the project shall
				remain exempt from the applicable provisions of the
				<act-name parsable-cite="NEPA69">National Environmental Policy Act of
				1969</act-name> (42 U.S.C. 4321 et
				seq.).</text>
										</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" id="idBB8313B8F8364738B3EE866BECEB9DF1"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis for chapter 1 of title 23, United States
			 Code, is amended by adding at the end the following:</text>

				meeting convened under this subsection at the request of a Federal agency of
				jurisdiction, the project sponsor, or the Governor shall be held not later than
				14 days after the date of receipt of the request unless the lead agency
				determines there is just cause to extend the time period for a meeting.</text>
									</clause></subparagraph><subparagraph commented="no" id="ID3e4c618eae654fc9824dfc17df2bc34b"><enum>(B)</enum><header>Elevation if
				resolution is not achieved</header>
									<clause commented="no" id="idF6F5782E4AC94498A09CE3C8934CA069"><enum>(i)</enum><header>In
				general</header><text>If a resolution is not achieved by the date that is 30
				days after the later of the date of a meeting described in subparagraph (A) and
				the date of a determination by the lead agency that all information necessary
				to resolve the issue has been obtained, the Secretary—</text>
										<subclause commented="no" id="idD25E0972121F4596B84717C033F57420"><enum>(I)</enum><text>may convene an
				issue resolution meeting of the lead agency, the heads of the relevant
				participating agencies, the project sponsor, and the Governor (if the initial
				issue resolution meeting is requested by the Governor) to resolve the issues;
				and</text>
										</subclause><subclause commented="no" id="id5C898557A9B343B7AE3C46556FEA91B9"><enum>(II)</enum><text>in the case of a
				Federal agency of jurisdiction that has not made a decision within the time
				period described in subsection (h)(3)(A), shall convene an issue resolution
				meeting to resolve the issues.</text>
										</subclause></clause><clause commented="no" id="id69C1FC9E92304F43992523DD4C7DFA53"><enum>(ii)</enum><header>Timing</header><text>A
				meeting convened by the Secretary under this subparagraph shall be held not
				later than 30 days after the end of the 30-day period described in clause (i)
				for resolution of issues following the date of a meeting described in
				subparagraph (A).</text>
									</clause><clause commented="no" id="id2FC8B1B7A0AE479C8FC3AC89BF2F51E9"><enum>(iii)</enum><header>Notification</header><text>The
				Secretary shall notify the Committee on Environment and Public Works of the
				Senate, the Committee on Transportation and Infrastructure of the House of
				Representatives, and the Council on Environmental Quality that a meeting is to
				be convened under this paragraph.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" id="ID58331b70c48e40b8973e783aaabf2c7a"><enum>(5)</enum><header>Deadlines for
				decisions under other laws</header><text>Notwithstanding any other provision of
				law (including a regulation)—</text>
								<subparagraph commented="no" id="ID74752e97226945ae953454ba58cd8d3b"><enum>(A)</enum><text>subject to
				subparagraph (B), a decision relating to a transportation project under any
				Federal law (including a regulation and any issuance or denial of a permit,
				license, or other approval) shall be made by the Federal agency of jurisdiction
				by the later of—</text>
									<clause commented="no" id="idC361F47351EE4A0E9B7546936E5617EB"><enum>(i)</enum><text>the date that is
				180 days after the date on which the Federal lead agency issues a decision on
				the project under the National Environmental Policy Act of 1969 (42 U.S.C. 4321
				et seq.) and (if applicable) section 138 of this title; and</text>
									</clause><clause commented="no" id="idB0A8E49B49B04817A4B2735A8B2368DC"><enum>(ii)</enum><text>the date that is
				180 days after the date on which an application is submitted for the permit,
				license, or approval;</text>
									</clause></subparagraph><subparagraph commented="no" id="idB255253C502E4599BCCE71F57FD3818B"><enum>(B)</enum><text>the Secretary may
				extend the time for a decision under subparagraph (A) for just cause;</text>
								</subparagraph><subparagraph commented="no" id="IDeb1b2efa4c9643ffaf89b8f9cef0df28"><enum>(C)</enum><text>the application
				for a project permit, license, or other approval shall be approved by operation
				of law without further action by the Federal agency of jurisdiction if—</text>
									<clause commented="no" id="ID892ec76b4a9a4fe0b063b62186cdee7b"><enum>(i)</enum><text>within the time
				for a decision under subparagraph (A), the Federal agency of jurisdiction has
				not issued a final decision or obtained concurrence to delay decision by the
				project sponsor; or</text>
									</clause><clause commented="no" id="ID7cd94c19d7aa472988b647156f47a8b0"><enum>(ii)</enum><text>the Federal
				agency has not issued a final decision within 30 days, or such longer time as
				the Secretary may establish for just cause, after the conclusion of a meeting
				convened by the Secretary pursuant to paragraph (4)(B);</text>
									</clause></subparagraph><subparagraph commented="no" id="ID93f0402830094dad8f280800fd502de1"><enum>(D)</enum><text>a permit,
				license, or other approval approved pursuant to this subsection shall not be
				subject to judicial review; and</text>
								</subparagraph><subparagraph commented="no" id="id66CDAD229B33416FBB66131469D5E7A4"><enum>(E)</enum><text>the Secretary may
				issue a written finding verifying the approval of an application, as submitted
				to the Federal agency of jurisdiction, in accordance with this
				subsection.</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" id="ID65193a1434e941c58adabafd3deeacbe"><enum>(8)</enum><text>by inserting
			 after subsection (i) (as so redesignated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id43706A39E50842A6AE7DCCAF929C7A5A" style="OLC">
							<subsection commented="no" id="ID71efd53fcea84188968c0cea315c3d47"><enum>(j)</enum><header>Consolidated
				statements and decisions</header>
								<paragraph commented="no" id="ID8bcc2e6167bc40989883bd6d5335cf90"><enum>(1)</enum><header>In
				general</header><text>In the event that a preferred alternative is identified
				in the draft environmental impact statement, and notwithstanding any other
				provision of law or regulation, the Secretary must, to the maximum extent
				practicable combine a final environmental impact statement and a record of
				decision into a single document following any public hearings required by
				section 128 of this title as long as, at least 30 days prior to the issuance of
				the combined final environmental impact statement and record of decision, the
				lead agency gives notice to the agencies participating in the environmental
				review process and the public of the proposed decision of the lead
				agency.</text>
								</paragraph><paragraph commented="no" id="ID019eb8435e784c5db908b79886d0c181"><enum>(2)</enum><header>Notice
				content</header><text>The notice described in paragraph (1) shall
				include—</text>
									<subparagraph commented="no" id="id0A1AF0EA9B5D49BD8CE68E832F32072A"><enum>(A)</enum><text>a brief summary
				description of the proposed decision, including the anticipated selected
				alternative and any mitigation commitments that will be required under the
				decision; and</text>
									</subparagraph><subparagraph commented="no" id="idD080CADF0B0E45508ED9A0A674A1E186"><enum>(B)</enum><text>a deadline of not
				less than 30 days after the date on which the participating agency receives the
				notice for any predecisional referral under part 1504 of title 40, Code of
				Federal Regulations (or successor regulations).</text>
									</subparagraph></paragraph><paragraph commented="no" id="ID89d8db0458a4409191a30c9e6f116f5c"><enum>(3)</enum><header>Manner of
				notice</header>
									<subparagraph commented="no" id="id998A8CA42CEC46F18E1FD897B4D7DCCA"><enum>(A)</enum><header>In
				general</header><text>The lead agency may give the required notice to agencies
				by mail, e-mail, fax, or other commercially acceptable means that permit
				confirmation of delivery.</text>
									</subparagraph><subparagraph commented="no" id="idBF3CD09622AD40D68B719903402530B0"><enum>(B)</enum><header>Public
				notice</header><text>The lead agency may give the required public notice by
				means of publication of the notice in a newspaper of statewide circulation, in
				the Federal Register, or by posting the notice on the website of the
				project.</text>

			 acquisition of real property in anticipation of a federally assisted or
			 federally approved surface transportation project that may use the real
			 property is not prohibited prior to the date on which the environmental review
			 process under the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et
			 seq.) for the surface transportation project is completed, subject to the
			 conditions that the acquisition does not have an adverse environmental effect

			 acquisition of real property interests for highways</header><text>Section 108

										</subparagraph><subparagraph commented="no" id="id7FA67BA80A3145498F558899964DD06B"><enum>(B)</enum><header>Conditions</header><text>An
				acquisition described in subparagraph (A) may be authorized by project
				agreement and shall be eligible for Federal-aid reimbursement as a project
				expense if the Secretary finds that the acquisition—</text>
											<clause commented="no" id="ID57f3e373569a4358b6dfabe033672649"><enum>(i)</enum><text>does not cause
				any significant adverse environmental impact;</text>
											</clause><clause commented="no" id="ID4c1a13e266c04d60b7fa672c4574e9d5"><enum>(ii)</enum><text>does not limit
				the choice of reasonable alternatives for the project or otherwise influence
				the decision of the Secretary on any approval required for the project;</text>
											</clause><clause commented="no" id="ID39e9c7f793ef4aa5ba484e3f3717c7f5"><enum>(iii)</enum><text>is consistent
				with the State transportation planning process under section 135;</text>
											</clause><clause commented="no" id="IDc58f1567406f47b4a5b0527481cdb5e7"><enum>(iv)</enum><text>complies with
				other applicable Federal laws (including regulations);</text>
											</clause><clause commented="no" id="IDfd53f4467a75464f88b61aa2382844c1"><enum>(v)</enum><text>is carried out
				through negotiation, without the threat of condemnation; and</text>
											</clause><clause commented="no" id="ID9d42af89c31046048f38aa9a4ac21b07"><enum>(vi)</enum><text>together with
				any relocation assistance provided, complies with—</text>
												<subclause commented="no" id="idA0839F37CDF74492BD9C83045EA08A89"><enum>(I)</enum><text>the Uniform
				Relocation Assistance and Real Property Acquisition Policies Act of 1970 (42
				U.S.C. 4601 et seq.); and</text>
												</subclause><subclause commented="no" id="id2E4E412542C640149F0D390E5AF6FEC1"><enum>(II)</enum><text>title VI of the
				Civil Rights Act of 1964 (42 U.S.C. 2000d et seq.).</text>
												</subclause></clause></subparagraph><subparagraph commented="no" id="ID90e7429382ae4e70af0d2b5f1c8224b7"><enum>(C)</enum><header>Development</header><text>Real
				property acquired under this subsection may not be developed in anticipation of
				the project until the date on which all required environmental reviews for the
				project have been completed.</text>
										</subparagraph><subparagraph commented="no" id="ID8f39b3f92afb4951909e1d7328b26d63"><enum>(D)</enum><header>Reimbursement</header><text>If
				Federal-aid reimbursement is made for early acquired real property under this
				subsection and the property is not incorporated into a project eligible for
				surface transportation funds in the time period described in subsection (a)(2),
				the Secretary shall offset the amount so reimbursed against funds apportioned
				to the State.</text>
										</subparagraph><subparagraph commented="no" id="ID081a54fdc256462cb7085983688e914d"><enum>(E)</enum><header>Other
				conditions</header><text>The Secretary may establish such other conditions or
				restrictions on the acquisition of real property under this section as the
				Secretary determines to be
				necessary.</text>
										</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection></section><section commented="no" id="ID12fd5587dd0043b995ed846adfabab0a"><enum>137.</enum><header>Surface
			 transportation project delivery program</header>
					<subsection commented="no" id="ID978ab1115fbd491d9b0c053f1d0fa37f"><enum>(a)</enum><header>In
			 general</header><text>Section 327 of title 23, United States Code, is
			 amended—</text>
						<paragraph commented="no" id="idBBE9DC19BA3840DE89907513770A9468"><enum>(1)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section" style="OLC">pilot</header-in-text></quote>; and</text>
						</paragraph><paragraph commented="no" id="idAC0534A6DF754C788604346EBF6387DA"><enum>(2)</enum><text>by striking
			 <quote>pilot</quote> each place it appears.</text>
						</paragraph></subsection><subsection commented="no" id="ID9ed63d70dfb34965b65873e8289cd7ae"><enum>(b)</enum><header>Establishment</header><text>Section
			 327(a)(2) of title 23, United States Code, is amended—</text>

				immunity</header><text>By executing an agreement with the Secretary and
				assuming the responsibilities of the Secretary under this section, a
				State—</text>
									<clause commented="no" id="idF0953E8E576948DBB1D7728CF02ABF5A"><enum>(i)</enum><text>waives the
				sovereign immunity of the State under the Eleventh Amendment of the
				Constitution of the United States from any civil action brought in a Federal
				court; and</text>
									</clause><clause commented="no" id="id1EA02787047F489A99B5D8886FFCC2A6"><enum>(ii)</enum><text>expressly
				consents to accept the jurisdiction of the Federal courts with respect to any
				action relating to the compliance, discharge, and enforcement of any
				responsibility of the Secretary that the State
				assumes.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" id="ID19f15c7672904480a2f8b741747b6e49"><enum>(c)</enum><header>State
			 participation</header><text>Section 327(b) of title 23, United States Code, is
			 amended—</text>
						<paragraph commented="no" id="ID7d3a7364fc9c4c5ba91d0ea1cf8a572e"><enum>(1)</enum><text>by striking
			 paragraph (1);</text>
						</paragraph><paragraph commented="no" id="ID78b98a0eed76490c945d1c18cf5e1062"><enum>(2)</enum><text>by redesignating
			 paragraphs (2) through (5) as paragraphs (1) through (4), respectively;
			 and</text>

						</paragraph></subsection><subsection commented="no" id="ID0d7827659f15446382657595b2a4424c"><enum>(d)</enum><header>Written
			 agreement</header><text>Section 327(c) of title 23, United States Code, is
			 amended—</text>

			 by striking the period at the end and inserting a semicolon; and</text>

			 end the following:</text>

				to provide to the Secretary any information the Secretary determines to be
				necessary to ensure that the State is adequately carrying out the
				responsibilities assigned to the State, including periodic written reports;
				and</text>
								</paragraph><paragraph commented="no" id="IDfdb446b998f94b76b3cf33479383c675"><enum>(5)</enum><text>require the
				Secretary—</text>
									<subparagraph commented="no" id="idCEB68D7DA3A041C5B4CFD93C10C7F47C"><enum>(A)</enum><text>after a period of
				5 years, to evaluate the ability of the State to carry out the responsibilities
				assumed under this section;</text>
									</subparagraph><subparagraph commented="no" id="id8EE8092065B6433FB131A9A0473757A7"><enum>(B)</enum><text>if the Secretary
				determines that the State is not ready to effectively carry out the
				responsibilities the State has assumed, to reevaluate the readiness of the
				State by not later than 3 years after the initial evaluation under subparagraph
				(A) and every 3 years thereafter, until the Secretary determines that the State
				is ready to assume those responsibilities on a permanent basis; and</text>
									</subparagraph><subparagraph commented="no" id="idC583B5C06C424F2C951F5159AFCAD063"><enum>(C)</enum><text>after the
				Secretary has determined under subparagraph (A) or (B) that the State is ready
				to permanently assume the responsibilities under this section, to notify the
				State—</text>
										<clause commented="no" id="idB51AABBF9A24419AAB3FFAE23648FF03"><enum>(i)</enum><text>of that
				determination; and</text>
										</clause><clause commented="no" id="id920F6E09BA534B079CE0435FF16903BA"><enum>(ii)</enum><text>that no further
				evaluations shall be
				required.</text>
										</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" id="IDda9d8e23b6d64ea5a08d1baf20b42ca7"><enum>(e)</enum><header>Audits</header><text>Section
			 327 of title 23, United States Code is amended—</text>
						<paragraph commented="no" id="id3A298EBD078446718B5B5361B22321A6"><enum>(1)</enum><text>by striking
			 subsection (g); and</text>
						</paragraph><paragraph commented="no" id="id57AF1F98CA8149DAAA8A62E8430B3685"><enum>(2)</enum><text>by redesignating
			 subsections (h) and (i) as (g) and (h), respectively.</text>

				immunity</header><text>By executing a memorandum of understanding with the
				Secretary under subsection (c) and assuming the responsibilities of the
				Secretary under this section, a State—</text>

				sovereign immunity of the State under the Eleventh Amendment of the
				Constitution of the United States from any civil action brought in a Federal
				court; and</text>
								</clause><clause commented="no" id="id0B897ECAE71546A3B67DB86435584A2B"><enum>(ii)</enum><text>expressly
				consents to accept the jurisdiction of the Federal courts with respect to any
				action relating to the compliance, discharge, and enforcement of any
				responsibility of the Secretary that the State assumes.</text>

				</section><section commented="no" id="IDe5e0c5bc0d5547ddaa71660f4a1e1653"><enum>139.</enum><header>Emergency
			 waiver</header><text display-inline="no-display-inline">Any road, highway, or
			 bridge that is in operation for fewer than 30 years or that is under
			 construction, and that is damaged by major disaster or emergency declared by
			 the Governor of the State and concurred in by the Secretary, or declared by the
			 President pursuant to the Robert T. Stafford Disaster Relief and Emergency
			 Assistance Act (42 U.S.C. 5121)—</text>
					<paragraph commented="no" id="idB51C4DACA90B4F65A7A11783AAB0A12B"><enum>(1)</enum><text display-inline="yes-display-inline">may be reconstructed in the same location
			 with the same capacity, dimensions, and design as before the disaster or
			 emergency; and</text>
					</paragraph><paragraph commented="no" id="idFAD2A19874D543F9A1B9FD20388B23B8"><enum>(2)</enum><text display-inline="yes-display-inline">shall be exempt from any environmental
			 reviews, approvals, licensing, and permit requirements under—</text>
						<subparagraph commented="no" id="ID8cca9596c93b45d3949259e26b8142c2"><enum>(A)</enum><text>the National
			 Historic Preservation Act (16 U.S.C. 470 et seq.);</text>
						</subparagraph><subparagraph commented="no" id="ID0ab0a113ddca4c04ab282676ea50e3f9"><enum>(B)</enum><text>the Migratory
			 Bird Treaty Act (16 U.S.C. 703 et seq.);</text>
						</subparagraph><subparagraph commented="no" id="IDa6ef27c1229848ba9442b808421df557"><enum>(C)</enum><text>the Fish and
			 Wildlife Coordination Act (16 U.S.C. 661 et seq.);</text>
						</subparagraph><subparagraph commented="no" id="ID648865fbb1f9486abc490aff883fa97f"><enum>(D)</enum><text>the Wild and
			 Scenic Rivers Act (16 U.S.C. 1271 et seq.);</text>
						</subparagraph><subparagraph commented="no" id="ID3171cc856f9f46a68b524fd3d524ebfa"><enum>(E)</enum><text>the Endangered
			 Species Act of 1973 (16 U.S.C. 1531 et seq.), except when the reconstruction
			 occurs in designated critical habitat for threatened and endangered

						</subparagraph><subparagraph commented="no" id="id9CDFDB64608740F4AE77CE160D649D81"><enum>(F)</enum><text>sections 402 and
			 404 of the Federal Water Pollution Control Act (33 U.S.C. 1342, 1344);</text>
						</subparagraph><subparagraph commented="no" id="id19459D69BDFD452CBA450EC579ABFA5A"><enum>(G)</enum><text>the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.);</text>
						</subparagraph><subparagraph commented="no" id="ID13e1ff1d660a4fd38561f370454ee25b"><enum>(H)</enum><text>Executive Order

						</subparagraph></paragraph></section><section commented="no" id="ID97c779a84eef45a68994e7c888b3e6b3"><enum>140.</enum><header>Cement sector
			 regulatory relief</header>
					<subsection commented="no" id="ID69a0f01e9e9c4695b4500c1eea09d830"><enum>(a)</enum><header>Establishment
			 of standards</header><text>In lieu of the rules specified in subsection (b),
			 and notwithstanding the date by which those rules would otherwise be required
			 to be promulgated, the Administrator of the Environmental Protection Agency
			 (referred to in this section as the <quote>Administrator</quote>) shall—</text>
						<paragraph commented="no" id="IDd721b95d2f034b93b1f1122943a15ff0"><enum>(1)</enum><text>propose
			 regulations for the Portland cement manufacturing industry and Portland cement
			 plants that are subject to any of the rules specified in subsection (b)
			 that—</text>
							<subparagraph commented="no" id="ID9486692c580f47d5a5b4861c6bb2c0ce"><enum>(A)</enum><text>establish maximum
			 achievable control technology standards, performance standards, and other
			 requirements under sections 112 and 129, as applicable, of the Clean Air Act
			 (42 U.S.C. 7412, 7429); and</text>
							</subparagraph><subparagraph commented="no" id="IDd54348f22ac84db3b92ad1469f66456d"><enum>(B)</enum><text>identify
			 nonhazardous secondary materials that, when used as fuels in combustion units
			 of that industry and those plants, qualify as solid waste under the Solid Waste
			 Disposal Act (42 U.S.C. 6901 et seq.) for purposes of determining the extent to
			 which the combustion units are required to meet the emission standards under
			 section 112 or 129 of the Clean Air Act (42 U.S.C. 7412, 7429); and</text>
							</subparagraph></paragraph><paragraph commented="no" id="ID6f03337e25314886a7cb03e8407c5a9a"><enum>(2)</enum><text>promulgate final
			 versions of those regulations by not later than—</text>
							<subparagraph commented="no" id="ID12d46c621c0f4b488f1ae4c5510ff971"><enum>(A)</enum><text>the date that is
			 15 months after the date of enactment of this Act; or</text>
							</subparagraph><subparagraph commented="no" id="ID1a5014c6425a4331b0a89f147d34a460"><enum>(B)</enum><text>such later date
			 as may be determined by the Administrator.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" id="ID8813431d70444fb6916afa86bea41eb5"><enum>(b)</enum><header>Stay of earlier
			 rules</header>
						<paragraph commented="no" id="ID88609369fa7a4f76ba028c25266b48fc"><enum>(1)</enum><header>Portland-specific
			 rules</header><text>The final rule entitled <quote>National Emission Standards
			 for Hazardous Air Pollutants from the Portland Cement Manufacturing Industry
			 and Standards of Performance for Portland Cement Plants</quote> (75 Fed. Reg.
			 54970 (September 9, 2010)) shall be—</text>
							<subparagraph commented="no" id="ID0ea507165a9b448f8f8fb326943404c0"><enum>(A)</enum><text>of no force or
			 effect;</text>
							</subparagraph><subparagraph commented="no" id="IDd67849e779a743d8a9a9cdc7246cd823"><enum>(B)</enum><text>treated as though
			 the rule had never taken effect; and</text>
							</subparagraph><subparagraph commented="no" id="IDbfafd33da15d4936bb2baf4d7450b50c"><enum>(C)</enum><text>replaced in
			 accordance with subsection (a).</text>
							</subparagraph></paragraph><paragraph commented="no" id="ID930c9eb1461948f98ba1a39119aa1280"><enum>(2)</enum><header>Other
			 rules</header>
							<subparagraph commented="no" id="IDd7d29ac489ec440987cf15ebc0f6f15c"><enum>(A)</enum><header>In
			 general</header><text>The final rules described in subparagraph (B), to the
			 extent that those rules apply to the Portland cement manufacturing industry and
			 Portland cement plants shall be—</text>
								<clause commented="no" id="IDeff466c6cfa84ca3aed47263795cbccf"><enum>(i)</enum><text>of no force or
			 effect;</text>
								</clause><clause commented="no" id="ID6151cc13446f4d88888984264e514eb5"><enum>(ii)</enum><text>treated as
			 though the rules had never taken effect; and</text>
								</clause><clause commented="no" id="ID8a7d2191d4234971a258055a31abe155"><enum>(iii)</enum><text>replaced in
			 accordance with subsection (a).</text>
								</clause></subparagraph><subparagraph commented="no" id="IDbc8572db1ced462886a65074db7ac102"><enum>(B)</enum><header>Description of
			 rules</header><text>The final rules described in this subparagraph are—</text>
								<clause commented="no" id="ID0bcad4ec488e4c528317be2ddcfa63d6"><enum>(i)</enum><text>the final rule
			 entitled <quote>Standards of Performance for New Stationary Sources and
			 Emission Guidelines for Existing Sources: Commercial and Industrial Solid Waste
			 Incineration Units</quote> (76 Fed. Reg. 15704 (March 21, 2011)); and</text>
								</clause><clause commented="no" id="IDb3840ca0590f4cff8d884ed07a098286"><enum>(ii)</enum><text>the final rule
			 entitled <quote>Identification of Non-Hazardous Secondary Materials That Are
			 Solid Waste</quote> (76 Fed. Reg. 15456 (March 21, 2011)).</text>
								</clause></subparagraph></paragraph></subsection><subsection commented="no" id="ID8f9cac4e017e45958879003784c2b620"><enum>(c)</enum><header>Establishment
			 of compliance dates</header><text>For each regulation promulgated pursuant to
			 subsection (a), the Administrator—</text>
						<paragraph commented="no" id="ID9bba466600e74a3c98eb696a6a4bd441"><enum>(1)</enum><text>shall establish a
			 date for compliance with standards and requirements under the regulation that
			 is, notwithstanding any other provision of law, not earlier than 5 years after
			 the effective date of the regulation; and</text>
						</paragraph><paragraph commented="no" id="ID617285cc75994966980766031859a96d"><enum>(2)</enum><text>in proposing a
			 date for that compliance, shall take into consideration—</text>
							<subparagraph commented="no" id="ID7cf3680d62544c47b89a0c976c88bcab"><enum>(A)</enum><text>the costs of
			 achieving emission reductions;</text>
							</subparagraph><subparagraph commented="no" id="ID710bfa8b08bd440cb7ee8c17ea32ead3"><enum>(B)</enum><text>any nonair
			 quality health and environmental impacts and energy requirements of the
			 standards and requirements;</text>
							</subparagraph><subparagraph commented="no" id="ID31db3b958a544165bee50a88e3a6c7a1"><enum>(C)</enum><text>the feasibility
			 of implementing the standards and requirements, including the time
			 necessary—</text>
								<clause commented="no" id="ID824869933bcf415b9748376e6c63106e"><enum>(i)</enum><text>to obtain
			 necessary permit approvals; and</text>
								</clause><clause commented="no" id="ID957f12521fea496ead1934b860099cbe"><enum>(ii)</enum><text>to procure,
			 install, and test control equipment;</text>
								</clause></subparagraph><subparagraph commented="no" id="IDa6ac48798bc14a2597770915390f69d3"><enum>(D)</enum><text>the availability
			 of equipment, suppliers, and labor, given the requirements of the regulation
			 and other proposed or finalized regulations of the Administrator; and</text>
							</subparagraph><subparagraph commented="no" id="ID45d65bbb33224ecf970229a60dba4a4c"><enum>(E)</enum><text>potential net
			 employment impacts.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" id="IDa37665b0b6c443bcaff82feadcf8bda9"><enum>(d)</enum><header>New
			 sources</header><text>The date on which the Administrator proposes a regulation
			 pursuant to subsection (a)(1) establishing an emission standard under section
			 112 or 129 of the Clean Air Act (42 U.S.C. 7412, 7429) shall be treated as the
			 date on which the Administrator first proposes such a regulation for purposes
			 of applying—</text>
						<paragraph commented="no" id="ID57835b7bb26b440e9bb482de4bdfeb32"><enum>(1)</enum><text>the definition of
			 the term <quote>new source</quote> under section 112(a)(4) of that Act (42
			 U.S.C. 7412(a)(4)); or</text>
						</paragraph><paragraph commented="no" id="IDa8e458f76e1c4a8685bcba0c0bf47db4"><enum>(2)</enum><text>the definition of
			 the term <quote>new solid waste incineration unit</quote> under section
			 129(g)(2) of that Act (42 U.S.C. 7429(g)(2)).</text>
						</paragraph></subsection><subsection commented="no" id="ID72ff7b75a03d46b3982839aabb402271"><enum>(e)</enum><header>Rule of
			 construction</header><text>Nothing in this section restricts or otherwise
			 affects paragraphs (3)(B) and (4) of section 112(i) of the Clean Air Act (42
			 U.S.C. 7412(i)).</text>
					</subsection><subsection commented="no" id="IDfb8d0067f2764b2db6ab677441b93b05"><enum>(f)</enum><header>Energy recovery
			 and conservation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 and to ensure the recovery and conservation of energy consistent with the Solid
			 Waste Disposal Act (42 U.S.C. 6901 et seq.), in promulgating regulations under
			 subsection (a) addressing the subject matter of the rules specified in
			 subsection (b)(2), the Administrator shall—</text>
						<paragraph commented="no" id="ID39828dab856245768e2e19810b1e621a"><enum>(1)</enum><text>adopt the
			 definitions of the terms <quote>commercial and industrial solid waste
			 incineration unit</quote>, <quote>commercial and industrial waste</quote>, and
			 <quote>contained gaseous material</quote> in the rule entitled <quote>Standards
			 for Performance of New Stationary Sources and Emission Guidelines for Existing
			 Sources: Commercial and Industrial Solid Waste Incineration Units</quote> (65
			 Fed. Reg. 75338 (December 1, 2000)); and</text>
						</paragraph><paragraph commented="no" id="ID32307595ea2243fb9d34051dbe34be18"><enum>(2)</enum><text>identify
			 nonhazardous secondary material to be solid waste (as defined in section 1004
			 of the Solid Waste Disposal Act (42 U.S.C. 6903)) only if—</text>
							<subparagraph commented="no" id="ID0ca574cbffde4d619614e5f0a2e1f986"><enum>(A)</enum><text>the material
			 meets that definition of commercial and industrial waste; or</text>
							</subparagraph><subparagraph commented="no" id="IDd6c3588ca8c7411eb6d90d1a07df1336"><enum>(B)</enum><text>if the material
			 is a gas, the material meets that definition of contained gaseous
			 material.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" id="IDf26ca773c81e448789658af3538cd31d"><enum>(g)</enum><header>Establishment
			 of standards achievable in practice</header><text>In promulgating regulations
			 under subsection (a), the Administrator shall ensure, to the maximum extent
			 practicable, that emission standards for existing and new sources established
			 under section 112 or 129 of the Clean Air Act (42 U.S.C. 7412, 7429), as
			 applicable, can be met under actual operating conditions consistently and
			 concurrently with emission standards for all other air pollutants covered by
			 regulations applicable to the source category, taking into account—</text>
						<paragraph commented="no" id="ID01163bebfef5480a869f3350b225aa05"><enum>(1)</enum><text>variability in
			 actual source performance;</text>
						</paragraph><paragraph commented="no" id="ID245d2d6488794b2ea0feccda688c801b"><enum>(2)</enum><text>source
			 design;</text>
						</paragraph><paragraph commented="no" id="ID81d43c8b163f4f03ac6d3563c1733672"><enum>(3)</enum><text>fuels;</text>
						</paragraph><paragraph commented="no" id="IDbd91e9b8c5c64a7c8bd1edaeb840c79a"><enum>(4)</enum><text>inputs;</text>
						</paragraph><paragraph commented="no" id="ID38c3e109ccce4e398b80767c31635f88"><enum>(5)</enum><text>controls;</text>
						</paragraph><paragraph commented="no" id="IDb5e9dcd873374820be5ed91a483933db"><enum>(6)</enum><text>ability to
			 measure the pollutant emissions; and</text>
						</paragraph><paragraph commented="no" id="IDda6da2e16e33498f933352e7526409de"><enum>(7)</enum><text>operating
			 conditions.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDde69e6b1c0ed48e29f61b6702f16775b"><enum>(h)</enum><header>Regulatory
			 alternatives</header><text>For each regulation promulgated under subsection
			 (a), from among the range of regulatory alternatives authorized under the Clean
			 Air Act (42 U.S.C. 7401 et seq.), including work practice standards under
			 section 112(h) of that Act (42 U.S.C. 7412(h)), the Administrator shall impose
			 the least burdensome, consistent with the purposes of that Act and Executive
			 Order 13563 (76 Fed. Reg. 3821 (January 21, 2011)).</text>
					</subsection></section></subtitle></title><title id="idC03668DCD7EE489FA9214ABC2000C9D9"><enum>II</enum><header>Public
			 transportation</header>
			<section id="idCFAB148011DC45D992436A45A63BE971"><enum>201.</enum><header>Public
			 transportation</header>
				<subsection id="ID3844296c71b64c278aca7fd4f1f82e71"><enum>(a)</enum><header>Extension for
			 public transportation</header><text>Except as otherwise provided in this
			 section, requirements, authorities, conditions, eligibilities, limitations, and
			 other provisions authorized under title III of the SAFETEA–LU (Public Law
			 109–59; 119 Stat. 2022), title III of the Intermodal Surface Transportation
			 Efficiency Act of 1991 (Public Law 102–240; 105 Stat. 2087), title III of the
			 Transportation Equity Act for the 21st Century (Public Law 105–178; 112 Stat.
			 338), and chapter 53 of title 49, United States Code, which would otherwise
			 expire on or cease to apply after March 31, 2012, are incorporated by reference
			 and shall continue in effect until September 30, 2013.</text>
				</subsection><subsection id="ID48f34b75b560404ca7112ee72735226b"><enum>(b)</enum><header>Authorization
			 of appropriations</header>
					<paragraph id="IDa8c2446204fd4185af34352a0191aafc"><enum>(1)</enum><header>Mass transit
			 account</header><text>There shall be available from the Mass Transit Account of
			 the Highway Trust Fund for each of fiscal years 2012 and 2013, an amount equal
			 to the total amount authorized to be appropriated out of the Mass Transit
			 Account of the Highway Trust Fund for programs, projects, and activities for
			 fiscal year 2011 under the SAFETEA–LU (Public Law 109–59) and under chapter 53
			 of title 49, United States Code.</text>
					</paragraph><paragraph id="ID44dffc426c774dec85f80f9b22910745"><enum>(2)</enum><header>General
			 fund</header><text>There is authorized to be appropriated from the General Fund
			 of the Treasury for each of fiscal years 2012 and 2013, an amount equal to the
			 total amount authorized to be appropriated from the General Fund of the
			 Treasury for programs, projects, and activities for fiscal year 2011 under the
			 SAFETEA–LU (Public Law 109–59) and under chapter 53 of title 49, United States
			 Code.</text>
					</paragraph></subsection><subsection id="IDe9a401c0bfaa49fa97d842822bd66f36"><enum>(c)</enum><header>Contract
			 authority</header><text>Funds made available under this section from the Mass
			 Transit Account of the Highway Trust Fund shall be available for obligation in
			 the same manner as provided for under section 5338(f)(1) of title 49, United
			 States Code.</text>
				</subsection><subsection id="ID56b46522b0774ed2a865761708cc9dbe"><enum>(d)</enum><header>Use of
			 funds</header><text>Funds authorized to be appropriated or made available for
			 obligation and expended under this section shall be distributed, administered,
			 limited, and made available for obligation in the same manner and at the same
			 rate as funds authorized to be appropriated or made available for fiscal year
			 2011 to carry out programs, projects, activities, eligibilities, and
			 requirements under the SAFETEA–LU (Public Law 109–59), title III of the
			 Intermodal Surface Transportation Efficiency Act of 1991 (Public Law 102–240;
			 105 Stat. 2087), title III of the Transportation Equity Act for the 21st
			 Century (Public Law 105–178; 112 Stat. 338), and chapter 53 of title 49, United
			 States Code, including section 5338(f)(1) of such title 49.</text>
				</subsection><subsection id="ID30a8fbaeb14f4a0888bb60712bb74a30"><enum>(e)</enum><header>Distribution of
			 funds under title III of SAFETEA-LU</header><text>Funds authorized to be
			 appropriated or made available for programs continued under this section shall
			 be distributed to those programs in the same proportion as funds were allocated
			 for those programs for fiscal year 2011, except that any designations for
			 specific activities in sections 3044 and 3046 of the SAFETEA–LU shall not be
			 required to be continued.</text>
				</subsection><subsection id="id9E2EB7E7CA8E4EA3B8E9997EAE414D3D"><enum>(f)</enum><header>Disadvantaged
			 business enterprises</header><text>Section 1101(b) of the SAFETEA–LU (23 U.S.C.
			 101 note) shall apply with respect to any program under title III of the
			 SAFETEA–LU (Public Law 109–59) or chapter 53 of title 49, United States Code,
			 that receives funds authorized to be appropriated or made available for
			 obligation and expended under this section.</text>
				</subsection><subsection id="id531C17C03D7A44ADA8A9FEEFC2E7ECB0"><enum>(g)</enum><header>Obligation
			 ceiling</header><text>Section 3040 of the SAFETEA–LU (Public Law 109–59; 119
			 Stat. 1639) is amended by striking paragraph (8) and inserting the
			 following</text>
					<quoted-block display-inline="no-display-inline" id="idBF3D05F2AD0742DB86290BCBDE0A8ECA" style="OLC">
						<paragraph id="idEA7B616DD6E74C0E8426CEB0CFB107BD"><enum>(8)</enum><text>for each of
				fiscal years 2012 and 2013, an amount equal to $10,507,752,000, of which not
				more than $8,360,565,000 shall be from the Mass Transit
				Account.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section></title><title id="id6E7A79066DE74E21BCC18576AEBDBF45"><enum>III</enum><header>Extension of

				804(2)(B), and 804(2)(C);</text>
										</clause><clause id="H600A415576204AE7B1D9455671542A9B" indent="up2"><enum>(iv)</enum><text>a list of any other related
				regulatory actions intended to implement the same statutory provision or
				regulatory objective as well as the individual and aggregate economic effects
				of those actions; and</text>
										</clause><clause id="HA4E79768D24541879771A7B19F8644EB" indent="up2"><enum>(v)</enum><text>the proposed effective date of the
				rule.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H51FEF20DFAE142868BCF62A59316CD30" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">On the date of the submission of the report
				under subparagraph (A), the Federal agency promulgating the rule shall submit
				to the Comptroller General and make available to each House of Congress—</text>
										<clause commented="no" display-inline="no-display-inline" id="H9570C40C958646E8B62BDDA77D3E6643"><enum>(i)</enum><text display-inline="yes-display-inline">a complete copy of the cost-benefit
				analysis of the rule, if any;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HC0EC0368FE744D24A3EA1FF9AAA59F5A"><enum>(ii)</enum><text display-inline="yes-display-inline">the agency’s actions pursuant to title 5 of
				the United States Code, sections 603, 604, 605, 607, and 609;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HBD9E0B3F30D8428AA2EB5E1CF5009FFC"><enum>(iii)</enum><text display-inline="yes-display-inline">the agency’s actions pursuant to title 2 of
				the United States Code, sections 1532, 1533, 1534, and 1535; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H565D36029CE5448BBEFC45E1912AD80F"><enum>(iv)</enum><text display-inline="yes-display-inline">any other relevant information or
				requirements under any other Act and any relevant Executive orders.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD3FA988097294584962B1645F7CE362F" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">Upon receipt of a report submitted under
				subparagraph (A), each House shall provide copies of the report to the chairman
				and ranking member of each standing committee with jurisdiction under the rules
				of the House of Representatives or the Senate to report a bill to amend the
				provision of law under which the rule is issued.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC69A077C798E40F0ADDEF191A145C042" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0C1223AE6C5145B5A667C3A9A17BF988"><enum>(A)</enum><text display-inline="yes-display-inline">The Comptroller General shall provide a
				report on each major rule to the committees of jurisdiction by the end of 15
				calendar days after the submission or publication date as provided in section
				802(b)(2). The report of the Comptroller General shall include an assessment of
				the agency’s compliance with procedural steps required by paragraph
				(1)(B).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCB14FFD4B4E94EBF8C8BF3B9AA8E0424" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Federal agencies shall cooperate with the
				Comptroller General by providing information relevant to the Comptroller
				General’s report under subparagraph (A).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD75A6F99B554A99999908B53B5FBBAF" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A
				major rule relating to a report submitted under paragraph (1) shall take effect
				upon enactment of a joint resolution of approval described in section 802 or as
				provided for in the rule following enactment of a joint resolution of approval
				described in section 802, whichever is later.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H054462759C424F30AC4578C265AF3308" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">A
				nonmajor rule shall take effect as provided by section 803 after submission to
				Congress under paragraph (1).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H264753F95E2349E59AD30FE08FEED7D1" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">If a joint resolution of approval relating
				to a major rule is not enacted within the period provided in subsection (b)(2),
				then a joint resolution of approval relating to the same rule may not be
				considered under this chapter in the same Congress by either the House of
				Representatives or the Senate.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB09E8D94C6A94778AB8983D89D1DF2F2"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HAC3FA04C13CB4422830DE7C41BD6111B"><enum>(1)</enum><text display-inline="yes-display-inline">A major rule shall not take effect unless
				the Congress enacts a joint resolution of approval described under section
				802.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE6BA302BD02D493F843BE9F41A90E1E6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If a joint resolution described in
				subsection (a) is not enacted into law by the end of 70 session days or
				legislative days, as applicable, beginning on the date on which the report
				referred to in section 801(a)(1)(A) is received by Congress (excluding days
				either House of Congress is adjourned for more than 3 days during a session of
				Congress), then the rule described in that resolution shall be deemed not to be
				approved and such rule shall not take effect.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEC906977632E487095E3ED4DC45DDFB8"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H4426A63DBC8346A2A1C2CBA41A3A9E12"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				section (except subject to paragraph (3)), a major rule may take effect for one
				90-calendar-day period if the President makes a determination under paragraph
				(2) and submits written notice of such determination to the Congress.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1CEBC9B5B3D84540B5512D29C72E3C01" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) applies to a determination
				made by the President by Executive order that the major rule should take effect
				because such rule is—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HBBD37147CA684476B88EC4F7C7044D5B"><enum>(A)</enum><text display-inline="yes-display-inline">necessary because of an imminent threat to
				health or safety or other emergency;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC96001FB3CA940ADA95F481B7B5573F6"><enum>(B)</enum><text display-inline="yes-display-inline">necessary for the enforcement of criminal
				laws;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8814EF478BA5473489FE46F78D9F43DD"><enum>(C)</enum><text display-inline="yes-display-inline">necessary for national security; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFC2085A7FC664F05B63AEA3422E5E24E"><enum>(D)</enum><text display-inline="yes-display-inline">issued pursuant to any statute implementing
				an international trade agreement.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H10903417736640FE82344449EA71D8E6" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">An exercise by the President of the
				authority under this subsection shall have no effect on the procedures under
				section 802.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H393F3C27986F474898A563455304AFB5"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6ED8D1E7E66143DCAC5F2FB110C6D6F1"><enum>(1)</enum><text display-inline="yes-display-inline">In addition to the opportunity for review
				otherwise provided under this chapter, in the case of any rule for which a
				report was submitted in accordance with subsection (a)(1)(A) during the period
				beginning on the date occurring—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HAD8ED3408EA743078E4C2CCFAB8A53DA" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of the Senate, 60 session days,
				or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2751718737014F319A0A0078100B9D15" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of the House of
				Representatives, 60 legislative days,</text>
									</subparagraph></paragraph><continuation-text commented="no" continuation-text-level="subsection">before the date the Congress is
				scheduled to adjourn a session of Congress through the date on which the same
				or succeeding Congress first convenes its next session, sections 802 and 803
				shall apply to such rule in the succeeding session of Congress.</continuation-text><paragraph commented="no" display-inline="no-display-inline" id="HD1E6A7803A784E62A687050177D46387" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0FED28D1DC5A4EC9837359481ADF2830"><enum>(A)</enum><text display-inline="yes-display-inline">In applying sections 802 and 803 for
				purposes of such additional review, a rule described under paragraph (1) shall
				be treated as though—</text>
										<clause commented="no" display-inline="no-display-inline" id="HAF5E100F9E544E2D9352069D9C39951C" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">such rule were published in the Federal
				Register on—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H07CC28C54F1D4E3B9F331C5D7FFC1C02"><enum>(I)</enum><text display-inline="yes-display-inline">in the case of the Senate, the 15th session
				day, or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H58FEFBD5D88D4DD98C1CCB41D97C852A"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of the House of
				Representatives, the 15th legislative day,</text>
											</subclause><continuation-text commented="no" continuation-text-level="clause">after the succeeding session of Congress
				first convenes; and</continuation-text></clause><clause commented="no" display-inline="no-display-inline" id="H6F6D0F7FCADC42AAA9C3FB2F43D61594" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">a
				report on such rule were submitted to Congress under subsection (a)(1) on such
				date.</text>
										</clause></subparagraph><subparagraph id="H9F310124A4E34F89B0938E3E2A3B454C" indent="up1"><enum>(B)</enum><text>Nothing in this paragraph shall be
				construed to affect the requirement under subsection (a)(1) that a report shall
				be submitted to Congress before a rule can take effect.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H63FE5842B94D4CCB82CBD4C90AAD36E4" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A
				rule described under paragraph (1) shall take effect as otherwise provided by
				law (including other subsections of this section).</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H49AFED1002CD46CEBD8F52695B172130" section-type="subsequent-section"><enum>802.</enum><header display-inline="yes-display-inline">Congressional approval procedure for major
				rules</header>
							<subsection commented="no" display-inline="no-display-inline" id="H98C18BB7FB364A438D3FF130E07A7496"><enum>(a)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>joint resolution</term> means only a joint resolution introduced on or
				after the date on which the report referred to in section 801(a)(1)(A) is
				received by Congress (excluding days either House of Congress is adjourned for
				more than 3 days during a session of Congress), the matter after the resolving
				clause of which is as follows: <quote>That Congress approves the rule submitted
				by the _ _ relating to _ _.</quote> (The blank spaces being appropriately
				filled in).</text>
								<paragraph commented="no" id="HFC1ABA8B7E4848A798D7B610080C72C6"><enum>(1)</enum><text display-inline="yes-display-inline">In the House, the majority leader of the
				House of Representatives (or his designee) and the minority leader of the House
				of Representatives (or his designee) shall introduce such joint resolution
				described in subsection (a) (by request), within 3 legislative days after
				Congress receives the report referred to in section 801(a)(1)(A).</text>
								</paragraph><paragraph commented="no" id="H5C56D7732E31467695DB306C68BB9B1C"><enum>(2)</enum><text>In the Senate, the
				majority leader of the Senate (or his designee) and the minority leader of the
				Senate (or his designee) shall introduce such joint resolution described in
				subsection (a) (by request), within 3 session days after Congress receives the
				report referred to in section 801(a)(1)(A).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA653EFF66B644BDEBE91AB74BDF01413"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2D0963705AF8446189CDB45DB6EF372A"><enum>(1)</enum><text display-inline="yes-display-inline">A joint resolution described in subsection
				(a) shall be referred to the committees in each House of Congress with
				jurisdiction under the rules of the House of Representatives or the Senate to
				report a bill to amend the provision of law under which the rule is
				issued.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8C9BD398821E423BB8C228F8DA66032E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>submission date</term> means the date on which the Congress receives the
				report submitted under section 801(a)(1).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5AEB336531AF40D2A9646DABB7FA45F9"><enum>(c)</enum><text display-inline="yes-display-inline">In the Senate, if the committee or
				committees to which a joint resolution described in subsection (a) has been
				referred have not reported it at the end of 15 session days after its
				introduction, such committee or committees shall be automatically discharged
				from further consideration of the resolution and it shall be placed on the
				calendar. A vote on final passage of the resolution shall be taken on or before
				the close of the 15th session day after the resolution is reported by the
				committee or committees to which it was referred, or after such committee or
				committees have been discharged from further consideration of the
				resolution.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H151378790622487880AB49EE45FC8F40"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H8398487DCD6746F89E32961A697FA555"><enum>(1)</enum><text display-inline="yes-display-inline">In the Senate, when the committee or
				committees to which a joint resolution is referred have reported, or when a
				committee or committees are discharged (under subsection (c)) from further
				consideration of a joint resolution described in subsection (a), it is at any
				time thereafter in order (even though a previous motion to the same effect has
				been disagreed to) for a motion to proceed to the consideration of the joint
				resolution, and all points of order against the joint resolution (and against
				consideration of the joint resolution) are waived. The motion is not subject to
				amendment, or to a motion to postpone, or to a motion to proceed to the
				consideration of other business. A motion to reconsider the vote by which the
				motion is agreed to or disagreed to shall not be in order. If a motion to
				proceed to the consideration of the joint resolution is agreed to, the joint
				resolution shall remain the unfinished business of the Senate until disposed
				of.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H58B52F809C22465380EB255AEEA3A9BA" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the Senate, debate on the joint
				resolution, and on all debatable motions and appeals in connection therewith,
				shall be limited to not more than 2 hours, which shall be divided equally
				between those favoring and those opposing the joint resolution. A motion to
				further limit debate is in order and not debatable. An amendment to, or a
				motion to postpone, or a motion to proceed to the consideration of other
				business, or a motion to recommit the joint resolution is not in order.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDE064852C4749A396323562F1A0D8DC" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In the Senate, immediately following the
				conclusion of the debate on a joint resolution described in subsection (a), and
				a single quorum call at the conclusion of the debate if requested in accordance
				with the rules of the Senate, the vote on final passage of the joint resolution
				shall occur.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H231A964281E44C968EE10EB652C8F7A0" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Appeals from the decisions of the Chair
				relating to the application of the rules of the Senate to the procedure
				relating to a joint resolution described in subsection (a) shall be decided
				without debate.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB58DF1D6ABD44AB2B387C5CC2832930F"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H9FF3086AB8EA418793BEB6A79ECAA551"><enum>(1)</enum><text display-inline="yes-display-inline">In the House of Representatives, if the
				committee or committees to which a joint resolution described in subsection (a)
				has been referred have not reported it at the end of 15 legislative days after
				its introduction, such committee or committees shall be automatically
				discharged from further consideration of the resolution and it shall be placed
				on the appropriate calendar. A vote on final passage of the resolution shall be
				taken on or before the close of the 15th legislative day after the resolution
				is reported by the committee or committees to which it was referred, or after
				such committee or committees have been discharged from further consideration of
				the resolution.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41F5D88E5611459BB499B8294E9D1167" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H797D19B612924ED39216BA80D5387235"><enum>(A)</enum><text display-inline="yes-display-inline">A motion in the House of Representatives to
				proceed to the consideration of a resolution shall be privileged and not
				debatable. An amendment to the motion shall not be in order, nor shall it be in
				order to move to reconsider the vote by which the motion is agreed to or
				disagreed to.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA455800A58844C8288A553CF79513731" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Debate in the House of Representatives on a
				resolution shall be limited to not more than two hours, which shall be divided
				equally between those favoring and those opposing the resolution. A motion to
				further limit debate shall not be debatable. No amendment to, or motion to
				recommit, the resolution shall be in order. It shall not be in order to
				reconsider the vote by which a resolution is agreed to or disagreed to.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCF8701696F0E4D178772B690308DB9BB" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Motions to postpone, made in the House of
				Representatives with respect to the consideration of a resolution, and motions
				to proceed to the consideration of other business, shall be decided without
				debate.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H141286835EC34FAC93993C4EF8E57622" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">All appeals from the decisions of the Chair
				relating to the application of the Rules of the House of Representatives to the
				procedure relating to a resolution shall be decided without debate.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE89ED1467DDB49B1A0D53A29C787B946"><enum>(f)</enum><text display-inline="yes-display-inline">If, before the passage by one House of a
				joint resolution of that House described in subsection (a), that House receives
				from the other House a joint resolution described in subsection (a), then the
				following procedures shall apply with respect to a joint resolution described
				in subsection (a) of the House receiving the joint resolution—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H95CD44E4A6D74016837BD2014DD2D256"><enum>(1)</enum><text display-inline="yes-display-inline">the procedure in that House shall be the
				same as if no joint resolution had been received from the other House;
				but</text>
								</paragraph><paragraph id="HC11BFB2029144127A8F8D4F8E4EEA13F"><enum>(2)</enum><text>the vote on final
				passage shall be on the joint resolution of the other House.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H32BBA31B0F3748D79E39F987241737EE"><enum>(g)</enum><text display-inline="yes-display-inline">The enactment of a resolution of approval
				does not serve as a grant or modification of statutory authority by Congress
				for the promulgation of a rule, does not extinguish or affect any claim,
				whether substantive or procedural, against any alleged defect in a rule, and
				shall not form part of the record before the court in any judicial proceeding
				concerning a rule.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H092920DFD490419E8A8010CB741F369F"><enum>(h)</enum><text display-inline="yes-display-inline">This section and section 803 are enacted by
				Congress—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HBBEBBB7BD4574819855940A262313357"><enum>(1)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of
				the Senate and House of Representatives, respectively, and as such it is deemed
				a part of the rules of each House, respectively, but applicable only with
				respect to the procedure to be followed in that House in the case of a joint
				resolution described in subsection (a), and it supersedes other rules only to
				the extent that it is inconsistent with such rules; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H12090A5B4C8F4932947CCE6D4E5B75A1"><enum>(2)</enum><text display-inline="yes-display-inline">with full recognition of the constitutional
				right of either House to change the rules (so far as relating to the procedure
				of that House) at any time, in the same manner, and to the same extent as in
				the case of any other rule of that House.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7EC9CBAEB5694926A5ADA48D705FE241" section-type="subsequent-section"><enum>803.</enum><header display-inline="yes-display-inline">Congressional disapproval procedure for
				nonmajor rules</header>
							<subsection commented="no" display-inline="no-display-inline" id="H80B608EC2F534DE3B767D7ECF75FE24A"><enum>(a)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>joint resolution</term> means only a joint resolution introduced in the
				period beginning on the date on which the report referred to in section
				801(a)(1)(A) is received by Congress and ending 60 days thereafter (excluding
				days either House of Congress is adjourned for more than 3 days during a
				session of Congress), the matter after the resolving clause of which is as
				follows: <quote>That Congress disapproves the nonmajor rule submitted by the _
				_ relating to _ _, and such rule shall have no force or effect.</quote> (The
				blank spaces being appropriately filled in).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H767B6869EEF742DBB0B40E0766D83913"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0CCF4245FEA94542B44B941ED6AA1D5D"><enum>(1)</enum><text display-inline="yes-display-inline">A joint resolution described in subsection
				(a) shall be referred to the committees in each House of Congress with
				jurisdiction.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H83C3744C5DC047989379C775D9632235" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>submission or publication date</term> means the later of the date on
				which—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H38BDC7D09EBB4501A0EDA0D3A969E376"><enum>(A)</enum><text display-inline="yes-display-inline">the Congress receives the report submitted
				under section 801(a)(1); or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA010C4BD3A1E4E889364245728924422"><enum>(B)</enum><text display-inline="yes-display-inline">the nonmajor rule is published in the
				Federal Register, if so published.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H86891B5521ED43DE8AA244ADBAB469DC"><enum>(c)</enum><text display-inline="yes-display-inline">In the Senate, if the committee to which is
				referred a joint resolution described in subsection (a) has not reported such
				joint resolution (or an identical joint resolution) at the end of 15 session
				days after the date of introduction of the joint resolution, such committee may
				be discharged from further consideration of such joint resolution upon a
				petition supported in writing by 30 Members of the Senate, and such joint
				resolution shall be placed on the calendar.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H27B730C552C545E0A0B6A4AE8C30C8BC"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2FCCBF48108840C6903E1A9EFC0D9981"><enum>(1)</enum><text display-inline="yes-display-inline">In the Senate, when the committee to which
				a joint resolution is referred has reported, or when a committee is discharged
				(under subsection (c)) from further consideration of a joint resolution
				described in subsection (a), it is at any time thereafter in order (even though
				a previous motion to the same effect has been disagreed to) for a motion to
				proceed to the consideration of the joint resolution, and all points of order
				against the joint resolution (and against consideration of the joint
				resolution) are waived. The motion is not subject to amendment, or to a motion
				to postpone, or to a motion to proceed to the consideration of other business.
				A motion to reconsider the vote by which the motion is agreed to or disagreed
				to shall not be in order. If a motion to proceed to the consideration of the
				joint resolution is agreed to, the joint resolution shall remain the unfinished
				business of the Senate until disposed of.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H95B4A8AC7C5744F59E9BA9A36CE51C38" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the Senate, debate on the joint
				resolution, and on all debatable motions and appeals in connection therewith,
				shall be limited to not more than 10 hours, which shall be divided equally
				between those favoring and those opposing the joint resolution. A motion to
				further limit debate is in order and not debatable. An amendment to, or a
				motion to postpone, or a motion to proceed to the consideration of other
				business, or a motion to recommit the joint resolution is not in order.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC22E9C8D226443A4B7C0419D2FCA30B2" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In the Senate, immediately following the
				conclusion of the debate on a joint resolution described in subsection (a), and
				a single quorum call at the conclusion of the debate if requested in accordance
				with the rules of the Senate, the vote on final passage of the joint resolution
				shall occur.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA61B15E6914145B49D047F5E444FD510" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Appeals from the decisions of the Chair
				relating to the application of the rules of the Senate to the procedure
				relating to a joint resolution described in subsection (a) shall be decided
				without debate.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF0E6B3BE33314AF6BC9A816BE6B54055"><enum>(e)</enum><text display-inline="yes-display-inline">In the Senate the procedure specified in
				subsection (c) or (d) shall not apply to the consideration of a joint
				resolution respecting a nonmajor rule—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HE34E8D5C243F4403B7CF062FAF17F2D4"><enum>(1)</enum><text display-inline="yes-display-inline">after the expiration of the 60 session days
				beginning with the applicable submission or publication date, or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB717361C06ED42349082A02050E80380"><enum>(2)</enum><text display-inline="yes-display-inline">if the report under section 801(a)(1)(A)
				was submitted during the period referred to in section 801(d)(1), after the
				expiration of the 60 session days beginning on the 15th session day after the
				succeeding session of Congress first convenes.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1990DE921B514DFEA505B45D25367939"><enum>(f)</enum><text display-inline="yes-display-inline">If, before the passage by one House of a
				joint resolution of that House described in subsection (a), that House receives
				from the other House a joint resolution described in subsection (a), then the
				following procedures shall apply:</text>
								<paragraph id="HBABDCC0D63874569B42A3E203AC517C5"><enum>(1)</enum><text>The joint
				resolution of the other House shall not be referred to a committee.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H16B38DE67C97494AAC01BDC1477C767B"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to a joint resolution
				described in subsection (a) of the House receiving the joint resolution—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H94B18F6F0F4B456293EF88C04FAA128F"><enum>(A)</enum><text display-inline="yes-display-inline">the procedure in that House shall be the
				same as if no joint resolution had been received from the other House;
				but</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBC30C516CEF040E5A85AEDE155F5043F"><enum>(B)</enum><text display-inline="yes-display-inline">the vote on final passage shall be on the
				joint resolution of the other House.</text>
									</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H908A068812A242EFADDFA43F142CC9F5" section-type="subsequent-section"><enum>804.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">For purposes of this chapter—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HA3EBE0DB53F449F3B8747321B9E34EAB"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Federal
				agency</term>—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id88A46FB1A2CB4B85A0F11EEF2612A525"><enum>(A)</enum><text display-inline="yes-display-inline">means any agency as that term is defined in
				section 551(1); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id801DC60D1B4443B386D1204E9CD42CFF"><enum>(B)</enum><text>includes the
				Board of Governors of the Federal Reserve System, the Bureau of Consumer
				Financial Protection, the Commodity Futures Trading Commission, the Federal
				Deposit Insurance Corporation, the Federal Housing Finance Agency, the
				Financial Stability Oversight Council, the Office of the Comptroller of the
				Currency, the Office of Financial Research, the National Credit Union
				Administration, and the Securities and Exchange Commission;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3D3821AAD31B445CA6C16E2D6E6EAD93"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>major rule</term> means any
				rule, including an interim final rule, that the Administrator of the Office of
				Information and Regulatory Affairs of the Office of Management and Budget finds
				has resulted in or is likely to result in—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="HD3C63A740BA04D83A73E0FBB5600936D"><enum>(A)</enum><text display-inline="yes-display-inline">an annual effect on the economy of
				$100,000,000 or more;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBF0BF43AD089438D8756AF8B62DE6F12"><enum>(B)</enum><text display-inline="yes-display-inline">a major increase in costs or prices for
				consumers, individual industries, Federal, State, or local government agencies,
				or geographic regions; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD04F8191A7724064BB2DD4AFE80E8913"><enum>(C)</enum><text display-inline="yes-display-inline">significant adverse effects on competition,
				employment, investment, productivity, innovation, or on the ability of United
				States-based enterprises to compete with foreign-based enterprises in domestic
				and export markets;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35F527CCFC0742FEA461B2BA04E86169"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>nonmajor rule</term> means
				any rule that is not a major rule; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H66879A86EF024733B96AC2C551CA52F0"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>rule</term> has the meaning
				given such term in section 551, except that such term does not include—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H1BD3DE3A1EC94F9DB67A2CAB52B5B73A"><enum>(A)</enum><text display-inline="yes-display-inline">any rule of particular applicability,
				including a rule that approves or prescribes for the future rates, wages,
				prices, services, or allowances therefore, corporate or financial structures,
				reorganizations, mergers, or acquisitions thereof, or accounting practices or
				disclosures bearing on any of the foregoing;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7E6EEF93F6F94A96ADCDB6497279D704"><enum>(B)</enum><text display-inline="yes-display-inline">any rule relating to agency management or
				personnel;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE3623110E6A04F36AF993EC1CEA118A3"><enum>(C)</enum><text display-inline="yes-display-inline">any rule of agency organization, procedure,
				or practice that does not substantially affect the rights or obligations of
				non-agency parties; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFE0B4B464FFC448F9AFE664AFF051DF1"><enum>(D)</enum><text display-inline="yes-display-inline">a rule that is promulgated by the Board of
				Governors of the Federal Reserve System or the Federal Open Market Committee
				under section 10A, 10B, 13, 13A, or 19 of the Federal Reserve Act, or any of
				subsections (a) through (f) of section 14 of that Act.</text>
								</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H429FC5FF17A949B7AEC672BE2857E1F6" section-type="subsequent-section"><enum>805.</enum><header display-inline="yes-display-inline">Judicial review</header>
							<subsection id="HB0E7B7A3F0DC4EA5BB7EFC2C836668D4"><enum>(a)</enum><text display-inline="yes-display-inline">No determination, finding, action, or
				omission under this chapter shall be subject to judicial review.</text>
							</subsection><subsection id="H255B59D5D3D142E4991BEE5D368C24AD"><enum>(b)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), a court may
				determine whether a Federal agency has completed the necessary requirements
				under this chapter for a rule to take effect.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="HC0C9190CDC8C4CD2BCCFA6A9FFAC6194" section-type="subsequent-section"><enum>806.</enum><header display-inline="yes-display-inline">Exemption for monetary policy</header><text display-inline="no-display-inline">Nothing in this chapter shall apply to rules
				that concern monetary policy proposed or implemented by the Board of Governors
				of the Federal Reserve System or the Federal Open Market Committee.</text>
						</section><section commented="no" display-inline="no-display-inline" id="H70BFEE64398F4605BD290092F72C0D6B" section-type="subsequent-section"><enum>807.</enum><header display-inline="yes-display-inline">Effective date of certain
				rules</header><text display-inline="no-display-inline">Notwithstanding section
				801—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HF3CB0BD613994532BABFFC84FB10227C"><enum>(1)</enum><text display-inline="yes-display-inline">any rule that establishes, modifies, opens,
				closes, or conducts a regulatory program for a commercial, recreational, or
				subsistence activity related to hunting, fishing, or camping; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2B3E3C41F3634A31AF2F39A606412A62"><enum>(2)</enum><text display-inline="yes-display-inline">any rule other than a major rule which an
				agency for good cause finds (and incorporates the finding and a brief statement
				of reasons therefore in the rule issued) that notice and public procedure
				thereon are impracticable, unnecessary, or contrary to the public
				interest,</text>

				take effect at such time as the Federal agency promulgating the rule

			 regulatory relief</header>
			<section id="H38BC8F2056FA4621935664490FF351FF"><enum>501.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>EPA Regulatory Relief Act of
			 2011</short-title></quote>.</text>
			</section><section id="idB184CA82675D4236BB1680C016A1033C"><enum>502.</enum><header>Legislative
			 stay</header>
				<subsection id="H8A233E95E5494F53BE0E2476EE644ADF"><enum>(a)</enum><header>Establishment of
			 standards</header><text display-inline="yes-display-inline">In place of the
			 rules specified in subsection (b), and notwithstanding the date by which such
			 rules would otherwise be required to be promulgated, the Administrator of the
			 Environmental Protection Agency (referred to in this title as the
			 <term>Administrator</term>) shall—</text>
					<paragraph commented="no" id="H6B00C2D260554B67BF3DC329EB642625"><enum>(1)</enum><text display-inline="yes-display-inline">propose regulations for industrial,
			 commercial, and institutional boilers and process heaters, and commercial and
			 industrial solid waste incinerator units, subject to any of the rules specified
			 in subsection (b)—</text>
						<subparagraph commented="no" id="H7AEE21CB50984264A361F3884ABD1578"><enum>(A)</enum><text>establishing
			 maximum achievable control technology standards, performance standards, and
			 other requirements under sections 112 and 129, as applicable, of the
			 <act-name>Clean Air Act</act-name> (42 U.S.C. 7412, 7429); and</text>
						</subparagraph><subparagraph commented="no" id="H48C06FE64E0C4E0BB55EF0B2DAA69342"><enum>(B)</enum><text>identifying
			 nonhazardous secondary materials that, when used as fuels or ingredients in
			 combustion units of such boilers, process heaters, or incinerator units are
			 solid waste under the Solid Waste Disposal Act (42 U.S.C. 6901 et seq.)
			 (commonly known as the <quote><act-name>Resource Conservation and Recovery
			 Act</act-name></quote>) for purposes of determining the extent to which such
			 combustion units are required to meet the emissions standards under section 112
			 of the <act-name>Clean Air Act</act-name> (42 U.S.C. 7412) or the emission
			 standards under section 129 of that Act (42 U.S.C. 7429); and</text>
						</subparagraph></paragraph><paragraph id="H17E70A7925004A35971CC30DA7A52CC2"><enum>(2)</enum><text display-inline="yes-display-inline">finalize the regulations on the date that
			 is 15 months after the date of enactment of this Act, or on such later date as
			 may be determined by the Administrator.</text>
					</paragraph></subsection><subsection id="HE5B0B9A4A23D42EEBA1902274547F1C5"><enum>(b)</enum><header>Stay of earlier
			 rules</header><text>The following rules are of no force or effect, shall be
			 treated as though the rules had never taken effect, and shall be replaced as
			 described in subsection (a):</text>

			 <quote>National Emission Standards for Hazardous Air Pollutants for Major

					</paragraph><paragraph id="H725B44AFCE4E43AFB350352C25C71B2D"><enum>(2)</enum><text>The rule entitled
			 <quote>National Emission Standards for Hazardous Air Pollutants for Area
			 Sources: Industrial, Commercial, and Institutional Boilers</quote> (76 Fed.

					</paragraph></subsection><subsection id="HCA400940AD464EE1A7BD1CD2F078A440"><enum>(c)</enum><header>Inapplicability
			 of certain provisions</header><text>With respect to any standard required by
			 subsection (a) to be promulgated in regulations under section 112 of the
			 <act-name>Clean Air Act</act-name> (42 U.S.C. 7412), the provisions of
			 subsections (g)(2) and (j) of that section shall not apply prior to the
			 effective date of the standard specified in those regulations.</text>
				</subsection></section><section commented="no" id="HD0BCCE6542E840668D585EAAE2F2552A"><enum>503.</enum><header>Compliance
			 dates</header>
				<subsection id="H9DE3C932AF9842B6856B9E21611D58DC"><enum>(a)</enum><header>Establishment of
			 compliance dates</header><text display-inline="yes-display-inline">For each
			 regulation promulgated pursuant to section 702, the Administrator—</text>
					<paragraph id="HE2BE757C8E0C4D20A7947DA922977D1B"><enum>(1)</enum><text>shall establish a
			 date for compliance with standards and requirements under such regulation that
			 is, notwithstanding any other provision of law, not earlier than 5 years after
			 the effective date of the regulation; and</text>
					</paragraph><paragraph id="H8F35E6B9258A4CAC9B021551C35D3F00"><enum>(2)</enum><text>in proposing a
			 date for such compliance, shall take into consideration—</text>
						<subparagraph id="H67483967B7B344409259075824FF9EF0"><enum>(A)</enum><text>the costs of
			 achieving emissions reductions;</text>
						</subparagraph><subparagraph id="H90F5FC2695E449B2B5022E3CB6FEF880"><enum>(B)</enum><text>any nonair quality
			 health and environmental impact and energy requirements of the standards and
			 requirements;</text>
						</subparagraph><subparagraph commented="no" id="HEEEE1EEBEE6D4947BD50D38939E3659E"><enum>(C)</enum><text>the feasibility of
			 implementing the standards and requirements, including the time needed—</text>
							<clause id="HCF6BD0EF93084A6EB38F32E87E8D9091"><enum>(i)</enum><text>to
			 obtain necessary permit approvals; and</text>
							</clause><clause id="HB5C7CC7B9359478FA2BF8A75BF4BECE8"><enum>(ii)</enum><text>to
			 procure, install, and test control equipment;</text>
							</clause></subparagraph><subparagraph id="HE8111FDDA20B427D90808982720F1DE0"><enum>(D)</enum><text>the availability
			 of equipment, suppliers, and labor, given the requirements of the regulation
			 and other proposed or finalized regulations of the Environmental Protection
			 Agency; and</text>
						</subparagraph><subparagraph id="HFFBE97569B9F48BD9B2BE7BBC9745ED1"><enum>(E)</enum><text>potential net
			 employment impacts.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFE92D1754C9A438DBEB668DB86874F5D"><enum>(b)</enum><header>New
			 sources</header><text display-inline="yes-display-inline">The date on which the
			 Administrator proposes a regulation pursuant to section 702(a)(1) establishing
			 an emission standard under section 112 or 129 of the <act-name>Clean Air
			 Act</act-name> (42 U.S.C. 7412, 7429) shall be treated as the date on which the
			 Administrator first proposes such a regulation for purposes of applying the
			 definition of a new source under section 112(a)(4) of that Act (42 U.S.C.
			 7412(a)(4)) or the definition of a new solid waste incineration unit under
			 section 129(g)(2) of that Act (42 U.S.C. 7429(g)(2)).</text>
				</subsection><subsection id="H095E55D9F7F34112A861A6C7925E59E0"><enum>(c)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 title restricts or otherwise affects paragraph (3)(B) or (4) of section 112(i)
			 of the <act-name>Clean Air Act</act-name> (42 U.S.C. 7412(i)).</text>
				</subsection></section><section commented="no" id="H83C269FCAB1E4412AD6AF90552623420"><enum>504.</enum><header>Energy recovery
			 and conservation</header>
				<subsection id="idF15AF6DC418F4A7C999B7605EB442E9A"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, to ensure the
			 recovery and conservation of energy consistent with the <act-name>Solid Waste
			 Disposal Act</act-name> (42 U.S.C. 6901 et seq.) (commonly known as the
			 <quote><act-name>Resource Conservation and Recovery Act of
			 1976</act-name></quote>), in promulgating regulations under section 702(a) that
			 address the subject matter of the regulations described in paragraphs (3) and
			 (4) of section 702(b), the Administrator shall—</text>
					<paragraph commented="no" id="H1EEC1074BC9F468E8567BA93550B5B82"><enum>(1)</enum><text>adopt the
			 definitions of the terms <term>commercial and industrial solid waste
			 incineration unit</term>, <term>commercial and industrial waste</term>, and
			 <term>contained gaseous material</term> contained in the regulation entitled
			 <quote>Standards of Performance for New Stationary Sources and Emission
			 Guidelines for Existing Sources: Commercial and Industrial Solid Waste
			 Incineration Units</quote> (65 Fed. Reg. 75338 (December 1, 2000)); and</text>
					</paragraph><paragraph commented="no" id="HF305132071A242C996E7C1F794474091"><enum>(2)</enum><text>identify
			 nonhazardous secondary material as not to be solid waste for purposes of the
			 <act-name>Solid Waste Disposal Act</act-name> (42 U.S.C. 6901 et seq.)
			 if—</text>
						<subparagraph commented="no" id="H7D74DBE4264E4347B845BB8FA6D9D645"><enum>(A)</enum><text>the
			 material—</text>
							<clause commented="no" id="idBEC4E195ED3F47D49D06CB75DEFC4B1D"><enum>(i)</enum><text>does not meet the
			 definition of commercial and industrial waste; and</text>
							</clause><clause commented="no" id="id35A12D14C2964C0D8CFD34174B3695D4"><enum>(ii)</enum><text>is on the list
			 published by the Administrator under subsection (b); or</text>
							</clause></subparagraph><subparagraph commented="no" id="id73B4082B7F3143CD8DEA6B2370523ABA"><enum>(B)</enum><text>in the case of
			 the material that is a gas, the material does not meet the definition of
			 contained gaseous material.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="id536E774A91FC4AB0B2F31A9145145129"><enum>(b)</enum><header>List of
			 nonhazardous secondary materials</header>
					<paragraph commented="no" id="idE289C1CF38EF4A60A45B364E8F2647F3"><enum>(1)</enum><header>In
			 general</header><text>Not later than 120 days after the date of enactment of
			 this Act, the Administrator shall publish a list of nonhazardous secondary
			 materials that are not solid waste when combusted in units designed for energy
			 recovery, including—</text>
						<subparagraph commented="no" id="id043E751C89C84D36930550C4305AD087"><enum>(A)</enum><text>without
			 limitation, all forms of biomass, including—</text>
							<clause commented="no" id="idE7FBBD9605DE48258891F724EB23B4BA"><enum>(i)</enum><text>agricultural and
			 forest-derived biomass;</text>
							</clause><clause commented="no" id="id63244FE3D6FB41E09666E105B7859C72"><enum>(ii)</enum><text>biomass crops,
			 vines, and orchard trees;</text>
							</clause><clause commented="no" id="idA08523649E78483EBF904F10B8E659B4"><enum>(iii)</enum><text>bagasse and
			 other crop and tree residues, including—</text>
								<subclause commented="no" id="id74CCD0D613EF49EAB2F5A73776DA92AA"><enum>(I)</enum><text>hulls and
			 seeds;</text>
								</subclause><subclause commented="no" id="id6A6A3E4305074ACDAB35D7947057C9EA"><enum>(II)</enum><text>spent
			 grains;</text>

			 cotton;</text>
								</subclause><subclause commented="no" id="id3B82E9307202433B86036D5B7D9E61A3"><enum>(IV)</enum><text>corn and peanut
			 production;</text>
								</subclause><subclause commented="no" id="idD098D77AFF2746248303C342EC5CA30F"><enum>(V)</enum><text>rice milling and
			 grain elevator operations;</text>
								</subclause><subclause commented="no" id="idC13AEA86E9CF4C65BA87CA0271F274A4"><enum>(VI)</enum><text>cellulosic
			 biofuels; and</text>
								</subclause><subclause commented="no" id="id05612E05777B49468A33B19BE9656604"><enum>(VII)</enum><text>byproducts of
			 ethanol natural fermentation processes;</text>
								</subclause></clause><clause commented="no" id="id9EEF9BAEC7614B43B50B357B9E548599"><enum>(iv)</enum><text>hogged fuel,
			 including wood pallets, sawdust, and wood pellets;</text>
							</clause><clause commented="no" id="id847A6E0519F64421BA43AA9A22DAD225"><enum>(v)</enum><text>wood debris from
			 forests and urban areas;</text>
							</clause><clause commented="no" id="id070B5F2AC7F944F9B01B1B6C27FF1B50"><enum>(vi)</enum><text>resinated wood
			 and other resinated biomass-derived residuals, including trim, sanderdust,
			 offcuts, and woodworking residuals;</text>
							</clause><clause commented="no" id="id71468EBA11A349C3B2DD079E800C4859"><enum>(vii)</enum><text>creosote-treated,
			 borate-treated, sap-stained, and other treated wood;</text>
							</clause><clause commented="no" id="id7E6E1700CCB144D08E8F322D960B62D2"><enum>(viii)</enum><text>residuals from
			 wastewater treatment by the manufacturing industry, including process
			 wastewater with significant British thermal unit (<term>Btu</term>)
			 value;</text>
							</clause><clause commented="no" id="id42D58086C35C4944B4533B055562D404"><enum>(ix)</enum><text>paper and paper
			 or cardboard recycling residuals, including paper-derived fuel cubes, paper
			 fines, and paper and cardboard rejects;</text>
							</clause><clause commented="no" id="idC4E5BAA60E404F03BE672AED77C7A523"><enum>(x)</enum><text>turpentine,
			 turpentine derivatives, pine tar, rectified methanol, glycerine, lumber kiln
			 condensates, and wood char;</text>
							</clause><clause commented="no" id="id7103C2F76D1C4C5C8DD6131435E2E3F6"><enum>(xi)</enum><text>tall oil and
			 related soaps;</text>
							</clause><clause commented="no" id="idADEDB44FE9E943C9B9E6A07D1CFDFFCF"><enum>(xii)</enum><text>biogases or
			 bioliquids generated from biomass materials, wastewater operations, or landfill
			 operations;</text>
							</clause><clause commented="no" id="idFB8F8501E385491CB43C4AF886D65D96"><enum>(xiii)</enum><text>processed
			 biomass derived from construction and demolition debris for the purpose of fuel
			 production; and</text>
							</clause><clause commented="no" id="id03FD878EAF4D4E0D9B1BF3DB0E5D8AF6"><enum>(xiv)</enum><text>animal manure
			 and bedding material;</text>
							</clause></subparagraph><subparagraph commented="no" id="id34F93E22424E44558C6DC200FB8F859D"><enum>(B)</enum><text>solid and
			 emulsified paraffin;</text>
						</subparagraph><subparagraph commented="no" id="idA3EECBA127B547F0906589FD12054E3B"><enum>(C)</enum><text>petroleum and
			 chemical reaction and distillation byproducts and residues, alcohol, ink, and
			 nonhalogenated solvents;</text>
						</subparagraph><subparagraph commented="no" id="idB4182B286CFD44B2B1615A61AAD444DD"><enum>(D)</enum><text>tire-derived
			 fuel, including factory scrap tire and related material;</text>
						</subparagraph><subparagraph commented="no" id="id3A731B52CA90410D86B3892E39709089"><enum>(E)</enum><text>foundry sand
			 processed in thermal reclamation units;</text>
						</subparagraph><subparagraph commented="no" id="id1B045ED7B8F746FB81CD69EA7466AB87"><enum>(F)</enum><text>coal refuse and
			 coal combustion residuals;</text>
						</subparagraph><subparagraph commented="no" id="id344C59744C5B4E339E010029DF95E95E"><enum>(G)</enum><text>shredded cloth
			 and carpet scrap;</text>
						</subparagraph><subparagraph commented="no" id="idC01DBCF82E6A4D2F89789C1582313EEE"><enum>(H)</enum><text>latex paint
			 water, organic printing dyes and inks, recovered paint solids, and nonmetallic
			 paint sludges;</text>
						</subparagraph><subparagraph commented="no" id="id82100E3968104281A80971849B93B164"><enum>(I)</enum><text>nonchlorinated
			 plastics;</text>
						</subparagraph><subparagraph commented="no" id="id4B246EB0ADDD4C9E9E01211CFA8BEBB4"><enum>(J)</enum><text>all used oil that
			 qualifies as recycled oil under section 1004 of the <act-name>Solid Waste
			 Disposal Act</act-name> (42 U.S.C. 6903);</text>
						</subparagraph><subparagraph commented="no" id="idFAF422E6470347ACA2F9345FFDF458BC"><enum>(K)</enum><text>process densified
			 fuels that contain any of the materials described in this paragraph; and</text>
						</subparagraph><subparagraph commented="no" id="idC9EB29A17C104D3696A93B885922CC5A"><enum>(L)</enum><text>any other
			 specific or general categories of material that the Administrator determines
			 the combustion of which is for use as a fuel pursuant to paragraph (2).</text>
						</subparagraph></paragraph><paragraph commented="no" id="id07EBE3D0D7CB438A9E8B6E7A445BA136"><enum>(2)</enum><header>Additions to
			 the list</header>
						<subparagraph commented="no" id="idB0607DB34D594B44AA2CE770CC62A27F"><enum>(A)</enum><header>In
			 general</header><text>To provide greater regulatory certainty, the
			 Administrator may, after public notice and opportunity to comment, add
			 nonhazardous secondary materials to the list published under paragraph
			 (1)—</text>
							<clause commented="no" id="id47C9AF09756B40BD852D1B4C02E086E3"><enum>(i)</enum><text>as the
			 Administrator determines necessary; or</text>
							</clause><clause commented="no" id="id74FCFB2E74CF4244B63929AACE053D7D"><enum>(ii)</enum><text>based on a
			 petition submitted by any person.</text>
							</clause></subparagraph><subparagraph commented="no" id="idB8951141054C4755ABF007157FAEE715"><enum>(B)</enum><header>Response</header><text>Not
			 later than 120 days after receiving any petition under subparagraph (A)(ii),
			 the Administrator shall respond to the petition.</text>
						</subparagraph><subparagraph commented="no" id="idEFDE845B92A84F9581DD653478825EA1"><enum>(C)</enum><header>Requirements</header><text>In
			 making a determination under this paragraph, the Administrator may decline to
			 add a material to the list under paragraph (1) if the Administrator determines
			 that regulation under section 112 of the <act-name>Clean Air Act</act-name> (42
			 U.S.C. 7412) would not reasonably protect public health with an ample margin of
			 safety.</text>
						</subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="H020C92D34AF34538A7C314091C6CF5B5" section-type="subsequent-section"><enum>505.</enum><header>Other
			 provisions</header>
				<subsection id="H88F57DE98F664B54939F8AB94D3D0589"><enum>(a)</enum><header>Establishment of
			 standards achievable in practice</header><text>In promulgating rules under
			 section 702(a), the Administrator shall ensure that emissions standards for
			 existing and new sources established under section 112 or 129 of the
			 <act-name>Clean Air Act</act-name> (42 U.S.C. 7412, 7429), as applicable, can
			 be met under actual operating conditions consistently and concurrently with
			 emission standards for all other air pollutants regulated by the rule for the
			 source category, taking into account variability in actual source performance,
			 source design, fuels, inputs, controls, ability to measure the pollutant
			 emissions, and operating conditions.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HD016931A7DF84C29ADAE7126562DBE74"><enum>(b)</enum><header>Regulatory
			 alternatives</header><text display-inline="yes-display-inline">For each
			 regulation promulgated pursuant to section 702(a), from among the range of
			 regulatory alternatives authorized under the <act-name>Clean Air Act</act-name>
			 (42 U.S.C. 7401 et seq.) including work practice standards under section 112(h)
			 of that Act (42 U.S.C. 7412(h)), the Administrator shall impose the least
			 burdensome, consistent with the purposes of that Act and Executive Order 13563
			 (76 Fed. Reg. 3821 (January 21, 2011)).</text>
				</subsection></section></title><title id="idD9BB44EF5E23403E8435D0388D3F0B65"><enum>VI</enum><header>Regulatory
			 Time-Out</header>
			<section id="idFAC5404EAFD04810950AC4EA9E3674B5"><enum>601.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Regulatory Time-Out Act of
			 2011</short-title></quote>.</text>
			</section><section id="id12066A0B8C0942F1B8FFD7C7F65C5E5A"><enum>602.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title—</text>
				<paragraph id="idF7E22D65162E4AF1804CCE6647D9FA70"><enum>(1)</enum><text>the term
			 <term>agency</term> has the meaning given that term under section 3502(1) of
			 title 44, United States Code; and</text>
				</paragraph><paragraph id="id7A0B023E84F5471DB403C6C2A690EBDF"><enum>(2)</enum><text>the term
			 <term>covered regulation</term> means a final regulation that—</text>
					<subparagraph id="idE41ECEB0B41449049F9C3588362C149A"><enum>(A)</enum><text>directly or
			 indirectly increases costs on businesses in a manner which will have an adverse
			 effect on job creation, job retention, productivity, competitiveness, or the
			 efficient functioning of the economy;</text>
					</subparagraph><subparagraph id="id75F6643CC4FB4D44AFA74E716B792411"><enum>(B)</enum><text>is likely
			 to—</text>
						<clause id="ID06051fc840a44c9f8ca23be9d599b347"><enum>(i)</enum><text>have an annual
			 effect on the economy of $100,000,000 or more;</text>
						</clause><clause id="idE2381896F74F41C29FC9D76342387A3E"><enum>(ii)</enum><text>adversely affect
			 in a material way the economy, a sector of the economy, productivity,
			 competition, jobs, the environment, public health or safety, or State, local,
			 or tribal governments or communities;</text>
						</clause><clause id="ID6e214ff23946476db4d3be9708be750a"><enum>(iii)</enum><text>create a
			 serious inconsistency or otherwise interfere with an action taken or planned by
			 another agency;</text>
						</clause><clause id="ID257930d56e814a748aa0bf1df90614e3"><enum>(iv)</enum><text>materially alter
			 the budgetary impact of entitlements, grants, user fees, or loan programs or
			 the rights and obligations of recipients thereof; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDd50fc7449ce3495bbd51406ab552032d"><enum>(v)</enum><text>raise novel legal
			 or policy issues; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2E846FBAF6A147F28A826BBDCBBE7E5B"><enum>(C)</enum><text>did not take
			 effect before September 1, 2011.</text>
					</subparagraph></paragraph></section><section id="id61575B25547D4FA89E96AB57695A01EF"><enum>603.</enum><header>Time-out
			 period for regulations</header>
				<subsection id="idAAE2E259B49E4347AF811CBDDA86E247"><enum>(a)</enum><header>Prior
			 regulations</header><text display-inline="yes-display-inline">A covered
			 regulation that took effect before the date of enactment of this Act shall be
			 treated as though that regulation never took effect for the 1-year period
			 beginning on the date of enactment of this Act.</text>
				</subsection><subsection id="idE0747D5BBB7F4602A5BFC9E584625F79"><enum>(b)</enum><header>Prospective
			 regulations</header><text display-inline="yes-display-inline">A covered
			 regulation that has not taken effect before the date of enactment of this Act,
			 may not take effect during the 1-year period beginning on the date of enactment
			 of this Act.</text>
				</subsection></section><section id="id42C6A8F85CE0408BA78429245F1C5BA0"><enum>604.</enum><header>Exemptions</header>
				<subsection id="idA3B78F6BB43A410FA9C67F1659061D0C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The head of an agency
			 may exempt a covered regulation prescribed by that agency from the application
			 of section 603, if the head of the agency—</text>
					<paragraph id="id6F6149E794CC4B22850058C748158978"><enum>(1)</enum><text display-inline="yes-display-inline">makes a specific finding that the covered
			 regulation—</text>
						<subparagraph id="idE3D462196809463BA3E86BCB5E9E2127"><enum>(A)</enum><text display-inline="yes-display-inline">is necessary due to an imminent threat to
			 human health or safety, or any other emergency;</text>
						</subparagraph><subparagraph id="idDE9BA626C8A74642B9E9CACBBAD7F8EC"><enum>(B)</enum><text display-inline="yes-display-inline">is necessary for the enforcement of a
			 criminal law;</text>
						</subparagraph><subparagraph id="idECB891CAEE0348E8B938B89663694B92"><enum>(C)</enum><text>has as its
			 principal effect—</text>
							<clause id="id16A1121D53C5484392E91269CAD84C55"><enum>(i)</enum><text>fostering private
			 sector job creation and the enhancement of the competitiveness of workers in
			 the United States;</text>
							</clause><clause id="idACC8E6DA80F8451F8C1FFE7D673C2708"><enum>(ii)</enum><text>encouraging
			 economic growth; or</text>
							</clause><clause id="idC492E3DBED774454B54624A72D0A3FCA"><enum>(iii)</enum><text>repealing,
			 narrowing, or streamlining a rule, regulation, or administrative process, or
			 otherwise reducing regulatory burdens;</text>
							</clause></subparagraph><subparagraph id="idDC068DBF86704EC48C0772763281FF28"><enum>(D)</enum><text>pertains to a
			 military or foreign affairs function of the United States; or</text>
						</subparagraph><subparagraph id="idFBA6CB04E4FD4DB3B23EEFE8C51ADFD2"><enum>(E)</enum><text>is limited to
			 interpreting, implementing, or administering the Internal Revenue Code of 1986;
			 and</text>
						</subparagraph></paragraph><paragraph id="idACDC3758344747C591FFD86B3FBAE4B2"><enum>(2)</enum><text>submits the
			 finding to Congress and publishes the finding in the Federal Register.</text>
					</paragraph></subsection><subsection id="idF9DD360D96B0491CAE243350ABF941E6"><enum>(b)</enum><header>Review</header><text>Not
			 later than 10 days after the date of enactment of this Act each agency shall
			 submit any covered regulation that the head of the agency determines is exempt
			 under this section to the Office of Management and Budget and Congress.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id6DE235FD9D2A4F22B08732C00DB0E5F0"><enum>(c)</enum><header>Nondelegable
			 authority</header><text>The head of an agency may not delegate the authority
			 provided under this section to exempt the application of any provision of this
			 title.</text>
				</subsection></section></title><title id="id9EA35A18E41C4B9BA3E7ACAEE92FCF89"><enum>VII</enum><header>Rescission of
			 Unspent Federal Funds to Offset Loss in Revenues</header>
			<section id="idAEE7A8DF4B2E44A8AAF456964EF3B8C9"><enum>701.</enum><header>Rescission</header>
				<subsection id="idAB648EF7BEEE4D768FAF6110894DCF94"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, except as
			 provided in subsection (c), of all appropriated discretionary funds remaining
			 unobligated as of the date of enactment of this Act, $40,000,000,000 is
			 rescinded.</text>
				</subsection><subsection id="ID960057cbe1d04e69b74cf51f70d3fc80"><enum>(b)</enum><header>Implementation</header>
					<paragraph id="id5574AF54BB704C2BB0743034566A1C30"><enum>(1)</enum><header>In
			 general</header><text>The Director of the Office of Management and Budget shall
			 determine and identify—</text>
						<subparagraph id="id20AEF83A2DAE4EBB86306AB012159108"><enum>(A)</enum><text>to which
			 appropriation accounts the rescission under subsection (a) shall apply;
			 and</text>
						</subparagraph><subparagraph id="id32474963B9E6494E8DC8F78298AEA788"><enum>(B)</enum><text>the amount of the
			 rescission that shall apply to each such account.</text>
						</subparagraph></paragraph><paragraph id="idFD0C3F5E83A7402191583E12489F5FA2"><enum>(2)</enum><header>Report</header><text>Not
			 later than 60 days after the date of enactment of this Act, the Director of the
			 Office of Management and Budget shall submit to Congress and the Secretary of
			 the Treasury a report that describes the accounts and amounts determined and
			 identified for rescission under paragraph (1).</text>
					</paragraph></subsection><subsection id="IDf607524eb8a640a4944384655aa79ab1"><enum>(c)</enum><header>Exception</header><text>This
			 section shall not apply to the unobligated funds of the Department of Defense,
			 the Corps of Engineers, or the Department of Veterans Affairs.</text>
