			<section id="IDb9188d4f1eee49b78dcce304a1fd892d"><enum>101.</enum><header>Extension of
			 funding for implementation of Geothermal Steam Act of 1970</header>
				<subsection id="ID61f54dffd0bf4ebdbc0ea5a5a6faf9c8"><enum>(a)</enum><header>In
			 general</header><text>Section 234(a) of the Energy Policy Act of 2005 (42
			 U.S.C. 15873(a)) is amended by striking <quote>in the first 5 fiscal years
			 beginning after the date of enactment of this Act</quote> and inserting
			 <quote>through fiscal year 2020</quote>.</text>
				</subsection><subsection id="ID53078b1dcb8c4f8393937e1054dc328f"><enum>(b)</enum><header>Authorization</header><text>Section
			 234(b) of the Energy Policy Act of 2005 (42 U.S.C. 15873(b)) is amended—</text>
					<paragraph id="ID63a84325faed49d09dd63e23581eb75b"><enum>(1)</enum><text>by striking
			 <quote>Amounts</quote> and inserting the following:</text>

				general</header><text>Amounts</text>

			 end the following:</text>

							<paragraph id="ID4c7546a000fb4d56bd6fc143f4a147df"><enum>(2)</enum><header>Authorization</header><text>Effective
				for fiscal year 2011 and each fiscal year thereafter, amounts deposited under
				subsection (a) shall be available to the Secretary of the Interior for
				expenditure, subject to appropriation and without fiscal year limitation, to
				implement the Geothermal Steam Act of 1970 (30 U.S.C. 1001 et seq.) and this
				Act.</text>

					</paragraph></subsection></section></title><title id="idF9BD990153844FD2A0E74106A5DF1038"><enum>II</enum><header>Development of
			 solar and wind energy on public land</header>
			<section id="IDb6fcf8fbd1424f3eb2f00d8551e849db"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="ID3c5029b0b2914c368d9c8cf6fe168bb5"><enum>(1)</enum><header>Covered
			 land</header><text>The term <term>covered land</term> means land that
			 is—</text>
					<subparagraph id="ID3178bbaad52540fba3c0e12f8b73c38c"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id90D5915A07E4452EAFD94A5C678151F5"><enum>(i)</enum><text>public land
			 administered by the Secretary; or</text>
						</clause><clause id="ID319dccfec70c4f3db4b22ef6897fe17e" indent="up1"><enum>(ii)</enum><text>National Forest System land
			 administered by the Secretary of Agriculture; and</text>
						</clause></subparagraph><subparagraph id="ID34ca17360f854bba9c3abfc0750c3268"><enum>(B)</enum><text>not excluded from
			 the development of solar or wind energy under—</text>
						<clause id="ID8321e0a1de424a6eb2d2fd2b734105f5"><enum>(i)</enum><text>a
			 land use plan established under the Federal Land Policy and Management Act of
			 1976 (43 U.S.C. 1701 et seq.);</text>
						</clause><clause id="IDab9d677ce3e4442c9b9d539e2ee5ed46"><enum>(ii)</enum><text>a
			 land use plan established under the National Forest Management Act of 1976 (16
			 U.S.C. 1600 et seq.); or</text>
						</clause><clause id="ID58d64954a52e4fc48676dba12c232597"><enum>(iii)</enum><text>other
			 law.</text>
						</clause></subparagraph></paragraph><paragraph id="ID2f9ec0a2366c414397ed36563684831e"><enum>(2)</enum><header>Pilot
			 program</header><text>The term <term>pilot program</term> means the wind and
			 solar leasing pilot program established under section 204(a).</text>
				</paragraph><paragraph id="ID76be59bde5264c438e0f61cce7940579"><enum>(3)</enum><header>Public
			 land</header><text>The term <term>public land</term> has the meaning given the
			 term <quote>public lands</quote> in section 103 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1702).</text>
				</paragraph><paragraph id="ID4f4f832f973e45678962b66943aaf3ed"><enum>(4)</enum><header>Secretaries</header><text>The
			 term <term>Secretaries</term> means—</text>
					<subparagraph id="ID6b9b29d786a74e6c838b4428e302f5b4"><enum>(A)</enum><text>in the case of
			 public land administered by the Secretary, the Secretary; and</text>
					</subparagraph><subparagraph id="IDc9259834f93b45a598e22ff6532cbf05"><enum>(B)</enum><text>in the case of
			 National Forest System land administered by the Secretary of Agriculture, the
			 Secretary of Agriculture.</text>
					</subparagraph></paragraph><paragraph id="ID68b0723f8cd1429d83bde40537ff223b"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph></section><section id="IDfaa48d95e1e44dcb8b8cd2fc38a08894"><enum>202.</enum><header>Programmatic
			 environmental impact statements and land use planning</header>
				<subsection id="ID90eea011707a42e39ef9b0cafd02d0dc"><enum>(a)</enum><header>Public
			 land</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Secretary shall—</text>
					<paragraph id="IDd69c4c97ae2e47758cb2b7dc882ff47c"><enum>(1)</enum><text>complete and
			 finalize the Programmatic Environmental Impact Statement for Solar Energy
			 Development in Six Southwestern States (BLM/DES 10–59; DOE/EIS–0403) in
			 accordance with the National Environmental Policy Act of 1969 (42 U.S.C. 4321
			 et seq.) to analyze the potential impacts of—</text>
						<subparagraph id="ID2948e16402ed4b2fa7898ace86b7bc5a"><enum>(A)</enum><text>a program to
			 develop solar energy on land administered by the Secretary, acting through the
			 Bureau of Land Management; and</text>
						</subparagraph><subparagraph id="ID3bb4e5e73fb244b8bdab609a6ef75990"><enum>(B)</enum><text>any necessary
			 amendments to land use plans for the land; and</text>
						</subparagraph></paragraph><paragraph id="IDcb9e2c86d9d4442bae6f01bd5347719a"><enum>(2)</enum><text>amend any land
			 use plans as appropriate to provide for the development of renewable energy in
			 areas considered appropriate by the Secretary.</text>
					</paragraph></subsection><subsection id="IDd2315dfce8c54fc0ac70a361ab003848"><enum>(b)</enum><header>National forest
			 system land</header><text>As soon as practicable but not later than 2 years
			 after the date of enactment of this Act, the Secretary of Agriculture
			 shall—</text>
					<paragraph id="IDff269ac12d0442308dc4c2379e28a3de"><enum>(1)</enum><text>prepare and
			 publish in the Federal Register a notice of intent to prepare a programmatic
			 environmental impact statement in accordance with the National Environmental
			 Policy Act of 1969 (42 U.S.C. 4321 et seq.) to analyze the potential impacts
			 of—</text>
						<subparagraph id="ID229167cc0cd746fb9fc2c72efdb6dee8"><enum>(A)</enum><text>a program to
			 develop solar and wind energy on National Forest System land administered by
			 the Secretary of Agriculture; and</text>
						</subparagraph><subparagraph id="ID1558929abd174a1ba6165cfd45832e81"><enum>(B)</enum><text>any necessary
			 amendments to land use plans for the land; and</text>
						</subparagraph></paragraph><paragraph id="IDfc187491e4e741158068a47506bec894"><enum>(2)</enum><text>amend any land
			 use plans as appropriate to provide for the development of renewable energy in
			 areas considered appropriate by the Secretary of Agriculture immediately on
			 completion of the programmatic environmental impact statement.</text>
					</paragraph></subsection><subsection id="IDdbea66f95d974adfbca4b8caf8a829ab"><enum>(c)</enum><header>Effect on
			 processing applications</header><text>The requirement for completion of
			 programmatic environmental impact statements under this section shall not
			 result in any delay in processing or approving applications for wind or solar
			 development on public land administered by the Secretary or on National Forest
			 System land.</text>
				</subsection><subsection id="ID83c1d0359b1a4fb19137f366a0be3d60"><enum>(d)</enum><header>Military
			 installations</header>
					<paragraph id="IDd54689f63e7348259d10992a59364749"><enum>(1)</enum><header>Report</header>
						<subparagraph id="id80F26F1F34D44480A56085A4BB3D859E"><enum>(A)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Secretary of Defense, in consultation with the Secretary of the
			 Interior, shall conduct a study, and prepare a report, that—</text>
							<clause id="ID9ba08759790b44b390f539c393dc41e8"><enum>(i)</enum><text>identifies
			 locations on land withdrawn from the public domain and reserved for military
			 purposes that—</text>
								<subclause id="IDd2f72ca36e334ad28b676a8c1e0a6579"><enum>(I)</enum><text>exhibit a high
			 potential for solar, wind, geothermal, or other renewable energy
			 production;</text>
								</subclause><subclause id="ID758d791cb566483fb5e20e1d4a62dd19"><enum>(II)</enum><text>are disturbed or
			 otherwise have comparatively low value for other resources; and</text>
								</subclause><subclause id="ID473580381d454dcc86c9f28db16f0df3"><enum>(III)</enum><text>could be
			 developed for renewable energy production in a manner consistent with all
			 present and reasonably foreseeable military training and operational missions
			 and research, development, testing, and evaluation requirements; and</text>
								</subclause></clause><clause id="IDde4a1f2b8f424fd3969fc5b7664b0cca"><enum>(ii)</enum><text>describes the
			 administration of public land withdrawn for military purposes for the
			 development of commercial-scale renewable energy projects, including the legal
			 authorities governing authorization for that use.</text>
							</clause></subparagraph><subparagraph id="ID35fc7acfcca346e39447f92913ea9f5c"><enum>(B)</enum><header>Recommendations</header><text>The
			 report shall include recommendations on—</text>
							<clause id="ID7e95a586ac394558976749457fe60380"><enum>(i)</enum><text>necessary changes
			 in any law (including regulations);</text>
							</clause><clause id="ID7dff320dff3841a38aa73bc5ef91f1e2"><enum>(ii)</enum><text>whether the
			 authorization for the use of the land for development of renewable energy
			 projects should be pursuant to lease, contract, right-of-way, permit, or other
			 form of authorization;</text>
							</clause><clause id="ID5af58d75557a4caca83f858abe135bee"><enum>(iii)</enum><text>methods of
			 improving coordination among the Federal, State, and local agencies, if any,
			 involved in authorizing the projects; and</text>
							</clause><clause id="IDd82d04c0c22b42c3a1560e5c054ee4c0"><enum>(iv)</enum><text>disposition of
			 revenues resulting from the development of renewable energy projects on the
			 land.</text>
							</clause></subparagraph></paragraph><paragraph id="IDb96658b4f6c046d7b4da0640fb144d2c"><enum>(2)</enum><header>Environmental
			 impact analysis</header><text>Not later than 1 year after the completion of the
			 study required by paragraph (1), the Secretary of Defense, in consultation with
			 the Secretary of the Interior, shall prepare and publish in the Federal
			 Register a notice of intent to prepare an environmental impact analysis
			 document to support a program to develop renewable energy on withdrawn military
			 land identified in the study as suitable for the production.</text>
					</paragraph><paragraph id="ID4c6bf62b5cea4047804fd0c37ad6728a"><enum>(3)</enum><header>Reports</header><text>On
			 completion of the report, the Secretary and the Secretary of Defense shall
			 jointly submit the report required by paragraph (1) to—</text>
						<subparagraph id="ID30ad1095d14a4ef9ab00fddcd9393fbc"><enum>(A)</enum><text>the Committee on
			 Armed Services of the Senate;</text>
						</subparagraph><subparagraph id="IDc961055ea8974e20908e0bd9f9b34833"><enum>(B)</enum><text>the Committee on
			 Energy and Natural Resources of the Senate;</text>
						</subparagraph><subparagraph id="ID081d56ae581f4ccdb7cabd2312a091bb"><enum>(C)</enum><text>the Committee on
			 Armed Services of the House of Representatives; and</text>
						</subparagraph><subparagraph id="IDb98f52d27d5d423994174070e5e270f2"><enum>(D)</enum><text>the Committee on
			 Natural Resources of the House of Representatives.</text>
						</subparagraph></paragraph></subsection></section><section id="ID78466780004e49afa77ad7ecc5a78af1"><enum>203.</enum><header>Development of
			 solar and wind energy on public land</header>
				<subsection id="ID89d87e0aafeb4556b721293a4db1ed5f"><enum>(a)</enum><header>Pilot
			 program</header>
					<paragraph id="IDd9cea6a9fdff4b05a6764e410fef8423"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Secretary shall establish a wind and solar leasing pilot program
			 on covered land administered by the Secretary.</text>
					</paragraph><paragraph id="ID6d892e5f548d48b48d6ed67ef79cdc8c"><enum>(2)</enum><header>Selection of
			 sites</header>
						<subparagraph id="ID26934c89c25d40cb8a0028e8f6f36db7"><enum>(A)</enum><header>In
			 general</header><text>Not later than 90 days after the date the pilot program
			 is established under this subsection, the Secretary shall (taking into
			 consideration the multiple resource values of the land) select 2 sites that are
			 appropriate for the development of a solar energy project, and 2 sites that are
			 appropriate for the development of a wind energy project, on covered land
			 administered by the Secretary as part of the pilot program.</text>
						</subparagraph><subparagraph id="IDddfa96f034d64f39914cc8f7b085037a"><enum>(B)</enum><header>Site
			 selection</header><text>In carrying out subparagraph (A), the Secretary shall
			 seek to select sites—</text>
							<clause id="ID59ba2909a7ec49cf81326c738ddc43b6"><enum>(i)</enum><text>for
			 which there is likely to be a high level of industry interest;</text>
							</clause><clause id="ID7301dccb171146739b88f11aac1ca038"><enum>(ii)</enum><text>that have a
			 comparatively low value for other resources; and</text>
							</clause><clause id="ID7dd1f463c8f641a5a181522aa2a3acc5"><enum>(iii)</enum><text>that are
			 representative of sites on which solar or wind energy is likely to be developed
			 on covered land.</text>
							</clause></subparagraph><subparagraph id="IDd598a614f31e46878c87bb6171245053"><enum>(C)</enum><header>Ineligible
			 sites</header><text>The Secretary shall not select as part of the pilot program
			 any site for which a right-of way for site testing or construction has been
			 issued.</text>
						</subparagraph></paragraph><paragraph id="ID01daa6b49bb641b3a87c9e8b6a79ea2b"><enum>(3)</enum><header>Qualifications</header><text>Prior
			 to any lease sale, the Secretary shall establish qualifications for bidders
			 that ensure bidders—</text>
						<subparagraph id="ID491d2479eefc4f208bc8109a6263f83e"><enum>(A)</enum><text>are able to
			 expeditiously develop a wind or solar energy project on the site for
			 lease;</text>
						</subparagraph><subparagraph id="ID322aa85a8eb942ebb3215bd25d7d9158"><enum>(B)</enum><text>possess—</text>
							<clause id="ID63addebcaa934bbca97920e0642907c8"><enum>(i)</enum><text>financial
			 resources necessary to complete a project;</text>
							</clause><clause id="ID22ebd84f39ed489f945fabe784b0f22d"><enum>(ii)</enum><text>knowledge of the
			 applicable technology; and</text>
							</clause><clause id="ID3d685cc099614c2f805c13e04dbc114b"><enum>(iii)</enum><text>such other
			 qualifications as are determined appropriate by the Secretary; and</text>
							</clause></subparagraph><subparagraph id="ID269322be1e8d4793b217e34b937aba4b"><enum>(C)</enum><text>meet the
			 eligibility requirements for leasing under the first section of the Mineral
			 Leasing Act (30 U.S.C. 181).</text>
						</subparagraph></paragraph><paragraph id="ID5d01b3f69f5e4583825e5becdda8268b"><enum>(4)</enum><header>Lease
			 sales</header>
						<subparagraph id="ID465e8fb3e512497ba146716b7086bf07"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (D)(ii), not later
			 than 180 days after the date sites are selected under paragraph (2), the
			 Secretary shall offer each site for competitive leasing to qualified bidders
			 under such terms and conditions as are required by the Secretary.</text>
						</subparagraph><subparagraph id="IDcc4d06c79eff48f7bffd57cadf5d6ad1"><enum>(B)</enum><header>Bidding
			 systems</header>
							<clause id="ID6ff182b2c2424718a5343cb34a000e52"><enum>(i)</enum><header>In
			 general</header><text>In offering the sites for lease, the Secretary may vary
			 the bidding systems to be used at each lease sale, including—</text>
								<subclause id="IDdae74d06f58149958c9afce7713cb61a"><enum>(I)</enum><text>cash bonus bids
			 with a requirement for payment of the royalty established under this
			 Act;</text>
								</subclause><subclause id="ID5917131a7d194384831e59c557fa8f7f"><enum>(II)</enum><text>variable royalty
			 bids based on a percentage of the gross proceeds from the sale of electricity
			 produced from the lease, except that the royalty shall not be less than the
			 royalty required under this Act, together with a fixed cash bonus; and</text>
								</subclause><subclause id="IDf35f4569a1d347baa57ac3819dae81fb"><enum>(III)</enum><text>such other
			 bidding system as ensures a fair return to the public consistent with the
			 royalty established under this Act.</text>
								</subclause></clause><clause id="IDc024e1a5037d461c8dac7e806972f4ce"><enum>(ii)</enum><header>Round</header><text>The
			 Secretary shall limit bidding to 1 round in any lease sale.</text>
							</clause><clause id="IDd74bc2a697a74dea83abd54a0ed87d59"><enum>(iii)</enum><header>Expenditures</header><text>In
			 any case in which the land that is subject to lease has 1 or more pending
			 applications for the development of wind or solar energy at the time of the
			 lease sale, the Secretary shall give credit toward any bid submitted by the
			 applicant for expenditures of the applicant considered by the Secretary to be
			 qualified and necessary for the preparation of the application.</text>
							</clause></subparagraph><subparagraph id="IDea38d8a9aaa74473af1885cbf0280e12"><enum>(C)</enum><header>Revenues</header><text>Bonus
			 bids, royalties, rentals, fees, or other payments collected by the Secretary
			 under this section shall be subject to section 5.</text>
						</subparagraph><subparagraph id="IDdb1b7b8593ac43feaf73e5fc4ee88ce2"><enum>(D)</enum><header>Lease
			 terms</header>
							<clause id="IDf1403b5478db4312a2239847464a1a05"><enum>(i)</enum><header>In
			 general</header><text>As part of the pilot program, the Secretary may vary the
			 length of the lease terms and establish such other lease terms and conditions
			 as the Secretary considers appropriate.</text>
							</clause><clause id="ID26b2936f49074b8885dcd2c31d4ee8ae"><enum>(ii)</enum><header>Data
			 collection</header><text>As part of the pilot program, the Secretary
			 shall—</text>
								<subclause id="IDc4306fc1af4240aa8feba38d60813c4c"><enum>(I)</enum><text>offer on a
			 noncompetitive basis on at least 1 site a short-term lease for data collection;
			 and</text>
								</subclause><subclause id="ID64c1e85907b84753ab861e974c45c252"><enum>(II)</enum><text>on the
			 expiration of the short-term lease, offer on a competitive basis a long-term
			 lease, giving credit toward the bonus bid to the holder of the short-term lease
			 for any qualified expenditures to collect data to develop the site during the
			 short-term lease.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="ID0a8bc8bb368f42d8b982895f6f3a6426"><enum>(5)</enum><header>Compliance with
			 laws</header><text>In offering for lease the selected sites under paragraph
			 (4), the Secretary shall comply with all applicable environmental and other
			 laws.</text>
					</paragraph><paragraph id="ID3f5d8225bc964ebfb176ede3653a3037"><enum>(6)</enum><header>Report</header><text>The
			 Secretary shall—</text>
						<subparagraph id="ID6e168bc1d2634682866d0d824e512156"><enum>(A)</enum><text>compile a report
			 of the results of each lease sale under the pilot program, including—</text>
							<clause id="IDfe8eeab111a74ffbad4c448ed0d51a5c"><enum>(i)</enum><text>the
			 level of competitive interest;</text>
							</clause><clause id="IDb42f774da6a74a918de4fae57eb48b53"><enum>(ii)</enum><text>a
			 summary of bids and revenues received; and</text>
							</clause><clause id="ID32a197ee9f85496998349d2a64ffd5e0"><enum>(iii)</enum><text>any other
			 factors that may have impacted the lease sale process; and</text>
							</clause></subparagraph><subparagraph id="ID7a1217c1c7a6493dbdfcbb5741208e1f"><enum>(B)</enum><text>not later than 90
			 days after the final lease sale, submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Natural Resources of the House of
			 Representatives the report described in subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="IDccb998a5e3ed4f47869093107297d748"><enum>(7)</enum><header>Rights-of-way</header><text>During
			 the pendency of the pilot program, the Secretary shall continue to issue
			 rights-of-way, in compliance with authority in effect on the date of enactment
			 of this Act, for available sites not selected for the pilot program.</text>
					</paragraph></subsection><subsection id="ID4c1ecaf94a9941f8a3bc98dcd88a0333"><enum>(b)</enum><header>Secretarial
			 determination</header>
					<paragraph id="ID659df86026714e4ab8116452d00c2e85"><enum>(1)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of
			 this Act, the Secretaries shall make a joint determination on whether to
			 establish a leasing program under this section for wind or solar energy, or
			 both, on all covered land.</text>
					</paragraph><paragraph id="ID879076e322e74c1da3bf236b5167250a"><enum>(2)</enum><header>System</header><text>If
			 the Secretaries determine that a leasing program should be established, the
			 program shall apply to all covered land in accordance with this Act and other
			 provisions of law applicable to public land or National Forest System
			 land.</text>
					</paragraph><paragraph id="IDd5d02d92367a4c21ade716d215dbfac0"><enum>(3)</enum><header>Establishment</header><text>The
			 Secretaries shall establish a leasing program unless the Secretaries determine
			 that the program—</text>
						<subparagraph id="ID6fadd88634124986b2d6a44e9431dba2"><enum>(A)</enum><text>is not in the
			 public interest; and</text>
						</subparagraph><subparagraph id="ID8abf87e5ac884e718a164c1e6ca07153"><enum>(B)</enum><text>does not provide
			 an effective means of developing wind or solar energy.</text>
						</subparagraph></paragraph><paragraph id="ID1dc0232ecb284de9a8cfb952dee9e0c8"><enum>(4)</enum><header>Consultation</header><text>In
			 making the determinations required under this subsection, the Secretaries shall
			 consult with—</text>
						<subparagraph id="ID841e6503dc9343fcb461f4460762f5b9"><enum>(A)</enum><text>the heads of
			 other relevant Federal agencies;</text>
						</subparagraph><subparagraph id="ID124aa0e5ee9643449a1e6cce4a34edca"><enum>(B)</enum><text>interested
			 States, Indian tribes, and local governments;</text>
						</subparagraph><subparagraph id="ID1e5ca28dfdac4e8796a824e342f6108b"><enum>(C)</enum><text>representatives
			 of the solar and wind industries;</text>
						</subparagraph><subparagraph id="ID62417b29887841fc912925674940223b"><enum>(D)</enum><text>representatives
			 of the environment, conservation, and outdoor sporting communities;</text>
						</subparagraph><subparagraph id="IDf9669220326d48b187ee1efbac1e7571"><enum>(E)</enum><text>other users of
			 the covered land; and</text>
						</subparagraph><subparagraph id="ID8f33f25a59c9494ab98d158ef3540e0c"><enum>(F)</enum><text>the
			 public.</text>
						</subparagraph></paragraph><paragraph id="ID482665f437ee40f1a756918a74e588c3"><enum>(5)</enum><header>Considerations</header><text>In
			 making the determinations required under this subsection, the Secretaries shall
			 consider the results of the pilot program.</text>
					</paragraph><paragraph id="ID08a9e7a5b31447deaeeaa7d01463290d"><enum>(6)</enum><header>Regulations</header><text>Not
			 later than 1 year after the date on which any determination is made to
			 establish a leasing program, the Secretaries shall jointly promulgate final
			 regulations to implement the program.</text>
					</paragraph><paragraph id="ID78211a5a36ef48438e1e3b1f48abc2b2"><enum>(7)</enum><header>Report</header><text>If
			 the Secretaries determine that a leasing program should not be established, not
			 later than 60 days after the date of the determination, the Secretaries shall
			 jointly submit to the Committee on Energy and Natural Resources of the Senate
			 and the Committee on Natural Resources of the House of Representatives a report
			 describing the basis and findings for the determination.</text>
					</paragraph></subsection><subsection id="ID59f25a1c75d14ac6b9c4cc39040a2890"><enum>(c)</enum><header>Transition</header>
					<paragraph id="ID5fabedb5c91a419ea282dd4e459b41b0"><enum>(1)</enum><header>In
			 general</header><text>If the Secretaries determine under subsection (b) that a
			 leasing program should be established for covered land, until the program is
			 established and final regulations for the program are issued—</text>
						<subparagraph id="IDbb2468eb460d47668b2b8d2e671dc2e9"><enum>(A)</enum><text>the Secretary
			 shall continue to accept applications for rights-of-way on covered land, and
			 provide for the issuance of rights-of-way on covered land within the
			 jurisdiction of the Secretary for the development of wind or solar energy
			 pursuant to each requirement described in title V of the Federal Land Policy
			 and Management Act of 1976 (43 U.S.C. 1761 et seq.) and other applicable law;
			 and</text>
						</subparagraph><subparagraph id="IDe958a870d78c4051a072216d02acd125"><enum>(B)</enum><text>the Secretary of
			 Agriculture shall continue to accept applications for authorizations, and
			 provide for the issuance of the authorizations, for the development of wind or
			 solar energy on covered land within the jurisdiction of the Secretary pursuant
			 to applicable law.</text>
						</subparagraph></paragraph><paragraph id="IDc29fbc57bc594d7fa04e3287243bca71"><enum>(2)</enum><header>Existing
			 rights-of-way and authorizations</header>
						<subparagraph id="IDe9c283fdb1bd4caea3f97cb7d61a5940"><enum>(A)</enum><header>In
			 general</header><text>Effective beginning on the date on which the wind or
			 solar leasing programs are established and final regulations are issued, the
			 Secretaries shall not renew an existing right-of-way or other authorization for
			 wind or solar energy development at the end of the term of the right-of-way or
			 authorization.</text>
						</subparagraph><subparagraph id="ID0de713c62a3f4848b3a50080df803cda"><enum>(B)</enum><header>Lease</header>
							<clause id="ID61045162cce6413283c1da77ed8bb8be"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), at the end of the term of the
			 right-of-way or other authorization for the wind or solar energy project, the
			 Secretary or, in the case of National Forest System land, the Secretary of
			 Agriculture, shall grant, without a competitive process, a lease to the holder
			 of the right-of-way or other authorization for the same covered land as was
			 authorized under the right-of-way or other authorization if (as determined by
			 the Secretary concerned)—</text>
								<subclause id="IDc2e5c0c8457749039549ef4b225270cd"><enum>(I)</enum><text>the holder of the
			 right-of-way or other authorization has met the requirements of diligent
			 development; and</text>
								</subclause><subclause id="ID2fcfad0495a548aeb8717dc2482215d1"><enum>(II)</enum><text>issuance of the
			 lease is in the public interest and consistent with applicable law.</text>
								</subclause></clause><clause id="ID060c52a5f9a844db833453d96fce9bd9"><enum>(ii)</enum><header>Terms and
			 conditions</header><text>Any lease described in clause (i) shall be subject
			 to—</text>
								<subclause id="ID1833c2c867c44b7da388d5a82787b346"><enum>(I)</enum><text>terms and
			 conditions that are consistent with this Act and the regulations issued under
			 this Act; and</text>
								</subclause><subclause id="ID9b2a2ed44aec4c9eb8915bb8274a6da3"><enum>(II)</enum><text>the regulations
			 in effect on the date of renewal and any other terms and conditions that the
			 Secretary considers necessary to protect the public interest.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="ID7b8f9a44ee48458688b0e8c2544cc1c6"><enum>(3)</enum><header>Pending
			 rights-of-way</header><text>Effective beginning on the date on which the wind
			 or solar leasing programs are established and final regulations for the
			 programs are issued, the Secretary or, with respect to National Forest System
			 land, the Secretary of Agriculture shall provide any applicant that has filed a
			 plan of development for a right-of-way or, in the case of National Forest
			 System land, for an applicable authorization, for a wind or solar energy
			 project with an option to acquire a lease on a noncompetitive basis, under such
			 terms and conditions as are required by this Act, applicable regulations, and
			 the Secretary concerned, for the same covered land included in the plan of
			 development if—</text>
						<subparagraph id="ID3387ca7f9e4b4548aaca03fb5dc6cf3e"><enum>(A)</enum><text>the plan of
			 development has been determined by the Secretary concerned to be adequate for
			 the initiation of environmental review;</text>
						</subparagraph><subparagraph id="IDcb7aca9c57574aa6ba232a05740f757a"><enum>(B)</enum><text>granting the
			 lease is consistent with all applicable land use planning, environmental, and
			 other laws;</text>
						</subparagraph><subparagraph id="ID2f13094f56f4462cbbc7012d72481e7b"><enum>(C)</enum><text>the applicant has
			 made a good faith effort to obtain a right-of-way or, in the case of National
			 Forest System land, other authorization, for the project; and</text>
						</subparagraph><subparagraph id="IDc04880da61fb4a5192df1b89ac14d4fb"><enum>(D)</enum><text>issuance of the
			 lease is in the public interest.</text>
						</subparagraph></paragraph></subsection><subsection id="ID7fe38039307d4f258dc9fa4d44ef1b37"><enum>(d)</enum><header>Leasing
			 program</header><text>If the Secretaries determine under subsection (b) that a
			 leasing program should be established, the program shall be established in
			 accordance with subsections (e) through (k).</text>
				</subsection><subsection id="IDd03a84c855a74182b1fcd8d46c6f7a26"><enum>(e)</enum><header>Competitive
			 leases</header>
					<paragraph id="IDe2e5f0a067834c2eba406e8255b5150f"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), leases for wind or
			 solar energy development under this section shall be issued on a competitive
			 basis with a single round of bidding in any lease sale.</text>
					</paragraph><paragraph id="IDe54f56a2f3034bb0bb65dca0b42ddd0e"><enum>(2)</enum><header>Exceptions</header><text>Paragraph
			 (1) shall not apply if the Secretary or, with respect to National Forest System
			 land, the Secretary of Agriculture determines that—</text>
						<subparagraph id="ID058b1b51667742909038669e7182ba5c"><enum>(A)</enum><text>no competitive
			 interest exists for the covered land;</text>
						</subparagraph><subparagraph id="IDb92f81a6c1394f1faa1352f4e24c2360"><enum>(B)</enum><text>the public
			 interest would not be served by the competitive issuance of a lease;</text>
						</subparagraph><subparagraph id="ID97546a0d83d847e7aa34322c09f75de3"><enum>(C)</enum><text>the lease is for
			 the placement and operation of a meteorological or data collection facility or
			 for the development or demonstration of a new wind or solar technology and has
			 a term of not more than 5 years; or</text>
						</subparagraph><subparagraph id="IDbe1f9e115e7d486994e3018f635dcbec"><enum>(D)</enum><text>the covered land
			 is eligible to be granted a noncompetitive lease under subsection (c).</text>
						</subparagraph></paragraph></subsection><subsection id="ID691e36046a8e406f83ae0b82b86822a5"><enum>(f)</enum><header>Payments</header>
					<paragraph id="ID839dee5a275f4e11b7bdd16d8ab57e9e"><enum>(1)</enum><header>In
			 general</header><text>The Secretaries shall jointly establish—</text>
						<subparagraph id="IDe917d9a6b1564d7fb2d42ccaece9de58"><enum>(A)</enum><text>fees, rentals,
			 bonuses, or other payments to ensure a fair return to the United States for any
			 lease issued under this section; and</text>
						</subparagraph><subparagraph id="ID9a94260aea1f4e10b30c7444d35c09ed"><enum>(B)</enum><text>royalties
			 pursuant to section 6 that apply to all leases issued under this
			 section.</text>
						</subparagraph></paragraph><paragraph id="IDbd42f400d2d24ab8b06e5d82a9058a7d"><enum>(2)</enum><header>Bonus
			 bids</header><text>The Secretaries may grant credit toward any bonus bid for a
			 qualified expenditure by the holder of a lease described in subsection
			 (e)(2)(C) in any competitive lease sale held for a long-term lease covering the
			 same land covered by the lease described in subsection (e)(2)(C).</text>
					</paragraph></subsection><subsection id="ID3ade6d0494584b11b5a4f4c9c477e41a"><enum>(g)</enum><header>Qualifications</header><text>Prior
			 to any lease sale, the Secretary shall establish qualifications for bidders
			 that ensure bidders meet the requirements described in section 4(a)(3).</text>
				</subsection><subsection id="ID1e7e9c1d0afd4d4ba73780a7099ae2c3"><enum>(h)</enum><header>Requirements</header><text>The
			 Secretaries shall ensure that any activity under a leasing program is carried
			 out in a manner that—</text>
					<paragraph id="ID8d4f4d4c65d449c6acf1a7ec52fd67d8"><enum>(1)</enum><text>is consistent
			 with all applicable land use planning, environmental, and other laws;
			 and</text>
					</paragraph><paragraph id="ID39321054d94549068ec386bc693fbb94"><enum>(2)</enum><text>provides
			 for—</text>
						<subparagraph id="IDee2a3570e2ec4194b511c6bc6b77df06"><enum>(A)</enum><text>safety;</text>
						</subparagraph><subparagraph id="IDde9e43d45fc6407097c14ececbb37b7c"><enum>(B)</enum><text>protection of the
			 environment and fish and wildlife habitat;</text>
						</subparagraph><subparagraph id="ID91d824081fcd4919aa922d7f32168cfc"><enum>(C)</enum><text>mitigation of
			 impacts;</text>
						</subparagraph><subparagraph id="ID835ce95d9cfc47fe9af2ff3e0a568b5d"><enum>(D)</enum><text>prevention of
			 waste;</text>
						</subparagraph><subparagraph id="ID869c86f9ec454ebba27e98fabb1ef0a3"><enum>(E)</enum><text>diligent
			 development of the resource, with specific milestones to be met by the lessee
			 as determined by the Secretaries;</text>
						</subparagraph><subparagraph id="ID3aa61cf26ed14bd18dcb3248af1ecb2b"><enum>(F)</enum><text>coordination with
			 applicable Federal agencies;</text>
						</subparagraph><subparagraph id="ID5b723115a7654b28b9cd72c8f6898789"><enum>(G)</enum><text>a fair return to
			 the United States for any lease;</text>
						</subparagraph><subparagraph id="ID8a6abc0578c24772bb840d39bd23e2b1"><enum>(H)</enum><text>use of best
			 management practices, including planning and practices for mitigation of
			 impacts;</text>
						</subparagraph><subparagraph id="ID663f6464042e4b269c294f226cff0658"><enum>(I)</enum><text>public notice and
			 comment on any proposal submitted for a lease under this section;</text>
						</subparagraph><subparagraph id="ID32591f9bec3545cd8c4f794df8f6b0b7"><enum>(J)</enum><text>oversight,
			 inspection, research, monitoring, and enforcement relating to a lease under
			 this section;</text>
						</subparagraph><subparagraph id="IDba6a8cd0637c4eb8858459e647675f93"><enum>(K)</enum><text>the quantity of
			 acreage to be commensurate with the size of the project covered by a lease;
			 and</text>
						</subparagraph><subparagraph id="IDffff3b68d1994e5190f589398d801070"><enum>(L)</enum><text>efficient use of
			 water resources.</text>
						</subparagraph></paragraph></subsection><subsection id="ID145f98ee8adf41a5be6c26abc719f6fa"><enum>(i)</enum><header>Lease duration,
			 suspension, and cancellation</header>
					<paragraph id="IDf4ee5714aab34245ba80e7ad3cb092a1"><enum>(1)</enum><header>Duration</header><text>A
			 lease under this section shall be for—</text>
						<subparagraph id="ID73e10d40d2394b68894876138adabc96"><enum>(A)</enum><text>an initial term
			 of 25 years; and</text>
						</subparagraph><subparagraph id="IDb47371e838df4a3e8363a3cc568ea25a"><enum>(B)</enum><text>any additional
			 period after the initial term during which electricity is being produced
			 annually in commercial quantities from the lease.</text>
						</subparagraph></paragraph><paragraph id="IDf567fd80d9f24be8a47cba3c1bbef737"><enum>(2)</enum><header>Administration</header><text>The
			 Secretary shall establish terms and conditions for the issuance, transfer,
			 renewal, suspension, and cancellation of a lease under this section.</text>
					</paragraph><paragraph id="IDe7e69f525c5443539d5d84fc42f6ff82"><enum>(3)</enum><header>Readjustment</header>
						<subparagraph id="ID98af19c7ff49449ea3b321c15d0ddc0c"><enum>(A)</enum><header>In
			 general</header><text>Royalties, rentals, and other terms and conditions of a
			 lease under this section shall be subject to readjustment—</text>
							<clause id="ID10b1cad326a545ab9eec4fd38ad037e4"><enum>(i)</enum><text>on
			 the date that is 15 years after the date on which the lease is issued;
			 and</text>
							</clause><clause id="IDf6a72e1ff9bd453293b1a01bc51b98c4"><enum>(ii)</enum><text>every 10 years
			 thereafter.</text>
							</clause></subparagraph><subparagraph id="ID86529d72adca4079991e3cca3992e917"><enum>(B)</enum><header>Lease</header><text>Each
			 lease issued under this Act shall provide for readjustment in accordance with
			 subparagraph (A).</text>
						</subparagraph></paragraph></subsection><subsection id="IDbb93da3afff9417784df60ffda09be9e"><enum>(j)</enum><header>Surface-Disturbing
			 activities</header><text>The Secretaries shall—</text>
					<paragraph id="ID4892132fe29749ebb480bc3cc02a864b"><enum>(1)</enum><text>regulate all
			 surface-disturbing activities conducted pursuant to any lease issued under this
			 section; and</text>
					</paragraph><paragraph id="IDa8028b5961c345e5bbee8e75e5c3b181"><enum>(2)</enum><text>require any
			 necessary reclamation and other actions under the lease as are required in the
			 interest of conservation of surface resources.</text>
					</paragraph></subsection><subsection id="ID21de45002c7d4868915cd2324547adfc"><enum>(k)</enum><header>Security</header><text>The
			 Secretaries shall require the holder of a lease issued under this
			 section—</text>
					<paragraph id="ID1eb65bd8bd1b4fadbbfbed1b53d7ece1"><enum>(1)</enum><text>to furnish a
			 surety bond or other form of security, as prescribed by the Secretaries;</text>
					</paragraph><paragraph id="IDa1c780e1738a4ab1ac69e6fa9a73da31"><enum>(2)</enum><text>to provide for
			 the reclamation and restoration of the area covered by the lease; and</text>
					</paragraph><paragraph id="ID5a7f7db63ae244caacc7f53343808ceb"><enum>(3)</enum><text>to comply with
			 such other requirements as the Secretaries consider necessary to protect the
			 interests of the public and the United States.</text>
					</paragraph></subsection><subsection id="ID6c7416509f6947d9bd153baa39b1f560"><enum>(l)</enum><header>Periodic
			 review</header><text>Not less frequently than once every 5 years, the Secretary
			 shall conduct a review of the adequacy of the surety bond or other form of
			 security provided by the holder of a lease issued under this section.</text>
				</subsection></section><section id="ID7a691c54f84b47889136f77cb81e55c1"><enum>204.</enum><header>Disposition of
			 revenues</header>
				<subsection id="ID2272c02ea46c4f1c82af64af4b323834"><enum>(a)</enum><header>Disposition of
			 revenues</header><text>Of the amounts collected as bonus bids, royalties,
			 rentals, fees, or other payments under a right-of-way, permit, lease, or other
			 authorization for the development of wind or solar energy on covered
			 land—</text>
					<paragraph id="IDe7a536d34a524cde9fe2fa59c5f437ac"><enum>(1)</enum><text>25 percent shall
			 be paid by the Secretary of the Treasury to the State within the boundaries of
			 which the income is derived;</text>
					</paragraph><paragraph id="IDcb04c738f1554049a31ea878d2f8edf7"><enum>(2)</enum><text>25 percent shall
			 be paid by the Secretary of the Treasury to the 1 or more counties within the
			 boundaries of which the income is derived;</text>
					</paragraph><paragraph id="IDa091c216df0042c38671d1e3a24d07f2"><enum>(3)</enum><text>15 percent
			 shall—</text>
						<subparagraph id="id8977799B04324E6087E086B7BC7B71F3"><enum>(A)</enum><text>for the period
			 beginning on the date of enactment of this Act and ending on date the date that
			 is 15 years after the date of enactment of this Act, be deposited in the
			 Treasury of the United States to help facilitate the processing of renewable
			 energy permits by the Bureau of Land Management, including the transfer of the
			 funds by the Bureau of Land Management to other Federal agencies and State
			 agencies to facilitate the processing of renewable energy permits on Federal
			 land; and</text>
						</subparagraph><subparagraph id="id25E8F50A553D4DEA97EBC89F74695FAD"><enum>(B)</enum><text>beginning on the
			 date that is 15 years after the date of enactment of this Act, be deposited in
			 the Fund; and</text>
						</subparagraph></paragraph><paragraph id="ID2c36132b353443849bbbda59aecae13e"><enum>(4)</enum><text>35 percent shall
			 be deposited in the Renewable Energy Resource Conservation Fund established by
			 subsection (c).</text>
					</paragraph></subsection><subsection id="ID54b5007339e74713a463159281b95787"><enum>(b)</enum><header>Payments to
			 States and counties</header>
					<paragraph id="ID9c69204e916f4433b7ea57c8f7156529"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), amounts paid to
			 States and counties under subsection (a) shall be used consistent with section
			 35 of the Mineral Leasing Act (30 U.S.C. 191).</text>
					</paragraph><paragraph id="ID1e59aaac41c44e46864af32bdf8f8f0d"><enum>(2)</enum><header>Impacts on
			 Federal land</header><text>Not less than 33 percent of the amount paid to a
			 State shall be used on an annual basis for the purposes described in subsection
			 (c)(2)(A).</text>
					</paragraph></subsection><subsection id="IDdb1d0b2489624db589b632428cc4b97c"><enum>(c)</enum><header>Renewable
			 energy resource conservation fund</header>
					<paragraph id="ID51efc1872fd7433ebb2b98494b3492f2"><enum>(1)</enum><header>In
			 general</header><text>There is established in the Treasury a fund, to be known
			 as the <quote>Renewable Energy Resource Conservation Fund</quote>, to be
			 administered by the Secretary for use in regions impacted by the development of
			 wind or solar energy.</text>
					</paragraph><paragraph id="ID9bf02795204b464cbffe1ba2b24d35bb"><enum>(2)</enum><header>Use</header>
						<subparagraph id="idF5177C8F2183404091375F18264116F8"><enum>(A)</enum><header>In
			 general</header><text>Amounts in the Fund shall be available to the Secretary,
			 who may make amounts available to the Secretary of Agriculture and to other
			 Federal or State agencies, as appropriate, for the purposes of—</text>
							<clause id="ID8b34230385054b2e92008e2f321ebffd"><enum>(i)</enum><text>addressing and
			 offsetting the impacts of wind or solar development on Federal land, including
			 restoring and protecting—</text>
								<subclause id="ID0bbb6b6a26fc400c8984dfee32a85d80"><enum>(I)</enum><text>fish and wildlife
			 habitat for affected species;</text>
								</subclause><subclause id="IDfb509f1a308e41eb8cb270f85c02fe01"><enum>(II)</enum><text>fish and
			 wildlife corridors for affected species; and</text>
								</subclause><subclause id="IDdf34e32f78ba4a05be4e6c16ddd8af70"><enum>(III)</enum><text>water resources
			 in areas impacted by wind or solar energy development;</text>
								</subclause></clause><clause id="ID450c0b229f714dd29b775071a22fdf98"><enum>(ii)</enum><text>securing
			 recreational access to Federal land through an easement, right-of-way, or fee
			 title acquisition from willing sellers for the purpose of providing enhanced
			 public access to existing Federal land that is inaccessible or significantly
			 restricted; and</text>
							</clause><clause id="ID2ef76fce37bd4d25a39ed6aadd69a63b"><enum>(iii)</enum><text>carrying out
			 activities authorized under the Land and Water Conservation Fund Act of 1965
			 (16 U.S.C. 460<italic>l</italic>–4 et seq.) in the State.</text>
							</clause></subparagraph><subparagraph id="id6D870D4E587648BD8F48B061F6EF1763"><enum>(B)</enum><header>Advisory
			 Board</header><text>The Secretary shall establish an independent advisory board
			 composed of key stakeholders and technical experts to provide recommendations
			 and guidance on the disposition of any amounts expended from the Fund.</text>
						</subparagraph></paragraph><paragraph id="ID55e8d47f4fbe45b082ee4bd36740fdfd"><enum>(3)</enum><header>Mitigation
			 requirements</header><text>The expenditure of funds under this subsection shall
			 be in addition to any mitigation requirements imposed pursuant to any law,
			 regulation, or term or condition of any lease, right-of-way, or other
			 authorization.</text>
					</paragraph><paragraph id="IDee0b2dff1f904fe4a446b72c378d48eb"><enum>(4)</enum><header>Investment of
			 fund</header>
						<subparagraph id="IDa935c3ceb04b440f9f94e7e96ce77362"><enum>(A)</enum><header>In
			 general</header><text>Any amounts deposited in the Fund shall earn interest in
			 an amount determined by the Secretary of the Treasury on the basis of the
			 current average market yield on outstanding marketable obligations of the
			 United States of comparable maturities.</text>
						</subparagraph><subparagraph id="IDec225c20c84c4b6384e7e8e883097d88"><enum>(B)</enum><header>Use</header><text>Any
			 interest earned under subparagraph (A) may be expended in accordance with this
			 subsection.</text>
						</subparagraph></paragraph></subsection></section><section id="ID0e747596f9124b08b27c032726989946"><enum>205.</enum><header>Royalties</header>
				<subsection id="IDdab8ceef3b88486a9ac8a9a806f3724d"><enum>(a)</enum><header>In
			 general</header><text>The Secretaries shall require as a term and condition of
			 any lease, right-of-way, permit, or other authorization for the development of
			 wind or solar energy on covered land the payment of a royalty established by
			 the Secretaries pursuant to a joint rulemaking that shall be a percentage of
			 the gross proceeds from the sale of electricity at a rate that—</text>
					<paragraph id="ID7b05e7825ca846559ea34d275cef1fdd"><enum>(1)</enum><text>encourages
			 production of solar or wind energy;</text>
					</paragraph><paragraph id="ID8a32ec772742429c9636ee1694bfe692"><enum>(2)</enum><text>ensures a fair
			 return to the public comparable to the return that would be obtained on State
			 and private land; and</text>
					</paragraph><paragraph id="ID58bebfab463648a3b96575b740c0063c"><enum>(3)</enum><text>encourages the
			 maximum energy generation while disturbing the least quantity of covered land
			 and other natural resources, including water.</text>
					</paragraph></subsection><subsection id="ID25b419e3d3d54e0f8f042f1560ebe208"><enum>(b)</enum><header>Amount</header><text>The
			 royalty on electricity produced using wind or solar resources shall be—</text>
					<paragraph id="ID53332e3ae27c48f4b4b4360c4648ba42"><enum>(1)</enum><text>not less than 1
			 percent, and not more than 2.5 percent, of the gross proceeds from the sale of
			 electricity produced from the resources during the first 10 years of
			 production; and</text>
					</paragraph><paragraph id="ID98cf908659a34cfebdc9da9fcadeb7b2"><enum>(2)</enum><text>not less than 2
			 percent, and not more than 5 percent, of the gross proceeds from the sale of
			 electricity produced from the resources during each year after that initial
			 10-year period.</text>
					</paragraph></subsection><subsection id="IDcf6b7d590a7942ff837206e81b8ae0e4"><enum>(c)</enum><header>Different
			 royalty rates</header><text>The Secretaries may establish—</text>
					<paragraph id="id298253DE7AD342EDA2CCFCCB2F9081BC"><enum>(1)</enum><text>a different
			 royalty rate for wind or solar energy generation; and</text>
					</paragraph><paragraph id="idB9B64C53D26D4190BCC8B622A7A974A3"><enum>(2)</enum><text>a reduced royalty
			 rate for projects located within a zone identified for development of solar or
			 wind energy.</text>
					</paragraph></subsection><subsection id="ID796b27bb42e84cc0bf5e2202ad7e530b"><enum>(d)</enum><header>Royalty in lieu
			 of rent</header><text>During the period of production, a royalty shall be
			 collected in lieu of any rent for the land from which the electricity is
			 produced.</text>
				</subsection><subsection id="IDe1a4397b30704f449c94bc910fe5fcb6"><enum>(e)</enum><header>Royalty
			 relief</header><text>To promote the generation of renewable energy, the
			 Secretaries may reduce any royalty otherwise required on a showing by clear and
			 convincing evidence by the person holding a lease, right-of-way, permit, or
			 other authorization for the development of wind or solar energy on covered land
			 under which the generation of energy is or will be produced in commercial
			 quantities that—</text>
					<paragraph id="id2A3A6087B8624373807C07DA4F3BEEE8"><enum>(1)</enum><text>collection of the
			 full royalty would unreasonably burden energy generation; and</text>
					</paragraph><paragraph id="idA190814A307F4201A9EAF6FC9D47E7E4"><enum>(2)</enum><text>the royalty
			 reduction is in the public interest.</text>
					</paragraph></subsection><subsection id="ID888921dc10c04e6f84816af29c23c290"><enum>(f)</enum><header>Periodic review
			 and report</header>
					<paragraph id="ID57c02277d291490582f19fa28195ce77"><enum>(1)</enum><header>In
			 general</header><text>Not later than 5 years after the date of enactment of
			 this Act and every 5 years thereafter, the Secretary, in consultation with the
			 Secretary of Agriculture, shall—</text>
						<subparagraph id="ID8310e116229f4a4abf741ce11c2d2f1f"><enum>(A)</enum><text>complete a review
			 of collections and impacts of the royalty and fees provided under this Act;
			 and</text>
						</subparagraph><subparagraph id="ID25958f28483b4d08826407b35b4ff59b"><enum>(B)</enum><text>submit to the
			 Committee on Energy and Natural Resources of the Senate and the Committee on
			 Natural Resources of the House of Representatives a report describing the
			 results of the review.</text>
						</subparagraph></paragraph><paragraph id="IDa073a676bef9485bbc4a2e357df5c29f"><enum>(2)</enum><header>Topics</header><text>The
			 report shall address—</text>
						<subparagraph id="ID096c11af335a4455b6895c95f502413d"><enum>(A)</enum><text>the total
			 revenues received (by category) on an annual basis as royalties from wind,
			 solar, and geothermal development and production (specified by energy source)
			 on covered land;</text>
						</subparagraph><subparagraph id="ID9dde0dbf3c7a4dcfa39436b1b66be90c"><enum>(B)</enum><text>whether the
			 revenues received for the development of wind, solar, and geothermal
			 development are comparable to the revenues received for similar development on
			 State and private land;</text>
						</subparagraph><subparagraph id="IDed945f44ec714f79b599274cbf7132f7"><enum>(C)</enum><text>any impact on the
			 development of wind, solar, and geothermal development and production on
			 covered land as a result of the royalties; and</text>
						</subparagraph><subparagraph id="ID619ed49a1b184c9dadb546976025bd01"><enum>(D)</enum><text>any
			 recommendations with respect to changes in Federal law (including regulations)
			 relating to the amount or method of collection (including auditing, compliance,
			 and enforcement) of the royalties.</text>
						</subparagraph></paragraph></subsection><subsection id="IDc02f184bb2a2499693d166976afbc52b"><enum>(g)</enum><header>Regulations</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretaries
			 shall jointly issue final regulations to carry out this section.</text>
				</subsection></section><section id="IDb75c14a4a3f44002bc824baf26e04cf2"><enum>206.</enum><header>Enforcement of
			 royalty and payment provisions</header>
				<subsection id="ID9f74764bff8d48d5afb69a698775d8d3"><enum>(a)</enum><header>Duties of the
			 Secretary</header><text>The Secretary shall establish a comprehensive
			 inspection, collection, fiscal, and production accounting and auditing
			 system—</text>
					<paragraph id="IDdd5e7281924d41fbbc767cf7670b5a78"><enum>(1)</enum><text>to accurately
			 determine royalties, rentals, interest, fines, penalties, fees, deposits, and
			 other payments owed under this Act; and</text>
					</paragraph><paragraph id="IDade2f01a42444dabbbd7a6c51a0e5a02"><enum>(2)</enum><text>to collect and
			 account for the payments in a timely manner.</text>
					</paragraph></subsection><subsection id="IDccba6126cc76436e9c7b252cb4af4f18"><enum>(b)</enum><header>Applicability
			 of other law</header><text>The Federal Oil and Gas Royalty Management Act of
			 1982 (30 U.S.C. 1701 et seq.) (including the civil and criminal enforcement
			 provisions of that Act) shall apply to leases, permits, rights-of-way, or other
			 authorizations issued for the development of solar or wind energy on covered
			 land and the holders and operators of the leases, permits, rights-of-way, or
			 other authorizations (and designees) under this title, except that in applying
			 that Act—</text>
					<paragraph commented="no" id="ID02a0a9ee521740f98a3c9d1a1e34eb36"><enum>(1)</enum><text>“wind or solar
			 leases, permits, rights-of-way, or other authorizations” shall be substituted
			 for <quote>oil and gas leases</quote>;</text>
					</paragraph><paragraph commented="no" id="IDbb423478c64843ca8b2fd5ccd2d5d4fa"><enum>(2)</enum><text>“electricity
			 generated from wind or solar resources” shall be substituted for <quote>oil and
			 gas</quote> (when used as nouns);</text>
					</paragraph><paragraph commented="no" id="ID67d19c8e77b44d9f9cb8ce2dd7d333a8"><enum>(3)</enum><text>“lease, permit,
			 right-of-way, or other authorization for the development of wind or solar
			 energy” shall be substituted for <quote>lease</quote> and <quote>lease for oil
			 and gas</quote> (when used as nouns); and</text>
					</paragraph><paragraph commented="no" id="IDa7212089968d46049e2265e007f27e4f"><enum>(4)</enum><text>“lessee,
			 permittee, right-of-way holder, or holder of an authorization for the
			 development of wind or solar energy” shall be substituted for
			 <quote>lessee</quote>.</text>
					</paragraph></subsection></section><section id="ID0c668dd314b94377ab932baf9283f5a1"><enum>207.</enum><header>Enforcement</header>
				<subsection id="ID09a36837002a4a66b49a8ba7c99885ea"><enum>(a)</enum><header>In
			 general</header><text>Sections 302(c) and 303 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1732(c), 1733) shall apply to activities
			 conducted on covered land under this title.</text>
				</subsection><subsection id="IDc013c3d21cf94241af43514677774c75"><enum>(b)</enum><header>Applicability
			 of other enforcement provisions</header><text>Nothing in this title reduces or
			 limits the enforcement authority vested in the Secretary or the Attorney
			 General by any other law.</text>
				</subsection></section><section id="ID2309d0ef6d82469180e1459527e36f03"><enum>208.</enum><header>Segregation
			 from appropriation under mining and Federal land laws</header>
				<subsection id="ID0300d99c3a8743b4a0bfc41fc3fda8d4"><enum>(a)</enum><header>In
			 general</header><text>On covered land identified by the Secretary or the
			 Secretary of Agriculture for the development of solar or wind power under this
			 title or other applicable law, the Secretary or the Secretary of Agriculture
			 may temporarily segregate the identified land from appropriation under the
			 mining and public land laws.</text>
				</subsection><subsection id="IDd0096a22f2bf4e4cb1b30978e45877db"><enum>(b)</enum><header>Administration</header><text>Segregation
			 of covered land under this section—</text>
					<paragraph id="IDad2f3001834b47ee8aba8924bebd61ac"><enum>(1)</enum><text>may only be made
			 for a period not to exceed 10 years; and</text>
					</paragraph><paragraph id="ID2b1bbd593bed4621bde5b69425fb90f8"><enum>(2)</enum><text>shall be subject
			 to valid existing rights as of the date of the segregation.</text>
					</paragraph></subsection></section><section id="IDea9432fe2e38424589132882691664cd"><enum>209.</enum><header>Report</header>
				<subsection id="IDe70e430c4b3f4be482c1c7c26e4e3efb"><enum>(a)</enum><header>Study</header>
					<paragraph id="ID3a0f2e3b86e0450091b9cc0d833574f0"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Secretaries shall carry out a study on the siting, development,
			 and management of projects to determine the feasibility of carrying out a
			 conservation banking program on land administered by the Secretaries.</text>
					</paragraph><paragraph id="ID8e13443c6eaa44a8b75da20d315b0b05"><enum>(2)</enum><header>Contents</header><text>The
			 study under paragraph (1) shall—</text>
						<subparagraph id="idD45DB77BDAE14F36A3BC38F5C7505EBA"><enum>(A)</enum><text>identify areas in
			 which—</text>
							<clause id="id1EC56BBC59B844CCBFF2FE2E915CEC1D"><enum>(i)</enum><text>privately owned
			 land is not available to offset the impacts of solar or wind energy development
			 on federally administered land; or</text>
							</clause><clause id="idCD4660CF2CF34677A91657AE94FB8222"><enum>(ii)</enum><text>mitigation
			 investments on federally administered land are likely to provide greater
			 conservation value for impacts of solar or wind energy development on federally
			 administered land; and</text>
							</clause></subparagraph><subparagraph id="ID90858c689db54454823e552da4e5d075"><enum>(B)</enum><text>examine—</text>
							<clause id="id384FF6C23D054CDBBF1A6D22A41C24DB"><enum>(i)</enum><text>the
			 effectiveness of laws (including regulations) and policies in effect on the
			 date of enactment of this Act in facilitating the development of conservation
			 banks;</text>
							</clause><clause id="IDc9d214ad263f4fac8da147c322205611"><enum>(ii)</enum><text>the advantages
			 and disadvantages of using conservation banks on Federal land to mitigate
			 impacts to natural resources on private land; and</text>
							</clause><clause id="ID46578790dbf84b73b9d91f434c23181c"><enum>(iii)</enum><text>any changes in
			 Federal law (including regulations) or policy necessary to further develop a
			 Federal conservation banking program.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="IDd5f32ebf39dd4bfaabbc2f6969d80062"><enum>(b)</enum><header>Report to
			 Congress</header><text>Not later than 18 months after the date of enactment of
			 this Act, the Secretaries shall jointly submit to Congress a report that
			 includes—</text>
					<paragraph id="ID16661c16d87845c3abc9a2d02f6b2f75"><enum>(1)</enum><text>the
			 recommendations of the Secretaries relating to—</text>
						<subparagraph id="IDd35d9be91e3c4c2abb4ac82153f01fb7"><enum>(A)</enum><text>the most
			 effective system for Federal land described in subsection (a)(2)(A) to meet the
			 goals of facilitating the development of a conservation banking program on
			 Federal land; and</text>
						</subparagraph><subparagraph id="IDad937214299e406ab3eb8d265de75991"><enum>(B)</enum><text>any change to
			 Federal law (including regulations) or policy necessary to address more
			 effectively the siting, development, and management of conservation banking
			 programs on Federal land to mitigate impacts to natural resources on private
			 land; and</text>
						</subparagraph></paragraph><paragraph id="IDbec78bbe5c37482db188c5a9726b31a2"><enum>(2)</enum><text>any
			 administrative action to be taken by the Secretaries in response to the
			 recommendations.</text>
					</paragraph></subsection><subsection id="ID35286ab7428948108bc816b75a633080"><enum>(c)</enum><header>Availability to
			 the public</header><text>Not later than 30 days after the date on which the
			 report described in subsection (b) is submitted to Congress, the Secretaries
			 shall make the results of the study available to the public.</text>
				</subsection></section><section id="ID5e98bb2443bb4d42ac04c7cf000f9e04"><enum>210.</enum><header>Applicability
			 of law</header>
				<subsection id="ID7a29658c3f19428aa981054ffe588be6"><enum>(a)</enum><header>Rental fee
			 exemption</header><text>Wind or solar generation projects with a capacity of 20
			 megawatts or more that are issued a lease, right-of-way, permit, or other
			 authorization under applicable law shall not be subject to the rental fee
			 exemption for rights-of-way under section 504(g) of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1764(g)).</text>
				</subsection><subsection id="IDefc0956157a546ff86cadedcd75a60de"><enum>(b)</enum><header>Fees, charges,
			 and commissions</header><text>Section 304 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1734) shall apply to an application made
			 under section 4.</text>
