			 Secretary</header><text display-inline="no-display-inline">In this Act, the
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
		</section><title id="HE3ECAED460FB42CB86602B984C20AB98"><enum>I</enum><header>Commodity programs
			 and crop insurance</header>
			<section id="H23CBD79DD04F4E69B952DDE0BFE769EA"><enum>1001.</enum><header>Sense of
			 Congress on removing barriers to domestic production of fruit and
			 vegetables</header><text display-inline="no-display-inline">It is the sense of
			 Congress that—</text>
				<paragraph id="H44009805A0AD480286EFF95D8C65C58C"><enum>(1)</enum><text>Federal commodity
			 and crop insurance programs should not create barriers to the domestic
			 production of fruit and vegetables;</text>
				</paragraph><paragraph id="H0BDBF3A81D9D49228758AC66C0AB1C92"><enum>(2)</enum><text>planting
			 flexibility under Federal commodity programs should be maximized with the goals
			 of—</text>
					<subparagraph id="H55DE4222CF30441186EFA5AE888E687E"><enum>(A)</enum><text>allowing producer
			 choice regarding the planting of agricultural commodities; and</text>
					</subparagraph><subparagraph id="H6B52B139B926446EBF39E20E97CCA42B"><enum>(B)</enum><text>increasing the
			 local and regional availability of fresh and minimally processed produce,
			 including to schools and other institutions; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H57540A50D58C43CCABDF2549D1134AAF"><enum>(3)</enum><text>crop and revenue
			 insurance products should be made available that are tailored to the needs of
			 diversified farming operations that serve local and regional food
			 markets.</text>
				</paragraph></section><section id="HDA1D8D1DB2B3477CA1BDE300D4DEB1F5"><enum>1002.</enum><header>Whole farm
			 adjusted revenue risk management insurance plan</header><text display-inline="no-display-inline">Section 508(c) of the Federal Crop Insurance
			 Act (7 U.S.C. 1508(c)) is amended by adding at the end the following:</text>
				<quoted-block id="HB3DACBE03BD14B198696E46311076AE6">
					<paragraph id="HEDD4FBC8A21944F4B211C7E0A97CCEB3"><enum>(11)</enum><header>Whole farm
				adjusted revenue risk management insurance plan</header>
						<subparagraph id="H19EAA288DC2F44F79F5BDB2EDD08CC99"><enum>(A)</enum><header>In
				general</header><text>The Corporation shall offer a whole farm adjusted revenue
				risk management insurance plan (in this paragraph referred to as the
				<quote>plan</quote>) that allows a producer to qualify for an indemnity if
				actual gross farm revenue is below 85 percent of the average gross farm revenue
				of the producer.</text>
						</subparagraph><subparagraph id="HD390289369B94011BB38EF213A9C5AA3"><enum>(B)</enum><header>Availability</header><text>The
				Corporation shall offer the plan in all States and counties, pending required
				rating.</text>
						</subparagraph><subparagraph id="H972E71C4D3914BFBA1024531FC765120"><enum>(C)</enum><header>Eligible
				producers</header><text display-inline="yes-display-inline">The Corporation
				shall permit producers of any type of agricultural commodity to participate in
				the plan. Eligible producers include contract growers, direct-to-consumer
				marketers, and producers servicing local and regional and farm
				identity-preserved markets. Eligible commodities include specialty crops,
				industrial crops, poultry, livestock, and aquacultural products.</text>
						</subparagraph><subparagraph id="HC4EE8451D34545C889E1588F7CF600DB"><enum>(D)</enum><header>Diversification</header><text>The
				Corporation may provide diversification-based additional coverage payment
				rates, premium discounts, or other enhanced benefits in recognition of the risk
				management benefits of diversification strategies regarding production of
				eligible commodities.</text>
						</subparagraph><subparagraph id="H68021FC5B44D45A687E1BCA97CF6C529"><enum>(E)</enum><header>Market
				readiness</header><text>The Corporation shall include coverage for the value of
				any packing, packaging, or labeling, washing, grain drying, or any other
				similar on-farm activities the Corporation determines to be the minimum
				required in order to sell an agricultural
				commodity.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HA9A84AE7F6D6429EBCAFF4B3C1096437"><enum>1003.</enum><header>Authority to
			 conduct crop insurance-related research and development in addition to
			 contracting for research and development</header>
				<subsection id="H4D7291EAF1194FF4BE46E81C08ABEAF7"><enum>(a)</enum><header>Conducting
			 research and development</header><text>Section 522(c) of the Federal Crop
			 Insurance Act (7 U.S.C. 1522(c)) is amended—</text>
					<paragraph id="H2C86A39FF3A04D69B2EE6395CBD53CAA"><enum>(1)</enum><text>in the subsection
			 heading, by striking <quote><header-in-text level="subsection" style="OLC">Contracting</header-in-text></quote>;</text>
					</paragraph><paragraph id="HD571B3B1DD374AB18EFDE9F7DA9B0E89"><enum>(2)</enum><text>in paragraph (1),
			 in the matter preceding paragraph (A), by striking <quote>enter into contracts
			 to carry out research and development to</quote> and inserting <quote>conduct
			 activities or enter into contracts to carry out research and development to
			 maintain or improve existing policies or develop new policies
			 to</quote>;</text>
					</paragraph><paragraph id="H0235B286CA684768BCBC77AC5D8D5BC2"><enum>(3)</enum><text>in paragraph
			 (2)—</text>
						<subparagraph id="HAA659F8976CE46109C2CEF96FD865130"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>conduct research and development or</quote> after
			 <quote>The Corporation may</quote>; and</text>
						</subparagraph><subparagraph id="H4E813D98814D47709A24C5846C893FE6"><enum>(B)</enum><text>in subparagraph
			 (B), by inserting <quote>conducting research and development or</quote> after
			 <quote>Before</quote>; and</text>
						</subparagraph></paragraph><paragraph id="H12E73E5ABC6B412B845A28E08075D598"><enum>(4)</enum><text>in paragraph (5),
			 by inserting <quote>after expert review in accordance with section
			 505(e)</quote> after <quote>approved by the Board</quote>.</text>
					</paragraph></subsection><subsection id="H2B94E3C544F24C6AA90D091B805475E4"><enum>(b)</enum><header>Funding</header><text>Section
			 522(e) of the Federal Crop Insurance Act (7 U.S.C. 1522(e)) is amended—</text>
					<paragraph id="H25B87C4D03D444879E4F4E0C31EA064A"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
						<subparagraph id="H43B103BE500640D38C720F39986EA3C9"><enum>(A)</enum><text>in the paragraph
			 heading, by striking <quote><header-in-text level="paragraph" style="OLC">Contracting</header-in-text></quote> and inserting
			 <quote><header-in-text level="paragraph" style="OLC">Research and development

					</paragraph></subsection></section><section id="HCFBEF74EF30D416DB9FAA15298DD706A"><enum>1004.</enum><header>Improved
			 availability of crop insurance for producers of organic crops</header>
				<subsection id="H4380A58779664434B9E611763E422403"><enum>(a)</enum><header>Elimination of
			 organic premium surcharge</header><text display-inline="yes-display-inline">Section 508(d) of the Federal Crop
			 Insurance Act (7 U.S.C. 1508(d)) is amended by adding at the end the following
			 new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H00C7A7F0E5F04E33BA3A48ACF90C7466" style="OLC">
						<paragraph id="HF555D06BA045490FA69F7454212460FB"><enum>(4)</enum><header>Elimination of
				organic premium surcharge</header><text display-inline="yes-display-inline">Effective beginning with the 2013
				reinsurance year, the Corporation may not require any producer to pay a premium
				surcharge for insuring crops produced in compliance with standards issued by
				the Department of Agriculture under the national organic program established
				under the Organic Foods Production Act of 1990 (7 U.S.C. 6501 et
				seq.).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H049367AE74C34ABE95F651A88EC3E98B"><enum>(b)</enum><header>Completion of
			 development of organic price series</header><text display-inline="yes-display-inline">Section 508(c)(6) of the Federal Crop
			 Insurance Act (7 U.S.C. 1508(c)(6)) is amended by adding at the end the
			 following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H63AAACEBBAFA4045AD09C74DDE7242A1" style="OLC">
						<subparagraph id="H7235704B41CF4AD4A249E3F630AF53F9"><enum>(D)</enum><header>Organic
				crops</header>
							<clause id="H2D0D7B2692AD4B028BF4FE3B0AC78083"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">As quickly as
				possible, but in no event later than the 2015 reinsurance year, the Corporation
				shall offer producers of organic crops price elections for all organic crops
				produced in compliance with standards issued by the Department of Agriculture
				under the national organic program established under the Organic Foods
				Production Act of 1990 (7 U.S.C. 6501 et seq.) that reflect the actual retail
				or wholesale prices, as appropriate, received by producers for organic crops,
				as determined by the Secretary using all relevant sources of
				information.</text>
							</clause><clause id="H1115E31BAAB34890AFEAD29DDA36D90C"><enum>(ii)</enum><header>Annual
				report</header><text>The Corporation shall submit to the Committee on
				Agriculture of the House of Representatives and the Committee on Agriculture,
				Nutrition, and Forestry of the Senate an annual report on progress made in
				developing and improving Federal crop insurance for organic crops,
				including—</text>
								<subclause id="H415D2CA3F6A24B1997BB0BD0478DA5DD"><enum>(I)</enum><text>the numbers and
				varieties of organic crops insured;</text>
								</subclause><subclause id="H3BFC1D30A394451C895BA4AC029A137E"><enum>(II)</enum><text>the progress of
				implementing the price elections required under this subparagraph, including
				the rate at which additional price elections are adopted for organic
				crops;</text>
								</subclause><subclause id="H7274AFE43A7E4A63B57E93EC65C914CE"><enum>(III)</enum><text>the development
				of new insurance approaches relevant to organic producers; and</text>
								</subclause><subclause id="H04AC32A0E05B43C999ED8F2A9D96FF0A"><enum>(IV)</enum><text>any
				recommendations the Corporation considers appropriate to improve Federal crop
				insurance coverage for organic
				crops.</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H04CE3B6412CD466DA0FE36F34381C0CA"><enum>(c)</enum><header>Repeal of
			 required contracts for organic production coverage improvements</header><text display-inline="yes-display-inline">Section 522(b) of the Federal Crop
			 Insurance Act (7 U.S.C. 1522(b)) is amended by striking paragraph (10).</text>
				</subsection></section></title><title id="HA1165498EF6F450EBA2F2F6997C7569E"><enum>II</enum><header>Conservation</header>
			<section commented="no" id="H0F773DC2E17D4D71AAB5B4514B69DAD7" section-type="subsequent-section"><enum>2001.</enum><header>Definition</header><text display-inline="no-display-inline">Section 1201(a) of the Food Security Act of
			 1985 (16 U.S.C. 3801(a)) is amended by redesignating paragraphs (18) through
			 (27) as paragraphs (19) through (28), respectively, and inserting after
			 paragraph (17) the following new paragraph:</text>

				or group of agricultural producers commits to supplying and delivering the
				products to a common distribution point or directly to the consumers.</text>
								</clause><clause id="HBF68C045470E46FCAF20FA060A6C73D9"><enum>(iii)</enum><header>Community-supported
				fishery program</header><text>The term <term>community-supported fishery
				program</term> or <term>CSF</term> means fishing business or a group of
				fishermen that form a partnership with consumers through which consumers buy a
				subscription for seafood in advance and the fishing business or group of
				fishermen commits to supplying and delivering the seafood to a common
				distribution point or directly to the consumers.</text>
								</clause><clause id="H229670E12A5F4C12B0F48B8C1E381712"><enum>(iv)</enum><header>Farmers'
				market</header><text>The term <term>farmers' market</term> means a regularly
				scheduled assembly of 2 or more agricultural producers for the direct sale of
				locally grown fresh fruits and vegetables and other staple foods to
				consumers.</text>
								</clause><clause id="HE49C38CD9AD64436A1916529E2393902"><enum>(v)</enum><header>Farm stand;
				roadside stand</header>
									<subclause id="H1469AD67A3704839985B4AAED0D9F529"><enum>(I)</enum><header>In
				general</header><text>The terms <term>farm stand</term> and <term>roadside
				stand</term> mean a retail outlet for the direct sale of locally grown fresh
				fruits and vegetables and other staple foods in rural or urban areas.</text>
									</subclause><subclause id="HA8B9786F648141098D28F30D0F931071"><enum>(II)</enum><header>Inclusion</header><text>The
				terms <term>farm stand</term> and <term>roadside stand</term> may include a
				single stall in a farmers' market.</text>
									</subclause></clause><clause id="H5F09634955A14436AF34D848ECAF3253"><enum>(vi)</enum><header>Green
				cart</header><text>The term <term>green cart</term> means a mobile retail food
				vendor who sells fresh fruits and vegetables on a regular basis from an
				unmotorized cart.</text>

				vendor</header>
									<subclause id="H69F284F3E86C499FBD2D2AA363BFB749"><enum>(I)</enum><header>In
				general</header><text>The term <term>route vendor</term> means a mobile retail
				food vendor who sells unprepared food from a vehicle directly to consumers
				along a scheduled route or by arranged delivery.</text>
									</subclause><subclause id="H9AE3E0A09CE74E238478D69F18473464"><enum>(II)</enum><header>Inclusion</header><text>The
				term <term>route vendor</term> includes vendors who provide food services in
				disaster or other emergency situations.</text>

				retailer</header><text>The term <term>wireless retailer</term> includes—</text>

				wireless technology available to the State agency in implementing the wireless
				electronic benefit transfer system, including smart phone technology and other
				technologies, so long as the technologies meet all industry security

					</subparagraph></paragraph><paragraph id="HE958DD7D41124A1E933822CD35045554"><enum>(2)</enum><text>in paragraph

				wireless retail food stores to receive funds in an amount not to exceed the
				cost of a wireless point-of-sale terminal if alternative wireless technology is
				used; and</text>
							</subparagraph><subparagraph id="H4A9C45084CDB43D387CEFBC76C01A2B6"><enum>(K)</enum><text>the potential for
				entering into a contract or memoranda of understanding with a statewide
				nonprofit organization, such as a statewide farmers' market association, to
				assist the State agency by providing outreach, training, and administration in
				wireless electronic benefit transfer equipment deployment at multiple-vendor
				farmers' markets, particularly in cases in which scrip (such as farmers' market
				tokens) is used to simplify program participation by agricultural producers and
				vendors.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HC4680525729344E0B200192492913F1B"><enum>(3)</enum><text>in paragraph
			 (3)(B)—</text>

						</paragraph><paragraph id="H1D4EB0B0F9FD4B84AC5508A1BC28A666"><enum>(15)</enum><header>Wireless
				retailer EBT pilot program for smartphone technology</header>
							<subparagraph id="H539311BC824F4349BAA34652B61422CE"><enum>(A)</enum><header>Establishment</header><text>The
				Secretary shall establish a wireless retailer EBT pilot program that shall
				operate in a minimum of 2 States for a minimum of 2 years in each State—</text>
								<clause id="H48D42C01B3F64CF5B3AD2713CABE8B09"><enum>(i)</enum><text>to
				explore EBT smartphone technology; and</text>
								</clause><clause id="HB8C3B99867AC41D48DEE8E6D0A7EF73C"><enum>(ii)</enum><text>to test the use
				of EBT technology in accepting benefits for multiple nutrition assistance
				programs.</text>
								</clause></subparagraph><subparagraph id="H93C87E70ED4A4B03BA4BB09231C9201E"><enum>(B)</enum><header>Purposes</header><text>The
				purposes of the EBT pilot program are—</text>
								<clause id="H41B9D21FD68F4093876572B7D37432C0"><enum>(i)</enum><text>to
				evaluate the opportunities and challenges faced by wireless retailers in using
				smartphone technology to process EBT transactions; and</text>
								</clause><clause id="HDA6D2CF782674562881DF40F84A5A7A9"><enum>(ii)</enum><text>to develop
				technology, software, and machinery that allows wireless retailers to redeem
				EBT benefits for multiple nutrition assistance programs including—</text>
									<subclause id="H170871F72C4B448C9AD4D622E6056FB3"><enum>(I)</enum><text>the supplemental
				nutrition assistance program established under the
				<act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name> (7
				U.S.C. 2011 et seq.);</text>
									</subclause><subclause id="H871F91CFEF1343FCB44FB0D02E78718D"><enum>(II)</enum><text>the farmers’
				market nutrition program established under section 17(m) of the
				<act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (42
				U.S.C. 1786(m));</text>
									</subclause><subclause id="HCB2DBC3FD2904FABB7EB06A2EEB4DFE5"><enum>(III)</enum><text>the seniors
				farmers’ market nutrition program established under section 4402 of the Farm
				Security and Rural Investment Act of 2002 (7 U.S.C. 3007);</text>
									</subclause><subclause id="H0726885980D748B3B9675B06924CCC9F"><enum>(IV)</enum><text>the special
				supplemental nutrition program for women, infants, and children established by
				section 17 of the <act-name parsable-cite="CNA66">Child Nutrition Act of
				1966</act-name> (42 U.S.C. 1786); and</text>
									</subclause><subclause id="HC869D5442B8543D0853435286917FCB6"><enum>(V)</enum><text>other Federal
				nutrition assistance programs for low-income individuals that adopt an
				electronic benefit transfer system.</text>
									</subclause></clause></subparagraph><subparagraph id="H638C04F6E2654A998B579AF23074956D"><enum>(C)</enum><header>Limitation on
				administrative expenses</header><text>For each fiscal year, not more than 10
				percent of the amounts made available to carry out this paragraph may be used
				for administrative expenses.</text>
							</subparagraph><subparagraph id="HC09A0198969C42E7A2D894C270F99010"><enum>(D)</enum><header>Funding</header><text>On
				October 1, 2012, of the funds of the Commodity Credit Corporation, the
				Secretary shall make available to carry out this paragraph $2,000,000, to
				remain available until

			 funds for purchase of fruits, vegetables, and nuts to support domestic
			 nutrition assistance programs</header>
				<subsection id="HA410271300E4406AB98D0A85F1EEE41A"><enum>(a)</enum><header>Purchase of
			 locally and regionally produced foods</header><text>Section 4404 of the Food,
			 Conservation, and Energy Act of 2008 (7 U.S.C. 612c–5) is amended—</text>
					<paragraph id="H1F519244482B4E55B9CB42AEF7631A78"><enum>(1)</enum><text>by redesignating
			 subsection (c) as subsection (d); and</text>
					</paragraph><paragraph id="HB97B125BBF484AAD9B2C17D6B855BCC7"><enum>(2)</enum><text>by inserting after
			 subsection (b) the following:</text>

				geographical preference for the procurement of unprocessed or minimally
				processed locally and regionally grown fruits, vegetables, and
				nuts.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HD112F6BE96344E67867B09269E9FD655"><enum>(b)</enum><header>Purchase of
			 fresh fruits and vegetables for distribution to schools and service
			 institutions</header><text>Section 10603(b) of the Farm Security and Rural
			 Investment Act of 2002 (7 U.S.C. 612c–4(b)) is amended—</text>
					<paragraph id="H6D55C80DF83D4C048A8BC6FCF3AA04B4"><enum>(1)</enum><text>by striking
			 <quote>The Secretary</quote> and inserting <quote>(1)
			 <header-in-text level="paragraph" style="OLC">In general</header-in-text>.—The
			 Secretary</quote>;</text>

				participate in the Department of Defense fresh fruit and vegetable distribution
				program;</text>
								</subparagraph><subparagraph id="H580CF12BB75C44CA98D9C0F1AA9504CB"><enum>(B)</enum><text>under such terms
				and conditions as the Secretary shall establish, purchasing locally and
				regionally grown fruits and vegetables with amounts that would have been used
				by the school or service institution to participate in the Department of
				Defense fresh fruit and vegetable distribution program; or</text>
								</subparagraph><subparagraph id="HE57D9FE8B52A4394BA1AB2FD64A2B167"><enum>(C)</enum><text>carrying out a
				combination of the activities described in subparagraphs (A) and
				(B).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H877B3B9B28EF45979E79D249BB9AFEF3"><enum>3004.</enum><header>Direct
			 expenditures for agricultural commodities and other foods</header><text display-inline="no-display-inline">Section 6 of the Richard B. Russell National
			 School Lunch Act (42 U.S.C. 1755) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H9F4A84820FBA4790B351A1A86263FFF6" style="OLC">
					<subsection id="H6930A262CE0143C6B20E33E8720E166C"><enum>(f)</enum><header>Local food
				credit program</header>
						<paragraph id="H314F8AD4B5F44F7FB44C2C3E39F13FBB"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="H7C4B52F2AAD04B60A7BC2E9CEE826909"><enum>(A)</enum><header>Local food
				credit</header><text>The term <term>local food credit</term> means cash,
				letters of credit, or another form of assistance, as determined by the
				Secretary.</text>
							</subparagraph><subparagraph id="HE583F7AE874F4EE4887321E48AB03BB8"><enum>(B)</enum><header>Participating
				school authority</header><text>The term <term>participating school
				authority</term> means a school food authority that—</text>
								<clause id="H7BD701A14D114A419A5A9D8FFC1F3B9E"><enum>(i)</enum><text>participates in
				the school lunch program under this Act; and</text>
								</clause><clause id="HAE128A1AE13A4E0DABDDC57BF91F3452"><enum>(ii)</enum><text>elects to
				participate in the local food credit program under this subsection.</text>
								</clause></subparagraph><subparagraph id="H67D1AF00D13D46168297C15138F6DB65"><enum>(C)</enum><header>Participating
				State agency</header><text>The term <term>participating State agency</term>
				means a State agency that—</text>
								<clause id="H6F0BA62E7C574E79889BF7F72BE6A734"><enum>(i)</enum><text>participates in
				the school lunch program under this Act; and</text>
								</clause><clause id="H3D4D768F3AE24C9DA04A5D4D10A81B42"><enum>(ii)</enum><text>elects to
				participate in the local food credit program under this subsection.</text>
								</clause></subparagraph></paragraph><paragraph id="HD791E62F13BC46C79A1C1EE68283F5E6"><enum>(2)</enum><header>Establishment</header><text>Beginning
				for the 2013–2014 school year and for each subsequent school year, the
				Secretary shall provide a grant to each participating State agency to provide
				each participating school food authority under the jurisdiction of that State
				agency with local food credits in an amount equal to not more than 15 percent
				of the total value of the commodity assistance or cash payments the State
				authority is eligible to receive under subsection (c)(2) for that school year
				in lieu of the commodity assistance or cash payments.</text>
						</paragraph><paragraph id="H01184B9AD3B7455DB49A1CDF6AD5E50A"><enum>(3)</enum><header>Requirements</header><text>As
				a condition of receiving a grant under this subsection, each participating
				school food authority shall—</text>
							<subparagraph id="H5572E859257046DCB0C97B62E6E207B2"><enum>(A)</enum><text>use local food
				credits received under this subsection to purchase unprocessed or minimally
				processed locally grown and locally raised foods to be served under the school
				lunch program in schools under the jurisdiction of the authority;</text>
							</subparagraph><subparagraph id="H5782836776C54E60ADE10E7E3A143236"><enum>(B)</enum><text>keep records of
				any purchases made with the assistance; and</text>
							</subparagraph><subparagraph id="H8C8FA202F135494398F9406E49B612E6"><enum>(C)</enum><text>provide the
				records to the Secretary in such manner and such form as the Secretary
				determines to be necessary.</text>
							</subparagraph></paragraph><paragraph id="H228A33FFED8C44D78DE212152E3B417C"><enum>(4)</enum><header>Prepurchasing</header><text>A
				participating school food authority may use a local food credit received under
				this subsection in a school year to purchase local foods to serve under the
				school lunch program during the following school year.</text>
						</paragraph><paragraph id="H0D79461D3F44440DA1690528EF2C5C51"><enum>(5)</enum><header>Minimum
				commodity purchases</header><text>The amount of a grant made under this
				subsection for a school year shall count toward the minimum commodity
				assistance requirements of subsection (c)(2) for that school
				year.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H7A279F4DD96F4688A72F1CE693D3D22F"><enum>3005.</enum><header>Purchases of
			 locally produced foods</header><text display-inline="no-display-inline">Section
			 9(j) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1758(j)) is
			 amended—</text>

			</section></title><title id="H590208595E9042A887C8C759055B4918"><enum>IV</enum><header>Credit</header>
			<section id="H7BB2BE617D2F49EE870B54DC72EC53A5"><enum>4001.</enum><header>Loans to local
			 and regional food producers</header><text display-inline="no-display-inline">Subtitle D of the Consolidated Farm and
			 Rural Development Act (7 U.S.C. 1981–2008u) is amended by inserting after
			 section 333C the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8DF589DE99A54EAAAAABDFD2BDF5811B" style="OLC">
					<section id="HF8352BA35A984E118541A9AC132D68A1"><enum>333D.</enum><header>Loans to local
				and regional food producers</header>
						<subsection id="HCB29703F1E3E45CD95A0EFE23BF28692"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall
				make and guarantee loans under this title to eligible producers for the
				production of locally or regionally produced agricultural food products (as
				defined in section 310B(g)(10) of this Act), including qualified producers
				engaged in direct-to-consumer marketing, direct-to-institution marketing, or
				direct-to-store marketing, businesses or activities that produce a value-added
				agricultural product (as defined in section 231(a)(5) of the Agricultural Risk
				Protection Act of 2000), mid-tier value chains (as defined in section 231(a)(3)
				of such Act of 2000), and other local and regional market outlets.</text>
						</subsection><subsection id="H91136B8BAF83473C9469FF95063BAE40"><enum>(b)</enum><header>Training</header><text>The
				Secretary shall ensure that loan officers receive appropriate training to serve
				borrowers and potential borrowers engaged in local and regional food
				production.</text>
						</subsection><subsection id="H346E42569D7C4E0C9CE7F17F4022DE42"><enum>(c)</enum><header>Valuation</header><text display-inline="yes-display-inline">The Secretary shall develop ways to
				determine unit prices (or other appropriate forms of valuation) for crops whose
				end use is intended to be in locally or regionally produced agricultural food
				products (as so defined) to facilitate lending to local and regional food
				producers. In addition, the Secretary shall implement a mechanism for the
				producers to establish their price history for the crops.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H9E8098394E784CF19B869DA7AF63C75F"><enum>(d)</enum><header>Outreach</header><text>The
				Secretary shall develop and implement an outreach strategy to engage and
				provide loan services to local and regional food
				producers.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H4AD9C70B5BF147E985A44B613D467D3B"><enum>4002.</enum><header>Clarification
			 of the mission of the farm credit system to recognize the economic benefits of
			 supporting young, beginning, and small farmers and ranchers, and contributions
			 of local and regional farm and food systems</header><text display-inline="no-display-inline">Section 1.1 of the Farm Credit Act of 1971
			 (12 U.S.C. 2001) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H86E70F5552BB47CB83539031A37CA670" style="OLC">
					<subsection id="H7DA587BD57764087AF4BE48402800149"><enum>(d)</enum><text display-inline="yes-display-inline">Recognizing that the vitality of United
				States agriculture and rural communities depends on the continued entry of
				young, beginning, and small farmers and ranchers into agriculture, many of whom
				will operate farms with local and regional food product distribution, it is
				declared to be the policy of the Congress and an objective of this Act that the
				Farm Credit System should endeavor to serve the credit and related needs of
				these individuals and the businesses on which they rely and that are necessary
				to the growth and vitality of local and regional farm and food
				systems.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HEC84584CE6DB41D9A7AA627A890FDED6"><enum>4003.</enum><header>Young,
			 beginning, and small farmers and ranchers and locally or regionally produced
			 agricultural products</header>
				<subsection id="HB579C460CE7340A7B9234D4C75C6E0FD"><enum>(a)</enum><header>Credit for
			 young, beginning, and small farmers</header><text display-inline="yes-display-inline">Section 4.19(a) of the Farm Credit Act of
			 1971 (12 U.S.C. 2207(a)) is amended—</text>
					<paragraph id="H1E7B5F06DB5041E187951FB72E4F4603"><enum>(1)</enum><text>in the 1st
			 sentence by inserting <quote>and for the production of locally or regionally
			 produced agricultural food products (as defined in section 310B(g)(10)(A) of
			 the Consolidated Farm and Rural Development Act)</quote> before the period;
			 and</text>
					</paragraph><paragraph id="H5352BE0B1E9F411E88F339A1543E01D1"><enum>(2)</enum><text>by inserting after
			 the 2nd sentence the following: <quote>Each such program shall include
			 initiatives and may include grants to support current and future borrowers by
			 helping to organize, build, expand, or improve infrastructure and markets for
			 locally or regionally produced agricultural food products (as so
			 defined).</quote>.</text>
					</paragraph></subsection><subsection id="HFBE40E35F4434752A4643AE720F528D2"><enum>(b)</enum><text display-inline="yes-display-inline">Section 4.19 of such Act (12 U.S.C.
			 2207(b)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H483D2E5B28474F5A8CC130CB395EC6EE" style="OLC">
						<subsection id="H0B66B0E13BBE4570A26C4DCBFCC536DE"><enum>(c)</enum><text display-inline="yes-display-inline">The Farm Credit Administration shall submit
				to the Committee on Agriculture of the House of Representatives and the
				Committee on Agriculture, Nutrition, and Forestry of the Senate an annual
				report that contains a summary and analysis of the operations and achievements
				of the Farm Credit System as a whole in meeting the objectives of this section.
				The Farm Credit Administration shall notify the Congress whenever a program is
				out of compliance with this section, and indicate in the notice the steps the
				Farm Credit Administration is taking in
				response.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HD0720A95FDA3456283CFF4FF45668298"><enum>4004.</enum><header>Government
			 accountability office study examining how well federal agencies are assessing
			 and meeting the capital needs of young, beginning, and small farmers and local
			 and regional farm and food systems</header>
				<subsection id="H4EAADE25F4FE4E779E8D8B15B5973458"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall conduct a study evaluating how the needs of young, beginning, and
			 small farmers and local and regional farm and food systems, and how their
			 credit needs are being assessed and met by the Farm Credit System, the
			 Department of Agriculture, the Department of the Treasury, and any other
			 Federal agencies.</text>
				</subsection><subsection id="H43F9E5550D1F4F2B8211E8EA01921F64"><enum>(b)</enum><header>Report to the
			 Congress</header><text display-inline="yes-display-inline">Within 1 year after
			 the date of the enactment of this section, the Comptroller General shall
			 prepare and submit to the Congress a report containing the findings and
			 conclusions made in the study required by subsection (a). The report shall
			 address—</text>
					<paragraph id="HC96EA84DB4644E6AAF5CBDA194AB885C"><enum>(1)</enum><text>the cost and
			 availability of credit and other assistance (including technical assistance)
			 provided through programs of the Farm Credit System, the Department of
			 Agriculture, and other Federal Government financial resources; and</text>
					</paragraph><paragraph id="HECCFF5E58B06428EA30B5753656D9B5F"><enum>(2)</enum><text>programs,
			 including those that serve historically underserved populations including
			 beginning and young farmers, small and medium-sized farms and ranches,
			 minorities and the socially disadvantaged, producers or harvesters of aquatic
			 products, businesses, and other entities, that are necessary to the growth and
			 vitality of local and regional farm and food systems, including aggregation,
			 processing, storage, distribution, and marketing.</text>
					</paragraph></subsection></section></title><title id="H2AAF735FBBFF458D8EB68D4F965385FC"><enum>V</enum><header>Rural
			 Development</header>
			<section id="HB33D854C11404224B68AEE286A3D8236" section-type="subsequent-section"><enum>5001.</enum><header>Support for local
			 and regional farm and food systems</header>
				<subsection id="HF9BD647E9DE34FCD8EC19CD9B371B808"><enum>(a)</enum><header>Rural business
			 opportunity grants</header><text display-inline="yes-display-inline">Section
			 306(a)(11) of the Consolidated Farm and Rural Development Act (7 U.S.C.
			 1926(a)(11)) is amended—</text>

			 for water, wastewater, and essential community facilities loans</header><text display-inline="yes-display-inline">Section 306(a)(24) of such Act (7 U.S.C.
			 1926(a)(24)) is amended by adding at the end the following:</text>

					<paragraph id="HA711340FDAA040CFB21EB223379BFF40"><enum>(1)</enum><header>Rural business
			 enterprise grants</header><text display-inline="yes-display-inline">Section
			 310B(c)(1)(B)(ii) of such Act (7 U.S.C. 1932(c)(1)(B)(ii)) is amended to read
			 as follows:</text>

				facility.</text>
								</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H306113736C754AA29CBC08DFD1F4855E"><enum>(2)</enum><header>Business and
			 industry direct and guaranteed loans</header><text>Section 310B(g) of such Act
			 (7 U.S.C. 1932(g)) is amended—</text>
						<subparagraph id="H12D36F656BD44325BE9FC924D7DC2A30"><enum>(A)</enum><text>by redesignating
			 paragraphs (5) through (9) as paragraphs (6) through (10), respectively; and
			 inserting after paragraph (4) the following:</text>

									</clause><clause id="HE039522E9AA84662B66132441F24D1AA"><enum>(v)</enum><header>Loan and loan
				guarantees in nonrural areas</header>
										<subclause id="HFAC2D04A658B4DC79AC1E6105E79A5B7"><enum>(I)</enum><header>In
				general</header><text>The Secretary may make or guarantee a business and
				industry loan for a facility that is not located in a rural area if the primary
				purpose of the loan or loan guarantee is for a facility to process, distribute,
				aggregate, store, or market locally or regionally produced agricultural food
				products in a manner that benefits agricultural producers and provides
				employment for residents of a rural area.</text>
										</subclause><subclause id="H9AC3E9A62F09417A9464438F043DA61F"><enum>(II)</enum><header>Retail</header><text display-inline="yes-display-inline">The Secretary may make or guarantee a
				business and industry loan for a rural or nonrural retail facility that
				provides access to locally or regionally produced agricultural products if the
				facility—</text>
											<item id="H535CB1D730C04C73AC274F13E66B6AC4"><enum>(aa)</enum><text>operates under a
				written policy that provides a clear preference for the products and
				demonstrates that a substantial portion of its business is or will be marketing
				the products; and</text>
											</item><item id="H005FCBCD9F7D4A40B160A6C5127FAE88"><enum>(bb)</enum><text>demonstrates that
				the facility has written agreements or will obtain written agreements with
				agricultural producers, agricultural producer groups, farmer or rancher
				cooperatives, or majority-controlled producer-based business ventures on
				marketing strategies that will increase the profitability and competitiveness
				of farmers and ranchers growing for the local or regional market.</text>
											</item></subclause></clause><clause id="H51523D435D6442E48E26CADE32C45182"><enum>(vi)</enum><header>Outreach</header><text>The
				Secretary shall develop and implement an outreach plan to publicize the
				availability of loans and loan guarantees under this paragraph, working closely
				with rural cooperative development centers, credit unions, community
				development financial institutions, regional economic development authorities,
				and other financial and economic development
				entities.</text>
									</clause><after-quoted-block>;</after-quoted-block></quoted-block>
							</clause></subparagraph><subparagraph id="HA27F4E960BE24FACAFB026F4A411E0C7"><enum>(C)</enum><text>in clause (vii)
			 (as so redesignated)—</text>

				at least ¼ of whom are beginning farmers and ranchers or socially disadvantaged
				farmers and ranchers.</text>
									</clause></subparagraph><subparagraph id="HAAA0246E102B44DC860AEC85736E1E4B"><enum>(B)</enum><header>Ranking</header><text>In
				evaluating and ranking proposals under this subsection, the Secretary shall
				give very substantial weight to the priorities described in subparagraph
				(A).</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H592C3DD854524F999AD3EE171BB2B06E"><enum>(B)</enum><text>by redesignating

				produced agricultural food product</header><text>In this subsection, the term
				<term>locally or regionally produced agricultural food product</term> has the
				meaning given the term in section 310B(g)(9) of the Consolidated Farm and Rural
				Development Act (7 U.S.C. 1932(g)(9)).</text>
							</paragraph><paragraph id="H1A1B3E1AE903475B9C34D131C09732E2"><enum>(2)</enum><header>Initiatives</header><text>The
				Secretary shall—</text>
								<subparagraph id="H9018CF90FB344CFABDE7956608273A2F"><enum>(A)</enum><text>collect data on
				the production and marketing of locally or regionally produced agricultural
				food products; and</text>
								</subparagraph><subparagraph id="H36B374CF737C4310AD467CA41359F481"><enum>(B)</enum><text>facilitate
				interagency collaboration and data sharing on research on local and regional
				food systems.</text>
								</subparagraph></paragraph><paragraph id="HE8270150D34041BAADBECC2782BE5045"><enum>(3)</enum><header>Requirements</header><text>In
				carrying out this subsection, the Secretary shall, at a minimum—</text>
								<subparagraph id="HF65354955F194575943A26F1E45A76A3"><enum>(A)</enum><text>collect and
				distribute comprehensive reporting of prices of locally or regionally produced
				agricultural food products;</text>
								</subparagraph><subparagraph id="HFB34C7D10BDB43D49263A5A1C2F32E6A"><enum>(B)</enum><text>conduct surveys
				and analysis and publish reports relating to the production, handling,
				distribution, retail sales, and trend studies (including consumer purchasing
				patterns) of or on locally or regionally produced agricultural food
				products;</text>
								</subparagraph><subparagraph id="HBDFABE47D89E4FF2A173E187594D5132"><enum>(C)</enum><text>form an
				interagency work group that includes representatives from—</text>
									<clause id="HCC86027B6331488CA616956E69DB3445"><enum>(i)</enum><text>the Agricultural
				Marketing Service;</text>
									</clause><clause id="HA16E067EF5954E35B2FD2BBF5C732344"><enum>(ii)</enum><text>the Agricultural
				Research Service;</text>
									</clause><clause id="HE5C6C40EF5A146A3AE045E18CF64B86B"><enum>(iii)</enum><text>the Economic
				Research Service;</text>
									</clause><clause id="HA02EA621D0FE48268A781C6A50664A95"><enum>(iv)</enum><text>the Food and
				Nutrition Service;</text>
									</clause><clause id="HFB9D7FAB82B445F586798FCC485C6B66"><enum>(v)</enum><text>the Food Safety
				and Inspection Service;</text>
									</clause><clause id="H4EB48456C092454C8659A0A1869A95EF"><enum>(vi)</enum><text>the National
				Agricultural Statistics Service;</text>
									</clause><clause id="H45D847D3610D4AEFAEE15CF49D2E39CE"><enum>(vii)</enum><text>the National
				Institute of Food and Agriculture; and</text>
									</clause><clause id="H61B1B5A539574ED3A1D317930610C905"><enum>(viii)</enum><text>other agencies
				that are involved in data collection and research on locally or regionally
				produced agricultural food products;</text>
									</clause></subparagraph><subparagraph id="HB69F8044BE79416CB26D9D1F356684F2"><enum>(D)</enum><text>expand the
				Agricultural Resource Management Surveys—</text>
									<clause id="H5801F67660C14709A900D1A06519CFDC"><enum>(i)</enum><text>to
				include questions on locally or regionally produced agricultural food products;
				and</text>
									</clause><clause id="HD76812B1366F49FAB5E9E490B9CB5ABF"><enum>(ii)</enum><text>sample a greater
				sector of agricultural producers, including agricultural producers engaged in
				the production of locally or regionally produced agricultural food
				products;</text>
									</clause></subparagraph><subparagraph id="H8240DB480FC646C89C4F80D817C8A9FB"><enum>(E)</enum><text>authorize the
				National Agricultural Statistics Service to create and administer—</text>
									<clause id="H43FAE67F31864881A208437C86D2897B"><enum>(i)</enum><text>a
				followup survey to the Census of Agriculture, in order to collect more detailed
				data on producers who indicated on the Census of Agriculture that the producers
				sell to markets for locally or regionally produced agricultural food products;
				and</text>
									</clause><clause id="H53A775FF369444C7ABBD3C386C6DB3B5"><enum>(ii)</enum><text display-inline="yes-display-inline">a survey for the purpose of collecting
				market data, including sales by product type and supply chain or sourcing data,
				from all vendors, including retail and wholesale vendors, of locally and
				regionally produced agricultural food products; and</text>
									</clause></subparagraph><subparagraph id="HEB0C422D73FB47C9876B92E2796FD372"><enum>(F)</enum><text>seek to establish
				or expand private-public partnerships to facilitate, to the maximum extent
				practicable, the collection of data on locally or regionally produced
				agricultural food products.</text>
								</subparagraph></paragraph><paragraph id="H4F239A5AF7964EE69D60F329368A8F16"><enum>(4)</enum><header>Funding</header>
								<subparagraph id="HAA573B598BEF49CFB4207385F06EEAEE"><enum>(A)</enum><header>In
				general</header><text>Of the funds of the Commodity Credit Corporation, the
				Secretary shall use to carry out this section $5,000,000, to remain available
				until expended.</text>
								</subparagraph><subparagraph id="H43FAB6444C1D4776A6201D492B76FF5A"><enum>(B)</enum><header>Additional
				funding</header><text>In addition to funds made available under paragraph (1),
				there are authorized to be appropriated to carry out this section $5,000,000
				for each of fiscal years 2012 through 2017, to remain available until
				expended.</text>

				group</header><text>In carrying out the special initiative, the Under Secretary
				shall establish a working group that reports to the Under Secretary, to be
				comprised of individuals who are responsible for the management or
				administration of public breeding programs in the Department from—</text>
								<clause id="H3096B90D275B4348883090314E329D0D"><enum>(i)</enum><text>the National
				Institute of Food and Agriculture;</text>
								</clause><clause id="HA2BB789FB536413D9DABB194F1B53CF6"><enum>(ii)</enum><text>the Agricultural
				Research Service;</text>
								</clause><clause id="H5647450E596F47F48EB81839B52A049C"><enum>(iii)</enum><text>the Economic
				Research Service; and</text>
								</clause><clause id="HCECF54C418A6474F93C8002982601EAF"><enum>(iv)</enum><text>the National
				Agricultural Statistics Service.</text>
								</clause></subparagraph><subparagraph id="H5972DC9677DB46D692FDFF370E19C517"><enum>(C)</enum><header>Duties of
				working group</header><text>The working group shall—</text>
								<clause id="H9103877B4ABA471A963C4559B53F51C0"><enum>(i)</enum><text>coordinate
				classical plant and animal breeding research being conducted at or funded by
				the agencies described in subparagraph (B)(i);</text>
								</clause><clause id="HCCB3C8F4BC75402D8EEE90A820C34343"><enum>(ii)</enum><text>carry out ongoing
				analysis and tracking activities for public grants to ensure that a diverse
				range of crop and animal breeding needs are being met in a timely and
				transparent manner;</text>
								</clause><clause id="HC425F22CCF7F45FF8CCB60BC42FF338F"><enum>(iii)</enum><text>coordinate and
				collaborate with the National Genetics Resource Advisory Council;</text>
								</clause><clause id="HF63A86D4E2DF4251B0BDCB853E3C7FC6"><enum>(iv)</enum><text>to maximize
				delivery of public cultivars and breeds, ensure efficient coordination of the
				activities the working group and those of—</text>
									<subclause id="H455C1D24ED364FCE9F702E48D7F12F1C"><enum>(I)</enum><text>the Agricultural
				Research Service;</text>
									</subclause><subclause id="HA71AF8B2A0574FB7860E4F7F6B9CF787"><enum>(II)</enum><text>National
				Institute of Food and Agriculture;</text>
									</subclause><subclause id="H7959022A7C8349E1B0424CB15020D696"><enum>(III)</enum><text>the National
				Genetic Resources Advisory Council;</text>
									</subclause><subclause id="HA08FFD05A7E54A1FBFA980DE43306E76"><enum>(IV)</enum><text>genetic resource
				conservation centers;</text>
									</subclause><subclause id="HDAB130771FC247E886F6173C0EF3D15B"><enum>(V)</enum><text>land grant
				universities;</text>
									</subclause><subclause id="H91811A71AE7E45A081FFADAAE99E794A"><enum>(VI)</enum><text>nongovernmental
				organizations with interests or expertise in classical breeding; and</text>
									</subclause><subclause id="H46B9F030A1C24BF49F17C6F3B49A7404"><enum>(VII)</enum><text>public and
				private classical plant and animal breeders; and</text>
									</subclause></clause><clause id="H24818BD7A0C74139B76AE4F1AF7E713D"><enum>(v)</enum><text>evaluate classical
				public plant and animal breeding activities and outcomes to make
				recommendations to the Under Secretary on the adequacy of human and financial
				resources needed to ensure that the next generation of public breeders and
				agricultural breeders are prepared to meet the challenges of the future.</text>
								</clause></subparagraph><subparagraph id="H0867E9F9B0D84DFE88C59B672EDA21FB"><enum>(D)</enum><header>Advisory
				board</header><text display-inline="yes-display-inline">The Under Secretary
				shall establish an advisory board whose primary duty will be to make
				recommendations to the working group on matters related to the duties specified
				in subparagraph (C). The advisory board shall be comprised of individuals with
				expertise in classical plant and animal breeding including representatives
				from—</text>
								<clause id="HBEC9DBA6CB9642B1A4AE886F59653726"><enum>(i)</enum><text>the Agricultural
				Research Service;</text>
								</clause><clause id="H8CF6F90720664541B935AFC81E16BF97"><enum>(ii)</enum><text>the National
				Institute of Food and Agriculture;</text>
								</clause><clause id="H3D3D5BA7D5F041EFA74E069966BCFA3F"><enum>(iii)</enum><text>the Extension
				Service;</text>
								</clause><clause id="HF25718A850034AB5959F9D70C5DCE353"><enum>(iv)</enum><text>private
				foundations and nonprofit organizations that have expertise in classical plant
				and animal breeding;</text>
								</clause><clause id="H7831C7D103F541FF9A28891590966709"><enum>(v)</enum><text>private
				agricultural research and technology transfer firms; and</text>
								</clause><clause id="H9C4FFDD291B5480487EE986886A05124"><enum>(vi)</enum><text>the Land Grant
				University
				System.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H586583E28F51499B9FA35847CDB60D57"><enum>(b)</enum><header>Conforming

			 regional food system enterprise facilitation</header><text display-inline="no-display-inline">Section 502 of the Rural Development Act of
			 1972 (7 U.S.C. 2662) in amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HE78F3B3ED7A34F32A0AB0275EEF4D98A" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H14EFEC46DE1C4629B8296EED0597FB2E"><enum>(j)</enum><header display-inline="yes-display-inline">Local and regional food system enterprise
				facilitation</header>
						<paragraph id="H05A3AA2A33FC4815AB7BAAF356CAB2B0"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish a local and regional food
				system enterprise facilitation initiative to increase technical assistance to
				help build sustainable local and regional food systems.</text>
						</paragraph><paragraph id="H1A66034058654AA8BC5B79F0ABDF150E"><enum>(2)</enum><header>Requirements</header><text>In
				carrying out this subsection, the Secretary shall, at a minimum—</text>
							<subparagraph id="HDF52507A4A1F4CE896D282FB52F65C5F"><enum>(A)</enum><text>authorize the
				establishment in the Extension Service of the position of enterprise
				facilitator (referred to in this subsection as an <quote>enterprise
				facilitator</quote>); and</text>
							</subparagraph><subparagraph id="H3E83BAEBA0E249C0BDCF5986D78FDCCA"><enum>(B)</enum><text>give priority to
				providing funding for enterprise facilitators that are located in areas
				that—</text>
								<clause id="H53D6EAD90E334A7CB3BBF632A5296AB0"><enum>(i)</enum><text>have high
				participation rates for the supplemental nutrition assistance program
				established under the <act-name parsable-cite="FSA77">Food and Nutrition Act of
				2008</act-name> (7 U.S.C. 2011 et seq.); and</text>
								</clause><clause id="HC4237DB382DE4B4A8BAE1DFE3EDDF842"><enum>(ii)</enum><text>are predominantly
				rural areas.</text>
								</clause></subparagraph></paragraph><paragraph id="HA6FBE350009F4985BE0F1CF7DA6FCDD8"><enum>(3)</enum><header>Grants</header><text>The
				Secretary may make grants on a competitive basis to nongovernmental
				organizations and institutions that have appropriate experience working on the
				rural development initiatives in the targeted areas described in paragraph
				(2)(B) to provide technical assistance to help build sustainable local and
				regional food systems if the Secretary determines that the Extension Service in
				a State or locality is not able to provide the assistance.</text>
						</paragraph><paragraph id="H51D6DF9B26FC47D7986AFDB3CD7348B5"><enum>(4)</enum><header>Duties</header><text>An
				enterprise facilitator shall, to the maximum extent practicable—</text>
							<subparagraph id="H4BAFF5B76329468CA3BA46544F5F234D"><enum>(A)</enum><text>identify and
				organize local food producers and entrepreneurs into entities that are able to
				deliver local and regional food into local markets, including—</text>
								<clause id="H774CA19A649244ACBD7E1343288835BF"><enum>(i)</enum><text>farmers
				markets;</text>
								</clause><clause id="HF6F6EE0740F547C196365F7BA1E79519"><enum>(ii)</enum><text>community
				kitchens;</text>
								</clause><clause id="H0B1164205D184D2ABA35F1F849546890"><enum>(iii)</enum><text>locally owned
				processing facilities;</text>
								</clause><clause id="H86D510D35C4C4535A4B7A6618E6D49C2"><enum>(iv)</enum><text>aggregation
				centers;</text>
								</clause><clause id="H69FF96DE30EF4C629575A2EB4192F7DC"><enum>(v)</enum><text>transportation
				cooperatives; and</text>
								</clause><clause id="H2553FF6E7F2F49CF8038CE71BFE91837"><enum>(vi)</enum><text>collaborative
				production cooperatives;</text>
								</clause></subparagraph><subparagraph id="HBAF3D86CE6AE4291B50CCF035E386821"><enum>(B)</enum><text>develop
				partnerships with local and regional organizations and institutions to provide
				resources for effective partnerships to train entrepreneurs and facilitate new
				enterprises;</text>
							</subparagraph><subparagraph id="H72C96CA19CB24F9AAE0F0FD39BC7C02E"><enum>(C)</enum><text>assist
				agricultural producers and processors with marketing and distribution of local
				and regional food products;</text>
							</subparagraph><subparagraph id="H22889F3A3CAC411BB309A5B2A9440548"><enum>(D)</enum><text>identify and work
				to remove barriers to the movement of local and regional food products into the
				marketplace;</text>
							</subparagraph><subparagraph id="H4D16AA6218B04544BE178596122CB3B4"><enum>(E)</enum><text>encourage new
				agricultural producers to produce foods for local and regional markets;</text>
							</subparagraph><subparagraph id="HCD46505D5A7F441A9B48ABDF5566FAC5"><enum>(F)</enum><text>provide education
				programs to new agricultural producers that emphasize local and regional
				foods;</text>
							</subparagraph><subparagraph id="H1B39164600BD42AFA85C7803DFBEB24B"><enum>(G)</enum><text>work with local
				expanded food and nutrition education programs, schools and other local
				institutions, and individuals to develop food processing skills;</text>
							</subparagraph><subparagraph id="HBAECCCE19369433BB4E40725FBBD0B20"><enum>(H)</enum><text>provide technical
				assistance in the preparation of grant and loan applications to promote the
				purposes of this subsection; and</text>
							</subparagraph><subparagraph id="H7D28BBA4BA3C404FBA7FF4F80342E4C6"><enum>(I)</enum><text>work with private
				sources of funding and other Federal and State agencies to acquire grants and
				loans to promote the purposes of this subsection.</text>
							</subparagraph></paragraph><paragraph id="HEAFD75E9F9154101873A317957EB8405"><enum>(5)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this subsection such sums as are
				necessary.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 requirements</header><text>Subsection (e) of such section 101 is

				specialty crop agriculture, including all types of farm enterprises, organic
				farming systems, beginning and socially disadvantaged farmers and ranchers, and
				small and mid-scale farms;</text>
								</subparagraph><subparagraph id="H5E13301FCBFA45FA94CB3B2A5933E786"><enum>(B)</enum><text>the full array of
				funding areas, including—</text>
									<clause id="H6BCCBF8BF94B4A289F2054B1BFFD4F9D"><enum>(i)</enum><text>research and
				education;</text>
									</clause><clause id="HBC73B7EFB6E54D589143A5F680814562"><enum>(ii)</enum><text>nutrition and
				public health;</text>
									</clause><clause id="H11DD0D6E87784D01A5C16DA95589A5AC"><enum>(iii)</enum><text>pest and plant
				health;</text>
									</clause><clause id="HEF7E80DB1BA8444A954F5D9DDDB1EAB1"><enum>(iv)</enum><text>conservation and
				the environment;</text>
									</clause><clause id="HB9B28BC734E1481DADCE88CA88056034"><enum>(v)</enum><text>food
				safety;</text>
									</clause><clause id="HC4128ABD66F4483BA850F8D045AE9C48"><enum>(vi)</enum><text>marketing and
				promotion; and</text>
									</clause><clause id="H23FE3D69DB07442DA579C2CBC759780B"><enum>(vii)</enum><text>production;
				and</text>
									</clause></subparagraph><subparagraph id="HC90CC9950FEB4437958EFDF063200085"><enum>(C)</enum><text>the full range of
				activities inherent in developing systems for locally or regionally produced
				foods, including issues related to processing, distributing, aggregating,
				storing, marketing, and
				consumption.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H0DF3E72F9CC0466BAFE8D5340EECC1A7"><enum>(d)</enum><header>Review of
			 application</header><text>Subsection (f) of such section 101 is amended—</text>
					<paragraph id="H212C770C5F914B068C80B17CC29795F9"><enum>(1)</enum><text>by striking
			 <quote>purpose</quote> and inserting <quote>purposes</quote>; and</text>
					</paragraph><paragraph id="H46E2A455E625429DB594AB2C25A9D860"><enum>(2)</enum><text>by striking
			 <quote>subsection (a)</quote> and inserting <quote>subsection (a), and would
			 represent a balanced and equitable distribution of grant funds, as specified in
			 subsection (e)</quote>.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="HBE57B2D4E6B24BCC9300660E68C3D910"><enum>(e)</enum><header>Preference</header><text>Such
			 section 101 is further amended—</text>
					<paragraph id="HAECCE2C710004F7290309E9155DA1E83"><enum>(1)</enum><text>by redesignating
			 subsections (g), (h), (i), and (j) as subsections (i), (j), (k), and (n),
			 respectively; and</text>
					</paragraph><paragraph id="HDDEB026FBCDB4B2A9BD54A77E9F89EC3"><enum>(2)</enum><text>by inserting after
			 subsection (f) the following new subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H20E68B90EF474DDFBEA5D3211AE1C3BF" style="OLC">
							<subsection id="H4CCD4E8923A149D68FFD779E69579C82"><enum>(g)</enum><header>Preference</header><text>In
				using grant funds provided under this section, the State receiving the grant
				shall give a preference to marketing proposals that—</text>
								<paragraph id="HC32309FD3A0145F4B88424AEA82C3406"><enum>(1)</enum><text>demonstrate
				ability to have direct positive impact on—</text>
									<subparagraph id="H0B962571B7A042E1BC7DB6FF2E012EB8"><enum>(A)</enum><text>farm profitability
				and sustainability;</text>
									</subparagraph><subparagraph id="H7B01FBA7E548411796B078931872AE0F"><enum>(B)</enum><text>improved
				distribution capacity for locally or regionally produced foods; or</text>
									</subparagraph><subparagraph id="H1A2486A90BC84DB785C21AF338820E78"><enum>(C)</enum><text>increased domestic
				consumption and affordability of edible specialty crops, particularly in
				low-income communities; and</text>
									</subparagraph></paragraph><paragraph id="H1B6C29F8FB9F436CAF797CC91B353F6B"><enum>(2)</enum><text>in which final
				products are marketed so that the total distance that products are transported
				for final sale is less than 250 miles from the origin of the
				products.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H51154398B1C84C1F94DDA8E04BEE92A0"><enum>(f)</enum><header>Transparency</header><text>Such
			 section 101 is further amended by inserting after subsection (g), as added by
			 subsection (e) of this section, the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HD3869107B3AE4D8AB1AEB19EE5A1977C" style="OLC">
						<subsection id="H8FB14F81821B470F8D3CE7AAC1D9F698"><enum>(h)</enum><header>Transparency</header><text display-inline="yes-display-inline">Each State receiving a grant under this
				section shall, in a timely manner, publish on an Internet website summary
				information about all grants received under this section and reports on the
				implementation of projects funded by such
				grants.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H7F44EB0D1A7D4FB3A346A4F8CD6172E0"><enum>(g)</enum><header>Use of grant
			 funds</header><text>Such section 101 is further amended by inserting after
			 subsection (k), as redesignated by subsection (e)(1) of this section, the
			 following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H4C13F18AA67F4D379AABEEC804BC4A5F" style="OLC">
						<subsection id="HF3BC373DD92E48E0805D424C513DC680"><enum>(l)</enum><header>Use of grant
				funds</header><text display-inline="yes-display-inline">The Secretary shall
				consider expansion of the grant program under this section to include
				traditional foods of federally recognized Indian tribes and other minority
				communities and may publish appropriate guidance to States receiving grants
				under this section regarding any such
				expansion.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H58D02221C6724DC6BE29B02B790E9736"><enum>(h)</enum><header>Other use of
			 funds</header><text>Such section 101 is further amended by inserting after
			 subsection (l), as added by subsection (g) of this section, the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HDEFE49EA35D34CFBA2F7BE743F6A06CD" style="OLC">
						<subsection id="H171F4FCC8CA84633B2E7E9BC5A7D7021"><enum>(m)</enum><header>Other use of
				funds</header>
							<paragraph id="H657444B3BDE64EFDB44C856D2CB74F38"><enum>(1)</enum><header>National
				research and evaluation</header><text display-inline="yes-display-inline">Of
				the funds made available under subsection (n), the Secretary shall use not less
				than $5,000,000 for a nationally-coordinated and regionally-balanced research
				and evaluation effort on the redevelopment of locally or regionally produced
				food systems conducted through a consortium of land grant universities, in
				partnership with non-governmental organizations engaged in work on locally or
				regionally produced food systems.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HC5A5118FE92E4148B2400AD06EC29388"><enum>(2)</enum><header>Locally or
				regionally produced food system development</header><text display-inline="yes-display-inline">Of the funds made available under
				subsection (n), the Secretary shall use $30,000,000 during each fiscal year for
				locally or regionally produced food system specialty crop development,
				including development or enhancement of State and regional local food marketing
				programs, local and regional food enterprise development, farmer-to-consumer
				direct marketing, direct-to-store and direct-to-institution marketing, regional
				supply chains, regional food hubs, new farmer development, and State food
				policy
				councils.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H0B6BEB82641242CA8CD75CBCC846130C"><enum>(i)</enum><header>Funding</header><text>Subsection
			 (n) of such section 101, as redesignated by subsection (e)(1) of this section,
			 is amended by striking <quote>shall make grants</quote> and all that follows
			 and inserting <quote>shall use $90,000,000 for each of fiscal years 2013
			 through 2017 to carry out this section.</quote>.</text>
				</subsection><subsection id="H1BF97565F3FF4F6DBF9361E91CD93C7D"><enum>(j)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 October 1, 2012.</text>
				</subsection></section><section id="H9F21F335C37B4171A0F80150084822F6"><enum>7002.</enum><header>National
			 organic certification cost-share program</header>
				<subsection id="H98B9DDA340404367843F64ED838D910B"><enum>(a)</enum><header>Reauthorization</header><text display-inline="yes-display-inline">Section 10606 of the Farm Security and
			 Rural Investment Act of 2002 (7 U.S.C. 6523) is amended—</text>
					<paragraph id="H206E58FC6FDD4D55AED89817AB480563"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>Of the funds</quote> and all that follows through
			 <quote>until expended, to</quote> and inserting <quote>The Secretary of
			 Agriculture (acting through the Agricultural Marketing Service) shall</quote>;
			 and</text>
					</paragraph><paragraph id="HEC4DD0630C1242EF9D0B23C0BB2B688B"><enum>(2)</enum><text>in subsection
			 (b)(2), by striking <quote>$750</quote> and inserting
			 <quote>$1,000</quote>.</text>
					</paragraph></subsection><subsection id="HD0D54214EDE841E5880F71FD2816BEEC"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on October 1, 2012.</text>
				</subsection></section><section id="HC2803A4BDE954A869A17BC4DCA1AECC8"><enum>7003.</enum><header>Availability
			 of organic certification cost share assistance and risk management education
			 and community outreach partnership assistance under the Federal Crop Insurance
			 Act</header><text display-inline="no-display-inline">Subsection (b) of section
			 524 of the Federal Crop Insurance Act (7 U.S.C. 1524) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HE752E6EA5A4D49CAB23D8B7049F2FFD3" style="OLC">
					<subsection id="H1766050800664B37AAFF5199E5E6FD79"><enum>(b)</enum><header>Organic
				certification cost share assistance and risk management education and community
				outreach partnership assistance</header>
						<paragraph id="H7648EC8AF051454B9FB880A9DC3590A5"><enum>(1)</enum><header>Provision of
				assistance</header><text display-inline="yes-display-inline">The Secretary
				shall provide organic certification cost share assistance and risk management
				education and community outreach partnership assistance asa provided in
				paragraph (4).</text>
						</paragraph><paragraph id="HAD7E2738976A4216B05D7EE296C59DE6"><enum>(2)</enum><header>Use of Commodity
				Credit Corporation</header><text display-inline="yes-display-inline">The
				Secretary shall carry out this subsection through the Commodity Credit
				Corporation.</text>
						</paragraph><paragraph id="H4F62CB51B5594041B3F62B8E7030D031"><enum>(3)</enum><header>Funding</header><text display-inline="yes-display-inline">Subject to paragraph (4), the Commodity
				Credit Corporation shall make available to carry out this subsection not less
				than $10,000,000 for each fiscal year.</text>
						</paragraph><paragraph id="H81A8673EDD4349BAB4E036B17467D1B1"><enum>(4)</enum><header>Distribution of
				funds</header><text display-inline="yes-display-inline">Of the amount made
				available under paragraph (3) for a fiscal year—</text>
							<subparagraph id="H1615E74859164FB3A3635529118ADC9F"><enum>(A)</enum><text display-inline="yes-display-inline">70 percent shall be used to provide organic
				certification cost share assistance pursuant to section 10606 of the Farm
				Security and Rural Investment Act of 2002 (7 U.S.C. 1524); and</text>
							</subparagraph><subparagraph id="H84211BD3410E48FEBA874C56473CF37F"><enum>(B)</enum><text display-inline="yes-display-inline">30 percent shall be used to conduct
				activities to support risk management education and community outreach
				partnerships pursuant to section
				522(d).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section display-inline="no-display-inline" id="H3253946BD6314779928BA5409399A9F2" section-type="subsequent-section"><enum>7004.</enum><header>Local Marketing
			 Promotion Program</header><text display-inline="no-display-inline">Section 6 of
			 the Farmer-to-Consumer Direct Marketing Act of 1976 (7 U.S.C. 3005) is amended
			 to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H660A9406B4C041A68FDED39FF5D8F8C4" style="OLC">
					<section id="H7C459542C64C4C13AA874B5E9260CAD8"><enum>6.</enum><header>Local Marketing
				Promotion Program</header>
						<subsection id="H0A946CAF2D9E47B59D4E79C1E8654D2D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall carry out a program, to
				be known as the <quote>Local Marketing Promotion Program</quote> (referred to
				in this section as the <quote>Program</quote>), to make grants to eligible
				entities for projects to establish, expand, and promote direct
				producer-to-consumer marketing, including farmers’ markets, and other local and
				regional food markets.</text>
						</subsection><subsection id="H3E4295554379405AB31A61AB6C1703E8"><enum>(b)</enum><header>Program
				Purposes</header>
							<paragraph id="H2F8338D40BD24923BE84B7F29C804CE4"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The purposes of the
				Program are to increase domestic consumption of and access to locally and
				regionally produced agricultural products by—</text>
								<subparagraph id="H24444466385147B4B62548B84CA20086"><enum>(A)</enum><text>improving and
				expanding or assisting in the improvement and expansion of—</text>
									<clause id="H45631703D88F4707B052D4DF2D7FDE86"><enum>(i)</enum><text display-inline="yes-display-inline">domestic farmers’ markets, farm and
				roadside stands, community-supported agriculture and community-supported
				fishery programs, agritourism activities, green carts, route vendors, buying
				clubs, and other direct producer-to-consumer market opportunities; and</text>
									</clause><clause id="H7D1B9EB78E894DDAA87359BD0594A5C5"><enum>(ii)</enum><text>local and
				regional food markets that are not direct farmer-to-consumer markets, but that
				may include the scaling up of such direct markets, including processing,
				distributing, aggregating, storing, and marketing;</text>
									</clause></subparagraph><subparagraph id="H8DF488DC9C1E47EA99FA14BF996C19BC"><enum>(B)</enum><text>developing or
				aiding in the development of—</text>
									<clause id="HEA36DCDD1FEB4F9D8D2A471AFB6A900D"><enum>(i)</enum><text>new farmers'
				markets, roadside stands, community-supported agriculture and
				community-supported fishery programs, agritourism activities, and other direct
				producer-to-consumer marketing opportunities; and</text>
									</clause><clause id="HD07553156BB84254A56F67A53D53C4B6"><enum>(ii)</enum><text display-inline="yes-display-inline">local and regional food markets that are
				not direct farmer-to-consumer markets, but that may include the scaling up of
				such direct markets, including processing, distributing, aggregating, storing,
				and marketing.</text>
									</clause></subparagraph></paragraph><paragraph id="HF840AA5C9F8D4E47B7F3DED2D8087BC7"><enum>(2)</enum><header>Limitations</header><text>An
				eligible entity may not use a grant or other assistance provided under the
				Program for the purchase, construction, or rehabilitation of a building or
				structure.</text>
							</paragraph></subsection><subsection id="HAEFDEF669A12432F8A80336639DDEC58"><enum>(c)</enum><header>Eligible
				Entities</header><text>An entity shall be eligible to receive a grant under the
				Program if the entity is—</text>
							<paragraph id="H51D2360C8018437B9AC8721251A509AD"><enum>(1)</enum><text display-inline="yes-display-inline">an agricultural or fishing cooperative or
				other business entity or a producer or fisher network or association, including
				community-supported agriculture or fishery networks or associations;</text>
							</paragraph><paragraph id="H507312F3DCFF40BB9CD10BA5231D195B"><enum>(2)</enum><text>a local
				government;</text>
							</paragraph><paragraph id="H7D2905E14EDE49199CB852358B917473"><enum>(3)</enum><text>a nonprofit
				corporation;</text>
							</paragraph><paragraph id="H479A2A5625894BAF94C17DA592FCE094"><enum>(4)</enum><text>a public benefit
				corporation;</text>
							</paragraph><paragraph id="HD8DB39078AC14878914DA10D3A27D998"><enum>(5)</enum><text>an economic
				development corporation;</text>
							</paragraph><paragraph id="H2DA22D75FAF3445E9EF20BA21C8ABBF6"><enum>(6)</enum><text>a regional
				farmers' market authority; or</text>
							</paragraph><paragraph id="H9BA5BEA4F6E04E269AE97ADB6356ED36"><enum>(7)</enum><text>such other entity
				as the Secretary may designate.</text>
							</paragraph></subsection><subsection id="HF3B4458A67A04BCBBCC61F56D3ED726A"><enum>(d)</enum><header>Criteria and
				Guidelines</header><text>The Secretary shall establish criteria and guidelines
				for the submission, evaluation, and funding of proposed projects under the
				Program.</text>
						</subsection><subsection id="H5F9917848FCF4EE5A02063583A1BD2A5"><enum>(e)</enum><header>Priorities</header>
							<paragraph id="HF5A91301E3DD4D189A5887E7DE3F726A"><enum>(1)</enum><header>Preference for
				certain communities and operations</header><text>In providing grants under the
				Program, priority shall be given to applications that include projects—</text>
								<subparagraph id="HE7B61F8B78834AEAA299D437234AB5F9"><enum>(A)</enum><text>to benefit
				underserved communities; and</text>
								</subparagraph><subparagraph id="H5E25F2FC4B2A45C8AC8FFFFFD9137B00"><enum>(B)</enum><text>to develop market
				opportunities for small and mid-sized farm and ranch operations.</text>
								</subparagraph></paragraph><paragraph id="H4A11B3FB2D6A435AB6B7375F4878BB51"><enum>(2)</enum><header>Preference for
				producer-only farmers’ markets</header><text>In providing grants under the
				direct marketing portion of the Program, priority shall be given to
				producer-only farmers’ markets.</text>
							</paragraph></subsection><subsection id="H6A4F508A5D5A4082AD33152F519EB87E"><enum>(f)</enum><header>Funding</header>
							<paragraph id="H30605B01BFBE4EA28B3F339ACCB695A6"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall use $30,000,000 of the funds of the
				Commodity Credit Corporation each fiscal year to carry out the Program.</text>
							</paragraph><paragraph id="H9A2A3F7417444B569ACF76AEDB944613"><enum>(2)</enum><header>Use of
				funds</header>
								<subparagraph id="H2901723FFF30419B8DC48E97F5F393E1"><enum>(A)</enum><header>Distribution
				between purposes</header><text display-inline="yes-display-inline">Of the funds
				made available under paragraph (1) for a fiscal year—</text>
									<clause id="H995769DF740745008CFCCAB39DE3EA35"><enum>(i)</enum><text display-inline="yes-display-inline">50 percent shall be used for the direct
				marketing portion of the Program in subparagraphs (A)(i) and (B)(i) of
				subsection (b)(1); and</text>
									</clause><clause id="H00EEC92ADF5842B089BB96677A7BA12B"><enum>(ii)</enum><text display-inline="yes-display-inline">50 percent shall be used for the local and
				regional food portion of the Program in subparagraphs (A)(ii) and (B)(ii) of
				subsection (b)(1).</text>
									</clause></subparagraph><subparagraph id="HD40AAD23DD724ED3B53425E18B699DED"><enum>(B)</enum><header>Direct marketing
				portion</header><text display-inline="yes-display-inline">For each of the
				following, not less than 10 percent of the funds reserved for the direct
				marketing portion of the Program in a fiscal year under paragraph (2)(A)(i)
				shall be used—</text>
									<clause id="H70C5DAFBE84B48EBA17BEACF13793F98"><enum>(i)</enum><text display-inline="yes-display-inline">to support outreach, education, and
				operation of the use of electronic benefits transfers for Federal nutrition
				programs at farmers’ markets and other direct marketing outlets including farm
				and roadside stands, community-supported agriculture and community-supported
				fishery programs, green carts, route vendors and buying clubs; and</text>
									</clause><clause id="HE0FAF3A9D67C490A8963554AF39158F4"><enum>(ii)</enum><text>to provide
				general technical assistance and organizational capacity building grants to
				strengthen market development networks and otherwise enhance the outcomes of
				the Program.</text>
									</clause></subparagraph><subparagraph id="H679679924E9A4A28AE921374C59DAD65"><enum>(C)</enum><header>Local and
				regional food portion</header><text display-inline="yes-display-inline">Not
				less than 10 percent of the funds reserved for the local and regional food
				portion of the Program in a fiscal year under paragraph (2)(A)(ii) shall be
				used to provide technical assistance grants to strengthen the ability of small
				and medium-sized agricultural producers, food wholesalers and retailers,
				schools, and other individuals, organizations, entities, and institutions for
				processing, distributing, aggregating, storing, and marketing locally and
				regionally produced agricultural products. Funds reserved under such paragraph
				may be used—</text>
									<clause id="H26B43A4F6B9248619F241D243B8F2E9F"><enum>(i)</enum><text display-inline="yes-display-inline">to carry out feasibility studies related to
				the local and regional food portion of the Program; and</text>
									</clause><clause id="H7F60EDCCCFB94AF4AAF03FEFBED3462A"><enum>(ii)</enum><text>to assist
				enterprises that process, distribute, aggregate, store, and market locally and
				regionally produced foods.</text>
									</clause></subparagraph></paragraph><paragraph id="H30BEAE331FE44A84AB10A3908BC2305F"><enum>(3)</enum><header>Interdepartmental
				coordination</header><text>In carrying out this subsection, the Secretary shall
				ensure coordination between the various agencies to the maximum extent
				practicable.</text>
							</paragraph><paragraph id="H11E7FEE0453445F38D22281CC63FBD5E"><enum>(4)</enum><header>Limitations</header>
								<subparagraph id="H422F7384FA7543DDBCF691E86AD0DD76"><enum>(A)</enum><header>Administrative
				expenses</header><text display-inline="yes-display-inline">Not more than 10
				percent of the total amount made available under paragraph (1) for a fiscal
				year may be used for administrative expenses.</text>
								</subparagraph><subparagraph id="HF1B11DD810144E9EA55C48D5213A1424"><enum>(B)</enum><header>Project
				limitations</header><text>Funds described in paragraph (2)(B)(i)—</text>
									<clause id="HCD3133C0D36D44B0A268552EAD0A85D2"><enum>(i)</enum><text>may not be used
				for the ongoing cost of carrying out any project; and</text>

			</section></title><title id="H96ABBEC3D9944701ACA67C2624199899"><enum>VIII</enum><header>Poultry and
			 Livestock</header>
			<section id="H18062B6874C4473E8DFB018B5940E091" section-type="subsequent-section"><enum>8001.</enum><header>Small and very
			 small meat processing plants</header>
				<subsection id="H4A81B12F7B7749F88A936965DD993B9D"><enum>(a)</enum><header>Technical
			 assistance and guidance</header><text display-inline="yes-display-inline">The
			 Federal Meat Inspection Act (21 U.S.C. 601 et seq.) is amended by adding at the
			 end the following new title:</text>
					<quoted-block display-inline="no-display-inline" id="HD8B41B7D132942D3B960F4011580C15C" style="OLC">
						<title id="H21BEDE5D089046C6B920AD23C3112EDB"><enum>VI</enum><header>Very small and
				certain small establishments</header>
							<section id="HF6D86679149F4C718F5DA1E8AB18F0EA"><enum>601.</enum><header>Technical
				assistance</header>
								<subsection id="H84820B83A3D146BF976BA1F3420C951C"><enum>(a)</enum><header>Establishment</header><text>The
				Secretary shall establish in the Food Safety and Inspection Service of the
				Department of Agriculture a technical assistance division to coordinate the
				initiatives of any other appropriate agency of the Department of Agriculture to
				provide—</text>
									<paragraph id="HF859C514FCEF40B2A84D7261D748765E"><enum>(1)</enum><text>outreach,
				education, and training to very small or certain small establishments (as
				defined by the Secretary);</text>
									</paragraph><paragraph id="HC5962A6007554284B023EE93021C23F8"><enum>(2)</enum><text display-inline="yes-display-inline">grants to appropriate State agencies,
				educational institutions, non-governmental organizations with appropriate
				expertise, or networks or partnerships of such agencies, such institutions, and
				such organizations to provide outreach, technical assistance, education, and
				training to very small or certain small establishments; and</text>
									</paragraph><paragraph id="H907B41F5C3EE4B8BB7280B8E56E339B8"><enum>(3)</enum><text>grants to
				appropriate State agencies to provide outreach, technical assistance,
				education, and training to very small or certain small establishments.</text>
									</paragraph></subsection><subsection id="H5972F1A6B5CB4AA9BD457B7B2E0F34F1"><enum>(b)</enum><header>Personnel</header><text>The
				technical assistance division shall be comprised of individuals that, as
				determined by the Secretary—</text>
									<paragraph id="H73BEB483BECC482AB6B77AB6B15E211B"><enum>(1)</enum><text>are of a quantity
				sufficient to carry out the duties of the technical assistance division;
				and</text>
									</paragraph><paragraph id="H6D4FC2AC9F974300926EB5D5C49CF340"><enum>(2)</enum><text>possess
				appropriate qualifications and expertise relating to the duties of the
				technical assistance division.</text>
									</paragraph></subsection></section><section id="H4DA8CD8A7DF540779335C8FEAD15B081"><enum>602.</enum><header>Guidance</header>
								<subsection id="HBA240E0965A449BBB55B425846D6596A"><enum>(a)</enum><header>Purpose</header><text>Not
				later than 2 years after the date of the enactment of this section, the
				Secretary, acting through the Food Safety and Inspection Service, shall issue
				guidance to allow very small or certain small establishments (as defined by the
				Secretary under section 601) to demonstrate compliance with required food
				safety and sanitation standards upon a showing that the process controls for
				food safety and sanitation are being applied.</text>
								</subsection><subsection id="HCC790C47D4334EE0AD4A346E7CEA0B6A"><enum>(b)</enum><header>Content</header><text>The
				guidance issued under subsection (a) shall address process controls,
				appropriate for the size and scale of a facility, for—</text>
									<paragraph id="H2197BF154D0942B1A442EE291CAD56A8"><enum>(1)</enum><text>slaughter and
				processing facilities that conduct Federal inspections, State inspections, or
				custom slaughter or processing at the facility;</text>
									</paragraph><paragraph id="H6863B8F4B2C94E2DA0A14091E0EE6633"><enum>(2)</enum><text>leased slaughter
				and processing facilities;</text>
									</paragraph><paragraph id="H60EDDE35EF6243FBB8A1AF6C3587F8E1"><enum>(3)</enum><text>on-farm slaughter
				and processing;</text>
									</paragraph><paragraph id="H15424619A6F14AF6A103C3B49FE85891"><enum>(4)</enum><text>mobile slaughter
				and processing facilities; and</text>
									</paragraph><paragraph id="H680C6E261D6941C3B6CE07E0B99E0136"><enum>(5)</enum><text>other facilities
				or circumstances determined by the stakeholders group referred to in subsection
				(c) to be relevant to very small or certain small establishments.</text>
									</paragraph></subsection><subsection id="H6795B25E5DF64C9DAE6384E8DD4AD0DB"><enum>(c)</enum><header>Stakeholder
				Group</header>
									<paragraph id="H7E5FE49778AC4FDC8CBBFEB55922758B"><enum>(1)</enum><header>In
				general</header><text>Not later than 90 days after the date of the enactment of
				this section, the Secretary shall convene a stakeholders group with expertise
				on small scale processing facilities, including mobile processing facilities,
				to prepare proposed guidance on process controls for food safety and sanitation
				for very small or certain small establishments.</text>
									</paragraph><paragraph id="H6655633BAA66497EA15B8B54C55C4131"><enum>(2)</enum><header>Membership</header><text>The
				stakeholders group convened under paragraph (1) shall include—</text>
										<subparagraph id="HD9BA87F14E4D4B78BEF4C6AB5A342FDF"><enum>(A)</enum><text>small scale
				growers;</text>
										</subparagraph><subparagraph id="HF5E3CE82B41D4AA0A51FD738FDE0E1C6"><enum>(B)</enum><text>operators of small
				scale slaughtering and processing facilities; and</text>
										</subparagraph><subparagraph id="HA78AFA188F75481183BF6458E1B3D41A"><enum>(C)</enum><text>representatives
				from appropriate Federal and State agencies, educational institutions,
				non-governmental organizations with appropriate expertise, or networks or
				partnerships of such agencies, such institutions, and such
				organizations.</text>
										</subparagraph></paragraph></subsection><subsection id="H692D4D8D7EBE40BE84131B0F171BCFFD"><enum>(d)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to the Secretary $5,000,000 for each of fiscal
				years 2013 through 2017 to carry out this title and section 32 of the Poultry
				Products Inspection
				Act.</text>
								</subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HB13936F190D14954B501B267CC6C8261"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 501 of the Federal Meat Inspection Act (21
			 U.S.C. 683) is amended—</text>
					<paragraph id="H397E83F781D54C62AEB7F1476A360F2A"><enum>(1)</enum><text>in subsection
			 (b)(3)(B)(ii), by striking <quote>subsection (j)</quote> and inserting
			 <quote>subsection (i)</quote>;</text>
					</paragraph><paragraph id="H694BFB0C9A174F15AA7E247DBF25F168"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(1), by striking
			 <quote>subsection (j)</quote> and inserting <quote>subsection
			 (i)</quote>;</text>

			 small poultry processing plants</header><text display-inline="no-display-inline">The Poultry Products Inspection Act (21
			 U.S.C. 451 et seq.) is amended by adding at the end the following new
			 section:</text>

				assistance</header>
							<paragraph id="H068D8367414A48639C47AEA0C688A4C7"><enum>(1)</enum><header>Establishment</header><text>The
				Secretary shall establish in the Food Safety and Inspection Service of the
				Department of Agriculture a technical assistance division to coordinate the
				initiatives of any other appropriate agency of the Department of Agriculture to
				provide—</text>

				appropriate State agencies to provide outreach, technical assistance,
				education, and training to very small or certain small establishments.</text>
								</subparagraph></paragraph><paragraph id="H9BF1C06A53F946FA93244FCD6285CC04"><enum>(2)</enum><header>Personnel</header><text>The
				technical assistance division shall be comprised of individuals that, as
				determined by the Secretary—</text>
								<subparagraph id="H72519A56A08A43EF883513FF1C497D69"><enum>(A)</enum><text>are of a quantity
				sufficient to carry out the duties of the technical assistance division;
				and</text>
								</subparagraph><subparagraph id="HF5FA4290FEF44F6CB2E0D3A162EC2B10"><enum>(B)</enum><text>possess
				appropriate qualifications and expertise relating to the duties of the
				technical assistance division.</text>
								</subparagraph></paragraph></subsection><subsection id="H513ACD95A68546D3B553B95162D1B85C"><enum>(b)</enum><header>Guidance</header>
							<paragraph id="H9BBE790A7CBB4DABBA33B0A76A48DC28"><enum>(1)</enum><header>Purpose</header><text>Not
				later than 2 years after the date of the enactment of this section, the
				Secretary, acting through the Food Safety and Inspection Service, shall issue
				guidance to allow very small or certain small establishments (as defined by the
				Secretary under subsection (a)) to demonstrate compliance with required food
				safety and sanitation standards upon a showing that the process controls for
				food safety and sanitation are being applied.</text>
							</paragraph><paragraph id="H519A268D18174AD4AC5FEB2D43FAF3C4"><enum>(2)</enum><header>Content</header><text>The
				guidance issued under paragraph (1) shall address process controls, appropriate
				for the size and scale of a facility, for—</text>
								<subparagraph id="H16B0ECBE44F5470A8D900AFB6C0D1BB1"><enum>(A)</enum><text>slaughter and
				processing facilities that conduct Federal inspections, State inspections, or
				custom slaughter or processing at the facility;</text>
								</subparagraph><subparagraph id="H74021DF661F94B9B8EF3D00D341ED6A6"><enum>(B)</enum><text>leased slaughter
				and processing facilities;</text>
								</subparagraph><subparagraph id="H04E4C43928F749F3ACD67DC9E41D52E4"><enum>(C)</enum><text>on-farm slaughter
				and processing;</text>
								</subparagraph><subparagraph id="H01A29329D8AA4E29894C44F519E96388"><enum>(D)</enum><text>mobile slaughter
				and processing facilities; and</text>
								</subparagraph><subparagraph id="H0ECF80F076A5441BA3692FB879C821E8"><enum>(E)</enum><text>other facilities
				or circumstances determined by the stakeholders group referred to in paragraph
				(3) to be relevant to very small or certain small establishments.</text>
								</subparagraph></paragraph><paragraph id="H8C9E53B1CD44443A8509A65BF769EF4E"><enum>(3)</enum><header>Stakeholder
				Group</header>
								<subparagraph id="HDE27F59C73B84A31A279A9FC39F4E310"><enum>(A)</enum><header>In
				general</header><text>Not later than 90 days after the date of the enactment of
				this section, the Secretary shall convene a stakeholders group with expertise
				on small scale processing facilities, including mobile processing facilities,
				to prepare proposed guidance on process controls for food safety and sanitation
				for very small or certain small establishments.</text>
								</subparagraph><subparagraph id="H9CFACAF8C6394FE09013C8BE54231EFE"><enum>(B)</enum><header>Membership</header><text>The
				stakeholders group convened under subparagraph (A) shall include—</text>
									<clause id="H1729CBF4A0C84E60A443118857D643D6"><enum>(i)</enum><text>small scale
				growers;</text>
									</clause><clause id="HB7EEBC74B211417293E4E7013C1B2417"><enum>(ii)</enum><text>operators of
				small scale slaughtering and processing facilities; and</text>
									</clause><clause id="H19D5664C31514A00896C37B891A8A653"><enum>(iii)</enum><text>representatives
				from appropriate Federal and State agencies, educational institutions,
				non-governmental organizations with appropriate expertise, or networks or
				partnerships of such agencies, such institutions, and such
				organizations.</text>
									</clause></subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H8CD99AD0385D45A393CC73808E3715F8"><enum>(c)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">The
				authorization of appropriations for this section appears in section 602 of the
				Federal Meat Inspection
				Act.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H256FB8CC7A7B4CBAA40F9D7540ABD36A"><enum>8003.</enum><header>Searchable
			 database of electronically submitted meat and poultry labels</header>
				<subsection id="H1A93AA8F6D694DF3A957A415BEA86F8C"><enum>(a)</enum><header>Electronic
			 option for submission</header><text display-inline="yes-display-inline">Not
			 later than 1 year after the date of the enactment of this Act, the Secretary of
			 Agriculture shall promulgate regulations under section 7 of the Federal Meat
			 Inspection Act (21 U.S.C. 607) and section 8 of the Poultry Products Inspection
			 Act (21 U.S.C. 457) to establish an electronic option for submitting meat and
			 poultry labels for preapproval.</text>
				</subsection><subsection id="H52AEC2E778C44A6281251D43FBC91A7F"><enum>(b)</enum><header>Searchable
			 database of electronically submitted labels</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary of Agriculture shall establish a publicly
			 accessible searchable database of electronically submitted meat and poultry
			 labels.</text>
				</subsection></section><section id="H10068A99C0FD4DF0A99A13B988635123"><enum>8004.</enum><header>Meat and
			 poultry processing report</header>
				<subsection commented="no" id="H696A20DE20774B36A80044B9042C89DB"><enum>(a)</enum><header>In
			 general</header><text>Not later than 18 months after the date of the enactment
			 of this Act, the Secretary of Agriculture, in consultation with the
			 stakeholders group referred to in section 602(c) of the Federal Meat Inspection
			 Act (as added by section 8001 of this Act) and the stakeholders group referred
			 to in section 32(b)(3) of the Poultry Products Inspection Act (as added by
			 section 8002 of this Act), shall submit to Congress a report on steps that can
			 be taken to better meet the needs of very small and certain small
			 establishments (as defined by the Secretary under section 601 of the Federal
			 Meat Inspection Act (as added by such section 8001) or section 32(a) of the
			 Poultry Products Inspection Act (as added by such section 8002)), including any
			 recommended changes to statutory and regulatory provisions of law.</text>
				</subsection><subsection id="HBD89165D58544BE489B4A331F8D075BD"><enum>(b)</enum><header>Contents</header><text>The
			 report required under paragraph (1) shall include a proposal to allow
			 participating States to enter into memoranda of understanding with
			 non-participating States to allow covered products produced in a participating
			 State to be sold in a non-participating State.</text>
				</subsection><subsection id="H51777603E225483B8492E748CB81FA7B"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="HDC3ACA6579104FEC8131460FC62200E1"><enum>(1)</enum><header>Covered
			 products</header><text>The term <term>covered products</term> means a meat or
			 poultry product inspected in accordance with the covered programs.</text>
					</paragraph><paragraph id="H29C7FC2166684E75B47DDADB9EE3546B"><enum>(2)</enum><header>Covered
			 programs</header><text>The term <term>covered programs</term> means the
			 cooperative meat and poultry inspection programs of the Food Safety and
			 Inspection Service of the Department of Agriculture.</text>
					</paragraph><paragraph id="H5B62FD11E60B40E3AC3303FA00BB6F2A"><enum>(3)</enum><header>Non-participating
			 State</header><text>The term <term>non-participating State</term> means a State
			 that does not participate in the covered programs.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFB6A4D48B7764D39B9E73280165EA489"><enum>(4)</enum><header>Participating
			 State</header><text display-inline="yes-display-inline">The term
			 <term>participating State</term> means a State that participates in the covered
			 programs.</text>
					</paragraph></subsection></section></title><title id="H3CF41573006F44C1ACE4E86B6C8F5900"><enum>IX</enum><header>Miscellaneous</header>
			<section id="H1E214C92D67C439DBF5E3C5548E964B9"><enum>9001.</enum><header>National food
			 safety training, education, extension, outreach, and technical assistance
			 program</header><text display-inline="no-display-inline">Section 405 of the
			 Agricultural Research, Extension, and Education Reform Act of 1998 (7 U.S.C.
			 7625) is amended by striking subsection (j) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7573FA6DC2494001A6AB44D263E9FE70" style="OLC">
					<subsection id="HAF33ADB70B2E460C8AD0DAC2B183B8B7"><enum>(j)</enum><header>Funding</header>

				general</header><text>Of the funds of the Commodity Credit Corporation, the
				Secretary shall use to carry out this section $15,000,000 for each of fiscal
				years 2013 through 2017.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD603673FE9ED4C47B4CA79AA55AB854E"><enum>(2)</enum><header>Additional
				funding</header><text>In addition to funds made available under paragraph (1),
				for the purposes of making grants under this section, there are authorized to
				be appropriated such sums as are necessary for each of fiscal years 2011
				through
				2017.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id0B662CFB964F41CCBA5D10E88C9D71AD"><enum>9002.</enum><header>Budgetary
			 effects</header><text display-inline="no-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act
			 of 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the Senate Budget
			 Committee, provided that such statement has been submitted prior to the vote on
			 passage.</text>
