		<official-title>To establish the Honorable Stephanie Tubbs Jones Fire
		  Suppression Demonstration Incentive Program within the Department of Education
		  to promote installation of fire sprinkler systems, or other fire suppression or
		  prevention technologies, in qualified student housing and dormitories, and for
		  other purposes.</official-title>

		<section display-inline="no-display-inline" id="H1FA35F9336A14FC0AAABB06BA7498080" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Honorable Stephanie Tubbs Jones
			 College Fire Prevention Act</short-title></quote>.</text>
		</section><section id="H75F8FD46C0A74E1C9C1B6001731AE175"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id3905FEFCA3764DB982413990B8B5CB7D"><enum>(1)</enum><header>Approved fire
			 suppression system</header><text>The term <term>approved fire suppression
			 system</term> means a fire suppression system that—</text>
				<subparagraph id="id8369A885EC864952B25E63A7B9251605"><enum>(A)</enum><text>meets with
			 applicable codes and standards for the jurisdiction where it is being
			 installed, or the standards promulgated by national model code organizations
			 such as the National Fire Protection Association or the International Code
			 Council;</text>
				</subparagraph><subparagraph id="idEF8819BA35B24E21BE5BE78E2762BF23"><enum>(B)</enum><text>ensures that the
			 safety of students with disabilities is met; and</text>
				</subparagraph><subparagraph id="idF8CD0F10AD424A39AEA3146463BE4CE1"><enum>(C)</enum><text>may
			 include—</text>
					<clause id="idB0B60AF078AB43B5B31FFC3F7BD0A97D"><enum>(i)</enum><text>an
			 automatic fire sprinkler system;</text>
					</clause><clause id="id239475C3936E477C8EC20D02D3BFCE51"><enum>(ii)</enum><text>a
			 fire and smoke alarm and detection system; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="idF74EEB8E83FD45CAB7E0690D979A1118"><enum>(iii)</enum><text>a mass
			 communication system that can be used in the event of a fire, disaster, or
			 other emergency.</text>
					</clause></subparagraph></paragraph><paragraph id="id5555BB52A2C94C08AF5820FDD6280970"><enum>(2)</enum><header>Institution of
			 higher education</header><text>The term <term>institution of higher
			 education</term> has the meaning given the term in section 102 of the Higher
			 Education Act of 1965 (20 U.S.C. 1002).</text>
			</paragraph><paragraph id="id0A8DA29765AD41DD827E4D2F92DDDFC9"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Education.</text>
			</paragraph></section><section id="idACA9A66C13DE416191835E9827514AE5"><enum>3.</enum><header>Establishment of
			 the Honorable Stephanie Tubbs Jones Fire Suppression Demonstration Incentive
			 Program</header>
			<subsection id="HC43A3CB2742441CCA56823A8FB03F747"><enum>(a)</enum><header>Grants</header><text>The
			 Secretary, in consultation with the United States Fire Administration, shall
			 establish a demonstration program to award grants on a competitive basis to any
			 eligible entity for the purpose of installing approved fire suppression systems
			 in student housing and dormitories owned or controlled by that eligible
			 entity.</text>
			</subsection><subsection id="H2238EEA916FD42D88E48206BF9FFD717"><enum>(b)</enum><header>Eligible
			 entity</header><text>In this Act, the term <term>eligible entity</term> means
			 any of the following:</text>
				<paragraph id="HE9ED011154794730A731950C3135462E"><enum>(1)</enum><text display-inline="yes-display-inline">An institution of higher education,
			 including an institution eligible to receive assistance under part A or B of
			 title III or title V of the Higher Education Act of 1965 (20 U.S.C. 1057 et
			 seq.; 20 U.S.C. 1060 et seq.; 20 U.S.C. 1101 et seq.).</text>
				</paragraph><paragraph id="H8CE626E006E1490CB042B91BBC5C7C52"><enum>(2)</enum><text display-inline="yes-display-inline">A social fraternity or sorority exempt from
			 taxation under section 501(a) of the Internal Revenue Code of 1986 (26 U.S.C.
			 501(a)), the active membership of which consists primarily of students in
			 attendance at an institution of higher education.</text>
				</paragraph></subsection><subsection id="H26EE22A6BAC44E558210A02E498ADC5E"><enum>(c)</enum><header>Selection
			 priority</header><text>In making grants under
			 <internal-xref idref="HC43A3CB2742441CCA56823A8FB03F747" legis-path="2.(a)">subsection (a)</internal-xref>, the Secretary shall give
			 priority to eligible entities that demonstrate the greatest financial
			 need.</text>
			</subsection><subsection id="H6D213C9F5F88429C86C10A3B17C1A35D"><enum>(d)</enum><header>Reserved
			 amounts</header>
				<paragraph display-inline="no-display-inline" id="H057687A18F134846A6E47692F8CAA502"><enum>(1)</enum><header>In
			 general</header><text>Of the amount made available to the Secretary for grants
			 under this section for each fiscal year, the Secretary shall award—</text>
					<subparagraph id="HC8534AEBCA4244CCB14224F5EF5D10E4"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 10 percent to eligible
			 entities that are institutions described in
			 <internal-xref idref="HE9ED011154794730A731950C3135462E" legis-path="2.(b)(1)">subsection (b)(1) </internal-xref>that are eligible to
			 receive assistance under part A or B of title III or title V of the Higher
			 Education Act of 1965 (20 U.S.C. 1057 et seq.; 20 U.S.C. 1060 et seq.; 20
			 U.S.C. 1101 et seq.); and</text>
					</subparagraph><subparagraph id="H9345B43497EA4C5B806421E82458CAE4"><enum>(B)</enum><text>not less than 10
			 percent to eligible entities that are social fraternities and sororities
			 described in
			 <internal-xref idref="H8CE626E006E1490CB042B91BBC5C7C52" legis-path="2.(b)(2)">subsection (b)(2)</internal-xref>.</text>
					</subparagraph></paragraph><paragraph id="H9AE5C45C179342A98796F4E40174E297"><enum>(2)</enum><header>Plan
			 required</header><text display-inline="yes-display-inline">The Secretary shall
			 develop a plan to inform entities described in
			 <internal-xref idref="HC8534AEBCA4244CCB14224F5EF5D10E4" legis-path="2.(d)(1)(A)">subparagraphs (A)</internal-xref> and
			 <internal-xref idref="H9345B43497EA4C5B806421E82458CAE4" legis-path="2.(d)(1)(B)">(B)</internal-xref> of
			 <internal-xref idref="H057687A18F134846A6E47692F8CAA502" legis-path="2.(d)(1)">paragraph (1)</internal-xref> that such entities may be
			 eligible to apply for grants under this section.</text>
				</paragraph><paragraph id="H51913FC9256B44E69F98A4941D2F119C"><enum>(3)</enum><header>Insufficient
			 applicants</header><text display-inline="yes-display-inline">If the Secretary
			 determines that there are an insufficient number of qualified applicants to
			 award the reserved amounts required in accordance with
			 <internal-xref idref="H057687A18F134846A6E47692F8CAA502" legis-path="2.(d)(1)">paragraph (1)</internal-xref>, the Secretary shall make
			 available the remainder of such reserved amounts for use by other eligible
			 entities.</text>
				</paragraph></subsection><subsection id="HC36E12D1E81443659C502A7F1C622CDE"><enum>(e)</enum><header>Application</header><text>To
			 seek a grant under this section, an eligible entity shall submit an application
			 to the Secretary at such time, in such manner, and accompanied by such
			 information as the Secretary may require.</text>
			</subsection><subsection id="HCD34D6C302364E3C85CD529CD5073F03"><enum>(f)</enum><header>Matching
			 requirement</header><text>As a condition of receipt of a grant under
			 <internal-xref idref="HC43A3CB2742441CCA56823A8FB03F747" legis-path="2.(a)">subsection (a)</internal-xref>, the eligible entity shall
			 provide (directly or through donations from public or private entities)
			 non-Federal matching funds in an amount equal to not less than 50 percent of
			 the cost of the activities for which assistance is sought.</text>
			</subsection><subsection id="H03FD65EF9E964DA69AA258143298875B"><enum>(g)</enum><header>Supplement Not
			 Supplant</header><text display-inline="yes-display-inline">Funds made available
			 under this program shall be used to supplement, not supplant, other funds that
			 would otherwise be expended to carry out fire safety activities.</text>
			</subsection><subsection id="H1A9A45E04196469582A7DE81290CEC08"><enum>(h)</enum><header>Limitation on
			 administrative expenses</header><text>Not more than 2 percent of a grant made
			 under
			 <internal-xref idref="HC43A3CB2742441CCA56823A8FB03F747" legis-path="2.(a)">subsection (a)</internal-xref> may be expended for
			 administrative expenses with respect to the grant.</text>
			</subsection><subsection id="HECBBAC312FF247B3A2E7C9E770572EC7"><enum>(i)</enum><header>Reports</header><text>Not
			 later than 12 months after the date of the first award of a grant under this
			 section and annually thereafter until completion of the program, the Secretary
			 shall provide to Congress a report that includes—</text>
				<paragraph id="H8E4119468EE7409FBA7B9E6791D8AF4B"><enum>(1)</enum><text>the number and
			 types of eligible entities receiving assistance under this section;</text>
				</paragraph><paragraph id="HA3F8C853B0BC4B1DA64AA8685C23E87E"><enum>(2)</enum><text>the amount of
			 assistance received under this section, the amount and source of non-Federal
			 funding leveraged for activities under grants under this section, and any other
			 relevant financial information;</text>
				</paragraph><paragraph id="H6DFEB50640E446F488D24AF56CF604E3"><enum>(3)</enum><text>the number and
			 types of student housing fitted with fire suppression or prevention
			 technologies with assistance under this section, and the number of students
			 protected by such technologies;</text>
				</paragraph><paragraph id="H310C878818D046F380F04732B9123E0A"><enum>(4)</enum><text>the types of fire
			 suppression or prevention technologies installed with assistance under this
			 section, and the costs of such technologies;</text>
				</paragraph><paragraph id="H49B38D5BB7C54937895214AF7ACD6A0D"><enum>(5)</enum><text>identification of
			 any Federal, State, or local policy that presents an impediment to the
			 development and installation of fire suppression or prevention technologies;
			 and</text>
				</paragraph><paragraph id="HFF666A53AE184989B777B7161400F1C4"><enum>(6)</enum><text>any other
			 information determined by the Secretary to be useful to evaluating the overall
			 effectiveness of the program established under this section in improving the
			 fire safety of student housing.</text>
				</paragraph></subsection><subsection id="H129A44227D3149A6A39DE53FFF0D1718"><enum>(j)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as may be
			 necessary for each of the fiscal years 2012 through 2014.</text>
			</subsection></section><section id="HD32EDB6FF87B4971968A097957FABE3D"><enum>4.</enum><header>Admissibility as
			 evidence</header>
			<subsection id="HD3E5A60ACF7F49ABB743D3BA83C12334"><enum>(a)</enum><header>Prohibition</header><text>Notwithstanding
			 any other provision of law and subject to
			 <internal-xref idref="H54B4F8583411490887A310EEACC5566D" legis-path="3.(b)">subsection (b)</internal-xref>, any application for
			 assistance under this Act, any negative determination on the part of the
			 Secretary with respect to such application, or any statement of reasons for the
			 determination, shall not be admissible as evidence in any proceeding of any
			 court, agency, board, or other entity.</text>
			</subsection><subsection id="H54B4F8583411490887A310EEACC5566D"><enum>(b)</enum><header>Exception</header><text>This
			 section does not apply to the admission of an application, determination, or
			 statement described in
			 <internal-xref idref="HD3E5A60ACF7F49ABB743D3BA83C12334" legis-path="3.(a)">subsection (a)</internal-xref> as evidence in a proceeding
			 to enforce an agreement entered into between the Secretary and an eligible
			 entity under
			 <internal-xref idref="H75F8FD46C0A74E1C9C1B6001731AE175" legis-path="2.">section 3</internal-xref>.</text>
