				violent crimes against Indian women, including the crimes of domestic violence,
				dating violence, sexual assault, sex trafficking, and
				stalking.</text>

				</paragraph></section><section id="id5A711F6565C944AABB8BE36CC15F2798"><enum>102.</enum><header>Tribal
			 coalition grants</header><text display-inline="no-display-inline">Section 2001
			 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3796gg) is amended by striking subsection (d) and inserting the
			 following:</text>

					<subsection id="id2F57570B0E964FC1AEB0D107D667FD4C"><enum>(d)</enum><header>Tribal coalition
				grants</header>
						<paragraph id="id6CE9E42F4FD84596B96551CE1B1EC1FF"><enum>(1)</enum><header>Purpose</header><text>The
				Attorney General shall award a grant to each established tribal coalition for
				purposes of—</text>
							<subparagraph id="idA2B5448E21BE4F90A03111119F1F54C0"><enum>(A)</enum><text>increasing
				awareness of domestic violence and sexual assault against Indian women;</text>
							</subparagraph><subparagraph id="idC92EA5C054804D7C9B3FEA5977FF6875"><enum>(B)</enum><text>enhancing the
				response to violence against Indian women at the Federal, State, and tribal
				levels;</text>
							</subparagraph><subparagraph id="id68720F811A134EC6A7A9319B2D15FFAC"><enum>(C)</enum><text>identifying and
				providing technical assistance to coalition membership and tribal communities
				to enhance access to essential services to Indian women victimized by domestic
				and sexual violence, including sex trafficking; and</text>
							</subparagraph><subparagraph id="ID49c83e378473449298ec36a204d73d74"><enum>(D)</enum><text>assisting Indian
				tribes in developing and promoting legislation and policies that enhance best
				practices for responding to violent crimes against Indian women, including the
				crimes of domestic violence, dating violence, sexual assault, sex trafficking,
				and stalking.</text>
							</subparagraph></paragraph><paragraph id="id5319023AA0484FBDBDAECD968781F051"><enum>(2)</enum><header>Grants</header>
							<subparagraph id="id303E5E549BFD439B8FCD1C65F93D979D"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), the Attorney General shall
				award grants on annual basis under paragraph (1) to—</text>
								<clause id="id949BB42268524A4B9C5ED6B5782D9731"><enum>(i)</enum><text>each tribal
				coalition that—</text>
									<subclause id="idE4E641A73BAC464B86D5EAA585A42494"><enum>(I)</enum><text>meets the criteria
				of a tribal coalition under section 40002(a) of the Violence Against Women Act
				of 1994 (42 U.S.C. 13925(a));</text>
									</subclause><subclause id="id5E95DB0FEB7841D4887323403CED314A"><enum>(II)</enum><text>is recognized by
				the Office on Violence Against Women; and</text>
									</subclause><subclause id="idB62F488E0A61494DB4D6EB96D6FFA167"><enum>(III)</enum><text>provides
				services to Indian tribes; and</text>
									</subclause></clause><clause id="id67C5036CA80C46C8A6DD99A20F3EC15B"><enum>(ii)</enum><text>organizations
				that propose to incorporate and operate a tribal coalition in areas where
				Indian tribes are located but no tribal coalition exists.</text>
								</clause></subparagraph><subparagraph id="idEA994EA08F204E9CBDABFF402336C22D"><enum>(B)</enum><header>Restriction</header><text>An
				organization described in subparagraph (A)(ii) shall use a grant under this
				subsection to support the planning and development of a tribal coalition,
				subject to the condition that any amounts provided to the organization under
				this subsection that remain unobligated on September 30 of each fiscal year for
				which amounts are made available under paragraph (3) shall be redistributed in
				the subsequent fiscal year by the Attorney General to tribal coalitions
				described in subparagraph (A)(i).</text>
							</subparagraph></paragraph><paragraph id="idDCF631F2343F4211AA6C2678EEDA86B2"><enum>(3)</enum><header>Use of
				amounts</header><text>For each of fiscal years 2013 through 2017, of the
				amounts appropriated to carry out this subsection—</text>
							<subparagraph id="id968802606B714CEF814385040ECE2388"><enum>(A)</enum><text>10 percent shall
				be made available to organizations described in paragraph (2)(A)(ii);
				and</text>
							</subparagraph><subparagraph id="idDA25E432D069494DB1EF2C3118E01099"><enum>(B)</enum><text>90 percent shall
				be made available to tribal coalitions described in paragraph (2)(A)(i), which
				amounts shall be distributed equally among each eligible tribal coalition for
				the applicable fiscal year.</text>
							</subparagraph></paragraph><paragraph id="idC3E569A4410E404BBEE00744FA932524"><enum>(4)</enum><header>Duration</header><text>A
				grant under this subsection shall be awarded for a period of 1 year.</text>
						</paragraph><paragraph id="id73C7A881A63441EBBF582D71CD307353"><enum>(5)</enum><header>Eligibility for
				other grants</header><text>Receipt of an award under this subsection by a
				tribal coalition shall not preclude the tribal coalition from receiving
				additional grants under this title to carry out the purposes described in
				paragraph (1).</text>
						</paragraph><paragraph id="id3E420A2CA6AD4B038D31ED131F6D5D60"><enum>(6)</enum><header>Multiple purpose
				applications</header><text>Nothing in this subsection prohibits any tribal
				coalition or organization described in paragraph (2)(A) from applying for
				funding to address sexual assault or domestic violence needs in the same
				application.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id533565568A9C4C1B8867D8134149F019"><enum>103.</enum><header>Consultation</header><text display-inline="no-display-inline">Section 903 of the Violence Against Women
			 and Department of Justice Reauthorization Act of 2005 (42 U.S.C. 14045d) is
			 amended—</text>
				<paragraph id="idE74BBF681719473C8B593B8A061BF655"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
					<subparagraph id="id06DFF233775A4952858964D27271C424"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and the Violence Against
			 Women Act of 2000</quote> and inserting <quote>, the Violence Against Women Act
			 of 2000</quote>; and</text>
					</subparagraph><subparagraph id="id2AF64D4218924FE18E04DF55C1E6DBB2"><enum>(B)</enum><text>by inserting
			 <quote>, and the <short-title>Stand Against Violence and
			 Empower Native Women Act</short-title></quote> before the period at the
			 end;</text>
					</subparagraph></paragraph><paragraph id="id2A89D0A3778344FEAEEBB5D81310D5C3"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="idB974B3D54782487797A2D1992E46DE17"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>the Secretary of the Department of
			 Health and Human Services and</quote> and inserting <quote>the Secretary of
			 Health and Human Services, the Secretary of the Interior, and</quote>;
			 and</text>
					</subparagraph><subparagraph id="idA9712F8F17364B5E9139ED1E12817259"><enum>(B)</enum><text>in paragraph (2),

			 research on violence against women</header><text display-inline="no-display-inline">Section 904(a) of the Violence Against Women
			 and Department of Justice Reauthorization Act of 2005 (42 U.S.C. 3796gg–10
			 note) is amended—</text>
				<paragraph id="idFCDE25C839E341E0A721F0566803D760"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="id0628CD15DF134E6688182DE4F16836EB"><enum>(A)</enum><text>by striking
			 <quote>The National</quote> and inserting <quote>Not later than 2 years after
			 the date of enactment of the <short-title>Stand Against
			 Violence and Empower Native Women Act</short-title>, the National</quote>;

						<paragraph id="idB138A7F55AEF44EC979FE8F45CD1DCDC"><enum>(31)</enum><header>Tribal
				coalition</header><text>The term <term>tribal coalition</term> means an
				established nonprofit, nongovernmental Indian organization established to
				provide services on a statewide, regional, or customary territory basis
				that—</text>
							<subparagraph id="idB0A66B72F0734A1B8B03EBCE016137E3"><enum>(A)</enum><text>provides
				education, support, and technical assistance to Indian service providers in a
				manner that enables the providers to establish and maintain culturally
				appropriate services, including shelter and rape crisis services, designed to
				assist Indian women and the dependents of those women who are victims of
				domestic violence, dating violence, sexual assault, and stalking;</text>
							</subparagraph><subparagraph id="ID6824f686f4794d908340d345096e0a5b"><enum>(B)</enum><text>is comprised of
				board and general members that are representative of—</text>
								<clause id="id6405AAE8AF534968AFAA7B5618EF343F"><enum>(i)</enum><text>the service
				providers described in subparagraph (A); and</text>
								</clause><clause id="idF9E9D82826F04F97A20D41DCB74AC10F"><enum>(ii)</enum><text>the tribal
				communities in which the services are being provided;</text>
								</clause></subparagraph><subparagraph id="ID345087747f2b480fa4de956457cc8b36"><enum>(C)</enum><text>serves as an
				information clearinghouse and resource center for Indian programs addressing
				domestic violence and sexual assault;</text>
							</subparagraph><subparagraph id="idD5BD416EF6094315BD0B41BD125844A5"><enum>(D)</enum><text>supports the
				development of legislation, policies, protocols, procedures, and guidance to
				enhance domestic violence and sexual assault intervention and prevention
				efforts in Indian tribes and communities to be served; and</text>
							</subparagraph><subparagraph id="ID69576dc5c7844a15a01f32b926f5a874"><enum>(E)</enum><text>has expertise in
				the development of Indian community-based, linguistically, and culturally
				specific outreach and intervention services for the Indian communities to be
				served.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title changed="deleted" committee-id="SLIA00" id="idE1A86B5D66D34B3A903884781948B3E3" reported-display-style="strikethrough"><enum>II</enum><header>Tribal
			 jurisdiction and criminal offenses</header>
			<section id="IDdbce3d1aed0d4d619b65681164587e7d"><enum>201.</enum><header>Tribal
			 jurisdiction over crimes of domestic violence</header><text display-inline="no-display-inline">Title II of Public Law 90–284 (25 U.S.C.
			 1301 et seq.) (commonly known as the <quote>Indian Civil Rights Act of
			 1968</quote>) is amended by adding at the end the following:</text>
				<quoted-block changed="deleted" committee-id="SLIA00" display-inline="no-display-inline" id="id9C892CA49F624539890522ED29D1D02D" reported-display-style="strikethrough" style="OLC">
					<section id="ID2a6cd8d4399347c7b403d739932556f3"><enum>204.</enum><header>Tribal
				jurisdiction over crimes of domestic violence</header>
						<subsection id="ID4eb8dab2d8a1461fb5ba9bd0df3744be"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="ID064e84ddadf343de8075a72092848ad2"><enum>(1)</enum><header>Dating
				violence</header><text>The term <term>dating violence</term> means violence
				committed by a person who is or has been in a social relationship of a romantic
				or intimate nature with the victim, as determined by the length of the
				relationship, the type of relationship, and the frequency of interaction
				between the persons involved in the relationship.</text>
							</paragraph><paragraph id="ID7d76782d5c334b50a022838d414852e8"><enum>(2)</enum><header>Domestic
				violence</header><text>The term <term>domestic violence</term> means violence
				committed by a current or former spouse of the victim, by a person with whom
				the victim shares a child in common, by a person who is cohabitating with or
				has cohabitated with the victim as a spouse, or by a person similarly situated
				to a spouse of the victim under the domestic or family violence laws of the
				Indian tribe that has jurisdiction over the Indian country where the violence
				occurs.</text>
							</paragraph><paragraph id="ID35e4da9ca3294949be43890351f63f52"><enum>(3)</enum><header>Indian
				country</header><text>The term <term>Indian country</term> has the meaning
				given the term in section 1151 of title 18, United States Code.</text>
							</paragraph><paragraph id="id2DF1461DC612405295CA6C7333C8DA4D"><enum>(4)</enum><header>Participating
				tribe</header><text>The term <term>participating tribe</term> means an Indian
				tribe that elects to exercise special domestic violence criminal jurisdiction
				over the Indian country of that Indian tribe.</text>
							</paragraph><paragraph id="ID22c0027fd7234398b21fa92e9d53f0ac"><enum>(5)</enum><header>Protection
				order</header><text>The term <term>protection order</term> means any
				injunction, restraining order, or other order issued by a civil or criminal
				court for the purpose of preventing violent or threatening acts or harassment
				against, sexual violence against, contact or communication with, or physical
				proximity to, another person, including any temporary or final order issued by
				a civil or criminal court, whether obtained by filing an independent action or
				as a pendente lite order in another proceeding, so long as the civil or
				criminal order was issued in response to a complaint, petition, or motion filed
				by or on behalf of a person seeking protection.</text>
							</paragraph><paragraph id="ID00ffe4d5ad16448cabf3d939f5466b70"><enum>(6)</enum><header>Special domestic
				violence criminal jurisdiction</header><text>The term <term>special domestic
				violence criminal jurisdiction</term> means the criminal jurisdiction that a
				participating tribe may exercise under this section but could not otherwise
				exercise.</text>
							</paragraph><paragraph id="ID20e31aa5d0a945d8908ac741d0aef558"><enum>(7)</enum><header>Spouse or
				intimate partner</header><text>The term <term>spouse or intimate partner</term>
				has the meaning given the term in section 2266 of title 18, United States
				Code.</text>
							</paragraph></subsection><subsection id="ID517ba6d6bb6f44acaf9d5a8a37e99c43"><enum>(b)</enum><header>Nature of the
				criminal jurisdiction</header>
							<paragraph id="IDe2bd49c813e745918a02187e72c5fb97"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, in addition
				to all powers of self-government recognized and affirmed by this Act, the
				powers of self-government of a participating tribe include the inherent power
				of that tribe, which is hereby recognized and affirmed, to exercise special
				domestic violence criminal jurisdiction over all persons.</text>
							</paragraph><paragraph id="ID200a66b12b8a450aa4dfa24b8f33de13"><enum>(2)</enum><header>Concurrent
				jurisdiction</header><text>A participating tribe shall exercise special
				domestic violence criminal jurisdiction concurrently, not exclusively.</text>
							</paragraph><paragraph id="IDfe51dec9fc964473b735e35fbe60bb57"><enum>(3)</enum><header>Applicability</header><text>Nothing
				in this section—</text>
								<subparagraph id="idA76680DDA20C438AB8D878D9791DBF61"><enum>(A)</enum><text>creates or
				eliminates any Federal or State criminal jurisdiction over Indian country;
				or</text>
								</subparagraph><subparagraph id="idF759FD250EB74F83B940205BA1FD6170"><enum>(B)</enum><text>affects the
				authority of the United States, or any State government that has been delegated
				authority by the United States, to investigate and prosecute a criminal
				violation in Indian country.</text>
								</subparagraph></paragraph></subsection><subsection id="IDcdae88a908bd4add9df4438e437f706e"><enum>(c)</enum><header>Criminal
				conduct</header><text>A participating tribe may exercise special domestic
				violence criminal jurisdiction over a defendant for criminal conduct that falls
				into 1 or more of the following categories:</text>
							<paragraph id="IDbf69fce710f240fc9253d0cf742a04e6"><enum>(1)</enum><header>Domestic
				violence and dating violence</header><text>An act of domestic violence or
				dating violence that occurs in the Indian country of the participating
				tribe.</text>
							</paragraph><paragraph id="ID4e1f3d1c042e4796a3026e4ec676f112"><enum>(2)</enum><header>Violations of
				protection orders</header><text>An act that—</text>
								<subparagraph id="id8EF337ACD045489CA620CA17D143640A"><enum>(A)</enum><text>occurs in the
				Indian country of the participating tribe; and</text>
								</subparagraph><subparagraph id="idEFD1504A6D524EB49F2333710BC7E6CA"><enum>(B)</enum><text>violates the
				portion of a protection order that—</text>
									<clause id="idD152632BFEEC4D0184456537ADB44C52"><enum>(i)</enum><text>prohibits or
				provides protection against violent or threatening acts or harassment against,
				sexual violence against, contact or communication with, or physical proximity
				to, another person; and</text>
									</clause><clause id="id81272BD38430429F8E2FC9755D5A789C"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idB5DE55ED157D4263A0468EA86E292011"><enum>(I)</enum><text>was issued against the
				defendant;</text>
										</subclause><subclause changed="deleted" committee-id="SLIA00" id="idBBDF6E6016F144679A8F774986F889AC" indent="up1" reported-display-style="strikethrough"><enum>(II)</enum><text>is enforceable by
				the participating tribe; and</text>
										</subclause><subclause changed="deleted" committee-id="SLIA00" id="idED2E825488984CD69A284B02FCBFE43F" indent="up1" reported-display-style="strikethrough"><enum>(III)</enum><text>is consistent
				with section 2265(b) of title 18, United States Code.</text>
										</subclause></clause></subparagraph></paragraph></subsection><subsection id="ID34c805ec0c8044819d5209e83111d99a"><enum>(d)</enum><header>Dismissal of
				certain cases</header>
							<paragraph id="ID0eaf6f0708c14ee798d65acdd4e3c6e2"><enum>(1)</enum><header>Definition of
				victim</header><text>In this subsection and with respect to a criminal
				proceeding in which a participating tribe exercises special domestic violence
				criminal jurisdiction based on a criminal violation of a protection order, the
				term <term>victim</term> means a person specifically protected by a protection
				order that the defendant allegedly violated.</text>
							</paragraph><paragraph id="id434191043AE24282A0122D8826DBAE52"><enum>(2)</enum><header>Non-Indian
				victims and defendants</header><text>In a criminal proceeding in which a
				participating tribe exercises special domestic violence criminal jurisdiction,
				the case shall be dismissed if—</text>
								<subparagraph id="idEC036ED940994C3BA54AA7FE612CD4B2"><enum>(A)</enum><text>the defendant
				files a pretrial motion to dismiss on the grounds that the alleged offense did
				not involve an Indian; and</text>
								</subparagraph><subparagraph id="id899DEAD49E9140D6A0CEE2E69B968182"><enum>(B)</enum><text>the participating
				tribe fails to prove that the defendant or an alleged victim is an
				Indian.</text>
								</subparagraph></paragraph><paragraph id="IDd20f3818ae69417484f4b925beb30d22"><enum>(3)</enum><header>Ties to Indian
				tribe</header><text>In a criminal proceeding in which a participating tribe
				exercises special domestic violence criminal jurisdiction, the case shall be
				dismissed if—</text>
								<subparagraph id="id46F6F23867FA4639B85034907D65580F"><enum>(A)</enum><text>the defendant
				files a pretrial motion to dismiss on the grounds that the defendant and the
				alleged victim lack sufficient ties to the Indian tribe; and</text>
								</subparagraph><subparagraph id="idA73472921D144CA0982EEB8F715DFA4A"><enum>(B)</enum><text>the prosecuting
				tribe fails to prove that the defendant or an alleged victim—</text>
									<clause id="id16F794C299A7412785D9F7238CE39FDF"><enum>(i)</enum><text>resides in the
				Indian country of the participating tribe;</text>
									</clause><clause id="idB84F1D76951E4EE89B94BA52CD7B20CA"><enum>(ii)</enum><text>is employed in
				the Indian country of the participating tribe; or</text>
									</clause><clause id="id8518CD0113084C3E9A21FF283FCD3593"><enum>(iii)</enum><text>is a spouse or
				intimate partner of a member of the participating tribe.</text>
									</clause></subparagraph></paragraph><paragraph id="ID2d467252eaa04766a09c24d96ce2410e"><enum>(4)</enum><header>Waiver</header><text>A
				knowing and voluntary failure of a defendant to file a pretrial motion
				described in paragraph (2) or (3) shall be considered a waiver of the right to
				seek a dismissal under this subsection.</text>
							</paragraph></subsection><subsection id="IDdafb2bc35f644cc2a3397f77701ae5fd"><enum>(e)</enum><header>Rights of
				defendants</header><text>In a criminal proceeding in which a participating
				tribe exercises special domestic violence criminal jurisdiction, the
				participating tribe shall provide to the defendant—</text>
							<paragraph id="IDb64878eadcc040c0bfe284dca7bc9ed0"><enum>(1)</enum><text>all applicable
				rights under this Act;</text>
							</paragraph><paragraph id="ID54b3c21629954b7b9574855d89ec544c"><enum>(2)</enum><text>if a term of
				imprisonment of any length is imposed, all rights described in section 202(c);
				and</text>
							</paragraph><paragraph id="IDbe9848e5085549568dfb19dc9109ac7e"><enum>(3)</enum><text>all other rights
				whose protection is necessary under the Constitution of the United States in
				order for Congress to recognize and affirm the inherent power of the
				participating tribe to exercise criminal jurisdiction over the
				defendant.</text>
							</paragraph></subsection><subsection id="id42FF3AD2C14F4A0D89E35CF07BE91E47"><enum>(f)</enum><header>Petitions To
				stay detention</header>
							<paragraph id="id89613D0BFA204CCA845D1AD343730239"><enum>(1)</enum><header>In
				general</header><text>A person who has filed a petition for a writ of habeas
				corpus in a court of the United States under section 203 may petition that
				court to stay further detention of that person by the participating
				tribe.</text>
							</paragraph><paragraph id="idE4426F9552904BF3BC752B733D92C806"><enum>(2)</enum><header>Grant of
				stay</header><text>A court shall grant a stay described in paragraph (1) if the
				court—</text>
								<subparagraph id="id31335CDAEF574A12A5E64C6DB6267707"><enum>(A)</enum><text>finds that there
				is a substantial likelihood that the habeas corpus petition will be granted;
				and</text>
								</subparagraph><subparagraph id="id689A2B8824D44489B993F640CF4EADD0"><enum>(B)</enum><text>after giving each
				alleged victim in the matter an opportunity to be heard, finds, by clear and
				convincing evidence that, under conditions imposed by the court, the petitioner
				is not likely to flee or pose a danger to any person or the community if
				released.</text>
								</subparagraph></paragraph></subsection><subsection id="ID63363a4da0d744768d136898b5d772fa"><enum>(g)</enum><header>Grants to tribal
				governments</header><text>The Attorney General may award grants to the
				governments of Indian tribes (or to authorized designees of those
				governments)—</text>
							<paragraph id="ID52eb11ae2f3942b7ae6c8a489005f6ab"><enum>(1)</enum><text>to strengthen
				tribal criminal justice systems to assist Indian tribes in exercising special
				domestic violence criminal jurisdiction, including—</text>
								<subparagraph id="idEEE4CA97B673460DA8E0BD0C4BBC4D56"><enum>(A)</enum><text>law enforcement
				(including the capacity to enter information into and obtain information from
				national crime information databases);</text>
								</subparagraph><subparagraph id="id7DF5B0B9CD5843A2A67F5219BCF7CEDD"><enum>(B)</enum><text>prosecution;</text>
								</subparagraph><subparagraph id="id83C175FC284247279C8247A22ADEA2FB"><enum>(C)</enum><text>trial and
				appellate courts;</text>
								</subparagraph><subparagraph id="id155359D9963046058457FA252979C270"><enum>(D)</enum><text>probation
				systems;</text>
								</subparagraph><subparagraph id="idACEBA976BA1744EE953465E6CEB0FAC3"><enum>(E)</enum><text>detention and
				correctional facilities;</text>
								</subparagraph><subparagraph id="id8C71D54E6354442AAD3EC8B63843018D"><enum>(F)</enum><text>alternative
				rehabilitation centers;</text>
								</subparagraph><subparagraph id="id52BC947E28BF4DC2B460F2A749AEC0AF"><enum>(G)</enum><text>culturally
				appropriate services and assistance for victims and their families; and</text>
								</subparagraph><subparagraph id="id815CCDF5BA7D40F4BDD440E4BFEDC9F3"><enum>(H)</enum><text>criminal codes and
				rules of criminal procedure, appellate procedure, and evidence;</text>
								</subparagraph></paragraph><paragraph id="ID981bd721ef324ad380996811d68e799d"><enum>(2)</enum><text>to provide
				indigent criminal defendants with the effective assistance of licensed defense
				counsel, at no cost to the defendant, in criminal proceedings in which a
				participating tribe prosecutes a crime of domestic violence or dating violence
				or a criminal violation of a protection order;</text>
							</paragraph><paragraph id="ID235aa5e509044e61ae97df9061ea7ccd"><enum>(3)</enum><text>to ensure that, in
				criminal proceedings in which a participating tribe exercises special domestic
				violence criminal jurisdiction, jurors are summoned, selected, and instructed
				in a manner consistent with all applicable requirements; and</text>
							</paragraph><paragraph id="ID380ca8d0fd6d44ae92dfdbff674a2a26"><enum>(4)</enum><text>to accord victims
				of domestic violence, dating violence, and violations of protection orders
				rights that are similar to the rights of a crime victim described in section
				3771(a) of title 18, United States Code, consistent with tribal law and
				custom.</text>
							</paragraph></subsection><subsection id="ID31478126e35c47de83ed43fe25af2238"><enum>(h)</enum><header>Supplement, not
				supplant</header><text>Amounts made available under this section shall
				supplement and not supplant any other Federal, State, tribal, or local
				government amounts made available to carry out activities described in this
				section.</text>
						</subsection><subsection id="idCD4A5EC4969B4C3EA0045CE4142A9C6E"><enum>(i)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out subsection (g) and to provide training, technical assistance, data
				collection, and evaluation of the criminal justice systems of participating
				tribes such sums as are
				necessary.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="IDb49e392d79db49d8892460a9b64500ca"><enum>202.</enum><header>Tribal
			 protection orders</header><text display-inline="no-display-inline">Section 2265
			 of title 18, United States Code, is amended by striking subsection (e) and
			 inserting the following:</text>
				<quoted-block changed="deleted" committee-id="SLIA00" display-inline="no-display-inline" id="id11E608CB4BC24C378687401D4EDCF58E" reported-display-style="strikethrough" style="OLC">
					<subsection id="IDff481a8b70c445d0bc91e1a850d61d2b"><enum>(e)</enum><header>Tribal court
				jurisdiction</header><text>For purposes of this section, a court of an Indian
				tribe shall have full civil jurisdiction to issue and enforce protection orders
				involving any person, including the authority to enforce any orders through
				civil contempt proceedings, the exclusion of violators from Indian land, and
				other appropriate mechanisms, in matters arising anywhere in the Indian country
				of the Indian tribe (as defined in section 1151) or otherwise within the
				authority of the Indian
				tribe.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID4868074191414aa19b1adbff3cb075a9"><enum>203.</enum><header>Amendments to
			 the Federal assault statute</header>
				<subsection id="ID0f427eeeab2644e78d8af138b69f1fea"><enum>(a)</enum><header>Assaults by
			 striking, beating, or wounding</header><text>Section 113(a)(4) of title 18,
			 United States Code, is amended by striking <quote>six months</quote> and
			 inserting <quote>1 year</quote>.</text>
				</subsection><subsection id="IDa9e4d05ab9404d08819e4ce2dad778e1"><enum>(b)</enum><header>Assaults
			 resulting in substantial bodily injury</header><text>Section 113(a)(7) of title
			 18, United States Code, is amended by striking “substantial bodily injury to an
			 individual who has not attained the age of 16 years” and inserting “substantial
			 bodily injury to a spouse or intimate partner, a dating partner, or an
			 individual who has not attained the age of 16 years”.</text>
				</subsection><subsection id="ID2baf60c26bd94704b37ab72cd6ee3326"><enum>(c)</enum><header>Assaults by
			 strangling or suffocating</header><text>Section 113(a) of title 18, United
			 States Code, is amended by adding at the end the following:</text>
					<quoted-block changed="deleted" committee-id="SLIA00" display-inline="no-display-inline" id="id91745488AF9B4CA48FD34B4664129E7F" reported-display-style="strikethrough" style="OLC">
						<paragraph id="ID0e12f49811ff481b8de7b676e5aea612"><enum>(8)</enum><text>Assault of a
				spouse, intimate partner, or dating partner by strangling, suffocating, or
				attempting to strangle or suffocate, by a fine under this title, imprisonment
				for not more than 10 years, or
				both.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="ID878d3fe9052d4f7089e3313da8709ff6"><enum>(d)</enum><header>Definitions</header><text>Section
			 113(b) of title 18, United States Code, is amended—</text>
					<paragraph id="ID6c837701f8054201b41458f8ee6d581f"><enum>(1)</enum><text>by striking
			 <quote>(b) As used in this subsection—</quote> and inserting the
			 following:</text>

				<term>strangling</term> means intentionally, knowingly, or recklessly impeding
				the normal breathing or circulation of the blood of a person by applying
				pressure to the throat or neck, regardless of whether that conduct results in
				any visible injury or whether there is any intent to kill or protractedly
				injure the victim; and</text>
							</paragraph><paragraph id="ID93ef29b46577401394f82741b41b1dbf"><enum>(5)</enum><text>the term
				<term>suffocating</term> means intentionally, knowingly, or recklessly impeding
				the normal breathing of a person by covering the mouth of the person, the nose
				of the person, or both, regardless of whether that conduct results in any
				visible injury or whether there is any intent to kill or protractedly injure
				the
				victim.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idA8624711E86C460D91B19BB4C68463D6"><enum>(e)</enum><header>Indian major
			 crimes</header><text>Section 1153(a) of title 18, United States Code, is
			 amended by striking “assault with intent to commit murder, assault with a
			 dangerous weapon, assault resulting in serious bodily injury (as defined in
			 section 1365 of this title)” and inserting <quote>a felony assault under
			 section 113</quote>.</text>
				</subsection></section><section id="IDb33d4dbb97994437bcd652f41739ccc3"><enum>204.</enum><header>Effective
			 dates; pilot project</header>
				<subsection id="IDe2d9e9cdae094209b4de200e68538057"><enum>(a)</enum><header>General
			 effective date</header><text>Except as provided in subsection (b), the
			 amendments made by this title shall take effect on the date of enactment of
			 this Act.</text>

			 for special domestic-Violence criminal jurisdiction</header>
					<paragraph id="IDa4a9edb29d6940c4abc2bca135de568a"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), subsections (b)
			 through (e) of section 204 of Public Law 90–284 (as added by section 201) shall
			 take effect on the date that is 2 years after the date of enactment of this
			 Act.</text>
					</paragraph><paragraph id="IDfd308bb3cf6245928b54e92de253ebc7"><enum>(2)</enum><header>Pilot
			 project</header>
						<subparagraph id="ID659d1d579adb4d32bf59d1baed2720fc"><enum>(A)</enum><header>In
			 general</header><text>At any time during the 2-year period beginning on the
			 date of enactment of this Act, an Indian tribe may ask the Attorney General to
			 designate the tribe as a participating tribe under section 204(a) of Public Law
			 90–284 on an accelerated basis.</text>
						</subparagraph><subparagraph id="id76738567B8BE400BB71E428F8A459CB5"><enum>(B)</enum><header>Procedure</header><text>The
			 Attorney General (or a designee of the Attorney General) may grant a request
			 under subparagraph (A) after coordinating with the Secretary of the Interior
			 (or a designee of the Secretary), consulting with affected Indian tribes, and
			 concluding that the criminal justice system of the requesting tribe has
			 adequate safeguards in place to protect defendants’ rights, consistent with
			 section 204 of Public Law 90–284.</text>
						</subparagraph><subparagraph id="IDe48013be6f6f4f878353ab8d271c970d"><enum>(C)</enum><header>Effective dates
			 for pilot projects</header><text>An Indian tribe designated as a participating
			 tribe under this paragraph may commence exercising special domestic violence
			 criminal jurisdiction pursuant to subsections (b) through (e) of section 204 of
			 Public Law 90–284 on a date established by the Attorney General, after
			 consultation with that Indian tribe, but in no event later than the date that
			 is 2 years after the date of enactment of this Act.</text>
						</subparagraph></paragraph></subsection></section><section id="ID11cc2c6a053f4d51bb70174d9f24c5a9"><enum>205.</enum><header>Other

			 amended by striking subsection (d) and inserting the following:</text>

						<paragraph id="id5f987e5f-0bf4-463d-8473-77f029061832"><enum>(1)</enum><header>Purpose</header><text>The
				Attorney General shall award a grant to tribal coalitions for purposes
				of—</text>
							<subparagraph id="idc13859d7-124e-4c7e-9978-926bc0f15592"><enum>(A)</enum><text>increasing awareness of
				domestic violence and sexual assault against Indian women;</text>
							</subparagraph><subparagraph id="ida41937aa-d410-4885-90a5-d13995e8a751"><enum>(B)</enum><text>enhancing the response to
				violence against Indian women at the Federal, State, and tribal levels;</text>
							</subparagraph><subparagraph id="id4b5fc2ba-56a5-41fd-8bdd-4237ac5854ac"><enum>(C)</enum><text>identifying and providing
				technical assistance to coalition membership and tribal communities to enhance
				access to essential services to Indian women victimized by domestic and sexual
				violence, including sex trafficking; and</text>
							</subparagraph><subparagraph id="idd4576f8c-88c4-47f4-86b9-285f5ab0dbe8"><enum>(D)</enum><text>assisting Indian tribes
				in developing legislation and policies and providing outreach and education
				that enhance best practices for responding to violent crimes against Indian
				women, including the crimes of domestic violence, dating violence, sexual
				assault, sex trafficking, and stalking.</text>
							</subparagraph></paragraph><paragraph id="id8ae65b91-f05f-4396-9731-06b56286a900"><enum>(2)</enum><header>Grants</header><text>The
				Attorney General shall award grants on annual basis under paragraph (1)
				to—</text>
							<subparagraph id="id6dd77f1c-c042-4de9-b692-50453fec8d86"><enum>(A)</enum><text>each tribal coalition
				that—</text>
								<clause id="idec7e5690-2146-4b7c-98c3-5d4086b67704"><enum>(i)</enum><text>meets the criteria of a
				tribal coalition under section 40002(a) of the Violence Against Women Act of
				1994 (42 U.S.C. 13925(a));</text>
								</clause><clause id="id67fa22bd-45fe-474e-9495-f1b767ab0daf"><enum>(ii)</enum><text>is recognized by the
				Office on Violence Against Women; and</text>
								</clause><clause id="id53b86ad7-c71e-4dec-91e0-9a896d30a865"><enum>(iii)</enum><text>provides services to
				Indian tribes; and</text>
								</clause></subparagraph><subparagraph id="id40587d3b-bb68-434d-8ae4-b8d654a6d228"><enum>(B)</enum><text>organizations that
				propose to incorporate and operate a tribal coalition in areas where Indian
				tribes are located but no tribal coalition exists.</text>
							</subparagraph></paragraph><paragraph id="idbe68ec9a-fc72-4c4d-b757-8e87fe3f8421"><enum>(3)</enum><header>Use of
				amounts</header><text>For each of fiscal years 2013 through 2017, of the
				amounts appropriated to carry out this subsection—</text>
							<subparagraph id="iddbf381af-5d42-43e5-ba13-411ff5aa44cd"><enum>(A)</enum><text>not more than 10 percent
				may be made available to organizations described in paragraph (2)(B);
				and</text>
							</subparagraph><subparagraph id="iddc07a6b6-9676-4dfb-958f-f5c496fc01e3"><enum>(B)</enum><text>not less than 90 percent
				shall be made available to tribal coalitions described in paragraph (2)(A),
				which amounts shall be distributed equally among each eligible tribal coalition
				for the applicable fiscal year.</text>
							</subparagraph></paragraph><paragraph id="id7e25184f-ef29-4135-89de-a059a9fe1fe8"><enum>(4)</enum><header>Duration</header><text>A
				grant under this subsection shall be awarded for a period of 1 year.</text>
						</paragraph><paragraph id="idd9c887f2-0a5a-4108-b129-df145c90eece"><enum>(5)</enum><header>Eligibility for other
				grants</header><text>Receipt of an award under this subsection by a tribal
				coalition shall not preclude the tribal coalition from receiving additional
				grants under this title to carry out the purposes described in paragraph
				(1).</text>
						</paragraph><paragraph id="idbb4aace0-7493-447f-b694-67c88b08c49a"><enum>(6)</enum><header>Multiple purpose
				applications</header><text>Nothing in this subsection prohibits any tribal
				coalition or organization described in paragraph (2) from applying for funding
				to address sexual assault or domestic violence needs in the same
				application.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id6a9e09ec-dd59-4329-9302-37e455016414"><enum>103.</enum><header>Consultation</header><text display-inline="no-display-inline">Section 903 of the Violence Against Women
			 and Department of Justice Reauthorization Act of 2005 (42 U.S.C. 14045d) is
			 amended—</text>
				<paragraph id="id0d91f77d-e3e0-4151-9ea4-d3c80e7871c0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
					<subparagraph id="idae508a33-d1cd-4455-9703-457052e23da7"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and the Violence Against
			 Women Act of 2000</quote> and inserting <quote>, the Violence Against Women Act

				services to members of the tribal coalition on a statewide, regional, or
				customary territory basis;</text>
							</subparagraph><subparagraph id="idd0a613d2-c5f6-4811-9d56-2c0b187f6e95"><enum>(B)</enum><text>provides education,
				support, and technical assistance to member Indian service providers in a
				manner that enables those member providers to establish and maintain culturally
				appropriate services, including shelter and rape crisis services, designed to
				assist Indian women and the dependents of those women who are victims of
				domestic violence, dating violence, sexual assault, and stalking;</text>
							</subparagraph><subparagraph id="id3685476266234EF0A5D131C48A2D3E0D"><enum>(C)</enum><text>serves as an information
				clearinghouse and resource center for Indian programs addressing domestic
				violence and sexual assault;</text>
							</subparagraph><subparagraph id="idf3726192-f022-4e41-93cb-65c06d6f334c"><enum>(D)</enum><text>is comprised of board and
				general members that are representative of—</text>
								<clause id="id548e4cb8-0554-491d-983c-f67fdbc543c3"><enum>(i)</enum><text>the member service
				providers described in subparagraph (B); and</text>
								</clause><clause id="id5f260231-b429-4603-8a2f-8cc9fef3c1ff"><enum>(ii)</enum><text>the tribal communities
				in which the services are being provided;</text>
								</clause></subparagraph><subparagraph id="idb19e5e79-30e7-4255-a1aa-8476d4ca8230"><enum>(E)</enum><text>supports the development
				of legislation, policies, protocols, procedures, and guidance to enhance
				domestic violence and sexual assault intervention and prevention efforts in
				Indian tribes and communities to be served; and</text>
							</subparagraph><subparagraph id="idb45e7ba5-3ece-44d9-b08e-5e2edc9f0e33"><enum>(F)</enum><text>has expertise in the
				development of Indian community-based, linguistically, and culturally specific
				outreach and intervention services for the Indian communities to be
				served.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section></title><title changed="added" committee-id="SLIA00" id="id0d8e2dc8-5c67-4ca1-a3a0-5812d750a5c3" reported-display-style="italic"><enum>II</enum><header>Tribal jurisdiction and
			 criminal offenses</header>
			<section id="idb8ed56c1-99d2-4bb3-b74f-65f7ae33effa"><enum>201.</enum><header>Tribal jurisdiction
			 over crimes of domestic violence</header><text display-inline="no-display-inline">Title II of Public Law 90–284 (25 U.S.C.
			 1301 et seq.) (commonly known as the <quote>Indian Civil Rights Act of
			 1968</quote>) is amended by adding at the end the following:</text>

					<section id="idef1cfc8c-0770-4ef0-8f89-a87db39186df"><enum>204.</enum><header>Tribal jurisdiction
				over crimes of domestic violence</header>
						<subsection id="id267c4a19-d3ad-4699-9b3c-72a8ffe17e94"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="id2270601e-1e9b-40d2-959b-d68082892c8d"><enum>(1)</enum><header>Dating
				violence</header><text>The term <term>dating violence</term> means violence
				committed by a person who is or has been in a social relationship of a romantic
				or intimate nature with the victim, as determined by the length of the
				relationship, the type of relationship, and the frequency of interaction
				between the persons involved in the relationship.</text>
							</paragraph><paragraph id="id814a2254-8ef3-4170-aa60-625089bfde36"><enum>(2)</enum><header>Domestic
				violence</header><text>The term <term>domestic violence</term> means violence
				committed by a current or former spouse of the victim, by a person with whom
				the victim shares a child in common, by a person who is cohabitating with or
				has cohabitated with the victim as a spouse, or by a person similarly situated
				to a spouse of the victim under the domestic or family violence laws of the
				Indian tribe that has jurisdiction over the Indian country where the violence
				occurs.</text>
							</paragraph><paragraph id="ide52612af-a0f3-4cd7-8c77-6b0759d19692"><enum>(3)</enum><header>Indian
				country</header><text>The term <term>Indian country</term> has the meaning
				given the term in section 1151 of title 18, United States Code.</text>
							</paragraph><paragraph id="id60e8fb4d-8ef2-42ee-82e3-11aadf163aee"><enum>(4)</enum><header>Participating
				tribe</header><text>The term <term>participating tribe</term> means an Indian
				tribe that elects to exercise special domestic violence criminal jurisdiction
				over the Indian country of that Indian tribe.</text>
							</paragraph><paragraph id="id7279ed1e-5397-4ef3-ad41-35b359acef2e"><enum>(5)</enum><header>Protection
				order</header><text>The term <term>protection order</term> means any
				injunction, restraining order, or other order issued by a civil or criminal
				court for the purpose of preventing violent or threatening acts or harassment
				against, sexual violence against, contact or communication with, or physical
				proximity to, another person, including any temporary or final order issued by
				a civil or criminal court, whether obtained by filing an independent action or
				as a pendente lite order in another proceeding, so long as the civil or
				criminal order was issued in response to a complaint, petition, or motion filed
				by or on behalf of a person seeking protection.</text>
							</paragraph><paragraph id="id74e7ff60-4eca-44ce-a425-cb610d1c3a20"><enum>(6)</enum><header>Special domestic
				violence criminal jurisdiction</header><text>The term <term>special domestic
				violence criminal jurisdiction</term> means the criminal jurisdiction that a
				participating tribe may exercise under this section but could not otherwise
				exercise.</text>
							</paragraph><paragraph id="iddd26fae8-53c1-4852-a636-535e227e34aa"><enum>(7)</enum><header>Spouse or intimate
				partner</header><text>The term <term>spouse or intimate partner</term> has the
				meaning given the term in section 2266 of title 18, United States Code.</text>
							</paragraph></subsection><subsection id="id1f6c912b-2617-40eb-911e-6c4b1d2ccfe5"><enum>(b)</enum><header>Nature of the criminal
				jurisdiction</header>
							<paragraph id="id1dddde94-e296-4080-8b54-1f25b9659138"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, in addition
				to all powers of self-government recognized and affirmed by this Act, the
				powers of self-government of a participating tribe include the inherent power
				of that tribe, which is hereby recognized and affirmed, to exercise special
				domestic violence criminal jurisdiction over all persons.</text>
							</paragraph><paragraph id="id270ff031-d937-4c94-a61a-9dc39cc84e82"><enum>(2)</enum><header>Concurrent
				jurisdiction</header><text>A participating tribe shall exercise special
				domestic violence criminal jurisdiction concurrently, not exclusively.</text>
							</paragraph><paragraph id="id99f926e2-f573-4030-b83c-10a6269744b3"><enum>(3)</enum><header>Applicability</header><text>Nothing
				in this section—</text>
								<subparagraph id="id4fe826f4-1e63-4c2b-b612-7ce7e80245ec"><enum>(A)</enum><text>creates or eliminates any
				Federal or State criminal jurisdiction over Indian country; or</text>
								</subparagraph><subparagraph id="id2b3a94f7-6c61-49af-b39a-89d3a2cf591b"><enum>(B)</enum><text>affects the authority of
				the United States, or any State government that has been delegated authority by
				the United States, to investigate and prosecute a criminal violation in Indian
				country.</text>
								</subparagraph></paragraph></subsection><subsection id="id24448c7c-5d93-4029-a2c6-b57ec7711b4b"><enum>(c)</enum><header>Criminal
				conduct</header><text>A participating tribe may exercise special domestic
				violence criminal jurisdiction over a defendant for criminal conduct that falls
				into 1 or more of the following categories:</text>
							<paragraph id="id2aa85884-0e1f-4ff1-9d67-794cf6235033"><enum>(1)</enum><header>Domestic violence and
				dating violence</header><text>An act of domestic violence or dating violence
				that occurs in the Indian country of the participating tribe.</text>
							</paragraph><paragraph id="id19b919aa-c63b-48c2-8ab2-ba4a508849b1"><enum>(2)</enum><header>Violations of
				protection orders</header><text>An act that—</text>
								<subparagraph id="id2afe8419-9b98-406f-9686-74c7a9acf527"><enum>(A)</enum><text>occurs in the Indian
				country of the participating tribe; and</text>
								</subparagraph><subparagraph id="idb18d8b53-0243-4f4f-bb03-79e525201ce0"><enum>(B)</enum><text>violates the portion of a
				protection order that—</text>
									<clause id="idbc261e65-e072-4a88-b5e1-9d94088c4d89"><enum>(i)</enum><text>prohibits or provides
				protection against violent or threatening acts or harassment against, sexual
				violence against, contact or communication with, or physical proximity to,
				another person; and</text>
									</clause><clause id="id37a3204e-d7b7-43f8-aeb5-194e77093143"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="ide3d2fb46-63e9-4825-b53a-fdc97e477677"><enum>(I)</enum><text>was issued against
				the defendant;</text>
										</subclause><subclause changed="added" committee-id="SLIA00" id="id3469ef5f-0685-4be3-b626-910c868890ce" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>is enforceable by the
				participating tribe; and</text>
										</subclause><subclause changed="added" committee-id="SLIA00" id="id8ddacfe9-b7b7-4a3c-b0f1-f15ba0c7e054" indent="up1" reported-display-style="italic"><enum>(III)</enum><text>is consistent with
				section 2265(b) of title 18, United States Code.</text>
										</subclause></clause></subparagraph></paragraph></subsection><subsection id="idd6e7f9d8-eb64-48a1-aee2-8cb3704bcc6f"><enum>(d)</enum><header>Dismissal of certain
				cases</header>
							<paragraph id="id6ccd34ab-2c20-4d55-8129-bf781b0ef385"><enum>(1)</enum><header>Definition of
				victim</header><text>In this subsection and with respect to a criminal
				proceeding in which a participating tribe exercises special domestic violence
				criminal jurisdiction based on a criminal violation of a protection order, the
				term <term>victim</term> means a person specifically protected by a protection
				order that the defendant allegedly violated.</text>
							</paragraph><paragraph id="id90d14170-b488-4303-82c9-bc2a9cd0f7a0"><enum>(2)</enum><header>Non-Indian victims and
				defendants</header><text>In a criminal proceeding in which a participating
				tribe exercises special domestic violence criminal jurisdiction, the case shall
				be dismissed if—</text>
								<subparagraph id="id7a1f3d16-80a4-44b9-bab6-55be1c1d4ffe"><enum>(A)</enum><text>the defendant files a
				pretrial motion to dismiss on the grounds that the alleged offense did not
				involve an Indian; and</text>
								</subparagraph><subparagraph id="id404460f5-6e47-4ffd-a9ff-5a87d9cd34f0"><enum>(B)</enum><text>the participating tribe
				fails to prove that the defendant or an alleged victim is an Indian.</text>
								</subparagraph></paragraph><paragraph id="id5ca282fe-39d1-4950-ac96-b2bda98cb4a8"><enum>(3)</enum><header>Ties to Indian
				tribe</header><text>In a criminal proceeding in which a participating tribe
				exercises special domestic violence criminal jurisdiction, the case shall be
				dismissed if—</text>
								<subparagraph id="id0f94c3e3-13ab-4ad9-9267-5ee4adf56ae9"><enum>(A)</enum><text>the defendant files a
				pretrial motion to dismiss on the grounds that the defendant and the alleged
				victim lack sufficient ties to the Indian tribe; and</text>
								</subparagraph><subparagraph id="id0dcc80d5-d9c1-4d34-9a74-f714762071cb"><enum>(B)</enum><text>the prosecuting tribe
				fails to prove that the defendant or an alleged victim—</text>
									<clause id="id7cd0f69d-48b4-4ee2-bd9b-454b069feedf"><enum>(i)</enum><text>resides in the Indian
				country of the participating tribe;</text>
									</clause><clause id="id1b6cc2ac-bd7f-4f6a-a7c6-444a9673e67f"><enum>(ii)</enum><text>is employed in the
				Indian country of the participating tribe; or</text>
									</clause><clause id="ida3410071-47e9-4c9b-8b54-2c4849021435"><enum>(iii)</enum><text>is a spouse or intimate
				partner of a member of the participating tribe.</text>
									</clause></subparagraph></paragraph><paragraph id="idf8585fa2-fee5-4f3d-a02b-6971e2da5c41"><enum>(4)</enum><header>Waiver</header><text>A
				knowing and voluntary failure of a defendant to file a pretrial motion
				described in paragraph (2) or (3) shall be considered a waiver of the right to
				seek a dismissal under this subsection.</text>
							</paragraph></subsection><subsection id="id73441c5d-abc5-4955-8270-c79ea2598c56"><enum>(e)</enum><header>Rights of
				defendants</header><text>In a criminal proceeding in which a participating
				tribe exercises special domestic violence criminal jurisdiction, the
				participating tribe shall provide to the defendant—</text>
							<paragraph id="idb7f33242-375a-4892-8403-bf2322e79d54"><enum>(1)</enum><text>all applicable rights
				under this Act;</text>
							</paragraph><paragraph id="id22a5c539-ce23-49a3-a493-ce00a5548d52"><enum>(2)</enum><text>if a term of imprisonment
				of any length is imposed, all rights described in section 202(c); and</text>
							</paragraph><paragraph id="id633391de-9b58-4f9c-85a5-f24b345301c1"><enum>(3)</enum><text>all other rights whose
				protection is necessary under the Constitution of the United States in order
				for Congress to recognize and affirm the inherent power of the participating
				tribe to exercise criminal jurisdiction over the defendant.</text>
							</paragraph></subsection><subsection id="id79b126d0-9f6c-483d-9f27-78d429154402"><enum>(f)</enum><header>Petitions To stay
				detention</header>
							<paragraph id="idd570a778-1d0c-4e2a-b676-8d235c5ff26f"><enum>(1)</enum><header>In
				general</header><text>A person who has filed a petition for a writ of habeas
				corpus in a court of the United States under section 203 may petition that
				court to stay further detention of that person by the participating
				tribe.</text>
							</paragraph><paragraph id="id327f6753-9bee-4a72-96c2-c796c0f10da0"><enum>(2)</enum><header>Grant of
				stay</header><text>A court shall grant a stay described in paragraph (1) if the
				court—</text>
								<subparagraph id="id12c13985-4376-48d5-bfb4-b3ec19b8ae66"><enum>(A)</enum><text>finds that there is a
				substantial likelihood that the habeas corpus petition will be granted;
				and</text>
								</subparagraph><subparagraph id="id9ac8fb93-a305-4e6e-b766-b160af281a8f"><enum>(B)</enum><text>after giving each alleged
				victim in the matter an opportunity to be heard, finds, by clear and convincing
				evidence that, under conditions imposed by the court, the petitioner is not
				likely to flee or pose a danger to any person or the community if
				released.</text>
								</subparagraph></paragraph></subsection><subsection id="id4d69b1e7-5918-4163-a7e7-cc950993b7aa"><enum>(g)</enum><header>Grants to tribal
				governments</header><text>The Attorney General may award grants to the
				governments of Indian tribes (or to authorized designees of those
				governments)—</text>
							<paragraph id="ide9a633b8-6bd4-40ac-906a-b5cfce5a68c0"><enum>(1)</enum><text>to strengthen tribal
				criminal justice systems to assist Indian tribes in exercising special domestic
				violence criminal jurisdiction, including—</text>
								<subparagraph id="id34c4ed94-0fad-4391-9ac4-2021d2934971"><enum>(A)</enum><text>law enforcement
				(including the capacity to enter information into and obtain information from
				national crime information databases);</text>
								</subparagraph><subparagraph id="idefb9b231-febb-4a17-8b39-ec03113c4167"><enum>(B)</enum><text>prosecution;</text>
								</subparagraph><subparagraph id="id5c73ddb0-97e4-42eb-bf81-c35c234c9490"><enum>(C)</enum><text>trial and appellate
				courts;</text>
								</subparagraph><subparagraph id="idb8a8185f-f59e-485b-ad6d-6fb4f0f625a5"><enum>(D)</enum><text>probation systems;</text>
								</subparagraph><subparagraph id="id92cf1d27-bcd2-40d9-9093-f2ac428ef13f"><enum>(E)</enum><text>detention and
				correctional facilities;</text>
								</subparagraph><subparagraph id="idd24b25f7-2e36-49f0-971e-29e0ab8840f7"><enum>(F)</enum><text>alternative
				rehabilitation centers;</text>
								</subparagraph><subparagraph id="id478ad3f4-688b-4ee3-bdd7-512d2ced10ba"><enum>(G)</enum><text>culturally appropriate
				services and assistance for victims and their families; and</text>
								</subparagraph><subparagraph id="ideb7e487c-233f-49f3-87cb-908673fbd6ba"><enum>(H)</enum><text>criminal codes and rules
				of criminal procedure, appellate procedure, and evidence;</text>
								</subparagraph></paragraph><paragraph id="id388975d1-8531-4482-8f7c-8db5f3d94c9a"><enum>(2)</enum><text>to provide indigent
				criminal defendants with the effective assistance of licensed defense counsel,
				at no cost to the defendant, in criminal proceedings in which a participating
				tribe prosecutes a crime of domestic violence or dating violence or a criminal
				violation of a protection order;</text>
							</paragraph><paragraph id="idaee40e1d-5d4e-4055-9fe9-60f9319c2784"><enum>(3)</enum><text>to ensure that, in
				criminal proceedings in which a participating tribe exercises special domestic
				violence criminal jurisdiction, jurors are summoned, selected, and instructed
				in a manner consistent with all applicable requirements; and</text>
							</paragraph><paragraph id="id9801d78c-090c-4945-88ee-75a7c29c1865"><enum>(4)</enum><text>to accord victims of
				domestic violence, dating violence, and violations of protection orders rights
				that are similar to the rights of a crime victim described in section 3771(a)
				of title 18, United States Code, consistent with tribal law and custom.</text>
							</paragraph></subsection><subsection id="id085632be-23d0-4cda-9b78-c205ea4267e3"><enum>(h)</enum><header>Supplement, not
				supplant</header><text>Amounts made available under this section shall
				supplement and not supplant any other Federal, State, tribal, or local
				government amounts made available to carry out activities described in this
				section.</text>
						</subsection><subsection id="ida63f6943-181f-44c3-a51d-463e66570f1c"><enum>(i)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out subsection (g) and to provide training, technical assistance, data
				collection, and evaluation of the criminal justice systems of participating
				tribes such sums as are
				necessary.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id12adf90a-4d30-48f3-89e0-57bc5d7c8b34"><enum>202.</enum><header>Tribal protection
			 orders</header><text display-inline="no-display-inline">Section 2265 of title
			 18, United States Code, is amended by striking subsection (e) and inserting the
			 following:</text>
				<quoted-block changed="added" committee-id="SLIA00" display-inline="no-display-inline" id="idef7643b9-d4e1-460c-8303-0164f0af5e95" reported-display-style="italic" style="OLC">
					<subsection id="id45fa5d20-0a15-49cc-8680-d52c2f67c3dc"><enum>(e)</enum><header>Tribal court
				jurisdiction</header><text>For purposes of this section, a court of an Indian
				tribe shall have full civil jurisdiction to issue and enforce protection orders
				involving any person, including the authority to enforce any orders through
				civil contempt proceedings, the exclusion of violators from Indian land, and
				other appropriate mechanisms, in matters arising anywhere in the Indian country
				of the Indian tribe (as defined in section 1151) or otherwise within the
				authority of the Indian tribe.</text>
					</subsection><subsection id="idC7AB365C80A846A089102590666F4E8F"><enum>(f)</enum><header>Applicability</header><text>Nothing
				in this section limits, alters, expands, or diminishes the civil or criminal
				jurisdiction of the State of Alaska, any subdivision of the State of Alaska, or
				any Indian tribe in the State of
				Alaska.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id655a5184-9e9a-4338-a4ed-d3a7c4d6a6de"><enum>203.</enum><header>Amendments to the
			 Federal assault statute</header>
				<subsection id="id271279ef-0f2d-422b-8c07-2c1a1768d147"><enum>(a)</enum><header>Assaults by striking,
			 beating, or wounding</header><text>Section 113(a)(4) of title 18, United States
			 Code, is amended by striking <quote>six months</quote> and inserting <quote>1
			 year</quote>.</text>
				</subsection><subsection id="id49f88006-9e88-4f1f-aeb3-b08b9198ae04"><enum>(b)</enum><header>Assaults resulting in
			 substantial bodily injury</header><text>Section 113(a)(7) of title 18, United
			 States Code, is amended by striking “substantial bodily injury to an individual
			 who has not attained the age of 16 years” and inserting “substantial bodily
			 injury to a spouse or intimate partner, a dating partner, or an individual who
			 has not attained the age of 16 years”.</text>
				</subsection><subsection id="id94484cc5-e4af-41d1-8845-d77ebaa14e28"><enum>(c)</enum><header>Assaults by strangling
			 or suffocating</header><text>Section 113(a) of title 18, United States Code, is
			 amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="SLIA00" display-inline="no-display-inline" id="id66780e6b-c588-4dda-b9b5-6a9e860b32bc" reported-display-style="italic" style="OLC">

							</paragraph><paragraph id="idea08f4e9-cd77-4016-b989-fed65cda5321"><enum>(5)</enum><text>the term
				<term>suffocating</term> means intentionally, knowingly, or recklessly impeding
				the normal breathing of a person by covering the mouth of the person, the nose
				of the person, or both, regardless of whether that conduct results in any
				visible injury or whether there is any intent to kill or protractedly injure
				the
				victim.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id57c58be7-c3de-45e0-b91d-4a32fb76ec6f"><enum>(e)</enum><header>Indian major
			 crimes</header><text>Section 1153(a) of title 18, United States Code, is
			 amended by striking “assault with intent to commit murder, assault with a
			 dangerous weapon, assault resulting in serious bodily injury (as defined in
			 section 1365 of this title)” and inserting <quote>a felony assault under
			 section 113</quote>.</text>
				</subsection></section><section id="id3381c83d-fa3c-4175-b8dc-9d9a2080717b"><enum>204.</enum><header>Effective dates; pilot
			 project</header>
				<subsection id="id2807e193-1171-426d-a801-b3fe37578e29"><enum>(a)</enum><header>General effective
			 date</header><text>Except as provided in subsection (b), the amendments made by
			 this title shall take effect on the date of enactment of this Act.</text>
				</subsection><subsection id="id47de7fd9-b3bc-417e-849d-209212bb43b0"><enum>(b)</enum><header>Effective date for
			 special domestic-Violence criminal jurisdiction</header>
					<paragraph id="id8e757222-68b5-4440-9e13-850fbde26c74"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), subsections (b)
			 through (e) of section 204 of Public Law 90–284 (as added by section 201) shall
			 take effect on the date that is 2 years after the date of enactment of this
			 Act.</text>
					</paragraph><paragraph id="id6a8e8668-836f-44c3-8f15-9b46a6a45708"><enum>(2)</enum><header>Pilot project</header>
						<subparagraph id="idc57b043d-b3fd-4b1b-bc36-d826f4dd128c"><enum>(A)</enum><header>In
			 general</header><text>At any time during the 2-year period beginning on the
			 date of enactment of this Act, an Indian tribe may ask the Attorney General to
			 designate the tribe as a participating tribe under section 204(a) of Public Law
			 90–284 on an accelerated basis.</text>
						</subparagraph><subparagraph id="id8b58389f-d161-4510-acdb-e8123e129c92"><enum>(B)</enum><header>Procedure</header><text>The
			 Attorney General (or a designee of the Attorney General) may grant a request
			 under subparagraph (A) after coordinating with the Secretary of the Interior
			 (or a designee of the Secretary), consulting with affected Indian tribes, and
			 concluding that the criminal justice system of the requesting tribe has
			 adequate safeguards in place to protect defendants’ rights, consistent with
			 section 204 of Public Law 90–284.</text>
						</subparagraph><subparagraph id="idb9374ed1-b486-4d77-b8a9-9e05c8c9e137"><enum>(C)</enum><header>Effective dates for
			 pilot projects</header><text>An Indian tribe designated as a participating
			 tribe under this paragraph may commence exercising special domestic violence
			 criminal jurisdiction pursuant to subsections (b) through (e) of section 204 of
			 Public Law 90–284 on a date established by the Attorney General, after
			 consultation with that Indian tribe, but in no event later than the date that
			 is 2 years after the date of enactment of this Act.</text>
						</subparagraph></paragraph></subsection></section><section id="id0f8a1e76-77cd-454a-983f-ab3e3cb79ce8"><enum>205.</enum><header>Assaults; repeat
			 offenders</header>
				<subsection id="idf1a17864-4955-40d0-87d8-01cc815b8eed"><enum>(a)</enum><header>Assaults</header><text>Section
			 113(a) of title 18, United States Code, is amended—</text>
					<paragraph id="id39ebd883-8dfc-4831-a1cd-4b7c6825a782"><enum>(1)</enum><text>by striking paragraph (1)
			 and inserting the following:</text>
						<quoted-block changed="added" committee-id="SLIA00" display-inline="no-display-inline" id="id2c7fc5de-9cc3-4ad5-8ab1-a2a30ac02f22" reported-display-style="italic" style="OLC">
							<paragraph id="idc444f6fe-5922-472c-afe2-10a2195a2c91"><enum>(1)</enum><text>Assault with intent to
				commit murder or a felony under chapter 109A, by a fine under this title,
				imprisonment for not more than 20 years, or

							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="idebea974b-5871-43bb-94cc-874233ba5a18"><enum>(2)</enum><text>in paragraph (3) by
			 striking <quote>and without just cause or excuse,</quote>; and</text>
					</paragraph><paragraph id="idaf5a2c25-444b-4c97-b58d-8b0b3f60fa6d"><enum>(3)</enum><text>in paragraph (7), by
			 striking <quote>fine</quote> and inserting <quote>a fine</quote>.</text>
					</paragraph></subsection><subsection id="id29a59721-ab32-4db3-8719-3801664f2bae"><enum>(b)</enum><header>Repeat
			 offenders</header><text>Section 2265A(b)(1)(B) of title 18, United States Code,
			 is amended by inserting <quote>or tribal</quote> after
			 <quote>State</quote>.</text>
				</subsection></section><section id="idF63BB302892B4AE58821A0CBCFF6C1C7"><enum>206.</enum><header>Violations of tribal
			 civil protection orders</header><text display-inline="no-display-inline">Section 1153 of title 18, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="SLIA00" display-inline="no-display-inline" id="id09408B398C59469683BF85CD9E3FFB18" reported-display-style="italic" style="OLC">
					<subsection id="ID130143b2cc2e42efa1f6c8cfe304d81e"><enum>(c)</enum><header>Violation of tribal
				civil protection order</header>
						<paragraph id="IDfb1904fa2b924e09be4beb99622cbd5f"><enum>(1)</enum><header>Definition of civil
				protection order</header><text>In this subsection, the term <term>civil
				protection order</term> means an order issued in a civil proceeding by a court
				or other judicial tribunal of an Indian tribe for the purpose of protecting a
				person who resides in the Indian country of the Indian tribe from physical
				harm, violent or threatening acts, harassment, or sexual violence by the
				respondent, which temporarily or permanently prohibits the respondent from
				approaching or coming into physical proximity to or contact with the person at
				a specified residence, place, or area in such Indian country.</text>
						</paragraph><paragraph id="id646142F433B34C91A96974D3653E1518"><enum>(2)</enum><header>Prohibition</header><text>It
				shall be unlawful for any person to violate the terms of a civil protection
				order issued by a court or other judicial tribunal of an Indian tribe in
				accordance with paragraph (4).</text>
						</paragraph><paragraph id="ID449748ed5e654342987e4ab912ff98bb"><enum>(3)</enum><header>Penalty</header><text>Any
				person who violates paragraph (2) shall—</text>
							<subparagraph id="idDAF9D499DB5B4417AC076DCE105EDDAD"><enum>(A)</enum><text>be guilty of a crime;
				and</text>
							</subparagraph><subparagraph id="id520954CBD54845F6810DA526AEBF3EC9"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idC6993920AE2D47F3A2A89EF260B65488"><enum>(i)</enum><text>for the first violation
				of the civil protection order, fined not more than $1,000, imprisoned for not
				more than 1 year, or both; and</text>
								</clause><clause changed="added" committee-id="SLIA00" id="id13506FDC12BF4714AE7D9A8EF16069D6" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>for any subsequent
				violation of the civil protection order, fined not more than $5,000, imprisoned
				for not more than 3 years, or both.</text>
								</clause></subparagraph></paragraph><paragraph id="ID1ed292f6ad6f48a291b5ddeefabff10f"><enum>(4)</enum><header>Requirements</header><text>A
				violation of a civil protection order or a civil exclusion order shall
				constitute an offense under paragraph (2) if the civil protection order—</text>
							<subparagraph id="IDd06dc02a0cba40f1baaeb29d93e5e54a"><enum>(A)</enum><text>meets all of the
				requirements of section 2265 relating to full faith and credit; and</text>
							</subparagraph><subparagraph id="IDa31c3eb490734bc7b96aebf5a5e8a8b0"><enum>(B)</enum><text>includes the following
				statement: <quote>A violation of this civil protection order may result in
				criminal prosecution under Federal law and the imposition of a fine,
				imprisonment, or both.</quote>.</text>
							</subparagraph></paragraph><paragraph id="IDd9f46462adc04790bb5fff3a038a907a"><enum>(5)</enum><header>Effect of
				subsection</header><text>Nothing in this subsection limits, modifies, or
				otherwise affects the application of any provision of sections 2261 through
				2266.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id252D81F1343E4C788A3F2AFA7947F0A5"><enum>207.</enum><header>High priority
			 performance goal pilot program reporting</header><text display-inline="no-display-inline">Section 3(c) of the Indian Law Enforcement
			 Reform Act (25 U.S.C. 2802(c)) is amended—</text>
				<paragraph id="id30F628FBC23E48ACB60AAFBF6973E321"><enum>(1)</enum><text>in paragraph (17), by
			 striking <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="id6DDCF00B8ABD4B57AE2512B3204DC223"><enum>(2)</enum><text>in paragraph (18), by
			 striking the period at the end and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="id8D79DB405F4244629EEC890D463A0E4B"><enum>(3)</enum><text>by adding at the end the
			 following:</text>
					<quoted-block changed="added" committee-id="SLIA00" display-inline="no-display-inline" id="id49D1EA6D99624C5189CB26530B86B5D0" reported-display-style="italic" style="OLC">
						<paragraph id="idF87A0133F85740938D27685154A89319"><enum>(19)</enum><text>beginning not later than
				90 days after the date of enactment of this paragraph, submitting to the
				appropriate committees of Congress for each fiscal year a report on the high
				priority performance goal pilot program carried out by the Secretary to reduce
				violent crime in Indian communities that includes—</text>
							<subparagraph id="id8B6CAE433A434BC2BD822811CB287763"><enum>(A)</enum><text>a list of the Indian
				tribes participating in the program, including—</text>
								<clause id="idBCFF2C81C1B347F5A794881FB7711764"><enum>(i)</enum><text>baseline data on the
				violent crimes occurring on the reservations of those Indian tribes before the
				high priority performance goal pilot program commenced, including the quantity
				and types of violent crimes;</text>
								</clause><clause id="idA55E2E4EB0644EF88B026B4A839427E3"><enum>(ii)</enum><text>data on the quantity and
				types of violent crimes on the reservations of those Indians tribes in each
				subsequent fiscal year; and</text>
								</clause><clause id="id0B7CC0F863FA4C2F9412152A522BC348"><enum>(iii)</enum><text>any barriers to
				reporting violent crimes on the reservations of those Indian tribes;</text>
								</clause></subparagraph><subparagraph id="id834CE3D3F79B476D93B2CD1405955676"><enum>(B)</enum><text>a projected list of
				Indians tribes, reservations, or Indian land that the Secretary anticipates
				including in the program, including details on when and how the Secretary
				intends to develop the program on the Indian land or reservations;</text>
							</subparagraph><subparagraph id="id4CD2AFA5B55C456E9B2ECB6E905B941D"><enum>(C)</enum><text>a description of the
				strategies, community policing activities, tribal consultation, best practices,
				training, technical assistance, and community and tribal outreach employed by
				the Office of Justice Services and law enforcement personnel;</text>
							</subparagraph><subparagraph id="idFAD5EF5AB175487A914418D60F84FE70"><enum>(D)</enum><text>for each of the
				reservations described in subparagraphs (A) and (B)—</text>
								<clause id="id801703B44A074783842152E44CD4141F"><enum>(i)</enum><text>baseline data on the
				quantity of law enforcement and court personnel at each of the
				reservations;</text>
								</clause><clause id="id2EB69F1D8C4044A4AF05C598A525590B"><enum>(ii)</enum><text>data on the quantity of
				law enforcement and court personnel at each of the reservations at the end of
				each subsequent fiscal year; and</text>
								</clause><clause id="idA36C936E219849FF8E9AB17A3037B233"><enum>(iii)</enum><text>a description of any
				barriers to hiring law enforcement and court personnel for those
				reservations;</text>
								</clause></subparagraph><subparagraph id="id524D38561CED4B90AC296F618DB1FC8F"><enum>(E)</enum><text>a description of the
				short- and long-term plans of action of the Secretary for reducing violent
				crime in the tribal communities described in subparagraphs (A) and (B);</text>
							</subparagraph><subparagraph id="id1349CD2BE08F4683A6B20DA3A569D98F"><enum>(F)</enum><text>any feasibility
				evaluations or studies relating to the expansion of the pilot program to other
				Indian tribes and Indian land or reservations, which shall include an analysis
				of the impact of such an expansion on existing programs; and</text>
							</subparagraph><subparagraph id="idCF20F0C12C884B73AEBE62051ECAA2A8"><enum>(G)</enum><text>any other information the
				Secretary determines to be
				necessary.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			 Commission</header><text display-inline="no-display-inline">Section 15(f) of
			 the Indian Law Enforcement Reform Act (25 U.S.C. 2812(f)) is amended by
			 striking <quote>2 years</quote> and inserting <quote>3 years</quote>.</text>
			</section></title><title changed="added" committee-id="SLIA00" id="idD6DEB92CB4954F838B1B51C0E1A15864" reported-display-style="italic"><enum>IV</enum><header>Safety enhancement study
			 and demonstration projects</header>
			<section id="id474C20A71F25417281048A03416A5BF7"><enum>401.</enum><header>Safety enhancement
			 study and demonstration projects</header><text display-inline="no-display-inline">Title II of Public Law 90–284 (25 U.S.C.
			 1301 et seq.) (commonly known as the <quote>Indian Civil Rights Act of
			 1968</quote>) (as amended by section 201) is amended by adding at the end the
			 following:</text>
				<quoted-block changed="added" committee-id="SLIA00" display-inline="no-display-inline" id="id216179C61AE44C439479274E2CC39383" reported-display-style="italic" style="OLC">
					<section id="ID68c8fd0c59b64e27912a841809810c87"><enum>205.</enum><header>Safety enhancement
				study and demonstration projects</header>
						<subsection id="ID04fcd6b2c5d4420c932882c71bfa9fd5"><enum>(a)</enum><header>In
				general</header><text>For each of fiscal years 2012 through 2018, the Secretary
				may select up to 5 Indian tribes to participate in a demonstration project to
				carry out Federal regulatory enforcement activities authorized by this
				section.</text>
						</subsection><subsection id="ID531725c89d284140af44f34092db0996"><enum>(b)</enum><header>Demonstration
				projects</header><text>For each Indian tribe selected by the Secretary for a
				demonstration project under this section, the Secretary shall—</text>
							<paragraph id="ID2d0bd5397c9d4fa48de60c404205f793"><enum>(1)</enum><text>in consultation with the
				Indian tribe, promulgate regulations with respect to the management, use, and
				public safety of and in Indian country, including the property in Indian
				country; and</text>
							</paragraph><paragraph id="IDf313d9a6f216459198cee382245881cc"><enum>(2)</enum><text>at the request of the
				Indian tribe, negotiate agreements with the Indian tribe that reflect the
				status of the applicable tribal officers as Federal law enforcement officers
				under section 5(f) of the Indian Law Enforcement Reform Act (25 U.S.C.
				2804(f)), acting within the scope of the duties described in section 3(c) of
				that Act (25 U.S.C. 2802(c)), to allow those tribal officers to enforce
				regulations promulgated under this section.</text>
							</paragraph></subsection><subsection id="ID560e3d44b7e342b1ac9bacecf65a28e3"><enum>(c)</enum><header>Application and
				selection</header>
							<paragraph id="id9962FF84F2D04406AF6802E5CD69763F"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), not later than 180 days after
				the date of enactment of this section, and after consultation with Indian
				tribes, the Secretary shall publish application requirements and selection
				criteria for demonstration projects authorized under this section.</text>
							</paragraph><paragraph id="idDF7F978086EF4547B99D37C1C8AD6DFA"><enum>(2)</enum><header>Criteria</header><text>In
				selecting an Indian tribe for participation in a demonstration project under
				this section, the Secretary shall—</text>
								<subparagraph id="ID97688b2a1eb94b19a1285d2dca8b2c84"><enum>(A)</enum><text>ensure that the Indian
				tribe has notified the applicable State and local governments in which the
				proposed demonstration project is located; and</text>
								</subparagraph><subparagraph id="ID0125a61ab4e943b88789ec5bff29b5b2"><enum>(B)</enum><text>give preference to an
				application for Indian country in which the United States Attorney for the
				district in which the proposed demonstration project is located consents to the
				proposed project.</text>
								</subparagraph></paragraph></subsection><subsection id="IDd64cbaa9f50647d8b7296cd6c12c33ec"><enum>(d)</enum><header>Penalties</header>
							<paragraph id="id230C51ABA17845A09086008964760B16"><enum>(1)</enum><header>In
				general</header><text>Any person who knowingly and willfully violates any
				regulation promulgated pursuant to this section shall be fined not more than
				$1,000, imprisoned for not more than 1 year, or both.</text>
							</paragraph><paragraph id="id7137540FC0A24357896AC04639DC8683"><enum>(2)</enum><header>Magistrate
				judges</header><text>Any person charged with a violation of a regulation
				promulgated pursuant to this section may be tried and sentenced by any United
				States magistrate judge who is designated for that purpose by the court in the
				same manner and subject to the same conditions and limitations as are described
				in section 3401 of title 18, United States Code</text>
							</paragraph></subsection><subsection id="id7AC34EC12BC54F96A19B976D08D6BC97"><enum>(e)</enum><header>Effect of
				regulations</header><text>Nothing in this section, including a regulation
				promulgated by the Secretary under this section—</text>
							<paragraph id="id8F5045683DC040E3B90C2A4CE4F05C5B"><enum>(1)</enum><text>modifies or diminishes
				the criminal jurisdiction of any State or local government; or</text>
							</paragraph><paragraph id="id4760785BBC0F415CB38F8CC7DAAEBAFA"><enum>(2)</enum><text>modifies or affects
				section 1152 of title 18, United States Code.</text>
							</paragraph></subsection><subsection id="ID0556c99e499542b49c09dca92a41b989"><enum>(f)</enum><header>Expiration of
				regulations</header><text>A regulation promulgated by the Secretary under this
				section may remain in effect for a period not to exceed 4 years after the date
				of expiration of the applicable demonstration project.</text>
						</subsection><subsection id="IDbbc1111544cd480593a2219e10d64a31"><enum>(g)</enum><header>Report</header><text>Not
				later than September 30, 2016, the Secretary shall submit to Congress a report
				that describes, as of the date on which the report is submitted—</text>
							<paragraph id="IDae58b03480ec4b6587a8d64228b642f7"><enum>(1)</enum><text>a description of each
				demonstration project approved under this section; and</text>
							</paragraph><paragraph id="IDb5e27e53fd1c4adfaed00030c152b9d0"><enum>(2)</enum><text>an assessment of the
				effectiveness of the demonstration
				projects.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
