		<official-title>To amend the Controlled Substances Act to provide for
		  increased penalties for operators of pill mills, and for other
		  purposes.</official-title>

		<section id="H8439AE2A558647CD9D06938BEE3F613C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Pill Mill Crackdown Act of
			 2011</short-title></quote>.</text>
		</section><section id="idD5343CE8805D4985B96C75504A75BC9B" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 102 of the Controlled Substances Act
			 (21 U.S.C. 802) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idC2253D0F1AD04D5BAC5CDCFE53E7B689" style="OLC">
				<paragraph id="id870A720813764BA88444C2CB1A2117F0"><enum>(57)</enum><text>The term
				<term>pill mill</term> includes a doctor's office, clinic, or health care
				facility that—</text>
					<subparagraph id="idC5438F7CE7AB459693FA57479A7A1FBE"><enum>(A)</enum><text>routinely
				prescribes or dispenses controlled substances outside the scope of the
				prevailing standards of medical practice in the community in relation to the
				prescribing or dispensing of controlled prescription drugs; or</text>
					</subparagraph><subparagraph id="idE830404E8A3149EEB402AE6308B038D6"><enum>(B)</enum><text>routinely
				violates this Act in relation to the prescribing or dispensing of controlled
				prescription drugs.</text>
					</subparagraph></paragraph><paragraph id="id329F3217ED6C4696A8D03F52D4D656FD"><enum>(58)</enum><text>The term
				<term>operator of a pill mill</term> includes—</text>
					<subparagraph id="id315B27863ABF4B9F87D22DB5724EA03F"><enum>(A)</enum><text>any practicing
				physician affiliated with a pill mill; or</text>
					</subparagraph><subparagraph id="id668679746E814A73AE7A9D491B5E3CE8"><enum>(B)</enum><text>any owner,
				director, officer, or partner of a pill
				mill.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id1D0E162795E14F75BD2A526C0336F6BE"><enum>3.</enum><header>Penalties for
			 operation of a pill mill</header><text display-inline="no-display-inline">Section 401(b) of the Controlled Substances
			 Act (21 U.S.C. 841(b)) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H429CE5E832894A118BC4C026AC3CF4B4" style="OLC">
				<paragraph id="H3490AF4ADEFD49428601F9C429269262"><enum>(8)</enum><text display-inline="yes-display-inline">In the case of a violation of subsection
				(a) involving distribution of a controlled substance in schedule II or schedule
				III by the operator of a pill mill, such operator shall be imprisoned as
				provided in this subsection (except that the term of such imprisonment shall be
				double the term otherwise applicable), fined as provided in this subsection
				(except that such fine shall be in an amount triple the amount otherwise
				applicable), or
				both.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HB02CA464D4A54BC781D2A85C7AA34C0F"><enum>4.</enum><header>Distribution to
			 persons under age twenty-one</header><text display-inline="no-display-inline">Section 418 of the Controlled Substances Act
			 (21 U.S.C. 859) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H82AC553AAA834D45BABAE718B3FC72B2" style="OLC">
				<subsection id="H74C4635C92E445ECA033BAC373448528"><enum>(c)</enum><header>Pill mill
				operators</header><text display-inline="yes-display-inline">In the case of a
				person who commits an offense punishable under section 401(b)(8), this section
				shall be applied by substituting <quote>thrice</quote> for <quote>twice</quote>
				in each of subsections (a) and
				(b).</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC3DB6E56E5A649C0A004943FBF569798"><enum>5.</enum><header>Alternative fine
			 not applicable to pill mill operators</header><text display-inline="no-display-inline">Section 415 of the Controlled Substances Act
			 (21 U.S.C. 855) is amended by striking <quote>In lieu of</quote> and inserting
			 the following: <quote>Except in the case of an offense punishable under section
			 401(b)(8) or 418(c), in lieu of</quote>.</text>
		</section><section id="HFD14A6C6EA6B48D3A36D3C4A49B13EBB"><enum>6.</enum><header>Sense of Congress
			 regarding criminal forfeiture of the property of pill mill
			 operators</header><text display-inline="no-display-inline">It is the sense of
			 Congress that an offense punishable under section 401(a)(8) of the Controlled
			 Substances Act (21 U.S.C. 841(a)(8)) is a violation for which certain property
			 is subject to forfeiture to the United States under section 413 of such Act (21
			 U.S.C. 853).</text>
		</section><section id="H1332891CFB5A4AA892316B222F6EEBEB"><enum>7.</enum><header>Use of certain
			 forfeited property for the operations of the Office of National Drug Control
			 Policy</header><text display-inline="no-display-inline">Section 413(h) of the
			 Controlled Substances Act (21 U.S.C. 853(h)) is amended by adding at the end
			 the following: <quote>In the case of property ordered forfeited under this
			 section by reason of a conviction for an offense punishable under section
			 401(b)(8) or 418(c), the proceeds from any disposition under this subsection of
			 such property shall be used, in addition to amounts previously made available
			 in appropriations Acts, for the programs under section 399O, 1911, and 1921 of
			 the Public Health Service Act.</quote>.</text>
		</section><section id="H2FD7CF5B2D2D4E80900E1851187263E5"><enum>8.</enum><header>Transfer between
			 schedules of certain substances</header>
			<subsection id="H6CC919364842482296989D331AAE67CD"><enum>(a)</enum><text>Schedule II in
			 section 202 of the Controlled Substances Act (21 U.S.C. 812) is amended by
			 adding at the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5960B727733E4928BA48E8781484390B" style="OLC">
					<subsection id="H2976ECFECA6743E5BDE976E61049F491"><enum>(d)</enum><text display-inline="yes-display-inline">Unless specifically excepted or unless
				listed in another schedule, any material, compound, mixture, or preparation
				containing limited quantities of any of the following narcotic drugs, or any
				salts thereof:</text>
						<paragraph id="H66F32777E24F4B6D9766CD14B7E10AFD"><enum>(1)</enum><text>Not more than 300
				milligrams of dihydrocodeinone per 100 milliliters or not more than 15
				milligrams per dosage unit, with a fourfold or greater quantity of an
				isoquinoline alkaloid of opium.</text>
						</paragraph><paragraph id="H173691056D0D44948A3768843BDD8E90"><enum>(2)</enum><text>Not more than 300
				milligrams of dihydrocodeinone per 100 milliliters or not more than 15
				milligrams per dosage unit, with one or more active, nonnarcotic ingredients in
				recognized therapeutic
				amounts.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H56DA74CE6CEE40ED9588A78DE9008214"><enum>(b)</enum><text>Schedule III in
			 section 202 of the Controlled Substances Act (21 U.S.C. 812) is amended by
			 striking the following:</text>
				<quoted-block display-inline="no-display-inline" id="H77EF16CFAB6B4E418B7F2F3FB6176E17" style="OLC">
					<paragraph id="H38143AEE52234ED7B40C39E68D641E4B"><enum>(3)</enum><text>Not more than 300
				milligrams of dihydrocodeinone per 100 milliliters or not more than 15
				milligrams per dosage unit, with a fourfold or greater quantity of an
				isoquinoline alkaloid of opium.</text>
					</paragraph><paragraph id="H2ECD261D0E38490E8686CD4E14840FBA"><enum>(4)</enum><text>Not more than 300
				milligrams of dihydrocodeinone per 100 milliliters or not more than 15
				milligrams per dosage unit, with one or more active, nonnarcotic ingredients in
				recognized therapeutic
				amounts.</text>
