		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Home Care Consumer Bill of Rights
			 Act</short-title></quote>.</text>
		</section><title id="id3A5940E3D07B4130BA25B08FBE0F0BD1"><enum>I</enum><header>Home
			 care bill of rights</header>
			<section id="ID3ee97bfcd2564316a0607ab20ce91fdf"><enum>101.</enum><header>Administration
			 on aging</header><text display-inline="no-display-inline">Section 201(e)(2) of
			 the Older Americans Act of 1965 (42 U.S.C. 3011(e)(2)) is amended—</text>
				<paragraph id="idFD02405E4EC644C796C0AF606025FDA3"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id7296EDF99AB14FD690670BDDF8DA8ED6"><enum>(2)</enum><text>in subparagraph
			 (B), by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="idE298F62568C3402CA8DB113875C51A37"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idFDA57FEC7C304179904B536E86D0E942" style="OLC">
						<subparagraph id="ID902bd1c48cd7406f8fa273ee0a01ce99" indent="up1"><enum>(C)</enum><text>to establish best practices for
				State-based enforcement of a Home Care Consumer Bill of Rights through a Plan
				for Enforcement, as such Bill and Plan are outlined in section 705, not later
				than 6 months after the date of enactment of the Home Care Consumer Bill of
				Rights Act, and to make those best practices available to States, and to the
				public through the National Center on Elder Abuse;</text>
						</subparagraph><subparagraph id="IDf039e778cd6f44a0918502c7c8d4673c" indent="up1"><enum>(D)</enum><text>to assist States with the development
				of Home Care Consumer Bills of Rights and Plans for Enforcement, to support the
				shift from institutional care to home and community-based long-term services
				and supports and ensure that home care consumers, as defined in section 736,
				have basic protections as outlined in subsections (b) and (c) of section
				705;</text>
						</subparagraph><subparagraph id="IDd2311fe685cc4e8d8a12944d5bfadb9e" indent="up1"><enum>(E)</enum><text>to develop a process for review and
				approval of States’ Home Care Consumer Bills of Rights and Plans for
				Enforcement, not later than 6 months after the date of enactment of the Home
				Care Consumer Bill of Rights Act; and</text>
						</subparagraph><subparagraph id="ID41352c9d9add4e5abacc412d6c0f81ea" indent="up1"><enum>(F)</enum><text>to review and approve States’ Home
				Care Consumer Bills of Rights and Plans for Enforcement through that
				process.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idC38689EE03034796B26DF8BABAE1E525"><enum>102.</enum><header>Additional
			 State plan requirements</header>
				<subsection id="idB9F1307E387F4BD3BCE155A8FDC3A9A9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 705 of the
			 Older Americans Act of 1965 (42 U.S.C. 3058d) is amended—</text>
					<paragraph id="id493B5BBB6BAC40E3B181741817A1C147"><enum>(1)</enum><text>in subsection
			 (a)—</text>
						<subparagraph id="idED2F0A0D7B4D4BEAAB40D717AF932D56"><enum>(A)</enum><text>in paragraph (6),
			 by striking <quote>and</quote> at the end;</text>
						</subparagraph><subparagraph id="id868196D6B2B041ED831AC201DAD2C67F"><enum>(B)</enum><text>in paragraph (7),
			 by striking the period and inserting <quote>; and</quote>; and</text>
						</subparagraph><subparagraph id="idF881637786684D5382E13C2928FFDE92"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id377F87C74E9C4D0AB1188F5576B334A0" style="OLC">
								<paragraph id="ID74b15bc7704449c48edfab641acaa60f"><enum>(8)</enum><text>subject to
				section 102(b) of the <short-title>Home Care Consumer Bill
				of Rights Act</short-title>, an assurance—</text>
									<subparagraph id="id5423D676FCD544DE85A921E3B2207026"><enum>(A)</enum><text>that the State
				has a Home Care Consumer Bill of Rights and a Plan for Enforcement of such a
				Bill, developed in accordance with the procedures described under paragraph (2)
				and as approved by the Assistant Secretary, and include a copy of the Bill and
				Plan; or</text>
									</subparagraph><subparagraph id="id4F5F58A4A2514BFA87BE409BB1C74FC2"><enum>(B)</enum><text>at the discretion
				of the Assistant Secretary, in the event the State does not have an approved
				Home Care Consumer Bill of Rights and Plan for Enforcement, that the State has
				an alternative such as a proposal for developing and submitting for approval a
				Home Care Consumer Bill of Rights and Plan for
				Enforcement.</text>
									</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="idF1B183FAC1074708AD92BF23428AD1AE"><enum>(2)</enum><text>by redesignating
			 subsection (b) as subsection (d);</text>
					</paragraph><paragraph id="idFFEEB694853F47E3B88B3749620BCF3A"><enum>(3)</enum><text>by inserting
			 after subsection (a) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id46693D483B864F2BA8048306F52C2042" style="OLC">
							<subsection id="id3C0CD9A99C5E40379D51C740C921A714"><enum>(b)</enum><header>Home Care
				Consumer Bill of Rights</header><text>The Home Care Consumer Bill of Rights
				referred to in subsection (a)(8) shall, at a minimum—</text>
								<paragraph id="ID31ccc985627348938fccb78d9af0dcd0"><enum>(1)</enum><text>address a home
				care consumer’s right to basic safety by—</text>
									<subparagraph id="ID613b214e43d04c05b68971a8310bd301"><enum>(A)</enum><text>affirming that
				home care consumers are protected from physical, sexual, mental, and verbal
				abuse, neglect, and exploitation, including financial exploitation;</text>
									</subparagraph><subparagraph id="ID5c9e6e494d59478d834930f7d85cf6c0"><enum>(B)</enum><text>affirming that
				home care consumers are served by providers who are properly trained and are
				providing home care services within their scope of practice and the scope of
				their certification or licensure (if such a certification or licensure is
				required by the applicable State);</text>
									</subparagraph><subparagraph id="IDf11c3fb0cb874e8caff7c46e9e651acf"><enum>(C)</enum><text>affirming that
				such providers maintain the confidentiality of all personal, financial, and
				medical information of home care consumers; and</text>
									</subparagraph><subparagraph id="IDfa66567fedfc4f54b7663924215f4bf0"><enum>(D)</enum><text>affirming that
				providers respect the personal property of home care consumers, and in the
				event of consumer reports of theft or loss, investigate and report back to the
				consumer the results of the investigation;</text>
									</subparagraph></paragraph><paragraph id="ID9ddebc9f5e4a46e0bfa7ce4f5b8d5143"><enum>(2)</enum><text>address a home
				care consumer’s right to access information by—</text>
									<subparagraph id="IDc2a2309e456f435094c58a29120f6381"><enum>(A)</enum><text>affirming that
				home care consumers are informed of their rights under this subsection and
				subsection (c) within 2 weeks after the start of home care services, and about
				the entities the consumers may contact if their rights are violated, including
				the name and contact information for State and local agencies responsible for
				enforcing the Home Care Consumer Bill of Rights;</text>
									</subparagraph><subparagraph id="ID3c602f13f5bf41d0bff4ee7ccd87e8a9"><enum>(B)</enum><text>affirming that
				home care consumers—</text>
										<clause id="id41ABB3A81B9D4EDB840822A85840E617"><enum>(i)</enum><text>are informed of
				the cost of home care services prior to receiving those services, whether the
				cost of those services are covered under health insurance, long-term care
				insurance, or other private and public programs, and any charges the consumer
				will be expected to pay; and</text>
										</clause><clause id="idA64437E1F6A6439E8C028CFBF3178140"><enum>(ii)</enum><text>are given
				advance notice of any changes to those costs or services; and</text>
										</clause></subparagraph><subparagraph id="IDa0d4599c7fdb49528f95c920c628cd70"><enum>(C)</enum><text>affirming that
				home care consumers have access to information about the availability of the
				home care services provided in the community involved and have the ability to
				choose among home care services and providers of home care services available
				in the community;</text>
									</subparagraph></paragraph><paragraph id="ID5e926410eaf840c3b071a26223c2b0df"><enum>(3)</enum><text>address a home
				care consumer’s right to choice, participation, and self-determination
				by—</text>
									<subparagraph id="ID2886cf719771435c8df730600b879f95"><enum>(A)</enum><text>affirming that
				home care consumers can participate in the planning of their home care
				services, including making choices about aspects of their care and services
				that are important to them, choosing providers and schedules to the extent
				practicable, receiving reasonable accommodation of their needs and preferences,
				and involving anyone they chose to participate with them in that
				planning;</text>
									</subparagraph><subparagraph id="ID745aa9e4966c4c04b1329c6cc167868b"><enum>(B)</enum><text>affirming that
				home care consumers are provided with sufficient information to make informed
				decisions, are fully informed in advance about any proposed changes in care and
				services, and are involved in the decisionmaking process regarding those
				changes; and</text>
									</subparagraph><subparagraph id="IDf99bcd3d529147c6a42d4d9ab7be574f"><enum>(C)</enum><text>affirming that
				home care consumers can refuse services and receive an explanation of the
				consequences of doing so;</text>
									</subparagraph></paragraph><paragraph id="ID8925644998304909bbe8717c19bb62bd"><enum>(4)</enum><text>address a home
				care consumer’s right to receive care and services provided in a way that
				promotes each consumer’s dignity and individuality;</text>
								</paragraph><paragraph id="IDe30af6b2189240d5b2bd1ce2855c4b8e"><enum>(5)</enum><text>address a home
				care consumer’s right to redress grievances by—</text>
									<subparagraph id="ID5bb0aecd59ab48ca96312ada451bc1ae"><enum>(A)</enum><text>affirming that
				home care consumers are able to voice grievances about the quality of their
				home care services, the number of hours of service, and violations of their
				rights, receive prompt responses to those concerns, and are informed about the
				entities the consumers may contact to state those grievances in order to have
				the grievances addressed in an appropriate and timely manner, and without
				retaliation; and</text>
									</subparagraph><subparagraph id="ID5d0f0d8313b34988b28cfc06f0edb411"><enum>(B)</enum><text>affirming that
				home care consumers are able to assert their rights under this subsection and
				subsection (c) without retaliation;</text>
									</subparagraph></paragraph><paragraph commented="no" id="idB27A2E702C2542D39D03F0516FDAD9A9"><enum>(6)</enum><text>address the role
				and responsibilities that fiduciaries may have in securing the rights of home
				care consumers affirmed under the Home Care Consumer Bill of Rights; and</text>
								</paragraph><paragraph id="ID3e6a2eb872e440e08ae1f18def2e3dc6"><enum>(7)</enum><text>meet any other
				guidelines determined to be appropriate by the Assistant Secretary.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id805F365081F5425C8655DF518E33234E"><enum>(c)</enum><header display-inline="yes-display-inline">Plan for enforcement</header><text display-inline="yes-display-inline">In developing the Plan for Enforcement
				referred to in subsection (a)(8), the State shall take into account the best
				practices established under section 201(e)(2)(C). The Plan shall include a
				description of how State entities with a role in protecting older individuals,
				such as home care services licensing agencies, adult protective services
				agencies, the Office of the State Long-Term Care Ombudsman (if the office has
				jurisdiction over home and community-based long-term care), local law
				enforcement agencies, and other entities determined to be appropriate by the
				Assistant Secretary, will coordinate activities to enforce the Home Care
				Consumer Bill of Rights.</text>
							</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="idA0A8E3E5E6C047BC9DEDFF47A3FBB52D"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id331F27EE687844C1935C46B8B94B8ECC" style="OLC">
							<subsection id="id2213C3D10A594B1C889E1E20867D498C"><enum>(e)</enum><header>Definition</header><text>In
				this section, the term <term>home care consumer</term> and <term>home care
				services</term> have the meanings given the terms in section
				736.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="id52BAC38DDD3346628AF74A57C1B72CFB"><enum>(b)</enum><header>Application of
			 requirement To submit State home care consumer bill of rights and plan for
			 enforcement</header>
					<paragraph commented="no" id="id83DE26EF0F2A40BA8129F833A46398DC"><enum>(1)</enum><header>In
			 general</header><text>The requirement for a State to provide an assurance, and
			 either a Home Care Consumer Bill of Rights and a Plan for Enforcement of such
			 Bill or an alternative, under paragraph (8) of section 705(a) of the Older
			 Americans Act of 1965 (as added by subsection (a)) shall apply to States
			 beginning on the date (referred to in this subsection as the <term>application
			 date</term>) that is 1 year after the date of the establishment of best
			 practices under section 201(e)(2)(C) of such Act (as added by section
			 101).</text>
					</paragraph><paragraph commented="no" id="idBA4AC9EA48114484B342180528910908"><enum>(2)</enum><header>First
			 submission after application date</header><text>A State shall comply with
			 paragraph (8) of section 705(a) of the Older Americans Act of 1965 (as added by
			 subsection (a)) in whichever of the following 2 submissions occurs first with
			 respect to such State after the application date described under paragraph
			 (1):</text>
						<subparagraph commented="no" id="id702E8A88CD0343C980D91A6099A4EA5E"><enum>(A)</enum><text>The submission of
			 a new State plan under section 307 of the Older Americans Act of 1965 (42
			 U.S.C. 3027).</text>
						</subparagraph><subparagraph commented="no" id="id69000DA5F67B45E892EEBEC8089F4257"><enum>(B)</enum><text>The submission of
			 an annual revision to a State plan submitted under such section 307.</text>
						</subparagraph></paragraph><paragraph commented="no" id="id2C0BC3191D504F4CB78FB362027B2FB1"><enum>(3)</enum><header>Ongoing
			 submissions</header><text>After complying with paragraph (8) of section 705(a)
			 of the Older Americans Act of 1965 (as added by subsection (a)) in a submission
			 in accordance with paragraph (2) of this subsection, a State shall comply with
			 such paragraph (8) in each new State plan submitted under section 307 of the
			 Older Americans Act of 1965 (42 U.S.C. 3027).</text>
					</paragraph></subsection></section><section id="idD611E1B0EF57410DA74EB950DB36383E"><enum>103.</enum><header>Prevention of
			 elder abuse, neglect, and exploitation</header><text display-inline="no-display-inline">Section 721(b) of the Older Americans Act of
			 1965 (42 U.S.C. 3058i(b)) is amended—</text>
				<paragraph id="id705077B66130414CA50F01B4E3BC389D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (11), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id1A1A43A67D44425D9CF693E1A4A627CD"><enum>(2)</enum><text>in paragraph
			 (12), by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="id18B49B800764455BADCDE41F109E0042"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6B2B7D4FCA864B949A23C487848113E3" style="OLC">
						<paragraph id="IDb0beea9d03444aec8896137add2a6ddd"><enum>(13)</enum><text>developing a
				State Home Care Consumer Bill of Rights and Plan for Enforcement (as described
				in section 705) to protect home care consumers (as defined in section 736) from
				abuse, neglect, and
				exploitation.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idE9B2CEF598F3447284009815366B224C"><enum>104.</enum><header>National adult
			 protective services resource center</header><text display-inline="no-display-inline">Section 201 of the Older Americans Act of
			 1965 (42 U.S.C. 3011) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7134B6F81D1F44259BB0AE590987598F" style="OLC">
					<subsection id="id94AAC6BABE5F4DE6AA06EC860D825662"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idAE5BAD55BD0E45829723A999A56D67DD"><enum>(1)</enum><text display-inline="yes-display-inline">The Assistant Secretary shall, by grant or
				contract with a national nonprofit entity, establish a National Adult
				Protective Services Resource Center (referred to in this subsection as the
				<term>Center</term>). The purposes of the Center are to improve the capacity of
				State and local adult protective services programs to respond effectively to
				abuse, neglect, and exploitation of vulnerable adults, including home care
				consumers and residents of long-term care facilities, and to coordinate with
				the Home Care Ombudsman Program and Long-Term Care Ombudsman Program to protect
				home care consumers and residents most effectively.</text>
						</paragraph><paragraph id="idDED9B45E4C764F77930F4F24A38973B0" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The nonprofit entity awarded a grant or
				contract under this subsection shall have expertise in, and representation by,
				State and local adult protective services programs.</text>
						</paragraph><paragraph id="id110065E119E546C3B30D3A02172A2A2F" indent="up1"><enum>(3)</enum><text>The Center shall—</text>
							<subparagraph id="idA3956F9F3F0A45DAB05898D52806524F"><enum>(A)</enum><text>collect and disseminate information
				regarding, and increase public awareness of, the role of adult protective
				services programs in investigating the abuse, neglect (including self-neglect),
				and exploitation of vulnerable adults, including home care consumers and
				residents of long-term care facilities, and in intervening to protect the
				consumers and residents from abuse;</text>
							</subparagraph><subparagraph id="id88B9D9059FEA47C0BAD921ECC1DABF95"><enum>(B)</enum><text>develop, distribute, and provide
				training and technical assistance for adult protective services program
				investigators and supervisors investigating the abuse, neglect (including
				self-neglect), and exploitation of vulnerable adults, including home care
				consumers and residents of long-term care facilities, and intervening to
				protect the consumers and residents from further abuse;</text>
							</subparagraph><subparagraph id="id740CD8F3FD954AC19EE4A6B9EC13BA4B"><enum>(C)</enum><text>develop, distribute, and provide
				training to home care and long-term care professionals and others on
				recognizing, reporting (including regarding mandatory reporting requirements),
				and responding to the abuse, neglect (including self-neglect), and financial
				exploitation of vulnerable adults, including home care consumers and residents
				of long-term care facilities;</text>
							</subparagraph><subparagraph id="idB9FC4E71F1CE4D589D7D10B1F5048705"><enum>(D)</enum><text>compile and disseminate reports on
				research and best practices for adult protective services programs and other
				programs on effective responses to the abuse, neglect (including self-neglect),
				and exploitation of vulnerable adults, including home care consumers and
				residents of long-term care facilities;</text>
							</subparagraph><subparagraph id="idE90B513AD127463CB3E40F097B69525E"><enum>(E)</enum><text>work with the National Ombudsman
				Resource Center and State and local home care ombudsman programs and long-term
				care ombudsman programs to develop and disseminate training, practice
				standards, and policies regarding—</text>
								<clause id="idAC7F5C4B1A124664BA3567FBD14244A5"><enum>(i)</enum><text>the roles and responsibilities of
				adult protective services and ombudsman programs;</text>
								</clause><clause id="id4DF74341FC6A47B7BA6D4602C56A0BB5"><enum>(ii)</enum><text>confidentiality and abuse
				reporting issues and protocols; and</text>
								</clause><clause id="id124127B48AB24979B3A6D8854DA21710"><enum>(iii)</enum><text>effective ways to maximize the
				resources of adult protective services programs for the benefit of home care
				consumers and residents of long-term care facilities; and</text>
								</clause></subparagraph><subparagraph id="idE918CA52D6B846F4B49B6DFAF8E19649"><enum>(F)</enum><text>establish a data system to collect
				information on the abuse, neglect (including self-neglect), and exploitation of
				home care consumers and residents of long-term care facilities and to measure
				the effectiveness of the activities carried out by the Center.</text>
							</subparagraph></paragraph><paragraph id="id88AA3EFAC8CC4A47AE177EE10659A0F9" indent="up1"><enum>(4)</enum><text>In this subsection, the terms
				<term>home care consumer</term> and <term>home care ombudsman program</term>
				have the meanings given the terms in section
				736.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="id816A8B24B0524550AAC8BEA184C5D25F"><enum>II</enum><header>State home care
			 ombudsman programs</header>
			<section id="id3A752182415840069F79A6BB27209698" section-type="subsequent-section"><enum>201.</enum><header>Program</header><text display-inline="no-display-inline">Section 701 of the Older Americans Act of
			 1965 (42 U.S.C. 3058) is amended by inserting <quote>and grants</quote> after
			 <quote>allotments</quote>.</text>
			</section><section id="id542940C0EA4C4FCC8BAD82860813B27B"><enum>202.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">Chapter 1 of
			 subtitle A of title VII of the Older Americans Act of 1965 is amended by
			 inserting after section 702 (42 U.S.C. 3058a) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9FC1BCBE7AF04DB5BDE4707D352C1051" style="OLC">
					<section id="id5CBAE35C6FDF44E0ACC878CF150EB6D1"><enum>702A.</enum><header>Authorization
				of appropriations for State home care ombudsman program</header><text display-inline="no-display-inline">There are authorized to be appropriated to
				carry out chapter 5 such sums as may be necessary for fiscal year 2012 and each
				subsequent fiscal
				year.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idA4EF72E9031C460886F4868C4B2D37F9"><enum>203.</enum><header>Grants</header><text display-inline="no-display-inline">Section 703 of the Older Americans Act of
			 1965 (42 U.S.C. 3058b) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id589D3A34248C4691A62DA35B1917B53F" style="OLC">
					<subsection id="ID07b87f142b1e44e4aa6f201880d29758"><enum>(d)</enum><header>Grants for
				State home care ombudsman programs</header>
						<paragraph id="idDF033490B5B2460299D8B81081E98C2D"><enum>(1)</enum><header>In
				general</header><text>The Assistant Secretary shall use funds made available
				under section 702A to award grants, on a competitive basis, to States for State
				Home Care Ombudsman Programs.</text>
						</paragraph><paragraph id="id9EF46973AFC74EA0A8E9CE9F9D855E1F"><enum>(2)</enum><header>Considerations</header><text>In
				selecting States to receive the grants, the Assistant Secretary shall
				consider—</text>
							<subparagraph id="IDc4c6824771fd41fe95805bd91c9caa52"><enum>(A)</enum><text>a State’s current
				financial support (as of the date of consideration) for home care ombudsman
				services;</text>
							</subparagraph><subparagraph id="IDd765be8e8cc340099796e38f01a45215"><enum>(B)</enum><text>a State’s
				commitment to preventing conflict of interest between providers of home care
				services and providers of home care ombudsman services; and</text>
							</subparagraph><subparagraph id="ID3d93b2e6d68d48eca30fa440c4ebe9dc"><enum>(C)</enum><text>other criteria
				determined by the Assistant Secretary.</text>
							</subparagraph></paragraph><paragraph id="idBDC160019F064BADBC3FA8BA90347D4E"><enum>(3)</enum><header>Priorities</header><text>In
				selecting States to receive the grants, the Assistant Secretary may give first
				priority to States that are providing home care ombudsman services to home care
				consumers on the date of enactment of section 737, and seek to enhance the home
				care ombudsman programs through which the States provide the
				services.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idF229B5C33DB04CE1BDD60AD9B1B4A34B"><enum>204.</enum><header>Eligibility</header>
				<subsection id="idC3F0AC18AF8F4CE0ABD7A9B783262C96"><enum>(a)</enum><header>Organization</header><text>Section
			 704 of the Older Americans Act of 1965 (42 U.S.C. 3058c) is amended, in the
			 matter preceding paragraph (1), by inserting <quote>or grants</quote> after
			 <quote>allotments</quote>.</text>
				</subsection><subsection id="idF3430272C18A464CB2CFF146D0FE2BAC"><enum>(b)</enum><header>Additional
			 requirements</header><text>Section 705(a) of the Older Americans Act of 1965
			 (42 U.S.C. 3058d(a)) is amended—</text>
					<paragraph id="id295E52C3247141998EF10024B48F2CF8"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1), by inserting <quote>or grant</quote> after

					</paragraph></subsection></section><section id="id9CCA59CEA68941A5A20C0368226C8D83"><enum>205.</enum><header>State Home
			 Care Ombudsman Programs</header><text display-inline="no-display-inline">Subtitle A of title VII of the Older
			 Americans Act of 1965 (42 U.S.C. 3058 et seq.) is amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5ED9E4B6B79045DDA3E9322D7FC68DB5" style="OLC">
					<chapter id="id59E952ECD53242EE80BD612D3035C598"><enum>5</enum><header>State Home Care
				Ombudsman Programs</header>
						<section id="idB7DBDAAEC24C4355A3869285D8A820B6"><enum>736.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text>
							<paragraph id="id1520E38702334AA0AADCB2A2D29AF624"><enum>(1)</enum><header>Home care
				consumer</header><text>The term <term>home care consumer</term> means a person
				who receives services in the person’s home or community to promote independence
				and reduce the necessity for residence in a long-term care facility, which may
				include—</text>
								<subparagraph id="idB0F2B387B25B4C488587318C31CCCD96"><enum>(A)</enum><text>home care
				services provided through this Act, the Medicare program under title XVIII of
				the Social Security Act (42 U.S.C. 1395 et seq.), the Medicaid program under
				title XIX of the Social Security Act (42 U.S.C. 1396 et seq.), or another
				public or private funding source; or</text>
								</subparagraph><subparagraph id="id7C7F5BE84D9E4AD2A7F30909414BF3B9"><enum>(B)</enum><text>home care
				services determined to be appropriate by a State operating a State Home Care
				Ombudsman Program.</text>
								</subparagraph></paragraph><paragraph id="id2F26B58DCB78445BAE6668593E826D1E"><enum>(2)</enum><header>Home care
				ombudsman program</header><text>The term <term>home care ombudsman
				program</term> means a State Home Care Ombudsman Program described in section
				737(a)(1).</text>
							</paragraph><paragraph id="idEEF5A34348884EFD897201A3652D1B7F"><enum>(3)</enum><header>Home care
				ombudsman representative</header><text>The term <term>home care ombudsman
				representative</term> includes an employee or volunteer who represents an
				entity designated under section 737(a)(5)(A) and who is individually designated
				by the Ombudsman.</text>
							</paragraph><paragraph id="id34BFA776356D4EA3B49D3A2AAA40C270"><enum>(4)</enum><header>Home care
				services</header><text>The term <term>home care services</term> means home and
				community-based services to promote independence and reduce the necessity for
				residence in a long-term care facility, including personal care services
				designed to assist an individual in the activities of daily living such as
				bathing, exercising, personal grooming, and getting in and out of bed.</text>
							</paragraph><paragraph id="id0BB57A7F82014835BCC3421B51ED41D9"><enum>(5)</enum><header>Local home care
				Ombudsman entity</header><text>The term <term>local home care Ombudsman
				entity</term> means an entity designated under section 737(a)(5)(A) to carry
				out the duties described in section 737(a)(5)(B) with respect to a planning and
				service area or other substate area.</text>
							</paragraph><paragraph id="id85C7DF38350F4FDBB92465E6A86918B1"><enum>(6)</enum><header>Office;
				Ombudsman</header><text>The terms <term>Office</term> and
				<term>Ombudsman</term>, used without further modification, have the meanings
				given the terms in section 711.</text>
							</paragraph></section><section id="id9B5515D53F0B46FC8BC89C3581843C24"><enum>737.</enum><header>Program</header>
							<subsection id="ID954df68f70e445b5bd6b0a772a7dc2e6"><enum>(a)</enum><header>Establishment</header>
								<paragraph id="IDd016bfee07a0483d974c494534544353"><enum>(1)</enum><header>In
				general</header><text>In order to be eligible to receive a grant under section
				703(d) from funds appropriated under section 702A and made available to carry
				out this chapter, a State agency shall, in accordance with this section, agree
				to carry out a State Home Care Ombudsman Program within the Office of the State
				Long-Term Care Ombudsman.</text>
								</paragraph><paragraph id="IDa3a3942be61041888a42fa911e5fdf4f"><enum>(2)</enum><header>Home care
				ombudsman program</header><text>The home care ombudsman program shall be
				carried out by the Ombudsman.</text>
								</paragraph><paragraph id="IDedf29c89f24f454ea8ca6db099e5ee8b"><enum>(3)</enum><header>Functions</header><text>In
				carrying out the home care ombudsman program, the Ombudsman, personally or
				through representatives of the home care ombudsman program—</text>
									<subparagraph id="id22088069E77540849ED40F9DC2757F6C"><enum>(A)</enum><text>shall identify,
				investigate, and resolve complaints that—</text>
										<clause id="ID618d6bbd1340464ab334097d10f1296d"><enum>(i)</enum><text>are made by, or
				on behalf of, home care consumers;</text>
										</clause><clause id="ID3667b9a0dece434a83d7bed7896221f1"><enum>(ii)</enum><text>relate to
				action, inaction, or decisions, that may adversely affect the health, safety,
				welfare, or rights of home care consumers (including the welfare and rights of
				home care consumers with respect to the appointment and activities of guardians
				and representative payees), of—</text>
											<subclause id="ID2d0a6f729aeb4989b62c1f15f4b47c2b"><enum>(I)</enum><text>entities
				responsible for determining eligibility for home care services, such as State
				and local governments; and</text>
											</subclause><subclause id="ID90553343e72e4563836f12ed3149fb4c"><enum>(II)</enum><text>entities
				responsible for determining availability of home care services, such as managed
				care organizations; or</text>
											</subclause></clause><clause id="ID4efb40394fe7468b93b84e4dc37000db"><enum>(iii)</enum><text>relate to
				action, inaction, or decisions, regarding informing home care consumers about
				their eligibility for, or the availability of, home care services, of—</text>
											<subclause id="ID16c6059aed3348e0b1f3d4b137665f3d"><enum>(I)</enum><text>providers, or
				representatives of providers, of home care services;</text>
											</subclause><subclause id="ID36c715092f314dd385f2be83c4b0a895"><enum>(II)</enum><text>public
				agencies;</text>
											</subclause><subclause id="IDcccbfef24c8e4a628fb149d5f544dd59"><enum>(III)</enum><text>health and
				social service agencies; and</text>
											</subclause><subclause id="ID9bea92b21e7a44308ec58e6b82080e7d"><enum>(IV)</enum><text>entities
				providing consumer-directed services under a consumer-directed program;</text>
											</subclause></clause></subparagraph><subparagraph id="IDc4ac3590ea0d4dc5bc668c673fc1ee11"><enum>(B)</enum><text>shall provide
				services to protect the health, safety, welfare, and rights of home care
				consumers;</text>
									</subparagraph><subparagraph id="ID02ef12aef6794ba281156a52cb0ba0a4"><enum>(C)</enum><text>shall inform home
				care consumers about means of obtaining services provided by providers or
				agencies described in subparagraph (A)(ii) or services described in
				subparagraph (B);</text>
									</subparagraph><subparagraph id="id6D0C61CDF2E1493F89F96F01A13AA086"><enum>(D)</enum><text>shall, in
				conjunction with other entities, such as area agencies on aging, conduct public
				education about the home care ombudsman program and its services, including the
				rights of home care workers to report concerns to the ombudsman in order to
				protect the health, safety, welfare, and rights of home care consumers;</text>
									</subparagraph><subparagraph id="IDbb1824f4d8764251a58fad7427febaf8"><enum>(E)</enum><text>shall ensure that
				home care consumers and complainants receive timely responses from
				representatives of the home care ombudsman program to complaints;</text>
									</subparagraph><subparagraph id="IDe19ca430455b4332bf2e84ba3b4c91c1"><enum>(F)</enum><text>shall represent
				the interests of home care consumers before governmental agencies and seek
				administrative, legal, and other remedies to protect the health, safety,
				welfare, and rights of the home care consumers, including issues related to the
				sufficiency of the home care workforce and its availability to meet the needs
				of home care consumers;</text>
									</subparagraph><subparagraph id="IDd858ecad2b6e4bf3833c2cb1dcd15f09"><enum>(G)</enum><text>shall provide
				administrative and technical assistance to entities designated under paragraph
				(5) to assist the entities in participating in the home care ombudsman
				program;</text>
									</subparagraph><subparagraph id="ID8b881200befb43a9a183ccd6d025faf1"><enum>(H)</enum><text>shall provide for
				training representatives of the home care ombudsman program;</text>
									</subparagraph><subparagraph id="ID1a37390eeba740b09db4f7f87deeb9f2"><enum>(I)</enum><text>shall—</text>
										<clause id="id43D0CBD950AC4947880A1CEDB468AA1F"><enum>(i)</enum><text>promote the
				development of citizen organizations, to participate in the home care ombudsman
				program;</text>
										</clause><clause id="ID189ae185414545928254d3f1d0b4ce9b"><enum>(ii)</enum><text>analyze, comment
				on, and monitor the development and implementation of Federal, State, and local
				laws, regulations, and other governmental policies and actions, that pertain to
				the health, safety, welfare, and rights of home care consumers, with respect to
				the adequacy of home care services in the State, including issues related to
				the sufficiency of the home care workforce and its availability to meet the
				needs of home care consumers;</text>
										</clause><clause id="ID7bb999390c38490c9b29bc636cdfafb0"><enum>(iii)</enum><text>recommend any
				changes in such laws, regulations, policies, and actions as the Ombudsman
				determines to be appropriate; and</text>
										</clause><clause id="ID2783fc1c7d9a47bd9de7bce0d8a3d411"><enum>(iv)</enum><text>facilitate
				public comment on the laws, regulations, policies, and actions; and</text>
										</clause></subparagraph><subparagraph id="ID971d9ba6d1df4440aa6592c1fe312be8"><enum>(J)</enum><text>shall carry out
				other activities as the Assistant Secretary determines to be
				appropriate.</text>
									</subparagraph></paragraph><paragraph id="ID428f25ecbf5a475da2a32312e2b24b2a"><enum>(4)</enum><header>Contracts and
				arrangements</header>
									<subparagraph id="ID990af27fd354435397fd4b46188953df"><enum>(A)</enum><header>In
				general</header>
										<clause id="id5E87F5BD64244C309C21127752C783F3"><enum>(i)</enum><header>Agencies and
				organizations</header><text>Except as provided in subparagraph (B), the State
				agency shall carry out the home care ombudsman program, directly, or by
				contract or other arrangement with any public agency or nonprofit private
				organization.</text>
										</clause><clause id="id2B50541B72514BC494A18BB9814DD970"><enum>(ii)</enum><header>Area agencies
				on aging</header><text>The State agency shall determine whether to enter into
				contracts or arrangements with area agencies on aging to carry out the home
				care ombudsman program, based on the structure of the State's existing (as of
				the date of the determination) long-term care ombudsman program and the
				potential for conflicts of interest in the home and community-based services
				system in the State. A State agency may carry out a home care ombudsman program
				through area agencies on aging in the State, if the area agencies on
				aging—</text>
											<subclause id="IDabeff24a1ed744a891ac1ccd7f69c029"><enum>(I)</enum><text>have existing (as
				of the date of the determination) consumer protection systems in place to
				prevent such conflicts of interest; or</text>
											</subclause><subclause id="ID11a94bd46cf94df5a0286269474e1ec2"><enum>(II)</enum><text>establish
				adequate procedures to prevent conflicts of interest under the program.</text>
											</subclause></clause></subparagraph><subparagraph id="IDaac6a6dc867442eda92e70e42a1b713e"><enum>(B)</enum><header>Licensing and
				certification organizations; associations</header><text>The State agency may
				not enter into the contract or other arrangement described in subparagraph (A)
				with—</text>
										<clause id="ID1262736ef9f647e9909bbb786ea0d6df"><enum>(i)</enum><text>an agency or
				organization that is responsible for licensing or certifying home care services
				in the State; or</text>
										</clause><clause id="ID0534a6d3fc444a3984d1a5274d81709d"><enum>(ii)</enum><text>an association
				(or an affiliate of such an association) of providers of home care
				services.</text>
										</clause></subparagraph></paragraph><paragraph id="IDf4f2adcddce7440e9c7b2b096f02fb35"><enum>(5)</enum><header>Designation of
				local home care ombudsman entities and home care ombudsman
				representatives</header>
									<subparagraph id="ID0018447db39f40898ccda617d74eeeec"><enum>(A)</enum><header>Designation</header><text>In
				carrying out the duties of the Office, the Ombudsman may designate an entity as
				a local home care Ombudsman entity (and, in doing so, the Ombudsman shall, if a
				local Ombudsman entity has already been designated, designate such local
				Ombudsman entity as the local home care Ombudsman entity), and may designate an
				employee or volunteer to represent the entity.</text>
									</subparagraph><subparagraph id="ID19fdb7e4514147008ce06ed1521f07da"><enum>(B)</enum><header>Duties</header><text>An
				individual so designated, in accordance with the policies and procedures
				established by the Ombudsman and the State agency—</text>
										<clause id="ID6abcc1e0e8f147f3999ed0f1c103ff46"><enum>(i)</enum><text>shall provide
				services to protect the health, safety, welfare, and rights of home care
				consumers;</text>
										</clause><clause id="IDe17f22f786c04dbda8be0fdfea3449c9"><enum>(ii)</enum><text>shall ensure
				that home care consumers in the service area of the entity have timely
				responses to complaints and requests for assistance;</text>
										</clause><clause id="ID09cdc2067aad4979864324a0e39da2ea"><enum>(iii)</enum><text>shall identify,
				investigate, and resolve complaints made by or on behalf of home care consumers
				that relate to action, inaction, or decisions, that may adversely affect the
				health, safety, welfare, or rights of home care consumers;</text>
										</clause><clause id="IDaf4353503b834317bc8fba3655ade0f8"><enum>(iv)</enum><text>shall represent
				the interests of home care consumers before government agencies and seek
				administrative, legal, and other remedies to protect the health, safety,
				welfare, and rights of home care consumers;</text>
										</clause><clause id="ID7ac7350bcfc44fa8beb7e665ee178864"><enum>(v)</enum><text>shall—</text>
											<subclause id="ID4c676756bb2040408b650ce75e0c250d"><enum>(I)</enum><text>review, and if
				necessary, comment on any existing and proposed laws, regulations, and other
				government policies and actions, that pertain to the rights and well-being of
				home care consumers; and</text>
											</subclause><subclause id="ID7f4d9bdaa6254cbfbcb9c1382498cc70"><enum>(II)</enum><text>facilitate the
				ability of the public to comment on the laws, regulations, policies, and
				actions; and</text>
											</subclause></clause><clause id="idF2BFCE93BC754B2193BBE40B8504738D"><enum>(vi)</enum><text>shall make
				referrals for services to protect and provide for the health, safety,
				educational needs, welfare, and rights of family or household members
				(including children) of home care consumers; and</text>
										</clause><clause id="ID3f13b7c6bdd64045a27c3a103ad27d98"><enum>(vii)</enum><text>shall carry out
				other activities that the Ombudsman determines to be appropriate.</text>
										</clause></subparagraph><subparagraph id="ID593f9f1908c44f37a19a9ed677374300"><enum>(C)</enum><header>Eligibility for
				designation</header><text>Entities eligible to be designated as local home care
				Ombudsman entities, and individuals eligible to be designated as home care
				ombudsman representatives of such entities, shall—</text>
										<clause id="ID5799573468c34be7b4bcc82f0b2c2b2c"><enum>(i)</enum><text>have demonstrated
				capability to carry out the duties established in section 712(a)(5)(B);</text>
										</clause><clause id="ID933dbf1d3bdb460887fda45293c51a1f"><enum>(ii)</enum><text>be free of
				conflicts of interest and not stand to gain financially through an action or
				potential action brought on behalf of individuals the Ombudsman serves;
				and</text>
										</clause><clause id="ID8187186396be45b1af170f77864de3ec"><enum>(iii)</enum><text>meet such
				additional requirements as the Ombudsman may specify.</text>
										</clause></subparagraph><subparagraph id="ID4fc1bbffbd41438f8cf74154849c2858"><enum>(D)</enum><header>Policies and
				procedures</header>
										<clause id="ID0b11c490bdb34810a9dec61158d73a0c"><enum>(i)</enum><header>In
				general</header><text>The State agency shall establish, in accordance with the
				Ombudsman, policies and procedures for monitoring local home care Ombudsman
				entities designated to carry out the duties established in section
				712(a)(5)(B).</text>
										</clause><clause id="IDf75af1416f13483a88b13fa3edf5a9ef"><enum>(ii)</enum><header>Policies</header><text>In
				a case in which the entities are grantees or the home care ombudsman
				representatives are employees, of area agencies on aging, the State agency
				shall develop the policies in consultation with the area agencies on aging. The
				policies shall provide for participation and comment by the agencies and for
				resolution of concerns with respect to case activity.</text>
										</clause><clause id="ID3c46ff9482704105947a35e17952b750"><enum>(iii)</enum><header>Confidentiality
				and disclosure</header><text>The State agency shall develop the policies and
				procedures in accordance with all provisions of this subtitle regarding
				confidentiality and conflict of interest for providers of home care
				services.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="IDf462057917834b04a88ab23fb8b02d87"><enum>(b)</enum><header>Procedures for
				access</header>
								<paragraph id="IDb515e01bda2c4aa38157b1615e279e60"><enum>(1)</enum><header>In
				general</header><text>The State shall ensure that representatives of the home
				care ombudsman program shall have—</text>
									<subparagraph id="ID59a93c03bedb4a0d95a2c06147c5528f"><enum>(A)</enum><text>access to home
				care consumers and their homes with permission of the home care consumer
				involved or a legal representative;</text>
									</subparagraph><subparagraph id="ID560c303eb50f45eaa0cc1798fe7d2a56"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id51BF3EFF85C94707819641D8C4909E66"><enum>(i)</enum><text>appropriate access to
				review all records of a home care consumer, if—</text>
											<subclause id="ID3cf6162b6a8a4513a4e63c1438fe19d0" indent="up1"><enum>(I)</enum><text>the representative of the home care
				ombudsman program has the permission of the home care consumer, or the legal
				representative of the home care consumer; or</text>
											</subclause><subclause id="IDac5459d097a94826a0deefb9eeaafcd9" indent="up1"><enum>(II)</enum><text>the home care consumer is unable to
				consent to the review and has no legal representative; or</text>
											</subclause></clause><clause id="ID854cb417ea0947b491c68ca48162a1c9" indent="up1"><enum>(ii)</enum><text>such access to the records as is
				necessary to investigate a complaint if—</text>
											<subclause id="ID070951c231324829a6f965cbdbf72f8e"><enum>(I)</enum><text>a legal guardian of the home care
				consumer refuses to give the permission;</text>
											</subclause><subclause id="ID7055a8cefe59440fac80f8572f462b97"><enum>(II)</enum><text>a representative of the home care
				ombudsman program has reasonable cause to believe that the guardian is not
				acting in the best interests of the home care consumer; and</text>
											</subclause><subclause id="IDe48e228fab954a00a26a03ac4b7308b4"><enum>(III)</enum><text>the representative obtains the approval
				of the Ombudsman;</text>
											</subclause></clause></subparagraph><subparagraph id="ID73237a94d2b84d76a1e6e8546c7f111b"><enum>(C)</enum><text>access to the
				administrative records, policies, and documents, to which home care consumers
				have, or the general public has access, of the provider of home care services;
				and</text>
									</subparagraph><subparagraph id="IDe258d180ed6b4968810b43889551fd15"><enum>(D)</enum><text>access to and, on
				request, copies of all licensing and certification records maintained by the
				State with respect to the provider of home care services.</text>
									</subparagraph></paragraph><paragraph id="ID6c7789b2f5f642b2b95d9d6198ccf182"><enum>(2)</enum><header>Procedures</header><text>The
				State agency shall establish procedures to ensure the access described in
				paragraph (1).</text>
								</paragraph></subsection><subsection id="IDb3ad267802c04689b991787de8f72f16"><enum>(c)</enum><header>Reporting
				system</header><text>The State agency shall ensure that the reporting system
				established in section 712(c) is equipped to—</text>
								<paragraph id="ID8f58a5c1b1434bfe91decece3df964ba"><enum>(1)</enum><text>collect and
				analyze data relating to complaints and conditions concerning home care
				services and to home care consumers for the purpose of identifying and
				resolving significant problems, including complaints concerning—</text>
									<subparagraph id="ID734f7ac0ba46410aa04d483f4f8b33e5"><enum>(A)</enum><text>quality of
				services;</text>
									</subparagraph><subparagraph id="ID9f4c43de5be64fbe8f8b55599e4e302a"><enum>(B)</enum><text>quantity of
				services;</text>
									</subparagraph><subparagraph id="ID4c82eb909df3444a8f2f8c18899b92ad"><enum>(C)</enum><text>availability of
				services; and</text>
									</subparagraph><subparagraph id="IDba2e43d276aa49fdab94cf08bee0fafe"><enum>(D)</enum><text>denial,
				reduction, and termination of services; and</text>
									</subparagraph></paragraph><paragraph id="ID0bf21258c16f49ce9cf86da0235788e1"><enum>(2)</enum><text>submit the data,
				on a regular basis, to—</text>
									<subparagraph id="IDf99c177791434f5bbae534ba7191be68"><enum>(A)</enum><text>the agency of the
				State responsible for licensing or certifying providers of home care services
				in the State;</text>
									</subparagraph><subparagraph id="ID07cdb2bf136a4b7384fcb325dcccd68f"><enum>(B)</enum><text>other State and
				Federal entities that the Ombudsman determines to be appropriate;</text>
									</subparagraph><subparagraph id="ID4332f4b0a3584fc59905c644fb8aa4ba"><enum>(C)</enum><text>the Assistant
				Secretary; and</text>
									</subparagraph><subparagraph id="ID5dd1b34326d54a939231db57f408b3e6"><enum>(D)</enum><text>the National
				Ombudsman Resource Center established in section 202(a)(18)(A).</text>
									</subparagraph></paragraph></subsection><subsection id="IDd53496ddc28144f6b8cc573fb3dcfd95"><enum>(d)</enum><header>Disclosure</header>
								<paragraph id="ID83923352bb7d48b5890caa9c87adebbf"><enum>(1)</enum><header>In
				general</header><text>The State agency shall establish procedures for the
				disclosure by the Ombudsman or local home care Ombudsman entities of files
				maintained by the home care ombudsman program, including records described in
				subsection (b)(1) or (c).</text>
								</paragraph><paragraph id="ID226b818c82d14625a49b1c2f66872174"><enum>(2)</enum><header>Identity of
				complainant or home care consumer</header><text>The procedures described in
				paragraph (1) shall—</text>
									<subparagraph id="ID80c321b041e44205880cde13a5992cca"><enum>(A)</enum><text>provide that,
				subject to subparagraph (B), the files and records described in paragraph (1)
				may be disclosed only at the discretion of the Ombudsman (or the person
				designated by the Ombudsman to disclose the files and records); and</text>
									</subparagraph><subparagraph id="ID867de0f8cc5848b18fd643708cfe3730"><enum>(B)</enum><text>prohibit the
				disclosure of the identity of any complainant or home care consumer with
				respect to whom the Office maintains such files or records unless—</text>
										<clause id="ID13b179f9fe774849afb6c8e27f2cda0a"><enum>(i)</enum><text>the complainant
				or home care consumer, or the legal representative of the complainant or home
				care consumer, consents to the disclosure and the consent is given in
				writing;</text>
										</clause><clause id="IDee9ea943c92d4f8aa1ca939455c39f98"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id514BEEDA04B64186946607DC23D1B78F"><enum>(I)</enum><text>the complainant or home
				care consumer gives consent orally; and</text>
											</subclause><subclause id="IDad21530f0fa842208317e3a2d7186e9d" indent="up1"><enum>(II)</enum><text>the consent is documented
				contemporaneously in a writing made by a representative of the home care
				ombudsman program in accordance with such requirements as the State agency
				shall establish; or</text>
											</subclause></clause><clause id="ID259af784e442458fbdc0cfbd65fd368f"><enum>(iii)</enum><text>the disclosure
				is required by court order.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID3a87a706e3c74d519c9c607f831e361c"><enum>(e)</enum><header>Consultation</header><text>In
				planning and carrying out the home care ombudsman program, the State agency
				shall consider the views of area agencies on aging, older individuals, and
				providers of home care services and demonstrate how the State agency has taken
				their views into consideration.</text>
							</subsection><subsection id="ID648a4cca633b4e508802a9920f43fe33"><enum>(f)</enum><header>Conflict of
				interest</header><text>The State agency shall—</text>
								<paragraph id="IDbf89a016700e4d88b5fcd67a26c8031b"><enum>(1)</enum><text>ensure that no
				individual, or member of the immediate family of an individual, involved in the
				designation of the Ombudsman (whether by appointment or otherwise) or the
				designation of an entity designated under subsection (a)(5), is subject to a
				conflict of interest;</text>
								</paragraph><paragraph id="ID10e1419f5c954acfb35a9b40fd7a2f05"><enum>(2)</enum><text>ensure that no
				officer or employee of the Office, home care ombudsman representative of a
				local home care Ombudsman entity, or member of the immediate family of the
				officer, employee, or home care ombudsman representative, is subject to a
				conflict of interest;</text>
								</paragraph><paragraph id="ID64c9ffe64f30453b8510fb7b33af0da2"><enum>(3)</enum><text>ensure that the
				Ombudsman—</text>
									<subparagraph id="ID931067f73ab542f887dd55e29ec588c9"><enum>(A)</enum><text>does not have a
				direct involvement in the licensing or certification of a provider of home care
				services;</text>
									</subparagraph><subparagraph id="IDe103b8fded034fee853014955157c0c1"><enum>(B)</enum><text>does not have an
				ownership or investment interest (represented by equity, debt, contract, or
				other financial relationship) in a provider of home care services;</text>
									</subparagraph><subparagraph id="ID1fcd11e1a2f045b4b4060dc9b5a67b5a"><enum>(C)</enum><text>is not employed
				by, or participating in the management of, a provider of home care services;
				and</text>
									</subparagraph><subparagraph id="ID2327bc6cc4654498a7980bf3a8dd5f27"><enum>(D)</enum><text>does not receive,
				or have the right to receive, directly or indirectly, remuneration (in cash or
				in-kind) under a compensation arrangement with an owner or operator of a
				provider of home care services; and</text>
									</subparagraph></paragraph><paragraph id="ID07e81a350d7145c4a103fefc64daa813"><enum>(4)</enum><text>establish, and
				specify in writing, mechanisms to identify and remove conflicts of interest
				referred to in paragraphs (1) and (2), and to identify and eliminate the
				relationships described in subparagraphs (A) through (D) of paragraph (3),
				including such mechanisms as—</text>
									<subparagraph id="IDc3a0eaa316c642c396ec7f4ea2672981"><enum>(A)</enum><text>the methods by
				which the State agency will examine individuals, and immediate family members,
				to identify the conflicts; and</text>
									</subparagraph><subparagraph id="ID11dc0148c9364d078f91ef3688374ef5"><enum>(B)</enum><text>the actions that
				the State agency will require the individuals and such family members to take
				to remove such conflicts.</text>
									</subparagraph></paragraph></subsection><subsection id="ID629fbc079b3d486d834e532b7b930de0"><enum>(g)</enum><header>Legal
				counsel</header><text>The State agency shall ensure that—</text>
								<paragraph id="ID9be584412a1f4cfb96bbda3d0356576c"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5DAF19D334A740EEA1136CA5DDF643CF"><enum>(A)</enum><text>adequate legal counsel
				is available, and is able, without conflict of interest, to—</text>
										<clause id="IDb72a06a38eb84b4f9ebfb2b9500c7023" indent="up1"><enum>(i)</enum><text>provide advice and consultation
				needed to protect the health, safety, welfare, and rights of home care
				consumers; and</text>
										</clause><clause id="ID52d6eb76b05c4010aa674f68950e4b59" indent="up1"><enum>(ii)</enum><text>assist the Ombudsman and
				representatives of the home care ombudsman program in the performance of the
				official duties of the Ombudsman and representatives; and</text>
										</clause></subparagraph><subparagraph id="IDf5bae27e43d9401e9db62788ee8e444f" indent="up1"><enum>(B)</enum><text>legal representation is provided to
				any representative of the home care ombudsman program against whom suit or
				other legal action is brought or threatened to be brought in connection with
				the performance of the official duties of the Ombudsman or such a
				representative; and</text>
									</subparagraph></paragraph><paragraph id="IDfb9c06bd5144483b9046e2b65df54fbe"><enum>(2)</enum><text>the Ombudsman
				pursues administrative, legal, and other appropriate remedies on behalf of home
				care consumers.</text>
								</paragraph></subsection><subsection id="IDca8157af22874c54947ba10aeb114cbe"><enum>(h)</enum><header>Administration</header>
								<paragraph id="id2AE52E158EAD4C2385D87E464A0314F4"><enum>(1)</enum><header>Requirements</header><text>The
				State agency shall require the Office to—</text>
									<subparagraph id="ID75856a016431437e83ce8e27123363a5"><enum>(A)</enum><text>include in its
				annual report required in section 712(h)(1)—</text>
										<clause id="IDb491ca1d14cd48b8a56e8f8a6624db4f"><enum>(i)</enum><text>a
				description of the activities carried out by the Office as they related to the
				home care ombudsman program in the year for which the report is
				prepared;</text>
										</clause><clause id="IDc6ad365674dd462c940b2c12c4c548f7"><enum>(ii)</enum><text>the data and an
				analysis of the data collected under subsection (c);</text>
										</clause><clause id="IDfefd6f3338c54593809210dc896629be"><enum>(iii)</enum><text>an evaluation
				of the problems experienced by, and the complaints made by or on behalf of,
				home care consumers;</text>
										</clause><clause id="ID2779163776db4253b49f515832950c9f"><enum>(iv)</enum><text>recommendations
				for—</text>
											<subclause id="ID73ba5f6bb35348fca22973f998f987e0"><enum>(I)</enum><text>improving quality
				of the care and life of the home care consumers; and</text>
											</subclause><subclause id="ID4153008beade44d68f5a383cc4062f29"><enum>(II)</enum><text>protecting the
				health, safety, welfare, and rights of the home care consumers;</text>
											</subclause></clause><clause id="IDed9d2dbf78154208932dcfabb5c20ece"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="id738302E65F3D411583A8F81B0AA64AB8"><enum>(I)</enum><text>an analysis of the
				success of the home care ombudsman program including success in providing
				services to home care consumers in communities with high percentages of racial
				or ethnic minorities; and</text>
											</subclause><subclause id="ID10b3428c937d4f24bc37ce7d28c3ed44" indent="up1"><enum>(II)</enum><text>identification of barriers that prevent
				the optimal operation of the home care ombudsman program; and</text>
											</subclause></clause><clause id="ID8d2f00647faf48f3839e234c3a5c900f"><enum>(vi)</enum><text>policy,
				regulatory, and legislative recommendations to solve identified problems, to
				resolve the complaints, to improve the quality of care and life of home care
				consumers, to protect the health, safety, welfare, and rights of home care
				consumers, and to remove the barriers;</text>
										</clause></subparagraph><subparagraph id="IDa0897177e78a49d88119e81f3be51e10"><enum>(B)</enum><text>not later than 2
				years after the date of the enactment of this chapter, establish procedures for
				the training of the representatives of the home care ombudsman program,
				including unpaid volunteers, based on best practices outlined by the Assistant
				Secretary in the most recent report submitted under subsection (m)(1), in
				consultation with representatives of citizen groups, providers of home care
				services, and the home care ombudsman program, that—</text>
										<clause id="IDd4d2d22869ba4771bd49388e4ee14b5f"><enum>(i)</enum><text>specify a minimum
				number of hours of initial training;</text>
										</clause><clause id="IDd260d20c58dd40e99bb2cb5d000e81fe"><enum>(ii)</enum><text>specify the
				content of the training, including training relating to—</text>
											<subclause id="ID765cbcfc118443b18a2574177e09a6d4"><enum>(I)</enum><text>Federal, State,
				and local laws, regulations, and policies, with respect to providers of home
				care services in the State;</text>
											</subclause><subclause id="ID544565724a114505bbdbf377e4fb8bc4"><enum>(II)</enum><text>investigative
				techniques; and</text>
											</subclause><subclause id="IDd21e8921f6844bfc932d12f51ca76a24"><enum>(III)</enum><text>such other
				matters as the State determines to be appropriate; and</text>
											</subclause></clause><clause id="ID9041c82ffa184a7cade9e80aeb3331bf"><enum>(iii)</enum><text>specify an
				annual number of hours of in-service training for all designated
				representatives;</text>
										</clause></subparagraph><subparagraph id="ID64ec87e65975442f947d9f9434bbdb1a"><enum>(C)</enum><text>prohibit any
				representative of the home care ombudsman program (other than the Ombudsman)
				from carrying out any activity described in subparagraphs (A) through (H) of
				subsection (a)(3) unless the representative—</text>
										<clause id="IDb7acc2f9006b4fefa4b2d433bb97b863"><enum>(i)</enum><text>has received the
				training required under subparagraph (B); and</text>
										</clause><clause id="ID8d07a501acfb49bcbefa820a24c3d2d5"><enum>(ii)</enum><text>has been
				approved by the Ombudsman as qualified to carry out the activity on behalf of
				the Office;</text>
										</clause></subparagraph><subparagraph id="ID3e7f1ce59910434f8e3ce0166dbbee77"><enum>(D)</enum><text>coordinate home
				care ombudsman services with the protection and advocacy systems for
				individuals with developmental disabilities and mental illnesses established
				under—</text>
										<clause id="ID6e197515b09a4b75bae1ec190a8e412d"><enum>(i)</enum><text>subtitle C of the
				Developmental Disabilities Assistance and Bill of Rights Act of 2000 (42 U.S.C.
				15041 et seq.); and</text>
										</clause><clause id="ID26738addc5964d2890e3eca760473f88"><enum>(ii)</enum><text>the Protection
				and Advocacy for Individuals with Mental Illness Act (42 U.S.C. 10801 et
				seq.);</text>
										</clause></subparagraph><subparagraph id="ID9790c16c6fab416f8f9d28c64efa14a3"><enum>(E)</enum><text>coordinate, to
				the greatest extent possible, home care ombudsman services with legal
				assistance provided under section 306(a)(2)(C), through adoption of memoranda
				of understanding and other means;</text>
									</subparagraph><subparagraph id="ID0ca7cdf647d44588a8af44ebb63b27cd"><enum>(F)</enum><text>coordinate
				services with State and local law enforcement agencies and courts of competent
				jurisdiction; and</text>
									</subparagraph><subparagraph id="ID2d55bb7ffb224bf18c6fbdbf2335216e"><enum>(G)</enum><text>permit any local
				home care Ombudsman entity to carry out the responsibilities described in
				subparagraph (A), (D), or (E).</text>
									</subparagraph></paragraph><paragraph id="ID2513e887090c4290b97a70cada0fdeca"><enum>(2)</enum><header>Authorities</header><text>The
				State agency shall require the Office to—</text>
									<subparagraph id="ID4cdadf3dc548419684fcda3d78944ff9"><enum>(A)</enum><text>analyze, comment
				on, and monitor the development and implementation of Federal, State, and local
				laws, regulations, and other government policies and actions that pertain to
				providers of home care services and those services, and to the health, safety,
				welfare, and rights of home care consumers, in the State, and recommend any
				changes in such laws, regulations, and policies as the Ombudsman determines to
				be appropriate;</text>
									</subparagraph><subparagraph id="ID63445a65ecb040eaba5e69e1ba7bf129"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id9E2E2DFF6589409C886A7F1F7DCF1851"><enum>(i)</enum><text>provide such
				information as the Ombudsman determines to be necessary to public and private
				agencies, legislators, and other persons, regarding—</text>
											<subclause id="IDfe051c25c23946d48a9b7bbca6a7cd38" indent="up1"><enum>(I)</enum><text>the problems and concerns of older
				individuals receiving home care services; and</text>
											</subclause><subclause id="ID873a345f789140dba4beb54b13500325" indent="up1"><enum>(II)</enum><text>recommendations related to the problems
				and concerns; and</text>
											</subclause></clause><clause id="IDf2b8458b92314bfdb854a82c0c4bc11e" indent="up1"><enum>(ii)</enum><text>make available to the public, and
				submit to the Assistant Secretary, the chief executive officer of the State,
				the State legislature, the State agency responsible for licensing or certifying
				providers of home care services, and other appropriate governmental entities,
				each report prepared under paragraph (1)(A); and</text>
										</clause></subparagraph><subparagraph id="ID072b4f378724483eb5eb31fd0891f3ac"><enum>(C)</enum><text>permit any local
				home care Ombudsman entity to carry out the responsibilities described in
				subparagraph (A) or (B).</text>
									</subparagraph></paragraph></subsection><subsection id="ID350c1626554b48e381136a3aefa2db78"><enum>(i)</enum><header>Liability</header><text>The
				State shall ensure that no representative of the home care ombudsman program
				will be liable under State law for the good faith performance of official
				duties.</text>
							</subsection><subsection id="ID0c2ee0c1d0b54425a328e557084410b2"><enum>(j)</enum><header>Noninterference</header><text>The
				State shall—</text>
								<paragraph id="ID52d63cbec5de479d8d4602a43616ec21"><enum>(1)</enum><text>ensure that
				willful interference with representatives of the home care ombudsman program in
				the performance of the official duties of the representatives (as defined by
				the Assistant Secretary) shall be unlawful;</text>
								</paragraph><paragraph id="IDc580a2ff46eb40f69e6df4f12e9fbb95"><enum>(2)</enum><text>prohibit
				retaliation and reprisals by a provider of home care services or other entity
				with respect to any recipient of home and community-based services, employee,
				exclusive representative of an employee, or other person for filing a complaint
				with, providing information to, or otherwise cooperating with any
				representative of, the home care ombudsman program; and</text>
								</paragraph><paragraph id="ID0c335c3e6b7448a2a97efc979776c54f"><enum>(3)</enum><text>provide for
				appropriate sanctions with respect to the interference, retaliation, and
				reprisals.</text>
								</paragraph></subsection><subsection id="ID6a35d4888bc1483eac67b11cced7ddbc"><enum>(k)</enum><header>Coordination
				with Adult Protective Services</header>
								<paragraph id="id0EB5D072EE4946AA910D1A18D44604F2"><enum>(1)</enum><header>In
				general</header><text>The Ombudsman, in carrying out the State Home Care
				Ombudsman Program, shall coordinate activities with the National Adult
				Protective Services Resource Center and the head of the State’s adult
				protective services program in a manner that is consistent with the State’s
				existing (as of the date of the coordination) protocols for coordination of
				activities between the Ombudsman, in carrying out the State Long-Term Care
				Ombudsman Program.</text>
								</paragraph><paragraph id="id97EAB4A6588240359851220707641B83"><enum>(2)</enum><header>Establishment
				of protocols</header><text>If the protocols described in paragraph (1) do not
				exist in the State, the Ombudsman, in conjunction with the head of the State’s
				adult protective services program, shall establish protocols to coordinate
				activities with the intent of better serving vulnerable adults, which protocols
				shall—</text>
									<subparagraph id="IDc21a2e05fcc245208ce38bfe30b30125"><enum>(A)</enum><text>clarify the roles
				of each program;</text>
									</subparagraph><subparagraph id="ID92afaee581dd4546b235da7a363db2c8"><enum>(B)</enum><text>establish
				procedures for maintaining a working relationship;</text>
									</subparagraph><subparagraph id="ID0b0c075bb30f46a7a70e86251b7fad9f"><enum>(C)</enum><text>outline mutual
				expectations; and</text>
									</subparagraph><subparagraph id="ID0924eee1cd9c43bd919548bca92c2e71"><enum>(D)</enum><text>establish
				procedures for coordinating activities with law enforcement.</text>
									</subparagraph></paragraph></subsection><subsection id="IDfdd32971c75b438cb140f3e5dc01573b"><enum>(l)</enum><header>Maintenance of
				effort</header><text>A State, in using the funds made available for a fiscal
				year through a grant received under section 703(d), shall maintain the
				expenditures of the State for home care ombudsman services at a level that is
				not less than the level of such expenditures maintained by the State for the
				preceding fiscal year.</text>
							</subsection><subsection id="ID7d7c66f581f1409da61db540271c8db4"><enum>(m)</enum><header>Evaluation</header><text>The
				Assistant Secretary shall—</text>
								<paragraph id="ID9457b9844c104f0fa7effc1b0f0b0413"><enum>(1)</enum><text>in conjunction
				with the Director of the Office of Long-Term Care Ombudsman Programs and the
				heads of other entities determined to be necessary by the Assistant Secretary,
				collect and analyze the data required to be submitted under subsection (c) by
				the States and within 1 year after receipt of the data, submit a report to
				Congress outlining best practices for carrying out a home care ombudsman
				program; and</text>
								</paragraph><paragraph id="ID836cb9318a564d1aaddeb0c6922faa61"><enum>(2)</enum><text>make the report
				available to
				States.</text>
								</paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="id2A185FFFBEB04546B9CD713B42F9EAC9"><enum>III</enum><header>Quality
			 assurance for home and community-based services</header>
			<section id="idCA36387805D54670890ECC93FA867817"><enum>301.</enum><header>Functions of
			 Assistant Secretary</header><text display-inline="no-display-inline">Section
			 202(b) of the Older Americans Act of 1965 (42 U.S.C. 3012(b)) is
			 amended—</text>
				<paragraph id="id8946F2E5C8F14991AD8E73789113D478"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (8)—</text>
					<subparagraph id="id68660830818A4CCD93F3E4A9A28D0763"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking
			 <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="id8FC50EFC9D5B4C0099E232A9C169FAE0"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (E) by adding
			 <quote>and</quote> at the end; and</text>
					</subparagraph><subparagraph id="id62FAA0BD7CF2482DB33CC36202A6AD34"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				quality assurance information, relating to the standards identified under
				paragraph (11)(A), using the methods described in paragraph (11)(B), about home
				and community-based long-term care programs, service providers, and resources,
				when referring consumers to those programs, providers, or
				resources;</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idDF822329CE0A492F9329EC8AF9589AAB"><enum>(2)</enum><text>in paragraph
			 (9)—</text>
					<subparagraph id="id7D0EA7B5C18D4BF38F96F0F17B3A47EA"><enum>(A)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>and community-based service
			 providers</quote> and inserting <quote>community-based service providers, and,
			 for purposes of subparagraph (C), Aging and Disability Resource
			 Centers,</quote>;</text>

					</subparagraph></paragraph><paragraph id="id6E9B49739F3F49F18EA5F9CFDF483014"><enum>(3)</enum><text>in paragraph
			 (10), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id3C2EB88B651D465EA07B16CDFC8E9114"><enum>(4)</enum><text>by redesignating
			 paragraph (11) as paragraph (12); and</text>
				</paragraph><paragraph id="id99BE95049ADF407D8A2B605F337DD0A2"><enum>(5)</enum><text>by inserting
			 after paragraph (10) the following:</text>

				consultation with States (either directly or by entering into a contract under
				this subparagraph and considering the recommendation of the contract recipient)
				quality assurance standards for home and community-based long-term care
				programs, service providers, and resources that—</text>
								<clause id="id9E4DC233A455446F9D347FF6E66984EE" indent="up1"><enum>(i)</enum><text>shall be designed to ensure the
				health, safety, and welfare of consumers who are referred to such programs,
				service providers, and resources by area agencies on aging, Aging and
				Disability Resource Centers, and such other entities as the Assistant Secretary
				determines to be appropriate; and</text>
								</clause><clause id="idC054CE2E787C4D49876FE833C093C8C3" indent="up1"><enum>(ii)</enum><text>shall be identified after the
				Assistant Secretary takes into account, at a minimum, standards for—</text>
									<subclause id="id5358D4BD663D4C029BE05EB37A26F51F"><enum>(I)</enum><text>background checks of service
				providers;</text>
									</subclause><subclause id="idE4E38EA60FC247E483367A280AA20874"><enum>(II)</enum><text>licensure of agencies and certification
				and training of service providers;</text>
									</subclause><subclause id="idB88BB872F4214A42ADC8FD108F10CC86"><enum>(III)</enum><text>consumer satisfaction regarding
				programs, service providers, and resources, in cases in which consumer
				satisfaction information is available; and</text>
									</subclause><subclause id="idBEEB33C5A2434B21AE11147A7EB93157"><enum>(IV)</enum><text>such additional matters as the Assistant
				Secretary determines to be appropriate; and</text>
									</subclause></clause></subparagraph><subparagraph id="IDe1e5a8650cc44e79b387fffadd94ab7e" indent="up1"><enum>(B)</enum><text>taking into account the variation in
				communication infrastructure development among Aging and Disability Resource
				Centers, establish consumer-friendly methods for communicating to consumers,
				consistently throughout a State—</text>
								<clause id="idC0984D75334F455DAD0987C8BB755441"><enum>(i)</enum><text>quality assurance information
				relating to the standards identified under subparagraph (A) about home and
				community-based long-term care programs, service providers, and resources to
				which such consumers are referred to by area agencies on aging, Aging and
				Disability Resource Centers, and such other entities as the Assistant Secretary
				determines to be appropriate; and</text>
								</clause><clause id="idD7FF6CB533E74474A061FB8A3585A289"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id991FA3BACD88486E8501B6A092A831A7"><enum>(I)</enum><text>the content of the
				State certification or licensure requirements applicable to such home and
				community-based long-term care programs, service providers, or resources;
				or</text>
									</subclause><subclause id="id92B39251AC884DC9BCD4FB0F38C1E7BC" indent="up1"><enum>(II)</enum><text>an explanation that the State does
				not have certification or licensure requirements applicable to such home and
				community-based long-term care programs, service providers, or resources;
				and</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idBB720AADEB644BD79BAFF77D949CB769"><enum>302.</enum><header>Organization</header><text display-inline="no-display-inline">Section 305(a)(3)(E) of the Older Americans
			 Act of 1965 (42 U.S.C. 3025(a)(3)(E)) is amended—</text>
				<paragraph id="id62F8BF1A73574030B956F66BB9E7FF07"><enum>(1)</enum><text>in the matter
			 before clause (i), by striking <quote>information relating to</quote>;</text>
				</paragraph><paragraph id="idDC4464FD91A64430A7509BB41816C3B2"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (i)—</text>
					<subparagraph id="id37DA82B7EB714B2C944E3D649694AD18"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>information relating
			 to</quote> after <quote>(i)</quote>; and</text>
