		<official-title>To amend the Immigration and Nationality Act to stimulate
		  international tourism to the United States.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Visa Improvements to Stimulate
			 International Tourism to the United States of America Act</short-title></quote>
			 or the <quote><short-title>VISIT USA
			 Act</short-title></quote>.</text>
		</section><section id="idD23269C6847A4586A309DEBAC7689B3B"><enum>2.</enum><header>Multiple entry
			 visas for nationals of China</header><text display-inline="no-display-inline">Section 214(a)(2) of the Immigration and
			 Nationality Act (8 U.S.C. 1184(a)(2)) is amended—</text>
			<paragraph id="idD6DA8A2DDF764BB798C14A17772691D7"><enum>(1)</enum><text>by redesignating
			 subparagraphs (A) and (B) as subparagraphs (B) and (C), respectively;
			 and</text>
			</paragraph><paragraph id="id288B84C1DE7A4C7CA48F2050F9FFF746"><enum>(2)</enum><text>by inserting
			 before subparagraph (B), as so redesignated, the following:</text>
				<quoted-block display-inline="no-display-inline" id="id6C57873E3F10435AB23C6FE733217B77" style="OLC">
					<subparagraph id="id6A3F982218A44AE394DF206B7DCBCD02" indent="up2"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idAEFBB19B2F9741799BBF7332C8810C3C"><enum>(i)</enum><text>Notwithstanding
				paragraph (1) and except as provided in clause (ii), the Secretary of State
				shall ensure that a nonimmigrant visa issued pursuant to section 101(a)(15)(B)
				to an alien described in clause (iii)—</text>
							<subclause id="id87164D6193AA4991975F3791964E1133" indent="up1"><enum>(I)</enum><text>is valid for a period of not less than
				5 years; and</text>
							</subclause><subclause id="idF0194CF9E95548AE99B8FC5E0CA60856" indent="up1"><enum>(II)</enum><text>permits unlimited entry into and exit
				from the United States during such period.</text>
							</subclause></clause><clause id="idC3A3F1EBB8E3465E870A45F17FA9B4FE" indent="up1"><enum>(ii)</enum><text>The Secretary of State may waive
				clause (i) with respect to an alien described in clause (iii) if the Secretary
				determines that a compelling national security reason exists for the
				waiver.</text>
						</clause><clause id="id6058F56BE136414D8B0424D426599658" indent="up1"><enum>(iii)</enum><text>An alien described in this clause
				is an alien who—</text>
							<subclause id="idA99E526B4D2948FFAD1E04319EE75C39"><enum>(I)</enum><text>is a national of China;</text>
							</subclause><subclause id="id42C03F2992CB44C9A251895759214726"><enum>(II)</enum><text>meets the requirements for a visa
				under section 101(a)(15)(B); and</text>
							</subclause><subclause id="idBEB07F51CB6745A68478C171691E2B31"><enum>(III)</enum><text>requests a visa pursuant to clause
				(i).</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idC4A0A79B50BB45C48ACBCD400A2FB552" indent="up1"><enum>(iv)</enum><text>An alien issued a visa pursuant to
				clause (i) shall be screened through the automated electronic travel
				authorization system implemented pursuant to section 217(h)(3) prior to being
				admitted into the United
				States.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id4C66CA1F07A44229BBBDF82EEA8AB3F8"><enum>3.</enum><header>Expediting
			 priority visitors</header><text display-inline="no-display-inline">Section
			 286(u) of the Immigration and Nationality Act (8 U.S.C. 1356(u)) is
			 amended—</text>
			<paragraph id="id0F38517AD9C949848195493528EB026D"><enum>(1)</enum><text display-inline="yes-display-inline">by amending the subsection heading to read
			 as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id04D2112C3E264197972C2FB914DA2632" style="OLC">
					<subsection id="idF7B2FF9EA4534B81BA540171411A3E28"><enum>(u)</enum><header>Premium
				processing
				fee</header>
					</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idAAA5F769008446DD89CE602CB58DBB78"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>The Attorney
			 General</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7E649F70AEA64946A9193AAFD93B160B" style="OLC">
					<paragraph id="idB0B3479B372B472EB939B0C6A34AFDDC"><enum>(1)</enum><header>Employment-based
				petitions and applications</header><text display-inline="yes-display-inline">The Secretary of Homeland
				Security</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idB799567B4B864EFDA8CF630EDF87CF28"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>This fee</quote> and
			 inserting <quote>The fee authorized under this paragraph</quote>;</text>
			</paragraph><paragraph id="idAA6E61DD4ABF478B9AD896A9ADEB8B23"><enum>(4)</enum><text>by striking
			 <quote>The Attorney General may adjust this fee</quote> and inserting
			 <quote>The Secretary may adjust the fee authorized under this
			 paragraph</quote>; and</text>
			</paragraph><paragraph id="id6BE14B15CC154FD9A34CE4B8F5244D7A"><enum>(5)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7DE46A7F56D9472B9D3EB115FF798D75" style="OLC">
					<paragraph id="idF50632AADCFA499A97B04FFA1F79362F"><enum>(2)</enum><header>Visitor
				visas</header><text>The Secretary of State shall offer premium processing for
				visitor visas issued to nonimmigrants described in section 101(a)(15)(B) and
				shall ensure that applicants requesting premium processing for such visas are
				interviewed and the visa application is adjudicated not later than 3 business
				days after the date of the applicant’s request for a visa appointment, absent
				compelling security concerns. The Secretary shall charge a fee for premium
				processing services under this paragraph in an amount sufficient to recover the
				costs incurred—</text>
						<subparagraph id="id84A426F2993E461FB966F0EF753C7AE8"><enum>(A)</enum><text>to more quickly
				process such visas in India, China, and Brazil;</text>
						</subparagraph><subparagraph id="id586825FD2AB14141BDDBD93C9AB6A0FB"><enum>(B)</enum><text>to procure the
				technology needed to conduct videoconferencing for visa interviews; and</text>
						</subparagraph><subparagraph id="idB5FD663895FB4D9F85DFE2D654D6414F"><enum>(C)</enum><text>to create mobile
				interview units to process visa applications and conduct visa interviews in
				cities with more than 1,000,000 people that do not have a United States embassy
				or
				consulate.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id5E5BF81FCF8D4F11B751DEDFA146B894"><enum>4.</enum><header>Video Conference
			 Pilot Program</header>
			<subsection id="IDa55d841e18854bd88774cbb7d4fc8e2b"><enum>(a)</enum><header>Authorization</header><text>Except
			 as provided in subsection (c), the Secretary of State—</text>
				<paragraph id="id3E4F74D592CC4578965C04E9D85BDEBF"><enum>(1)</enum><text>shall develop and
			 conduct a pilot program for processing B–1 and B–2 visas using secure remote
			 videoconferencing technology as a method for conducting visa interviews of
			 applicants; and</text>
				</paragraph><paragraph id="id9A5E1CD0D8D6490DB8F6C5AACE1FC8D4"><enum>(2)</enum><text>in consultation
			 with other Federal agencies that use such secure communications, shall help
			 ensure the security of the videoconferencing transmission and encryption
			 conducted under paragraph (1).</text>
				</paragraph></subsection><subsection id="ID6a5c8f394fea444580c31b41bcf01ea3"><enum>(b)</enum><header>Report</header><text>Not
			 later than 90 days after the termination of the pilot program authorized under
			 subsection (a), the Secretary of State shall submit a report to the
			 <committee-name committee-id="SSAP00">Committee on Appropriations of the
			 Senate</committee-name> and the <committee-name committee-id="">Committee on
			 Appropriations of the House of Representatives</committee-name> that
			 contains—</text>
				<paragraph id="id540585F3929546569651E8EFC37DD882"><enum>(1)</enum><text>a detailed
			 description of the results of such program, including an assessment of the
			 efficacy, efficiency, and security of the remote vid­eo­con­fer­enc­ing
			 technology as a method for conducting visa interviews of applicants; and</text>
				</paragraph><paragraph id="idC228DA97F8114F14AA16642658AC2C3E"><enum>(2)</enum><text>recommendations
			 for whether such program should be continued, broadened, or modified.</text>
				</paragraph></subsection><subsection id="ID87e3cd8a719347f593d8f7eb76e78136"><enum>(c)</enum><header>Limitation</header>
				<paragraph id="idF7F853FFAC40484FB89405AFA74657AC"><enum>(1)</enum><header>In
			 general</header><text>The pilot program authorized under subsection (a) may not
			 be conducted if the Secretary of State determines that such program—</text>
					<subparagraph id="id3F817576D37F4E79BE0206D263BC998C"><enum>(A)</enum><text>poses an undue
			 security risk; and</text>
					</subparagraph><subparagraph id="id4F7E5BF435EC41A6B04FA2B049E4F151"><enum>(B)</enum><text>cannot be
			 conducted in a manner consistent with maintaining security controls.</text>
					</subparagraph></paragraph><paragraph id="id1B77354A8AFE476FB3C74517F1F6A18B"><enum>(2)</enum><header>Report</header><text>If
			 the Secretary of State makes a determination under paragraph (1), the Secretary
			 shall submit a report to the <committee-name committee-id="SSAP00">Committee on
			 Appropriations of the Senate</committee-name> and the
			 <committee-name committee-id="">Committee on Appropriations of the House of
			 Representatives</committee-name> that describes the reasons for such
			 determination.</text>
				</paragraph></subsection></section><section id="id2C52D21B714C4D669E1556645CE6FBA2"><enum>5.</enum><header>Encouraging
			 Canadian tourism to the United States</header>
			<subsection id="id1ED28366107D4C4EA3869B381B04CB12"><enum>(a)</enum><header>Canadian
			 retiree visas</header><text display-inline="yes-display-inline">Section
			 101(a)(15) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)) is
			 amended—</text>
				<paragraph id="id7D785CECE22B47519CE67FD6041EFB64"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (T)(iii), by striking the
			 period at the end and inserting a semicolon;</text>
				</paragraph><paragraph id="id0D4492643E304C7788C16F1EFABCD98C"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (U)(iii), by striking
			 <quote>or</quote> and the end;</text>
				</paragraph><paragraph id="idCAF91803FD934660970EC0DBA6F15A59"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (V), by striking the period
			 at the end and inserting a semicolon; and</text>
				</paragraph><paragraph id="id1B818B98578A40EBB4D18FAAB1F66CC7"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC0B7F6E1BFF749D1B25431CBD18CC3D2" style="OLC">
						<subparagraph id="id1C90FF79F3E641FEBED2CACFCB723786"><enum>(W)</enum><text>subject to
				section 214(s), an alien who the Secretary of Homeland Security
				determines—</text>
							<clause id="idE77461098A8546BF9B172891E0BF7A15"><enum>(i)</enum><text>is a citizen of
				Canada, is older than 50 years of age, owns a residence in the United States or
				has signed a rental agreement for accommodations in the United States for the
				duration of the alien’s stay in the United States; and</text>
							</clause><clause id="idE634910520264F5890B1130C3697C464"><enum>(ii)</enum><text>the alien spouse
				and children of the alien described in clause (i) if accompanying or following
				to join the alien;
				or</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idFD7B535F7B2D47758318314DFA568BFC"><enum>(b)</enum><header>Visa
			 application procedures</header><text>Section 214 of the Immigration and
			 Nationality Act (8 U.S.C. 1184) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id9B0B00BA04DA4F01974FC6F2539ADAC5" style="OLC">
					<subsection id="id2CB9F30A75F844BF9A8CE4770C5FCAD5"><enum>(s)</enum><header>Visas of
				nonimmigrants described in section
				101<enum-in-header>(a)</enum-in-header>(15)(W)</header>
						<paragraph id="id4F12E6BC525C480694030D09638D2524"><enum>(1)</enum><text>The Secretary of
				Homeland Security shall authorize the issuance of a nonimmigrant visa to any
				alien described in section 101(a)(15)(W) who submits a petition to the
				Secretary that demonstrates, to the satisfaction of the Secretary, that the
				alien—</text>
							<subparagraph id="idD3D5173429744CFFB8697A68C131345E"><enum>(A)</enum><text>meets the
				eligibility requirements set forth in section 101(a)(15)(W);</text>
							</subparagraph><subparagraph id="idF19C3CE1D38A435B98F2F6D7B875F60A"><enum>(B)</enum><text>is not
				inadmissible under section 212; and</text>
							</subparagraph><subparagraph id="id836FA848988541CE9828267B4BDC4A34"><enum>(C)</enum><text>will comply with
				the terms set forth in paragraph (2).</text>
							</subparagraph></paragraph><paragraph id="id8DD03774131D4EB59F5693B116F2EC71"><enum>(2)</enum><text>An alien who is
				issued a visa under this subsection—</text>
							<subparagraph id="id785870E895314FC9BA73C0EEC7273161"><enum>(A)</enum><text>is authorized to
				visit the United States during the 3-year period beginning on the date on which
				the visa is issued;</text>
							</subparagraph><subparagraph id="id467382BEB9284FC0A36E005AFE92CE5E"><enum>(B)</enum><text>may remain in the
				United States during such authorized period for not more than 240 consecutive
				days;</text>
							</subparagraph><subparagraph id="idF748CC6D417B4810BF32EC8263AAFA8F"><enum>(C)</enum><text>may renew such
				visa every 3 years under the same terms and conditions;</text>
							</subparagraph><subparagraph id="idB7C27B4DECE148CD987B82D71DCE57F2"><enum>(D)</enum><text>is not authorized
				to engage in employment in the United States; and</text>
							</subparagraph><subparagraph id="idE4C2B1AB590E415AB802ED025BDFE534"><enum>(E)</enum><text>is not eligible
				for any form of assistance or benefit described in section 403(a) of the
				Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (8
				U.S.C.
				1613(a)).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idB73C2222F7EB406590914D99F99F3903"><enum>6.</enum><header>Incentives for
			 foreign visitors visiting the United States during low peak seasons</header>
			<subsection id="idD2F0421F66C6424BA9B9AAF799DD46AD"><enum>(a)</enum><header>Application
			 fees</header><text display-inline="yes-display-inline">The Secretary of State
			 shall give foreign visitors an incentive to apply for a visa when the demand is
			 lower by decreasing the visa application and issuance fees charged to
			 nonimmigrants described in section 101(a)(15)(B) of the Immigration and
			 Nationality Act (8 U.S.C. 1101(a)(15)(B)) in selected countries during periods
			 when there is low demand for visitor visas in such countries.</text>
			</subsection><subsection id="id7ECE3256842D4F5CB3EB5EFE67CE6A0D"><enum>(b)</enum><header>Limitation</header><text>In
			 decreasing visa application and issuance fees under subsection (a), the
			 Secretary shall—</text>
				<paragraph id="idCB39F0D5D994406EBBB68AF290ECF36D"><enum>(1)</enum><text>subject to
			 paragraph (2), maximize the demand for such visa applications; and</text>
				</paragraph><paragraph id="idFD846833F7CB4015BDBC9E626FFBE87C"><enum>(2)</enum><text>maintain the
			 total amount collected from such fees.</text>
				</paragraph></subsection></section><section id="id405E1EDB1DA94CE896C783060A2F5105"><enum>7.</enum><header>Secure Travel
			 and Counterterrorism Partnership Program</header>
			<subsection id="id48487D90EA454C20806FB43ED3384F03"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 217(c)(1) of the Immigration and
			 Nationality Act (8 U.S.C. 1187(c)(1)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id7736848981FB484ABEF7CB6EBADBAC02" style="OLC">
					<paragraph id="id8F902C88D1674DDEA8DF2E53FF912050"><enum>(1)</enum><header>Authority to
				designate</header>
						<subparagraph id="id20A7E94EFBA644D6B143901327BD548F"><enum>(A)</enum><header>In
				general</header><text>The Secretary of Homeland Security, in consultation with
				the Secretary of State, may designate any country as a program country if that
				country meets the requirements under paragraph (2).</text>
						</subparagraph><subparagraph id="idE6E0E9B406DA43608C9304B002FC56B5"><enum>(B)</enum><header>Definitions</header>
							<clause id="id20206803E3924C0D97FA76AB9CADDC6A"><enum>(i)</enum><header>Appropriate
				congressional committees</header><text>The term <term>appropriate congressional
				committees</term> means—</text>
								<subclause id="idDF897A5B6CD540669832738BFEA4DD7A"><enum>(I)</enum><text>the
				<committee-name committee-id="SSFR00">Committee on Foreign Relations of the
				Senate</committee-name>;</text>
								</subclause><subclause id="idC5BBA43D707E42998801CFB2C683FB85"><enum>(II)</enum><text>the
				<committee-name committee-id="SSGA00">Committee on Homeland Security and
				Governmental Affairs of the Senate</committee-name>;</text>
								</subclause><subclause id="id49980471E6D8452EA046810A724EB547"><enum>(III)</enum><text>the
				<committee-name committee-id="SSJU00">Committee on the Judiciary of the
				Senate</committee-name>;</text>
								</subclause><subclause id="id7E2BF1A13D4147699BFE37983F55981E"><enum>(IV)</enum><text>the
				<committee-name committee-id="">Committee on Foreign Affairs of the House of
				Representatives</committee-name>;</text>
								</subclause><subclause id="idF1DB3D18DFD94868A2EC9B4CFA1ACF57"><enum>(V)</enum><text>the
				<committee-name committee-id="">Committee on Homeland Security of the House of
				Representatives</committee-name>; and</text>
								</subclause><subclause id="id1C9CA0D3891840308E7D1549E4C7E19D"><enum>(VI)</enum><text>the
				<committee-name committee-id="">Committee on the Judiciary of the House of
				Representatives</committee-name>.</text>
								</subclause></clause><clause id="id3FADE98F86634DEDB9BD20EF8090167C"><enum>(ii)</enum><header>Program
				country</header><text>The term <term>program country</term> means a country
				designated as a program country under subparagraph
				(A).</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id315B919F9DDB4A6C93D68BF6F7FF508F"><enum>(b)</enum><header>Technical and
			 conforming amendments</header><text>Section 217 of the Immigration and
			 Nationality Act (8 U.S.C. 1187) is amended—</text>
				<paragraph id="idCDC2743EBC464DA4BEE4C48AD3DC9A6F"><enum>(1)</enum><text>by striking
			 <quote>Attorney General</quote> each place the term appears (except for
			 subsection (c)(11)(B)) and inserting <quote>Secretary of Homeland
			 Security</quote>; and</text>
				</paragraph><paragraph id="id4C49159E19BD4DFD99D2EBE04189779F"><enum>(2)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="id6923979BB4D5402C9BA0DF6FC09F0CA8"><enum>(A)</enum><text>in paragraph
			 (2)(C)(iii), by striking <quote>Committee on the Judiciary and the Committee on
			 International Relations of the House of Representatives and the Committee on
			 the Judiciary and the Committee on Foreign Relations of the Senate</quote> and
			 inserting <quote>appropriate congressional committees</quote>;</text>
					</subparagraph><subparagraph id="idE2D07D6EE7C54247B0237BBABBA87A49"><enum>(B)</enum><text>in paragraph

			 program countries</header><text>Section 217(c) of the Immigration and
			 Nationality Act (8 U.S.C. 1187(c)) is amended—</text>
				<paragraph id="id8AE692F6EF9647CBB230CF5A0D1BC7EE"><enum>(1)</enum><text>in paragraph (2),
			 by amending subparagraph (A) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id741A63908B68439392663FF646A9A6D9" style="OLC">
						<subparagraph id="idA8127DFDDFC34D318469566DBF5125D8"><enum>(A)</enum><header>General
				numerical limitations</header><text>Either—</text>
							<clause id="id96EE8D1A4EF64799A01FF5AC16C37AA0"><enum>(i)</enum><text>the number of
				refusals of nonimmigrant visas under section 101(a)(15)(B) for nationals of
				that country during the previous fiscal year was not more than 3 percent;
				or</text>
							</clause><clause id="idA43EB0B4655F421180EA6823269EC0A5"><enum>(ii)</enum><text>the overstay
				rate for that country during the previous fiscal year was not more than 3
				percent.</text>
							</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idB91E6AD359F04FC08F41F4454CD96437"><enum>(2)</enum><text>by amending
			 paragraph (3) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idCBA57622629E470BA72BDC118D5CDA95" style="OLC">
						<paragraph id="id34E54F85D6734C93BF129BDA02C48A0D"><enum>(3)</enum><header>Qualification
				criteria</header><text>After the initial period, a country may not be
				designated as a program country unless the Secretary of Homeland Security, in
				consultation with the Secretary of State, determines, pursuant to paragraph
				(5), that the designation will be
				continued.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id754DD075DFCD4FBFA207D8BA9CB5828D"><enum>(3)</enum><text>in paragraph
			 (5)(A)(i)(II), by striking <quote>ought to be continued or terminated under
			 subsection (d)</quote> and inserting <quote>under subsection (d) or (f), or
			 probation under subsection (f), ought to be continued or
			 terminated</quote>;</text>
				</paragraph><paragraph id="id4C55F3E158E248AE8B199B4F70F49DA1"><enum>(4)</enum><text>by amending

							<subparagraph id="id55B535ABAB2B46D190BA47895FD4F023"><enum>(A)</enum><header>Computation of
				visa refusal rates</header><text>For purposes of determining the eligibility of
				a country to be designated as a program country, the calculation of visa
				refusal rates shall not include any visa refusals which incorporate any
				procedures based on, or are otherwise based on, race, sex, or disability,
				unless otherwise specifically authorized by law.</text>
							</subparagraph><subparagraph id="id28E5B939D7864FC0AE7AF79F9001F3EB"><enum>(B)</enum><header>Judicial
				review</header><text>No court has jurisdiction under this section to review any
				visa refusal, the Secretary of State's computation of a visa refusal rate, the
				Secretary of Homeland Security's computation of an overstay rate, or the
				designation or nondesignation of a country as a program
				country.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id3F1D0183478D4D2FAE04BE435207EEE2"><enum>(5)</enum><text>in paragraph (7),
			 as amended by subsection (b)(2)(C)—</text>
					<subparagraph id="id68157E26F7A4475BB0C6DAAA49B4DF44"><enum>(A)</enum><text>in subparagraph

				authority</header><text>The Secretary of Homeland Security, in consultation
				with the Secretary of State, may waive the application of paragraph (2)(A)(i)
				for a country if—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID109FF29CE9B54C0B9A178AC250FF7CDA"><enum>(A)</enum><text>the country meets
				all of the other requirements under paragraph (2);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID224FE19F2A394F7B9A6E87A1D2FDA3C9"><enum>(B)</enum><text>the Secretary of
				Homeland Security determines that the totality of the country's security risk
				mitigation measures provide assurance that the country's participation in the
				program would not compromise the law enforcement, security interests, or
				enforcement of the immigration laws of the United States;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9F9EF848E6284DFD94189F13527E3A54"><enum>(C)</enum><text>there has been a
				general downward trend in the rate of refusals for nonimmigrant visas under
				section 101(a)(15)(B) for nationals of the country;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1A87E20F948C45629746322D8C380AD4"><enum>(D)</enum><text>the country has
				consistently cooperated with the Government of the United States on
				counterterrorism initiatives, information sharing, preventing terrorist travel,
				and extradition of the country's nationals to the United States before the date
				of its designation as a program country, and the Secretary of Homeland Security
				and the Secretary of State assess that such cooperation is likely to continue;
				and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3DCF40D7006045259508023D86EC9C31"><enum>(E)</enum><text>the rate of
				refusals for nonimmigrant visas under section 101(a)(15)(B) for nationals of
				the country during the previous fiscal year was not more than 10
				percent.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idEA8F31092D1346BD9191B75D42E5D12E"><enum>(7)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id54CBF55E46784AF7BE012E418B2EB450" style="OLC">
						<paragraph id="id3651D2431CFB4A0595190B313AE8D876"><enum>(12)</enum><header>Overstay
				rate</header>
							<subparagraph id="idC647DE7C57D4470980B0FBF6CA998FA2"><enum>(A)</enum><header>Initial
				designation</header><text>With respect to a country being considered for
				designation as a program country under paragraph (1)(A), the overstay rate for
				a fiscal year is the ratio between—</text>
								<clause id="id5E63A7F768764AFA8879CB1A30FCBCD4"><enum>(i)</enum><text>the number of
				nationals of such country who were admitted to the United States as
				nonimmigrants described in section 101(a)(15)(B), whose periods of authorized
				stay under such section expired during such fiscal year, and who remained in
				the United States unlawfully after such expiration date; and</text>
								</clause><clause id="idEEF71E5382FB4A8AA75A04794C5B3942"><enum>(ii)</enum><text>the number of
				nationals of such country who were admitted to the United States as
				nonimmigrants described in section 101(a)(15)(B), whose periods of authorized
				stay under such section expired during such fiscal year.</text>
								</clause></subparagraph><subparagraph id="id4B50926466094FECB345B9FAA0FFEBBB"><enum>(B)</enum><header>Continuing
				designation</header><text>With respect to any program country, the overstay
				rate for each fiscal year after the initial designation under paragraph (1)(A)
				is the ratio between—</text>
								<clause id="id6B936F6F424E4AFCBE76A100DA3B1ACA"><enum>(i)</enum><text>the number of
				nationals of such country who were admitted to the United States under this
				section or as nonimmigrants described in section 101(a)(15)(B), whose periods
				of authorized stay expired during such fiscal year, and who remained in the
				United States unlawfully after such expiration date; and</text>
								</clause><clause id="id62EF4B905756435BB486A3D67E7E4531"><enum>(ii)</enum><text>the number of
				nationals of such country who were admitted to the United States under this
				section or as nonimmigrants described in section 101(a)(15)(B), whose periods
				of authorized stay expired during such fiscal year.</text>
								</clause></subparagraph><subparagraph id="idE8311B1BE90E4214B9C097770ACA7EBB"><enum>(C)</enum><header>Computation of
				overstay rate</header><text>In determining the overstay rate for a country, the
				Secretary of Homeland Security may utilize information from any available
				database to ensure the accuracy of such
				rate.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idC0834619D134460497857F4359F2A9E4"><enum>(d)</enum><header>Termination of
			 designation; probation</header><text>Section 217(f) of the Immigration and
			 Nationality Act (8 U.S.C. 1187(f)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idADE5E384C94F4942A6625F9EBEAE5AD2" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID12A9EB6C9BF94016956DC8499AE65FB3"><enum>(f)</enum><header display-inline="yes-display-inline">Termination of designation;
				probation</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID89E3B20BFFE6442A9CFE67092A39311A"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idA82062B29C7B41DFAE0C440C71E6BA80"><enum>(A)</enum><header>Probationary
				period</header><text>The term <term>probationary period</term> means a fiscal
				year in which a country is place in probationary status under this
				subsection.</text>
							</subparagraph><subparagraph id="ID09107B7371BD471CB945C5C6E5C3BA84"><enum>(B)</enum><header>Program
				country</header><text>The term <term>program country</term> means a country
				designated as a program country under subsection (c)(1).</text>
							</subparagraph></paragraph><paragraph id="IDD1CC83E4727C4F45BEB4C8AC8E5E1C0C"><enum>(2)</enum><header>Determination,
				notice, and initial probationary period</header>
							<subparagraph id="id1C30997AAE49444A8284A71797442040"><enum>(A)</enum><header>Determination
				of probationary status and notice of noncompliance</header><text>As part of
				each program country's periodic evaluation required under subsection (c)(5)(A),
				the Secretary of Homeland Security shall determine whether the program country
				is in compliance with the requirements under subparagraphs (A)(ii), (B), (C),
				(D), (E), and (F) of subsection (c)(2).</text>
							</subparagraph><subparagraph id="ID3E0546F644BD40869CCF83F3EAF08950"><enum>(B)</enum><header>Initial
				probationary period</header><text>If the Secretary of Homeland Security
				determines that a program country is not in compliance with the requirements
				under subparagraphs (A)(ii), (B), (C), (D), (E), and (F) of subsection (c)(2),
				the Secretary shall place the program country in probationary status for the
				fiscal year following the fiscal year in which the periodic evaluation is
				completed.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB56DF827EEBF494683B0A186327CEC68"><enum>(3)</enum><header>Actions at the
				end of the initial probationary period</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idB535937A3AE641A98797405D1D92EB63"><enum>(A)</enum><header>Compliance
				during initial probationary period</header><text>If the Secretary of Homeland
				Security determines that all instances of noncompliance with the requirements
				under subparagraphs (A)(ii), (B), (C), (D), (E), and (F) of subsection (c)(2)
				that were identified in the latest periodic evaluation have been remedied by
				the end of the country's initial probationary period under paragraph (2)(B),
				the Secretary shall discontinue the probationary period.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7AFE274513164C338A5F21B3BE8F3812"><enum>(B)</enum><header>Noncompliance
				during initial probationary period</header><text>If the Secretary of Homeland
				Security determines that any instance of noncompliance with the requirements
				under subparagraphs (A)(ii), (B), (C), (D), (E), and (F) of subsection (c)(2)
				that were identified in the latest periodic evaluation has not been remedied by
				the end of the country's initial probationary period under paragraph (2)(B),
				the Secretary may—</text>
								<clause commented="no" display-inline="no-display-inline" id="id5BDE3AE8798C421B883687953663054D"><enum>(i)</enum><text>terminate the
				country's participation in the program; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id4AD5469C2EC84380A8006C1ECB54CE45"><enum>(ii)</enum><text>extend the
				country's probationary status for an additional fiscal year if the Secretary,
				in consultation with the Secretary of State, determines that the country's
				continued participation in the program is in the national interest of the
				United States.</text>
								</clause></subparagraph></paragraph><paragraph id="IDBDC634B683D243108F30E2799616B30A"><enum>(4)</enum><header>Actions at the
				end of additional probationary periods</header>
							<subparagraph id="idBB6316DDB7574C7C8CC1CED960473F1F"><enum>(A)</enum><header>Compliance
				during additional periods</header><text>The Secretary of Homeland Security
				shall discontinue a country's probationary status if the Secretary determines,
				during the latest periodic evaluation required under subsection (c)(5)(A), that
				the country is in compliance with the requirements under subparagraphs (A)(ii),
				(B), (C), (D), (E), and (F) of subsection (c)(2).</text>
							</subparagraph><subparagraph id="id2A46A19F6F99473E86B8E785CA13EF0F"><enum>(B)</enum><header>Noncompliance
				during additional periods</header><text>The Secretary of Homeland Security
				shall terminate a country's participation in the program if the Secretary
				determines, during the latest periodic evaluation required under subsection
				(c)(5)(A), that the country is not in compliance with any of the requirements
				under subparagraphs (A)(ii), (B), (C), (D), (E), and (F) of subsection
				(c)(2).</text>
							</subparagraph></paragraph><paragraph id="ID2CE825E638544955A796253961A1746A"><enum>(5)</enum><header>Effective
				date</header><text>The termination of a country's participation in the program
				under paragraph (3)(B) or (4)(B) shall take effect on the first day of the
				first fiscal year following the fiscal year in which the Secretary of Homeland
				Security determines that such participation shall be terminated. Until such
				date, nationals of the country shall remain eligible for a waiver under
				subsection (a).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID82EC7774C85C4336BDE11B3A497C8DE5"><enum>(6)</enum><header>Treatment of
				nationals after termination</header><text>For purposes of this subsection and
				subsection (d)—</text>
							<subparagraph id="ID83e5020c080f4a359b79edf7637fbaef"><enum>(A)</enum><text>nationals of a
				country whose designation is terminated under paragraph (3) or (4) shall remain
				eligible for a waiver under subsection (a) until the effective date of such
				termination; and</text>
							</subparagraph><subparagraph id="ID9b4ae0c924984a0ebf104f9d473d33ad"><enum>(B)</enum><text>a waiver under
				this section that is provided to such a national for a period described in
				subsection (a)(1) shall not, by such termination, be deemed to have been
				rescinded or otherwise rendered invalid, if the waiver is granted prior to such
				termination.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id36FF3F81995F4D12BB1139957FE8437B"><enum>(e)</enum><header>Review of
			 overstay tracking methodology</header><text>Not later than 180 days after the
			 date of the enactment of this Act, the Comptroller General of the United States
			 shall conduct a review of the methods used by the Secretary of Homeland
			 Security—</text>
				<paragraph id="IDb3cc1aa2ea62422495a76e7321d020a2"><enum>(1)</enum><text>to track aliens
			 entering and exiting the United States; and</text>
				</paragraph><paragraph id="ID59423b9ba25a458a91fe43e95863f7e4"><enum>(2)</enum><text>to detect any
			 such alien who stays longer than such alien's period of authorized
			 admission.</text>
				</paragraph></subsection></section><section id="idAFEE587B96C54BA5BBB7B88FA7D3269E"><enum>8.</enum><header>Increasing home
			 ownership by priority visitors</header>
			<subsection id="id7ED9851DEF144CC2A7429AE84CC5E796"><enum>(a)</enum><header>Nonimmigrant
			 status</header><text display-inline="yes-display-inline">Section 101(a)(15) of
			 the Immigration and Nationality Act, as amended by section 5(a), is further
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9D19CFE7E5C0465F98A20F0C731B7599" style="OLC">
					<subparagraph id="id1F2E6D1EF96047CBA6DA17638FCCE64F"><enum>(X)</enum><text>subject to
				section 214(t), an alien who, after the date of the enactment of the
				<short-title>VISIT USA Act</short-title>—</text>
						<clause id="id4833A5C610E64B3185E36810677491CB"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idAE301F246D0147239F719B0AFB591CAB"><enum>(I)</enum><text>uses at least $500,000
				in cash to purchase 1 or more residences in the United States, which each sold
				for more than 100 percent of the most recent appraised value of such residence,
				as determined by the property assessor in the city or county in which the
				residence is located;</text>
							</subclause><subclause id="id80F8BDE6334744A28E4E7B7D117AAB5E" indent="up1"><enum>(II)</enum><text>maintains ownership of residential
				property in the United States worth at least $500,000 during the entire period
				the alien remains in the United States as a nonimmigrant described in this
				subparagraph; and</text>
							</subclause><subclause id="id297F230FABB3466299FC827E5512E73B" indent="up1"><enum>(III)</enum><text>resides for more than 180 days per year
				in a residence in the United States that is worth at least $250,000; and</text>
							</subclause></clause><clause id="idE0386E5754BD406898CC8BC05C32676D"><enum>(ii)</enum><text>the alien spouse
				and children of the alien described in clause (i) if accompanying or following
				to join the
				alien.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id64D2369633BA46D1B7D740039D3209AE"><enum>(b)</enum><header>Visa
			 application procedures</header><text>Section 214 of the Immigration and
			 Nationality Act, as amended by section 5(b), is further amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4CDE9714BF844F269DB8F1F00F87F059" style="OLC">
					<subsection id="idF23BC564EC7B46409BC8E4AF5634A6F3"><enum>(t)</enum><header>Visas of
				nonimmigrants described in section
				101(<enum-in-header>a</enum-in-header>)(15)(X)</header>
						<paragraph id="id035343A1D8E847769186CD895E9E22F6"><enum>(1)</enum><text>The Secretary of
				Homeland Security shall authorize the issuance of a nonimmigrant visa to any
				alien described in section 101(a)(15)(X) who submits a petition to the
				Secretary that demonstrates, to the satisfaction of the Secretary, that the
				alien—</text>
							<subparagraph id="idF0FDCA6A119140EFB6A6783A508CA568"><enum>(A)</enum><text>has purchased a
				residence in the United States that meets the criteria set forth in section
				101(a)(15)(X)(i);</text>
							</subparagraph><subparagraph id="id34A9B17F4CB94201BE22D7EC042403C9"><enum>(B)</enum><text>is not
				inadmissible under section 212; and</text>
							</subparagraph><subparagraph id="id55741AAAF527447685CEC3EC94BE0630"><enum>(C)</enum><text>will comply with
				the terms set forth in paragraph (2).</text>
							</subparagraph></paragraph><paragraph id="id4DF921082917484B8AD2326F617962E0"><enum>(2)</enum><text>An alien who is
				issued a visa under this subsection—</text>
							<subparagraph id="id9B255E1D79814A9C9A63220428564238"><enum>(A)</enum><text>shall reside in
				the United States at a residence that meets the criteria set forth in section
				101(a)(15)(X)(i) for more than 180 days per year;</text>
							</subparagraph><subparagraph id="id712F5BEA74594F49AFC2FB3E4018D819"><enum>(B)</enum><text>is not authorized
				to engage in employment in the United States, except for employment that is
				directly related to the management of the residential property described in
				section 101(X)(i)(II);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDC0650BE52A24CDBBA18DA7FEEA269E2"><enum>(C)</enum><text>is not eligible
				for any form of assistance or benefit described in section 403(a) of the
				Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (8
				U.S.C. 1613(a)); and</text>
							</subparagraph><subparagraph id="id29CEC5D4E7B0480D823DE292DF61FA90"><enum>(D)</enum><text>may renew such
				visa every 3 years under the same terms and
				conditions.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="ID97103f5360e24d85aad4d2498b4d5ed1"><enum>9.</enum><header>Expediting entry
			 for priority visitors</header><text display-inline="no-display-inline">Section
			 7208(k) of the Intelligence Reform and Terrorism Prevention Act of 2004 (8
			 U.S.C. 1365b(k)) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idA95865AAE8654F94B6702CE8F963E888" style="OLC">
				<paragraph id="ID988007670e78460cae2aa98ee4aba880"><enum>(4)</enum><header>Expediting
				entry for priority visitors</header>
					<subparagraph id="id4BFBA14D1FED4CF4BB647A08C7073D34"><enum>(A)</enum><header>In
				general</header><text>The Secretary of Homeland Security shall expand the
				enrollment in the Global Entry Trusted Traveler Network (referred to in this
				paragraph as <quote>Global Entry</quote>) to include individuals employed by
				international organizations, selected by the Secretary, which maintain strong
				working relationships with the United States.</text>
					</subparagraph><subparagraph id="ID6468839cafe44257bde83212feb5abae"><enum>(B)</enum><header>Sponsors</header><text>An
				individual may not be enrolled in Global Entry unless the individual is
				sponsored by—</text>
						<clause id="idA73BAAE82FE74082BA8DA6450A80B144"><enum>(i)</enum><text>an international
				organization selected by the Secretary under subparagraph (A); and</text>
						</clause><clause id="id02E59DD1610847479EA2FFC35F46862C"><enum>(ii)</enum><text>the government
				that issued the passport that the individual is using to participate in Global
				Entry.</text>
						</clause></subparagraph><subparagraph id="ID0ef87c8adf874ec9adec2f88d17ced12"><enum>(C)</enum><header>Security
				requirements</header><text>An individual may not be enrolled in Global Entry
				unless the individual has successfully completed all applicable security
				requirements established by the Secretary, including cooperation from the
				applicable foreign government, to ensure that the individual does not pose a
				risk to the United States.</text>
					</subparagraph><subparagraph id="IDb276908f7ebc4a588421fdc67ab8ee55"><enum>(D)</enum><header>Discretion</header><text>The
				Secretary shall retain unreviewable discretion to offer or revoke enrollment in
				Global Entry to any
				individual.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
