		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Sacramento River National
			 Recreation Area Act of 2011</short-title></quote>.</text>
		</section><section id="ID917b735e7a4b4efa9d171f8f440b993f"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID3f30279812f24c64bc95697b4601906b"><enum>(1)</enum><header>Advisory
			 Council</header><text>The term <term>Advisory Council</term> means the
			 Sacramento River National Recreation Area Advisory Council established by
			 section 5(a).</text>
			</paragraph><paragraph id="IDa591c31efff145a88cf8cdfffd946ee7"><enum>(2)</enum><header>Management
			 plan</header><text>The term <term>management plan</term> means the management
			 plan for the Recreation Area prepared under section 4(c).</text>
			</paragraph><paragraph id="IDc5874fe99c0140619a3dda008cd8e47a"><enum>(3)</enum><header>Recreation
			 Area</header><text>The term <term>Recreation Area</term> means the Sacramento
			 River National Recreation Area.</text>
			</paragraph><paragraph id="IDaf97acafd76540f1b6c03203152bb00d"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="IDf8cf460aaf5d4c6f94da7a90bfd41ca3"><enum>(5)</enum><header>State</header><text>The
			 term <term>State</term> means the State of California.</text>
			</paragraph></section><section id="ID090afd73421d4dd58988908b6d87b552"><enum>3.</enum><header>Establishment of
			 Sacramento River National Recreation Area</header>
			<subsection id="ID65d80063f2144414a72d649f9ea2b4f8"><enum>(a)</enum><header>In
			 General</header><text>To conserve, protect, and enhance the landscape described
			 in subsection (b) in order to promote the outstanding recreational, ecological,
			 geological, scenic, cultural, and historic resources, fish and wildlife values,
			 and other resources of the landscape, there is established the Sacramento River
			 National Recreation Area in the State, to be managed by the Secretary.</text>
			</subsection><subsection id="ID28545c7396b24e828bab386829c55a8c"><enum>(b)</enum><header>Boundaries</header><text>The
			 Recreation Area shall consist of approximately 17,869 acres of Federal land in
			 Tehama County and Shasta County, California, adjacent to the Sacramento River,
			 lower Battle Creek, and lower Paynes Creek, as generally depicted on the map
			 entitled <quote>Sacramento River National Recreation Area</quote> and dated
			 February 2, 2010.</text>
			</subsection><subsection id="IDc4ff25f76b004558a31ddac382ebbf7e"><enum>(c)</enum><header>Map</header>
				<paragraph id="IDd46a890e2fff4158a722c648380aa8be"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable, but not later than 3 years, after
			 the date of enactment of this Act, the Secretary shall submit a map and legal
			 description of the Recreation Area to—</text>
					<subparagraph id="IDb244b9ab8c1f4ff7a899bb17a0c7f1c7"><enum>(A)</enum><text>the Committee on
			 Energy and Natural Resources of the Senate; and</text>
					</subparagraph><subparagraph id="ID4731d058f93243148630c3bdcd7d9596"><enum>(B)</enum><text>the Committee on
			 Natural Resources of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="ID452985794db04376a892ddc07ef42b03"><enum>(2)</enum><header>Effect</header><text>The
			 map and legal description submitted under paragraph (1) shall have the same
			 force and effect as if included in this Act, except that the Secretary may
			 correct any clerical and typographical errors in the map and legal
			 description.</text>
				</paragraph><paragraph id="ID474ae723a12e4ecd9766e101927ea16f"><enum>(3)</enum><header>Availability</header><text>Copies
			 of the map submitted under paragraph (1) shall be on file and available for
			 public inspection in—</text>
					<subparagraph id="IDa057a5347b2f4dc39ad5b4062a30d34d"><enum>(A)</enum><text>the Office of the
			 Director of the Bureau of Land Management; and</text>
					</subparagraph><subparagraph id="IDbd23c7c2c11f4dce9d9a0b40d5c4ca49"><enum>(B)</enum><text>the appropriate
			 office of the Bureau of Land Management in California.</text>
					</subparagraph></paragraph></subsection><subsection id="ID37d3ff8d6de74c639d31953388829fae"><enum>(d)</enum><header>Inclusion in
			 National Landscape Conservation System</header><text>The Recreation Area shall
			 be included in the National Landscape Conservation System.</text>
			</subsection></section><section id="IDe1c923ed2cd04fddb7f545626edab721"><enum>4.</enum><header>Management</header>
			<subsection id="ID5f52880cfc01480d8bffb9eb8ffcb695"><enum>(a)</enum><header>In
			 General</header><text>The Secretary shall manage the Recreation Area to further
			 the purposes described in section 3(a), in accordance with—</text>
				<paragraph id="ID0e8d118d19e448078a4ddb41a4797327"><enum>(1)</enum><text>this Act;</text>
				</paragraph><paragraph id="IDa68b0ee0cedf4d85abadd2ef9d4d077a"><enum>(2)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.); and</text>
				</paragraph><paragraph id="IDb318cbf824e9445298d00c3e9ace7ccf"><enum>(3)</enum><text>any other
			 applicable law.</text>
				</paragraph></subsection><subsection id="ID24948bfbaa3c4d11910ed46735c6df31"><enum>(b)</enum><header>Uses</header><text>The
			 Secretary shall only allow uses of the Recreation Area that would further the
			 purposes for which the area is designated, as described in section 3(a).</text>
			</subsection><subsection id="ID9ca970e2426b475d81c5b0ad40dad6d7"><enum>(c)</enum><header>Recreation area
			 management plan</header>
				<paragraph id="IDf3a0a1898e23488689003f48873c2974"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary shall submit a comprehensive plan for the long-range
			 protection and management of the Recreation Area to—</text>
					<subparagraph id="ID7678f7cb288744c79d7a8c2b61347eaa"><enum>(A)</enum><text>the Committee on
			 Energy and Natural Resources of the Senate; and</text>
					</subparagraph><subparagraph id="IDd728284b472747c4b72d73a7db94b5aa"><enum>(B)</enum><text>the Committee on
			 Natural Resources of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="ID0485fe9760864a2fa278b9e02dd96e78"><enum>(2)</enum><header>Contents of
			 plan</header><text>The management plan—</text>
					<subparagraph id="ID46d95ab78bac4669b2c7ddaa2d02546d"><enum>(A)</enum><text>shall describe
			 the appropriate uses and management of the Recreation Area in accordance with
			 this Act;</text>
					</subparagraph><subparagraph id="IDa0b11fa155eb42dcac2c3accfc3ad707"><enum>(B)</enum><text>may incorporate
			 any appropriate decisions, as determined by the Secretary, in accordance with
			 this Act, that are contained in any management or activity plan for the area
			 completed before the date of enactment of this Act;</text>
					</subparagraph><subparagraph id="IDece55adaa2284d15a8d6ee3a58c96075"><enum>(C)</enum><text>may incorporate
			 appropriate wildlife habitat management plans or other plans prepared for the
			 land within or adjacent to the Recreation Area before the date of enactment of
			 this Act, in accordance with this Act;</text>
					</subparagraph><subparagraph id="ID0135cb38175847418b79a6139a858bcb"><enum>(D)</enum><text>shall include a
			 monitoring and enforcement strategy;</text>
					</subparagraph><subparagraph id="IDf04b66a66ebc4b57822ed2667dc0524b"><enum>(E)</enum><text>shall be prepared
			 in consultation with—</text>
						<clause id="IDf09e5d009a024a3092bcfc067f9839dd"><enum>(i)</enum><text>the
			 Sacramento River National Recreation Area Advisory Council;</text>
						</clause><clause id="IDe24c370cecd5498d9fb7d8d1136b0385"><enum>(ii)</enum><text>appropriate
			 Federal, State, and local agencies (including Tehama County and Shasta County,
			 California);</text>
						</clause><clause id="IDab969dfea9ce427c801322ac96c6d91d"><enum>(iii)</enum><text>adjacent
			 landowners; and</text>
						</clause><clause id="ID7e17f6989300483ebb671ce3bd2b1e0c"><enum>(iv)</enum><text>other
			 stakeholders; and</text>
						</clause></subparagraph><subparagraph id="IDa36215d4324942ea9907711cba6728e4"><enum>(F)</enum><text>may use
			 information developed under any studies of land within or adjacent to the
			 Recreation Area carried out before the date of enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="IDa0457c1176b84bf294e4ae4fc722e8ef"><enum>(d)</enum><header>Acquisition of
			 property</header>
				<paragraph id="IDbc69ca91005348a393429f59cf2cb8e9"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may acquire land adjacent to the National
			 Recreation Area by purchase from willing sellers, donation, or exchange.</text>
				</paragraph><paragraph id="IDec64c7ec9c1d46d0b604c87a0dc7ca01"><enum>(2)</enum><header>Management</header><text>Any
			 land acquired under paragraph (1) shall be managed in accordance with—</text>
					<subparagraph id="IDce5e34bbf5e44306924c5f4226efe34d"><enum>(A)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.);</text>
					</subparagraph><subparagraph id="ID9d3282936ea2447691264717f3bf29fd"><enum>(B)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="IDa49ad4cff0774c53a9cb7e1910376be8"><enum>(C)</enum><text>any other
			 applicable law (including regulations).</text>
					</subparagraph></paragraph><paragraph id="ID15e59941d3104dba9f8e15e7a4af0de5"><enum>(3)</enum><header>Improved
			 access</header><text>The Secretary may acquire, through voluntary sale,
			 donation, exchange, or easement, land or interest in land to improve public
			 safety in providing access to the Recreation Area.</text>
				</paragraph></subsection><subsection id="IDbd227a8691554fcb9333a930e9ffecc9"><enum>(e)</enum><header>Private
			 Property</header>
				<paragraph id="ID98450c1dd4764290b97f13158b51b8c1"><enum>(1)</enum><header>Access to
			 private property</header>
					<subparagraph id="ID7584c84942934dedbdde42d71cbf31b2"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall provide landowners adequate access to
			 inholdings within the Recreation Area.</text>
					</subparagraph><subparagraph id="IDc4b5d653ec1c4b00a47dc5f810346d2f"><enum>(B)</enum><header>Inholdings</header><text>For
			 access purposes, private land adjacent to the Recreation Area to which there is
			 no other practicable access except through the Recreation Area shall be managed
			 as an inholding.</text>
					</subparagraph></paragraph><paragraph id="ID821760e07e1b4a16b6f5ad1a59397a76"><enum>(2)</enum><header>Use of private
			 property</header><text>Nothing in this Act affects the ownership, management,
			 or other rights relating to any non-Federal land (including any interest in any
			 non-Federal land).</text>
				</paragraph><paragraph id="ID5750b85b872d4ddaa30d52fa47e54e1e"><enum>(3)</enum><header>Buffer
			 zones</header><text>Nothing in this Act creates a protective perimeter or
			 buffer zone around any area designated as a Recreation Area by this Act.</text>
				</paragraph><paragraph id="ID0045fe38b72946598afe92d598f123ec"><enum>(4)</enum><header>Valid
			 rights</header><text>Nothing in this Act affects any easements, rights-of-way,
			 and other valid rights in existence on the date of enactment of this
			 Act.</text>
				</paragraph></subsection><subsection id="ID501af8de13f541c7b22957ee62e926b3"><enum>(f)</enum><header>Water Right
			 Exclusion</header><text>Nothing in this Act—</text>
				<paragraph id="IDa7f2b17c7981426fa1963e917052e226"><enum>(1)</enum><text>shall constitute
			 or be construed to constitute either an express or implied reservation by the
			 United States of any water or water rights with respect to the land designated
			 as a National Recreation Area by section 3(a); or</text>
				</paragraph><paragraph id="IDe1b1d88bd09b4e98b861d62a17f8391a"><enum>(2)</enum><text>shall affect any
			 water rights existing on the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="ID46fef4ba6b0a459e89fd0983cb3aa0f9"><enum>(g)</enum><header>Hunting and
			 fishing</header><text>Nothing in this Act—</text>
				<paragraph id="ID8ea3dd22f96c4e96956700a605e9da78"><enum>(1)</enum><text>limits hunting or
			 fishing; or</text>
				</paragraph><paragraph id="ID61d74bb3a3cb48768590be969cbc6519"><enum>(2)</enum><text>affects the
			 authority, jurisdiction, or responsibility of the State to manage, control, or
			 regulate fish and resident wildlife under State law (including regulations),
			 including the regulation of hunting or fishing on public land managed by the
			 Bureau of Land Management.</text>
				</paragraph></subsection><subsection id="IDc26c86012ae040b8952e1f35f593f7a3"><enum>(h)</enum><header>Motorized
			 Vehicles</header><text>Except in cases in which motorized vehicles are needed
			 for administrative purposes or to respond to an emergency, the use of motorized
			 vehicles on public land in the Recreation Area shall be permitted only on
			 routes designated by the management plan for the use of motorized
			 vehicles.</text>
			</subsection><subsection id="IDf2943172fd954b55a73de5adfd6d7d2e"><enum>(i)</enum><header>Motorized
			 Boats</header>
				<paragraph id="ID5bac34974fbf40998135381ddbfca8d5"><enum>(1)</enum><header>In
			 general</header><text>Nothing in this Act restricts the use of motorized boats
			 on the Sacramento River.</text>
				</paragraph><paragraph id="ID94491729507c45519298250e91af49f0"><enum>(2)</enum><header>Regulation</header><text>Tehama
			 County and Shasta County, California, and the California Department of Boating
			 and Waterways shall retain authority to regulate motorized boating for the
			 purpose of ensuring public safety and environmental protection.</text>
				</paragraph></subsection><subsection id="IDc4db4b03485342e6adc7f1ecb5467ce3"><enum>(j)</enum><header>Grazing</header><text>In
			 the Recreation Area, the grazing of livestock in areas in which grazing is
			 allowed as of the date of enactment of this Act shall be allowed to continue,
			 consistent with—</text>
				<paragraph id="IDdc53d607ef6c417b90b516f4f4642501"><enum>(1)</enum><text>this Act;</text>
				</paragraph><paragraph id="IDfbac299ee92d4b78aa5412e7ad5832e8"><enum>(2)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.); and</text>
				</paragraph><paragraph id="ID97362acd476d48248acde23605e1abe9"><enum>(3)</enum><text>any regulations
			 promulgated by the Secretary, acting through the Director of the Bureau of Land
			 Management.</text>
				</paragraph></subsection><subsection id="IDc8471bb333bb473f8f7a9517a3d86dfe"><enum>(k)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights, all Federal land within the Recreation Area is
			 withdrawn from—</text>
				<paragraph id="ID2194273f71f64fcd974480860d70f26f"><enum>(1)</enum><text>all forms of
			 entry, appropriation, and disposal under the public land laws;</text>
				</paragraph><paragraph id="ID1dfa6a05754141db845e6e8d2984aff6"><enum>(2)</enum><text>location, entry,
			 and patenting under the mining laws; and</text>
				</paragraph><paragraph id="ID7a60f56669bb4995b948f4bcfca41cec"><enum>(3)</enum><text>operation of the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
				</paragraph></subsection></section><section id="ID7bfe4a0104074848b8e9fa0b5ed55090"><enum>5.</enum><header>Sacramento River
			 National Recreation Area Advisory Council</header>
			<subsection id="ID1887cc95a0db4d1c882762d41e708871"><enum>(a)</enum><header>Establishment</header><text>There
			 is established an advisory council to be known as the <quote>Sacramento River
			 National Recreation Area Advisory Council</quote>.</text>
			</subsection><subsection id="ID19027ae43f4d45e29317982e307cddab"><enum>(b)</enum><header>Purpose</header><text>The
			 purposes of the Advisory Council are—</text>
				<paragraph id="IDbaa50d81aa47464692f48943e12d7629"><enum>(1)</enum><text>to ensure public
			 involvement in the management of the Recreation Area;</text>
				</paragraph><paragraph id="ID8a0732a252b7429db8978c87ee7e6939"><enum>(2)</enum><text>to provide advice
			 and recommendations to the Secretary relating to the development,
			 implementation, and amendment of the management plan; and</text>
				</paragraph><paragraph id="IDa63d984d5a704e1399525a810be13e02"><enum>(3)</enum><text>to improve
			 collaborative relationships among persons and entities interested in the
			 management of the Recreation Area.</text>
				</paragraph></subsection><subsection id="ID7a4574582a1843a6ad1d1e92dee981ff"><enum>(c)</enum><header>Composition of
			 Council</header><text>The Advisory Council shall consist of 11 members, of
			 whom—</text>
				<paragraph id="ID8a2cf322cb9f4f7c8e412e25e477d36a"><enum>(1)</enum><text>3 members shall
			 be appointed by the Secretary, based on recommendations from the Board of
			 Supervisors of Tehama County, to represent Tehama County, California;</text>
				</paragraph><paragraph id="ID8e3064b1fb8b409181a59a21753a2d4f"><enum>(2)</enum><text>1 member shall be
			 appointed by the Secretary, based on recommendations from the Board of
			 Supervisors of Shasta County, to represent Shasta County, California;</text>
				</paragraph><paragraph id="ID32f4026436684393ad1e385b1c008b8e"><enum>(3)</enum><text>1 member shall be
			 appointed by the Secretary to represent the conservation community that is
			 carrying out conservation activities in or near the Recreation Area;</text>
				</paragraph><paragraph id="ID560529cdd71442f58b8e3d4bb3b75526"><enum>(4)</enum><text>1 member shall be
			 appointed by the Secretary from the livestock grazing community in or near the
			 Recreation Area;</text>
				</paragraph><paragraph id="IDfac9108c0a194884b3c6a38c0a6611be"><enum>(5)</enum><text>1 member shall be
			 appointed by the Secretary to represent Indian tribes in or near the Recreation
			 Area; and</text>
				</paragraph><paragraph id="ID1badb2f1df154f82bf0201cf7bb38adb"><enum>(6)</enum><text>4 members shall
			 be appointed by the Secretary to represent different sectors of the recreation
			 community that are carrying out activities in or near the Recreation
			 Area.</text>
				</paragraph></subsection><subsection id="ID9cdd6582ee914f9096c1988682fa7441"><enum>(d)</enum><header>Terms</header>
				<paragraph id="IDd5a55b728911475bb193597174af9b0e"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (3), a member of the
			 Advisory Council shall be appointed to a term of 4 years.</text>
				</paragraph><paragraph id="IDbfe4c5f1c3bb4c6fb58133bd40473b3c"><enum>(2)</enum><header>Reappointment</header><text>A
			 member of the Advisory Council may be reappointed to additional 4-year
			 terms.</text>
				</paragraph><paragraph id="ID33dac945c445426d9e1dad92a9b6ced4"><enum>(3)</enum><header>Initial
			 term</header><text>Of the members initially appointed to the Advisory
			 Council—</text>
					<subparagraph id="ID8364e64633994c5ab64650b8e2f64448"><enum>(A)</enum><text>5 shall be
			 appointed for a term of 2 years; and</text>
					</subparagraph><subparagraph id="ID77fd5db9c0d641e4bba0673254d82875"><enum>(B)</enum><text>6 shall be
			 appointed for a term of 4 years.</text>
					</subparagraph></paragraph></subsection><subsection id="ID1da9163da9df40cdaf57962dcec329be"><enum>(e)</enum><header>Chairperson</header>
				<paragraph id="IDd1b752632cab4470a06ebf1b7f31b2ba"><enum>(1)</enum><header>In
			 general</header><text>The Advisory Council shall elect a member of the Advisory
			 Council to serve as chairperson of the Advisory Council.</text>
				</paragraph><paragraph id="ID930e651d7e6e447a858f653d4b97364b"><enum>(2)</enum><header>Term</header><text>The
			 chairperson of the Advisory Council shall serve for a term of 1 year.</text>
				</paragraph><paragraph id="ID53e33dcc6d934982b904a0c2aa783038"><enum>(3)</enum><header>Reelection</header><text>The
			 chairperson may be reelected for additional 1-year terms.</text>
				</paragraph></subsection><subsection id="ID97672d1010224349a167e16455631de1"><enum>(f)</enum><header>Consultation
			 With Secretary</header><text>The Secretary shall consult with the Advisory
			 Council on a periodic basis to discuss matters relating to the development and
			 implementation of the management plan for the Recreation Area.</text>
			</subsection><subsection id="IDe5e9c62e2b0043179bfe9fb1dd8e66fd"><enum>(g)</enum><header>Meetings</header>
				<paragraph id="ID6d0d396a8c644faabd632da213c132d5"><enum>(1)</enum><header>In
			 general</header><text>The Advisory Council shall meet—</text>
					<subparagraph id="IDb510e42a78a64a2a9d1ebb6b3b919fb0"><enum>(A)</enum><text>at the call of
			 the Secretary; but</text>
					</subparagraph><subparagraph id="IDd9e8ac692af346a58d43a1f755503d8a"><enum>(B)</enum><text>not less
			 than—</text>
						<clause id="IDc69942d63c174fa5bc6f6474618edd95"><enum>(i)</enum><text>4
			 times annually while the management plan is being developed, unless a majority
			 of members of the Advisory Council determine the meetings to be unnecessary;
			 and</text>
						</clause><clause id="ID249932e3055c47789a8dca7bd952c3e5"><enum>(ii)</enum><text>not less than
			 annually after the management plan is completed.</text>
						</clause></subparagraph></paragraph><paragraph id="ID6892d9c151bd446886476b5e4009e566"><enum>(2)</enum><header>Public
			 access</header><text>All meetings of the Advisory Council shall be open to the
			 public.</text>
				</paragraph><paragraph id="IDa9ec8bb29b404b9da95ef952d121e2f1"><enum>(3)</enum><header>Public
			 comments</header><text>During meetings, the Advisory Council shall provide
			 interested persons a reasonable opportunity to comment on the management of the
			 Recreation Area.</text>
				</paragraph><paragraph id="ID600db52d69d846a7b3b2cd275b5293c1"><enum>(4)</enum><header>Notice</header><text>The
			 Secretary shall provide appropriate notice of the time, date, and location of
			 each meeting of the Advisory Council.</text>
				</paragraph></subsection><subsection id="IDc13259a7b0194d4095aff507412dc3ab"><enum>(h)</enum><header>Compensation</header><text>Members
			 of the Advisory Council shall serve without pay.</text>
			</subsection><subsection id="ID661cf464403243ac8c980f8808997fef"><enum>(i)</enum><header>Termination</header>
				<paragraph id="ID80ce0e2bb2dd461aa83926cd27e9113c"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the Advisory Council
			 shall terminate on the date that is 20 years after the date of enactment of
			 this Act.</text>
				</paragraph><paragraph id="IDabbae029fd994aeba66e1bfbbfc16c32"><enum>(2)</enum><header>Exception</header><text>The
			 Secretary may, at the request of the Advisory Council, extend the authority of
			 the Advisory Council beyond the date specified in paragraph (1).</text>
				</paragraph></subsection></section><section id="ID9e57a935ae004ca0b93b2ff7742e26be"><enum>6.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as are
			 necessary.</text>
