		<official-title>To amend the Elementary and Secondary Education Act of
		  1965 regarding highly qualified teachers, growth models, adequate yearly
		  progress, Native American language programs, and parental involvement, and for
		  other purposes.</official-title>

		<section id="ID2B92B93808EB45CD8C825C3180889352" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>School Accountability Improvements
			 Act</short-title></quote>.</text>
		</section><section id="ID3249198c6b3f4690bfca40f60ac1ae81"><enum>2.</enum><header>Highly qualified
			 teachers in small, rural, or remote schools</header>
			<subsection id="ID902e80cc3a2347088b0c6f7a9d79d9dc"><enum>(a)</enum><header>Purposes</header><text>The
			 purposes of this section are—</text>
				<paragraph id="id29B7113955DA49D09A0B8BAEC24B4476"><enum>(1)</enum><text>to ensure that
			 local educational agencies have flexibility in the ways in which the local
			 educational agencies may provide instruction in core academic subjects;</text>
				</paragraph><paragraph id="id41C71BD6A8804928B178DA77384D643C"><enum>(2)</enum><text>to provide relief
			 to teachers who are assigned to teach more than 2 core academic subjects in
			 small, rural, or remote schools; and</text>
				</paragraph><paragraph id="id21400E31B1784017A10A031C4740E420"><enum>(3)</enum><text>to provide
			 assurances to students that their instructors will have appropriate knowledge
			 of the core academic subjects the instructors teach.</text>
				</paragraph></subsection><subsection id="idC46342EC97D74B93BFC44264C7CFDC36"><enum>(b)</enum><header>Highly
			 qualified teachers of multiple core academic subjects in small
			 schools</header><text>Section 1119(a) of the Elementary and Secondary Education
			 Act of 1965 (20 U.S.C. 6319(a)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id463AABBC65E44D03815BD5E05C36F519" style="OLC">
					<paragraph id="ID949f1fc242d249eebc70ee57b298d004"><enum>(4)</enum><header>Special rule
				for small, rural, or remote schools</header><text>In the case of a local
				educational agency that is unable to provide a highly qualified teacher to
				serve as an on-site classroom teacher for a core academic subject in a small,
				rural, or remote school, the local educational agency may meet the requirements
				of this section by using distance learning to provide such instruction by a
				teacher who is highly qualified in the core academic subject, as long
				as—</text>
						<subparagraph id="idD19D815F0D5C4516B49A2CE0E108723E"><enum>(A)</enum><text>the teacher who
				is highly qualified in the core academic subject—</text>
							<clause id="ID71794585456e4e2b8321e9e5a210e95c"><enum>(i)</enum><text>is responsible
				for providing at least 50 percent of the direct instruction in the core
				academic subject through distance learning;</text>
							</clause><clause id="ID16908e236acd4dc5ab9ff9236f97163b"><enum>(ii)</enum><text>is responsible
				for monitoring student progress; and</text>
							</clause><clause id="ID981d97de9ef0493596ab44da05d2a8af"><enum>(iii)</enum><text>is the teacher
				who assigns the students their grades; and</text>
							</clause></subparagraph><subparagraph id="ID76e29a1675b14683a447148ef14598f5"><enum>(B)</enum><text>an on-site
				teacher who is highly qualified in a subject other the core academic subject
				taught through distance learning is present in the classroom throughout the
				period of distance learning and provides supporting instruction and assistance
				to the
				students.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDc11d8afa2c1b46cca1fcb0a9e8fc16a5"><enum>(c)</enum><header>Small, rural,
			 or remote schools</header><text>Section 9101 of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 7801) is amended—</text>
				<paragraph id="ID7a3876db5e0e4653a7b0e23a47748de2"><enum>(1)</enum><text>by redesignating
			 paragraphs (41) through (43) as paragraphs (42) through (44),
			 respectively;</text>
				</paragraph><paragraph id="ID45908c3ccfe04ab2adb5dcfc91b068ef"><enum>(2)</enum><text>in the
			 undesignated paragraph following paragraph (39), by striking
			 <quote><header-in-text level="paragraph" style="OLC">State</header-in-text>.—The</quote> and inserting the
			 following</text>
					<quoted-block display-inline="no-display-inline" id="id3BDF67EFBA7245C0BDF6DF43AA48050B" style="OLC">
						<paragraph id="idBC3400A517584E85AB98E0DF5D73C357"><enum>(41)</enum><header>State</header><text>The</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID66dfaf244fe141e096aa13997a2d1025"><enum>(3)</enum><text>by inserting
			 after paragraph (39) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF7F914C6893B4AFB8961DB2920B15DD2" style="OLC">
						<paragraph id="ID8298459bbeee46ed88cb5f04b03dadd5"><enum>(40)</enum><header>Small, rural,
				or remote school</header><text>The term <term>small, rural, or remote
				school</term> means a school that—</text>
							<subparagraph id="IDad328ade869346a4802e5c45735ba60b"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idA056D7D7F46C43F9AC6A4A35B07667AD"><enum>(i)</enum><text>is served by a local
				educational agency that meets the eligibility requirements of section 6211(b)
				or 6221(b)(1)(B);</text>
								</clause><clause id="ID879b3afc37fe4f1789eb6f8c9d8705f8" indent="up1"><enum>(ii)</enum><text>has an average daily student
				membership of fewer than 500 students for grades kindergarten through grade 12,
				inclusive, for the full school year preceding the school year for which the
				determination is being made under this paragraph; or</text>
								</clause><clause id="ID7a07cb8b8a594a7ab4d486e801ba11ff" indent="up1"><enum>(iii)</enum><text>has an average daily membership
				of fewer than 100 students in grades 7 through 12, inclusive, for such
				preceding full school year; and</text>
								</clause></subparagraph><subparagraph id="IDabcd878c181a473a87ec871dd36a4b4e"><enum>(B)</enum><text>has, as certified
				by the State educational agency, been unable, despite reasonable efforts to do
				so, to recruit, hire, or retain a sufficient number of teachers who are highly
				qualified in the core academic subjects for the school year for which the
				determination is being made under this
				paragraph.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID3652A711126248A4A2936B8046250994"><enum>3.</enum><header>Growth
			 models</header><text display-inline="no-display-inline">Section 1111(b)(2) of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311(b)(2)) is
			 amended by adding at the end the following:</text>
			<quoted-block id="IDB2C5E7F7B5B548EF8359BCEC14A333A9" style="OLC">
				<subparagraph id="ID553D6467D0C0454F8E760B4F673F46AB"><enum>(L)</enum><header>Growth
				models</header>
					<clause id="ID8556EFD71F2144D18C6846022571B570"><enum>(i)</enum><header>In
				general</header><text>In the case of a State that desires to satisfy the
				requirements of a single, statewide State accountability system under
				subparagraph (A) through the use of a growth model, the Secretary shall approve
				such State’s use of the growth model if—</text>
						<subclause id="IDE7F26ED1A3C643EBB7F513CF36C48DBB"><enum>(I)</enum><text>the State plan
				ensures that 100 percent of students in each group described in subparagraph
				(C)(v)—</text>
							<item id="ID312246EF50134B60B74DAC5F123CE364"><enum>(aa)</enum><text>meet or exceed
				the State’s proficient level of academic achievement on the State assessments
				under paragraph (3) by the 2013–2014 school year; or</text>
							</item><item id="ID76F3E58CEE734FEFA87BFB3C6568A454"><enum>(bb)</enum><text>are making
				sufficient progress to enable each student to meet or exceed the State’s
				proficient level on such assessments for the grade level in which the student
				is enrolled not later than the student’s final year in secondary school;</text>
							</item></subclause><subclause id="ID8D545F5649E84DFAB16CAE36DF7B998C"><enum>(II)</enum><text>the State plan
				complies with all of the requirements of this paragraph, except as provided in
				clause (ii);</text>
						</subclause><subclause id="ID403F7AD3FCA44DD7815935768ADAB818"><enum>(III)</enum><text>the growth
				model is based on a fully approved assessment system;</text>
						</subclause><subclause id="ID8B59490FBC0742E293D834A332E42983"><enum>(IV)</enum><text>the growth model
				calculates growth in student proficiency for the purposes of determining
				adequate yearly progress either by individual students or by cohorts of
				students, and may use methodologies, such as confidence intervals and the
				State-approved minimum designations, that will yield statistically reliable
				data;</text>
						</subclause><subclause id="ID618CB59FD5C44562BFE02EC86D6C655C"><enum>(V)</enum><text>the growth model
				includes all students; and</text>
						</subclause><subclause id="ID0778860902634E7EA88EB4D4A3E57F80"><enum>(VI)</enum><text>the State has
				the capacity to track and manage the data for the growth model efficiently and
				effectively.</text>
						</subclause></clause><clause id="ID42C01B498B114994B19B9DE23E19CAF5"><enum>(ii)</enum><header>Special
				rule</header><text>Notwithstanding any other provision of law, for purposes of
				any provision that requires the calculation of a number or percentage of
				students who meet or exceed the proficient level of academic achievement on a
				State assessment under paragraph (3), a State using a growth model approved
				under clause (i) shall calculate such number or percentage by counting—</text>
						<subclause id="IDFFCCD2DEEA6541C4AEA314AC061D93CE"><enum>(I)</enum><text>the students who
				meet or exceed the proficient level of academic achievement on the State
				assessment; and</text>
						</subclause><subclause id="ID11FD370634354112A238C0D8FC4B0E8C"><enum>(II)</enum><text>the students
				who, as demonstrated through the growth model, are making sufficient progress
				to enable each student to meet or exceed the proficient level on the State
				assessment for the student’s corresponding grade level not later than the
				student’s final year in secondary
				school.</text>
						</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID91621051F3DA44FC9B683A862C37A956"><enum>4.</enum><header>School choice
			 and supplemental educational services</header>
			<subsection id="IDF9A2541CC1A14F24A3A566DA9CF31729"><enum>(a)</enum><header>School Choice
			 and Supplemental Educational Services</header><text>Section 1116(b) of the
			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of
			 1965</act-name> (20 U.S.C. 6316(b)) is amended—</text>
				<paragraph id="ID4EEF83474BEF4B7AA90FB04668DC1465"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="IDB53D8CB891A24466A9973AC8C2DCF2C8"><enum>(A)</enum><text>by striking
			 subparagraph (E) and inserting the following:</text>
						<quoted-block id="ID749E2B757DB1418B83A65C2B1337FC4C" style="OLC">
							<subparagraph id="IDAD940DE030F1479A87B28BAEB52B3513"><enum>(E)</enum><header>Supplemental
				educational services</header><text>In the case of a school identified for
				school improvement under this paragraph, the local educational agency shall,
				not later than the first day of the school year following such identification,
				make supplemental educational services available consistent with subsection
				(e).</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="ID0058AE6125DC4D64971B7DFAA9A8907E"><enum>(B)</enum><text>by striking
			 subparagraph (F);</text>
					</subparagraph></paragraph><paragraph id="ID7059A34EF1E044DEABD1116F59A4C083"><enum>(2)</enum><text>by striking
			 paragraph (5) and inserting the following:</text>
					<quoted-block id="IDF81BBFDB93E24726825807B30D3BA0B8" style="OLC">
						<paragraph id="IDD13CFC36B14244248D514376D14E1963"><enum>(5)</enum><header>Failure to make
				adequate yearly progress after identification</header>
							<subparagraph id="ID7E2D792B940247E4B08A9193C1D16131"><enum>(A)</enum><header>In
				general</header><text>In the case of any school served under this part that
				fails to make adequate yearly progress, as set out in the State’s plan under
				section 1111(b)(2), not later than the first day of the second school year
				following identification under paragraph (1), the local educational agency
				serving such school shall—</text>
								<clause id="ID21518CCA63E74156AD1E95F933BADA80"><enum>(i)</enum><text>provide students
				in grades 3 through 12 who are enrolled in the school and who did not meet or
				exceed the proficient level on the most recent State assessment in mathematics
				or in reading or language arts with the option to transfer to another public
				school served by the local educational agency in accordance with subparagraph
				(B);</text>
								</clause><clause id="IDA607B66D9F3543A39ECC9327AA9FA6D2"><enum>(ii)</enum><text>continue to make
				supplemental educational services available consistent with subsection (e)(1);
				and</text>
								</clause><clause id="ID58BC3C37B3E24266A7BC4AF012755D44"><enum>(iii)</enum><text>continue to
				provide technical assistance.</text>
								</clause></subparagraph><subparagraph id="IDDF8A35EBB74546DB8E901E34CC135659"><enum>(B)</enum><header>Public school
				choice</header><text>In carrying out subparagraph (A)(i) with respect to a
				school, the local educational agency serving such school shall, not later than
				the first day of the school year following such identification, provide all
				students described in subparagraph (A)(i) with the option to transfer to
				another public school served by the local educational agency, which may include
				a public charter school, that has not been identified for school improvement
				under this paragraph, unless such an option is prohibited by State law.</text>
							</subparagraph><subparagraph id="ID07F6824A0D454C94AEA07931F1F977A5"><enum>(C)</enum><header>Transfer</header><text>Students
				who use the option to transfer under subparagraph (A)(i), paragraph (7)(C)(i)
				or (8)(A)(i), or subsection (c)(10)(C)(vii), shall be enrolled in classes and
				other activities in the public school to which the students transfer in the
				same manner as all other children at the public
				school.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id16FB9B7E927E410F94B76ECB9145DF98"><enum>(3)</enum><text>in paragraph
			 (7)(C)(i), by striking <quote>all</quote>; and</text>
				</paragraph><paragraph id="ID7C7B47F890234F58AEB0CCE3E05A5A6B"><enum>(4)</enum><text>in paragraph
			 (8)(A)(i), by striking <quote>all</quote>.</text>
				</paragraph></subsection><subsection id="ID8BD399F43AAE4371B053E3C2E617C38D"><enum>(b)</enum><header>Supplemental
			 educational services providers</header><text>Section 1116(e) of the
			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of
			 1965</act-name> (20 U.S.C. 6316(e)) is amended—</text>
				<paragraph id="IDE10BDE302EA545BBA2B65EF1C9A4A229"><enum>(1)</enum><text>by redesignating
			 paragraph (12) as paragraph (13);</text>
				</paragraph><paragraph id="IDECF3E1752DC94EF5A7586043D60AEC34"><enum>(2)</enum><text>by inserting
			 after paragraph (11) the following:</text>
					<quoted-block id="ID748EBBEF216545D4938A41A284A8F102" style="OLC">
						<paragraph id="ID2EFD89C116714D9D99261000E7AB564C"><enum>(12)</enum><header>Rule regarding
				providers</header><text>Notwithstanding paragraph (13)(B), a local educational
				agency identified under subsection (c) that is required to arrange for the
				provision of supplemental educational services under this subsection may serve
				as a provider of such services in accordance with this
				subsection.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDBA25C0DD7C4942F78D317BE6304A56B9"><enum>(3)</enum><text>in paragraph
			 (13)(A) (as redesignated by paragraph (1)), by inserting <quote>, who is in any
			 of grades 3 through 12 and who did not meet or exceed the proficient level on
			 the most recent State assessment in mathematics or in reading or language
			 arts</quote> before the semicolon.</text>
				</paragraph></subsection></section><section id="IDEE6CB5D1703F4E959B641D0906CD1861"><enum>5.</enum><header>Calculating
			 adequate yearly progress for students with disabilities and students with
			 limited English proficiency</header><text display-inline="no-display-inline">Section 1116 of the
			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of
			 1965</act-name> (as amended by section 4) (20 U.S.C. 6316) is further
			 amended—</text>
			<paragraph id="ID9DCE26E0A8FB43879F94199F487D59C8"><enum>(1)</enum><text>by redesignating
			 subsection (h) as subsection (i); and</text>
			</paragraph><paragraph id="ID2C8D81E541AF48F0B8E914872012D927"><enum>(2)</enum><text>by inserting
			 after subsection (g) the following:</text>
				<quoted-block id="ID68ACF831E3974A19A2EEE54B2A2F3ACD" style="OLC">
					<subsection id="ID0D940520E63547528F75B9F6F79A1E96"><enum>(h)</enum><header>Partial
				Satisfaction of AYP</header>
						<paragraph id="IDA2ED094B74F54EBBA11B1DC00B25CDFA"><enum>(1)</enum><header>Schools</header><text>Notwithstanding
				this section or any other provision of law, in the case of a school that failed
				to make adequate yearly progress under section 1111(b)(2) solely because the
				school did not meet or exceed 1 or more annual measurable objectives set by the
				State under section 1111(b)(2)(G) for the subgroup of students with
				disabilities or students with limited English proficiency, or both such
				subgroups—</text>
							<subparagraph id="IDD72F3EC88D78404CB1417691C5520394"><enum>(A)</enum><text>if such school is
				identified for school improvement under subsection (b)(1), such school shall
				only be required to develop or revise and implement a school plan under
				subsection (b)(3) with respect to each such subgroup that did not meet or
				exceed each annual measurable objective; and</text>
							</subparagraph><subparagraph id="IDF7091C01641748638B4E2387D6C7A75C"><enum>(B)</enum><text>if such school is
				identified for corrective action or restructuring under paragraph (7) or (8) of
				subsection (b), respectively, the local educational agency serving such school
				shall not be required to implement subsection (b)(7)(C)(iv) or subsection
				(b)(8)(B), respectively, if the local educational agency demonstrates to the
				State educational agency that the school would have made adequate yearly
				progress for each assessment and for each such subgroup for the most recent
				school year if the percentage of students who met or exceeded the proficient
				level of academic achievement on the State assessment was calculated by
				counting—</text>
								<clause id="ID0E66AD61F7EE4F33AA2FBA75495D1FB0"><enum>(i)</enum><text>the students who
				met or exceeded such proficient level; and</text>
								</clause><clause id="IDCDF198F24CA4485BA17EA753C65B0550"><enum>(ii)</enum><text>the students who
				are making sufficient progress to enable each such student to meet or exceed
				the proficient level on the assessment for the student’s corresponding grade
				level not later than the student’s final year in secondary school, as
				demonstrated through a growth model that meets the requirements described in
				subclauses (III) through (VI) of section 1111(b)(2)(L)(i).</text>
								</clause></subparagraph></paragraph><paragraph id="ID9411CEFED3F948E2B3BA7914C8817758"><enum>(2)</enum><header>Local
				educational agencies</header><text>Notwithstanding this section or any other
				provision of law, in the case of a local educational agency that failed to make
				adequately yearly progress under subsection (c)(1) solely because the local
				educational agency did not meet or exceed 1 or more annual measurable
				objectives set by the State under section 1111(b)(2)(G) for the subgroup of
				students with disabilities or students with limited English proficiency, or
				both such subgroups—</text>
							<subparagraph id="idD397FB5AFB3A4515A79989A5C4AC1EB0"><enum>(A)</enum><text>if the local
				educational agency is identified for improvement under subsection (c)(3), the
				local educational agency shall only be required to develop or revise and
				implement a local educational agency plan under subsection (c)(7) with respect
				to each such subgroup that did not meet or exceed each annual measurable
				objective; and</text>
							</subparagraph><subparagraph id="id71CF44F515E0494B80B337475D47DD71"><enum>(B)</enum><text>if the local
				educational agency is identified for corrective action under subsection
				(c)(10), the State educational agency shall not be required to implement such
				subsection if the State educational agency demonstrates to the Secretary that
				the local educational agency would have made adequate yearly progress for each
				assessment and for each such subgroup if the percentage of students who met or
				exceeded the proficient level of academic achievement on the State assessment
				was calculated by counting—</text>
								<clause id="ID419E23FA0210430CB5A3005981AA318A"><enum>(i)</enum><text>the students who
				meet or exceed such proficient level; and</text>
								</clause><clause id="ID3E30BB1E728A41C2B55A443E8385ED69"><enum>(ii)</enum><text>the students who
				are making sufficient progress to enable each such student to meet or exceed
				the proficient level on the assessment for the student’s corresponding grade
				level not later than the student’s final year in secondary school, as
				demonstrated through a growth model that meets the requirements described in
				subclauses (III) through (VI) of section
				1111(b)(2)(L)(i).</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID218F152F62554F86AB8641B9058E63FC"><enum>6.</enum><header>Native American
			 language programs</header><text display-inline="no-display-inline">Section
			 1111(b)(2) of the <act-name parsable-cite="ESEA">Elementary and Secondary
			 Education Act of 1965</act-name> (as amended by section 3) (20 U.S.C.
			 6311(b)(2)) is further amended by adding at the end the following:</text>
			<quoted-block act-name="Elementary and Secondary Education Act of 1965" id="IDA6286125C25847EEB7299D6500245B88" style="OLC">
				<subparagraph id="ID51A883790A6C4ECAACD8C04F1DFA1FDB"><enum>(M)</enum><header>Native American
				language programs</header><text>Notwithstanding subparagraph (I) or any other
				provision of law—</text>
					<clause id="ID9E2F0A45763049909F7F9F2A0F2FB40E"><enum>(i)</enum><text>a
				school serving students who receive not less than a half day of daily Native
				language instruction in an American Indian language, an Alaska Native language,
				or Hawaiian in at least grades kindergarten through grade 2 for a school year
				that does not have State assessments under paragraph (3) available in the
				Native American language taught at the school as provided for in paragraph
				(3)(C)(ix)(III)—</text>
						<subclause id="ID2F9E9D584BCB424592B267EB93212F7B"><enum>(I)</enum><text>shall assess
				students in grade 3 as required under paragraph (3), and such students shall be
				included in determining if the school met the participation requirements for
				all groups of students as required under subparagraph (I)(ii) for such school
				year; and</text>
						</subclause><subclause id="ID28973FD0EF35485E8D91490DD124BDD3"><enum>(II)</enum><text>shall not
				include such assessment results for students in grade 3 in determining if the
				school met or exceeded the annual measurable objectives for all groups of
				students as required under subparagraph (I)(i) for such school year; and</text>
						</subclause></clause><clause id="IDB634C32C24C84917990E5050C3E2ABE9"><enum>(ii)</enum><text>in the case of a
				school serving students in any of grades 4 through 8 who received such Native
				American language instruction, such school shall count for purposes of
				calculating the percentage of students who met or exceeded the proficient level
				of academic achievement on the State assessment—</text>
						<subclause id="IDBA347728E1F4488EB0DC7CD1C4E8289D"><enum>(I)</enum><text>the students who
				met or exceeded such proficient level; and</text>
						</subclause><subclause id="IDC7C8667AFBCC433B9579CC348A3D3196"><enum>(II)</enum><text>the students who
				are making sufficient progress to enable each such student to meet or exceed
				such proficient level on the assessment for the student’s corresponding grade
				level by the time the student enters grade 7, as demonstrated through a growth
				model that meets the requirements described in subclauses (III) through (VI) of
				subparagraph
				(L)(i).</text>
						</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID3FF406F3C404420CA468238250AED440"><enum>7.</enum><header>Improving
			 effective parental involvement</header><text display-inline="no-display-inline">Title II of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6601 et seq.) is amended—</text>
			<paragraph id="id53DB7F1CDCE147E8B87006E69FFCFEC1"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2131(1)(B) (20 U.S.C.
			 6631(1)(B)), by inserting <quote>1 or more parent teacher associations or
			 organizations,</quote> after <quote>another local educational agency,</quote>;
			 and</text>
			</paragraph><paragraph id="idB038F261FC16426B90009603F97C4955"><enum>(2)</enum><text display-inline="yes-display-inline">in section 2134 (20 U.S.C. 6634)—</text>
				<subparagraph id="IDEB3CC6BB5C2442BF9154A90E71AB1F42"><enum>(A)</enum><text>in subsection
			 (a)(2)(C), by inserting <quote>1 or more parent teacher associations or
			 organizations,</quote> after <quote>such local educational
			 agencies,</quote>;</text>
				</subparagraph><subparagraph id="ID75494EF80C734DD59BECA1B78D9E1E51"><enum>(B)</enum><text>by redesignating
			 subsection (b) as subsection (c); and</text>
				</subparagraph><subparagraph id="ID0626D16CC1AC4CB2922924FEDA649E84"><enum>(C)</enum><text>by inserting
			 after subsection (a) the following:</text>
					<quoted-block id="IDC3148F25897F479C99DED2840CF5C21F" style="OLC">
						<subsection id="ID6B3BD0F26EB64B60AA488CF819DEC6FD"><enum>(b)</enum><header>Optional Use of
				Funds</header><text>An eligible partnership that receives a subgrant under this
				section may use subgrant funds remaining after carrying out all of the
				activities described in subsection (a) for—</text>
							<paragraph id="ID65B928711AAA4183B2EEA8F7FF53F106"><enum>(1)</enum><text>developing
				parental engagement strategies, with accountability goals, as a key part of the
				ongoing school improvement plan under section 1116(b)(3)(A) for a school
				identified for improvement under section 1116(b)(1); or</text>
							</paragraph><paragraph id="IDB78659BC287548088D7D4889A44A5AD0"><enum>(2)</enum><text>providing
				training to teachers, principals, and parents in skills that will enhance
				effective communication, which training shall—</text>
								<subparagraph id="IDE0191BAA5053411EA44B92F8CD881EC5"><enum>(A)</enum><text>include the
				research-based standards and methodologies of effective parent or family
				involvement programs; and</text>
								</subparagraph><subparagraph id="ID44639988820E42FD96933E1ABFD161D2"><enum>(B)</enum><text>to the greatest
				extent possible, involve the members of the local and State parent teacher
				association or organization in such training activities and in the
				implementation of school improvement plans under section
				1116(b)(3)(A).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="idD96EC7ECD98649F5A7B05F4818161C77"><enum>8.</enum><header>Qualifications
			 for American Indian, Alaska Native, or Native Hawaiian language, culture, or
			 history teachers</header><text display-inline="no-display-inline">Section 1119
			 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of
			 1965</act-name> (20 U.S.C. 6319) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idF57A518FD0954620932173C88F682903" style="OLC">
				<subsection id="idE8AF9ECA0A42403B8B8F461F496D71EE"><enum>(m)</enum><header>Qualifications
				for American Indian, Alaska Native, or Native Hawaiian language, culture, or
				history teachers</header>
					<paragraph id="id000C658FC91A42D293789270EBCC2902"><enum>(1)</enum><header>Language or
				culture</header>
						<subparagraph id="idFDD388B4F4704E2A821221382CB9DE50"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, the
				requirements of subsection (a) on local educational agencies and States with
				respect to highly qualified teachers, shall not apply to a teacher of American
				Indian, Alaska Native, or Native Hawaiian language or culture, whether the
				teacher is teaching on a permanent, part-time, or occasional basis.</text>
						</subparagraph><subparagraph id="id9B95A7D32236424AB1C24278C6014B9D"><enum>(B)</enum><header>Competency</header><text>A
				State may require that a local tribe or tribal organization, as defined in
				section 4 of the Indian Self-Determination and Education Assistance Act (25
				U.S.C. 450b), verify the competency of a public school teacher of American
				Indian, Alaska Native, or Native Hawaiian language or culture to teach such
				subject, to the chief administrative officer of the local educational agency or
				the chief State school officer.</text>
						</subparagraph></paragraph><paragraph id="ID90e32df71d2d4b1f974533ad8e60be7d"><enum>(2)</enum><header>History</header>
						<subparagraph id="id1A3CAF5D49BB45829F5E66141A7EEE7B"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, the
				requirements of subsection (a) on local educational agencies and States with
				respect to highly qualified teachers, shall not apply to a teacher who is a
				Native elder or other authority on American Indian, Alaska Native, or Native
				Hawaiian history who provides instruction in such subject, whether on a
				periodic or 1-time basis.</text>
						</subparagraph><subparagraph id="idF1831CC2EB2B4CED9D8A858E550A486F"><enum>(B)</enum><header>Competency</header><text>A
				State may require that a local tribe or tribal organization, as defined in
				section 4 of the Indian Self-Determination and Education Assistance Act (25
				U.S.C. 450b), verify the competency of the instructor described in subparagraph
				(A) of American Indian, Alaska Native, or Native Hawaiian history to teach such
				subject, to the chief administrative officer of the local educational agency or
				the chief State school
				officer.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDFF7F5A6EAABA4F659EC531C924B0DAE2"><enum>9.</enum><header>Conforming
			 amendments</header><text display-inline="no-display-inline">Section 1116 of the
			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of
			 1965</act-name> (as amended by sections 4 and 5) (20 U.S.C. 6316) is further
			 amended—</text>
