		  require the Secretary of Agriculture to conduct hearings to assess the
		  implications of transitioning Federal milk marketing orders from end-product
		  pricing to a competitive pay pricing system, and for other

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Dairy Producer Income Protection
			 Act of 2011</short-title></quote>.</text>
		</section><section id="IDEFC89026904F47A1B96F09F5BEC1F74E"><enum>2.</enum><header>Milk income loss
			 contract program</header>
			<subsection id="id3BA1740020E04BF489FC0AE33BE02761"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1506 of the
			 Food, Conservation, and Energy Act of 2008 (7 U.S.C. 8773) is amended—</text>
				<paragraph id="idE99C8B4311CA411CBEEA18C43678DFAA"><enum>(1)</enum><text>in subsection
			 (c)(3)—</text>
					<subparagraph id="idAB80762455C94BBEA2313038E8DABEB3"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>and</quote> after the semicolon at the end;</text>
					</subparagraph><subparagraph id="idAC425D88330B4AE58C232E8958CBE755"><enum>(B)</enum><text>in subparagraph
			 (B)—</text>
						<clause id="id74AB3FC1BB5D4B06A4265877C2E48671"><enum>(i)</enum><text>by
			 striking <quote>ending August 31, 2012</quote> and inserting
			 <quote>thereafter</quote>; and</text>
						</clause><clause id="idD75D068BE89747CBA6D25E2DBC9E1B52"><enum>(ii)</enum><text>by
			 striking <quote>; and</quote> and inserting a period; and</text>
						</clause></subparagraph><subparagraph id="idF1623E45AF5F4AB7851C533DC827F4C6"><enum>(C)</enum><text>by striking
			 subparagraph (C);</text>
					</subparagraph></paragraph><paragraph id="id47A09485642349C5AA12C8113DF8F052"><enum>(2)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="id344A886C5EE74A409ADA534B841DACA3"><enum>(A)</enum><text>in the subsection
			 heading, by striking <quote><header-in-text level="subsection" style="OLC">for
			 feed prices</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="id3E932E47D60F422AB2B943C0ADD672FE"><enum>(B)</enum><text>by adding at the
			 end the following:</text>

							<paragraph id="idF69901F367CD48D6984DDBFEFADEEB86"><enum>(4)</enum><header>Payment rate
				adjustments</header>
								<subparagraph id="id01AB1D9667214B91802E5780FF6F79DD"><enum>(A)</enum><header>In
				general</header><text>Subject to paragraphs (1) through (3), for each of fiscal
				years 2012 through 2015, the amount specified in subsection (c)(2)(A) used to
				determine the payment rate for the fiscal year shall be the payment rate for
				the preceding fiscal year, as adjusted to reflect changes for the 12-month
				period ending the preceding November 30 in the Consumer Price Index for All
				Urban Consumers published by the Bureau of Labor Statistics of the Department
				of Labor.</text>
								</subparagraph><subparagraph id="id93D48C87D80E4EA88F2C1CE6608288DE"><enum>(B)</enum><header>Termination of
				authority</header><text>Effective beginning in fiscal year 2016, the authority
				for the adjustment described in subparagraph (A) shall
				terminate.</text>
								</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idA2FF73EC9EE64B03A1296A2914087A07"><enum>(3)</enum><text>in subsection
			 (e)(2)(A)—</text>
					<subparagraph id="idB63859BCC0E5438EAC191332E88A8B32"><enum>(A)</enum><text>in clause (i), by
			 inserting <quote>and</quote> after the semicolon at the end;</text>
					</subparagraph><subparagraph id="idAF99818B4E734C0EA1DCBA08256E16F0"><enum>(B)</enum><text>in clause
			 (ii)—</text>
						<clause id="id0667E82096EA448588C792784BC6FEBA"><enum>(i)</enum><text>by
			 striking <quote>for the period</quote> and all that follows through
			 <quote>2012</quote> and inserting <quote>effective beginning October 1,
			 2008</quote>; and</text>
						</clause><clause id="idA425EDF0E76645D6A4785A6B1D18E0C1"><enum>(ii)</enum><text>by
			 striking <quote>; and</quote> and inserting a period; and</text>
						</clause></subparagraph><subparagraph id="id6F166B6C13E649B0A7DC7C33E4D920D6"><enum>(C)</enum><text>by striking
			 clause (iii); and</text>
					</subparagraph></paragraph><paragraph id="id95F8EF4AA2594792B4031109377BEF5A"><enum>(4)</enum><text display-inline="yes-display-inline">in subsections (g) and (h)(1), by striking
			 <quote>September 30, 2012</quote> each place it appears and inserting
			 <quote>September 30, 2017</quote>.</text>
				</paragraph></subsection><subsection id="id7201B2435B5E4262AF5503C54F31E547"><enum>(b)</enum><header>Offsets</header>
				<paragraph id="id2D542BB01DC84036A7B5032A9B537597"><enum>(1)</enum><header>Repeal of
			 permanent price support authority for milk</header>
					<subparagraph id="ID19726b2351c14bc5b412b8a2a804c87e"><enum>(A)</enum><header>In
			 general</header><text>Section 201 of the Agricultural Act of 1949 (7 U.S.C.
			 1446) is amended—</text>
						<clause id="IDc69d31d450ae4d9295d21f06d87ab02b"><enum>(i)</enum><text>in
			 subsection (a), by striking <quote>milk,</quote>; and</text>
						</clause><clause id="ID14573b2c0da94de2b0badd337de29e2a"><enum>(ii)</enum><text>by
			 striking subsections (c) and (d).</text>
						</clause></subparagraph><subparagraph id="IDb925afe7a28c44adaee330da46ad196e"><enum>(B)</enum><header>Conforming
			 amendment</header><text>Section 301 of the Agricultural Act of 1949 (7 U.S.C.
			 1447) is amended by inserting <quote>(other than milk)</quote> after
			 <quote>agricultural commodity</quote>.</text>
					</subparagraph></paragraph><paragraph id="H6440B515A260462395EB70D7369B17A4"><enum>(2)</enum><header>Repeal of dairy
			 product price support program</header><text>Section 1501 of the Food,
			 Conservation, and Energy Act of 2008 (7 U.S.C. 8771) is repealed.</text>
				</paragraph><paragraph id="ID9A995950293A4CF2BDAC5B5A149CA898"><enum>(3)</enum><header>Repeal of dairy
			 export incentive program</header>
					<subparagraph id="idF39896F40DB540CBB644FC5DA9F0E3BB"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 153 of the
			 Food Security Act of 1985 (15 U.S.C. 713a–14) is repealed.</text>
					</subparagraph><subparagraph id="idD98CAEA104B94B3CBB9C6054E11DF96A"><enum>(B)</enum><header>Conforming
			 amendments</header><text>Section 902(2) of the Trade Sanctions Reform and
			 Export Enhancement Act of 2000 (22 U.S.C. 7201(2)) is amended—</text>
						<clause id="id7480C3839D49484389AF3266F33064EA"><enum>(i)</enum><text>by
			 striking subparagraph (D); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idB9B3A8098A514E09B46F7529F38112A2"><enum>(ii)</enum><text>by redesignating
			 subparagraphs (E) and (F) as subparagraphs (D) and (E), respectively.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="ID96b0f441b167400f9f6a523bafdfd684"><enum>3.</enum><header>Federal milk
			 marketing reform</header>
			<subsection id="IDd76e6530ff6d49bc9dcb312f11df5c1f"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Secretary of Agriculture shall conduct hearings to assess the
			 implications of transitioning Federal milk marketing orders from end-product
			 pricing to a competitive pay pricing system.</text>
			</subsection><subsection id="ID2a0c627fd6144b0d9724a582ef2a1b63"><enum>(b)</enum><header>Requirements</header><text>In
			 conducting hearings under this section, the Secretary shall—</text>
				<paragraph id="ID52a7ff2c982a45369e281c6c76ab5ebb"><enum>(1)</enum><text>ensure that
			 market administrators conduct a thorough analysis of the reforms to the Federal
			 milk marketing orders proposed by the Maine Dairy Industry Advisory Council and
			 the reforms included in title II of the Dairy Security Act of 2011;</text>
				</paragraph><paragraph id="ID44a15ce486824ecaa1476792932d37cc"><enum>(2)</enum><text>analyze the
			 implications of transitioning from a 4-class system for milk products to a
			 2-class system;</text>
				</paragraph><paragraph id="ID12d3836c05e145c69d49bd0f610a93da"><enum>(3)</enum><text>explore methods
			 to improve signals for price discovery in the short- and long-term to allow
			 dairy producers to better use risk management tools;</text>
				</paragraph><paragraph id="IDe0d12c65e0c643f4986ad3f1e32a4a96"><enum>(4)</enum><text>assess whether a
			 2-class competitive pay pricing system for milk products would be more or less
			 transparent than the system in effect as of the day before the date of
			 enactment of this Act; and</text>
				</paragraph><paragraph id="ID7f3b201f8413452eb82d0eaad80a8a89"><enum>(5)</enum><text>analyze the
			 impact of eliminating a minimum regulated price on price volatility in dairy
			 markets.</text>
				</paragraph></subsection></section><section id="id0B662CFB964F41CCBA5D10E88C9D71AD"><enum>4.</enum><header>Budgetary
			 effects</header><text display-inline="no-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act
			 of 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the Senate Budget
			 Committee, provided that such statement has been submitted prior to the vote on
			 passage.</text>
