		<official-title>To increase transparency in the payment of judgments and
		  settlements by agencies, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Transparency in Judgment Payments
			 Act of 2011</short-title></quote>.</text>
		</section><section id="id203D3032CD154665BCBFDEF29B2835C4"><enum>2.</enum><header>Disclosure of
			 payments</header><text display-inline="no-display-inline">Section 1304 of title
			 31, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idCB80683494304CC9B2043F0A0F08D684" style="USC">
				<subsection id="id4FC993DD12CF46A694FC4FD9F113872B"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id34C4386723B24BDA9462BB1109C76414"><enum>(1)</enum><text>Not later than 30 days
				after the payment of a final judgment, award, or compromise settlement under
				this section, the Secretary of the Treasury shall publish electronically
				(including on a dedicated, publicly accessible Web site), in a manner
				consistent with applicable Federal privacy law—</text>
						<subparagraph id="id4AA19FFA2F9341A08AED45ABD88D226B" indent="up1"><enum>(A)</enum><text>the agency responsible for the
				payment;</text>
						</subparagraph><subparagraph id="id521A0F3250514715A401B00C2F20853C" indent="up1"><enum>(B)</enum><text>a citation to the provision of law
				under which the claim was made;</text>
						</subparagraph><subparagraph id="id43916FA59EF5457EAB7E785D21A45BB4" indent="up1"><enum>(C)</enum><text>the amount to be paid;</text>
						</subparagraph><subparagraph id="idD2841ACADD9E442BB4B905FFCBA77493" indent="up1"><enum>(D)</enum><text>the amount of any interest to be
				paid;</text>
						</subparagraph><subparagraph id="id6165E4B116E74626AF4DE4833759C351" indent="up1"><enum>(E)</enum><text>the amount of any attorney fees to be
				paid; and</text>
						</subparagraph><subparagraph id="idE131D260BC324D79B13D5C992606BFEC" indent="up1"><enum>(F)</enum><text>for any case filed in a court—</text>
							<clause id="id6079C7F356154DF3866AB7271EA7AC18"><enum>(i)</enum><text>the case number for the case that
				resulted in the judgment, award, or settlement; and</text>
							</clause><clause id="idF85E2B82F6D54C04982BA329C49021DD"><enum>(ii)</enum><text>the court in which the case was
				filed.</text>
							</clause></subparagraph></paragraph><paragraph id="idF38F1E2FD721434C8CFA424B4B6A369A" indent="up1"><enum>(2)</enum><text>The information published under
				paragraph (1) shall contain separate sections for claims filed in court and
				administrative claims.</text>
					</paragraph><paragraph id="id505576B4E3BE4F1E9431775211B9FF06" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idFBE6D2EC9FA246DE868D02853D0CB296"><enum>(A)</enum><text>The Secretary of the
				Treasury shall submit to the Committee on the Judiciary and the Committee on
				Homeland Security and Governmental Affairs of the Senate and the Committee on
				the Judiciary and the Committee on Oversight and Government Reform of the House
				of Representatives a quarterly report that contains—</text>
							<clause id="id020F8A12F72344EFAD071416FE827FDA" indent="up1"><enum>(i)</enum><text>any information published under
				paragraph (1) during the preceding quarter; and</text>
							</clause><clause id="idABA034BDE841401180F2D587D618FD3C" indent="up1"><enum>(ii)</enum><text>a confidential appendix that
				includes, for each case or claim described in clause (i), the identity of the
				plaintiff, counsel for the plaintiff, and the defendant.</text>
							</clause></subparagraph><subparagraph id="idD53456DB15874BC8B43A10A57CA54910" indent="up1"><enum>(B)</enum><text>A report under subparagraph (A) shall
				be exempt from disclosure under section 552 of title 5. For purposes of section
				552 of title 5, this paragraph shall be considered a statute described in
				subsection (b)(3)(B) of such section
				552.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id2FCE2D4647344CD188210EAD4588BCC3"><enum>3.</enum><header>Litigation
			 management</header>
			<subsection id="id3A9F8D041FEA4D66AE931D77C85FE130"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 6 of title 5,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0C9075EAA7AA44E2AB516843032D760B" style="USC">
					<section id="idF62391710A534D36937ABC740D42FCFB"><enum>613.</enum><header>Litigation
				management</header>
						<subsection id="idA2ACACFC8F45478EA5089C8DFF5417CE"><enum>(a)</enum><text display-inline="yes-display-inline">Each agency, in consultation with the
				Attorney General of the United States and consistent with applicable Federal
				privacy law, shall submit to the Committee on Homeland Security and
				Governmental Affairs of the Senate and the Committee on Oversight and
				Government Reform of the House of Representatives an annual report
				describing—</text>
							<paragraph id="id5FD379DE94EB489AA18F575F36743532"><enum>(1)</enum><text display-inline="yes-display-inline">any civil action filed or pending against
				the agency or any employee of the agency; and</text>
							</paragraph><paragraph id="idF524EEAE4DF648A5A3C50242FCC02573"><enum>(2)</enum><text display-inline="yes-display-inline">any settlements entered by or final
				judgments entered against the agency or any employee of the agency.</text>
							</paragraph></subsection><subsection id="id7411C66068A147DAB30D55303C0172FC"><enum>(b)</enum><text display-inline="yes-display-inline">The report required under subsection (a)
				shall include—</text>
							<paragraph id="id5A6DAC481C9748859D8470ACC7886347"><enum>(1)</enum><text display-inline="yes-display-inline">a summary of—</text>
								<subparagraph id="idA3C535AAA98145598CAB2DB22F75803F"><enum>(A)</enum><text display-inline="yes-display-inline">the number of civil actions filed, pending,
				or settled;</text>
								</subparagraph><subparagraph id="id858D4FFEB675498CBF6949DF979DC922"><enum>(B)</enum><text display-inline="yes-display-inline">the number of civil actions for which more
				than 36 months have passed since the date the action was filed;</text>
								</subparagraph><subparagraph id="id2002980DF24848B9BD9E6A56234C713D"><enum>(C)</enum><text display-inline="yes-display-inline">the number of claims—</text>
									<clause id="idCD2B29731A1343FB82D6AD2C628B698F"><enum>(i)</enum><text display-inline="yes-display-inline">made under a statute or regulation;
				and</text>
									</clause><clause id="idF1FAA1DE426B42C2A9EB3F57EC8B0B8E"><enum>(ii)</enum><text display-inline="yes-display-inline">alleging a violation of a statute or
				regulation;</text>
									</clause></subparagraph><subparagraph id="id0AE7B498167943E3A592A43B1D39B05F"><enum>(D)</enum><text display-inline="yes-display-inline">the number of judgments entered for and
				against the agency;</text>
								</subparagraph><subparagraph id="id973EF224B5844712B992A0451434E4DE"><enum>(E)</enum><text display-inline="yes-display-inline">the number of settlements or consent
				decrees involving the agency;</text>
								</subparagraph><subparagraph id="idAA6A4AEB260A4ACBA7510100B29E9475"><enum>(F)</enum><text display-inline="yes-display-inline">the number of judgments entered under
				seal;</text>
								</subparagraph><subparagraph id="id35BB5B24F48D4ECAB935A96065F95749"><enum>(G)</enum><text>the number of
				settlements or consent decrees involving a confidentiality agreement or
				order;</text>
								</subparagraph><subparagraph id="id4442543562AF4B988180C2FC48364366"><enum>(H)</enum><text display-inline="yes-display-inline">the total amount of all judgments,
				settlements, and attorney fees paid by or on behalf of the agency; and</text>
								</subparagraph><subparagraph id="id3386770E285143C399CCAC2D96BCEBCF"><enum>(I)</enum><text display-inline="yes-display-inline">the total number of agency rulemakings or
				other actions commenced due to a judgment or settlement;</text>
								</subparagraph></paragraph><paragraph id="id82C32202E5A4411CA559FCE9A26252D8"><enum>(2)</enum><text display-inline="yes-display-inline">for each filed or pending civil action, a
				summary of the action that—</text>
								<subparagraph id="id110FDF3F923945CBB7AA81E8561A51AA"><enum>(A)</enum><text display-inline="yes-display-inline">describes—</text>
									<clause id="idA4F6449F65E1413A81B2D2192133DF96"><enum>(i)</enum><text display-inline="yes-display-inline">the nature of the action;</text>
									</clause><clause id="id8F06FBBD6B8F4D70BE0ACCE8722CE0A0"><enum>(ii)</enum><text display-inline="yes-display-inline">the cause of action asserted, including
				specific statutory references;</text>
									</clause><clause id="id04968E8BCDD644378A0E564357AC5F3D"><enum>(iii)</enum><text display-inline="yes-display-inline">the nature and amount of relief
				requested;</text>
									</clause><clause id="idF6549051AF864851B48AA87F972B0E0A"><enum>(iv)</enum><text display-inline="yes-display-inline">whether the plaintiff is a party to any
				other litigation against the agency;</text>
									</clause><clause id="id0C9DD09083284C80B2E86AA0755BADAF"><enum>(v)</enum><text display-inline="yes-display-inline">whether a claim for attorney fees has been
				made, and if so, the statutory basis for the claim;</text>
									</clause><clause id="id6D9E1E5EE8A64F95BA797B79E186DAB6"><enum>(vi)</enum><text>the date the
				action was filed; and</text>
									</clause><clause id="id37E358B244324D7B974A7CD5A1882BED"><enum>(vii)</enum><text>whether more
				than 36 months have passed since the date the action was filed; and</text>
									</clause></subparagraph><subparagraph id="id5C5EE1633C6E4F099188BDACE45964F0"><enum>(B)</enum><text display-inline="yes-display-inline">identifies—</text>
									<clause id="id6842DC96D29041819E3301CAA758DF63"><enum>(i)</enum><text display-inline="yes-display-inline">the court, the presiding judge, and the
				case number; and</text>
									</clause><clause id="id0F758B3F5A1345ECB62739754020355A"><enum>(ii)</enum><text display-inline="yes-display-inline">the plaintiff and counsel for the
				plaintiff; and</text>
									</clause></subparagraph></paragraph><paragraph id="id478CED9D85E14602A5B61DC0119FEFCF"><enum>(3)</enum><text display-inline="yes-display-inline">for each settlement or final judgment,
				except a settlement or final judgment described in paragraph (4), a summary of
				the civil action that includes—</text>
								<subparagraph id="idADD18A384B9A4591A1E4446326B1B868"><enum>(A)</enum><text display-inline="yes-display-inline">the nature of the civil action;</text>
								</subparagraph><subparagraph id="id2F5038AF02964672965BA3886EDCF6CC"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of the payment or other relief
				granted or agreed;</text>
								</subparagraph><subparagraph id="id27A7D674B435497997012643616C9F19"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of attorneys fees paid;
				and</text>
								</subparagraph><subparagraph id="id4D7D1F096D134B43BD67646EA1706ACB"><enum>(D)</enum><text display-inline="yes-display-inline">the nature of any rulemaking or other
				agency action commenced due to the settlement or judgment; and</text>
								</subparagraph></paragraph><paragraph id="idF1219022669642FC859E804DEA024CC6"><enum>(4)</enum><text display-inline="yes-display-inline">for each settlement or final judgment
				involving a judgment under seal or a confidentiality agreement or order—</text>
								<subparagraph id="idE0FBCD25D5114CFDAE05F15192BFD814"><enum>(A)</enum><text display-inline="yes-display-inline">the parties to the settlement or final
				judgment; and</text>
								</subparagraph><subparagraph id="id5A1C0AB5CD484EB68F244303A7996B80"><enum>(B)</enum><text display-inline="yes-display-inline">each cause of action alleged in the
				complaint.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID5D526E662BF247EBB8A32FE651FAA44F"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text display-inline="yes-display-inline">The
			 table of sections for chapter 6 of title 5, United States Code, is amended by
			 adding at the end the following:</text>
