Sec. 301. Definitions.
3.Except as otherwise expressly provided,
whenever in this Act an amendment or repeal is expressed in terms of an
amendment to, or repeal of, a section or other provision, the reference shall
be considered to be made to a section or other provision of the Elementary and
Secondary Education Act of 1965 (20 U.S.C. 6301 et seq.).
4.Congress finds the following:
(1)Research
conclusively shows that children's experiences in the early years of life
influence the developing brain and have a significant and lasting impact upon
their ability to succeed in school and in life.
(2)All children
deserve access to high-quality early childhood education programs that support
their social, emotional, and cognitive development and help prepare them to
enter school ready to learn.
(3)Research
conclusively shows that high-quality early childhood education programs lead to
an increase in positive outcomes for children in multiple arenas,
including—
(A)improved
socialization skills;
(B)higher early
reading and early mathematics skills;
(C)decreased grade
retention;
(D)decreased special
education or remedial education services, or both;
(E)decreased
involvement with the juvenile justice system;
(F)increased
likelihood that children will graduate from high school; and
(G)increased likelihood of employment, thus
helping support America’s long-term national economic strength.
(4)High-quality early
childhood education programs provide parents the means to work and be
financially responsible for their families.
(5)Research
conclusively shows the cost-effectiveness of investments in high-quality early
childhood education programs, with cost savings ranging from $7 to $17 for
every dollar invested.
(6)Aligning and
connecting Federal and State early education efforts with the Elementary and
Secondary Education Act of 1965 (20 U.S.C. 6301 et seq.) is critical to
establishing quality care and learning opportunities for children, beginning at
birth and continuing through adulthood, thereby closing the achievement gap,
and improving high school graduation rates and college enrollment rates.
(7)Utilizing existing
partnerships, as well as instituting new partnerships, between high-quality
early childhood education programs, particularly in high-need communities, and
elementary schools will provide opportunities for meaningful transitions for
children and result in a successful elementary and secondary education
experience.
(8)Under section 1112(b)(1)(K) of the
Elementary and Secondary Education Act of 1965 (20 U.S.C. 6312(b)(1)(K)), local
educational agencies may, but are not required to, support preschool-age and
younger children through direct services or subcontracts with Head Start or
other early childhood programs, but more effort is required to ensure that
early learning programs and elementary schools are meeting the educational
needs of young children.
(9)There is
widespread acknowledgment among experts on child education that prior to
entrance in kindergarten, and in the early grades, children remain on a path of
development that requires attention to and support for their emotional, social,
and physical development and their creativity, curiosity and tenacity.
(10)Better alignment between early childhood
education programs and elementary schools, and greater support for elementary
school leadership in instituting more developmentally appropriate and
comprehensive learning approaches for young children, are widely acknowledged
within the education community as areas ripe for improvement that would lead to
better outcomes for children.
(11)Through several
laws enacted in the past 2 decades, Congress has signified its interest in
ensuring that young children’s learning opportunities are enhanced by requiring
States to develop and implement guidelines and standards to support
developmentally appropriate instruction across comprehensive domains of
learning.
<enum>I</enum><header>Improving the
academic achievement of the disadvantaged</header>
<section id="H2002B120B6C24FB38DF1F7EFCD77E6DE"><enum>101.</enum><header>Statement of
purpose</header><text display-inline="no-display-inline">Section 1001 (20
U.S.C. 6301) is amended—</text>
<paragraph id="H077C225508B14C249A0691C6C760DE24"><enum>(1)</enum><text>in paragraph
(1)—</text>
<subparagraph id="HEF3B9660A0A448ECB12A907C1CFA2590"><enum>(A)</enum><text>by inserting
<quote>and other types of</quote> after <quote>high-quality

plans</header><text display-inline="no-display-inline">Section 1111 (20 U.S.C.
6311) is amended—</text>
<paragraph id="HD953987857774C729D7D7F241E3D967C"><enum>(1)</enum><text>in subsection
(a)(1), by striking <quote>and parents,</quote> and inserting <quote>parents,
the State Advisory Council on Early Childhood Education and Care designated or
established under section 642B of the Head Start Act and preschool through
grade 20 (P–20) councils, to the extent that such councils exist, and other
community-based providers of early childhood education
programs,</quote>;</text>
</paragraph><paragraph commented="no" id="H67C4F2C243C34E1CBA9CC30B3AB0781C"><enum>(2)</enum><text>in subsection
(b)(1)—</text>
<subparagraph commented="no" id="H9586E99BF37243DC955FDCC84E984878"><enum>(A)</enum><text>in subparagraph
(A), by striking <quote>standards and challenging student academic achievement
standards</quote> and inserting <quote>standards, challenging student academic
achievement standards, and other learning standards (such as social, emotional,
and physical development and approaches to learning for children in the early
elementary grades and younger children) that are challenging and grounded in
the appropriate developmental expectations for children and

guidelines and early grades standards</header><text>Not later than 3 years
after the date of enactment of the <short-title>Continuum
of Learning Act of 2011</short-title>, the State shall carry out the
following:</text>
<clause commented="no" id="H228C0D0AD14443C6A74DF71FFFCAB667"><enum>(i)</enum><header>Early learning
guidelines</header><text>In collaboration and agreement with the State Advisory
Council on Early Childhood Education and Care designated or established under
section 642B of the Head Start Act, the State agency designated to administer
State programs under the Child Care and Development Block Grant Act of 1990 (42
U.S.C. 9858 et seq.), and the State educational agency, shall complete a review
and create or revise, as necessary, the State's early learning guidelines for
young children in order to promote developmentally appropriate, high-quality
programs so that the guidelines—</text>
<subclause id="H618C552F33E64DDB9FD77F7493AD1B17"><enum>(I)</enum><text>address infants,
toddlers, and preschool age children;</text>
</subclause><subclause id="H5CD677FFF6E046ACB7CE52C77784BC05"><enum>(II)</enum><text>are developed in
all domains of child development and learning, as appropriate, for each age
group (including language, literacy, mathematics, creative arts, science,
social studies, social and emotional development, physical development and
health, and approaches to learning);</text>
</subclause><subclause id="HD944FF02461C48C095045F6D292F5A98"><enum>(III)</enum><text>reflect research
and evidence-based developmental and learning expectations, including the
foundation for and progression in how children develop and learn the requisite
skills and content forward from one stage to the next, including what children
should know and be able to do;</text>
</subclause><subclause id="H81CEB993B80E46D3B9EF372C09EBD2DE"><enum>(IV)</enum><text>address cultural,
linguistic, and ability diversity of young children;</text>
</subclause><subclause id="H9B68D5A1B61F461ABF21DDDAEEAE439B"><enum>(V)</enum><text>can inform
teaching practices, improve professional development, and support quality
services in early childhood education programs;</text>
</subclause><subclause id="H5296C0530053476BA47672DC653B772A"><enum>(VI)</enum><text>are disseminated
to parents, educators, and other stakeholders; and</text>
</subclause><subclause id="HEA72DAC85DD54C88ABFFCECB631A6DD2"><enum>(VII)</enum><text>for preschool
age children, appropriately assist in the transition of such children to
kindergarten.</text>
</subclause></clause><clause id="HA0C36B68437549549E98A1C072EF6CD5"><enum>(ii)</enum><header>Early learning
standards</header><text>Review and revise, as needed, standards for
kindergarten through grade 3 to ensure that such standards—</text>
<subclause commented="no" id="HC920F0335D614E47A4D86EB0A701EE7A"><enum>(I)</enum><text>are developed in
all domains of child development and learning (including language, literacy,
mathematics, creative arts, science, social studies, social and emotional
development, physical development and health, and approaches to
learning);</text>
</subclause><subclause commented="no" id="H9694BE91A89F4846A96FB16B9DEC2CE3"><enum>(II)</enum><text>reflect research
and evidence-based development and learning expectations for each level and
address cultural, linguistic, and ability-level diversity; and</text>
</subclause><subclause commented="no" id="HF2DF9480E7EA4C9B8C07C2F02DCD8761"><enum>(III)</enum><text>across grade
levels, reflect progression in how children develop and learn the requisite
skills and content from earlier grades forward, including
preschool.</text>
</subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
</subparagraph></paragraph><paragraph id="H5C10A8B0C9B1465AB4926CB7D23F9732"><enum>(3)</enum><text>in subsection
(c)—</text>
<subparagraph id="H710EE0C119174CE68918CFC8E807149B"><enum>(A)</enum><text>in paragraph (13),
by striking <quote>and</quote> after the semicolon;</text>

and individual elementary schools that are participating in a program assisted
under this part to offer early childhood education programs from birth to the
age of mandatory school entry (using funds under this part), by disseminating
information through publications, conferences, and other events, that describe
how such funds may best be used to support early childhood education programs
and evidence-based and promising early childhood home visitation programs, as
described under section 511 of the Social Security Act (42 U.S.C.
711).</text>
</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
</subparagraph></paragraph><paragraph id="HC4FF46800D3B44A1B351A6909324E689"><enum>(4)</enum><text>in subsection
(d)—</text>
<subparagraph id="H7D79BC068C374463BCB7B43E4143BAC7"><enum>(A)</enum><text>in paragraph (1),
by striking <quote>and</quote> after the semicolon;</text>

</item><item commented="no" id="HA07194642C1E40F28161D4AA6C3E2446"><enum>(cc)</enum><text>the amount each
local educational agency spent using grant funds awarded under this title on
services for such children; and</text>
</item></subclause><after-quoted-block>;
and</after-quoted-block></quoted-block>
</subparagraph></paragraph><paragraph id="H44B1313C264C4A14B038C6BF6C097199"><enum>(6)</enum><text>by striking
subsection (l) and inserting the following:</text>
<quoted-block display-inline="no-display-inline" id="H8072FF024D5C4630A19C1B63674FDE3D" style="OLC">
<subsection id="H8BC1662E8A4E4F2FA10CF40239F3D38B"><enum>(l)</enum><header>Construction</header>
<paragraph id="H84EE3F33CF0F4ED69F4252E2E0EF83B7"><enum>(1)</enum><header>Student
Promotion or Graduation</header><text>Nothing in this part shall be construed
to prescribe the use of the academic assessments described in this part for
student promotion or graduation purposes.</text>
</paragraph><paragraph id="H06FF39B5C3944A7DB0A54CF7CD028CF3"><enum>(2)</enum><header>Compulsory
Education and Special Education Services</header><text>Nothing in this title
shall be construed to limit a child's right to compulsory education under State
law, or to special education and related services under the Individuals with
Disabilities Education
Act.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="HBFD0B349920842A5AAFC0806417568A5"><enum>104.</enum><header>Local
educational agency plans</header><text display-inline="no-display-inline">Section 1112 (20 U.S.C. 6312) is amended as
follows:</text>
<paragraph id="H20DADB3C543B4E0B853508774920C75F"><enum>(1)</enum><header>General plan
provisions</header><text>Subsection (b)(1) is amended as follows:</text>
<subparagraph id="H7F2BA21A6D3D467DB40081F08277DD36"><enum>(A)</enum><header>Joint
professional development</header><text>In subparagraph (D), by inserting
<quote>and joint high-quality, evidence-based professional development between
preschool through grade 3 teachers in Head Start programs and, as feasible,
other community-based early childhood education programs,</quote> after
<quote>teachers and principals,</quote>.</text>
</subparagraph><subparagraph id="HE98E6744A18C4E23A8631BEE6A864F4F"><enum>(B)</enum><header>Allowable
use</header><text>By striking subparagraph (K) and inserting the
following:</text>

in other parts of this title);</text>

school personnel;</text>
</subparagraph><subparagraph id="H39B217F924934C26BBEE5EBC51CB1016"><enum>(C)</enum><text>parents of
children in schools served under this part; and</text>
</subparagraph><subparagraph id="H79F398C53BFC4A41BB6B499B8533EEC1"><enum>(D)</enum><text>local early
childhood councils and representatives of community-based early childhood
education programs, such as Head Start, State-funded prekindergarten programs,
early intervention programs, and child care
providers.</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section id="H611D9A81D28F48429A8AEF44FE197575"><enum>105.</enum><header>Academic
assessment and local educational agency and school improvement</header><text display-inline="no-display-inline">Section 1116(c)(7)(A) (20 U.S.C. 6316(c)(7))
is amended—</text>
<paragraph id="H34F0A0DE666F4B2EBCD21DFF5D25E9EE"><enum>(1)</enum><text>by redesignating
clauses (vi), (vii), and (viii), as clauses (vii), (viii), and (ix)
respectively; and</text>
</paragraph><paragraph id="HD8280FF609E94051ADE4A4CE77ABFA5C"><enum>(2)</enum><text>by inserting after
clause (v) the following:</text>

</paragraph></section><section commented="no" id="HC66365C0C2A14B8A945733E6357878E7"><enum>106.</enum><header>Qualifications
for teachers and paraprofessionals</header><text display-inline="no-display-inline">Section 1119(a)(1) (20 U.S.C. 6319(a)(1)) is
amended by inserting <quote>and to the extent feasible, starting with the
2015–2016 school year, that teachers placed in classrooms to teach children in
the early grades of elementary school have a specialized early childhood
education teaching license, credential, or endorsement</quote> before the
period.</text>
</section><section id="HDE1EE1A298E94531B2B02DBE0DB8435B"><enum>107.</enum><header>Coordination
requirements</header><text display-inline="no-display-inline">Section 1120B (20
U.S.C. 6322) is amended to read as follows:</text>

<section id="H66BFC72384BB49AFB27A4E818F45DB91"><enum>1120B.</enum><header>Coordination
requirements</header>
<subsection id="H21BA3FF8D30C4F5E8892C8A1B1AA37EB"><enum>(a)</enum><header>In
general</header><text>Each local educational agency receiving assistance under
this part shall—</text>
<paragraph id="HAB1DC90E0AF74715A5A8413A4EB37DFC"><enum>(1)</enum><text>coordinate, as
feasible, with early childhood education programs to carry out the activities
described in subsection (b); and</text>
</paragraph><paragraph id="H4DF17EB68CF44334ACCB840D325CB9CD"><enum>(2)</enum><text>develop agreements
with Head Start agencies as specified in section 642(e)(5) of the Head Start
Act to carry out the activities described in subsection (b).</text>
</paragraph></subsection><subsection id="HEC669B295F494F00A06DB44B934E41D0"><enum>(b)</enum><header>Activities</header><text>The
activities referred to in subsection (a) are activities that increase
coordination between the local educational agency and a Head Start agency and,
to the maximum extent practicable, other entities carrying out early childhood
education programs, such as State-funded prekindergarten, and child care,
serving children who will attend the schools served by the local educational
agency, including—</text>
<paragraph id="HE04B5CA5124F4DD0A880CB82A3D3E764"><enum>(1)</enum><text>developing and
implementing with local Head Start agency staff and staff from other early
childhood education programs, a systematic and comprehensive transition
procedure, which shall include procedures for receiving records regarding such
children, transferred with the consent of a parent or guardian;</text>
</paragraph><paragraph id="H30DCDA40D06840099DFE184978424841"><enum>(2)</enum><text>establishing
channels of communication between school staff and their counterparts
(including teachers, social workers, local educational agency liaisons
designated under section 722(g)(1)(J)(ii) of the McKinney-Vento Homeless
Assistance Act (42 U.S.C. 11432(g)(1)(J)(ii)), and health staff) in such Head
Start agencies and other entities carrying out early childhood education
programs, as appropriate, to facilitate coordination of supportive service
delivery;</text>
</paragraph><paragraph id="H2E6C9B01191E4DB79584414C370A0924"><enum>(3)</enum><text>establishing
ongoing communications between the Head Start agency or other entities carrying
out early childhood education programs and the local educational agency for
developing continuity of developmentally appropriate curricular objectives and
for shared expectations for children's learning and development as the children
transition to school;</text>
</paragraph><paragraph id="HF1E0CADF19674CFC86AC31122661EA64"><enum>(4)</enum><text display-inline="yes-display-inline">conducting meetings involving parents,
kindergarten or elementary school teachers, and Head Start teachers or, if
appropriate, teachers from other early childhood education programs to discuss
the developmental and other needs of children and families, and to the
appropriate instructional and noninstructional services;</text>
</paragraph><paragraph id="HA6FA59BCDE36436DA1D721FC7C903AFC"><enum>(5)</enum><text>organizing and
participating in joint high-quality, evidence-based professional development of
school staff, Head Start program staff, and other early childhood education
program staff on—</text>
<subparagraph id="H4A9453A92DE247E39755FEEA7317F5F7"><enum>(A)</enum><text>developmentally
appropriate curricula and teaching practices;</text>
</subparagraph><subparagraph id="H2C281CDD1C714508AF75B757067D5D82"><enum>(B)</enum><text>family
engagement;</text>
</subparagraph><subparagraph id="HAF6C3DCCAC154011AE1225EAA50C3816"><enum>(C)</enum><text>support for
children with disabilities and dual language learners; and</text>
</subparagraph><subparagraph id="HA293106492C046A9B94019DA6476C647"><enum>(D)</enum><text>transitions and
continuity; and</text>
</subparagraph></paragraph><paragraph id="H549EF1AF206C4D43B75589B6BAED7C89"><enum>(6)</enum><text>linking the
educational services provided by such local educational agency with the
services provided by local Head Start agencies and, as feasible, other entities
carrying out early childhood education programs.</text>
</paragraph></subsection><subsection id="HAE545BCB6AAC4BD58D1B37EFC67A971B"><enum>(c)</enum><header>Coordination of
regulations</header><text>The Secretary shall work with the Secretary of Health
and Human Services to coordinate regulations promulgated under this part with
regulations promulgated under the Head Start Act, including reasonable
compliance
measures.</text>
</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="HECC676CA493E48458185A0BB482050F4"><enum>108.</enum><header>Prohibited use
of assessments for young children</header><text display-inline="no-display-inline">Part I of title I (20 U.S.C. 6571 et seq.)
is amended by adding at the end the following:</text>

for the purposes of program improvement and parent information; or</text>

as part of a national
