			 2012</header><text>Funds are authorized to be appropriated for fiscal year 2012
			 for necessary expenses of the Coast Guard as follows:</text>
					<paragraph id="ID1d67cc3d36be471ba632a48ed947d23d"><enum>(1)</enum><text>For the operation
			 and maintenance of the Coast Guard, $7,077,783,000 of which $24,500,000 is
			 authorized to be derived from the Oil Spill Liability Trust Fund to carry out
			 the purposes of section 1012(a)(5) of the Oil Pollution Act of 1990 (33 U.S.C.
			 2712(a)(5)).</text>
					</paragraph><paragraph id="ID7d393a124c024cfea5a11dddeaa3d501"><enum>(2)</enum><text>For the
			 acquisition, construction, rebuilding, renovation, and improvement of aids to
			 navigation, shore and offshore facilities, vessels, and aircraft, including
			 equipment related thereto, $1,421,924,000 of which—</text>
						<subparagraph id="IDd406650968fc4c399d36b05a14f0bc8e"><enum>(A)</enum><text>$20,000,000 shall
			 be derived from the Oil Spill Liability Trust Fund to carry out the purposes of
			 section 1012(a)(5) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2712">33 U.S.C.
			 2712(a)(5)</external-xref>), to remain available until expended;</text>
						</subparagraph><subparagraph id="ID011dbe67950c4e54b5610620dc8bf64a"><enum>(B)</enum><text>$642,000,000 is
			 authorized to acquire, effect major repairs to, renovate, or improve vessels,
			 small boats, and related equipment;</text>
						</subparagraph><subparagraph id="ID066a9e0691b04ab19c21b4c2a73ae81a"><enum>(C)</enum><text>$289,000,000 is
			 authorized to acquire, effect major repairs to, renovate, or improve aircraft
			 or increase aviation capability;</text>
						</subparagraph><subparagraph id="ID77e2227df6ec4ebb8bba1a75f9690b8c"><enum>(D)</enum><text>$166,140,000 is
			 authorized for other equipment;</text>
						</subparagraph><subparagraph id="ID6692a3172a134dd09547c464539b4f4e"><enum>(E)</enum><text>$213,692,000 is
			 authorized for shore facilities, aids to navigation facilities, and military
			 housing, of which not more than $14,000,000 shall be derived from the Coast
			 Guard Housing Fund; and</text>
						</subparagraph><subparagraph id="IDed2938e513ef49b7846a9366fadf8692"><enum>(F)</enum><text>$110,192,000 is
			 authorized for personnel compensation and benefits and related costs.</text>
						</subparagraph></paragraph><paragraph id="ID0be222716ede461591417cceded282fd"><enum>(3)</enum><text>For research,
			 development, testing, and evaluation of technologies, materials, and human
			 factors directly related to improving the performance of the Coast Guard's
			 mission in search and rescue, aids to navigation, marine safety, marine
			 environmental protection, enforcement of laws and treaties, ice operations,
			 oceanographic research, and defense readiness, $19,779,000.</text>
					</paragraph><paragraph id="ID8a682a98ef024c1da6870d88769dec7f"><enum>(4)</enum><text>For retired pay
			 (including the payment of obligations otherwise chargeable to lapsed
			 appropriations for this purpose), payments under the Retired Serviceman's
			 Family Protection and Survivor Benefit Plans, and payments for medical and
			 dental care of retired personnel and their dependents under chapter 55 of title
			 10, United States Code, $1,440,157,000, to remain available until
			 expended.</text>
					</paragraph><paragraph id="ID59b1ff40c39a4a7c9bfdc1e92e1a3f5f"><enum>(5)</enum><text>For alteration or
			 removal of bridges over navigable waters of the United States constituting
			 obstructions to navigation, and for personnel and administrative costs
			 associated with the Alteration of Bridges Program, $16,000,000.</text>

			 2012</header>
					<paragraph id="IDb2b45580911a4bfda07a4d66a2f3ff5e"><enum>(1)</enum><header>Active duty
			 strength</header><text>The Coast Guard is authorized an end-of-year strength
			 for active duty personnel of 47,000 for the fiscal year ending on September 30,
			 2012.</text>
					</paragraph><paragraph id="IDb02425dcafae488d9c4b8d597bf90981"><enum>(2)</enum><header>Military
			 training student loads</header><text>For fiscal year 2012, the Coast Guard is
			 authorized average military training student loads as follows:</text>
						<subparagraph id="IDa2cd2ed20fba42c1a6ade91e533abc09"><enum>(A)</enum><text>For recruit and
			 special training, 2,500 student years.</text>
						</subparagraph><subparagraph id="IDd4e22510b7a64726b009fa909cc52452"><enum>(B)</enum><text>For flight
			 training, 165 student years.</text>
						</subparagraph><subparagraph id="IDbc6bf71d30f546a8b8f185c3ecef3060"><enum>(C)</enum><text>For professional
			 training in military and civilian institutions, 350 student years.</text>
						</subparagraph><subparagraph id="IDcecd820f8a9a467a8ef46a456a34c6ad"><enum>(D)</enum><text>For officer
			 acquisition, 1,200 student years.</text>

			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/14/93">Section 93</external-xref> of title 14, United States
			 Code, is amended by adding at the end the following:</text>

						<subsection id="ID339da2e3798f4f5fa33586c81ae76cb2"><enum>(e)</enum><header>Operation and
				maintenance of Coast Guard assets and facilities</header><text>All authority,
				including programmatic budget authority, for the operation and maintenance of
				Coast Guard vessels, aircraft, systems, aides to navigation, infrastructure,
				and any other Coast Guard assets or facilities, shall be allocated to and
				vested in the Coast Guard and the department in which the Coast Guard is
				operating.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="ID9a0a00f2e205456a8ce5ea7b33a9549e"><enum>202.</enum><header>Clarification
			 of Coast Guard ice operations mission</header>
				<subsection id="id4C00C2096C2541D183CFBA3FF006626B"><enum>(a)</enum><header>Coast guard
			 provision of Federal icebreaking services</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">Chapter 5</external-xref> of title 14, United
			 States Code, is amended by inserting after section 86 the following:</text>

						<section id="idEDCB38EFF2AB4E159FC85CA353B4AB03"><enum>87.</enum><header>Provision of
				icebreaking services</header>
							<subsection id="IDee55c45d9b734c5d98589bc8dc51469b"><enum>(a)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, except as
				provided in subsection (b), the Coast Guard shall be the sole supplier of
				icebreaking services, on an advancement or reimbursable basis, to each Federal
				agency that requires icebreaking services.</text>
							</subsection><subsection id="ID79e918a09253448181f9f739918b529d"><enum>(b)</enum><header>Exception</header><text>In
				the event that a Federal agency requires icebreaking services and the Coast
				Guard is unable to provide the services, the Federal agency may acquire
				icebreaking services from another
				entity.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="ID17016efb08ee4ee7a3958116eb8ee85c"><enum>(b)</enum><header>Priority of
			 Coast Guard missions in polar regions</header>
					<paragraph id="ID8f09cb5bfc8f4744ac896f0530737bd8"><enum>(1)</enum><header>Section
			 110</header><text>Section 110(b)(2) of the Arctic Research and Policy Act of
			 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4109">15 U.S.C.
			 4109(b)(2)</external-xref>) is amended—</text>
						<subparagraph id="ID3fc9765852aa4bcebd152ce604cb75f5"><enum>(A)</enum><text>by inserting
			 <quote>to execute the statutory missions of the Coast Guard and</quote> after
			 <quote>needed</quote>; and</text>
						</subparagraph><subparagraph id="ID0ad65bba3549425c9905428cca743500"><enum>(B)</enum><text>by inserting
			 <quote>and all budget authority related to such operations</quote> after
			 <quote>projects,</quote>.</text>
						</subparagraph></paragraph><paragraph id="ID3e271b8801cd46cf94b501eeb7c03867"><enum>(2)</enum><header>Section
			 312</header><text>Section 312(c) of the Antarctic Marine Living Resources
			 Convention Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/16/2441">16 U.S.C. 2441(c)</external-xref>) is amended by
			 inserting <quote>to execute the statutory missions of the Coast Guard
			 and</quote> after <quote>needed</quote>.</text>
					</paragraph></subsection><subsection id="id799D7AD32BB54877B84B884A8BBA2730"><enum>(c)</enum><header>Conforming
			 amendment</header><text>The table of contents for
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/5">chapter
			 5</external-xref> of title 14, United States Code, is amended by inserting
			 after the item relating to section 86 the following:</text>

				<subsection id="id4E38AD970896432D92C0DE5F7902E042"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/9">Chapter 9</external-xref> of title 14, United
			 States Code, is amended by adding at the end the following:</text>

							<subsection id="ID31e5a302dc8c419188b8721777d3a396"><enum>(a)</enum><header>Required
				policy</header><text>The Commandant shall direct the Superintendent of the
				Academy to prescribe a policy on sexual harassment and sexual violence. The
				policy shall apply to each member of the Coast Guard Academy personnel. For
				purposes of this section, the term <term>Coast Guard Academy personnel</term>
				includes cadets.</text>
							</subsection><subsection id="ID3752b15929674d3696c511ed856e1ff7"><enum>(b)</enum><header>Policy
				specifications</header><text>The policy under subsection (a) shall
				include—</text>
								<paragraph id="ID7b424352001b49f1be35d296b2fe3a5c"><enum>(1)</enum><text>programs to
				promote awareness of the incidence of rape, acquaintance rape, and other sexual
				offenses of a criminal nature on and off the Academy reservation;</text>
								</paragraph><paragraph id="ID7db27d847b674287bc7e8b9050d8b70c"><enum>(2)</enum><text>the procedure that
				a victim of sexual harassment or sexual violence on or off the Academy
				reservation shall follow if the victim chooses to report the sexual harassment
				or sexual violence, including—</text>
									<subparagraph id="ID20f087bf2b2d46a89b9e6449eb3162aa"><enum>(A)</enum><text>how to report the
				alleged sexual harassment or sexual violence, including—</text>
										<clause id="idE3181B4A5C194A40A4BAD0BDE5988F16"><enum>(i)</enum><text>the name and
				contact information of each person that the victim must contact; and</text>
										</clause><clause id="id7661613CAF854D5F982B37C71729D131"><enum>(ii)</enum><text>an option for
				confidential reporting;</text>
										</clause></subparagraph><subparagraph id="IDdc127787df97491bbdc0f66b6554b0e7"><enum>(B)</enum><text>the name and
				contact information of each person that the victim can contact for assistance;
				and</text>
									</subparagraph><subparagraph id="IDb4bff7a627e44bf3996c68923fc9984d"><enum>(C)</enum><text>how to preserve
				evidence;</text>
									</subparagraph></paragraph><paragraph id="ID7f24640298744cefa39e9e862183d578"><enum>(3)</enum><text>the procedure for
				disciplinary action against a member of the Coast Guard Academy personnel who
				commits sexual harassment or sexual violence;</text>
								</paragraph><paragraph id="IDdc0d9b57f58440df84e24994bfe7bdf7"><enum>(4)</enum><text>any other
				authorized sanctions against a member of the Coast Guard Academy personnel who
				commits sexual harassment or sexual violence; and</text>
								</paragraph><paragraph id="ID769e2ec2a28c4494891e94aff3fcfb2f"><enum>(5)</enum><text>required training
				on the policy for each member of the Coast Guard Academy personnel, including a
				specific training requirement for each member of the Coast Guard Academy
				personnel who process allegations of sexual harassment or sexual
				violence.</text>
								</paragraph></subsection><subsection id="ID14d2b2f4eb0b494aac9c1d5dc2abf5ee"><enum>(c)</enum><header>Assessment</header>
								<paragraph id="ID406a536af5074abca93504c14af3c7ce"><enum>(1)</enum><header>In
				general</header><text>The Commandant shall direct the Superintendent of the
				Academy to conduct an assessment during each Academy program year to determine
				the effectiveness of the policy under subsection (a).</text>
								</paragraph><paragraph id="ID0603f2c4519a4d59b395563ba48a5e0a"><enum>(2)</enum><header>Biennial
				survey</header><text>Each assessment under paragraph (1) that is conducted
				during an odd-numbered program year shall include a survey of Coast Guard
				Academy personnel. The survey shall—</text>
									<subparagraph id="ID87b76803a6f442f1905ce58b72a7d70b"><enum>(A)</enum><text>measure—</text>
										<clause id="ID3de1b1d547d5479db59067a0a343f4a9"><enum>(i)</enum><text>the incidence,
				during that program year, of sexual harassment and sexual violence, on or off
				the Academy reservation, that were reported under subsection (b)(2); and</text>
										</clause><clause id="ID9801c100e22e47af978205b30ae55aba"><enum>(ii)</enum><text>the incidence,
				during that program year, of sexual harassment and sexual violence, on or off
				the Academy reservation, that were not reported under subsection (b)(2);
				and</text>
										</clause></subparagraph><subparagraph id="ID8ebbc775c68a406fade56fc00b1dc3bc"><enum>(B)</enum><text>assess the
				perceptions of Coast Guard Academy personnel regarding—</text>
										<clause id="IDeefef3f901c643bf97991b08ef60b182"><enum>(i)</enum><text>the policy,
				training, and procedures on sexual harassment and sexual violence;</text>
										</clause><clause id="IDabccf7c68b25432f8999a856156b6e9d"><enum>(ii)</enum><text>the enforcement
				of the policy;</text>
										</clause><clause id="IDd7ca1a4c2281499ab1c834752a1663bc"><enum>(iii)</enum><text>the incidence of
				sexual harassment and sexual violence involving Coast Guard Academy personnel;
				and</text>
										</clause><clause id="IDfec6baf5fd5e468eb53de1be06855a8f"><enum>(iv)</enum><text>any other issues
				relating to sexual harassment and sexual violence involving Coast Guard Academy
				personnel, that the Superintendent of the Academy considers relevant.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID0f26273091804d758d9eccbddee23b04"><enum>(d)</enum><header>Report</header>
								<paragraph id="IDb5fa1c2f3af94dc4b4adb4af25487713"><enum>(1)</enum><header>In
				general</header><text>The Commandant shall direct the Superintendent of the
				Academy to submit a report to the Commandant each Academy program year on
				sexual harassment and sexual violence involving a member of the Coast Guard
				Academy personnel that year.</text>
								</paragraph><paragraph id="IDba0f54a485554df1989e45f6a2b5041b"><enum>(2)</enum><header>Report
				specifications</header><text>A report under paragraph (1) shall include—</text>
									<subparagraph id="IDb23f9d1df95c4066bd601c7fb23c40a3"><enum>(A)</enum><text>the number of
				reported incidents of sexual violence, on or off the Academy reservation,
				involving a member of the Coast Guard Academy, categorized by the type of
				offence, such as rape and sexual assault;</text>
									</subparagraph><subparagraph id="id03C2BA528A1A48A698A41108ECF3FEC6"><enum>(B)</enum><text>the number of
				reported incidents under subparagraph (A) that were substantiated;</text>
									</subparagraph><subparagraph id="IDf5b2b3abf098400d9193c3921370efae"><enum>(C)</enum><text>any updates to the
				policy, training, or procedures on sexual harassment and sexual violence under
				this section during the Academy program year; and</text>
									</subparagraph><subparagraph id="ID43ea15843594493b99ca216c024d7c86"><enum>(D)</enum><text>a plan detailing
				the action that will be taken during the subsequent Academy program year to
				respond to and prevent sexual harassment and sexual violence, on or off the
				Academy reservation, involving a member of the Coast Guard Academy.</text>
									</subparagraph></paragraph><paragraph id="IDf7bc3edb47e74023bbd0cb61dc5c8d02"><enum>(3)</enum><header>Biennial
				survey</header><text>Each report under paragraph (1) that is submitted during
				an odd-numbered program year shall include the results of the survey under
				subsection (c)(2).</text>
								</paragraph><paragraph id="ID18376737f6d74016816612cf4d5660b5"><enum>(4)</enum><header>Transmission of
				report</header><text>Not later than 90 days after the date of receipt of a
				report under paragraph (1), the Commandant shall transmit a copy of the report
				and the Commandant’s comments on the report to the Committee on Commerce,
				Science, and Transportation of the Senate and the Committee on Transportation
				and Infrastructure of the House of
				Representatives.</text>

			 auxiliarists enrollment eligibility</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/14/823">Section 823</external-xref> of title
			 14, United States Code, is amended to read as follows:</text>

				shall be composed of citizens of the United States and its territories and
				possessions, and of aliens lawfully admitted for permanent residence, as
				defined in section 101(a)(20) of the Immigration and Nationality Act (8 U.S.C.

			</section></title><title changed="deleted" committee-id="SSCM00" id="idCA0203795D5D45008774D1E9C336059C" reported-display-style="strikethrough"><enum>IV</enum><header>Administration</header>
			<section id="id1C6CEE11CC9746E2B4A9D9917823F2BC"><enum>401.</enum><header>Advance
			 procurement funding</header><text display-inline="no-display-inline">With
			 respect to any Coast Guard vessel for which amounts are appropriated or
			 otherwise made available for vessels for the Coast Guard in any fiscal year,
			 the Secretary may enter into a contract or place an order, in advance of a
			 contract or order for construction of a vessel, for—</text>
				<paragraph id="ID414389c491404bd0bf5f7e22955c37a1"><enum>(1)</enum><text>materials, parts,
			 components, and effort for the vessel;</text>
				</paragraph><paragraph id="ID4648c8f89f0f40d59083c3a137e12203"><enum>(2)</enum><text>the advance
			 construction of parts or components for the vessel;</text>
				</paragraph><paragraph id="IDb107f9ec4dd3429dafc1b94a09126395"><enum>(3)</enum><text>protection and
			 storage of materials, parts, or components for the vessel; and</text>
				</paragraph><paragraph id="IDffdab627a5d241409587618af7e2d0d7"><enum>(4)</enum><text>production
			 planning, design, and other related support services that reduce the overall
			 procurement lead time of the vessel.</text>
				</paragraph></section><section commented="no" id="ID0ba2d441f77b4ea3846789e3759d1593"><enum>402.</enum><header>Authority to
			 maintain United States polar icebreaking capability</header>
				<subsection commented="no" id="ID795c67c2cac94fa9b73e8d84ef888e44"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of the department in which the Coast Guard
			 is operating shall acquire, either through new construction or the rebuilding,
			 renovating, or improving of existing Coast Guard assets, not less than 2 heavy
			 polar icebreakers for operation by the Coast Guard.</text>
				</subsection><subsection commented="no" id="ID10a31945b8ad4d9bbb9f5ebe10da358f"><enum>(b)</enum><header>Necessary
			 measures</header><text>The Secretary shall take all necessary measures,
			 including the provision of necessary operation and maintenance funding, to
			 ensure that—</text>
					<paragraph commented="no" id="ID9ab6a9d164474e8b94c409decfdc6b18"><enum>(1)</enum><text>the Coast Guard
			 maintains, at a minimum, its current vessel capacity, including 1 medium and 2
			 heavy polar icebreakers, for carrying out ice operations and other Coast Guard
			 missions in the Arctic and Antarctic, Great Lakes, and New England regions;
			 and</text>
					</paragraph><paragraph commented="no" id="ID7e582d6dd3f347b3a19bb45f8fa41b41"><enum>(2)</enum><text>any such vessels
			 that are not fully operational are brought up to, and maintained at, full
			 operational capability.</text>
					</paragraph></subsection><subsection commented="no" id="ID230c9c3de9974d29a1a559ac97bc0763"><enum>(c)</enum><header>Reimbursement</header><text>Nothing
			 in this section shall preclude the Secretary from seeking reimbursement for
			 operation and maintenance costs of the polar icebreakers from other Federal
			 agencies and entities, including foreign countries, that benefit from the use
			 of the polar icebreakers.</text>
				</subsection><subsection commented="no" id="ID68cee878660346dd93da5faf70fa8f98"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary of the department in which the Coast Guard is operating such sums as
			 may be necessary—</text>
					<paragraph commented="no" id="idB6F587DA426D4F5BA533A28B99372EEE"><enum>(1)</enum><text>to acquire the
			 polar icebreakers under subsection (a); and</text>
					</paragraph><paragraph commented="no" id="id507F579B159048AEA96F1787AAA8CC43"><enum>(2)</enum><text>to maintain and
			 operate the polar icebreaker fleet under subsection (b).</text>
					</paragraph></subsection></section><section id="ID3caefd912a4b473c97b1d513ca18c5b7"><enum>403.</enum><header>Forward
			 operating facility</header><text display-inline="no-display-inline">Not later
			 than 180 days after the date of enactment of this Act, the Secretary of the
			 department in which the Coast Guard is operating may construct or lease hangar,
			 berthing, and messing facilities in the Aleutian Island-Bering Sea operating
			 area. The facilities shall—</text>
				<paragraph id="IDa17b5d4615b4429db5d97312e6388e55"><enum>(1)</enum><text>support aircraft
			 maintenance, including exhaust ventilation, heat, engine wash system, head
			 facilities, fuel, ground support services, and electrical power; and</text>
				</paragraph><paragraph id="ID23ac75cae03c42f28b72eb0bbcdb8322"><enum>(2)</enum><text>provide shelter
			 for both current helicopter assets and those projected to be located at Air
			 Station Kodiak, Alaska for at least 20 years.</text>
				</paragraph></section><section id="IDb8f24676d5154f37842855561ee3924b"><enum>404.</enum><header>National
			 response functions</header>
				<subsection id="IDde36bc8ee4bc47f3881a2607a51135c9"><enum>(a)</enum><header>In
			 general</header><text>Section 311 of the Federal Water Pollution Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C.
			 1321</external-xref>) is amended—</text>

			 navigation</header>
			<section id="id11717F30CD824557B916A969AAB80A35"><enum>501.</enum><header>Designation of
			 St. George Harbor as a harbor of refuge</header>
				<subsection id="ID458fdc2767c34d3c8f43c5896c5c3111"><enum>(a)</enum><header>Consultation</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Commandant of
			 the Coast Guard shall consult with appropriate Federal agencies and with State
			 and local interests to determine what improvements are necessary to make the
			 harbor at St. George, Alaska, a fully functional harbor of refuge throughout
			 the year.</text>
				</subsection><subsection id="idA24B26A819D2488E94C1C2749BC70C16"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of the consultation under subsection (a) shall be to enhance safety of
			 human life at sea and protect the marine environment in the Central Bering
			 Sea.</text>
				</subsection><subsection id="IDc61a1c5095fd41179d3ae86c7c366978"><enum>(c)</enum><header>Report</header><text>Not
			 later than 90 days after making the determination under subsection (a), the
			 Commandant shall inform the Committee on Commerce, Science, and Transportation
			 of the Senate and the Committee on Transportation and Infrastructure of the
			 House of Representatives in writing of the improvements necessary to make the
			 harbor at St. George, Alaska, a fully functional harbor of refuge throughout
			 the year.</text>
				</subsection></section><section id="ID71eb4fd0c1f4495c917aac5c16fdc10a"><enum>502.</enum><header>Protection and
			 fair treatment of seafarers</header>
				<subsection id="ID752e6b74b4f94560a79546a0e18383c4"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/111">Chapter 111</external-xref> of title 46,
			 United States Code, is amended by adding at the end the following:</text>
					<quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id9D4CBF3FC78946789BEB0D12DF61E5AE" reported-display-style="strikethrough" style="USC">
						<section id="ID135fe42941914ab2b39fc6905d9e2913"><enum>11113.</enum><header>Protection
				and fair treatment of seafarers</header>
							<subsection id="ID2f3ecc9ac30447139063d6bf419b26ff"><enum>(a)</enum><header>Purpose</header><text>The
				purpose of this section shall be to ensure the protection and fair treatment of
				seafarers.</text>
							</subsection><subsection id="IDfd9fcd5dfe614f35929ca893932a13f8"><enum>(b)</enum><header>Special
				fund</header>
								<paragraph id="IDb0fbf743ac5549949362c20460d26184"><enum>(1)</enum><header>Establishment</header><text>There
				is established in the Treasury a special fund known as the <quote>Support of
				Seafarers Fund</quote>.</text>
								</paragraph><paragraph id="ID239f8fe88f194433b92cfee2f3f0d1b6"><enum>(2)</enum><header>Use of amounts
				in Fund</header><text>The amounts deposited into the Fund shall be available to
				the Secretary, without further appropriation and without fiscal year
				limitation, to—</text>
									<subparagraph id="IDd635653efb764493b3b23245240d7c85"><enum>(A)</enum><text>pay necessary
				support under subsection (c)(1); and</text>
									</subparagraph><subparagraph id="ID4933481b5087458f96948fdfc429fb99"><enum>(B)</enum><text>reimburse a
				shipowner for necessary support under subsection (c)(2).</text>
									</subparagraph></paragraph><paragraph id="ID76a03b4151f44d38a9e0f4ea8bb080cd"><enum>(3)</enum><header>Amounts credited
				to Fund</header><text>Notwithstanding any other provision of law, the Fund may
				receive—</text>
									<subparagraph id="ID4981953f10d54f238a60a147cb4fdc85"><enum>(A)</enum><text>any moneys ordered
				to be paid to the Fund as a form of credit in lieu of community service under
				<external-xref legal-doc="usc" parsable-cite="usc/18/3563">section
				3563(b)</external-xref> of title 18 to the extent permitted under paragraph
				(4);</text>
									</subparagraph><subparagraph id="ID34b8f6a25463421382ec3044e09798e6"><enum>(B)</enum><text>amounts reimbursed
				or recovered under subsection (e);</text>
									</subparagraph><subparagraph id="IDe204a9c5f49d449d945ac7418c8a4c58"><enum>(C)</enum><text>amounts
				appropriated to the Fund; and</text>
									</subparagraph><subparagraph id="IDfe14ed5dd046404abb6b663441c7c9cb"><enum>(D)</enum><text>appropriations
				available to the Secretary for transfer.</text>
									</subparagraph></paragraph><paragraph id="ID4b7299d5c8a3484192e022435694f255"><enum>(4)</enum><header>Prerequisite for
				community service credits</header><text>The Fund may receive credits under
				paragraph (3)(A) if the unobligated balance of the Fund is less than
				$5,000,000.</text>
								</paragraph><paragraph id="ID725cbe883c7e4d8e868c7bb58ab31952"><enum>(5)</enum><header>Report
				required</header>
									<subparagraph id="IDcc6ca2d9ba534830a1674cb136b7d06f"><enum>(A)</enum><header>In
				general</header><text>Except as provided under subparagraph (B), the Secretary
				may not obligate any amount in the Fund in a given fiscal year unless the
				Secretary submits a report to Congress, concurrent with the President’s budget
				submission for that fiscal year, that describes—</text>
										<clause id="ID3e66d463066044c69a46879212226490"><enum>(i)</enum><text>the amounts
				credited to the Fund under paragraph (3) for the preceding fiscal year;</text>
										</clause><clause id="ID89c98db5aa1842a39d95db6ed8a75af0"><enum>(ii)</enum><text>in detail, the
				activities for which amounts were charged; and</text>
										</clause><clause id="ID9cff92c7711247b190565c7ee70d6aeb"><enum>(iii)</enum><text>the projected
				level of expenditures from the Fund for the upcoming fiscal year, based
				on—</text>
											<subclause id="IDfc6890d884c54799aa1620564bb61bf3"><enum>(I)</enum><text>on-going
				activities; and</text>
											</subclause><subclause id="ID64e23c15cb8c403f81528eae4ec9718f"><enum>(II)</enum><text>new cases,
				derived from historic data.</text>
											</subclause></clause></subparagraph><subparagraph id="ID33c5aa9d38da469c94a4c1af7e59a72f"><enum>(B)</enum><header>Exception</header><text>Subparagraph
				(A) shall not apply to obligations during the first fiscal year during which
				amounts are credited to the Fund.</text>
									</subparagraph></paragraph><paragraph id="ID46e4cdd4ae9f4bb8829c265d0b45d103"><enum>(6)</enum><header>Fund
				manager</header><text>The Secretary shall designate a Fund manager. The Fund
				manager shall—</text>
									<subparagraph id="IDa92fe2bdf9a44f09bde70bd9726f5441"><enum>(A)</enum><text>ensure the
				visibility and accountability of transactions utilizing the Fund;</text>
									</subparagraph><subparagraph id="IDd1459e677af84d13adad769ad10a104d"><enum>(B)</enum><text>prepare the report
				under paragraph (5);</text>
									</subparagraph><subparagraph id="ID2ee3267fa1d84fa4a4c9c95521bbcb12"><enum>(C)</enum><text>monitor the
				unobligated balance of the Fund; and</text>
									</subparagraph><subparagraph id="id8DD7E12349774EBCBDAA0A2B343E8A9E"><enum>(D)</enum><text>provide notice to
				the Secretary and the Attorney General whenever the unobligated balance of the
				Fund is less than $5,000,000.</text>
									</subparagraph></paragraph></subsection><subsection id="IDee8d61b7e0034f779262289a19825264"><enum>(c)</enum><header>Authority</header><text>The
				Secretary may—</text>
								<paragraph id="IDb6fff2a5c4814334a6566e19cc1a9150"><enum>(1)</enum><text>pay, in whole or
				in part, without further appropriation and without fiscal year limitation, from
				amounts in the Fund, necessary support of—</text>
									<subparagraph id="ID85fea07d89a246c79d6e6091ee027319"><enum>(A)</enum><text>a seafarer
				that—</text>
										<clause id="idE220ADCDBF6C4B55A497A0AF32FF31BC"><enum>(i)</enum><text>enters, remains,
				or is paroled into the United States; and</text>
										</clause><clause id="id69339E464A1E4CC3AF5DCA8EFF6BFDFF"><enum>(ii)</enum><text>is involved in an
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard; and</text>
										</clause></subparagraph><subparagraph id="ID3e21caf7a80f4255b32b4424aa42665c"><enum>(B)</enum><text>a seafarer that
				the Secretary determines was abandoned in the United States; and</text>
									</subparagraph></paragraph><paragraph id="ID70587b531982440faf9b999c784d2b62"><enum>(2)</enum><text>reimburse, in
				whole or in part, without further appropriation and without fiscal year
				limitation, from amounts in the Fund, a shipowner that has filed a bond or
				surety satisfactory under subsection (f) and provides necessary support of a
				seafarer, for the costs of necessary support if the Secretary determines that
				reimbursement is necessary to avoid serious injustice.</text>
								</paragraph></subsection><subsection id="IDb9d93a1473604b80ad7e6c4fde7b6fb7"><enum>(d)</enum><header>Limitation</header><text>Nothing
				in this section shall be construed—</text>
								<paragraph id="ID55fafecb050c484aaa27a2a90c433da3"><enum>(1)</enum><text>to create a right,
				benefit, or entitlement to necessary support; or</text>
								</paragraph><paragraph id="IDe537b1f8bacc4317a91b7149c749ed15"><enum>(2)</enum><text>to compel the
				Secretary to pay or reimburse the cost of necessary support.</text>
								</paragraph></subsection><subsection id="ID7c460588e1074bd3b88de82e602526aa"><enum>(e)</enum><header>Reimbursement;
				recovery</header>
								<paragraph id="IDde62a6efaa9b4315ab88814a471b6b26"><enum>(1)</enum><header>In
				general</header><text>A shipowner shall reimburse the Fund an amount equal to
				the total amount paid from the Fund for necessary support of a seafarer plus a
				surcharge of 25 percent of the total amount if—</text>
									<subparagraph id="IDeaa1c108b8224ccdbcb44f7f80600091"><enum>(A)</enum><text>the
				shipowner—</text>
										<clause id="id6A77CF36D8B64E15A59A164E019EB91C"><enum>(i)</enum><text>during the course
				of an investigation, reporting, documentation, or adjudication of any matter
				that the Coast Guard referred to a United States Attorney or the Attorney
				General, fails to provide necessary support of a seafarer who was paroled into
				the United States to facilitate the investigation, reporting, documentation, or
				adjudication; and</text>
										</clause><clause id="id013032C3EC01453A8B4ACC676D623781"><enum>(ii)</enum><text>subsequently
				receives a criminal penalty; or</text>
										</clause></subparagraph><subparagraph id="ID89548de888f34d54940a3b3d00561bbf"><enum>(B)</enum><text>the shipowner,
				under any circumstance, abandons a seafarer in the United States, as determined
				by the Secretary.</text>
									</subparagraph></paragraph><paragraph id="ID5d6f3d57fecb4c6d93f93251c54b4786"><enum>(2)</enum><header>Enforcement</header><text>If
				a shipowner fails to reimburse the Fund under paragraph (1), the Secretary
				may—</text>
									<subparagraph id="ID138d833325f04fb1a2e9b75e6ccdb7e2"><enum>(A)</enum><text>proceed in rem
				against any vessel of the shipowner in the Federal district court for the
				district in which the vessel is found; and</text>
									</subparagraph><subparagraph id="IDebff78d1d76b432a92c19159ff5f9c75"><enum>(B)</enum><text>withhold or revoke
				the clearance required under section 60105 of any vessel of the shipowner
				wherever the vessel is found.</text>
									</subparagraph></paragraph><paragraph id="ID6e3160a553544e12a37c28ffdcd99252"><enum>(3)</enum><header>Remedy</header><text>A
				vessel may obtain clearance from the Secretary after it is withheld or revoked
				under paragraph (2)(B) if the shipowner reimburses the Fund the amount required
				under paragraph (1).</text>
								</paragraph></subsection><subsection id="ID6296da6d97eb4702979135c3dab24a8f"><enum>(f)</enum><header>Bond and
				surety</header>
								<paragraph id="ID955fcf4fe91045afa18ebd5f658790e5"><enum>(1)</enum><header>Authority</header><text>The
				Secretary may require a bond or a surety satisfactory to the Secretary as an
				alternative to withholding or revoking clearance under subsection (e)
				if—</text>
									<subparagraph id="idFF034076394143DDA10E97A47D155B2A"><enum>(A)</enum><text>in the opinion of
				the Secretary the bond or surety satisfactory is necessary to facilitate an
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard; and</text>
									</subparagraph><subparagraph id="id236AEAE93A3A47A8A7A4484BF579C924"><enum>(B)</enum><text>the surety
				corporation providing the bond or surety satisfactory is authorized by the
				Secretary of the Treasury under
				<external-xref legal-doc="usc" parsable-cite="usc/31/9305">section
				9305</external-xref> of title 31 to provide surety bonds under
				<external-xref legal-doc="usc" parsable-cite="usc/31/9304">section
				9304</external-xref> of title 31.</text>
									</subparagraph></paragraph><paragraph id="ID378733dd67be4110bd1168f6e9ec8ac7"><enum>(2)</enum><header>Application</header><text>The
				authority to require a bond or surety satisfactory or to request the
				withholding or revocation of the clearance under subsection (e) applies to any
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard.</text>
								</paragraph></subsection><subsection id="ID44b4cdcbbc1b4432863a9f066306c9a3"><enum>(g)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="IDec35e48d571e43029e67e7c8965d1dc5"><enum>(1)</enum><header>Abandons;
				abandoned</header><text>The term <term>abandons</term> or
				<term>abandoned</term> means—</text>
									<subparagraph id="id30A23E2255E5497382440B76DCBA2D88"><enum>(A)</enum><text>a shipowner's
				unilateral severance of ties with a seafarer; or</text>
									</subparagraph><subparagraph id="idCC535B2F5AF44E3ABF984B57B6A2EA1F"><enum>(B)</enum><text>a shipowner's
				failure to provide necessary support of a seafarer.</text>
									</subparagraph></paragraph><paragraph id="ID7a6eb6d4bbed4218a3b0759010e257cd"><enum>(2)</enum><header>Bond or surety
				satisfactory</header><text>The term <term>bond or surety satisfactory</term>
				means a negotiated instrument, the terms of which may, at the discretion of the
				Secretary, include provisions that require a shipowner to—</text>
									<subparagraph id="ID0a5f73b179fc43d2ba3e1c5ddee08689"><enum>(A)</enum><text>provide necessary
				support of a seafarer who has or may have information pertinent to an
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard;</text>
									</subparagraph><subparagraph id="ID2d791def74d84959a5539cfcf3c5c18f"><enum>(B)</enum><text>facilitate an
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard;</text>
									</subparagraph><subparagraph id="IDcd21ef1dbc06496aa7f4db993aa4eaf1"><enum>(C)</enum><text>stipulate to
				certain incontrovertible facts, including the ownership or operation of the
				vessel, or the authenticity of documents and things from the vessel;</text>
									</subparagraph><subparagraph id="ID538e18ee173e4f5ba3a04a985571d5ce"><enum>(D)</enum><text>facilitate service
				of correspondence and legal papers;</text>
									</subparagraph><subparagraph id="IDbffa8bc08b774810ac7688b041cd5faf"><enum>(E)</enum><text>enter an
				appearance in United States district court;</text>
									</subparagraph><subparagraph id="ID67f943a4963b4003826e522f8bed617c"><enum>(F)</enum><text>comply with
				directions regarding payment of funds;</text>
									</subparagraph><subparagraph id="IDede28670cb824b9aadc5c1df7ed096ba"><enum>(G)</enum><text>name an agent in
				the United States for service of process;</text>
									</subparagraph><subparagraph id="IDc7816ab025a5443b8c00e8a26d8b9530"><enum>(H)</enum><text>stipulate in
				United States district court as to the authenticity of certain
				documents;</text>
									</subparagraph><subparagraph id="IDdd4a3dd9417549a78ad9125168beaae4"><enum>(I)</enum><text>provide assurances
				that no discriminatory or retaliatory measures will be taken against a seafarer
				involved in an investigation, reporting, documentation, or adjudication of any
				matter that is related to the administration or enforcement of any treaty, law,
				or regulation by the Coast Guard;</text>
									</subparagraph><subparagraph id="ID7b6a0608d36044fb9b208e3f6ddc4d1e"><enum>(J)</enum><text>provide financial
				security in the form of cash, bond, or other means acceptable to the Secretary;
				and</text>
									</subparagraph><subparagraph id="ID27470216f7f84602846687a30710dd92"><enum>(K)</enum><text>provide for any
				other appropriate measures as the Secretary considers necessary to ensure the
				Government is not prejudiced by granting the clearance required under section
				60105 of title 46.</text>
									</subparagraph></paragraph><paragraph id="ID9c2f70f8b2cd4f8ea6f3253bef40bb67"><enum>(3)</enum><header>Fund</header><text>The
				term <term>Fund</term> means the Support of Seafarers Fund established under
				this section.</text>
								</paragraph><paragraph id="ID427fbc6a2b8c439ab9d25244831754f8"><enum>(4)</enum><header>Necessary
				support</header><text>The term <term>necessary support</term> means normal
				wages, lodging, subsistence, clothing, medical care (including
				hospitalization), repatriation, and any other expense the Secretary considers
				appropriate.</text>
								</paragraph><paragraph id="ID0b07e9779189460788c07fb3d4942f72"><enum>(5)</enum><header>Seafarer</header><text>The
				term <term>seafarer</term> means an alien crewman who is employed or engaged in
				any capacity on board a vessel subject to the jurisdiction of the United
				States.</text>
								</paragraph><paragraph id="ID269afcf83bc746ccad1681098420abee"><enum>(6)</enum><header>Shipowner</header><text>The
				term <term>shipowner</term> means an individual or entity that owns, has an
				ownership interest in, or operates a vessel subject to the jurisdiction of the
				United States.</text>
								</paragraph><paragraph id="ID142a0fb6820e4567a23dd7c27a68f730"><enum>(7)</enum><header>Vessel subject
				to the jurisdiction of the United States</header><text>The term <term>vessel
				subject to the jurisdiction of the United States</term> has the meaning given
				the term in section 70502(c), except that it excludes—</text>
									<subparagraph id="id38017C1BD3B2471F871FEB254C7564D4"><enum>(A)</enum><text>a vessel—</text>
										<clause id="idC63713C409584E22AB618430E18A4828"><enum>(i)</enum><text>that is owned by
				the United States, a State or political subdivision thereof, or a foreign
				nation; and</text>
										</clause><clause id="idE8C82D66C9E745B4AD991DEA07B1ECCE"><enum>(ii)</enum><text>that is not
				engaged in commerce; and</text>
										</clause></subparagraph><subparagraph id="id6ED00CA3E95E4120866BD3C615E12A61"><enum>(B)</enum><text>a bareboat—</text>
										<clause id="idF6AEE7337E5043F29AEBFAFB3B0546D5"><enum>(i)</enum><text>that is chartered
				and operated by the United States, a State or political subdivision thereof, or
				a foreign nation; and</text>
										</clause><clause id="id8A2BB9DE3EAC4D5795D588C12A9C72C5"><enum>(ii)</enum><text>that is not
				engaged in commerce.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID0bbe794b6eaf4bc0aadce8119800b5a5"><enum>(h)</enum><header>Regulations</header><text>The
				Secretary may prescribe regulations to implement this
				section.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id21F26590A92844F48E50ABE4815CF5DE"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents for
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/111">chapter 111</external-xref> of title 46,
			 United States Code, is amended by inserting after the item relating to section
			 11112 the following:</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="ID8408c6e0fb584ceda8e2961bf648da9e"><enum>504.</enum><header>Report on
			 establishment of arctic deep water port</header>
				<subsection id="ID38d678ae54be411eb0912228a293c38d"><enum>(a)</enum><header>Study</header><text>The
			 Commandant of the Coast Guard shall conduct a study on the feasibility and
			 potential of establishing a deep water sea port in the Arctic to protect and
			 advance strategic United States interests within the Arctic region.</text>
				</subsection><subsection id="IDf1a8e7a84a6c4624a7d4366cd4dfc09e"><enum>(b)</enum><header>Scope</header><text>The
			 study under subsection (a) shall include an analysis of:</text>
					<paragraph id="IDbf39215eb6d749ec82ab44522e34ae46"><enum>(1)</enum><text>the capability
			 that a deep water sea port would provide;</text>
					</paragraph><paragraph id="ID085a98f1acfc4c4cb954ba91ffa03718"><enum>(2)</enum><text>potential and
			 optimum locations for the port;</text>
					</paragraph><paragraph id="ID057ac9639dc1416aa4c5d1c9a61387f5"><enum>(3)</enum><text>the resources
			 needed to establish the port;</text>
					</paragraph><paragraph id="ID6442fc33fe50448aa7ba41c4d313d6c7"><enum>(4)</enum><text>the time frame
			 needed to establish the port;</text>
					</paragraph><paragraph id="ID793e0bb4e9d64b659d3d9c0ea972bac5"><enum>(5)</enum><text>the infrastructure
			 required to support the port; and</text>
					</paragraph><paragraph id="ID16d6863ff3994227914718c18f217030"><enum>(6)</enum><text>any other issues
			 the Secretary considers necessary to complete the study.</text>
					</paragraph></subsection><subsection id="ID0c96d928322e41288ed46ac2d547cac2"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Commandant shall
			 submit a report on the findings of the study under subsection (a) to the
			 Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives.</text>

			<section id="id75F57BAA19DB4E368FAC2983576CA7FB"><enum>601.</enum><header>Conveyance of
			 decommissioned Coast Guard cutter STORIS</header>
				<subsection id="IDf97ac69f8b2b44faa15d246f930cc8bb"><enum>(a)</enum><header>In
			 general</header><text>The Commandant of the Coast Guard shall convey the Coast
			 Guard Cutter STORIS to the Storis Museum under subsection (b) if the Commandant
			 determines that the cost to the Federal Government of conveying the Coast Guard
			 Cutter STORIS through the General Services Administration exceeds the cost to
			 the Federal Government of conveying to the STORIS Museum under subsection
			 (b).</text>
				</subsection><subsection id="IDd6a54af8199b4de894174734179e6dd2"><enum>(b)</enum><header>Coast Guard
			 cutter STORIS</header><text>Subject to the cost determination under subsection
			 (a) and after the decommissioning of the Coast Guard Cutter STORIS, the
			 Commandant of the Coast Guard shall convey, without consideration, all right,
			 title, and interest owned by the United States in the Coast Guard Cutter STORIS
			 to the Storis Museum, a nonprofit entity of Juneau, Alaska, if the head of the
			 STORIS Museum agrees—</text>
					<paragraph id="ID86532f979f5c40f4a758260542245ba7"><enum>(1)</enum><text>to use the vessel
			 as a historic memorial;</text>
					</paragraph><paragraph id="id01BD977EC117401C9FE5BFBF3FF3B79B"><enum>(2)</enum><text>to make the United
			 States Coast Guard Cutter STORIS available to the public as a museum;</text>
					</paragraph><paragraph id="idF9A9D3E7E18D46E9B19CF9461E76A1B3"><enum>(3)</enum><text>to work
			 cooperatively with other museums to provide education and memorialize the
			 maritime heritage of the United States Coast Guard Cutter STORIS and other
			 maritime activities in Alaska, the Pacific Northwest, the Arctic Ocean, and
			 adjacent oceans and seas;</text>
					</paragraph><paragraph id="ID202f9e07d6844b70857dac15840a03ec"><enum>(4)</enum><text>that the vessel
			 will not be used for commercial transportation purposes;</text>
					</paragraph><paragraph id="ID602209f9382b46d7872dcca12b2f2a4b"><enum>(5)</enum><text>to make the vessel
			 available to the United States Government if needed for use by the Commandant
			 in time of war or a national emergency or based on the critical needs of the
			 United States Coast Guard;</text>
					</paragraph><paragraph id="ID4797640ba8d8499c87953088db5eeff8"><enum>(6)</enum><text>to hold the
			 Government harmless for any claims arising from exposure to hazardous
			 materials, including asbestos and polychlorinated biphenyls (PCBs), except for
			 claims arising from the use of the United States Coast Guard Cutter STORIS by
			 the Government; and</text>
					</paragraph><paragraph id="ID9a761ed9044142b49663943da79918be"><enum>(7)</enum><text>to any other
			 conditions the Commandant considers appropriate.</text>
					</paragraph></subsection><subsection commented="no" id="id7180C4708DC6429DB4ED8CCD716A71BA"><enum>(c)</enum><header>Treatment of
			 Conveyance</header><text>The conveyance of the Coast Guard Cutter STORIS under
			 this section shall not be considered a distribution in commerce for purposes of
			 section 6(e) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C.
			 2605(e)</external-xref>).</text>
				</subsection><subsection commented="no" id="id489E1909BCA5466D92B1C6BF9E7BDD71"><enum>(d)</enum><header>Other Excess
			 Equipment</header><text>The Commandant may convey to the recipient of the Coast
			 Guard Cutter STORIS under this section any excess equipment or parts from other
			 decommissioned Coast Guard vessels for use to enhance the vessel's operability
			 and function for purposes of a public museum and historical display.</text>
				</subsection></section><section id="idDD117537531C4CA6ACD0156FAC80598B"><enum>602.</enum><header>Coast Guard
			 administrative costs</header><text display-inline="no-display-inline">Section
			 1012(a)(4) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2712">33 U.S.C. 2712(a)(4)</external-xref>) is amended by
			 striking <quote>damages</quote> and inserting <quote>damages, including the
			 cost of commercial claims processing, expert services, training, technical
			 services, and other administrative and personnel costs to process
			 claims</quote>.</text>
			</section><section id="id898328C97EFA42CE806E224619F36506"><enum>603.</enum><header>Oil spill
			 liability trust fund investment amount</header><text display-inline="no-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Secretary of the Treasury shall increase the amount
			 invested in income producing securities under section 5006(b) of the Oil

				policy</header><text>The Commandant shall direct the Superintendent of the
				Academy to prescribe a policy on sexual harassment and sexual violence. The
				policy shall apply to each member of the Coast Guard Academy personnel. For
				purposes of this section, the term <term>Coast Guard Academy personnel</term>
				includes cadets.</text>
							</subsection><subsection id="id148d6144-4cef-4a48-a600-ca8a0a54e708"><enum>(b)</enum><header>Policy
				specifications</header><text>The policy under subsection (a) shall
				include—</text>
								<paragraph id="idb5c867d0-67d4-4ccc-ab85-cbe9146390b3"><enum>(1)</enum><text>programs to promote
				awareness of the incidence of rape, acquaintance rape, and other sexual
				offenses of a criminal nature on and off the Academy reservation;</text>
								</paragraph><paragraph id="id672b02d1-5a8e-42ce-82c7-ed6b11b29b00"><enum>(2)</enum><text>the procedure that a
				victim of sexual harassment or sexual violence on or off the Academy
				reservation shall follow if the victim chooses to report the sexual harassment
				or sexual violence, including—</text>
									<subparagraph id="id1c998a29-57cb-4eb0-baf5-d6d51787c018"><enum>(A)</enum><text>how to report the alleged
				sexual harassment or sexual violence, including—</text>
										<clause id="id7182a0a6-b537-4558-b726-20cd36df88eb"><enum>(i)</enum><text>the name and contact
				information of each person that the victim must contact; and</text>
										</clause><clause id="id96fc948f-a882-4597-ab71-17e444af791d"><enum>(ii)</enum><text>an option for
				confidential reporting;</text>
										</clause></subparagraph><subparagraph id="id644b7686-178e-49b2-8fdf-f5dafc7bb9ec"><enum>(B)</enum><text>the name and contact
				information of each person that the victim can contact for assistance;
				and</text>
									</subparagraph><subparagraph id="idb17ee1c3-ea4c-40f2-803b-09939720f949"><enum>(C)</enum><text>how to preserve
				evidence;</text>
									</subparagraph></paragraph><paragraph id="idccad53ba-dc34-49bd-a291-574c742fd8c0"><enum>(3)</enum><text>the procedure for
				disciplinary action against a member of the Coast Guard Academy personnel who
				commits sexual harassment or sexual violence;</text>
								</paragraph><paragraph id="id764529a0-cba0-4b2f-ab03-3fd567c8643a"><enum>(4)</enum><text>any other authorized
				sanctions against a member of the Coast Guard Academy personnel who commits
				sexual harassment or sexual violence; and</text>
								</paragraph><paragraph id="id0559ceba-d4b7-40ab-a2e1-82485ae88334"><enum>(5)</enum><text>required training on the
				policy for each member of the Coast Guard Academy personnel, including a
				specific training requirement for each member of the Coast Guard Academy
				personnel who process allegations of sexual harassment or sexual
				violence.</text>
								</paragraph></subsection><subsection id="id9af67cf4-67c3-4a21-b10c-4fb896610adc"><enum>(c)</enum><header>Assessment</header>
								<paragraph id="idc59d5d70-4a16-43d4-9b6f-84992bbd9e53"><enum>(1)</enum><header>In
				general</header><text>The Commandant shall direct the Superintendent of the
				Academy to conduct an assessment during each Academy program year to determine
				the effectiveness of the policy under subsection (a).</text>
								</paragraph><paragraph id="ide8e019d6-f1ea-4ca8-81da-2f820472b443"><enum>(2)</enum><header>Biennial
				survey</header><text>Each assessment under paragraph (1) that is conducted
				during an odd-numbered program year shall include a survey of Coast Guard
				Academy personnel. The survey shall—</text>
									<subparagraph id="id0a79c0c9-17c7-41b2-86b0-84dda564badf"><enum>(A)</enum><text>measure—</text>
										<clause id="ide4ea64c4-49a8-43da-981a-456ebb32811f"><enum>(i)</enum><text>the incidence, during
				that program year, of sexual harassment and sexual violence, on or off the
				Academy reservation, that were reported under subsection (b)(2); and</text>
										</clause><clause id="id225b19f5-f513-4a56-a959-923dc4d2a997"><enum>(ii)</enum><text>the incidence, during
				that program year, of sexual harassment and sexual violence, on or off the
				Academy reservation, that were not reported under subsection (b)(2); and</text>
										</clause></subparagraph><subparagraph id="id87f7a017-1def-4496-bf44-97c26363eb27"><enum>(B)</enum><text>assess the perceptions of
				Coast Guard Academy personnel regarding—</text>
										<clause id="idc4ad2d97-6e5c-4b41-a789-3b4d318c50f4"><enum>(i)</enum><text>the policy, training, and
				procedures on sexual harassment and sexual violence;</text>
										</clause><clause id="id16803210-fab1-4a81-9008-cb3df7f74367"><enum>(ii)</enum><text>the enforcement of the
				policy;</text>
										</clause><clause id="id0fea5538-0bc1-436a-b9ca-62d1c1db9c00"><enum>(iii)</enum><text>the incidence of sexual
				harassment and sexual violence involving Coast Guard Academy personnel;
				and</text>
										</clause><clause id="idf8c1f892-4246-4dd0-8b1d-d698b02cd235"><enum>(iv)</enum><text>any other issues
				relating to sexual harassment and sexual violence involving Coast Guard Academy
				personnel, that the Superintendent of the Academy considers relevant.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="id61051e0a-5b81-4eef-91cd-0d1c3ab6d66a"><enum>(d)</enum><header>Report</header>
								<paragraph id="iddfe6be08-0ed3-4cf2-9c65-84739f2f1221"><enum>(1)</enum><header>In
				general</header><text>The Commandant shall direct the Superintendent of the
				Academy to submit a report to the Commandant each Academy program year on
				sexual harassment and sexual violence involving a member of the Coast Guard
				Academy personnel that year.</text>
								</paragraph><paragraph id="ida570eb3e-fe62-4877-96ce-a829249dfc37"><enum>(2)</enum><header>Report
				specifications</header><text>A report under paragraph (1) shall include—</text>
									<subparagraph id="ida2bb2d98-9988-4211-a5bf-851127e0f218"><enum>(A)</enum><text>the number of reported
				incidents of sexual violence, on or off the Academy reservation, involving a
				member of the Coast Guard Academy, categorized by the type of offence, such as
				rape and sexual assault;</text>
									</subparagraph><subparagraph id="id024b7bfe-fa99-41db-8530-c18cefa37571"><enum>(B)</enum><text>the number of reported
				incidents under subparagraph (A) that were substantiated;</text>
									</subparagraph><subparagraph id="id48190bde-f610-4d6f-80e8-5a29f990a72a"><enum>(C)</enum><text>any updates to the
				policy, training, or procedures on sexual harassment and sexual violence under
				this section during the Academy program year; and</text>
									</subparagraph><subparagraph id="id5c5d891b-1144-4b95-8ff0-588d6a2cec98"><enum>(D)</enum><text>a plan detailing the
				action that will be taken during the subsequent Academy program year to respond
				to and prevent sexual harassment and sexual violence, on or off the Academy
				reservation, involving a member of the Coast Guard Academy.</text>
									</subparagraph></paragraph><paragraph id="id5d68b0e5-70d0-47ab-9508-4e8dbed98691"><enum>(3)</enum><header>Biennial
				survey</header><text>Each report under paragraph (1) that is submitted during
				an odd-numbered program year shall include the results of the survey under
				subsection (c)(2).</text>
								</paragraph><paragraph id="idb907739b-63ab-4843-8dd7-346ab3304045"><enum>(4)</enum><header>Transmission of
				report</header><text>Not later than 90 days after the date of receipt of a

				shall be composed of citizens of the United States and its territories and
				possessions, and of aliens lawfully admitted for permanent residence, as
				defined in section 101(a)(20) of the Immigration and Nationality Act (8 U.S.C.
				1101(a)(20))—</text>
						<paragraph id="idfb9010c1-7e3e-4758-9148-bbfa5b0b630f"><enum>(1)</enum><text display-inline="yes-display-inline">who are owners, sole or part, of
				motorboats, yachts, aircraft, or radio stations; or</text>
						</paragraph><paragraph id="idfb6965a8-b227-4b14-bb3a-84d3effe87fb"><enum>(2)</enum><text display-inline="yes-display-inline">who by reason of their special training or
				experience are deemed by the Commandant to be qualified for duty in the
				Auxiliary, and who may be enrolled therein pursuant to applicable
				regulations.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title changed="added" committee-id="SSCM00" id="idfcfa675e-62f6-4719-b58e-4c3d7821f024" reported-display-style="italic"><enum>IV</enum><header>Administration</header>
			<section id="ide8057303-a879-439f-9bad-fd72f42e49f0"><enum>401.</enum><header>Advance procurement
			 funding</header><text display-inline="no-display-inline">With respect to any
			 Coast Guard vessel for which amounts are appropriated or otherwise made
			 available for vessels for the Coast Guard in any fiscal year, the Secretary may
			 enter into a contract or place an order, in advance of a contract or order for
			 construction of a vessel, for—</text>
				<paragraph id="idad695001-e302-49c1-8c45-49aeaa4bd6ef"><enum>(1)</enum><text>materials, parts,
			 components, and effort for the vessel;</text>
				</paragraph><paragraph id="id1f7065a2-2959-4f9d-99d2-69f734a08838"><enum>(2)</enum><text>the advance construction
			 of parts or components for the vessel;</text>
				</paragraph><paragraph id="id761df87e-c607-4c8d-b5ad-326e14dd8fad"><enum>(3)</enum><text>protection and storage of
			 materials, parts, or components for the vessel; and</text>
				</paragraph><paragraph id="id2f7d0167-0e4b-4db2-8075-9a3a6960388d"><enum>(4)</enum><text>production planning,
			 design, and other related support services that reduce the overall procurement
			 lead time of the vessel.</text>
				</paragraph></section><section id="idB12B3EDE81FA4609934AA825F2BCA0C2"><enum>402.</enum><header>Multiyear procurement
			 authority for Coast Guard National Security Cutters</header>
				<subsection id="id7EFA493019674036A3EE2905FB4DD2A4"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Beginning with the
			 fiscal year 2012 program year, the Secretary of the department in which the
			 Coast Guard is operating may enter, under section 2306b of title 10, United
			 States Code, into a multiyear contract for the procurement of Coast Guard
			 National Security Cutters and government-furnished equipment associated with
			 the National Security Cutter program.</text>
				</subsection><subsection id="id69A5D130162B402A8622E291849F8AC0"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may not enter into a contract
			 under subsection (a) until—</text>
					<paragraph id="idBB93D83242AB4286BCC3C1AAE1DC7847"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary submits to the Committee on
			 Commerce, Science, and Transportation of the Senate and the Committee on
			 Transportation and Infrastructure of the House of Representatives a
			 certification that the Secretary has made, with respect to the contract, each
			 of the findings under section 2306b(a) of title 10, United States Code, such as
			 the analysis referred to under subsection (c) of this section; and</text>
					</paragraph><paragraph id="id588FABCEB50149A0B2C37966FF62EB4E"><enum>(2)</enum><text display-inline="yes-display-inline">a period of 30 days has elapsed after the
			 date that the Secretary submits the certification under paragraph (1).</text>
					</paragraph></subsection><subsection id="id6804C63A7CE74E96A4DA5B7C57D909E9"><enum>(c)</enum><header>Determination of
			 Substantial Savings</header><text display-inline="yes-display-inline">In
			 conducting an analysis of substantial savings under section 2306b(a)(1) of
			 title 10, United States Code, the Secretary—</text>
					<paragraph id="idD85DD1A87C1640C5B1F6590C25E0FAA2"><enum>(1)</enum><text display-inline="yes-display-inline">may not limit the analysis to a simple
			 percentage-based metric; and</text>
					</paragraph><paragraph id="id53D783159AED49109782980B4F999626"><enum>(2)</enum><text display-inline="yes-display-inline">shall employ a full-scale analysis of cost
			 avoidance—</text>
						<subparagraph id="idCD48C92FA2AE4551B2EF19A61C64120D"><enum>(A)</enum><text display-inline="yes-display-inline">based on a multiyear procurement;
			 and</text>
						</subparagraph><subparagraph id="idA58121E8EDE24937AFD7314BB11BB423"><enum>(B)</enum><text display-inline="yes-display-inline">taking into account the potential benefit
			 any accrued savings might have for future shipbuilding programs if the cost
			 avoidance savings were subsequently utilized for further ship
			 construction.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" id="id091d07e0-c3cc-4b47-b7df-185dba483f83"><enum>403.</enum><header>Requirement to
			 maintain United States polar icebreaking capability</header>
				<subsection commented="no" id="id488490d7-fc76-47df-b12a-ece2bd6381d5"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of the department in which the Coast Guard
			 is operating shall acquire, either through new construction or the rebuilding,
			 renovating, or improving of existing Coast Guard assets, not less than 2 heavy
			 polar icebreakers for operation by the Coast Guard to avoid jeopardizing
			 national security, law enforcement, maritime safety, search and rescue,
			 environmental protection, disaster response, scientific research, natural
			 resource protection, marine pollution response and prevention, and fishery
			 enforcement missions.</text>
				</subsection><subsection commented="no" id="id40CC61FACC204A7BBB8580D6FDEBB0A2"><enum>(b)</enum><header>Necessary
			 measures</header><text>The Secretary shall take all necessary measures,
			 including the provision of necessary operation and maintenance funding, to
			 ensure that—</text>
					<paragraph commented="no" id="id875589FD86774E80808136294C504D64"><enum><added-phrase reported-display-style="italic">(1)</added-phrase></enum><text>the Coast Guard
			 maintains, at a minimum, its current vessel capacity, including 1 medium and 2
			 heavy polar icebreakers, for carrying out ice operations and other Coast Guard
			 missions in the Arctic and Antarctic, Great Lakes, and New England regions;
			 and</text>
					</paragraph><paragraph commented="no" id="id090B76586F6D4EDB95C1B2B7E387527A"><enum>(2)</enum><text>any such vessels that are
			 not fully operational are brought up to, and maintained at, full operational
			 capability.</text>
					</paragraph></subsection><subsection commented="no" id="idE74DD8185A674B90AB84DAACAE6133F4"><enum><added-phrase reported-display-style="italic">(c)</added-phrase></enum><header>Current
			 icebreaker maintenance</header><text>Until new icebreakers are acquired under
			 subsection (a), the Commandant of the Coast Guard may not—</text>
					<paragraph commented="no" id="id7C1DD4C656F1416CB0FF46CC8D6B2AEC"><enum><added-phrase reported-display-style="italic">(1)</added-phrase></enum><text>transfer,
			 relinquish ownership of, or recycle the POLAR SEA or POLAR STAR;</text>
					</paragraph><paragraph commented="no" id="id919A3C3BD3554E7599B905AE716FF23A"><enum>(2)</enum><text>remove any part of the
			 POLAR SEA unless it will be installed on the POLAR STAR before it is put in
			 ‘‘active’’ status and the Commandant certifies to the Committee on Commerce,
			 Science, and Transportation and the Committee on Armed Services of the Senate
			 and the Committee on Transportation and Infrastructure and the Committee on
			 Armed Services of the House of Representatives that it is not possible for the
			 POLAR STAR to function properly without doing so;</text>
					</paragraph><paragraph commented="no" id="idB1BD103CA80B4229AA98E15CB407C8D4"><enum>(3)</enum><text>change the existing
			 homeport of any Coast Guard icebreaker; or</text>
					</paragraph><paragraph commented="no" id="idC99E69A071224A9C99F73D8C09190150"><enum>(4)</enum><text>expend any funds—</text>
						<subparagraph commented="no" id="id155003CB926C42F59D433AECF646C3D5"><enum><added-phrase reported-display-style="italic">(A)</added-phrase></enum><text>for any expenses
			 directly or indirectly associated with the decommissioning of either of the
			 vessels, including expenses for dock use or other goods and services;</text>
						</subparagraph><subparagraph commented="no" id="id6C79DD94A03944C38122F3E9855866B1"><enum>(B)</enum><text>for any personnel
			 expenses directly or indirectly associated with the decommissioning of either
			 of the vessels, including expenses for a decommissioning officer;</text>
						</subparagraph><subparagraph commented="no" id="id3D8A984B82734C67BAE2E6DA0CC1087E"><enum>(C)</enum><text>for any expenses
			 associated with a decommissioning ceremony for either of the vessels;</text>
						</subparagraph><subparagraph commented="no" id="idA14110219E784794AAFEB94D68953F14"><enum>(D)</enum><text>to appoint a
			 decommissioning officer to be affiliated with either of the vessels; or</text>
						</subparagraph><subparagraph commented="no" id="idBCAA4A5F93BD4F4B881F30126CAB446E"><enum>(E)</enum><text>to place either of the
			 vessels in inactive status.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="id929F5E7695A848DCAA00240B279A8F99"><enum><added-phrase reported-display-style="italic">(d)</added-phrase></enum><header>Reimbursement</header><text>Nothing
			 in this section shall preclude the Secretary from seeking reimbursement for
			 operation and maintenance costs of the polar icebreakers from other Federal
			 agencies and entities, including foreign governments, that benefit from the use
			 of the polar icebreakers.</text>
				</subsection><subsection commented="no" id="id315089F0751249789688BB74B155D0B0"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary of the department in which the Coast Guard is operating such sums as
			 may be necessary—</text>
					<paragraph commented="no" id="id3069ce34-61f2-4f52-bf24-49381b955492"><enum>(1)</enum><text>to acquire the polar
			 icebreakers under subsection (a); and</text>
					</paragraph><paragraph commented="no" id="id39bcf873-1ca1-4407-8a42-1c02df3c9c70"><enum>(2)</enum><text>to maintain and operate
			 the polar icebreaker fleet under subsection (b).</text>
					</paragraph></subsection></section><section id="id7c978d50-cc31-4fec-afc6-673eeffa48de"><enum>404.</enum><header>Forward operating
			 facility</header><text display-inline="no-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Secretary of the department
			 in which the Coast Guard is operating may construct or lease hangar, berthing,
			 and messing facilities in the Aleutian Island-Bering Sea operating area. The
			 facilities shall—</text>
				<paragraph id="id57d7f493-0658-42bd-b3a6-257b6c2405dd"><enum>(1)</enum><text>support aircraft
			 maintenance, including exhaust ventilation, heat, engine wash system, head
			 facilities, fuel, ground support services, and electrical power; and</text>
				</paragraph><paragraph id="id59f6acb1-8840-453e-bae8-26f3a5f041d8"><enum>(2)</enum><text>provide shelter for both
			 current helicopter assets and those projected to be located at Air Station
			 Kodiak, Alaska for at least 20 years.</text>
				</paragraph></section><section id="id0adb04d6-92c1-495e-9965-080d1184b471"><enum>405.</enum><header>National response
			 functions</header>
				<subsection id="id3094e538-29e9-4c14-9076-f83f12753e0f"><enum>(a)</enum><header>In
			 general</header><text>Section 311 of the Federal Water Pollution Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C.
			 1321</external-xref>) is amended—</text>
					<paragraph id="id7ee55c70-db36-442b-8a6f-8384517e39cd"><enum>(1)</enum><text>in subsection (a)—</text>
						<subparagraph id="ida786440d-1235-48a3-a966-cd6ac4dd97f0"><enum>(A)</enum><text>by striking paragraph
			 (23); and</text>
						</subparagraph><subparagraph id="id60e88b5e-53ee-471e-a123-b19b3d3ebf78"><enum>(B)</enum><text>redesignating paragraphs

					</paragraph></subsection></section><section id="idff887ea5-363d-460b-a843-96822c2feb73"><enum>406.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">Section 210 of the
			 Coast Guard and Maritime Transportation Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/14/93">14 U.S.C. 93</external-xref> note) is
			 repealed.</text>
			</section></title><title changed="added" committee-id="SSCM00" id="idf766bf30-789f-4296-b487-38e41b91c167" reported-display-style="italic"><enum>V</enum><header>Shipping and
			 navigation</header>
			<section id="idab943e38-2a39-4d57-b56d-3a27411d67d6"><enum>501.</enum><header>Designation of St.
			 George Harbor as a harbor of refuge</header>
				<subsection id="ida98b3324-5c00-493c-a245-db49acf250b5"><enum>(a)</enum><header>Consultation</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Commandant of
			 the Coast Guard shall consult with appropriate Federal agencies and with State
			 and local interests to determine what improvements are necessary to make the
			 harbor at St. George, Alaska, a fully functional harbor of refuge throughout
			 the year.</text>
				</subsection><subsection id="id41815dbc-2b0a-4257-9246-c5952024a5ae"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of the consultation under subsection (a) shall be to enhance safety of
			 human life at sea and protect the marine environment in the Central Bering
			 Sea.</text>
				</subsection><subsection id="idb170f920-e012-4d4c-bc9c-022f074a7ec0"><enum>(c)</enum><header>Report</header><text>Not
			 later than 90 days after making the determination under subsection (a), the
			 Commandant shall inform the Committee on Commerce, Science, and Transportation
			 of the Senate and the Committee on Transportation and Infrastructure of the
			 House of Representatives in writing of the improvements necessary to make the
			 harbor at St. George, Alaska, a fully functional harbor of refuge throughout
			 the year.</text>
				</subsection></section><section id="idf493471e-d58b-476c-a56c-50d787a1fd3d"><enum>502.</enum><header>Protection and fair
			 treatment of seafarers</header>
				<subsection id="id91cfb424-c657-4d11-a660-7a5180c264ac"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/111">Chapter 111</external-xref> of title 46,
			 United States Code, is amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id02b756a5-429e-4ec8-bb21-82384383cd6c" reported-display-style="italic" style="USC">
						<section id="id80dacdd6-3fd4-462d-9b9c-8f07e0f46f16"><enum>11113.</enum><header>Protection and fair
				treatment of seafarers</header>
							<subsection id="id257275d0-da2e-4b8e-a578-e9b2678b031a"><enum>(a)</enum><header>Purpose</header><text>The
				purpose of this section shall be to ensure the protection and fair treatment of
				seafarers.</text>
							</subsection><subsection id="id96f1bdbf-4af9-425a-95e2-e2274706edf5"><enum>(b)</enum><header>Special fund</header>
								<paragraph id="id70114b32-7af8-4451-a6c8-fa7626a916a6"><enum>(1)</enum><header>Establishment</header><text>There
				is established in the Treasury a special fund known as the <quote>Support of
				Seafarers Fund</quote>.</text>
								</paragraph><paragraph id="id6a995ae5-90b9-496c-b429-e4a00e7d751e"><enum>(2)</enum><header>Use of amounts in
				Fund</header><text>The amounts deposited into the Fund shall be available to
				the Secretary, without fiscal year limitation, to—</text>
									<subparagraph id="id4337bfb3-56e5-4023-b0d7-1a5b2af5f413"><enum>(A)</enum><text>pay necessary support
				under subsection (c)(1); and</text>
									</subparagraph><subparagraph id="id0e67ae9c-557d-4316-8300-b5e6010b2b8c"><enum>(B)</enum><text>reimburse a shipowner for
				necessary support under subsection (c)(2).</text>
									</subparagraph></paragraph><paragraph id="idb86e634c-062b-4183-b1fc-3128a465ba82"><enum>(3)</enum><header>Amounts credited to
				Fund</header><text>Notwithstanding any other provision of law, the Fund may
				receive—</text>
									<subparagraph id="id1720231e-81c8-4206-a5c5-2db6247156ba"><enum>(A)</enum><text>any moneys ordered to be
				paid to the Fund in the form of community service under section 8B1.3 of the
				United States Sentencing Guidelines Manual or to the extent permitted under
				paragraph (4); and</text>
									</subparagraph><subparagraph id="id9aa999f5-075a-4ff3-8e0c-80f8498bda33"><enum>(B)</enum><text>amounts reimbursed or
				recovered under subsection (e).</text>
									</subparagraph></paragraph><paragraph id="idda03ae06-6410-4bfe-aebc-20e57c69ad58"><enum>(4)</enum><header>Prerequisite for
				community service credits</header><text>The Fund may receive credits under
				paragraph (3)(A) if the unobligated balance of the Fund is less than
				$5,000,000.</text>
								</paragraph><paragraph id="id0D18082E66C24E5DBF0BEACE580EF8F4"><enum>(5)</enum><header>Authorization of
				appropriation</header><text>There are authorized to be appropriated, from the
				Fund, for each fiscal year such sums as may be necessary for the purposes set
				forth in paragraph (2).</text>
								</paragraph><paragraph id="id5a0f3fb4-6093-4804-87da-4339dd70775f"><enum>(6)</enum><header>Report
				required</header>
									<subparagraph id="id21693507-7340-40ec-b8f8-ff6f35c70ff1"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall submit to Congress, concurrent with
				the President’s budget submission for a given fiscal year, a report that
				describes—</text>
										<clause id="id0c3e2da7-1521-4464-802f-93773c8dd63c"><enum>(i)</enum><text>the amounts credited to
				the Fund under paragraph (3) for the preceding fiscal year;</text>
										</clause><clause id="id64252d98-9a38-44dc-af91-eb75387f7aba"><enum>(ii)</enum><text>in detail, the
				activities for which amounts were charged; and</text>
										</clause><clause id="id7f951988-05bc-4926-a807-02b2ea187f67"><enum>(iii)</enum><text>the projected level of
				expenditures from the Fund for the upcoming fiscal year, based on—</text>
											<subclause id="idb1352530-269f-4e80-8115-3b7bc2f10fe2"><enum>(I)</enum><text>on-going activities;
				and</text>
											</subclause><subclause id="ideca5fcdb-cf89-4212-b6f5-244066c34dbd"><enum>(II)</enum><text>new cases, derived from
				historic data.</text>
											</subclause></clause></subparagraph><subparagraph id="idcf9381d2-0f1b-450c-86cd-c668930332d8"><enum>(B)</enum><header>Exception</header><text>Subparagraph
				(A) shall not apply to obligations during the first fiscal year during which
				amounts are credited to the Fund.</text>
									</subparagraph></paragraph><paragraph id="id3b0b051c-62ac-4b7c-8bf7-269e58476ccc"><enum>(7)</enum><header>Fund
				manager</header><text>The Secretary shall designate a Fund manager. The Fund
				manager shall—</text>
									<subparagraph id="idf8a77fc0-2654-4fa6-8079-4fe6de0cbbae"><enum>(A)</enum><text>ensure the visibility and
				accountability of transactions utilizing the Fund;</text>
									</subparagraph><subparagraph id="idde0fb915-f1b1-4ecb-8b0e-94f7224cc4e7"><enum>(B)</enum><text>prepare the report under
				paragraph (6);</text>
									</subparagraph><subparagraph id="idd679e194-c102-4240-9ec0-6035472d21da"><enum>(C)</enum><text>monitor the unobligated
				balance of the Fund; and</text>
									</subparagraph><subparagraph id="id037ceb93-d661-475f-966b-d4c3d021785a"><enum>(D)</enum><text>provide notice to the
				Secretary and the Attorney General whenever the unobligated balance of the Fund
				is less than $5,000,000.</text>
									</subparagraph></paragraph></subsection><subsection id="id3907e4c2-7df0-46cc-b264-8362b181af5a"><enum>(c)</enum><header>Authority</header><text>The
				Secretary may—</text>
								<paragraph id="idc884a604-9a7e-49df-bbdc-386bb406826a"><enum>(1)</enum><text>pay, from amounts
				appropriated from the Fund, necessary support of—</text>
									<subparagraph id="ide9f89b0f-09f1-4818-a628-27f7e5b51995"><enum>(A)</enum><text>a seafarer that—</text>
										<clause id="id231bcd8f-2980-46f5-857e-a3a679b721b5"><enum>(i)</enum><text>enters, remains, or is
				paroled into the United States; and</text>
										</clause><clause id="idb02ec03e-e4cf-43e4-a978-1ccbb764c31b"><enum>(ii)</enum><text>is involved in an
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard; and</text>
										</clause></subparagraph><subparagraph id="id0bf64050-be26-4b92-a1e5-36ec894cb00b"><enum>(B)</enum><text>a seafarer that the
				Secretary determines was abandoned in the United States; and</text>
									</subparagraph></paragraph><paragraph id="ide3404774-00d9-4642-9ced-4887a39d1a22"><enum>(2)</enum><text>reimburse, from amounts
				appropriated from the Fund, a shipowner that has provided necessary support of
				a seafarer who has been paroled into the United States to facilitate an
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard, for the costs of necessary support if the Secretary
				determines that reimbursement is necessary to avoid serious injustice.</text>
								</paragraph></subsection><subsection id="ide37fc673-142b-45be-8f26-0e4f55065c95"><enum>(d)</enum><header>Limitation</header><text>Nothing
				in this section shall be construed—</text>
								<paragraph id="idc2521b5a-119f-4e27-a753-45d7d2308505"><enum>(1)</enum><text>to create a right,
				benefit, or entitlement to necessary support; or</text>
								</paragraph><paragraph id="idb77c5610-09eb-4d50-bb9f-e043a3a7e186"><enum>(2)</enum><text>to compel the Secretary
				to pay or reimburse the cost of necessary support.</text>
								</paragraph></subsection><subsection id="id8204ff69-2046-408c-80d5-811ddfa9e4b3"><enum>(e)</enum><header>Reimbursement;
				recovery</header>
								<paragraph id="id9d89b820-34ad-494f-ab50-75cb90f43457"><enum>(1)</enum><header>In
				general</header><text>A shipowner shall reimburse the Fund an amount equal to
				the total amount paid from the Fund for necessary support of a seafarer plus a
				surcharge of 25 percent of the total amount if—</text>
									<subparagraph id="id0fda554f-ee5b-4ced-9250-87036e9df719"><enum>(A)</enum><text>the shipowner—</text>
										<clause id="idd6299f68-a579-4972-923c-42cb73f77cbc"><enum>(i)</enum><text>during the course of an
				investigation, reporting, documentation, or adjudication of any matter that the
				Coast Guard referred to a United States Attorney or the Attorney General, fails
				to provide necessary support of a seafarer who was paroled into the United
				States to facilitate the investigation, reporting, documentation, or
				adjudication; and</text>
										</clause><clause id="id71530e6f-1c53-4a1e-ba76-5c0be24679aa"><enum>(ii)</enum><text>subsequently receives a
				criminal penalty; or</text>
										</clause></subparagraph><subparagraph id="id08fb2147-1049-47b5-b2af-44f5973fd1f6"><enum>(B)</enum><text>the shipowner, under any
				circumstance, abandons a seafarer in the United States, as determined by the
				Secretary.</text>
									</subparagraph></paragraph><paragraph id="id16d39e3c-0eb6-4c37-87ac-146f90878f1f"><enum>(2)</enum><header>Enforcement</header><text>If
				a shipowner fails to reimburse the Fund under paragraph (1), the Secretary
				may—</text>
									<subparagraph id="idc7ff5d05-2f97-48e7-8449-7d2fd38951f7"><enum>(A)</enum><text>proceed in rem against
				any vessel of the shipowner in the Federal district court for the district in
				which the vessel is found; and</text>
									</subparagraph><subparagraph id="id2a959030-b9c5-4fbe-bdac-3390c3906aa6"><enum>(B)</enum><text>withhold or revoke the
				clearance required under section 60105 of any vessel of the shipowner wherever
				the vessel is found.</text>
									</subparagraph></paragraph><paragraph id="id102ea52d-033a-4aa2-9bc1-c7547d249963"><enum>(3)</enum><header>Remedy</header><text>A
				vessel may obtain clearance from the Secretary after it is withheld or revoked
				under paragraph (2)(B) if the shipowner reimburses the Fund the amount required
				under paragraph (1).</text>
								</paragraph></subsection><subsection id="idc19e8670-296b-4815-8593-0dd2f1314591"><enum>(f)</enum><header>Bond and
				surety</header>
								<paragraph id="id3960733b-532f-451c-bbcc-7673612040ee"><enum>(1)</enum><header>Authority</header><text>The
				Secretary may require a bond or a surety satisfactory as an alternative to
				withholding or revoking clearance under subsection (e) if, in the opinion of
				the Secretary, the bond or surety satisfactory is necessary to facilitate an
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard.</text>
								</paragraph><paragraph id="idA032F6977DE94B4EACFD33B4D0A9A72E"><enum>(2)</enum><header>Surety
				corporations</header><text>A surety corporation may provide a bond or surety
				satisfactory under paragraph (1) if the surety corporation is authorized by the
				Secretary of the Treasury under
				<external-xref legal-doc="usc" parsable-cite="usc/31/9305">section
				9305</external-xref> of title 31 to provide surety bonds under
				<external-xref legal-doc="usc" parsable-cite="usc/31/9304">section
				9304</external-xref> of title 31.</text>
								</paragraph><paragraph id="id47caa452-1136-417b-8101-081e24ada43f"><enum>(3)</enum><header>Application</header><text>The
				authority to require a bond or surety satisfactory or to request the
				withholding or revocation of the clearance under subsection (e) applies to any
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard.</text>
								</paragraph></subsection><subsection id="id108b5087-6d0a-4275-939d-b331d7e1e178"><enum>(g)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="id8235cef9-8eb0-4146-90ce-c2e9641948df"><enum>(1)</enum><header>Abandons;
				abandoned</header><text>The term <term>abandons</term> or
				<term>abandoned</term> means—</text>
									<subparagraph id="idc143d824-f5c3-4c3b-8529-d9f3c0a0d890"><enum>(A)</enum><text>a shipowner's unilateral
				severance of ties with a seafarer; or</text>
									</subparagraph><subparagraph id="id6906df4a-cbfb-4c3d-9925-bb1893c9a44e"><enum>(B)</enum><text>a shipowner's failure to
				provide necessary support of a seafarer.</text>
									</subparagraph></paragraph><paragraph id="id68c7c9ac-99ff-41e4-bfb0-b3a8a083a430"><enum>(2)</enum><header>Bond or surety
				satisfactory</header><text>The term <term>bond or surety satisfactory</term>
				means a negotiated instrument, the terms of which may, at the discretion of the
				Secretary, include provisions that require a shipowner to—</text>
									<subparagraph id="idebc42d5f-17a8-42d2-94c7-5f1e83f3f73d"><enum>(A)</enum><text>provide necessary support
				of a seafarer who has or may have information pertinent to an investigation,
				reporting, documentation, or adjudication of any matter that is related to the
				administration or enforcement of any treaty, law, or regulation by the Coast
				Guard;</text>
									</subparagraph><subparagraph id="id2a88773e-ef1b-4d11-94ae-871c386f8a60"><enum>(B)</enum><text>facilitate an
				investigation, reporting, documentation, or adjudication of any matter that is
				related to the administration or enforcement of any treaty, law, or regulation
				by the Coast Guard;</text>
									</subparagraph><subparagraph id="id1be013b7-76da-49a6-993b-50faf387fae5"><enum>(C)</enum><text>stipulate to certain
				incontrovertible facts, including the ownership or operation of the vessel, or
				the authenticity of documents and things from the vessel;</text>
									</subparagraph><subparagraph id="id769c818d-7520-444a-becc-6d8abf1a7494"><enum>(D)</enum><text>facilitate service of
				correspondence and legal papers;</text>
									</subparagraph><subparagraph id="id9d0d52a2-1535-46f5-883f-e5abe3d54af0"><enum>(E)</enum><text>enter an appearance in
				United States district court;</text>
									</subparagraph><subparagraph id="id5488a224-fb06-4a40-80ed-1ffc4497792e"><enum>(F)</enum><text>comply with directions
				regarding payment of funds;</text>
									</subparagraph><subparagraph id="idf0e9dcb2-0389-476e-9ad4-d4001e5ca547"><enum>(G)</enum><text>name an agent in the
				United States for service of process;</text>
									</subparagraph><subparagraph id="ide3a430b7-a7bb-4cc2-b1e1-fa5add0cc1a0"><enum>(H)</enum><text>stipulate in United
				States district court as to the authenticity of certain documents;</text>
									</subparagraph><subparagraph id="id4dffd323-e070-43e3-86b6-5ad078e0495d"><enum>(I)</enum><text>provide assurances that
				no discriminatory or retaliatory measures will be taken against a seafarer
				involved in an investigation, reporting, documentation, or adjudication of any
				matter that is related to the administration or enforcement of any treaty, law,
				or regulation by the Coast Guard;</text>
									</subparagraph><subparagraph id="id677f1385-aa32-41a2-af64-9fdab01da73b"><enum>(J)</enum><text>provide financial
				security in the form of cash, bond, or other means acceptable to the Secretary;
				and</text>
									</subparagraph><subparagraph id="idd2b219a5-d997-46b0-99af-59632fda0d7b"><enum>(K)</enum><text>provide for any other
				appropriate measures as the Secretary considers necessary to ensure the
				Government is not prejudiced by granting the clearance required under section
				60105 of title 46.</text>
									</subparagraph></paragraph><paragraph id="idf1086a46-ed9b-48bc-ba85-31efab5fb8d0"><enum>(3)</enum><header>Fund</header><text>The
				term <term>Fund</term> means the Support of Seafarers Fund established under
				this section.</text>
								</paragraph><paragraph id="id0a861243-9ec4-41cc-8791-34444b898159"><enum>(4)</enum><header>Necessary
				support</header><text>The term <term>necessary support</term> means normal
				wages, lodging, subsistence, clothing, medical care (including
				hospitalization), repatriation, and any other expense the Secretary considers
				appropriate.</text>
								</paragraph><paragraph id="id59f82dab-9b64-44ec-b2c2-bd5422eaf2f2"><enum>(5)</enum><header>Seafarer</header><text>The
				term <term>seafarer</term> means an alien crewman who is employed or engaged in
				any capacity on board a vessel subject to the jurisdiction of the United
				States.</text>
								</paragraph><paragraph id="id257d62fd-181a-4631-b81b-3d225cbd9545"><enum>(6)</enum><header>Shipowner</header><text>The
				term <term>shipowner</term> means an individual or entity that owns, has an
				ownership interest in, or operates a vessel subject to the jurisdiction of the
				United States.</text>
								</paragraph><paragraph id="idebafef10-3c56-43c1-88f8-a719333bdf40"><enum>(7)</enum><header>Vessel subject to the
				jurisdiction of the United States</header><text>The term <term>vessel subject
				to the jurisdiction of the United States</term> has the meaning given the term
				in section 70502(c), except that it excludes—</text>
									<subparagraph id="idce72e96b-89e6-4cd4-8f0b-868d5a7ba224"><enum>(A)</enum><text>a vessel—</text>
										<clause id="ida29335b2-84ea-4f06-a8aa-308806c001d5"><enum>(i)</enum><text>that is owned by the
				United States, a State or political subdivision thereof, or a foreign nation;
				and</text>
										</clause><clause id="id7d5b8320-cb5d-4603-92ff-1ae8847b1a4f"><enum>(ii)</enum><text>that is not engaged in
				commerce; and</text>
										</clause></subparagraph><subparagraph id="idb6296f0c-f927-4818-8af1-f284ebafe811"><enum>(B)</enum><text>a bareboat—</text>
										<clause id="ida854f0aa-fa9a-4363-826b-35ab36ae0abe"><enum>(i)</enum><text>that is chartered and
				operated by the United States, a State or political subdivision thereof, or a
				foreign nation; and</text>
										</clause><clause id="id19cc1372-3c41-4e3a-8b4c-fa23f6d3b26e"><enum>(ii)</enum><text>that is not engaged in
				commerce.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="idabc9acdd-a463-4097-976b-e79675eba405"><enum>(h)</enum><header>Regulations</header><text>The
				Secretary may prescribe regulations to implement this
				section.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idcadedaef-869f-44e9-a1de-4920b1fc4230"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents for
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/111">chapter 111</external-xref> of title 46,
			 United States Code, is amended by inserting after the item relating to section
			 11112 the following:</text>

			 Fund $1,500,000 for each of fiscal years 2012, 2013, and 2014.</text>
				</subsection></section><section id="id2a913e4d-3dee-48e3-a346-05d1a87cba08"><enum>503.</enum><header>Delegation of
			 authority</header><text display-inline="no-display-inline">Section 3316 of
			 title 46, United States Code, is amended—</text>

				classification society provides comparable services in or for the government of
				a country designated by the Secretary of State as a State Sponsor of
				Terrorism.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="id78c9a0c3-10db-4f29-8c96-f140e959e0bd"><enum>504.</enum><header>Report on
			 establishment of arctic deep water port</header>
				<subsection id="ide0ac9065-2a9e-4fe9-816a-6bce1b9d2b82"><enum>(a)</enum><header>Study</header><text>The
			 Commandant of the Coast Guard shall conduct a study on the feasibility and
			 potential of establishing a deep water sea port in the Arctic to protect and
			 advance strategic United States interests within the Arctic region.</text>
				</subsection><subsection id="id4de938fb-2a2a-4224-a0ec-c839ecfd521e"><enum>(b)</enum><header>Scope</header><text>The
			 study under subsection (a) shall include an analysis of:</text>
					<paragraph id="id3ba6a5de-ceed-4538-88c4-dcae9c170043"><enum>(1)</enum><text>the capability that a
			 deep water sea port would provide;</text>
					</paragraph><paragraph id="id27c971db-02bb-47f0-a139-68fd24e01fbc"><enum>(2)</enum><text>potential and optimum
			 locations for the port;</text>
					</paragraph><paragraph id="id89b48f97-31da-462f-ab1a-8518ef92885e"><enum>(3)</enum><text>the resources needed to
			 establish the port;</text>
					</paragraph><paragraph id="idd42792f3-cc70-4eb0-ac2d-307d1e21942a"><enum>(4)</enum><text>the time frame needed to
			 establish the port;</text>
					</paragraph><paragraph id="id9ec09842-02c7-4f4d-9a40-f0760b354da9"><enum>(5)</enum><text>the infrastructure
			 required to support the port; and</text>
					</paragraph><paragraph id="id0f9abe75-d023-40c3-9a43-554dedb3b1f5"><enum>(6)</enum><text>any other issues the
			 Secretary considers necessary to complete the study.</text>
					</paragraph></subsection><subsection id="id6564a2b4-af25-4d3e-99a7-88d77007d5c4"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Commandant shall
			 submit a report on the findings of the study under subsection (a) to the
			 Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives.</text>
				</subsection></section><section id="idAAF77FF68B474FBBBF2914FBDB135A72"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">505.</added-phrase></enum><header>Risk analysis
			 of transporting Canadian tar sands</header>
				<subsection id="idAC2D0B9C6D994027AC331FC9B8EF9993"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">(a)</added-phrase></enum><header>In
			 general</header><text>The Commandant of the Coast Guard shall assess the
			 increased vessel traffic in the Salish Sea (including the Puget Sound, the
			 Strait of Georgia, Haro Strait, Rosario Strait, and the Strait of Juan de
			 Fuca), that may occur from the transport of Canadian tar sands oil.</text>
				</subsection><subsection id="id4AE1E94EC198402DA3F55B9D093C973D"><enum>(b)</enum><header>Scope</header><text>The
			 analysis required under subsection (a) shall, at a minimum, consider—</text>
					<paragraph id="idE0D0B3EB70A74A599668D6B31BD555DD"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">(1)</added-phrase></enum><text>the extent to
			 which vessel (barge, tanker, and supertanker) traffic may increase due to
			 Canadian tar sands development;</text>
					</paragraph><paragraph id="idC4C8BC6AA52E461788823974E9880FE8"><enum>(2)</enum><text>whether transport of
			 Canadian tar sands within the Salish Sea is likely to require navigation
			 through United States territorial waters;</text>
					</paragraph><paragraph id="id8FF77B46670E436A8AFDA26C0F4D2C6A"><enum>(3)</enum><text>the rules and regulations
			 that restrict supertanker traffic in United States waters, including an
			 assessment of whether there are methods to bypass those rules in such waterways
			 and adjacent Canadian waters;</text>
					</paragraph><paragraph id="id9E09D742B35F4FAB841450EA045EBAC7"><enum>(4)</enum><text>the rules and regulations
			 that restrict the amount of oil transported in tankers or barges in United
			 States waters, including an assessment of whether there are methods to bypass
			 those rules in such waterways and adjacent Canadian waters;</text>
					</paragraph><paragraph id="idAD11EAFFB990449DB0920BD185DFF846"><enum>(5)</enum><text>spill response capability
			 throughout the shared water of the United States and Canada, including oil
			 spill response planning requirements for vessels bound for one nation
			 transiting through the waters of the other nation;</text>
					</paragraph><paragraph id="id52D134A141854D2EBB47B3C4603C9F42"><enum>(6)</enum><text>vessel emergency response
			 towing capability at the entrance to the Strait of Juan de Fuca;</text>
					</paragraph><paragraph id="id0246A1C49EBB4AAAA093144E7E629FA1"><enum>(7)</enum><text>the agreement between the
			 United States and Canada that outlines requirements for laden tank vessels to
			 be escorted by tug boats;</text>
					</paragraph><paragraph id="id35EEBDD2997E42C9B66FAE03F80D50FD"><enum>(8)</enum><text>whether oil extracted
			 from tar sands has different properties from other types of oil, including
			 toxicity and other properties, which may require different maritime clean up
			 technologies; and</text>
					</paragraph><paragraph id="id37A26404FCC14F77BD37CBD3048013D4"><enum>(9)</enum><text>a risk assessment of the
			 increasing supertanker, tanker, and barge traffic associated with Canadian tar
			 sands development or expected to be associated with Canadian tar sands
			 development.</text>
					</paragraph></subsection><subsection id="id6A559798F4E74730A938A63046FD5DBE"><enum><added-phrase committee-id="SSCM00" reported-display-style="italic">(c)</added-phrase></enum><header>Consultation
			 requirement</header><text>In conducting the analysis required under this
			 section, the Commandant shall consult with the State of Washington and affected
			 tribal governments. The Commandant is also strongly encouraged to consult with
			 the Secretary of State.</text>
				</subsection><subsection id="id1E7058A5C6AC4C94A51C8C0E5AF10BFF"><enum>(d)</enum><header>Recommendations</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Commandant
			 shall submit recommendations based on the analysis required under this section
			 to the Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of Representatives.
			 The recommendations shall consider a full range of options for the management
			 of increasing maritime traffic and minimizing the increased likelihood of an
			 oil spill, including Federal legislation, promulgation of Federal rules, and
			 the establishment of cooperative agreements for shared funding of spill
			 prevention and response systems.</text>
				</subsection></section></title><title changed="added" committee-id="SSCM00" id="idb4493b60-68b8-41a0-9427-21c29c4b7c77" reported-display-style="italic"><enum>VI</enum><header>Miscellaneous</header>
			<section id="id3b2147c6-4460-4247-9f9b-e51b51bea26a"><enum>601.</enum><header>Conveyance of
			 decommissioned Coast Guard Cutter STORIS</header>
				<subsection id="id59fc0ed3-3ec2-4be4-94d0-1019362b32cb"><enum>(a)</enum><header>In
			 general</header><text>The Commandant of the Coast Guard shall convey the Coast
			 Guard Cutter STORIS to the Storis Museum under subsection (b) if the Commandant
			 determines that the cost to the Federal Government of conveying the Coast Guard
			 Cutter STORIS through the General Services Administration exceeds the cost to
			 the Federal Government of conveying to the STORIS Museum under subsection
			 (b).</text>
				</subsection><subsection id="id87e36c00-e0a9-4294-bd4b-3d401fa8e45a"><enum>(b)</enum><header>Coast Guard cutter
			 STORIS</header><text>Subject to the cost determination under subsection (a) and
			 after the decommissioning of the Coast Guard Cutter STORIS, the Commandant of
			 the Coast Guard shall convey, without consideration, all right, title, and
			 interest owned by the United States in the Coast Guard Cutter STORIS to the
			 Storis Museum, a nonprofit entity of Juneau, Alaska, if the head of the STORIS
			 Museum agrees—</text>
					<paragraph id="idc3a764a7-2881-406c-b980-bccb9cff9731"><enum>(1)</enum><text>to use the vessel as a
			 historic memorial;</text>
					</paragraph><paragraph id="id44b3b2ef-77e8-4d35-a3e5-532073e8eed4"><enum>(2)</enum><text>to make the United States
			 Coast Guard Cutter STORIS available to the public as a museum;</text>
					</paragraph><paragraph id="id6a4519ee-7676-41a7-99e6-8e6cd8d091bb"><enum>(3)</enum><text>to work cooperatively
			 with other museums to provide education and memorialize the maritime heritage
			 of the United States Coast Guard Cutter STORIS and other maritime activities in
			 Alaska, the Pacific Northwest, the Arctic Ocean, and adjacent oceans and
			 seas;</text>
					</paragraph><paragraph id="id7bee5af9-e85b-41b3-b981-8f1bddcb2b24"><enum>(4)</enum><text>that the vessel will not
			 be used for commercial transportation purposes;</text>
					</paragraph><paragraph id="id57b9889e-433f-4f28-9d50-a6474b501062"><enum>(5)</enum><text>to make the vessel
			 available to the United States Government if needed for use by the Commandant
			 in time of war or a national emergency or based on the critical needs of the
			 United States Coast Guard;</text>
					</paragraph><paragraph id="id7662d846-1721-4dfb-ac0e-d11c6ac11db6"><enum>(6)</enum><text>to hold the Government
			 harmless for any claims arising from exposure to hazardous materials, including
			 asbestos and polychlorinated biphenyls (PCBs), except for claims arising from
			 the use of the United States Coast Guard Cutter STORIS by the Government;
			 and</text>
					</paragraph><paragraph id="id53d58011-c6fc-4877-85d7-5931e1c6c7a4"><enum>(7)</enum><text>to any other conditions
			 the Commandant considers appropriate.</text>
					</paragraph></subsection><subsection commented="no" id="idfcf995cb-699b-4de4-afbe-0398686d95c6"><enum>(c)</enum><header>Treatment of
			 Conveyance</header><text>The conveyance of the Coast Guard Cutter STORIS under
			 this section shall not be considered a distribution in commerce for purposes of
			 section 6(e) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C.
			 2605(e)</external-xref>).</text>
				</subsection><subsection commented="no" id="iddae00574-747e-42c4-aff6-ae16e3e72a6d"><enum>(d)</enum><header>Other Excess
			 Equipment</header><text>The Commandant may convey to the recipient of the Coast
			 Guard Cutter STORIS under this section any excess equipment or parts from other
			 decommissioned Coast Guard vessels for use to enhance the vessel's operability
			 and function for purposes of a public museum and historical display.</text>
				</subsection></section><section id="id79dd18aa-7a47-4510-8ce4-2daef0876bde"><enum>602.</enum><header>Coast Guard
			 administrative costs</header><text display-inline="no-display-inline">Section
			 1012(a)(4) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2712">33 U.S.C. 2712(a)(4)</external-xref>) is amended by
			 striking <quote>damages</quote> and inserting <quote>damages, including the
			 cost of commercial claims processing, expert services, training, technical
			 services, and other administrative and personnel costs to process
			 claims</quote>.</text>
			</section><section id="id1148da5f-4049-4a54-9e98-bf0b186473f6"><enum>603.</enum><header>Oil spill liability
			 trust fund investment amount</header><text display-inline="no-display-inline">Not later than 30 days after the date of
			 enactment of this Act, the Secretary of the Treasury shall increase the amount
			 invested in income producing securities under section 5006(b) of the Oil
			 Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2736">33 U.S.C. 2736(b)</external-xref>) by
			 $12,851,340.</text>
			</section><section id="id02a22608-094a-481f-8280-43d4f0459471"><enum>604.</enum><header>Dry dock
			 operation</header><text display-inline="no-display-inline">A vessel transported
			 in Dry Dock #2 (State of Alaska registration AIDEA FDD-2) is not merchandise
			 for purposes of section 55102 of title 46, United States Code, if, during such
			 transportation, Dry Dock #2 remains connected by a utility or other connecting
			 line to pier-side moorage.</text>
			</section><section id="ideb0a8fdf-5434-4600-a78e-717519a37a5d"><enum>605.</enum><header>Technical
			 amendments</header>
				<subsection id="id4a99bb2e-16fe-4612-a88a-bf7363ad24ba"><enum>(a)</enum><header>Continuation on active
			 duty</header><text><external-xref legal-doc="usc" parsable-cite="usc/14/290">Section 290(a)</external-xref> of title 14, United
			 States Code, is amended in the second sentence by striking <quote>in the grade
			 of vice admiral</quote> and inserting <quote>in or above the grade of vice
			 admiral</quote>.</text>

			 determinations</header>
				<subsection id="idC2A8106720514881AE2C2693DE7EE926"><enum>(a)</enum><header>Vessels Deemed New
			 Vessels</header><text display-inline="yes-display-inline">The vessel with
			 United States official number 981472 and the vessel with United States official
			 number 988333 shall each be deemed to be a new vessel effective on the date of
			 delivery after January 1, 2008, from a privately owned United States shipyard
			 if no encumbrances are on record with the United States Coast Guard at the time
			 of the issuance of the new vessel certificate of documentation for each
			 vessel.</text>
				</subsection><subsection id="id9EFA3B9F4085464F921B7339E5CF0526"><enum>(b)</enum><header>Safety
			 Inspection</header><text display-inline="yes-display-inline">Each vessel under
			 subsection (a) shall be subject to the vessel safety and inspection
			 requirements of title 46, United States Code (as in effect on the day before
			 the date of enactment of this Act), applicable to any such vessel.</text>
				</subsection></section><section id="idAF046BF79AAD42F2851CBA116CE0DBA5"><enum>607.</enum><header>Alteration of bridge
			 obstructing navigation</header>
				<subsection id="idE4E9BDBC68F047A4AE44663C2EF12152"><enum>(a)</enum><header>Requirement to commence
			 administrative review</header><text display-inline="yes-display-inline">Not
			 later than 15 days after the date of enactment of this Act, the Commandant of
			 the Coast Guard shall certify to the Committee on Commerce, Science, and
			 Transportation of the Senate and the Committee on Transportation and
			 Infrastructure of the House of Representatives that the Coast Guard has
			 commenced the required interagency administrative review of the pending
			 proposal to alter the bridge that is unreasonably obstructing navigation and
			 that spans the Kill Van Kull, connecting Bayonne, New Jersey, and Staten
			 Island, New York.</text>
				</subsection><subsection id="id8BAE88FF441E4004AEE4F1165D3E71ED"><enum>(b)</enum><header>Expedited
			 Process</header><text display-inline="yes-display-inline">The
			 Commandant—</text>
					<paragraph id="id620EACBA8E814B799A0D31D2E1668480"><enum>(1)</enum><text display-inline="yes-display-inline">shall expedite the interagency
			 administrative review under subsection (a); and</text>
					</paragraph><paragraph id="id0CEEF08C53574734991853A2F862F310"><enum>(2)</enum><text display-inline="yes-display-inline">may use any resources offered to the Coast
			 Guard by the bridge owner for the purpose of paragraph (1).</text>
					</paragraph></subsection><subsection id="id20B18E20AB704719BB77D6CE470A824B"><enum>(c)</enum><header>Deadline for
			 Completion</header><text display-inline="yes-display-inline">Not later than
			 December 31, 2011, the Coast Guard shall complete the interagency
			 administrative review under subsection (a).</text>
				</subsection></section><section id="id57A8B5169C8844DEA066EE869AB595BA"><enum>608.</enum><header>Documentation of LNG
			 tankers</header>
				<subsection id="idDD29BF2676C443AAAE9C23D23B4F6291"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Notwithstanding
			 sections 12112 and 12132 and chapter 551 of title 46, United States Code, the
			 Secretary of the department in which the Coast Guard is operating may issue a
			 certificate of documentation with a coastwise endorsement for each of the
			 following vessels:</text>
					<paragraph id="idCB8F156D2D204D8E853453268D25FA5F"><enum>(1)</enum><text display-inline="yes-display-inline">LNG GEMINI (United States official number
			 595752).</text>
					</paragraph><paragraph id="id2AEE3396A6184A02B3BADE693F2336F8"><enum>(2)</enum><text display-inline="yes-display-inline">LNG LEO (United States official number
			 595753).</text>
					</paragraph><paragraph id="idE2C4DCD37ED54764B4F5EFD6ED59E5FE"><enum>(3)</enum><text display-inline="yes-display-inline">LNG VIRGO (United States official number
			 595755).</text>
					</paragraph></subsection><subsection id="id45FE2B78805441C6B9A2F575229B6F9C"><enum>(b)</enum><header>Limitation on
			 Operation</header><text display-inline="yes-display-inline">Coastwise trade
			 authorized under subsection (a) shall be limited to carriage of natural gas, as
			 that term is defined in section 3(13) of the Deepwater Port Act of 1974 (33
			 U.S.C. 1502(13)).</text>
				</subsection><subsection id="id0C6D929E36EF47C3BB07B142FE279A0C"><enum>(c)</enum><header>Termination of
			 Effectiveness of Endorsements</header><text display-inline="yes-display-inline">The coastwise endorsement issued under
			 subsection (a) for a vessel shall expire on the date of the sale of the vessel
			 by the owner of the vessel on the date of enactment of this Act to a person who
			 is not related by ownership or control to such owner.</text>
				</subsection></section><section id="id2A06818A00F74DB0A680312E4B40224A"><enum>609.</enum><header>Notice of
			 arrival</header><text display-inline="no-display-inline">The regulations
			 required under section 109(a) of the Security and Accountability For Every Port
			 Act of 2006 (33 U.S.C. 1223 note) dealing with notice of arrival requirements
			 for foreign vessels on the Outer Continental Shelf shall not apply to a vessel
			 documented under section 12105 of title 46, United States Code, unless the
			 vessel arrives from a foreign port or place.</text>
			</section><section id="idCFCD18D60ACC4C0D8D8B0760B9751222"><enum>610.</enum><header>Homeporting of FSV
			 HENRY B BIGELOW</header>
				<subsection id="id2E886BCAA5D2421881E3BB30ABECB1F4"><enum>(a)</enum><header>Deadline for Final
			 Decision regarding the Homeport for the FSV Henry B Bigelow</header>
					<paragraph id="idE2231D7BD7494F2CAFE2229D1091C004"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Administrator of the National
			 Oceanic and Atmospheric Administration shall make a final decision regarding
			 the homeport for the FSV HENRY B BIGELOW.</text>
					</paragraph><paragraph id="idBE30E59C48B943D9BABE97AE0458CD48"><enum>(2)</enum><header>Advance notice to
			 Congress</header><text display-inline="yes-display-inline">Not later than 45
			 days before the date that the final decision under paragraph (1) is
			 implemented, the Administrator shall submit to the Committee on Commerce,
			 Science, and Transportation of the Senate and the Committee on Natural
			 Resources of the House of Representative—</text>
						<subparagraph id="idA62C8F09E00347459F019FB0F08EBA34"><enum>(A)</enum><text display-inline="yes-display-inline">notification of the proposed final
			 decision; and</text>
						</subparagraph><subparagraph id="id4065B8E82E5D45D8A4B355D342EE828D"><enum>(B)</enum><text display-inline="yes-display-inline">an explanation of—</text>
							<clause id="id8E78F4BB28C346BD89135785F0BD8DB7"><enum>(i)</enum><text display-inline="yes-display-inline">the rationale for the homeport selected in
			 the proposed final decision; and</text>
							</clause><clause id="id0B3CFC000E604296AAE142749091977C"><enum>(ii)</enum><text display-inline="yes-display-inline">how the proposed final decision addresses
			 the considerations under subsection (b).</text>
							</clause></subparagraph></paragraph></subsection><subsection id="idEAB31F6AA9324CE990EAF9590268B051"><enum>(b)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making a final decision under subsection
			 (a), the Administrator of the National Oceanic and Atmospheric Administration
			 shall consider—</text>
					<paragraph id="id2CA5CA7F5144488D97A5990715065161"><enum>(1)</enum><text display-inline="yes-display-inline">the use of existing infrastructure owned by
			 the Administration;</text>
					</paragraph><paragraph id="id7837964913EC40F3AB2C85B5809F3C37"><enum>(2)</enum><text display-inline="yes-display-inline">the proximity of the proposed homeport to
			 Federal research facilities and to programs that could directly benefit from
			 the research conducted by the FSV HENRY B BIGELOW, including the
			 Administration’s Northeast Fisheries Science Center;</text>
					</paragraph><paragraph id="id2F665D002B3B4974B276E02F38DA18E5"><enum>(3)</enum><text display-inline="yes-display-inline">the proximity of the proposed homeport to
			 non-Federal fisheries research partners and vessel and equipment repair and
			 support infrastructure;</text>
					</paragraph><paragraph id="id5961060F7A8F40ED9A6A9A9C55D7D067"><enum>(4)</enum><text display-inline="yes-display-inline">the prior homeport location of the FSV
			 ALBATROSS, which the FSV HENRY B BIGELOW is replacing; and</text>
					</paragraph><paragraph id="id43AC666092C7422CA3BEB6FB761C1CD5"><enum>(5)</enum><text display-inline="yes-display-inline">the historical and cultural significance of
			 the presence of a Federal fisheries research vessel at the proposed
			 homeport.</text>
					</paragraph></subsection><subsection id="idF4169BBC5D2541308A2B3A31B78E9A5A"><enum>(c)</enum><header>Progress
			 Report</header><text display-inline="yes-display-inline">Not later than 30 days
			 after the date of enactment of this Act, the Administrator of the National
			 Oceanic and Atmospheric Administration shall submit to the Committee on
			 Commerce, Science, and Transportation of the Senate and the Committee on
			 Natural Resources of the House of Representatives a report on the
			 Administrator's progress in making a final decision under subsection
			 (a).</text>
				</subsection></section><section id="id390FA44DF12D4E359C221B2EEDFFA574"><enum><added-phrase reported-display-style="italic">611.</added-phrase></enum><header>Higher volume
			 port area regulatory definition change</header>
				<subsection id="id5253242B14134E08B72A4C73AE3D8615"><enum><added-phrase reported-display-style="italic">(a)</added-phrase></enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (a) of
			 section 710 of the Coast Guard Authorization Act of 2010 (Public Law 111–281;
			 124 Stat. 2986) is amended to read as follows:</text>

				title 33, Code of Federal Regulations, that apply to the higher volume port
				area for the Strait of Juan de Fuca at Port Angeles, Washington (including any
				water area within 50 nautical miles seaward), to and including Puget Sound,
				shall be deemed to apply, in the same manner, and to the same extent, to the
				Strait of Juan de Fuca at Cape Flattery, Washington (including any water area
				within 50 nautical miles seaward), to and including Puget Sound.</text>
							</paragraph><paragraph id="id41EB824D56C0485BBB47F7BDBA7FAE6F"><enum>(2)</enum><header>Effective
				date</header><text display-inline="yes-display-inline">This subsection shall
				take effect on July 1,
				2012.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idC7E90EEB831B48D09F6FA001616097FC"><enum>(b)</enum><header>Conforming
