		<official-title>To amend the Public Health Service Act to prohibit
		  certain abortion-related discrimination in governmental
		  activities.</official-title>

		<section id="HA5C1E32B053C474AA4E77EFFFAC52956" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Abortion Non-Discrimination Act of
			 2011</short-title></quote>.</text>
		</section><section id="H54E355E7BBA14269BE6951E6C4E707B6"><enum>2.</enum><header>Abortion
			 non-discrimination</header><text display-inline="no-display-inline">Section 245
			 of the Public Health Service Act (42 U.S.C. 238n) is amended—</text>
			<paragraph id="HE949B9432F4E40D7A7A5ED43B4B53F7B"><enum>(1)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section" style="traditional">and licensing of physicians</header-in-text></quote> and
			 inserting <quote><header-in-text level="section" style="traditional">,
			 licensing, and practice of physicians and other health care
			 entities</header-in-text></quote>;</text>
			</paragraph><paragraph id="H0EA413BC1F3C40DA97B754F4A3E25223"><enum>(2)</enum><text>in subsection (a),
			 by amending paragraph (1) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H6ECF4F2D6D384DDCB8D8771B6B591D9B" style="OLC">
					<paragraph id="H13E3BCC9CF854CEFB98296123E648EF7"><enum>(1)</enum><text>the entity
				refuses—</text>
						<subparagraph id="HBF2E5C53216442CF83D900DBAA70E189"><enum>(A)</enum><text>to undergo
				training in the performance of induced abortions;</text>
						</subparagraph><subparagraph id="HF6B46C7DE1914080AF78ADA0F6FB66FD"><enum>(B)</enum><text>to require or
				provide such training;</text>
						</subparagraph><subparagraph id="HDA3A2AF7D24A4E95B6B8FF76210A29E3"><enum>(C)</enum><text>to perform,
				participate in, provide coverage of, or pay for induced abortions; or</text>
						</subparagraph><subparagraph id="HDF147E5AEA454E57BE84F0E76B46387B"><enum>(D)</enum><text>to provide
				referrals for such training or such
				abortions;</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H10C2A1ACC35B4261A423082BC13785BE"><enum>(3)</enum><text>in subsection (b),
			 by striking <quote>an accreditation standards that requires</quote> and
			 inserting <quote>an accreditation standard that requires</quote>;</text>
			</paragraph><paragraph id="H89F27D49E2D54ADE83270555F808B836"><enum>(4)</enum><text>in subsection (c),
			 by amending paragraphs (1) and (2) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H6671EA19ADB94EEAA8D4D18364BD1387" style="OLC">
					<paragraph id="HF0AF86FD6FC943B2A12EEDAB0857C1D3"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>financial assistance</term>,
				with respect to a government program, means governmental payments to cover the
				cost of health care services or benefits, or other Federal payments, grants, or
				loans to promote or otherwise facilitate health-related activities.</text>
					</paragraph><paragraph id="HC7BA8627948443DF88C416E1E53198F5"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>health care entity</term>
				includes an individual physician or other health professional, a postgraduate
				physician training program, a participant in a program of training in the
				health professions, a hospital, a provider sponsored organization, a health
				maintenance organization, an accountable care organization, a health insurance
				plan, or any other kind of health care facility, organization, or
				plan.</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H99AD5BCFFB704427BB8074172C956DB3"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (c), by adding a new
			 paragraph (4) as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HD3D71388E0CA48F4983A403555EF8D26" style="OLC">
					<paragraph id="HF0B1DF8CFF8B4FED9110ACA23BE90089"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>State or local government
				that receives Federal financial assistance</term> includes any agency or other
				governmental unit of a State or local government that receives Federal
				financial
				assistance.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H627EBB2F941A4CFB9DB3A57E6272702E"><enum>(6)</enum><text>by redesignating
			 subsection (c) as subsection (e); and</text>
			</paragraph><paragraph id="HF75CEB4AB0D44B9AA1CDDF4B22AA57D6"><enum>(7)</enum><text>by inserting after
			 subsection (b) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HECC521F2E0784EC3BA3887BD0B74D152" style="OLC">
					<subsection id="HC6D71A68BABB4EE1966F9BDE3F1DC536"><enum>(c)</enum><header>Remedies</header>
						<paragraph id="H98DB9D776E674080A2E071106794EF1E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The courts of the
				United States shall have jurisdiction to prevent and redress actual or
				threatened violations of this section by issuing any form of legal or equitable
				relief, including—</text>
							<subparagraph id="H03DF3B0CFC784BCF9C8EF1401D7F5875"><enum>(A)</enum><text display-inline="yes-display-inline">injunctions prohibiting conduct that
				violates this section; and</text>
							</subparagraph><subparagraph id="HB875737CFC6C4CD1840197262AA062E2"><enum>(B)</enum><text>orders preventing
				the disbursement of all or a portion of Federal financial assistance to a State
				or local government, or to a specific offending agency or program of a State or
				local government, until such time as the conduct prohibited by this section has
				ceased.</text>
							</subparagraph></paragraph><paragraph id="H6F1D65EC61A74D3D9A09C7E45269321B"><enum>(2)</enum><header>Commencement of
				action</header><text display-inline="yes-display-inline">An action under this
				section may be instituted by—</text>
							<subparagraph id="HAA411D0C29FC4096BD4F85E381204F13"><enum>(A)</enum><text display-inline="yes-display-inline">any health care entity that has standing to
				complain of an actual or threatened violation of this section; or</text>
							</subparagraph><subparagraph id="H29140BD858D04E5096929551776E20F8"><enum>(B)</enum><text display-inline="yes-display-inline">the Attorney General of the United
				States.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" id="H99ACDB3A68B74BEC9021A53FB6A1784F"><enum>(d)</enum><header>Administration</header><text>The
				Secretary shall designate the Director of the Office for Civil Rights of the
				Department of Health and Human Services—</text>
						<paragraph commented="no" id="H06D5B9FA009A4A9199DF1766BD88C876"><enum>(1)</enum><text>to receive
				complaints alleging a violation of this section; and</text>
						</paragraph><paragraph id="HDE693265103546FE8984927F198E5198"><enum>(2)</enum><text display-inline="yes-display-inline">to pursue the investigation of such
				complaints, in coordination with the Attorney
				General.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section></legis-body>
