		  relating to the methodology for calculating the amount of any Postal surplus or
		  supplemental liability under the Civil Service Retirement System, and for other

		<section id="HBC0A38A9BA6546519E65178B2B8AB023" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>United States Postal Service Pension
			 Obligation Recalculation and Restoration Act of
			 2011</short-title></quote>.</text>
		</section><section id="HA154539B5C2D405EBCACBEF6C397365F"><enum>2.</enum><header>Modified
			 methodology</header>
			<subsection id="HCA689E691EC545A9A4385F7A6CAFEADA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8348(h) of
			 title 5, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H35E823DC82774CBC81293C9901BA8181" style="USC">
					<paragraph id="HFF7DE74AF3EB45EC9B17FC285DF331B7" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HDC935A5AE4D74FD59A0ED56EB4298D9E"><enum>(A)</enum><text>To the extent that a
				determination under paragraph (1), relating to benefits attributable to
				civilian employment with the United States Postal Service, is based on any
				provision of law described in subparagraph (C), such determination shall be
				made in accordance with such provision and any otherwise applicable provisions
				of law, subject to the following:</text>
							<clause id="HE2AAA6DBD88A4857B624FF9DA78A292E" indent="up1"><enum>(i)</enum><text>The <quote>average pay</quote> used in
				the case of any individual shall be a single amount, determined in accordance
				with section 8331(4), taking into account the rates of basic pay in effect for
				such individual during the periods of creditable service performed by such
				individual. Nothing in this subsection shall be considered to permit or
				require—</text>
								<subclause id="H0BA050B8F1144C5EA668468D69393136"><enum>(I)</enum><text>one determination of average pay
				with respect to service performed with the United States Postal Service;
				and</text>
								</subclause><subclause id="H35027EF7B83F42A9B2EBADC7CED2C910"><enum>(II)</enum><text>a separate determination of
				average pay with respect to service performed with its predecessor entity in
				function.</text>
								</subclause></clause><clause id="HEE99FF8B92CD4FB4B5150327D6A99DC5" indent="up1"><enum>(ii)</enum><text>In determining the portion of an
				annuity attributable to civilian employment with the United States Postal
				Service, with respect to any period of employment with the United States Postal
				Service that follows any other period of employment creditable under section
				8332 (without regard to whether such employment was with an entity referred to
				in clause (i)(II)), the total service of an employee for purposes of any
				provision of law described in subparagraph (C) shall be the sum of—</text>
								<subclause id="idCFCA731537054D35AB32872BF72701E3"><enum>(I)</enum><text>any period of employment with the
				United States Postal Service; and</text>
								</subclause><subclause id="idA9C07737669944CB95A0D61F69031253"><enum>(II)</enum><text>any period of employment
				creditable under section 8332 that precedes the period described in subclause
				(I).</text>
								</subclause></clause></subparagraph><subparagraph id="HACB86253D0ED43E7A386F61E0BC356F9" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HAB3C63ECE2D94CA1970447E5D7F185CC"><enum>(i)</enum><text>Not later than 6 months
				after the date of enactment of this paragraph, the Office shall determine (or,
				if applicable, redetermine) the amount of the Postal surplus or supplemental
				liability as of the close of the fiscal year most recently ending before such
				date of enactment, in conformance with the methodology required under
				subparagraph (A).</text>
							</clause><clause id="H162F3A2DCDB14A02BC3E7F85325D1C43" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H7C54AE9EAEB74775BBA6D495BA9B40C6"><enum>(I)</enum><text display-inline="yes-display-inline">If the result of the determination or
				redetermination under clause (i) is a surplus, the Office shall transfer the
				amount of such surplus to the Postal Service Retiree Health Benefits Fund not
				later than 15 days after the date of such determination or
				redetermination.</text>
								</subclause><subclause id="H1236D06802F24231AA494005FA04F661" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">If a determination or redetermination under
				clause (i) for a fiscal year is made before the Office makes a redetermination
				under paragraph (2)(B) with respect to the fiscal year, the Office may not make
				a determination under paragraph (2)(B) with respect to the fiscal year.</text>
								</subclause></clause></subparagraph><subparagraph id="HA478E4EDF866402F8CDC85D2A5C5FF70" indent="up1"><enum>(C)</enum><text>The provisions of law described in
				this subparagraph are—</text>
							<clause id="HB2ADCAD575B34C658638EF0E73CF3848"><enum>(i)</enum><text>the first sentence of section 8339(a);
				and</text>
							</clause><clause id="HB3A286FEF0AF4BB7A104484982AC0475"><enum>(ii)</enum><text>section 8339(d)(1).</text>
							</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HCF8A4DE7CA6C4D7A9E8EBE728BE7E823" indent="up1"><enum>(5)</enum><text>For purposes of this
				subsection—</text>
						<subparagraph id="H4092533DFAAE49719D6C359A273BF12C"><enum>(A)</enum><text>the term <term>Postal Service Retiree
				Health Benefits Fund</term> means the fund established under section 8909a;
				and</text>
						</subparagraph><subparagraph id="H8CB66CBCF3CC4F1D94A7C641EFB5548C"><enum>(B)</enum><text>the term <term>Postal Service
				Fund</term> means the fund established under section 2003 of title
				39.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H9657ABAE85A0481ABE2B0A55617667C7"><enum>(b)</enum><header>Coordination
			 provisions</header>
				<paragraph id="idC62103840E2642368BCE755CA28F7F46"><enum>(1)</enum><header>Amendment</header><text>Section
			 8909a of title 5, United States Code, is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H3D9641BFE2EE426F8FE7744EEBC81F29" style="USC">
						<subsection id="H25899BA7B3734650A09DBC7CCA635E86"><enum>(e)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				the amount payable by the Postal Service under subsection (d) in any fiscal
				year ending on or before September 30, 2021, shall be determined without regard
				to the requirements under section
				8348(h)(4).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H3405B6BE2FD6407B81942C7A1A21ADE3"><enum>(2)</enum><header>Rule of
			 construction</header><text>Nothing in this Act, or an amendment made by this
			 Act, shall be construed to affect the amount of any benefits otherwise payable
			 from the Civil Service Retirement and Disability Fund to any individual.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HB947CCBFA20C48EE9729CFBE3BB0F56A"><enum>(c)</enum><header>Technical
			 amendment</header><text display-inline="yes-display-inline">The heading for
			 section 8909a of title 5, United States Code, is amended by striking
			 <quote><header-in-text level="section" style="USC">Benefit</header-in-text></quote> and inserting
			 <quote><header-in-text level="section" style="USC">Benefits</header-in-text></quote>.</text>
			</subsection></section><section display-inline="no-display-inline" id="H699C2C6214F14DEB8E85FD567E0CBE2D" section-type="subsequent-section"><enum>3.</enum><header>Additional
			 provisions</header>
			<subsection id="H8ED857C7DC27408BA5C26D06E982199B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8348(h)(2) of
			 title 5, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H21190FD6516C4AFC8874CC22908CBA35" style="USC">
					<subparagraph id="H742955FACB664856B0E50F032E6C60BF" indent="up2"><enum>(F)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				subsection, for purposes of determining the Postal surplus or supplemental
				liability for each of fiscal years 2016, 2017, 2018, 2019, and 2020—</text>
						<clause id="id8DEE3D08ADBD4AF79EA73E03FA744FB7"><enum>(i)</enum><text display-inline="yes-display-inline">paragraph (4)(A) shall not apply to a
				determination under paragraph (1); and</text>
						</clause><clause id="idC12412931CD9476EBD44266638E46F6C"><enum>(ii)</enum><text display-inline="yes-display-inline">the determination under paragraph (1) shall
				be made by applying the methodology that was used to carry out this paragraph
				with respect to the fiscal year preceding the fiscal year referred to in
				paragraph
				(4)(B)(i).</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA38C28AA7CA34C90A6E8B03BA6E7D9BE"><enum>(b)</enum><header>Relating to a
			 postal surplus</header><text>Section 8348(h)(2)(C) of title 5, United States
			 Code, is amended—</text>
				<paragraph id="HFF6EB6F3BD684E728FF3E5F213EF5A48"><enum>(1)</enum><text>by inserting
			 <quote>2021,</quote> after <quote>2015,</quote>; and</text>
				</paragraph><paragraph id="HAA1DE4F355D5473CB10890E4D9CE8203"><enum>(2)</enum><text>by striking
			 <quote>if the result is</quote> and all that follows through
			 <quote>terminated.</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="yes-display-inline" id="HAC2900A0DA6744638432BD33FABE6C3D" style="OLC">
						<text>if the result is a
			 surplus—</text><clause id="HCB80D1996B3142B68DBA7DF4F8753960" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">that amount shall be transferred—</text>
							<subclause id="H488CD116733749E68E05CB734656DA8E"><enum>(I)</enum><text>to the Postal Service Retiree
				Health Benefits Fund, if the surplus is for fiscal year 2020 or a preceding
				fiscal year; and</text>
							</subclause><subclause id="HA5C5FA8268C04DE88C9D8EDECD429706"><enum>(II)</enum><text>to the Postal Service Fund, if the
				surplus is for fiscal year 2021 or a subsequent fiscal year; and</text>
							</subclause></clause><clause id="HB1CED40DF2E94D09B6DB4C5BEF1981F6" indent="up2"><enum>(ii)</enum><text>any prior amortization schedule for
				payments shall be
				terminated.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H0155BB545B4E485C854A03F348B26187" section-type="subsequent-section"><enum>4.</enum><header>Treatment of certain
			 surplus retirement contributions</header><text display-inline="no-display-inline">Section 8423(b) of title 5, United States
			 Code, is amended—</text>
			<paragraph id="H3F3DE73DC88C4EB198FAE100B33C92E4"><enum>(1)</enum><text>by redesignating
			 paragraph (5) as paragraph (6); and</text>
			</paragraph><paragraph id="H9ADDFBDA42DB4E0196E042FB081541B9"><enum>(2)</enum><text>by inserting after
			 paragraph (4) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H041484CD91664224A40F7EDE496D3246" style="USC">
					<paragraph id="HDFDD642E365E4D9688301755D273F5B3" indent="up1"><enum>(5)</enum><text>If, for fiscal year 2010, the amount
				computed under paragraph (1)(B) is less than zero (in this section referred to
				as <quote>surplus postal contributions</quote>), the amount of such surplus
				postal contributions shall be transferred—</text>
						<subparagraph id="H0E514BBCE0F24330A17D68E6D7D006B8"><enum>(A)</enum><text>to the Postal Service Retiree Health
				Benefits Fund to pay any liability to the Postal Service Retiree Health
				Benefits Fund for fiscal year 2011;</text>
						</subparagraph><subparagraph id="H9DF7D28F391046AC944750AD14E9B22B"><enum>(B)</enum><text>if all liability to the Postal Service
				Retiree Health Benefits Fund for fiscal year 2011 has been paid, to the
				Employees’ Compensation Fund established under section 8147; and</text>
						</subparagraph><subparagraph id="H27A0DB2D48B34A5F942EBE9FF76AE90E"><enum>(C)</enum><text>if all liability of the United States
				Postal Service to the Employees’ Compensation Fund has been paid, to the United
				States Postal Service for the repayment of any obligation issued under section
				2005 of title
				39.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H8A95E57B41274386A5420C3241DED41C"><enum>5.</enum><header>Rural post
			 offices</header><text display-inline="no-display-inline">Section 404(d) of
			 title 39, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id62C5B78375D8422EABF9B53C6D40B32D" style="OLC">
				<paragraph id="id8C16448BA1CD426B84B2AE1D3B887E1A" indent="up1"><enum>(7)</enum><text>Notwithstanding any other provision
				of this subsection, in making any determination under subsection (a)(3) as to
				the necessity for the closing or consolidation of any post office, the Postal
				Service may not close any post office which is located more than 10 miles from
				any other post
				office.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF4EC279C33994D0E9773002E6B82171B"><enum>6.</enum><header>Effective
			 date</header>
			<subsection id="HDC0ED3FD2B204A7AAAF32B8586670167"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">This Act and the
			 amendments made by this Act shall take effect on the date of enactment of this
			 Act.</text>
			</subsection><subsection id="H220172596FB64BFEB75D413BEBE50FF8"><enum>(b)</enum><header>Intent of
			 Congress</header><text>It is the intent of Congress that this Act apply with
			 respect to the allocation of past, present, and future benefit liabilities
			 between the United States Postal Service and the Treasury of the United
			 States.</text>
