		  Secretary of Agriculture to determine the price of all milk used for
		  manufactured purposes, which shall be classified as Class II milk, by using the

		<section id="idA53E385C27D54971A125F63B6FF5E269" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Milk Marketing Improvement Act
			 of 2011</short-title></quote>.</text>
		</section><section id="ID363554bad0774333a90ae670455b79fa"><enum>2.</enum><header>Prices received
			 for milk under milk marketing orders</header><text display-inline="no-display-inline">Section 8c(5)(B) of the Agricultural
			 Adjustment Act (7 U.S.C. 608c(5)(B)), reenacted with amendments by the
			 Agricultural Marketing Agreement Act of 1937, is amended—</text>
			<paragraph id="IDb64e7dc7768f4cd2af2287c2c3829eb0"><enum>(1)</enum><text>in the first
			 clauses (i) and (ii), by inserting <quote>(based on the blended price of all
			 milk covered by the order)</quote> after <quote>uniform prices</quote> each
			 place it appears; and</text>
			</paragraph><paragraph id="ID3b0c754735b2433ab61ca4b0d2ce781d"><enum>(2)</enum><text>in clause (b) of
			 the matter following the first clause (ii), by inserting <quote>and the
			 component value</quote> after <quote>quality</quote>.</text>
			</paragraph></section><section id="idFBEEC64ACBA44E0D9DE9AA78A73AA286"><enum>3.</enum><header>Class II milk
			 pricing</header><text display-inline="no-display-inline">Section 8c(5) of the
			 Agricultural Adjustment Act (7 U.S.C. 608c(5)), reenacted with amendments by
			 the Agricultural Marketing Agreement Act of 1937, is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id41B8A7842B8B4627AE569D6C6C96D413" style="OLC">
				<subparagraph id="id877BAAED07254F529EAEB31EFBA90C02"><enum>(P)</enum><header>Class II milk
				pricing</header>
					<clause id="id764E4ADEAB8C42E8BE04BD5766987CD2"><enum>(i)</enum><header>Definition of
				national average cost of production</header><text>In this subparagraph, the
				term <term>national average cost of production</term> means the amount, as
				determined by the Economic Research Service of the Department of Agriculture,
				equal to the difference between—</text>
						<subclause id="id296AE462FA4D4E4A88969B9CB64A56B1"><enum>(I)</enum><text>the national
				average of the operating cost and the allocated overhead cost of producing all
				milk in the 48 contiguous States; and</text>
						</subclause><subclause id="idA72D2CECE5B44638A0CE85265D37414E"><enum>(II)</enum><text>the opportunity
				cost for unpaid labor of producing all milk in the 48 contiguous States.</text>
						</subclause></clause><clause id="id95F77A48F06B4B418347DB62C789F6F6"><enum>(ii)</enum><header>Minimum
				price</header><text>The Secretary shall base the minimum price for Class II
				milk on the national average cost of production.</text>
					</clause><clause id="id5103CE16ECC84D369DDD9A84209BC3D8"><enum>(iii)</enum><header>Survey</header><text>For
				purposes of determining the national average cost of production under clause
				(i), the Secretary shall survey dairy producers and associations of dairy
				producers subject to Federal and State milk marketing orders and in all
				unregulated areas applicable to all milk.</text>
					</clause><clause id="idCBFB071047B64C58A285AE65860A10B2"><enum>(iv)</enum><header>Price
				announcement</header>
						<subclause id="idEABC6FCB356C49FE9BA4CF1AD19FD814"><enum>(I)</enum><header>In
				general</header><text>Not later than November 1 of each calendar year, the
				Secretary shall announce the minimum price for Class II milk for the next
				calendar year, as determined in accordance with clause (ii).</text>
						</subclause><subclause id="idDA588F62113D4B649232333816FFAA57"><enum>(II)</enum><header>Adjustments</header><text>Using
				the most currently available national average cost of production, the Secretary
				shall adjust the price announced under subclause (I) for a calendar year on
				April 1, July 1, and October 1 of the calendar year.</text>
						</subclause><subclause id="ID881b8f8a56cb45e6a681952dc3c126cc"><enum>(III)</enum><header>Notification</header><text>Not
				later than 15 days prior to the effective date of a price adjustment under this
				clause, the Secretary shall submit notification of the adjusted price
				to—</text>
							<item id="idF1255AC6DD2445FC996DAEED1D13AD15"><enum>(aa)</enum><text>the Committee on
				Agriculture of the House of Representatives;</text>
							</item><item id="id49706E2D160948AA949FB1440CC4367B"><enum>(bb)</enum><text>the Committee on
				Agriculture, Nutrition, and Forestry of the Senate;</text>
							</item><item id="idEDB0EB89E4B24278BBD04D5D0231AD72"><enum>(cc)</enum><text>each
				administrator of a Federal milk marketing order;</text>
							</item><item id="id86DDDD344729424F82701B33B76EF491"><enum>(dd)</enum><text>each State
				agency that oversees the pricing of milk paid to dairy producers; and</text>
							</item><item id="idAA13B6BA1EB34046AA98E7AA4E64A89F"><enum>(ee)</enum><text>other applicable
				Federal and State agencies.</text>
							</item></subclause><subclause id="id2CC07B3B4138499DBB66126F90E6AD1F"><enum>(IV)</enum><header>Publication</header><text>After
				receiving notification under subclause (III)(cc), each administrator of a
				Federal milk marketing order shall publish the decision of the Secretary in all
				bulletins and publications of the Federal milk marketing order.</text>
						</subclause></clause><clause id="idBAEEA8539B9E4A22A79098930626A335"><enum>(v)</enum><header>Basic formula
				price</header>
						<subclause id="idE2FF6F866DE0444D8B36AFBCCF8489F5"><enum>(I)</enum><header>In
				general</header><text>The Secretary shall use the Class II milk price announced
				under clause (iv) as the basic formula price for all Federal and State milk
				marketing orders and all unregulated milk production areas.</text>
						</subclause><subclause id="id423570DACC684F9C8A287CE1B50D796E"><enum>(II)</enum><header>Class I
				milk</header>
							<item id="idE11D872AAE0F4CACA83E3933C9DF7A76"><enum>(aa)</enum><header>In
				general</header><text>The price of Class I milk in all Federal and State milk
				marketing orders and all unregulated milk production areas shall be equal
				to—</text>
								<subitem id="id02D2C5DCD5E542A597B29150443634EB"><enum>(AA)</enum><text>the basic
				formula price under subclause (I); plus</text>
								</subitem><subitem id="idFA7594C928AF40E9B6D71B5BEC35D273"><enum>(BB)</enum><text>the applicable
				Class I milk differential under Federal and State milk marketing orders.</text>
								</subitem></item><item id="idF7C0E900EC9442C3A4BF89D15EAE66D4"><enum>(bb)</enum><header>Unregulated
				areas</header><text>For purposes of item (aa)(BB), the Secretary shall assign
				comparable Class I milk differentials to each unregulated
				area.</text>
							</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idCB3CCACA0ADE496FB691872A2664BD69"><enum>4.</enum><header>Inventory
			 management program</header><text display-inline="no-display-inline">Section
			 8c(5) of the Agricultural Adjustment Act (7 U.S.C. 608c(5)), reenacted with
			 amendments by the Agricultural Marketing Agreement Act of 1937, as amended by
			 section 3, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id9B9AA36AAF084AE8BBEEF85854C97991" style="OLC">
				<subparagraph id="idD7D57C57344A4877859B95E74AEF9540"><enum>(Q)</enum><header>Inventory
				management program</header>
					<clause id="id66829E25862B4BFBBDBD79C43BEB5AB6"><enum>(i)</enum><header>Milk production
				totals</header><text>Not later than February 1 of each calendar year, the
				Secretary shall determine the total quantity of all milk produced by each dairy
				producer or farming operation during the 3 preceding calendar years.</text>
					</clause><clause id="ID1743be5b7d9a4ddd8b2b994c86de2614"><enum>(ii)</enum><header>Production
				base</header>
						<subclause id="idF181EABC4C35486B84757A19D35BA47A"><enum>(I)</enum><header>In
				general</header><text>The starting production base of a dairy producer shall be
				the average quantity of milk produced by the dairy producer during the 3
				calendar years immediately preceding the date of enactment of this
				subparagraph.</text>
						</subclause><subclause id="idC74C7D26A7754CC2B0C8CBB78B064782"><enum>(II)</enum><header>Adjustment</header><text>The
				production base of a dairy producer shall be adjusted on January 1st of each
				year.</text>
						</subclause><subclause id="id3486C0A119304A5EA1F3C3D096D508E4"><enum>(III)</enum><header>Limitation</header><text>The
				production base of a dairy producer shall be based on the dairy producer, not
				the farming operation, and may not be sold, transferred, bartered, or
				donated.</text>
						</subclause><subclause id="id2F05975283D8433280EF4B313ABE13DF"><enum>(IV)</enum><header>New dairy
				producer exception</header><text>A new dairy producer, as defined by the
				Secretary, shall—</text>
							<item id="ID775465a660854ed2ba4280ef662f4102"><enum>(aa)</enum><text>during the
				1-year period beginning on the date on which the new dairy producer commences
				operation, be exempt from any applicable price reduction relating to the first
				3,000,000 pounds of milk produced by the new dairy producer;</text>
							</item><item id="id7CB40FDBCB8A42E3B3FD7E6A9D59DD10"><enum>(bb)</enum><text>in
				the case of any milk produced in excess of 3,000,000 pounds during that 1-year
				period, be subject to each price reduction described in clauses (vi) and (vii);
				and</text>
							</item><item id="idBB8712B584A04EB59973BDADCCA7C2AE"><enum>(cc)</enum><text>after that
				1-year period, be subject to each price reduction that applies to existing
				dairy producers.</text>
							</item></subclause></clause><clause id="id5C13680EEA744B43AF474BF9446FF8C9"><enum>(iii)</enum><header>Estimation of
				annual milk production and domestic consumption</header><text>Not later than
				November 1 of each calendar year and taking into consideration the import
				projections and export projections for all milk products, the Secretary shall
				estimate the quantity of all milk to be produced in the 48 contiguous States
				and marketed by dairy producers for commercial use during the next 12
				months.</text>
					</clause><clause id="id33D60E17495641E1BDA14AE890BDDFBF"><enum>(iv)</enum><header>Identification
				and determination of dairy products</header>
						<subclause id="ID74ac0c3d42cd40c08a9fcbdba8c124ba"><enum>(I)</enum><header>In
				general</header><text>Not less frequently than once each quarter, the Secretary
				shall—</text>
							<item id="id1B5AC45BB12040AEB7200DBD74B0F2F8"><enum>(aa)</enum><text>identify all
				dairy products (including cheeses, curds, butter, butterfat, butter oil,
				buttermilk, anhydrous milk fat, dairy spreads, milk, cream, concentrated milk,
				condensed milk, nonfat dry milk powder, whole milk powder, skim milk powder,
				all other forms of powdered milk, yogurt, ice cream, whey, whey powder, dried
				whey, whey protein concentrate, all other forms of whey products, milk protein
				concentrate, milk protein isolate, casein, caseinates, lactose, food preps
				containing milk, and milk chocolate) imported into, or exported from, the
				United States; and</text>
							</item><item id="idF717FD879DA94BD7ACA10219EECFAE0C"><enum>(bb)</enum><text>determine the
				quantity of raw milk contained in each such product.</text>
							</item></subclause><subclause id="id9AFD36E1C5D541B69BC4BD0B2B20C962"><enum>(II)</enum><header>Inclusions</header><text>In
				identifying dairy products under subclause (I)(aa), the Secretary shall include
				any current or projected future imports or exports of a product used for dairy,
				a dairy substitute, or ingredient, including any product that does not have the
				status of <quote>generally recognized as safe</quote>, as determined by the
				Commissioner of Food and Drugs.</text>
						</subclause></clause><clause id="id6809FF8D74AD48F9BBD783A4244AFC87"><enum>(v)</enum><header>Excess
				production determination</header><text>Not more than once every 2 months, if
				the Secretary, acting through the Commodity Credit Corporation, has purchased
				the maximum quantity of milk and milk products as required by law to administer
				programs including child nutrition programs (as defined in section 25(b) of the
				Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act (42
				U.S.C. 1769f</act-name>(b)), feeding programs administered by the Secretary of
				Defense, institutional programs, and any other mandated Federal food or feeding
				programs, the Secretary shall determine whether an excess quantity of milk and
				milk products is being produced for the national domestic market.</text>
					</clause><clause id="idD9709D63024A4D0BB095EA365BF56588"><enum>(vi)</enum><header>Reduction in
				price received</header>
						<subclause id="idF087636014D24359B88186DB5B96D859"><enum>(I)</enum><header>In
				general</header><text>Subject to subclauses (II), (IV), and (V), if the
				Secretary determines under clause (v) that there is excess production, the
				Secretary shall provide for a reduction in the price received by all dairy
				producers for not more than 5 percent of all milk produced in the 48 contiguous
				States and marketed by dairy producers for commercial use.</text>
						</subclause><subclause id="id1C9BA71142E34415AB38DE6373069841"><enum>(II)</enum><header>Notification</header><text>Not
				later than 15 days prior to the implementation of a reduction in price in
				accordance with subclause (I), the Secretary shall submit notification of, and
				justification for, the reduction in price to—</text>
							<item id="idCCF4C6EC08AC41F7832BA19DBA447F82"><enum>(aa)</enum><text>the Committee on
				Agriculture of the House of Representatives;</text>
							</item><item id="id20AB6B7C40B4450CAA3B3854254424BB"><enum>(bb)</enum><text>the Committee on
				Agriculture, Nutrition, and Forestry of the Senate;</text>
							</item><item id="id7D2BFB6988D84369B0168724E9241494"><enum>(cc)</enum><text>each
				administrator of a Federal milk marketing order;</text>
							</item><item id="idF3A6BF164F2E4F2E9DCF51E455C6D900"><enum>(dd)</enum><text>each State
				agency that oversees the pricing of milk paid to dairy producers; and</text>
							</item><item id="idFE522F0D79724B3AA430AD104AF8137A"><enum>(ee)</enum><text>other applicable
				Federal and State agencies.</text>
							</item></subclause><subclause id="id28264CC835F3474DB7319977C06B5AA9"><enum>(III)</enum><header>Publication</header><text>After
				receiving notification under subclause (II)(cc), each administrator of a
				Federal milk marketing order shall publish the decision of the Secretary in all
				bulletins and publications of the Federal milk marketing order.</text>
						</subclause><subclause id="id3F87B2EAA711481EA81059AB910C4B82"><enum>(IV)</enum><header>Limitation</header><text>The
				Secretary shall not provide for a reduction in the price received by a dairy
				producer under subclause (I) unless the Secretary determines under this
				subparagraph that there exists a positive trade balance in dairy products that
				are imported into, or exported from, the United States, based on—</text>
							<item id="idD0966ACF5BB84BB0BBC73830F3F2FCC8"><enum>(aa)</enum><text>dollar value;
				and</text>
							</item><item id="id805D52D230044F43B4EC76B6F06DAA85"><enum>(bb)</enum><text>the quantity of
				milk represented by imports and exports, as determined under this
				subparagraph.</text>
							</item></subclause><subclause id="id05DBAF79B3944B3E8198D9866C58E65C"><enum>(V)</enum><header>Amount</header><text>The
				amount of the reduction under subclause (I) in the price received by dairy
				producers shall not exceed <fraction>1/2</fraction> the minimum price of Class
				II milk.</text>
						</subclause></clause><clause id="idCF8B2E14A8474631AE76194BE9088DE4"><enum>(vii)</enum><header>Additional
				reduction</header>
						<subclause id="idD34B4FFFAD7B48C3AF95E4C4311B03E3"><enum>(I)</enum><header>In
				general</header><text>If the Secretary determines that the reduction described
				in clause (vi) is insufficient to reduce excess production, subject to
				subclauses (II) and (III) and clause (ii)(IV), the Secretary shall reduce the
				price received by any dairy producer or farming operation that has increased
				the production of all milk in a calendar quarter, as compared to the average
				quantity of milk produced in the corresponding calendar quarter in the previous
				3 years.</text>
						</subclause><subclause id="id9572B69B139F4D64AA64E53738A1604A"><enum>(II)</enum><header>Application</header><text>A
				reduction in price under subclause (I) shall apply only to the quantity of milk
				produced in excess of the average quantity of milk produced in the
				corresponding calendar quarters in the previous 3 years.</text>
						</subclause><subclause id="id091AA2F56E4246DB89104D76352BE0CE"><enum>(III)</enum><header>Notification</header><text>Not
				later than 15 days prior to the implementation of a reduction in price in
				accordance with subclause (I), the Secretary shall submit notification of, and
				justification for, the reduction in price to—</text>
							<item id="idDF004E18A7CE410EB172D80D394805C5"><enum>(aa)</enum><text>the Committee on
				Agriculture of the House of Representatives;</text>
							</item><item id="idA644A043D56A4E0CB49F87E099245593"><enum>(bb)</enum><text>the Committee on
				Agriculture, Nutrition, and Forestry of the Senate;</text>
							</item><item id="id8677BD89EDCB4320B8A69499A57BC035"><enum>(cc)</enum><text>each
				administrator of a Federal milk marketing order;</text>
							</item><item id="id321E48C1CB8141EC92AF6A16B99E8C7C"><enum>(dd)</enum><text>each State
				agency that oversees the pricing of milk paid to dairy producers; and</text>
							</item><item id="idF70312041C074951843442FC5E7774AB"><enum>(ee)</enum><text>other applicable
				Federal and State agencies.</text>
							</item></subclause><subclause id="idE77F3FA696BC49B4A1237E23F5D8545C"><enum>(IV)</enum><header>Publication</header><text>After
				receiving notification under subclause (III)(cc), each administrator of a
				Federal milk marketing order shall publish the decision of the Secretary in all
				bulletins and publications of the Federal milk marketing order.</text>
						</subclause></clause><clause id="IDe465c985b4cd45d6acc07c1e0c4b2eea"><enum>(viii)</enum><header>Amounts
				derived from reduction in prices paid to dairy producers</header>
						<subclause id="idF22FEAD11FA44C588D6B4251AA6E7E8B"><enum>(I)</enum><header>In
				general</header><text>Not later than 30 days after the end of each quarter, the
				Secretary shall pay to the special dairy producer account established under
				subclause (II) any amounts derived from a reduction in milk prices paid to
				dairy producers under clauses (vi) and (vii).</text>
						</subclause><subclause id="idBD7BA5D1C1E942A3904D5A407D9C9280"><enum>(II)</enum><header>Special dairy
				producer account</header><text>The Commodity Credit Corporation shall establish
				a special dairy producer account in which amounts described in subclause (I)
				shall be credited.</text>
						</subclause></clause><clause id="idBD596D1E098C4244827DD1BF58662C83"><enum>(ix)</enum><header>Appeals</header>
						<subclause id="id41D1D2CFA1F545FDB13F7EA7A04940B4"><enum>(I)</enum><header>In
				general</header><text>A dairy producer subject to an additional reduction under
				clause (vii) may appeal to the Federal or State milk marketing administrator to
				provide evidence that the dairy producer did not increase production in the
				calendar year that the reduction was in effect when compared to the average
				quantity of milk produced during the 3 previous years.</text>
						</subclause><subclause id="ID4ef54ae3221b4b648dc7e8a17c57e2e3"><enum>(II)</enum><header>Return of
				amounts</header><text>If a dairy producer proves that the dairy producer did
				not increase total production for the effective calendar year, the Secretary
				shall return to the dairy producer any amounts collected for any overproduction
				of any quarter of the affected year.</text>
						</subclause><subclause id="id91BB788E7EFF425FA64481620032CE02"><enum>(III)</enum><header>Submission of
				appeal</header><text>A dairy producer that ships to an unregulated milk handler
				may submit any appeal of the dairy producer to the Secretary or to the
				designated representative of the Secretary.</text>
						</subclause></clause><clause id="id7B75726D7F8F4218959A6231B6FDA640"><enum>(x)</enum><header>Extraordinary
				circumstances</header><text>In deciding an appeal submitted by a dairy producer
				under clause (ix), a Federal or State milk marketing administrator (or, in the
				case of an appeal under clause (ix)(III), the Secretary or the designated
				representative of the Secretary) shall take into consideration production
				losses due to, at a minimum, fire, severe weather conditions, or severe disease
				outbreaks.</text>
					</clause><clause id="id9DBD4B6837C54A4C863880A674E234E7"><enum>(xi)</enum><header>Collection</header><text>Except
				as provided in clause (xii), reductions in price required under clause (vi) or
				(vii) shall be collected by Federal and State milk marketing administrators and
				timely remitted to the Commodity Credit Corporation to offset the cost of
				purchasing excess milk products.</text>
					</clause><clause id="idABF4E2EB58C34C28AE78903B2C4C4DDA"><enum>(xii)</enum><header>Collection in
				unregulated areas</header><text>Reductions in price required for unregulated
				areas under subclause (IV) or (VI) shall be collected by the Secretary and
				timely remitted to the Commodity Credit Corporation to offset the cost of
				purchasing excess milk products.</text>
					</clause></subparagraph><subparagraph id="idC4CDDAC889884751B26D11A4600577E9"><enum>(R)</enum><header>Prohibition on
				certain charges</header><text>In carrying out this Act, the Secretary shall not
				impose charges on dairy producers for the cost of the conversion of raw milk to
				manufactured products.</text>
				</subparagraph><subparagraph id="id87D8608DD00F4093BAE988712371BC30"><enum>(S)</enum><header>Responsibilities
				of milk purchasing handlers</header><text>A milk handler that purchases milk
				from a dairy producer shall assume title for the milk at the time at which the
				milk is pumped into a milk truck provided by or otherwise delivered to the milk
				handler.</text>
				</subparagraph><subparagraph id="idA7A87CE0A7BC4B80BA839263FED52146"><enum>(T)</enum><header>Applicability</header><text>Subparagraphs
				(P) through (S) apply to all dairy producers and handlers of milk in the 48
				contiguous
				States.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID4354cb84e7b446ccb331808df7ea9efc"><enum>5.</enum><header>Amendments to
			 Federal milk marketing orders</header><text display-inline="no-display-inline">Section 8c(17) of the Agricultural
			 Adjustment Act (7 U.S.C. 608c(17)), reenacted with amendments by the
			 Agricultural Marketing Agreement Act of 1937, is amended by adding at the end
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="idF1F98131E03145FAAE68AD30E79FBA76" style="OLC">
				<subparagraph id="idD3114D88F3DC44B0908DDA0E63FDFB9C"><enum>(H)</enum><header>Orders covering
				milk and milk products</header><text>In the case of an order covering milk or
				milk products, disapproval of an amendment to the order shall not be considered
				to be disapproval of—</text>
					<clause id="id21DEF8CC6BB6455982468FAF6F4B04CC"><enum>(i)</enum><text>the order;
				or</text>
					</clause><clause id="id878C3D6BF8F04BBB91ED0A8744041C06"><enum>(ii)</enum><text>other terms of
				the
				order.</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section></legis-body>
