		<section id="idF1B2F0607E5E4DCDAD918820E927EF27" section-type="section-one"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preserve Our Large Arctic Response
			 Capability Act</short-title></quote> or as the <quote><short-title>POLAR-C Act</short-title></quote>.</text>
		</section><section id="ID0f1446a793c749f1bdf727a569047630"><enum>2.</enum><header>Finding; sense
			 of Congress</header>
			<subsection id="id70B4A3995AFC4344909EB6D6E5A93284"><enum>(a)</enum><header>Finding</header><text>Congress
			 finds that the United States priorities for maritime transportation in the
			 polar regions set out in the National Security Presidential Directive 66 and
			 Homeland Security Presidential Directive 25 dated January 9, 2009 are—</text>
				<paragraph id="id944DBE5E9E55483DA6A50B4E8518F52C"><enum>(1)</enum><text>to facilitate
			 safe, secure, and reliable navigation;</text>
				</paragraph><paragraph id="id6AE65500E43546F4A01E1700DEBC42A7"><enum>(2)</enum><text>to protect
			 maritime commerce; and</text>
				</paragraph><paragraph id="id197767F23D1F407BB3FACACDC2AE19EE"><enum>(3)</enum><text>to protect the
			 environment.</text>
				</paragraph></subsection><subsection id="idF1C8302D6E9344EDAFCFD35BB33447AE"><enum>(b)</enum><header>Sense of
			 Congress</header><text>It is the sense of Congress that the United States
			 should maintain domestic heavy and medium duty icebreaker assets to meet United
			 States Coast Guard statutory requirements and priorities for maritime
			 transportation and that maintaining less than a sufficient number of heavy duty
			 icebreaking assets jeopardizes national security, law enforcement, maritime
			 safety, environmental protection, disaster response, scientific research, and
			 natural resource protection in the polar regions and Alaska.</text>
			</subsection></section><section id="ID50575a6e16ba4dcd80e70aecfdd9b39e"><enum>3.</enum><header>Icebreaking
			 capability</header>
			<subsection id="ID319c5335bc96485da233b08fbd8c8c96"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id63F3B1E7A25E4AD09B536D71B1992FB8"><enum>(1)</enum><header>Covered
			 vessels</header><text>The term <quote>covered vessels</quote> means—</text>
					<subparagraph id="id79FC882DAF9746ACB3E209B930DD4594"><enum>(A)</enum><text>Coast Guard
			 Cutter POLAR SEA (WAGB 11); and</text>
					</subparagraph><subparagraph id="id866FC1FC9A2A497C92C90112670E4AA9"><enum>(B)</enum><text>the Coast Guard
			 Cutter POLAR STAR (WAGB 10).</text>
					</subparagraph></paragraph><paragraph id="id49C9696C8F7A466DBE1F3B8B92C49314"><enum>(2)</enum><header>Inactive
			 status</header><text>The term <quote>inactive status</quote> includes a status
			 of—</text>
					<subparagraph id="id4E07AE51E9074F58A1990541A9AEE0EA"><enum>(A)</enum><text>out of
			 commission, in reserve;</text>
					</subparagraph><subparagraph id="id6121023A2D5D46BF8DD9D25B4A244E62"><enum>(B)</enum><text>out of service,
			 in reserve; or</text>
					</subparagraph><subparagraph id="id6BC6B11FE9BF420AA581AABD985CFA4F"><enum>(C)</enum><text>pending placement
			 out of commission.</text>
					</subparagraph></paragraph><paragraph id="id78D77B21A0B2459DA60CD4CC724E4B10"><enum>(3)</enum><header>Submission
			 date</header><text>The term <quote>submission date</quote> means—</text>
					<subparagraph id="id89D966B8AFCD450AB09D8FF07FFEA750"><enum>(A)</enum><text>October 15, 2011;
			 or</text>
					</subparagraph><subparagraph id="id5E9FB72AA21D4F45AD547B8BDDE1EE85"><enum>(B)</enum><text>if this Act is
			 enacted after October 15, 2011, the date that is 1 day after the date of the
			 enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="idE0FF29F2E76944E9A6E27160B1C42838"><enum>(b)</enum><header>Submission of
			 business case analysis</header><text>Not later than the submission date, the
			 Commandant of the United States Coast Guard shall submit to the Committee on
			 Commerce, Science, and Transportation of the Senate and the Committee on
			 Transportation and Infrastructure of the House of Representatives the polar
			 icebreaker business case analysis prepared by the Coast Guard.</text>
			</subsection><subsection id="ID3022543668b5487db52165ea97cb6ee8"><enum>(c)</enum><header>Maintenance of
			 existing vessels</header><text>Until the date that is 2 years after the date
			 the Commandant of the United States Coast Guard makes the submission required
			 by subsection (b)—</text>
				<paragraph id="idBFD9B7FC7FD040CD8ECA6A36336725EF"><enum>(1)</enum><text>the Commandant
			 may not—</text>
					<subparagraph id="idA64E5A55D3064F6DB9BB1AA1214478AB"><enum>(A)</enum><text>transfer,
			 relinquish ownership of, dismantle, or recycle the covered vessels;</text>
					</subparagraph><subparagraph id="IDb80ea12d9a23475dbdb43b3b369487e9"><enum>(B)</enum><text>change the
			 homeport of either of the covered vessels;</text>
					</subparagraph><subparagraph id="IDb23a112ff8fa4a5eaa8ede096e89ca82"><enum>(C)</enum><text>expend any
			 funds—</text>
						<clause id="idEDAC3F2EE4DE4B91A5171D081966FB8B"><enum>(i)</enum><text>for
			 any expenses directly or indirectly associated with the decommissioning of
			 either of the covered vessels, including expenses for dock use or other goods
			 and services;</text>
						</clause><clause id="IDa1f9cea930f04ceaab73e8c7c105cd94"><enum>(ii)</enum><text>for any
			 personnel expenses directly or indirectly associated with the decommissioning
			 of either of the covered vessels, including expenses for decommissioning
			 officer; or</text>
						</clause><clause id="ID0ae7928e8f07440db6fc405dcbcf3a41"><enum>(iii)</enum><text>for any
			 expenses associated with a decommissioning ceremony for either of the covered
			 vessels;</text>
						</clause></subparagraph><subparagraph id="id123596572FB34D0BA10A2CB2FB894814"><enum>(D)</enum><text>appoint a
			 decommissioning officer to be affiliated with either of the covered vessels;
			 or</text>
					</subparagraph><subparagraph id="idEDDFECC6DB9C406CA39D869BCFA088E5"><enum>(E)</enum><text>place either of
			 the covered vessels in inactive status; and</text>
					</subparagraph></paragraph><paragraph id="idAB15FAA249D14611AA8C88631ABDD655"><enum>(2)</enum><text>the Administrator
			 of the Maritime Administration may not receive, maintain, dismantle, or recycle
			 either of the covered vessels.</text>
				</paragraph></subsection></section></legis-body>
