		<official-title>To provide additional time for the Administrator of the
		  Environmental Protection Agency to promulgate achievable standards for cement
		  manufacturing facilities, and for other purposes.</official-title>

		<section id="H65C8FFD61B1649698C4EBCB9CDA5E9C6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cement Sector Regulatory Relief Act of
			 2011</short-title></quote>.</text>
		</section><section id="H1C6677C3D98D4EC5A11913A42EDC7CE4"><enum>2.</enum><header>Legislative
			 stay</header>
			<subsection id="H30B18D81D8DE4F9CAB4554F287DE505B"><enum>(a)</enum><header>Establishment of
			 standards</header><text display-inline="yes-display-inline">In lieu of the
			 rules specified in subsection (b), and notwithstanding the date by which those
			 rules would otherwise be required to be promulgated, the Administrator of the
			 Environmental Protection Agency (referred to in this Act as the
			 <quote>Administrator</quote>) shall—</text>
				<paragraph commented="no" id="H9B25AECD8C6047D28F390A7F332C13C6"><enum>(1)</enum><text display-inline="yes-display-inline">propose regulations for the Portland cement
			 manufacturing industry and Portland cement plants that are subject to any of
			 the rules specified in subsection (b) that—</text>
					<subparagraph commented="no" id="H738525DAE65349CA8471093495196BCD"><enum>(A)</enum><text>establish maximum
			 achievable control technology standards, performance standards, and other
			 requirements under sections 112 and 129, as applicable, of the Clean Air Act
			 (42 U.S.C. 7412, 7429); and</text>
					</subparagraph><subparagraph commented="no" id="H5F34280A8F8245DDAF5AD1BB87854A85"><enum>(B)</enum><text>identify
			 nonhazardous secondary materials that, when used as fuels in combustion units
			 of that industry and those plants, qualify as solid waste under the Solid Waste
			 Disposal Act (42 U.S.C. 6901 et seq.) for purposes of determining the extent to
			 which the combustion units are required to meet the emission standards under
			 section 112 or 129 of the Clean Air Act (42 U.S.C. 7412, 7429); and</text>
					</subparagraph></paragraph><paragraph id="HD5B898D0BEE94398AF474FC4ADADCE3F"><enum>(2)</enum><text display-inline="yes-display-inline">promulgate final versions of those
			 regulations by not later than—</text>
					<subparagraph id="id92984C91A0EC44008E2BE99761362723"><enum>(A)</enum><text display-inline="yes-display-inline">the date that is 15 months after the date
			 of enactment of this Act; or</text>
					</subparagraph><subparagraph id="idC41C58B10BB6454BBB667E58449AD845"><enum>(B)</enum><text display-inline="yes-display-inline">such later date as may be determined by the
			 Administrator.</text>
					</subparagraph></paragraph></subsection><subsection id="HB0AC886DEF6D43479EFB1C791E1630C4"><enum>(b)</enum><header>Stay of earlier
			 rules</header>
				<paragraph id="HDC7D0AACBAF94FE09095AE7892F5ACC8"><enum>(1)</enum><header>Portland-specific
			 rules</header><text display-inline="yes-display-inline">The final rule entitled
			 <quote>National Emission Standards for Hazardous Air Pollutants from the
			 Portland Cement Manufacturing Industry and Standards of Performance for
			 Portland Cement Plants</quote> (75 Fed. Reg. 54970 (September 9, 2010)) shall
			 be—</text>
					<subparagraph id="id6F50FD2A23DF4E7BA235F691D4281669"><enum>(A)</enum><text display-inline="yes-display-inline">of no force or effect;</text>
					</subparagraph><subparagraph id="id9B5B483694EB44CF8249F1326B530B1A"><enum>(B)</enum><text display-inline="yes-display-inline">treated as though the rule had never taken
			 effect; and</text>
					</subparagraph><subparagraph id="id1B921D1369104FEA839B1E930CBA5B92"><enum>(C)</enum><text display-inline="yes-display-inline">replaced in accordance with subsection
			 (a).</text>
					</subparagraph></paragraph><paragraph id="H2970D23C844D44B7A043ABDEC94CC43E"><enum>(2)</enum><header>Other
			 rules</header>
					<subparagraph id="idD042F45766154BC5B1FCE7D6708FDC03"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The final rules
			 described in subparagraph (B), to the extent that those rules apply to the
			 Portland cement manufacturing industry and Portland cement plants, shall
			 be—</text>
						<clause id="id19E7B2FDF87F4FA8B62C174A3C980CA4"><enum>(i)</enum><text display-inline="yes-display-inline">of no force or effect;</text>
						</clause><clause id="id2F8061447D8A4A819D21C969BF6AAE06"><enum>(ii)</enum><text display-inline="yes-display-inline">treated as though the rules had never taken
			 effect; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idB4D83345E0DD413B9C96A87210DCC5AF"><enum>(iii)</enum><text display-inline="yes-display-inline">replaced in accordance with subsection
			 (a).</text>
						</clause></subparagraph><subparagraph id="HB390BF7C18774351936E72E6ED51576E"><enum>(B)</enum><header>Description of
			 rules</header><text>The final rules described in this subparagraph are—</text>
						<clause id="id87530522CE7C4B1E9429E7395151FBD6"><enum>(i)</enum><text>the
			 final rule entitled <quote>Standards of Performance for New Stationary Sources
			 and Emission Guidelines for Existing Sources: Commercial and Industrial Solid
			 Waste Incineration Units</quote> (76 Fed. Reg. 15704 (March 21, 2011));
			 and</text>
						</clause><clause commented="no" id="HC93FAA9075BB4C6AB1AA9AC0C160B122"><enum>(ii)</enum><text display-inline="yes-display-inline">the final rule entitled
			 <quote>Identification of Non-Hazardous Secondary Materials That Are Solid
			 Waste</quote> (76 Fed. Reg. 15456 (March 21, 2011)).</text>
						</clause></subparagraph></paragraph></subsection></section><section commented="no" id="H03EDDBA9743F4C5B97502024FCCD523E"><enum>3.</enum><header>Compliance
			 dates</header>
			<subsection id="HF1F73BF2B2844B4791C827F1781ECDD4"><enum>(a)</enum><header>Establishment of
			 compliance dates</header><text display-inline="yes-display-inline">For each
			 regulation promulgated pursuant to section 2(a), the Administrator—</text>
				<paragraph id="H95E677A378154BC69E4499C854E33A2D"><enum>(1)</enum><text>shall establish a
			 date for compliance with standards and requirements under the regulation that
			 is, notwithstanding any other provision of law, not earlier than 5 years after
			 the effective date of the regulation; and</text>
				</paragraph><paragraph id="HED36420793F84DA9886DDC00C08A4B3C"><enum>(2)</enum><text>in proposing a
			 date for that compliance, shall take into consideration—</text>
					<subparagraph id="HAABC557E85234E46A9895372C26BB07B"><enum>(A)</enum><text>the costs of
			 achieving emission reductions;</text>
					</subparagraph><subparagraph id="HD8E9BC49CE74429DAB6040D0125E000B"><enum>(B)</enum><text>any non-air
			 quality health and environmental impact and energy requirements of the
			 standards and requirements;</text>
					</subparagraph><subparagraph commented="no" id="HD423B9CEBEB34A258D212A2005AF54A5"><enum>(C)</enum><text>the feasibility of
			 implementing the standards and requirements, including the time
			 necessary—</text>
						<clause id="H520FA92DDD3646A588DEE19BA770F3E0"><enum>(i)</enum><text>to
			 obtain necessary permit approvals; and</text>
						</clause><clause id="H551DAD441E0843BD9D05E6E6D1775B0E"><enum>(ii)</enum><text>to
			 procure, install, and test control equipment;</text>
						</clause></subparagraph><subparagraph id="H8667D08FD218470B912E8D75B5504ECA"><enum>(D)</enum><text>the availability
			 of equipment, suppliers, and labor, given the requirements of the regulation
			 and other proposed or finalized regulations of the Administrator; and</text>
					</subparagraph><subparagraph id="H4C6422030022421191AD73FBA12C1509"><enum>(E)</enum><text>potential net
			 employment impacts.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HA3AB18A446AB4881A764E74E62700D07"><enum>(b)</enum><header>New
			 sources</header><text display-inline="yes-display-inline">The date on which the
			 Administrator proposes a regulation pursuant to section 2(a)(1) establishing an
			 emission standard under section 112 or 129 of the Clean Air Act (42 U.S.C.
			 7412, 7429) shall be treated as the date on which the Administrator first
			 proposes such a regulation for purposes of applying—</text>
				<paragraph commented="no" id="id23DC31939B6D463C8C9958978BA879A2"><enum>(1)</enum><text display-inline="yes-display-inline">the definition of the term <quote>new
			 source</quote> under section 112(a)(4) of that Act (42 U.S.C. 7412(a)(4));
			 or</text>
				</paragraph><paragraph commented="no" id="idA5E80FD9D9D8440DBE3A8EDD16F9E168"><enum>(2)</enum><text display-inline="yes-display-inline">the definition of the term <quote>new solid
			 waste incineration unit</quote> under section 129(g)(2) of that Act (42 U.S.C.
			 7429(g)(2)).</text>
				</paragraph></subsection><subsection id="H7FE2324B4C0148DFB7559F992395A4F7"><enum>(c)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 Act restricts or otherwise affects paragraphs (3)(B) and (4) of section 112(i)
			 of the Clean Air Act (42 U.S.C. 7412(i)).</text>
			</subsection></section><section commented="no" id="H3D5B473473DD44AE9896D22C6F27F2E3"><enum>4.</enum><header>Energy recovery
			 and conservation</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 and to ensure the recovery and conservation of energy consistent with the Solid
			 Waste Disposal Act (42 U.S.C. 6901 et seq.), in promulgating regulations under
			 section 2(a) addressing the subject matter of the rules specified in section
			 2(b)(2), the Administrator shall—</text>
			<paragraph commented="no" id="H6903CF9027CA43A3AF87B75BF03E44F6"><enum>(1)</enum><text>adopt the
			 definitions of the terms <term>commercial and industrial solid waste
			 incineration unit</term>, <term>commercial and industrial waste</term>, and
			 <term>contained gaseous material</term> in the rule entitled <quote>Standards
			 for Performance of New Stationary Sources and Emission Guidelines for Existing
			 Sources: Commercial and Industrial Solid Waste Incineration Units</quote> (65
			 Fed. Reg. 75338 (December 1, 2000)); and</text>
			</paragraph><paragraph commented="no" id="H5DE49E604D6C4C26AD8B7730A75E1CDB"><enum>(2)</enum><text>identify
			 nonhazardous secondary material to be solid waste (as defined in section 1004
			 of the Solid Waste Disposal Act (42 U.S.C. 6903) only if—</text>
				<subparagraph commented="no" id="H4C6AFD5F09924F78A8214F9EE6A4BEB6"><enum>(A)</enum><text>the material meets
			 that definition of commercial and industrial waste; or</text>
				</subparagraph><subparagraph commented="no" id="HCC09A2C6FAC84604B8744C234937DB61"><enum>(B)</enum><text>if the material is
			 a gas, the material meets that definition of contained gaseous material.</text>
				</subparagraph></paragraph></section><section display-inline="no-display-inline" id="H3A5D0DAED5B94F2EBA8ACF19608B8DD3" section-type="subsequent-section"><enum>5.</enum><header>Other
			 provisions</header>
			<subsection display-inline="no-display-inline" id="HFF0D7E72F3884DC999AE26DD8DC504D9"><enum>(a)</enum><header>Establishment of
			 standards achievable in practice</header><text>In promulgating regulations
			 under section 2(a), the Administrator shall ensure, to the maximum extent
			 practicable, that emission standards for existing and new sources established
			 under section 112 or 129 of the Clean Air Act (42 U.S.C. 7412, 7429), as
			 applicable, can be met under actual operating conditions consistently and
			 concurrently with emission standards for all other air pollutants covered by
			 regulations applicable to the source category, taking into account—</text>
				<paragraph display-inline="no-display-inline" id="id7873495BCD364A77BE483D8F43A7CF28"><enum>(1)</enum><text>variability in
			 actual source performance;</text>
				</paragraph><paragraph display-inline="no-display-inline" id="id40E64D8968E6445BA60E605658671D94"><enum>(2)</enum><text>source
			 design;</text>
				</paragraph><paragraph display-inline="no-display-inline" id="idFCAD6FC6EAD94A5A9918B1FAFEAA9170"><enum>(3)</enum><text>fuels;</text>
				</paragraph><paragraph display-inline="no-display-inline" id="id7056AD5B70114AC98F67E66C2A344034"><enum>(4)</enum><text>inputs;</text>
				</paragraph><paragraph display-inline="no-display-inline" id="id7DE72092A002427F8003C846CE8851A3"><enum>(5)</enum><text>controls;</text>
				</paragraph><paragraph display-inline="no-display-inline" id="id52F9890E137B43F1A02E4D27C02E9662"><enum>(6)</enum><text>ability to
			 measure the pollutant emissions; and</text>
				</paragraph><paragraph display-inline="no-display-inline" id="id9193FE7CA6C14A3F88558F5C6EE086CC"><enum>(7)</enum><text>operating
			 conditions.</text>
				</paragraph></subsection><subsection commented="no" id="H8E2D768C338942369C7A0B92AF4FEE0D"><enum>(b)</enum><header>Regulatory
			 alternatives</header><text display-inline="yes-display-inline">For each
			 regulation promulgated under section 2(a), from among the range of regulatory
			 alternatives authorized under the Clean Air Act (42 U.S.C. 7401 et seq.),
			 including work practice standards under section 112(h) of that Act (42 U.S.C.
			 7412(h)), the Administrator shall impose the least burdensome, consistent with
			 the purposes of that Act and Executive Order 13563 (76 Fed. Reg. 3821 (January
			 21, 2011)).</text>
