		<official-title>To require the Secretary of Health and Human Services to
		  establish a demonstration program to award grants to, and enter into contracts
		  with, medical-legal partnerships to assist patients and their families to
		  navigate health-related programs and activities.</official-title>

		<section id="H8B1C78FE38184C0DB019021F147DA186" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medical-Legal Partnership for Health
			 Act</short-title></quote>.</text>
		</section><section id="H0DDC977BD75C4397813EB99FEABFB3B8" section-type="subsequent-section"><enum>2.</enum><header>Findings;
			 purpose</header>
			<subsection id="HF505C5D944B34041A5E1F79EC0775AE2"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
				<paragraph id="H5545A1C5CF8A4DA0AD8279F1325914D7"><enum>(1)</enum><text>Numerous studies
			 and reports, including the annual National Healthcare Disparities Report and
			 Unequal Treatment, the 2002 Institute of Medicine Report, document the
			 extensiveness to which vulnerable populations suffer from health disparities
			 across the country.</text>
				</paragraph><paragraph id="HF8E3625343814333A37DB2C73003F40C"><enum>(2)</enum><text>These studies have
			 found that, on average, racial and ethnic minorities and low-income populations
			 are disproportionately afflicted with chronic and acute conditions such as
			 asthma, cancer, diabetes, and hypertension and suffer worse health outcomes,
			 worse health status, and higher mortality rates.</text>
				</paragraph><paragraph id="HDD1B42C89410433ABC0EFABBFE659DBC"><enum>(3)</enum><text>Several recent
			 studies also show that health and healthcare quality are a function of not only
			 access to healthcare, but also the social determinants of health, including the
			 environment, the physical structure of communities, socio-economic status,
			 nutrition, educational attainment, employment, race, ethnicity, geography, and
			 language preference, that directly and indirectly affect the health,
			 healthcare, and wellness of individuals and communities.</text>
				</paragraph><paragraph id="HFB95D2F7CCC44A448A98ED180A963719"><enum>(4)</enum><text>Formally
			 integrating medical and legal professionals in the health setting can more
			 effectively address the health needs of vulnerable populations and ultimately
			 reduce health disparities.</text>
				</paragraph><paragraph id="H7D62709768F944F8BE7611080607E084"><enum>(5)</enum><text>All over the
			 United States, healthcare providers who take care of low-income individuals and
			 families are partnering with legal professionals to assist them in providing
			 better quality of healthcare.</text>
				</paragraph><paragraph id="H9999F18A0A254DF181ED53383F3A0AC5"><enum>(6)</enum><text>Medical-legal
			 partnerships integrate lawyers in a health setting to help patients navigate
			 the complex government, legal, and service systems in addressing social
			 determinants of health, such as income supports for food insecure families and
			 mold removal from the home of asthmatics.</text>
				</paragraph></subsection><subsection id="H6157B4E6347D45899F6CB0C8FE1DB477"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are to—</text>
				<paragraph id="HEFC0AD043A2C445BA5264ABB48289B9A"><enum>(1)</enum><text>support and
			 advance opportunity for medical-legal partnerships to be more fully integrated
			 in healthcare settings nationwide;</text>
				</paragraph><paragraph id="idD25D17892FB8440F8D887C6B8D3C6A55"><enum>(2)</enum><text>to improve the
			 quality of care for vulnerable populations by reducing health disparities among
			 health disparities populations and addressing the social determinants of
			 health; and</text>
				</paragraph><paragraph id="HA968D300FDA146E7B47502BDA823F4CC"><enum>(3)</enum><text>identify and
			 develop cost-effective strategies that will improve patient outcomes and
			 realize savings for healthcare systems.</text>
				</paragraph></subsection></section><section id="H1427AFABD1E44CDA9615E02D4495E3EF"><enum>3.</enum><header>Medical-legal
			 partnerships</header>
			<subsection id="H43D4B6A8BD8446DC85D792902B5A1ECB"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services shall
			 establish a nationwide demonstration project consisting of—</text>
				<paragraph id="H369AFD9F909747968F8F24A99E8BD83C"><enum>(1)</enum><text>awarding grants
			 to, and entering into contracts with, medical-legal partnerships to assist
			 patients and their families to navigate programs and activities; and</text>
				</paragraph><paragraph id="H09D862CF838D4AC3A2A6E14AA6FD7ADE"><enum>(2)</enum><text>evaluating the
			 effectiveness of such partnerships.</text>
				</paragraph></subsection><subsection id="H832F1FC6A0B0492DAD060740A5EA08AB"><enum>(b)</enum><header>Technical
			 assistance</header><text display-inline="yes-display-inline">The Secretary may,
			 directly or through grants or contracts, provide technical assistance to
			 grantees under subsection (a)(1) to support the establishment and
			 sustainability of medical-legal partnerships. Not to exceed 5 percent of the
			 amount appropriated to carry out this section in a fiscal year may be used for
			 purposes of this subsection.</text>
			</subsection><subsection id="HA7B07AB7FB5F4530B600645534C65FAE"><enum>(c)</enum><header>Funding</header>
				<paragraph id="H0F1F79C35355488784840A6CF8EBA377"><enum>(1)</enum><header>Use of
			 funds</header><text>Amounts received as a grant or pursuant to a contract under
			 this section shall be used to assist patients and their families to navigate
			 health-related programs and activities for purposes of achieving one or more of
			 the following goals:</text>
					<subparagraph id="HA2D490AC72AE490193F280DDBB82B520"><enum>(A)</enum><text>Enhancing access
			 to healthcare services.</text>
					</subparagraph><subparagraph id="HB9F13F7124D940A9BB32BD649D3ABF93"><enum>(B)</enum><text>Improving health
			 outcomes for low-income individuals, as defined in subsection (g).</text>
					</subparagraph><subparagraph id="H9CBE863760C046B281D14158CB6E7584"><enum>(C)</enum><text>Reducing health
			 disparities among health disparities populations.</text>
					</subparagraph><subparagraph id="H9CA65B6CAF2343A09EB53E002E5C9421"><enum>(D)</enum><text>Enhancing wellness
			 and prevention of chronic conditions and other health problems.</text>
					</subparagraph><subparagraph id="HF6FF424922EF4CCF947E7B91C1EDA093"><enum>(E)</enum><text>Reducing cost of
			 care to the healthcare system.</text>
					</subparagraph><subparagraph id="HF4F82451C6EE4EBDB466C60425B8F5D0"><enum>(F)</enum><text>Addressing the
			 social determinants of health.</text>
					</subparagraph><subparagraph id="id8307BBE5856443DE81B699BFF9284358"><enum>(G)</enum><text>Addressing
			 situational contributing factors.</text>
					</subparagraph></paragraph><paragraph id="H9C791C944BA14201A098BED6F7CF62C4"><enum>(2)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this section such sums as may be
			 necessary, but not to exceed $10,000,000, for each of the fiscal years 2012
			 through 2016.</text>
				</paragraph><paragraph id="idDFD3535122F1410CA3E35D55D5E0A017"><enum>(3)</enum><header>Matching
			 requirement</header><text>For each fiscal year, the Secretary may not award a
			 grant or contract under this section to an entity unless the entity agrees to
			 make available non-Federal contributions (which may include in-kind
			 contributions) toward the costs of a grant or contract awarded under this
			 section in an amount that is not less than $1 for each $10 of Federal funds
			 provided under the grant or contract.</text>
				</paragraph><paragraph id="H1B1F78444B01435A9C55108183A3174F"><enum>(4)</enum><header>Allocation</header><text display-inline="yes-display-inline">Of the amounts appropriated pursuant to
			 paragraph (2) for a fiscal year, the Secretary may obligate not more than 5
			 percent for the administrative expenses of the Secretary in carrying out this
			 section.</text>
				</paragraph></subsection><subsection id="H506010F917F441839517B1F154445410"><enum>(d)</enum><header>Eligible
			 entities</header><text display-inline="yes-display-inline">To be eligible to
			 receive a grant or contract under this section, an entity shall—</text>
				<paragraph id="idDD2900426EA341EB90F57E8676BE9AA6"><enum>(1)</enum><text display-inline="yes-display-inline">be an organization experienced in bridging
			 the medical and legal professions on behalf of vulnerable populations
			 nationally; and</text>
				</paragraph><paragraph id="id975FEA77AACA4218847CC8AECAA74B53"><enum>(2)</enum><text>submit to the
			 Secretary an application at such time, in such manner, and containing such
			 information as the Secretary may require, including information demonstrating
			 that the applicant has experience in bridging the medical and legal professions
			 or a strategy or plan for cultivating and building medical-legal
			 partnerships.</text>
				</paragraph></subsection><subsection id="H58BE9EED820B402E8323B97D2C8C2B27"><enum>(e)</enum><header>Prohibitions</header><text>No
			 funds under this section may be used—</text>
				<paragraph id="H8E3BD5CCE36D460F9585F62D75E96D4D"><enum>(1)</enum><text>for any medical
			 malpractice action or proceeding;</text>
				</paragraph><paragraph id="ID53ff90ce2f1a4652a885a6f19fcf88b2"><enum>(2)</enum><text>to provide any
			 support to an alien who is not—</text>
					<subparagraph id="id183C5780DB234A10810D9AD0C53A1ABA"><enum>(A)</enum><text>a qualified alien
			 (as defined in section 431 of the Immigration and Nationality Act);</text>
					</subparagraph><subparagraph id="id3FF06F99694D47B88B09ACEDD42E2803"><enum>(B)</enum><text>a nonimmigrant
			 under the Immigration and Nationality Act; or</text>
					</subparagraph><subparagraph id="idD76F06FE25E840B185EA5F7E3933932F"><enum>(C)</enum><text>an alien who is
			 paroled into the United States under section 212(d)(5) of such Act for less
			 than one year;</text>
					</subparagraph></paragraph><paragraph id="id482CBEBADFFB428A9B762C369B82D782"><enum>(3)</enum><text>to provide legal
			 assistance with respect to any proceeding or litigation which seeks to procure
			 an abortion or to compel any individual or institution to perform an abortion,
			 or assist in the performance of an abortion; or</text>
				</paragraph><paragraph id="id8C6597A6E1CD4184BCC04EC040CA6315"><enum>(4)</enum><text>to initiate or
			 participate in a class action lawsuit.</text>
				</paragraph></subsection><subsection id="H5A9B4039E0774B5992802FD5371AE51A"><enum>(f)</enum><header>Reports</header>
				<paragraph id="H278A3323BBC249D2A7B7A5D5298BD243"><enum>(1)</enum><header>Final report by
			 secretary</header><text>Not later than 6 months after the date of the
			 completion of the demonstration program under this section, the Secretary shall
			 conduct a study of the results of the program and submit to the Congress a
			 report on such results that includes the following:</text>
					<subparagraph id="H12AA3B2BE31F486598E623BFBD8D5DC4"><enum>(A)</enum><text>An evaluation of
			 the program outcomes, including—</text>
						<clause id="H07131A80CD9346CCB47ED7CF3DF9E1EC"><enum>(i)</enum><text>a
			 description of the extent to which medical-legal partnerships funded through
			 this section achieved the goals described in subsection (b);</text>
						</clause><clause id="H77034341902A4B2D82C73F5CEDD09167"><enum>(ii)</enum><text>quantitative and
			 qualitative analysis of baseline and benchmark measures; and</text>
						</clause><clause id="H0F322A317C7D4D32A37BCAC3709189AC"><enum>(iii)</enum><text>aggregate
			 information about the individuals served and program activities.</text>
						</clause></subparagraph><subparagraph id="H3024F44744004CEDB1C7322CB3643D0A"><enum>(B)</enum><text>Recommendations on
			 whether the programs funded under this section could be used to improve patient
			 outcomes in other public health areas.</text>
					</subparagraph></paragraph><paragraph id="H851F68D1AA81430980273977833E33B2"><enum>(2)</enum><header>Interim reports
			 by secretary</header><text>The Secretary may provide interim reports to the
			 Congress on the demonstration program under this section at such intervals as
			 the Secretary determines to be appropriate.</text>
				</paragraph><paragraph id="H692661C80EAA4A80A9049AEA2510BFF5"><enum>(3)</enum><header>Reports by
			 grantees</header><text>The Secretary may require each recipient of a grant
			 under this section to submit interim and final reports on the programs carried
			 out by such recipient with such grant.</text>
				</paragraph></subsection><subsection id="H45A4E812FD364D2BA1BBEFEBCE385682"><enum>(g)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="H7D6CA6927BDF4D06A15608E23E8DB2B9"><enum>(1)</enum><text>The term
			 <term>health disparities populations</term> has the meaning given such term in
			 section 485E(d) of the Public Health Service Act.</text>
				</paragraph><paragraph id="H2AA0AC59882547739E33D0A7A38A323F"><enum>(2)</enum><text>The term
			 <term>low-income individuals</term> refers to the population of individuals and
			 families who earn up to 200 percent of the Federal poverty level.</text>
				</paragraph><paragraph id="H9F391ABD2FB14CC8945BC9084D7C3C60"><enum>(3)</enum><text>The term
			 <term>medical-legal partnership</term> means an entity—</text>
					<subparagraph id="HCCCA40C70A1749C783BE298BD5D6D1A7"><enum>(A)</enum><text>that is a
			 partnership between—</text>
						<clause id="H114396466849490B8A66010B9C356CEB"><enum>(i)</enum><text>a
			 community health center, public hospital, children’s hospital, or other
			 provider of healthcare services to a significant number of low-income
			 beneficiaries; and</text>
						</clause><clause id="HABDA41CC803248D88C5E8E37E4AF28AB"><enum>(ii)</enum><text>one
			 or more legal professionals; and</text>
						</clause></subparagraph><subparagraph id="H3E9B8AE5B7184A68B61AF5F398BCAD45"><enum>(B)</enum><text>whose primary
			 mission is to assist patients and their families navigate health-related
			 programs, activities, and services through the provision of relevant civil
			 legal assistance on-site in the healthcare setting involved, in conjunction
			 with regular training for healthcare staff and providers regarding the
			 connections between legal interventions, social determinants, and health of
			 low-income individuals.</text>
					</subparagraph></paragraph><paragraph id="HA3C682A6421A440A8C293A6C925BAFB2"><enum>(4)</enum><text>The term
			 <term>Secretary</term> means the Secretary of Health and Human Services.</text>
				</paragraph></subsection></section></legis-body>
