		<official-title>To enable transportation fuel competition, consumer
		  choice, and greater use of domestic energy sources in order to reduce our
		  Nation’s dependence on foreign oil.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Open Fuels Standard Act of
			 2011</short-title></quote>.</text>
		</section><section id="ID5201b752cddd4f1bba25acabde9b8e3b"><enum>2.</enum><header>Open fuels
			 standard</header>
			<subsection id="id18D62328160C419F9ADBC4BF91979680"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 329 of title
			 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD35DBC16A0E74D0F8D0E7898E929B46E" style="USC">
					<section id="id279FA9832EE9445F93B1ED518CE28B0C"><enum>32920.</enum><header>Open fuels
				standard</header>
						<subsection id="id93194F4656064405806661B25C053564"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="IDf54151a8b133424f9d5dddc2b24b3bb8"><enum>(1)</enum><header>Advanced
				alternative fuel blend</header><text>The term <term>advanced alternative fuel
				blend</term> means—</text>
								<subparagraph id="id1C5C7969C8764737B6AA26430B6A24E6"><enum>(A)</enum><text>a mixture
				containing—</text>
									<clause id="idEB617507CC6C46BEB1717C5F970D5DA0"><enum>(i)</enum><text>at least 85
				percent denatured ethanol, by volume, or a lower percentage prescribed by the
				Secretary pursuant to section 32901(b); and</text>
									</clause><clause id="idC9AB9D30A0AD4C61825006D8749A9147"><enum>(ii)</enum><text>gasoline or
				drop-in fuel;</text>
									</clause></subparagraph><subparagraph id="idB293EE81D2074ADBB24B2A764FE08D34"><enum>(B)</enum><text>a mixture
				containing—</text>
									<clause id="idF10420149DE148BCA4B62A63FB420402"><enum>(i)</enum><text>at least 70
				percent methanol, by volume; and</text>
									</clause><clause id="idEB02BA0303F54804873942088D284B9F"><enum>(ii)</enum><text>gasoline or
				drop-in fuel; and</text>
									</clause></subparagraph><subparagraph id="id03D5053E994648EB86A01CEEEF92D0A6"><enum>(C)</enum><text>any other mixture
				of alcohols or liquid fuels certified by the Secretary pursuant to subsection
				(b)(2).</text>
								</subparagraph></paragraph><paragraph id="ID877ac4fd7bb14e9e8e6e1054e24cfa1a"><enum>(2)</enum><header>Annual covered
				inventory</header><text>The term <term>annual covered inventory</term> means
				the number of automobiles (as defined in section 32901(a)(3)) that a
				manufacturer, during a given calendar year, manufactures in the United States
				or imports from outside of the United States, for sale in the United
				States.</text>
							</paragraph><paragraph id="ID75c4eb30f9c14e4f9613ed916114927e"><enum>(3)</enum><header>Fuel
				choice-enabling vehicle</header><text>The term <term>fuel choice-enabling
				vehicle</term> means a automobile warranted by its manufacturer—</text>
								<subparagraph id="id2042B1CD435F4161A0DADB994A893C69"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idD408E5D3166E4A2DA34A05B929B73CE8"><enum>(i)</enum><text>absent certification
				authorizing the use of an advanced alternative fuel blend under subsection
				(b)(2), to operate on a mixture containing—</text>
										<subclause id="idFCECD3766A11475580E77A1708019CBF"><enum>(I)</enum><text>at least 85
				percent denatured ethanol, by volume, or a lower percentage prescribed by the
				Secretary pursuant to section 32901(b); and</text>
										</subclause><subclause id="id2F0CA3D7992A493C80B77F15AEF7B1DC"><enum>(II)</enum><text>gasoline or
				drop-in fuel; and</text>
										</subclause></clause><clause id="idFFF57CFD09BD473089D296725BEF8748"><enum>(ii)</enum><text>after
				certification under subsection (b)(2), to operate on an advanced alternative
				fuel blend; or</text>
									</clause></subparagraph><subparagraph id="id539EA72337884866A36A2F268181CB08"><enum>(B)</enum><text>to operate
				on—</text>
									<clause id="ID3ed729f0fe994ea1808c95897c9408eb"><enum>(i)</enum><text>natural
				gas;</text>
									</clause><clause id="ID6ce4ffd82e02475c887fd8faab5c3799"><enum>(ii)</enum><text>hydrogen;</text>
									</clause><clause id="ID7311a38246714edd9054e6f293ba2a11"><enum>(iii)</enum><text>electricity;</text>
									</clause><clause id="ID8f93de02c7be4e7e942a244835a9e042"><enum>(iv)</enum><text>a hybrid
				electric engine;</text>
									</clause><clause id="IDd2ca296288dd4d389b07703359ff82c0"><enum>(v)</enum><text>a
				mixture of biodiesel and diesel fuel meeting the standard established by the
				American Society for Testing and Materials or under section 211(u) of the Clean
				Air Act (42 U.S.C. 7545(u)) for fuel containing 5 percent biodiesel; or</text>
									</clause><clause id="idCD2BFC37722E49EBA49EE7936EBE3452"><enum>(vi)</enum><text>any other fuel
				or means of powering covered automobiles prescribed by the Secretary, by
				regulation, that contains not more than 10 percent petroleum, by volume.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="ID5f4edeec51f74ff5b630d8bb7e7e2768"><enum>(b)</enum><header>Open fuels
				standard</header>
							<paragraph id="IDb5ba0753440d48ceaf88e4372207c507"><enum>(1)</enum><header>In
				general</header><text>Each automobile manufacturer’s annual covered inventory
				shall be comprised of—</text>
								<subparagraph id="id4F88D36B59734E1D8FA372836ECC4408"><enum>(A)</enum><text>not less than 50
				percent fuel choice-enabling vehicles in model years 2015, 2016, and 2017;
				and</text>
								</subparagraph><subparagraph id="idD4B7E6D158204F86AC064FBD7CFB163E"><enum>(B)</enum><text>not less than 80
				percent fuel choice-enabling vehicles in model year 2018 and each subsequent
				model year.</text>
								</subparagraph></paragraph><paragraph id="ID5b951a93cb14403f8e456cfab5489aec"><enum>(2)</enum><header>Certifications</header><text>Not
				later than 2 years after the date of the enactment of the
				<short-title>Open Fuels Standard Act of
				2011</short-title>, the Secretary of Transportation, in consultation with the
				Administrator of the Environmental Protection Agency, shall certify—</text>
								<subparagraph id="id6A2EC85F010A45979996944DEA4B6D3B"><enum>(A)</enum><text>the use of
				advanced alternative fuel blends in fuel choice-enabling vehicles unless the
				Secretary determines that such certification—</text>
									<clause id="id758B0CC60E25442ABAE2E7A669D716D1"><enum>(i)</enum><text>is not
				technologically feasible;</text>
									</clause><clause id="id65798EF4A2454BA2B5F3212C5C132D0C"><enum>(ii)</enum><text>would result in
				burdensome consumer costs;</text>
									</clause><clause id="idC504C247BB304772BE7DA36E979E4AAB"><enum>(iii)</enum><text>negatively
				impacts automobile safety;</text>
									</clause><clause id="id72434B81CABB4C839108861C68BE4A3B"><enum>(iv)</enum><text>negatively
				impacts air quality;</text>
									</clause><clause id="id29DDEBFBA1D8441EA64C45639E5FF098"><enum>(v)</enum><text>would not
				increase the use of domestic feedstock sources; or</text>
									</clause><clause id="id5196391D4E554CCF9D5DA993E2C40603"><enum>(vi)</enum><text>is unlikely to
				enable reductions in foreign oil imports;</text>
									</clause></subparagraph><subparagraph id="id13ACAE3C7F754A05996BBD1ABC9C4D0A"><enum>(B)</enum><text>the type and
				blend of advanced alternative fuel blend that can be utilized by specific
				automobiles in use on such date of enactment; and</text>
								</subparagraph><subparagraph id="idDA464AB6040E4F709E9F2A9BEEFF6A56"><enum>(C)</enum><text>the type and
				blend of advanced alternative fuel blend that can be utilized by new and
				existing components of the Nation’s transportation fueling infrastructure for
				fuel choice-enabled vehicles.</text>
								</subparagraph></paragraph><paragraph id="ID73138ff14a2a4b2c8602a2c99755c725"><enum>(3)</enum><header>Small
				manufacturer exemption</header><text>At the request of a manufacturer, the
				Secretary of Transportation shall exempt the manufacturer from the requirement
				described in paragraph (1) if the manufacturer’s annual covered inventory is
				fewer than 10,000.</text>
							</paragraph><paragraph id="ID5aab2684e7c64677b11aba37ae1423d0"><enum>(4)</enum><header>Credit trading
				among manufacturers</header>
								<subparagraph id="IDe054a426a7534d56ad44aeca2bc92260"><enum>(A)</enum><header>In
				general</header><text>The Secretary may establish, by regulation, an open fuels
				standard credit trading program to allow manufacturers whose annual covered
				inventory exceeds the requirement described in paragraph (1) to earn credits,
				which may be sold to manufacturers that are unable to achieve such
				requirement.</text>
								</subparagraph><subparagraph id="IDd05bcaf1483c4a969b2b113e6e0db566"><enum>(B)</enum><header>Dual fuel
				credit</header><text>Beginning in model year 2018, any automobile used to
				qualify for the open fuels standard under this subsection cannot be used to
				receive the dual fuel credit under section 32903.</text>
								</subparagraph></paragraph></subsection><subsection id="IDd345220686ce4be3bab3488447ac42c4"><enum>(c)</enum><header>Fuel choice
				comparison tool</header><text>The Secretary of Transportation, in consultation
				with the Secretary of Energy, the Secretary of Agriculture, the Administrator
				of the Environmental Protection Agency, and the Federal Trade Commission,
				shall—</text>
							<paragraph id="id475C046B8DC64574AD01A9F477F877AC"><enum>(1)</enum><text>develop a model
				label for pumps in the United States dispensing advanced alternative fuels to
				consumers that—</text>
								<subparagraph id="id3293E081419E4D4B8F253AE50448C19A"><enum>(A)</enum><text>identifies a
				single, readily comprehensible metric that allows consumers to evaluate the
				relative value, energy density, and expected automobile performance of any
				particular advanced alternative fuel blend; and</text>
								</subparagraph><subparagraph id="id2293FC75F5894408A23E050899251C76"><enum>(B)</enum><text>includes
				appropriate warnings against the use of such fuels in unwarranted engines,
				including nonautomobile engines; and</text>
								</subparagraph></paragraph><paragraph id="idDAC1A2B3D37E40539E45E67264585CF2"><enum>(2)</enum><text>make the label
				described in paragraph (1) available for voluntary reproduction and
				adoption.</text>
							</paragraph></subsection><subsection id="id042A4433F6284A9898A0ABEAAE47852A"><enum>(d)</enum><header>Study of fuel
				dispensing infrastructure for advanced alternative fuel blends</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				the enactment of the <short-title>Open Fuels Standard Act
				of 2011</short-title>, the Secretary of Transportation shall submit a report to
				the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and
				Transportation of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Energy and Commerce of the House
				of Representatives</committee-name> that evaluates the need for standardized
				fueling equipment that facilitates the dispensing of advanced alternative fuel
				blends to fuel choice-enabling vehicles and prevents such fuel blends from
				being dispensed to incompatible
				automobiles.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id2E0CD0725DFA4C08B6011A0B6347A3B6"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of section for chapter 329 of title 49,
			 United States Code, is amended by adding at the end the following:</text>

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id07E340FDDB2D47D494EEC46D9E1416EF"><enum>(c)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary shall promulgate regulations to carry out
			 the amendment made by subsection (a).</text>
