		<official-title>To amend the Food and Nutrition Act of 2008 to require
		  State electronic benefit transfer contracts to treat wireless program retail
		  food stores in the same manner as wired program retail food stores.
		  </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Electronic benefit
			 transfers</header>
			<subsection id="IDc9f2a8cd67f94edf89c3c5d0a044723c"><enum>(a)</enum><header>In
			 general</header><text>Section 7(h) of the Food and Nutrition Act of 2008 (7
			 U.S.C. 2016(h)) is amended—</text>
				<paragraph id="ID3cb0d44f975d47e6be0896c98700a55a"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="ID363353bf6c954847b6aad431720c0462"><enum>(A)</enum><text>by redesignating
			 subparagraphs (A) through (D) as subparagraphs (B) through (E),
			 respectively;</text>
					</subparagraph><subparagraph id="ID03ac8ebb90f646b38d44a0909f3aedfe"><enum>(B)</enum><text>by inserting
			 before subparagraph (B) (as so redesignated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idFF639B7631B044FE8FCBDE4625E6F72A" style="OLC">
							<subparagraph id="IDb4873eda16ff4bdd81160a490b5f3504"><enum>(A)</enum><header>Definitions</header><text>In
				this subsection:</text>
								<clause id="IDc3c8d8db505c43f7ab278c2ca39a1748"><enum>(i)</enum><header>Community-supported
				agriculture program</header><text>The term <term>community-supported
				agriculture program</term> or <term>CSA</term> means a farm business or a group
				of agricultural producers that form a partnership with consumers through which
				consumers buy a subscription for farm products in advance and the farm business
				or group of agricultural producers commits to supplying and delivering the
				products to a common distribution point or directly to the consumers.</text>
								</clause><clause id="ID8ecfae3e21f946c591862e78305c849b"><enum>(ii)</enum><header>Farmers
				market</header><text>The term <term>farmers market</term> means a regularly
				scheduled assembly of 2 or more agricultural producers for the direct sale of
				locally grown fresh fruits and vegetables and other staple foods to
				consumers.</text>
								</clause><clause id="IDdb3caa1ad1704a8d89b5dd114e172625"><enum>(iii)</enum><header>Farm stand;
				roadside stand</header>
									<subclause id="IDc2097bb7cabd48db80d02e496a2d612b"><enum>(I)</enum><header>In
				general</header><text>The terms <term>farm stand</term> and <term>roadside
				stand</term> mean a retail outlet for the direct sale of locally grown fresh
				fruits and vegetables and other staple foods in rural or urban areas.</text>
									</subclause><subclause id="ID617cc30933a347939b549da01ddb7052"><enum>(II)</enum><header>Inclusion</header><text>The
				terms <term>farm stand</term> and <term>roadside stand</term> may include a
				single stall in a farmers market.</text>
									</subclause></clause><clause id="ID47465a2d85444a8db99afda6095b2194"><enum>(iv)</enum><header>Green
				cart</header><text>The term <term>green cart</term> means a mobile retail food
				vendor who sells fresh fruits and vegetables on a regular basis from an
				unmotorized cart.</text>
								</clause><clause id="ID8ba4080bd11043f1882bd40dda1fbba0"><enum>(v)</enum><header>Route
				vendor</header>
									<subclause id="ID9182596bf0f341cca4f4fb4d10163995"><enum>(I)</enum><header>In
				general</header><text>The term <term>route vendor</term> means a mobile retail
				food vendor who sells unprepared food from a vehicle directly to consumers
				along a scheduled route or by arranged delivery.</text>
									</subclause><subclause id="ID8e7258f79f32435195f38081071b1e97"><enum>(II)</enum><header>Inclusion</header><text>The
				term <term>route vendor</term> includes vendors who provide food services in
				disaster or other emergency situations.</text>
									</subclause></clause><clause id="IDc02c8c96fb144143be90efcfc561b346"><enum>(vi)</enum><header>Wireless
				retailer</header><text>The term <term>wireless retailer</term> includes—</text>
									<subclause id="id9323464FF0D547C6893EE59A32E4AE18"><enum>(I)</enum><text>a farmers
				market;</text>
									</subclause><subclause id="id6AC074EDC35E4022B03AC65284F85868"><enum>(II)</enum><text>a farm
				stand;</text>
									</subclause><subclause id="id7E82D4D410A44133B0373A441174D859"><enum>(III)</enum><text>a green
				cart;</text>
									</subclause><subclause id="idFB83D4992B6E43CBB26F84FEC173AC32"><enum>(IV)</enum><text>a route
				vendor;</text>
									</subclause><subclause id="idC439C8B05479456D9D0D18EFFBD9DCA4"><enum>(V)</enum><text>an entity
				operating a community-supported agriculture program; and</text>
									</subclause><subclause id="id8E72A9E8A6B04E208FF06E705B55CBAD"><enum>(VI)</enum><text>an individual
				farmer affiliated with an entity described in subclauses (I) through
				(V).</text>
									</subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="ID8ee7598dfe124cddbce07b19a07be1c8"><enum>(C)</enum><text>in subparagraph
			 (C) (as so redesignated) by striking <quote>subparagraph (A)</quote> and
			 inserting <quote>subparagraph (B)</quote>;</text>
					</subparagraph><subparagraph id="ID9be662aefdda48c198068c7ce841a336"><enum>(D)</enum><text>in clause (i) of
			 subparagraph (E) (as so redesignated), by inserting <quote>, including wireless
			 technology</quote> before the semicolon at the end; and</text>
					</subparagraph><subparagraph id="ID9df10cc39ec642629e08dbb03815fe2c"><enum>(E)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id7D32888A2AFB464389FA0F6048D74C3B" style="OLC">
							<subparagraph id="id2C5DD4858F3C4E7188219E6D4E085B50"><enum>(F)</enum><header>State
				flexibility for wireless ebt systems</header><text>Subject to paragraph (2), a
				State agency may—</text>
								<clause id="id0415650E90A74A369CB0C69FBDBE9BB0"><enum>(i)</enum><text>procure and
				implement any wireless electronic benefit transfer system that the State agency
				considers to be appropriate and that meets all industry security standards;
				and</text>
								</clause><clause id="id468E10566AE745AABFCE367CE1518148"><enum>(ii)</enum><text>use appropriate
				wireless technology available to the State agency in implementing the wireless
				electronic benefit transfer system, including smart phone technology and other
				technologies, so long as the technologies meet all industry security
				standards.</text>
								</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDb28ceccf92bf4720b4a7a7ac9ece6c67"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="IDecd5e45e73794c1e8025df199da33665"><enum>(A)</enum><text>in subparagraph
			 (G), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="ID610b882388be432db38113d5d7db7158"><enum>(B)</enum><text>in subparagraph
			 (H), by striking the period at the end and inserting a semicolon; and</text>
					</subparagraph><subparagraph id="IDf7eae8a1ee5a4752a999dc7445a5381a"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idDE75A5FF83D7493C99A50CEA5A62B679" style="OLC">
							<subparagraph id="IDf4ac95f58e434f77b9a21ca72f7866bd"><enum>(I)</enum><text>a requirement
				that, for purposes of program participation, State agencies and the Food and
				Nutrition Service treat wireless retailers in the same manner as retail food
				stores that use wired electronic benefit transfer equipment by providing the
				retail food stores with wireless electronic benefit transfer equipment that
				ensures immediate benefit account verification;</text>
							</subparagraph><subparagraph id="IDe27903e3e9a4421f99ac42097610968d"><enum>(J)</enum><text>a system for
				wireless retail food stores to receive funds in an amount not exceeding the
				cost of a wireless point-of-sale terminal if alternative wireless technology is
				used; and</text>
							</subparagraph><subparagraph id="ID3af3315b57c7453596677c96f605b99e"><enum>(K)</enum><text>the potential for
				entering into a contract or memoranda of understanding with a statewide
				nonprofit organization, such as a statewide farmers market association, to
				assist the State agency by providing outreach, training, and administration in
				wireless electronic benefit transfer equipment deployment at multiple-vendor
				farmers markets, particularly in cases in which scrip (such as farmers market
				tokens) is used to simplify program participation by agricultural producers and
				vendors.</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDce3499c8a83246fa8a31980edec05611"><enum>(3)</enum><text>in paragraph
			 (3)(B)—</text>
					<subparagraph id="ID0e29edd4fd1c4cb68fcce142681ac803"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="ID8d956326266f4d0b937d0959f21424cb"><enum>(B)</enum><text>in clause (ii),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="ID254d8a9359d3429080af9d23a80dfd9b"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id06C350B978574E1A975042AB9D23AEF7" style="OLC">
							<clause id="ID5bb9268af3a2467da5d0a4d768ce2438"><enum>(iii)</enum><text>in the case of
				wireless retailers, wireless electronic benefit and wireless EBT connection
				services are
				available.</text>
							</clause><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID7d132b379942454085fa881acd653056"><enum>(4)</enum><text>in paragraph (5),
			 by inserting before the period at the end <quote>, including wireless
			 electronic benefit systems that enable all wireless retailers to provide for
			 improved access to nutritious foods in areas lacking such access, and in
			 disaster-recovery situations</quote>;</text>
				</paragraph><paragraph id="ID4729a24f7d324246b8af20cedf56fad5"><enum>(5)</enum><text>by redesignating
			 the second paragraph (12) (relating to interchange fees) as paragraph (13);
			 and</text>
				</paragraph><paragraph id="ID2ead03a51bbe49c49f0001d8ed1ed095"><enum>(6)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id39E21198FADF4D208F66E16EF3F43A79" style="OLC">
						<paragraph id="ID9edd2601970041c0974eb06c9c4893f1"><enum>(14)</enum><header>Non-ebt
				transactions</header><text>Wireless EBT equipment provided to an authorized
				retailer may be used for non-EBT transactions (such as credit and debit card
				transactions) only if the retailer bears all costs associated with those
				non-EBT
				transactions.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDae0f8258ecd643be8599c2bcaba58b3c"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 16(a) of the Food and Nutrition Act of 2008 (7
			 U.S.C. 2025(a)) is amended—</text>
				<paragraph id="IDfd59023c7a0b4d2e8a369455671d8a36"><enum>(1)</enum><text>in paragraph (2),
			 by inserting <quote>, including wireless access fees</quote> after <quote>the
			 State</quote>;</text>
				</paragraph><paragraph id="ID7113c098fbac48448a4255e66602c17b"><enum>(2)</enum><text>in paragraph (7),
			 by striking <quote>and</quote> at the end; and</text>
				</paragraph><paragraph id="IDa4474e201dad4a1bbef7d7e74d6798b8"><enum>(3)</enum><text>by striking
			 <quote>: <italic>Provided,</italic> That the</quote> and inserting <quote>, and
			 (9) outreach and training for farmers markets and other vendors defined in
			 section 7(h)(1)(A) in wireless electronic benefit transfer equipment deployment
			 and operations, particularly in cases in which scrip (such as farmers market
			 tokens) is used to facilitate and simplify program participation by
			 agricultural producers and vendors. The</quote>.</text>
