		<official-title>To amend section 9401 of the Elementary and Secondary
		  Education Act of 1965 with regard to waivers of statutory and regulatory
		  requirements.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>State Innovation Pilot Act of
			 2011</short-title></quote>.</text>
		</section><section id="id6BCC77C6757344D9AFC36F685EE2BD94"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="id6C4421F88F474F0187F38100FFA495A1"><enum>(1)</enum><text>to support State,
			 local, and tribal leadership and innovation in preparing all students to meet
			 State-developed college and career ready academic content standards and student
			 academic achievement standards, by establishing a process to permit State,
			 local, and tribal educational leaders to implement alternative and innovative
			 strategies to improve student academic achievement and otherwise meet the
			 purposes of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301
			 et seq.); and</text>
			</paragraph><paragraph id="IDf5180b5449274b7c852a4c723c6e416d"><enum>(2)</enum><text>to direct the
			 Secretary of Education to defer to State, local, and tribal judgments regarding
			 how best to accomplish the purposes of the Elementary and Secondary Education
			 Act of 1965.</text>
			</paragraph></section><section id="id3B3E8FDA84A9485798E6F7B78A75F29A"><enum>3.</enum><header>Waivers of
			 statutory and regulatory requirements</header><text display-inline="no-display-inline">Section 9401 of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 7861) is amended—</text>
			<paragraph id="idBBAC630013E74C0DBC1A35EAC2D7F14D"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8AA94B3FB2424C3CA807F2623FF2F829" style="OLC">
					<subsection id="id436B18D9D6F14908BCC7CD12C77BBEC5"><enum>(a)</enum><header>In
				General</header>
						<paragraph id="idD14C16B160564D22BAD0E37C7EA973D1"><enum>(1)</enum><header>Request for
				Waiver</header><text>A State educational agency, local educational agency, or
				Indian tribe that receives funds under a program authorized under this Act may
				submit a request to the Secretary to waive any statutory or regulatory
				requirement of this Act.</text>
						</paragraph><paragraph id="id5E6C361AB6B3413184510AB05435B9E4"><enum>(2)</enum><header>Receipt of
				Waiver</header><text>Except as provided in subsection (c), the Secretary shall
				waive any statutory or regulatory requirement of this Act for a State
				educational agency, local educational agency, Indian tribe, or school (through
				a local educational agency), that submits a waiver request pursuant to this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id830DAF3C80E04A28A19C0221EF0059AB"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="id56EA5A539E4E4A4B88B2EEEE7D89A3EE"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="idABAED794558E412BBD0003941F247270"><enum>(i)</enum><text>in
			 the matter preceding subparagraph (A), by inserting <quote>, which shall
			 include a plan</quote> after <quote>waiver request to the
			 Secretary</quote>;</text>
					</clause><clause id="idFA1D4E24352D4EA58C2B4EA1165D4497"><enum>(ii)</enum><text>in
			 subparagraph (B), by striking <quote>and how the waiving of those requirements
			 will</quote> and all that follows through the end, and inserting a
			 semicolon;</text>
					</clause><clause id="idA5AD9649F06C4CD1B9B33855DF5705A7"><enum>(iii)</enum><text>by
			 redesignating subparagraph (E) as subparagraph (F); and</text>
					</clause><clause id="id0D00849CE46C4A92961F51028AEED168"><enum>(iv)</enum><text>by
			 striking subparagraphs (C) and (D), and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id66C0679AE330466C8695807A50F1B4DF" style="OLC">
							<subparagraph id="id03F1D22894514D4788EEBA0F24D52357"><enum>(C)</enum><text>reasonably
				demonstrates that the waiver will improve instruction for students, advance
				student academic achievement, and contribute to student mastery of knowledge
				and skills, consistent with the State's college and career ready academic
				content standards and student academic achievement standards;</text>
							</subparagraph><subparagraph id="id2A67F5789ECA48D8A7D0B0AA2CF4ECC6"><enum>(D)</enum><text>describes the
				methods the State educational agency, local educational agency, or Indian tribe
				will use to—</text>
								<clause id="idF584D70BF371443EBCB1F4DDA9AF94BC"><enum>(i)</enum><text>monitor the
				effectiveness of the implementation of the plan; and</text>
								</clause><clause id="idE3FC939FEAC547A5B17FD52869845016"><enum>(ii)</enum><text>assure regular
				evaluation and continuous improvement of the plan;</text>
								</clause></subparagraph><subparagraph id="id3F605AF3617743C98E1709923AA32E2C"><enum>(E)</enum><text>as applicable to
				the waiver request—</text>
								<clause id="id719F02ABC0CF41879D2309A309C4DA5A"><enum>(i)</enum><text>describes the
				State educational agency, local educational agency, or Indian tribe's process
				for making valid and meaningful accountability determinations, based on student
				academic achievement, to review the success of schools and local educational
				agencies or Indian tribes in implementing the State's college and career ready
				academic content standards and student academic achievement standards;</text>
								</clause><clause id="id9E7B314BA75A465D85A56F287E9E03EA"><enum>(ii)</enum><text>describes the
				State educational agency, local educational agency, or Indian tribe's process
				for accurately and meaningfully identifying, supporting, and intervening in
				underperforming schools, consistent with applicable State or local policy;
				and</text>
								</clause><clause id="idECEB9A35F6A54765A6512FA0F64AAF7B"><enum>(iii)</enum><text>includes
				information on how the State educational agency, local educational agency, or
				Indian tribe will maintain and improve transparency in reporting to parents and
				the public on student achievement and school performance, including the
				achievement of students according to the student subgroups described in
				subclauses (I) through (IV) of section 1111(b)(2)(B)(viii);
				and</text>
								</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="id013C9BEC044E45AE8B6D690BCB1591AA"><enum>(B)</enum><text>in paragraph
			 (2)(B)(i)(II), by striking <quote>(on behalf of, and based on the requests of,
			 local educational agencies)</quote> and inserting <quote>(on their own behalf,
			 or on behalf of, and based on the requests of, local educational agencies in
			 the State)</quote>;</text>
				</subparagraph><subparagraph id="id5D941AA834C642DB986C1FC42ED271C3"><enum>(C)</enum><text>in paragraph
			 (3)(A), in the matter preceding clause (i), by inserting <quote>or on behalf of
			 local educational agencies in the State,</quote> after <quote>acting on its own
			 behalf, </quote>; and</text>
				</subparagraph><subparagraph id="id9ADDB5AF947244EBBC4DC83E23F90636"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id58B38C1D87B7461D9D3F0F358CAD027F" style="OLC">
						<paragraph id="idBD4294BCCE224F93AAD15CD4BC6EBC4C"><enum>(4)</enum><header>Peer
				Review</header>
							<subparagraph id="id271A35B45935482C945161E9C7DB34CA"><enum>(A)</enum><header>Peer Review
				Team</header>
								<clause id="idF2D47F9BAC32442DB1BF9A60042F84A5"><enum>(i)</enum><header>In
				General</header><text>The Secretary shall establish multi-disciplinary peer
				review teams and appoint members to such teams, including persons who have
				experience with a State educational agency (or local educational agency or
				Indian tribe, as appropriate) and broader education reform experience, to
				review waiver requests under this section if—</text>
									<subclause id="id8AC4DD434A9746A6B4F56D50B4F4C155"><enum>(I)</enum><text>the Secretary
				requests such input in order to approve a waiver request; or</text>
									</subclause><subclause id="id96AA175A221D4586A6CF3D05E5136983"><enum>(II)</enum><text>the Secretary
				intends to disapprove a request.</text>
									</subclause></clause><clause id="idB0E762AB22614F8CA83216028FC21DA7"><enum>(ii)</enum><header>Team in place
				for all waiver requests</header><text>The Secretary may, at the Secretary’s
				discretion, have a peer review team review all waiver requests submitted under
				this section.</text>
								</clause></subparagraph><subparagraph id="id5BB109FA77EF40CCB693AFD041346954"><enum>(B)</enum><header>Applicability</header><text>The
				Secretary may approve a waiver request under this section without conducting a
				peer review of the request, but shall use the peer review process under this
				paragraph before disapproving such a request.</text>
							</subparagraph><subparagraph id="idE7A041C92B054BDC95AFF4C9271BECFB"><enum>(C)</enum><header>Purpose of Peer
				Review</header><text>The peer review process shall be designed to—</text>
								<clause id="idCEC793792F454FD88C23FA157E8B7930"><enum>(i)</enum><text>promote effective
				implementation of State-developed college and career ready academic content
				standards and student academic achievement standards, through State and local
				innovation; and</text>
								</clause><clause id="id63426EDAD26A4AF2BFA8A8F5FDB35879"><enum>(ii)</enum><text>provide
				transparent feedback to State educational agencies, local educational agencies,
				or Indian tribes, designed to strengthen the applicant's plan described under
				paragraph (1)(C).</text>
								</clause></subparagraph><subparagraph id="id7EE0D00461EE4298B6D6436E6CDA767E"><enum>(D)</enum><header>Standard and
				Nature of Review</header><text>Peer reviewers shall conduct a good faith review
				of waiver requests submitted to them under this section. Peer reviewers shall
				review such waiver requests—</text>
								<clause id="idE4FD5EFDACA44701BC34BBD38FB1C8EB"><enum>(i)</enum><text>in their
				totality;</text>
								</clause><clause id="idA98045810FA84D4898432A75E3778F5E"><enum>(ii)</enum><text>in deference to
				State and local judgment; and</text>
								</clause><clause id="id7168BAEA96B64679A86D93C56ACD7F33"><enum>(iii)</enum><text>with the goal
				of promoting State- and local-led innovation.</text>
								</clause></subparagraph></paragraph><paragraph id="id4EC194DF15484648A966F60D5F6ED645"><enum>(5)</enum><header>Waiver
				Determination, Demonstration, and Revision</header>
							<subparagraph id="id6A6259E8B6424AC19416C730B4391F86"><enum>(A)</enum><header>In
				General</header><text>The Secretary shall approve a waiver request not more
				than 90 days after the date on which such request is submitted, unless the
				Secretary determines and demonstrates that—</text>
								<clause id="id0AC25FA64BA64B52B081BE6602EFB4D7"><enum>(i)</enum><text>the waiver
				request does not meet the requirements of this section;</text>
								</clause><clause id="idDFCE385E4DC7404095A31F839C8E808A"><enum>(ii)</enum><text>the waiver is
				not permitted under subsection (c);</text>
								</clause><clause id="idF301B1D6CA1E4700B9B1E599AA2E654F"><enum>(iii)</enum><text>the plan that
				is required under paragraph (1)(C), and reviewed with deference to State and
				local judgment, provides no reasonable basis to determine that a waiver will
				enhance student academic achievement; or</text>
								</clause><clause id="id77B1028D89B341DAABF018017A463F93"><enum>(iv)</enum><text>the waiver
				request does not provide for adequate evaluation to ensure review and
				continuous improvement of the plan, consistent with paragraph (1)(D).</text>
								</clause></subparagraph><subparagraph id="idCFFE3FA373674896A6B57EEACED3DB96"><enum>(B)</enum><header>Waiver
				Determination and Revision</header><text>If the Secretary determines and
				demonstrates that the waiver request does not meet the requirements of this
				section, the Secretary shall—</text>
								<clause id="id0D3D70F3C7E34F82ADBE8F3F58674E82"><enum>(i)</enum><text>immediately—</text>
									<subclause id="idB94EA86062514297B701C76DA9019A51"><enum>(I)</enum><text>notify the State
				educational agency, local educational agency, or Indian tribe of such
				determination; and</text>
									</subclause><subclause id="id68DB5D283FEC4C58A230068DFB7CA06D"><enum>(II)</enum><text>at the request
				of the State educational agency, local educational agency, or Indian tribe,
				provide detailed reasons for such determination in writing;</text>
									</subclause></clause><clause id="idC917D4F4C40643F18112CEEE0EFAA9C3"><enum>(ii)</enum><text>offer the State
				educational agency, local educational agency, or Indian tribe an opportunity to
				revise and resubmit the waiver request not more than 60 days after the date of
				such determination; and</text>
								</clause><clause id="idF0F4AD5D7B3E48E8BAFE13967D7750A4"><enum>(iii)</enum><text>if the
				Secretary determines that the resubmission does not meet the requirements of
				this section, at the request of the State educational agency, local educational
				agency, or Indian tribe, conduct a public hearing not more than 30 days after
				the date of such resubmission.</text>
								</clause></subparagraph><subparagraph id="id159A4FE8AA964222BAE4ABE6FB5DC0CF"><enum>(C)</enum><header>Waiver
				Disapproval</header><text>The Secretary may disapprove a waiver request
				if—</text>
								<clause id="idC2B6E3ECB8BA491BBB1507F85CB7D8C8"><enum>(i)</enum><text>the State
				educational agency, local educational agency, or Indian tribe has been notified
				and offered an opportunity to revise and resubmit the waiver request, as
				described under clauses (i) and (ii) of subparagraph (B); and</text>
								</clause><clause id="idAF1515CAF85C442499FB3A445F7D3FF7"><enum>(ii)</enum><text>the State
				educational agency, local educational agency, or Indian tribe—</text>
									<subclause id="idFC29636B6CEB4FB28F46DBC50579146E"><enum>(I)</enum><text>does not revise
				and resubmit the waiver request; or</text>
									</subclause><subclause id="idEC0985D9899646E994DE38B6515AA75A"><enum>(II)</enum><text>revises and
				resubmits the waiver request, and the Secretary determines that such waiver
				request does not meet the requirements of this section after a hearing
				conducted under subparagraph (B)(iii).</text>
									</subclause></clause></subparagraph><subparagraph id="id64FE1B5867134BE3A6CF29D1A95B7A0D"><enum>(D)</enum><header>External
				Conditions</header><text>The Secretary shall not disapprove a waiver request
				under this section based on conditions outside the scope of the waiver
				request.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id03CE572DEB40439E9F0B906D26414CDF"><enum>(3)</enum><text>in subsection
			 (d)—</text>
				<subparagraph id="id9C392E661D894888870337A52336AAC1"><enum>(A)</enum><text>in the heading,
			 by adding <quote><header-in-text level="subsection" style="OLC">;
			 Limitations</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Duration and Extension of
			 Waiver</header-in-text></quote>; and</text>
				</subparagraph><subparagraph id="id3D138E7F70B24E789D302B0B09CE7089"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4EDB18310FC64D39AB7248529EC3E1C9" style="OLC">
						<paragraph id="idB024056238254CD2854DF2E20BF4440B"><enum>(3)</enum><header>Specific
				Limitations</header><text>The Secretary shall not require a State educational
				agency, local educational agency, or Indian tribe, as a condition of approval
				of a waiver request, to—</text>
							<subparagraph id="id4DA23E4C95D744B588C442131BA62ECB"><enum>(A)</enum><text>include in, or
				delete from, such request, specific academic content standards or academic
				achievement standards;</text>
							</subparagraph><subparagraph id="idCA9A7340EDD84FA6833BB3D09D32B4F3"><enum>(B)</enum><text>use specific
				academic assessment instruments or items; or</text>
							</subparagraph><subparagraph id="id4075C355BC5F4801B35A7823EA722379"><enum>(C)</enum><text>include in, or
				delete from, such waiver request any criterion that specifies, defines, or
				prescribes the standards or measures that a State or local educational agency
				uses to establish, implement, or improve—</text>
								<clause id="id61A9091EADC34410922F4DF2CF283367"><enum>(i)</enum><text>State academic
				content standards or academic achievement standards;</text>
								</clause><clause id="id0EF124F34DAD4AA5BC190FB5EF24C627"><enum>(ii)</enum><text>assessments;</text>
								</clause><clause id="idCD0D44262FC14D808561BD0957A7D876"><enum>(iii)</enum><text>State
				accountability systems;</text>
								</clause><clause id="idB0C1AAA3BCCF4641A71EF6CEC587A3ED"><enum>(iv)</enum><text>systems that
				measure student growth;</text>
								</clause><clause id="idF3E475715C6C4703921EFDC1CA0754DB"><enum>(v)</enum><text>measures of other
				academic indicators; or</text>
								</clause><clause id="id9A24C2BAD3644BA8A3A1C27BA165F4BC"><enum>(vi)</enum><text>teacher and
				principal evaluation
				systems.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id94E2302BFBB641F8A5590EC0C3F043BD"><enum>(4)</enum><text>in subsection
			 (e)—</text>
				<subparagraph id="id3243B66AEBE74370BDCC25E7682E5113"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="id6F1BDDAABC934A55BA9AC6EDA40DAE29"><enum>(i)</enum><text>by
			 striking the heading and inserting <quote><header-in-text level="paragraph" style="OLC">Waiver Reports</header-in-text></quote>;</text>
					</clause><clause id="idC9D7710E2799464F8CB2DCBEE6811A0F"><enum>(ii)</enum><text>in
			 the matter preceding subparagraph (A)—</text>
						<subclause id="idFB01D5A9F31B4E6EA9637DA9F7E1B4EC"><enum>(I)</enum><text>by striking
			 <quote>local educational agency that receives</quote> and inserting
			 <quote>State educational agency, local educational agency, or Indian tribe that
			 receives</quote>; and</text>
						</subclause><subclause id="id45C6B6DF67DB4428AFCE07181CE9671B"><enum>(II)</enum><text>by striking
			 <quote>submit a report to the State educational agency that</quote> and
			 inserting <quote>submit a report to the Secretary that</quote>;</text>
						</subclause></clause></subparagraph><subparagraph id="idD051077836CE4A0A894E94E62B7EC80B"><enum>(B)</enum><text>by striking
			 paragraphs (2) and (3);</text>
				</subparagraph><subparagraph id="id0F2477D32AC040D3B3582C6AE7343A2E"><enum>(C)</enum><text>by redesignating
			 paragraph (4) as paragraph (2); and</text>
				</subparagraph><subparagraph id="id322B1DA2384C4C43AAB5A63DCAFAC5E7"><enum>(D)</enum><text>in paragraph (2),
			 (as redesignated by subparagraph (C)), by striking <quote>Beginning in fiscal
			 year 2002 and for each subsequent year, the Secretary shall submit to the
			 Committee</quote> and inserting <quote>The Secretary shall annually submit to
			 the Committee</quote>; and</text>
				</subparagraph></paragraph><paragraph id="id5A4FD33603B549739CDC02008BD80B35"><enum>(5)</enum><text>in subsection
			 (f), by inserting <quote>and the recipient of the waiver has failed to make
			 revisions needed to carry out the purpose of the waiver,</quote> after
			 <quote>has been inadequate to justify a continuation of the
			 waiver</quote>.</text>
