			 authority</header><text display-inline="no-display-inline">Section 7 of the
			 Export-Import Bank Act of 1945 (12 U.S.C. 635f) is amended by striking
			 <quote>2011</quote> and inserting <quote>2015</quote>.</text>
		</section><section id="idA393D28EF1F049169B0DB7F0BA31CC87"><enum>3.</enum><header>Foreign Credit
			 Insurance Association</header><text display-inline="no-display-inline">Section
			 2(b)(1) of the Export-Import Bank Act of 1945 (12 U.S.C. 635(b)(1)) is amended
			 by striking subparagraph (F).</text>
		</section><section id="id0CC0A06186F14AEA8E7EB6E13DFC2462"><enum>4.</enum><header>Marxist-Leninist
			 country defined</header><text display-inline="no-display-inline">Section
			 2(b)(2)(B)(ii) of the Export-Import Bank Act of 1945 (12 U.S.C.
			 635(b)(2)(B)(ii)) is amended by striking subclauses (I), (IV), and (VII) and by
			 redesignating subclauses (II), (III), (V), (VI), (VIII), and (IX) as subclauses
			 (I), (II), (III), (IV), (V), and (VI), respectively.</text>

			 Africa Advisory Committee</header><text display-inline="no-display-inline">Section 2(b)(9)(B)(iii) of the Export-Import

			 <quote>2011</quote> and inserting <quote>2015</quote>.</text>

			 guarantee, and insurance authority</header><text display-inline="no-display-inline">Section 6(a)(2) of the Export-Import Bank
			 Act of 1945 (12 U.S.C. 635e(a)(2)) is amended—</text>

			 <quote>and</quote> at the end of subparagraph (D);</text>
			</paragraph><paragraph id="ID828901e8a08b4b4b854ec9f7c083643c"><enum>(2)</enum><text>by striking
			 <quote>2011,</quote> at the end of subparagraph (E) and inserting <quote>2011,
			 $100,000,000,000;</quote>; and</text>

			 services the primary end use of which will be for civilian
			 purposes</header><text display-inline="no-display-inline">Section 4 of Public
			 Law 109–438 (12 U.S.C. 635 note; 108 Stat. 4376) is amended by striking
			 <quote>2011</quote> and inserting <quote>2015</quote>.</text>
		</section><section id="ID6a8f85e264a642fbb725964b1461dac7"><enum>8.</enum><header>Modifications to
			 provisions relating to textiles</header>
			<subsection id="ID36ad2d11efa141c2a68dd5e6f4baf742"><enum>(a)</enum><header>Representation
			 of the textile industry on advisory committee</header><text display-inline="yes-display-inline">Section 3(d)(1)(B) of the Export-Import
			 Bank Act of 1945 (12 U.S.C. 635a(d)(1)(B)) is amended by striking <quote>and
			 State government</quote> and inserting <quote>State government, and the textile
			 industry</quote>.</text>
			</subsection><subsection id="id393DCADD3FB34B23ADC1A34886017E3F"><enum>(b)</enum><header>Annual report
			 regarding textile and apparel goods</header><text>Section 8 of the
			 Export-Import Bank Act of 1945 (12 U.S.C. 635g) is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id0F1B508E62384B3FB21F89AFB066FC66" style="OLC">
					<subsection id="ID6e8bcb9078564f638b55e09b6bb473d0"><enum>(g)</enum><header>Textile and
				apparel supply chain financing</header><text>The Bank shall include in its
				annual report to the Congress—</text>
						<paragraph id="idB71E599EA3514DEC855C0C28A2C001C6"><enum>(1)</enum><text>a description of
				the efforts of the Bank to provide financing to the United States textile and
				apparel industry for exports of textile and apparel goods manufactured in the
				United States that are used as components in global textile and apparel supply
				chains; and</text>
						</paragraph><paragraph id="id03E5521086C84EDF8AD11F9CD68FC263"><enum>(2)</enum><text>the amount of
				support the Bank provided for the export of textiles and apparel goods for each
				of the 3 years preceding the
				report.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id37BDA05B34984003AEDCE2C9ACABF17C"><enum>9.</enum><header>Review and
			 report on domestic content policy</header>
			<subsection id="id60C3A56702804EF0831429BCCD169054"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Export-Import
			 Bank of the United States shall conduct a review of its domestic content policy
			 for medium- and long-term transactions. The review shall examine and evaluate
			 the effectiveness of the Bank’s policy—</text>
				<paragraph id="idA9F39FDA84094CFBB501DD45CCC10366"><enum>(1)</enum><text display-inline="yes-display-inline">in maintaining and creating jobs in the
			 United States; and</text>
				</paragraph><paragraph id="idAE0AA6B8181A4ABF9E79594ECD34D516"><enum>(2)</enum><text display-inline="yes-display-inline">in contributing to a stronger national
			 economy through the export of goods and services.</text>
				</paragraph></subsection><subsection id="ID125187ba840a4262b34052476e835cbb"><enum>(b)</enum><header>Factors To
			 Consider</header><text>In conducting the review under subsection (a), the Bank
			 shall consider the following:</text>
				<paragraph id="ID21d99e116ab34f06b8594b39c57d69c2"><enum>(1)</enum><text>Whether the
			 domestic content policy accurately captures the costs of United States
			 production of goods and services, including the direct and indirect costs of
			 manufacturing costs, parts, components, materials and supplies, research,
			 planning engineering, design, development, production, return on investment,
			 marketing and other business costs and the effect of such policy on the
			 maintenance and creation of jobs in the United States.</text>
				</paragraph><paragraph id="ID441ec7dd73fb4cf880d2048f11e975f9"><enum>(2)</enum><text>The ability of
			 the Bank to provide financing that is competitive with the financing provided
			 by foreign export credit agencies and the impact that such financing has in
			 enabling companies with operations in the United States to contribute to a
			 stronger United States economy by increasing employment through the export of
			 goods and services.</text>
				</paragraph><paragraph id="ID616b1e9becc948949a7e523db1f8e017"><enum>(3)</enum><text>The effects of
			 the domestic content policy on the manufacturing and service workforce of the
			 United States.</text>
				</paragraph><paragraph id="IDf5dc1410211d492da9a771a1eb8470b3"><enum>(4)</enum><text>Any
			 recommendations the members of the Bank's Advisory Committee have regarding the
			 Bank's domestic content policy.</text>
				</paragraph><paragraph id="ID57a8b9fe23674650863f853a8826a10e"><enum>(5)</enum><text>The effect that
			 changes to the Bank’s domestic content requirements would have in providing
			 companies an incentive to create and maintain operations in the United States
			 and to increase jobs in the United States.</text>
				</paragraph></subsection><subsection id="idD2CED035E21E411F99A8D997141B1383"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Bank shall submit a report on the results of the
			 review conducted under this section to the Committee on Banking, Housing, and
			 Urban Affairs of the Senate, and the Committee on Financial Services of the
			 House of Representatives.</text>
			</subsection></section><section id="id4BB8ED89D5D64DB2B3B41EB66B1180B0"><enum>10.</enum><header>Strategic
			 plan</header><text display-inline="no-display-inline">Section 8 of the
			 Export-Import Bank Act of 1945 (12 U.S.C. 635g), as amended by section 8, is
			 further amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="id8613EBA619B0418485E33659BD286A17" style="OLC">
				<subsection commented="no" id="ID1d7aa7a6ae1444f497bd44dc6f7edf12"><enum>(h)</enum><header>Strategic plan
				for the bank</header>
					<paragraph commented="no" id="IDb2398927edd046e0b0f3f6f3914b1b66"><enum>(1)</enum><header>In
				general</header><text>The Bank shall include in its annual report to the
				Congress under subsection (a) of this section, not less than every 4 years,
				beginning in 2012, a 5-year strategic plan that provides—</text>
						<subparagraph commented="no" id="ID1d48366feccc4077993dd74a9bab46a8"><enum>(A)</enum><text>a comprehensive
				mission statement covering the major functions and operations of the
				Bank;</text>
						</subparagraph><subparagraph commented="no" id="ID02a897b1e8a64660aaf92a3ae5bbcaa7"><enum>(B)</enum><text>general goals and
				objectives, including outcome-oriented goals, for the major functions of the
				Bank;</text>
						</subparagraph><subparagraph commented="no" id="ID47e024471299426a81446bd917e527a0"><enum>(C)</enum><text>a description of
				the Bank’s highest-priority goals and how they can be achieved within the
				5-year plan period, according to clearly defined milestones; and</text>
						</subparagraph><subparagraph commented="no" id="IDcaf1fa49fe66478c9bad545031fdc896"><enum>(D)</enum><text>a description of
				how the goals and objectives incorporate views and suggestions obtained through
				congressional consultations;</text>
						</subparagraph></paragraph><paragraph commented="no" id="ID4aea8df6a7ee4759ae61a5e1eecdf759"><enum>(2)</enum><header>Progress</header><text>The
				progress the Bank is making in meeting the milestones established by the
				strategic plan shall be updated in each annual report the Bank submits to the
				Congress.</text>
					</paragraph><paragraph commented="no" id="IDd503e15f240549d3a00453f0fdb9af2b"><enum>(3)</enum><header>Availability of
				annual report</header><text>The Bank shall make its annual report available on
				its public
				website.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID76082944352c4cd1a9d629cf850123c1"><enum>11.</enum><header>Review and
			 report on Bank's information technology infrastructure</header>
			<subsection id="IDe1e9d511b709491cbd96282ae8712fa4"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Export-Import Bank of the United States shall conduct a review
			 of the Bank's information technology infrastructure and report to Congress
			 on—</text>
				<paragraph id="ID1f5575ca926247fc858316ffa12c3662"><enum>(1)</enum><text>how the Bank will
			 modernize and continue to maintain the technology infrastructure, taking into
			 consideration commercially available technologies or other cost-savings
			 measures; and</text>
				</paragraph><paragraph id="IDbe36d30ceb544d8a94328f61d5f856c1"><enum>(2)</enum><text>how
			 modernization, maintenance, and other cost-saving measures will result—</text>
					<subparagraph id="id09BB965D8135496EB4B1FEB65CBEE331"><enum>(A)</enum><text>in improved
			 service delivery to customers of the Bank;</text>
					</subparagraph><subparagraph id="id05D1BDA0E9204E04A0F3B75A35CAF4D5"><enum>(B)</enum><text>in generally
			 improving the Bank's performance; and</text>
					</subparagraph><subparagraph id="id51CEAEBEF2B642708216F4EC451876E1"><enum>(C)</enum><text>in mitigating
			 taxpayer exposure to losses.</text>
					</subparagraph></paragraph></subsection></section><section id="IDe6fa58f472384ddb8e0c89cbb3ad55d9"><enum>12.</enum><header>Study by the
			 Comptroller General on risk management</header>
			<subsection id="ID276ced6fe525452098f101ede31a33e0"><enum>(a)</enum><header>In
			 general</header><text>Not later than 18 months after the date of the enactment
			 of this Act, the Comptroller General of the United States shall complete and
			 submit to the Export-Import Bank of the United States, the Committee on
			 Banking, Housing, and Urban Affairs of the Senate and the Committee on
			 Financial Services of the House of Representatives a report—</text>
				<paragraph id="ID461113d31e6f40919667b675f889dc24"><enum>(1)</enum><text>on the financial
			 position of the Bank and the risks it poses for American taxpayers; and</text>
				</paragraph><paragraph id="IDb696f75558434207bb22d8e949629126"><enum>(2)</enum><text>that contains
			 recommendations to the Bank on how to properly account for risk and ensure the
			 solvency of the Bank.</text>
				</paragraph></subsection><subsection id="IDc2d56bacc07547a6a96fcd10270ac9c5"><enum>(b)</enum><header>Report</header><text>The
			 report submitted under subsection (a) shall evaluate—</text>
				<paragraph id="IDe304f5e46e4942f0bb74b9fa2bbd8d01"><enum>(1)</enum><text>the effectiveness
			 of the Bank’s risk management;</text>
				</paragraph><paragraph id="IDc7fe520f081d4ceb805e02f6a855ad38"><enum>(2)</enum><text>the adequacy of
			 the Bank’s loan loss reserves;</text>
				</paragraph><paragraph id="ID06f134f4d2604364ab5e046fd1386b5f"><enum>(3)</enum><text>the exposure and
			 potential for exposure to losses from each of the products offered by the
			 Bank;</text>
				</paragraph><paragraph id="IDb69588799d3446549c16226442d1d3fa"><enum>(4)</enum><text>the overall risk
			 of the Bank’s portfolio, taking into account—</text>
					<subparagraph id="id917D5384789D4749AF48033A216D814A"><enum>(A)</enum><text>market
			 risk;</text>
					</subparagraph><subparagraph id="idB167FCE689A145F3A468297FE4B4AF15"><enum>(B)</enum><text>credit
			 risk;</text>
					</subparagraph><subparagraph id="id13207D99DAAB425B91EB2980EA71377D"><enum>(C)</enum><text>political
			 risk;</text>
					</subparagraph><subparagraph id="idD81BE605C37043BDB2BA9F87D4DC5ECC"><enum>(D)</enum><text>industry-concentration
			 risk;</text>
					</subparagraph><subparagraph id="id138BB307C218414F82F263FBC8E8620E"><enum>(E)</enum><text>geographic-concentration
			 risk;</text>
					</subparagraph><subparagraph id="id52009DFF1DF84E36BA9F67C05114C8CE"><enum>(F)</enum><text>obligor-concentration
			 risk; and</text>
					</subparagraph><subparagraph id="id30D031BF4EB446F089E99134C9F873F5"><enum>(G)</enum><text>foreign-currency
			 risk;</text>
					</subparagraph></paragraph><paragraph id="ID2973afaefafa4f9d9aba601f87d57364"><enum>(5)</enum><text>the Bank’s use of
			 historical default and recovery rates to calculate future program costs, taking
			 into consideration cost estimates determined under the Federal Credit Reform
			 Act of 1990 (2 U.S.C. 661 et seq.) and whether discount rates applied to cost
			 estimates should reflect the risks described in paragraph (4);</text>
				</paragraph><paragraph id="IDbc17337106d04aad972cf6881a85cdd3"><enum>(6)</enum><text>the fees charged
			 by the Bank for the products the Bank offers, whether the Bank’s fees properly
			 reflect the risks described in paragraph (4), and how the fees are affected by
			 United States participation in international agreements; and</text>
				</paragraph><paragraph id="IDdce206b70ca642a5a3816f342ea9de52"><enum>(7)</enum><text>whether the
			 Bank’s loan loss reserves policy is sufficient to cover the risks described in
			 paragraph (4).</text>
				</paragraph></subsection><subsection id="ID9f9cf897ccc542b8b329bea41a0b65c3"><enum>(c)</enum><header>Recommendations
			 and report by the bank</header><text>If the Bank does not adopt the
			 recommendations provided under subsection (a) by the Comptroller General, the
			 Bank shall submit to Congress, not later than 60 days after the Bank receives
			 the report, a report on why the Bank has not adopted the
			 recommendations.</text>
			</subsection></section><section id="IDb519f87ef56d4c42b0f3ece5e7cc0e55"><enum>13.</enum><header>Renewable
			 energy and energy efficiency technologies</header>
			<subsection id="id5C5097479F1940639E8A9F371E1DB060"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Export-Import
			 Bank of the United States should work to increase the export of renewable
			 energy technologies and end-use energy efficiency technologies with a goal of
			 significantly expanding, year-after-year, the Bank's annual aggregate loan,
			 guarantee, and insurance authorizations supporting those technologies.</text>
			</subsection><subsection id="id6D2205EC959B4554983A4C26B159BB10"><enum>(b)</enum><header>Increased
			 reporting requirements</header><text>The Export-Import Bank of the United
			 States shall include in its annual report to the Congress an analysis of any
			 barriers to realizing the Bank’s congressional directive to increase the Bank's
			 financing for renewable energy technology and end-use energy efficiency
			 technology and any tools the Bank needs to assist the Bank in overcoming those
			 barriers. The analysis shall include barriers such as—</text>
				<paragraph id="id13191B55290844A4A1BFA556B2DA3AA7"><enum>(1)</enum><text>inadequate
			 staffing;</text>
				</paragraph><paragraph id="idEB9FB31259CC4D868B1E5D9BB3D98823"><enum>(2)</enum><text>inadequate
			 financial products;</text>
				</paragraph><paragraph id="idB9F5F65654874A5AB97D44AF018432AE"><enum>(3)</enum><text>lack of capital
			 authority; and</text>
				</paragraph><paragraph id="idBC63DFE95C9D497EBDD026DAE47E7D37"><enum>(4)</enum><text>limitations
			 imposed by domestic markets.</text>
				</paragraph></subsection></section><section id="id121610FF603348DC9C8BBD5A91B398C8"><enum>14.</enum><header>Transparency
			 and accountability of bank financing</header><text display-inline="no-display-inline">Section 2(b) of the Export-Import Bank Act
			 of 1945 (12 U.S.C. 635(b)) is amended by inserting after paragraph (3) the
			 following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="idA62667748B7D402193DC2834C80DE000" style="OLC">
				<paragraph id="idC99B4F7F55D442ABA5B623431D73DC89" indent="up1"><enum>(3A)</enum><header>Transparency and accountability of
				bank financing</header>
					<subparagraph id="id224F1EB15B8F438383CA225DA8933295"><enum>(A)</enum><header>Preapproval notice</header><text>Not
				later than 14 days before any meeting of the Board of Directors for final
				approval of a transaction the value of which exceeds $100,000,000, and
				concurrent with any statement required to be submitted under paragraph (3) with
				respect to the transaction, the Bank shall post a notice on the Bank's website
				that includes—</text>
						<clause id="idAEC6BF3F45CD4F2D87BAD676423E1CED"><enum>(i)</enum><text>a description of the transaction
				proposed to be financed;</text>
						</clause><clause id="id6A6A37299EA1464797B58CA56F609255"><enum>(ii)</enum><text>the identities of the obligor,
				principal supplier, and guarantor involved in the transaction; and</text>
						</clause><clause id="idB830C4B0B6314774BD626EB36593F664"><enum>(iii)</enum><text>a description of any item with
				respect to which Bank financing is being sought.</text>
						</clause></subparagraph><subparagraph id="idDC2A00D3F68E4931B1BC3B5C9E9B9977"><enum>(B)</enum><header>Manner of
				disclosure</header><text>Any information required to be disclosed under
				subparagraph (A) shall be disclosed in a manner that does not disclose any
				information that is confidential or proprietary business information, that
				would violate section 1905 of title 18, United States Code (commonly referred
				to as the <quote>Trade Secrets Act</quote>), or that would jeopardize jobs in
				the United States by supplying information which competitors could use to
				compete with companies in the United States.</text>
					</subparagraph><subparagraph id="idBE1DA7CE6CA5488D92396B984F2CB625"><enum>(C)</enum><header>Post consideration</header><text>Not
				later than 30 days after the final approval of a transaction the value of which
				exceeds $100,000,000, the Bank shall post a notice on the Bank's website that
				includes the information required under subparagraph (A) in a manner that
				complies with subparagraph
				(B).</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id15C95ECF9F994F8B8A0ADF88AD59332A"><enum>15.</enum><header>Annual
			 competitiveness report</header><text display-inline="no-display-inline">Section
			 8A(a) of the Export-Import Bank Act of 1945 (12 U.S.C. 635g–1(a)) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idB61B853B7FA2428C98A13FF5ACDF50C1" style="OLC">
				<paragraph id="IDc742ea1ffa494aa2b35b19eb9ace770e"><enum>(11)</enum><header>Case
				processing</header><text>A separate section detailing the Bank's annual survey
				of exporters, financial institutions, and brokers regarding the Bank's
				processing of transactions, timeliness in reviewing transactions and processing
				applications, adherence to financial standards, clarity and ease of use of
				applications, and general customer service during the application and approval
				process for each of the Bank's major programs.</text>
				</paragraph><paragraph id="IDf625497c458541a9ab4fd55f89936a18"><enum>(12)</enum><header>Operations</header><text>A
				separate section detailing the Bank's annual survey of exporters, financial
				institutions, and brokers regarding the Bank's documentation requirements,
				certifications, and processing of applications for medium- and long-term
				program transactions compared to the processing of applications by other export
				credit agencies.</text>
				</paragraph><paragraph id="IDf4e70e7a912c499c9d7891a66697239b"><enum>(13)</enum><header>Process
				improvement</header><text>A description of the recommendations made by the
				Bank’s Advisory Committee and the advisory committee on Sub-Saharan Africa
				established under section 2(b)(9)(B)(ii) regarding improving the Bank's
				processing of transactions and customer service. The Bank shall make every
				reasonable effort to act on the recommendations of the advisory committees and
				shall include a separate section detailing the actions taken by the Bank to
				comply with the
				recommendations.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID46148b7ddc594c5291bf196469036e7b"><enum>16.</enum><header>Prohibitions on
			 financing for certain persons involved in sanctionable activities with respect
			 to Iran</header>
			<subsection id="ID1c4b763b159749ea8833cf0dc3a06dda"><enum>(a)</enum><header>Prohibition on
			 financing for persons that engage in certain sanctionable activities</header>
				<paragraph id="idEF0FF0D1A5AD4217A7E691628E1E56BF"><enum>(1)</enum><header>In
			 general</header><text>Beginning on the date that is 90 days after the date of
			 the enactment of this Act, the Board of Directors of the Export-Import Bank of
			 the United States may not approve any transaction that is subject to approval
			 by the Board with respect to the provision by the Bank of any guarantee,
			 insurance, or extension of credit, or the participation by the Bank in any
			 extension of credit, in connection with the exportation of any good or service
			 by a person unless the person makes the certification described in paragraph
			 (2).</text>
				</paragraph><paragraph id="id8FD738E35DAF4526924A7BFE06760685"><enum>(2)</enum><header>Certification
			 described</header><text>The certification described in this paragraph is a
			 certification by a person—</text>
					<subparagraph id="idA2C68118FF71408580DC38A02E31A818"><enum>(A)</enum><text>that neither the
			 person nor any other person owned or controlled by the person—</text>
						<clause id="IDd3a3e4715def4f27872c2259d52705a0"><enum>(i)</enum><text>engages in any
			 activity described in section 5(a) of the Iran Sanctions Act of 1996 (Public
			 Law 104–172; 50 U.S.C. 1701 note) for which the person may be subject to
			 sanctions under that Act;</text>
						</clause><clause id="ID2607649b737f4dddbd3d5ecf56e0d8c1"><enum>(ii)</enum><text>exports
			 sensitive technology, as defined in section 106 of the Comprehensive Iran
			 Sanctions, Accountability, and Divestment Act of 2010 (22 U.S.C. 8515), to
			 Iran; or</text>
						</clause><clause id="IDce64847819db41208b5714611496615f"><enum>(iii)</enum><text>engages in any
			 activity prohibited by part 560 of title 31, Code of Federal Regulations
			 (commonly known as the <quote>Iranian Transactions Regulations</quote>), unless
			 the activity is disclosed to the Office of Foreign Assets Control of the
			 Department of the Treasury when the activity is discovered; or</text>
						</clause></subparagraph><subparagraph id="id8CA36C53FCAE49718E241CFD372116C1"><enum>(B)</enum><text>if the person or
			 any other person owned or controlled by the person has engaged in an activity
			 described in subparagraph (A), that—</text>
						<clause id="id6CD43B27D9064F6E83D9F10F6B9F99FC"><enum>(i)</enum><text>in
			 the case of an activity described in subparagraph (A)(i), the President—</text>
							<subclause id="id2D400B7B145C440CA34341A80C950B70"><enum>(I)</enum><text>has waived the
			 imposition of sanctions with respect to the person that engaged in that
			 activity pursuant to section 4(c), 6(b)(5), or 9(c) of the Iran Sanctions Act
			 of 1996 (Public Law 104–172; 50 U.S.C. 1701 note);</text>
							</subclause><subclause id="ID3ec28188abdf49898360417066541b9d"><enum>(II)</enum><text>has determined
			 not to initiate, or has terminated, an investigation under section 4(e)(1) of
			 that Act with respect to the person that engaged in that activity pursuant to
			 section 4(e)(3) of that Act; or</text>
							</subclause><subclause id="id89A0E723233C45A7A3EA2EE86DB4CB77"><enum>(III)</enum><text>has determined
			 that the criteria have been met for the exception provided for under section
			 5(a)(3)(C) of that Act to apply with respect to the person that engaged in that
			 activity; or</text>
							</subclause></clause><clause id="ID476bfb68ced84ff984392b48d4878723"><enum>(ii)</enum><text>in
			 the case of an activity described in subparagraph (A)(ii), the President has
			 waived, pursuant to section 401(b)(1) of the Comprehensive Iran Sanctions,
			 Accountability, and Divestment Act of 2010 (22 U.S.C. 8551(b)(1)), the
			 application of the prohibition under section 106(a) of that Act (22 U.S.C.
			 8515(a)) with respect to that person.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="idB8EBF36FE0AE4AFDB7DA483FB3E7819B"><enum>(b)</enum><header>Prohibition on
			 financings</header><text>Beginning on the date that is 90 days after the date
			 of the enactment of this Act, the Board of Directors of the Export-Import Bank
			 of the United States may not approve any transaction that is subject to
			 approval by the Board with respect to the provision by the Bank of any
			 guarantee, insurance, or extension of credit, or the participation by the Bank
			 in any extension of credit, in connection with a financing in which a borrower
			 or controlling sponsor, or a person that is owned or controlled by such
			 borrower or controlling sponsor, is subject to sanctions under section 5(a) of
			 the Iran Sanctions Act of 1996 (Public Law 104–172; 50 U.S.C. 1701
			 note).</text>
			</subsection><subsection id="IDdd2074e7348247da97d3bde866d9d3de"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id21DBCF70E8434370885F555B3169C9EE"><enum>(1)</enum><header>Appropriate
			 congressional committees; person</header><text>The terms <term>appropriate
			 congressional committees</term> and <term>person</term> have the meanings given
			 those terms in section 14(14) of the Iran Sanctions Act of 1996 (Public Law
			 104–172; 50 U.S.C. 1701 note).</text>
				</paragraph><paragraph id="idA6597612FD374C51B06DDB1E31DD8999"><enum>(2)</enum><header>Controlling
			 sponsor</header><text>The term <term>controlling sponsor</term> means an entity
			 providing controlling direct private equity investment (excluding investments
			 made through publicly held investment funds, publicly held securities, public
			 offerings, or similar public market vehicles) in connection with a
			 financing.</text>
