			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Retirement Equity for Pentagon
			 Police Heroes Act of 2011</short-title></quote>.</text>
		</section><section id="id5A4369BECFBE4CE0A8EFB6D8E03F97AC"><enum>2.</enum><header>Pentagon Force
			 Protection Agency</header>
			<subsection id="ID5e896227737541dfb6dd32f2163b8580"><enum>(a)</enum><header>Amendments
			 relating to the Civil Service Retirement System</header>
				<paragraph id="ID0cafe31dbb03483d8f7818207d99676c"><enum>(1)</enum><header>Definitions</header>
					<subparagraph id="ID21e3d3d5faf44c2d8a0217d173490483"><enum>(A)</enum><header>Civil Service
			 Retirement System</header><text>Section 8331 of title 5 United States Code is
			 amended—</text>
						<clause id="IDedf73a3a189d41f48a1abfbb2c16517f"><enum>(i)</enum><text>in
			 paragraph (30), by striking <quote>and</quote> at the end;</text>
						</clause><clause id="id0C71F3CDDF2A472D93AAE33ECEE68ECC"><enum>(ii)</enum><text>in
			 paragraph (31), by striking the period at the end and inserting <quote>;
			 and</quote>; and</text>
						</clause><clause id="ID6dc348546466438a968e108c40dd717b"><enum>(iii)</enum><text>by adding at
			 the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id18F10426E62C40F1B78A142C5D12D000" style="OLC">
								<paragraph id="ID264aa80bbae4492b81b8320d5d22cf98"><enum>(32)</enum><text><term>Pentagon
				Force Protection Agency officer</term> means an employee appointed to perform
				law enforcement and security functions under section 2674(b) of title 10 whose
				permanent duty station is the Pentagon Reservation and who occupies a position
				in job series 0083, or any successor position, for which the rate of basic pay
				is fixed in accordance with paragraph (2) of such
				section.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="ID6f4d41fec0af44cdb04688a7146a4166"><enum>(2)</enum><header>Deductions,
			 contributions, and deposits</header><text>Section 8334 of title 5, United
			 States Code, is amended—</text>
					<subparagraph id="id03C8460E285E40BB9BB71ABCC2BEB835"><enum>(A)</enum><text>in subsection
			 (a)(1)(A), by striking <quote>or customs and border protection officer,</quote>
			 and inserting <quote>customs and border protection officer, or Pentagon Force
			 Protection Agency officer,</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDae6ee45f7bf048cd92baced9e0e8d79b"><enum>(B)</enum><text display-inline="yes-display-inline">in the table contained in subsection (c),
			 by adding at the end the following:</text>

			 separation</header><text>Section 8835(b)(1) of title 5, United States Code, is
			 amended in the first sentence by striking <quote>or customs and border
			 protection officer</quote> and inserting <quote>customs and border protection
			 officer, or Pentagon Force Protection Agency officer</quote>.</text>
				</paragraph><paragraph id="ID022d155d931b49ffaff0a1758e112b56"><enum>(4)</enum><header>Immediate
			 retirement</header><text>Section 8336 of title 5, United States Code, is
			 amended—</text>
					<subparagraph id="IDdbf64be291ed4e7186b503cfb05b8b07"><enum>(A)</enum><text>in subsection
			 (c)(1), by striking <quote>or customs and border protection officer</quote> and
			 inserting <quote>customs and border protection officer, or Pentagon Force
			 Protection Agency officer</quote>; and</text>
					</subparagraph><subparagraph id="IDf1e19d82bd7142e78caa889863efbf8e"><enum>(B)</enum><text>in subsections
			 (m) and (n), by striking <quote>or as a customs and border protection
			 officer,</quote> and inserting <quote>as a customs and border protection
			 officer, or as a Pentagon Force Protection Agency officer,</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="ID5398b4c9e2bb4fb9ba9f1e670ec02844"><enum>(b)</enum><header>Amendments
			 relating to the Federal Employees’ Retirement System</header>
				<paragraph id="ID52f3d8f0ec39420bb8e9549199f4c458"><enum>(1)</enum><header>Definitions</header><text>Section
			 8401 of title 5, United States Code, is amended—</text>
					<subparagraph id="IDd49034d50e1442d5a38cc43d42590a87"><enum>(A)</enum><text>in paragraph
			 (35), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="id5024AFC8D5BC4224B1C119EC1DBF93A2"><enum>(B)</enum><text>in paragraph
			 (36), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="ID170ae6ae4e574d7a9453a7cd37527357"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

			 retirement</header><text>Paragraphs (1) and (2) of section 8412(d) of title 5,
			 United States Code, are amended by striking <quote>or customs and border
			 protection officer,</quote> and inserting <quote>customs and border protection
			 officer, or Pentagon Force Protection Agency officer,</quote>.</text>
				</paragraph><paragraph id="IDb6633ac784754b4583b81b5a8a5784ba"><enum>(3)</enum><header>Computation of
			 basic annuity</header><text>Section 8415(h)(2) of title 5, United States Code,
			 is amended by striking <quote>or customs and border protection officer</quote>
			 and inserting <quote>customs and border protection officer, or Pentagon Force
			 Protection Agency officer.</quote>.</text>
				</paragraph><paragraph id="ID02206ac1cf684ba18e7c6eb118cfc8a4"><enum>(4)</enum><header>Deductions from
			 pay</header><text>The table contained in section 8422(a)(3) of title 5, United
			 States Code, is amended by adding at the end the following:</text>

				</paragraph><paragraph id="ID4b4db57e10c146e8acb49174f7595ce3"><enum>(5)</enum><header>Government
			 contributions</header><text>Paragraphs (1)(B)(i) and (3) of section 8423(a) of
			 title 5, United States Code, are amended by inserting <quote>Pentagon Force
			 Protection Agency officers,</quote> after <quote>customs and border protection
			 officers,</quote> each place it appears.</text>
				</paragraph><paragraph id="ID3e968d39ea9141dea599f3d2eb99db5b"><enum>(6)</enum><header>Mandatory
			 separation</header><text>Section 8425(b)(1) of title 5, United States Code, is
			 amended—</text>
					<subparagraph id="ID954951d826b84dbab74e3ec08e881d0b"><enum>(A)</enum><text>by striking
			 <quote>or customs and border protection officers who</quote> and inserting
			 <quote>customs and border protection officer, or Pentagon Force Protection
			 Agency officers who</quote>; and</text>
					</subparagraph><subparagraph id="ID332a85911a1e42e3aac847b2cc6f355a"><enum>(B)</enum><text>by striking
			 <quote>or customs and border protection officer as the case</quote> and
			 inserting <quote>customs and border protection officer, or Pentagon Force
			 Protection Agency officer, as the case</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="ID799edbf427d14e18b0834c826fbbde03"><enum>(c)</enum><header>Maximum age for
			 original appointment</header><text>Section 3307 of title 5, United States Code,
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4C99DA1D193C445DA656E0D1A308CAFE" style="OLC">
					<subsection id="IDee337383032e4bb8bc5f1551370002bd"><enum>(h)</enum><text>The Secretary of
				Defense may determine and fix the maximum age limit for an original appointment
				to a position as a Pentagon Force Protection Agency officer, as defined by
				section
				8401(37).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID346f7fac10654fcd80d6eff0b6c0e7ef"><enum>(d)</enum><header>Regulations</header><text>Any
			 regulations necessary to carry out the amendments made by this section shall be
			 prescribed by the Director of the Office of Personnel Management, in
			 consultation with the Secretary of Defense.</text>
			</subsection><subsection id="ID318ca49881174a2fbc345b36b4d2ff89"><enum>(e)</enum><header>Effective Date;
			 transition rules</header>
				<paragraph id="ID5ce1f08cada84a2b8ace5d7a1fad975d"><enum>(1)</enum><header>Effective
			 date</header><text>The amendments made by this section shall become effective
			 on the first day of the first pay period beginning at least 6 months after the
			 date of the enactment of this Act.</text>
				</paragraph><paragraph id="IDb8f992f4d7094d658b243ce88bae7f12"><enum>(2)</enum><header>Transition
			 rules</header>
					<subparagraph id="ID2f8ddc0a791e4e5686778c6d4d19c164"><enum>(A)</enum><header>Nonapplicability
			 of mandatory separation provisions to certain individuals</header><text>The
			 amendments made by subsections (a)(3) and (b)(6), respectively, shall not apply
			 to an individual first appointed as a Pentagon Force Protection Agency officer
			 before the effective date under paragraph (1).</text>
					</subparagraph><subparagraph id="IDd6f27bfe856e418a984b13319907d066"><enum>(B)</enum><header>Treatment of
			 prior Pentagon Force Protection Agency officer service</header><text>Nothing in
			 this section or any amendment made by this section shall be considered to apply
			 with respect to any service performed as a Pentagon Force Protection Agency
			 officer before the effective date under paragraph (1).</text>
					</subparagraph><subparagraph id="ID649733beaa274c90a07605de4aea0be6"><enum>(C)</enum><header>Minimum annuity
			 amount</header><text>The annuity of an individual serving as a Pentagon Force
			 Protection Agency officer on the effective date under paragraph (1) pursuant to
			 an appointment made before that date shall, to the extent that its computation
			 is based on service rendered as a Pentagon Force Protection Agency officer on
			 or after that date, be at least equal to the amount that would be
			 payable—</text>
						<clause id="ID2b417101203f4766ac1d210172128b21"><enum>(i)</enum><text>to
			 the extent that such service is subject to the Civil Service Retirement System,
			 by applying section 8339(d) of title 5, United States Code, with respect to
			 such service; and</text>
						</clause><clause id="IDcf3a515ccf7b4727a9b4505aeb46b418"><enum>(ii)</enum><text>to
			 the extent that such service is subject to the Federal Employees’ Retirement
			 System, by applying section 8415(d) of title 5, United States Code, with
			 respect to such service.</text>
						</clause></subparagraph><subparagraph id="ID0ea6ab87b36b46258123560ee360d47f"><enum>(D)</enum><header>Rule of
			 construction</header><text>Nothing in the amendment made by subsection (c)
			 shall be considered to apply with respect to any appointment made before the
			 effective date under paragraph (1).</text>
					</subparagraph></paragraph><paragraph id="IDa0350a1ab2544dfd99699571e7fea7a9"><enum>(3)</enum><header>Definition</header><text>For
			 purposes of this subsection, the term <term>Pentagon Force Protection Agency
			 officer</term> has the meaning given such term by section 8331(32) or 8401(37)
			 of title 5, United States Code (as amended by this Act).</text>
				</paragraph><paragraph id="ID6abb5c972d5f4e34a9f89359c8c4603d"><enum>(4)</enum><header>Exclusion</header><text>Nothing
			 in this Act or any amendment made by this Act shall be considered to afford any
			 election or to otherwise apply with respect to any individual who, as of the
			 day before the date of the enactment of this Act—</text>
					<subparagraph id="IDe811c425014b412a8aafd9771e97daf1"><enum>(A)</enum><text>holds a position
			 within the Pentagon Force Protection Agency; and</text>
					</subparagraph><subparagraph id="IDd5a6afdb364948f0aeaef66bdc578787"><enum>(B)</enum><text>is considered a
			 law enforcement officer for purposes of subchapter III of chapter 83 or chapter
			 84 of title 5, United States Code, by virtue of such position.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
